ZE-111A-84 ~ L BEFORE THE BOA12D OF COUNTY COMMI SSI ONERS OF SPOKANE COUNTY, WASH I NGTON IN ~NE-MATT~ER OF CHANGE OF CONUITION ) FINDINGS OF FACT, DECISION ~ flELETION OF CONDITIONS OF ) AND CONDITIONS OPMROWVALr REQUIRING L4CAL BUSINESS ) SIGNAGE IN RESTRICTED INDUSTRIAL ZONE, ) T D PARTNERSN IP ) THIS MATTER, Being the consideration by the Board of County Corr~nissioners of Spokane County, hereinafter referred to as the "Board" of an appeal of Spokane County Zoning Hearing Examiner Committee Decision of August l, 1985, denying a cnange of conditions (ZE-111A-84), Deletion of Planning Departinent Condition #6 of file ZE-111-84 wF»ch required compliance with Local Business sign standards within a Restricted Industrial zone for the purpose of erecting billboard signs without any otiier use of the site, hereinafter referred to as the "Proposal", and the Board of County Commissioners of Spokane County having held a public nearing on September 17, 1985, and having fully considered all testimony presented thereat, and further having individually visited with the site and vicinity in question, and haviny rendered a decision on the 8th day of October, 1985, denying in part the appeal and approving a modified proposal, does hereby make the following FINDINGS 0F FACT 1 That the proposal is generally located at the southwest corner of Park Road and Broadway Adenue in Section 13-25-43 2 That tne proposal consists of deleting +'lanning Department Condition #o from file ZE-111-84 which required compliance with Local Business sign standards as stated in Section 4 09 125 of the Spokane County Zoning Ordinance Deletion was requested, in part, to allow billboards to be erected on the property without any otner use on tne property 3 Tnat tne adopted Spokane County Generalized Comprehensive Land Use ►'lan designates this area as Industrial witri an Urban designation adjoining to the norto of Broadway Avenue Due to this situation, the site is within a transitional zone, as defined by the Comprehensive Plan, wrich may require special mitigating measures on proposals in order to ensure land use compati bi 1 i ty 4 That the provisions of ROW Chapter 43 21C, (State Environmental Policy Act) were complied with in conjunction with ZE-111-84, and this proposal does not change the environmental analysis [WAC 191-11-600(2)] 5 That the Spofcane County Hearing Examiner Committee neld a public hearing on August 1, 1985, concerning the proposal, subsequent to which by Findings of Fact, Decision and Order dated August 1, 1985, they denied the proposal 6 That tne existing land uses in the area of proposal include residential, comnercial, mining, and undeve1oped open area 7 That the proposal can be modified and mitigated to be compatible with existing uses in the area 8 That the proposal, if modified and mitigated, would not be detrimental or otherwise harmful to the public health, safety and welfare 9 That a modified proposal is not totally inconsistent with the surrounding land use classifications and would not necessarily grant a special privilege or right to tne applicant different than those enjoyed by adjacent property owners 10 That the proper legal requirements for advertising of the hearing before the Board of County Commissioners of Spokane County have been inet 11 That on the 8th day of October, 1985, the Board of County Commissioners of Spokane County at a regular meeting did deny, in part, the appeal of the applicant and did approve a modified proposal subject to certain conditions . • ~F~~~ FINDINGS OF FAI,T, DECISION AND CONDITIOIdS ZE-111A-84 2 From the foregoing Findings, a review of the Planning Department Staff Report dated August l, 1985, review of tfie Hearing Examiner Committee's Findings and Order dated August 1, 1985, and the Staff presentation of File No ZE-111A-84, the Board hereby denyiny, in part, the appeal and approving a modified proposal does malce the following conditions 1 That Planning Departjrient condition #6 contained in Hearing Examiner Committee's findings and order for file ZE-111-84 dated April 4, 1985, be modified to allow one freestanding, unipole outdoor advertising structure Maximum overall sign neight shall be 20 feet, and maximum sign face shall be 6 f2et by 12 feet on each of the two sides All other provisions of Condition #6 (Local Business sign standards of the Spokane County Zoniny Ordinance, Section 4 09 125) will continue in effect for future development and related signage on tnis site 2 That upon development of a use on this site, the outdoor advertising structure allowed by Condition #1 above shall be removed and eliminated froin the site No outdoor advertising structure (billboard) will be allowed on the site when a specific use is developed 3 TNAT ALL OTHER CONDITIONS Oh FILE ZE-111-84 SHALL CONTINUE IN EFFECT FOR THIS SITE _,en,,4j/ DATED This ,Z V4 day of 7 , 1985 BOARD OF COUNTY COMMISSIONERS OF SPOKANE C OUNTY , WASH I NGTON ~ W.9-12m C. f ~ -
