FINDINGS OF FACT, CONCLUSIONS AND ORDER F E B 2 5 1994

INTRODUCTION
This matter has come before the Hearing Examiner Committee on February 24,
1994. The members of the Committee present are: Lunell Haught, Chair, Jan
Reuter and Frank Yuse.
PROPOSAL
The sponsor, Dick Baiter requests approval of a Zone Reclassification ZE-52-93,
from Light Industrial (I-2) to Heavy Industrial (I-3) for the purpose of tile
manufacturing and those uses allowed in the Heavy Industrial (I-3) zone.
FINDINGS OF FACT AND CONCLUSIONS
1. The property is generally located west of and adjacent to Dollar Road and south of
and adjacent to Utah Street and east of Eastern Road in Section 12, Township 25
North, Range 43 EWM, Spokane County, Washington.
2. The Committee adopts the Planning Department Report as a part of this record.
3. The existing land uses in the area include industrial storage, lumber yard, auto
wrecking, metal plating, airport, multiple family residences and a mobile home
pazk.
4. The proposed use is compatible with existing uses in the area.
5. The Comprehensive Plan designates this site as Industrial. The Industrial category
is intended to provide the opportunity for industrial development and reserve land
for industrial purposes. The Industrial category will be composed of a variety of
industrial, mining and transportation uses. Few commercial and residential uses
will be found. In some cases there will be open areas for buffering and screening
industrial activities from less intensive uses.
6. The proposed zoning dces implement and conform to the Comprehensive Plan. 7. The Arterial Road Plan designates Utah Avenue, Dollar Road and Eastern Road
fronting the site as Local Access Streets. In order to implement the Arterial Road
Plan, the County Engineer has requested dedicadon of a 15 foot wide strip along .
Eastern Road to be set aside as a future acquisition area. The existing right of way °
widths for Utah Avenue and Dollar Road are adequate to meet the requirements of
the Arterial Road Plan. !
8. The existing zoning of the property described in the application is Light Industrial
(I-2) previously established as Restricted Industrial (RI) zoning in 1956 a.nd

redesignated to Light Industrial (I-2) on January 1, 1991 pursuant to the Program to
Implement the Spokane County Zoning Code.
9. The provisions of RCW 43.21C (The State Environmental Policy Act) have been
complied with and a Deternunation of Nonsignificance (DNS) was issued. The
Committee, after independent review, hereby adopts the DNS.
10. The legal requirements for public notice have been fulfilled.
11. The owners of adjacent lands expressed approval nether approval nor disapproval
of the proposed use. .
12. The applicant has demonstc-ated that conditions have substantially changed since the
original zoning of this area and accordingly, the proposed zone reclassification is
justified. Changed cond.itions include additional industrial development in the area.
13. The proposed use will not be detrimental to the public health, safety, morals or
welfare especially in light of the conditions recommended by the reviewing
agencies.
CONDTTIONS OR CONTINGENCIES APPLIED TO THIS APPROVAL
1. All Conditions imposed by the Hearing Examiner Committee shall be bind.ing on
the "Applicant," which teim shall include the owner or owners of the propemy,
heirs, assigns, and successors-in-interest.
2. The following Conditions of Approval apply to the real property described below:
All of Lot 21; all of Lot 22, EXCEPT the west 20 feet thereof; and part of Tract 10,
lst Addition to Orchard Park, according to plat recorded in Volume "E" of Plats,
Page 47, in Spokane County, described as follows:
Beginning at the northeast corner of said Tract 10; south on the east line thereof,
110.65 feet; thence west on a line parallel with the south line of said tract, 467.5
feet, more or less, to a point 156 feet east of the west line thereof; thence north
parallel with the west line of said tract, 110.65 feet, more or less, to the north line
thereof; thence east 467.5 feet to the point of beginning; EXCEPT the west 10 feet
of that part of said Tract lO lying east of the west 156 feet of said Tract 10.
SPOKANE COUNTY PLANNING DEPARTMENT
1. The proposal shall comply with the Heavy Industrial (I-3) zone as amended.
2. The applicant shall develop subject property generally in accordance within the
concept presented to the Hearing Body. Variations, when approved by the
Planning Director/designee, may be pernutted, including, but not limited to building
location, landscape plans and general allowable uses of the permitted zone. All
variations must conform to regularions set forth in the Spokane County Zoning
Code, and the original intent of the development plans shall be maintained.

