F'INI)INGS OF FACT 1 The subject applications request a rezone of approxunately 12,100 square feet of property from the Light Industnal (I-2) zone to the Regional Business (B-3) zone, and a vanance from the frontage requuements of the B-3 zone, for development of the site for an existing use and those uses permitted in the B-3 zone 2 The site is generally located north of and adjacent to Third Avenue, at the northeast corner of the intersechon of Third Avenue and Koren Road, in the NE '/4 of Section 23, Township 25 North, Range 43 EWM, Spokane County, Washulgton 3 The site is currently referenced as a portion of County Assessor's tax parcel nos 35231 0704 The site is legally descnbed in the project file 4 The apphcant is Butch Luttrell, 1419 N' Thierman Road, Spokane, WA 99212 The legal owners of the site are Larry and Lois Hayden, 5603 E 3rd Avenue, Spokane, WA 99212 5 The Heanng Examiner heard the application pursuant to the County Heanng Examiner Ordinance (County Resolution No 96-0171) and the County Heanng Examiner Rules of Procedure (County Resoluhon No 96-0294) 6 The Hearing Exanuner conducted a site visit on March 26, 2003 A public heanng was held on the proposed rezone on March 26, 2003 The requirements for notice of pubhc heanng were met 7 The following persons testified at the public hearing Jun Falk, Division of Planrung Greg Baldwin, Division of Enguleeruig 1026 West Broadway 1026 West Broadway Spokane, WA 99260 Spokane, WA 99260 HE Findings, Conclusions and Decision ZE-1-03/VE-1-03 Page 1 . and the Uruform Building Code and Uruform Fue Code This includes Zoiung Code regulations for signage, landscaping and screerung, off-street parkulg and on-site illumination These and other apphcable Spokane County and Waslungton State development regulations will be used to rrutigate project impacts, as needed 16 Effective January 15, 2002, the County implemented a new comprehensive plan ("GMA Comprehensrve Plan"), Caprtal Facilities Plan, County Urban Growth Area (UGA) boundanes, and Phase I Development Regulations, all pursuant to the State Growth Management Act (GMA) The County also repealed the mtenm development regulations previously adopted by the County under the State Growth Management Act See County Resolution No 2-0037 Minor revisions were made to the Phase I Development Regulations on May 7, 2002 See County Resolution No 2-0470 17 The GMA Comprehensive Plan designates the site and neighbonng land to the north, east and west, between Interstate 90 and Sprague Avenue, m the Regional Commercial category of the Comprehensive Plan The Phase I Development Regulations retained the I-2 zoning of the site and such neighbonng land, and designated the site and area in the County UGA 18 The Phase I Development Regulations requue all zone reclassification applications to be consistent with the GMA Comprehensive Plan, and lunit such apphcations in the Regional Commercial category to the B-3 zone Such regulations modified the I-2 zone to permit some additional light industnal and commercial uses, but elimuiated the general allowance m such zone for the uses pernutted in the B-3 zone (subject to the development standards of the B-3 zone) 19 Interstate 90 is located immediately south of Third Avenue in the vicinity The I-90/Sprague Avenue/Fancher Avenue freeway interchange is located several hundred feet east of the site The site and other properties along Third Avenue west of the site are visible from Interstate 90 20 The Artenal Road Plan in the GMA Comprehensive Plan designates Third Avenue in tlle vicinrty as an Urban Muior Artenal, and Fancher Road and Sprague Avenue as Pnncipal Artenals Third Avenue is a 2-lane, one-way street, flowing east from its merger with Fancher Road to the east The other roads near the site are Urban Local Access streets 21 A new fi.irruture store is located directly west of the site, a large truck maintenance facility and closed state vehicle emission inspection center are located east of the site, and an equipment and materials storage facility, and other light and heavy industnal uses are located north of the site Light mdustnal and commercial uses are found along the north side of Tlvrd Avenue to the east and west Smgle-family homes are found north of Tlurd Avenue, east of Carnahan Road, approximately one-third mile east of the site The land fronting along Third Avenue m the area has been transitioTUng from light industnal to commercial and retail uses over the last few years, since the nearby interchange and Third Avenue were reconstructed Some B-3 zoning is found in the I-90 interchange area HE Findings, Conclusions and Decision ZE-1-03/VE-1-03 Page 3 0 1 i 30 Effecnve March 31, 2003, the site and neighbonxig land will become part of the City of Spokane Valley Based on the above findings of fact, the Heanrig Examiner enters the following 111. CONCL,LTSIONS OF LAW 1 Because of special cucumstances applicable to the property, stnct application of the road frontage requuement of Section 14 628 325 of the County Zorung Code creates practical difficulties and depnves the subject property of nghts and pnvileges enjoyed by other properhes in the vicuuty with sinular