A paving waiver application was submitted to SCAPCA on October 31, 2000 by Terry & Kathy
Thompson, owners of Blue Iris Watergardens, located at 8003 E. Cataldo, Spokane, WA. The
application requests a waiver of certain paving requirements pursuant to the Spokane County
Zoning Code, Section 14.802.080, for a circular driveway and parking area to be used by the
home industry. SCAPCA does not have the authority to implement or enforce the Spokane
County Zoning Code related to paving (Section 14.802.080). However, before Spokane County
approves a project without paving, (i.e. grants a paving waiver), SCAPCA is consulted to review
the air quality impacts.
The business has been operating at the site for 5 years. According to the application, an
average of 2 employees and 2-3 customers use the driveway and parking lot per day. In the
summer months, as many as 8-10 customers visit the facility per day. Since the facility is a
home industry, it is located in a residential neighborhood. Therefore, there is the potential for
dust emissions from the facility to impact neighbors. The site is located inside the PM10 non -
attainment area. The proponent has not committed to any mitigating measures in lieu of paving
to control dust.
Recommendation
SCAPCA prefers that all traveled surfaces be paved in Spokane County for the protection of the
airshed. Portions of Spokane County are designated as nonattainment, for the federal air
quality health standards for fine particulate. The proposed facility is located inside the PM10
non -attainment area.

SCAPCA does not oppose the issuance of a paving waver, provided that crushed asphalt is
applied to all traveled surfaces on-site (e.g. circular driveway, parking area, etc.), and the
following conditions are met:
1. Recycled or crushed asphalt must be applied to all traveled surfaces on the site (e.g.
circular driveway, parking area, etc.). In addition, an appropriate dust palliative (i.e. lignin
sulfite or equivalent) or water may be required to minimize dust. The unpaved traveled
surfaces must be properly maintained to keep the surfaces free of dirt and mud. In order to
fulfill this requirement, the recycled/ crushed asphalt may need to be periodically re-applied.
2. Reasonable measures must be taken to prevent particulate matter from becoming airborne.
The deposition of particulate matter onto the property of others or beyond the property line
is prohibited.
If SCAPCA documents a violation of Regulation I, Section 6.04, "Odors and Nuisances,"
additional controls, which could include paving, may be required.
4. Failure to comply with any of the above conditions may result in additional controls, which
could include paving.
A paving waiver, in no way, exempts the facility from complying with SCAPCA regulations.