3. Approval is required by the Planning Director/designee of a specific lighting and
signing plan for the described property prior to the release of any building permits.
4. A specific landscape plan, planting schedule and provisions for maintenance
acceptable to the Planning Director/designee shall be submitted with a performance
bond for the project prior to release of building permits. Landscaping shall be
installed and maintained so that sight distance at access points is not obscured or
unpaired. Pursuant to the Spokane County Zoning Code Section 14.806.020
landscaping and screening requirements of Chapter 14.806 are not applicable.
Landscaping requirements associated with the parking areas are applicable to the
project accord.ing to Section 14.802.220. In add.ition, installation a 5 foot wide
strip of Type I landscaping is required along the southwest site boundary adjacent
to the adjoining apartment house and mobile home park property. The existing
chain link fence shall be slatted to provide an additional visual barrier adjacent to the
multiple family dwellings and mobile home park.
5. The Planning Deparnnent shall prepare and record with the Spokane County
Auditor a Tide Notice noting that the property in question is subject to a variety of
special conditions imposed as a result of approval of a land use action. This Title
Notice shall serve as public notice of the conditions of approval affecting the
property in question. The Tide Notice should be recorded within the same time
frame as allowed for an appeal and shall only be released, in full or in part, by the
Planning Department, The Title Notice shall generally provide as follows:
The parcel of property legally described as [ ] is the sub ject
of a land use action by a Spokane County Hearing Body or
Administrative Official on [ imposing a variety of
special development conditions. File No. [ ] is available for
inspection and copying in the Spokane County Planning Department.
6. A filed avigation easement satisfactory to the Felts Field Municipal Airport shall be
provided prior to the Planning Deparnnent's sign-off on a building permit
7. Paving of all traveled surfaces is required prior to issuance of an occupancy permit.
SPOKANE COUNTY DIVISION OF ENGINEERING
Prior to issuance of a building permit or at the request of the County Engineer in conjunction
with a County Road Project/Road Improvement District, whichever comes first:
1. Applicant shall dedicate 15 feet on Eastern Road for right-of-way.
Prior to release of building pemut or use of the property as proposed:
2. Access permits for approaches to the county road system shall be obtained from the
Spokane County Engineer.
3. The applicant shall submit for approval by the Spokane County Engineer road,
drainage and access plans.

4. A parking plan and tiraffic circulation plan shall be submitted and approved by the
Spokane County Engineer. The design, location and amangement of parking stalls
shall be in accordance with standard traffic engineering practices. Paving or
surfacing as approved by the County Engineer, will be required for any portion of
the project which is to be occupied or traveled by vehicles.
5. To construct the roadway irnprovements stated herein, the applicant may, with the
approval of the County Engineer, join in and be willing to parricipate in any
petidon or resolurion which purpose is the formation of a Road Improvement
District (RID) for said improvement, pursuant to RCW 36.88, as amended.
Spokane County will not participate in the cost of these improvements. This is
applicable to Utah S meet and Eastern Road.
6. As an alternative method of constructing the road improvements stated herein, the
applicant may, with the approval of the County Engineer, accomplish the road
improvements stated herein by joining and participating in a County Road Project
(CRP) to the extent of the required improvement. Spokane County will not
participate in the cost of these improvements. This is applicable to Utah Street and
Eastern Road.
7. The construction of the road improvements stated herein shall be accomplished as
approved by the Spokane County Engineer.
8. The County Engineer has designated Typical Roadway Section Number One Local
Access standard for the improvement of Dollar Street, which is adjacent to the
proposed development. This will require the addition of approximately 11- 13 feet
of asphalt along the frontage of the development. The construction of curbing and
sidewallc is also required.
9. The Counry Engineer has designated Typical Roadway Section Number One Local
Access standard for the improvement of Utah Street and Eastern Road, which is
adjacent to the proposed development. This will require the addition of
approxirnately 10 - 12 feet of asphalt along the frontage of the development The
construction of curbing and sidewalk is also required.
10. All required improvements shall conform to the cturent State of Washington
Standard Specifications for Road and Bridge Construction and other applicable
County standards and/or adopted resolutions pertaining to Road Standards and
Stoimwater Management in effect at the date of construction, unless otherwise
approved by the County Engineer.
11. Roadway standards, typical roadway sections and drainage plan requirements are
found in Spokane Board of County Commissioners Resolution No. 80-1592 as
amended and are applicable to this proposal.
12. No construction work shall be performed within the existing or proposed public
right-of-way until a permit has been issued by the County Engineer. All work
within the public road right-of-way is subject to inspection and approval by the
County Engineer.

