ACTION: This project is subject to a future public hearing. You will be receiving a Notice
of Hearing, which will be issued a minimum of fifteen (15) days prior to the public
hearing. A written report, including a staff analysis of the project and recommendation of
decision, will be available for inspection seven (7) calendar days prior to the public
hearing. Participation in the public hearing is encouraged. A copy of the Notice of
Decision issued by the Spokane County Hearing Examiner, which identifies the findings
of fact, conclusion, decision and appeal rights will be provided to those individuals who
testify at the public hearing and will be available to all others upon request.

The applicant proposes that Spokane County Division and Engineering and Roads
Condition # 8(a) and (b) be deleted and replaced with the proposed condition as stated
below:
"The applicant shall be responsible for improvements to Mission Avenue along the
project frontage. In addition, the applicant agrees to the following off site improvement:

Give a detailed explanation of request for change in status of the proposal:
The proposed change of condition request addresses conditions 8(a) and 8(b) of
Division of Engineering and Roads conditions from the Spokane County Hearinc,
Examiners Findings of Fact, Corlclusions a11d Decisioil, dated June 4, 1998.
The original condition required mitigation and ottsite improvements to the unpaved
segment (approximately 3,000 lineal feet) of Mission Avenue east of the project site. The
improvements included the application of a dust palliative on a yearly basis and the
design and construction of a 28 foot roadway section. Construction of the improvements
were to be completed prior to the 61 S` manufactured home being placed on the lot or prior
to October 1, 2001, no matter how many manufactured homes have been placed.
The applicant proposes to eliminate the requirement for application of a dust palliativ e tr>

The new proposed condition language requires the applicant to design and construct the
28-foot roadway section within five vears from the date of issuance of the first buildinc,
permit for placement of a manufactured home on the site. The condition also provides
flexibility for the applicant to contribute to an area wide road improvement plaii or rilakt
other improvements or contributions to satisfy the requirement should the subject
property or the segment of roadwav fall tmder the jtirisdiction of some other politir<<I
entitv.

1) Under the State Environmental Policy Act, mitigation measures ca.ii be 1111poti`cl upo►i
an applicant only to the extent attributable to the identified adverse impacts of its
proposal. In this case, the requirements to apply dust palliative and to design and
construct the roadway are intended to mitigate impacts to the un-paved section of
Mission Avenue resulting from project-generated vehicle traffic. Since there is little to no
project-generated traffic before the homes are actually placed and occupied, any
requirement to apply dust palliative or make off-site improvements prior to any actual
development taking place is inconsistent with this policy. When the condition was
imposed in 1998, it was not unreasonable to believe that the project would be well
underway by October 2001, with at least 60 homes placed and occupied. The project has
not, for various reasons, proceeded as fast as expected (some construction of undero-r-oliml
titilities has taken place htlt no hOmes have heen placeci). The pronoseci rham7e o f"
candition re-adjusts the time frame of the imprvwements sa that they will occur when
they are ac#ually needed based on the impacts vf the proposed development.
2) Mission Avenue is classified as a minar arterial and is currently used by many
residences and businesses in the a.rea. While the proposed project will add traffic ta the
unpaved segment vf 1Vlission, the most equitable method for construction of the
improvement would be through an area wide road improvement plan, such as the Harvaard
Road Mitigati4n Plan, where cantriiautions could be made an a pro-rata basis and would
be applied toward th+e ultimate improvement needed far the roadway, as opposed to a
temporary imprayement.
3} There have been ather projects approved in the vicinity, which wauld have similar
imgacts on Mission Avenue. Some of them (PE-1$7$-QalZE-31 -04) had nearly identical
requirements to thvse imposed far this proj ect, essentially putting completely separate
prajects an the hvok far the exact same improvement. Uthers projects have been
approved with no requirement for improvement to un-paved Mission Avenue.
4) The road section is in an area of un-incorporated 5pvkane County that is proposed far
annexation intra khe City vf Liberty Lake. The proposed gruject site is in an area that is
incorparating as part of the City of Spvkane Valley. The praposed condition language
provides the flexibility for these j urisdictians to have future input into the improvement
of Mission Avenue.

change from UR 3.5 to UR-7 to allow the development of a manufactured home park and those