zonulg 2 As conditioned, granting of the vanance will neither be detnmental to the pubhc welfare nor injunous to the property or unprovements in the vicinity and zone in wluch the site is located 3 The proposed rezone and vanance, as conditioned, conform to the GMA Comprehensive Plan and Phase I Development Regulations 4 The proposal, aside from the requested vanance, complies with the B-3 zone and other applicable development regulations 5 The applicant has established that the proposed rezone, as condihoned, bears a substannal relahonship, and will not be detnmental, to the public health, safety or welfare 6 A change in economic, technological, or land use condihons has occurred to warrant the proposed rezone, as conditioned A substantial change of circumstances has occurred in the area since the site was last zoned 7 The proposed rezone, as conditioned, meets the cntena establlshed by Waslungton case law for approving a rezone, and the cntena established in paragraphs 14 402 020 (1)(2) of the County Zorung Code for amending the County official zorung map 8 The proposed vanance meets the cntena for approving a vanance listed m Chapter 14 404 of the County Zorung Code 9 The procedural requirements of the State Environmental Policy Act and the County's Local Environmental Ordinance have been met The proposal, as conditioned, will not have a sigruficant, probable adverse unpact on the environment 10 Approval of the rezone and vanance applications, as condihoned, is appropnate under section 11 of the County Hearmg Exanuner Ordmance, adopted by County Resolution No 96-0171 HE Findings, Conclusions and Decision ZE-1-03/VE-1-03 Page 5 ~ Title Notice shall generally provide as follows "The parcel of property legally descnbed as Eastwood Addihon (W/39) W110FT L3, W110FT ofNl/2 14 B7 is the subject of a land use achon by a Spokane County Heanng Exammer on March 28, 2003, approving a rezone and vanance and imposing a vanety of special development conditions File No ZE-1-03/VE-1-03 is available for inspechon and copying in the Spokane County Division of Planrung " SPOKANE COUN'I'Y BgJILDING ANI) COY)E ENFORCEMENT 1 The applicant should contact the Division of Building and Code Enforcement at the earliest possible stage in order to be informed of code requirements admuustered or enforced as authonzed by the State Building Code Act Design/development concerns include addressing, fire apparatus access roads, fire hydrant flow, approved water systems, building accessibility, construction type, occupancy classificahon, existmg extenor wall protection and energy code requirements SPOKANE DIVISION OF ENGgNEE1tING AIVI) ROAAI)S Pnor to release of a buildulg pernut or use of the property as proposed 1 The applicant shall dedicate the apphcable radius on Tlurd Avenue and Koren Road 2 Access pemuts for approaches to the County Road System shall be obtauled from the County Engineer 3 The County Engineer does not object to the proposed zone change for the conversion of the existing structure on the site plan of record to a retail sales and sernce shop for electnc and au tools along with compressors Review of the site plan of record indicates that there are no other changes to the structure or surrounding areas proposed The apphcant is advised that any future revisions to the structure or redevelopment of the site will be reviewed for consistency with adopted standards that include but are not limited to road unprovements, drainage and traffic 4 A parking plan and traffic circulation plan shall be subnutted and approved by the Spokane County Engineer The design, location and arrangement of parlcing stalls shall be in accordance with standard englneerulg practices Note Parkuig stalls shall be designed to assure Spokane County that back-up maneuvers onto county artenals vvill not occur from the facility 5 The County Engineer will issue a Concurrency Cernficate for the rezone under the County GMA Colnprehensive Plan and Phase I Development Regulations for twenty-four (24) PM peak hour tnps, for a 9200-square foot specialty retail center HE Findings, Conclusions and Decision ZE-1-03/VE-1-03 Page 7 0 ~ 5 The use of pnvate wells and water systems is prohibited WASHgNGTON STATE DEIPART1VIENT OF TRANSP0R'TATION 1 All signage for tlus site shall be in compliance with the Federal and State Sceruc Vistas Act DATED tlus 28th day of March, 2003 SPOKANE COUNTY HEARING EXAM][NER / 4 c 1Vlich el C Dempsey, WSB6V2 3NO'TICE OF FINAI. Third Ave in front of this site is currently owned by WSDOT but is scheCUled to be turned back to Spokane County. The County had given us this property in conjunction with our Sprague Ave. interchange for the construction of the new ramp and other features in this area. When our construction is complete we typically turn back to the County or City those portions we no longer need for our system. This instance is no exception as the turn back line extends across this property arid terminates about 160' to the east of the Koren right of way line. I talked with our traffic engineer, Ted Trepanier, yesterciay about this and his preference would be to let you folks deal with this one as you typically do.