13. All required construction within the existing or proposed public right-of-way is to
be completed prior to the release of a building permit, or a bond in an amount
estimated by the County Engineer to cover the cost of construction of improvements
shall be filed with the County Engineer.
14. Applicant shall sign and record Spokane County Notice to the Public No. 6 which
specifies the following:
The owner(s) or successor(s) in interest agree to authorize the County to place their
name(s) on a petition for the formation of a Road Improvement Distnct (RID) by
the petition method pursuant to Chapter 36.88 RCW, which petition includes the
owner(s) progerty, and further not to object, by the signing of a ballot, the
formation of a RID by the resolution method pursuant to Chapter 36.88 RCW,
which resolution includes the owner(s) property. If an RID is formed by either the
petition or resolution method, as provided for in Chapter 36.88 RCW, the owner(s)
or successor(s) further agree:
(a) that the improvement or construction contemplated within the proposed RID is
feasible;
(b) that the benefits to be derived from the formation of the RID by the property
included therein, together with the amount of any County participation,
exceeds the cost and expense of fonnation of the RID; and
(c) that the property within the proposed RID is sufficiently developed.
Provided further that the owner(s) or successor(s) shall retain the right, as
authorized under RCW 36.88.090, to object to any assessment on the property as a
result of the improvements called for in conjunction with the fomlation of the RID
by either petition or resolution method under Chapter 36.88 RCW.
T'his requirement applies to Utah Street and Eastern Road, from which the subject
parcel takes access.
15. There may exist utilities, either underground or overhead, affecting the subject
property, including property to be dedicated or set aside for future acquisition.
Spokane County assumes no financial obligation for adjustments or relocation
regarding these utilities. Applicant(s) should check with the applicable utility
purveyor and the Spokane County Engineer to determine whether applicant(s) or
the urility is responsible for adjustment or relocation costs and to make
arrangements for any necessary work.
SPOKANE COUNTY DIVISION OF UTILITIES
1. Any water service for this project shall be provided in accordance with the
Coordinated Water System Plan for Spokane County, as amended.
2. This project lies within the City of Spokane Sewer Service Area and the applicant is
required to contact this sewer utility and comply with the utility's specifications,
standards and practice.

SPOKANE COUNTY HEALTH DISTRICT
1. Sewage disposal method shall be as authorized by the City of Spokane.
2. Water service shall be coordinated through the City of Spokane.
3. Water service shall be by an existing public water supply when approved by the
Regional Engineer (Spokane), State Department of Health.
4. A public sewer system will be made available for the project, and individual service
will be provided to each lot/tract prior to sale. Use of individual on-site sewage
disposal systems shall not be authorized.
5. Use of private wells and water systems is prohibited.
SPOKANE COUNTY AIR POLLUTION CONTROL AUTHORITY
1. All air pollution regulations must be met.
2. Air pollution regulations require that dust emissions during demolition, construction
and excavation projects be controlled. This may require use of water sprays, tarps,
sprinklers or suspension of activity during certain weather conditions. Haul roads
should be treated, and emissions from the transfer of earthen material must be
controlled, as well as emissions from all other construction-related acriviries.
3. Measures must be taken to avoid the deposition of dirt and mud from unpaved
surfaces onto paved surfaces. If tracking or spills occur on paved surfaces,
measures must be taken immediately to clean these surfaces.
4. All traveled surfaces (ingress, egress, parking areas, access roads) must be paved
and kept clean.
5. SCAPCA Regulation I, Article V, requires that a Notice of Construction and
Application for Approval be submitted to and approved by our agency prior to the
construction, installation or establishment of an air pollution source. This facility
will need an approved Noace of Construction prior to commencing construction.
Because the Notice of Construction process can be lengthy, the proponent is
encouraged to apply as soon as possible. Please contact Chuck Studer at SCAPCA

described in the application ZE-52-93.

Location: Generally located west of and adjacent to Dollar Road and south of and
adjacent to Utah Street and east of Eastern Road in Section 12, Township 25 North,
Range 43 EWM, Spokane County, Washington.
Proposal: Zone Reclassification from Light Industrial (I-2) to Heavy Industrial
(I-3) for the purpose of tile manufacturing and those uses allowed in the Heavy
Industrial (I-3) zone.
II. STTE INFORMATION
A. Site Size: 7.2 acres.
B. Comprehensive Plan
1. Land Use Plan: The property is located within the Industrial category
of the Comprehensive Plan. The Indusa-ial category is intended to
provide the opportunity for industrial development and reserve land for
industrial purposes. The Industrial category will be composed of a
variety of industrial, mining and transportation uses. Few commercial
and residential uses will be found. In some cases there will be open
areas far buffering and screening industrial activicies firom less intensive
uses.

2. Arterial Road Plan: The subject prroperty fFants on Eastem Road,
L7►ollu Road and tJtah Street. All of tFtese roads are designated as Local
A.ccess Sueets by th+e Arterial Road F'lan. With the exception ~f Eastern
Road, the existing iight of way widths uc adequate to rrleet the
re.cnmmendations of the Arterial Road Piannp The County Engineer has
required that a strip of 1and 15 feet in width be dedicated for right of
way along the site's Eastezn Road fiontage.
Rutter Avenue,1occated approxirnately 200 feet nvrth of the sit+e, is
designated as a Minorr Arterial by the Arterial Road Plan.
C. Site Characteristics: The site is developed with 104,700 square feet of
industrial bui]ding space in thme buildings. A11 of the badings are cunently
v~cant. There is a railroarl spur locate.d on the western gortion vf the site.

E. T.oning Analysis: The site and alI surraunding property was zoned
Restiictted IndusaW (M in 1956 (ZE-203-56). The site and surraunding
proPerty was redesignated to the Light Industrial. (I-2) zone when the ,5poka.ne
County Zaning Gode was fully implementecl in 199 1.

manufacturing, proeessing, fabricafiion, assembly, frei,ght handling and
similar ogerations except mining subject to performance standards for noise,
air emissivns, odor, sewage ciisprosal, firre, explosionj stvrage, he-at and glare.
The proposed Heavy Industrial (1-3) zane allaws the widest ran,ge of
industrial operanons of any zone. Developrnent standards vsohich addres~
landscap'mg, buildir~~ setback, scaceening of sto~~e areas, n~ise, ~lare, heat,
and air gollution are provided in the H.eavy Industrial z4ne to mim'mize

I. Drainage: A drainage plan for the site is required by the County Engineer.
The proposal is inside the Aquifer Sensitive Area Overlay zone. Therefore,
"208" storm drainage requirements must be met.
J. Water Supply: The proposal is provided with water by the City of
Spokane.
K. Sewage Disposal: Public sewer is required for the site. Sewer lines
provided by the City of Spokane are located north of the site in Rutter
Avenue.
L. School: The proposal is in the West Valley School District No. 363. The
school district has been notified of the proposal. No comments were
received.
M. Fire Protection: The proposa] is within Fire District No. 1. The Fire
District and tfie Division of Buildings Deparanent (Fire Marshall) are required
to approve fire protection provisions prior to issuance of building pern-~its.

An Environmental Checklist was submitted by the sponsor and was reviewed by the
County Planning Deparnnent. The review considered che specifics of the proposal,

County policies and guidelines. The Planning Deparament has determined that "No
probable significant adverse impacts" would result from the proposal being developed
and has issued a I?etennination of Nonsignificance ("DNS").
The "DNS" was circulated to 13 other agencies of jurisdicdon and other
agencie$/departnzents affected by the future develapment for review and commenL
The "DNS" comment period ends Fcbruary 22, 1994 and was advertised 15 calendar
days befare said date in the newspaper, by letter to adjacent pmperty owners within
400 feet of the proposal, and by notice on a sign posted on the proposal site. The
Hearing Examiner may consider additional environmental related tesrimny at the
public hearing.
IV. PLAN1vING DEPARTMENT SUMMARY AND RECOMMENDATION
The proposal is located in the Industrrial category of the Comprehensive Plan. The
proposed zoning is generally in confomance with the Goals, Objectives and
Decision Guidelines of the Industrial category when considering the industrial
nature of most adjacent land uses and prnposed landscape buffering of the
residential use southwest of the proposal, the zone reclassification should not
adversely affect adjacent properties.

The proposal makes provisions for public sewer, water and roads and meets
applicable design standards of the Heavy Industrial (I-3) zone. The Planning
Department recommends approval as conditioned.
V. CONDITIONS OF APPROVAL
i. Alt conditions imposed by the Hearing Examiner Committee
shall be binding on the "Applicant", which terms shall include
the owner or owners of the property, heirs, assigns and
successors.

more or less, to the north line thereof; thence east 467.5 feet to the point of

SPOKANE COUNTY PLANNING DEPARTMENT
1. The proposal shall comply with the Heavy Industrial (I-3) zone as amended.
2. The applicant shall develop subject property generally in accordance within the
concept presented to the Hearing Body. Variations, when approved by the
Planning Director/designee, may be permitted, including, but not Fmited to building
location, landscape plans and general allowable uses of the pennitted zone. All
variations must confarm to regulations set forth in the Spokane County Zoning
Code, and the original intent of the developrnent plans shall be maintained.
3. Approval is required by the Planning Director/designee of a specific lighting and
signing plan for the described property prior to the release of any building pernuts.
4. A specific landscape plan, planting schedule and pnovisions for maintenance
acceptable to the Planning Directar/designee shall be submitted with a perfomnance
bond for the project prior tio release of building penruts. Landscaping shall be
installed and maintained so that sight distance at access points is not obscured or
impaired. Pursuant to Spokane County Zoning Code Section 14.806.020
landscaping and screening requirements of Chapter 14.806 ar+e not applicable.
Landscaping requirements associated with the pariQng areas are applicable to the
project according to Section 14.802.220. In addition, a strip of Type I
landscaping, 20 feet wide, is required along the southwest site boundary adjacent to
the adjoining apartment house and mobile home park property.

5. The Planning Depanment shall prepare and record with the Spokane County
Audimr a Title Notice noting that the property in question is subject to a variety af

4. A public sewer system will be made available for the project, and individual service
will be provided to each lot/tract prior to sale. Use of individual on-site sewage
disposal systems shall not be authorized.

SPOKANE COUNTY AIR POLLUTION CONTROL AUTHORITY
1. All air polludon regulations must be met.
2. Air pollution regulations require that dust emissions during demolition, construction
and excavation projects be controlled. This may require use of water sprays, tarps,
sprinklers or suspension of activity during certain weather conditions. Haul roads
should be meated, and emissions from thc transfer of earthen material must be
controlled, as well as emissions from all other construction-related activities.
3. Measures must be taken to awid the deposition of dirt and mud from unpaved
surfaces onto paved surfaces. If tracking or spills occur oo paved surfaces,
measures must be taken immediately to clean these surfaces.
4. All traveled surfaces (ingress, egress, parking areas, access roads) must be paved
and kept clean.
5. SC'APCA Regulation I, Article V, requires that a Notice of Construction and
Application for Approval be submitted to and approvcd by our agency prior to the
construction, installation or establishment of an air pollution source. 'Ihis facility
will need an approverl Notice of Construction prior to commencing construction.
