This matter has come before the Heanng Examiner Comnuttee on June 23, 1994
The members of the Committee present are Jan Reuter, Chaix, Jane Myers and
Harry Gibbons
PROPOSAL
The sponsor, Doug Lydig requests approval of a Zone Reclassif'ica i+~ •
from Light Indusmal (I-2) to Regional Business (B-3) for an indoo s orts arena and
those uses pernutted in the Regional Business (B 3) zone with Vanances, VE-16-94
for building height (65' where 35 /60 is permitted) and VE-17 94 road frontage (no
artenal road frontage)
FINDINGS OF FACT AND CONCLUSIONS
1 The property is generally located north of Interstate 90 northeast of Cataldo
Avenue and south of Boone Avenue (extended) m Section 13, Township 25 North
Range 43 EWM, Spokane County, Washington
2 The Comrmttee adopts the Planning Department Report as a part of this record
3 The existing land uses in the area include single family resldennal wholesale sales
industnal sales and sernce, distnbution center and Interstate 90
4 The proposed use is compatible with existing uses in the area
5 The Comprehensive Plan designates thls site as Urban The Urban category is
intended to provide the opportunity for development of a city like envuonment
which includes vanous land uses Intensive residenaal, public facilities and public
service are typical of this category The residenrial density ranges from 1 unit per
acre to 17 units per acre The proposed zone reclassificanon to Regional Business
(B-3) is consistent with the goals and objecnves of the Urban Category and the
proposed zone reclassificanon is also conslstent with the "transinon policy" of the
Comprehensive Plan where fnnge areas located between two categones may allow
development complying with either category
6 The proposed zomng does unplement and conform to the Comprehensive Plan
7 The Artenal Road Plan deslgnates Cataldo Avenue as a Local Access Street
8 The existing zoning of the property descnbed in the application is Light Industnal
(I-2) previously established as Restncted Industnal zoning in 1977 and
redesignated to Light Indusmal (12) on January 1 1991 pursuant to the Program to
Implement the Spokane County Zoning Code The proposal does conform to the
requirements of the proposed zone
9 The provisions of RCW 43 21C (The State Envu-onmental Policy Act) have been
comphed with and a Determinanon of Nonsignificance (DNS) was issued The
Comrnittee after independent review, hereby adopts the DNS
10 The legal requirements for pubhc notice have been fulfilled
11 The owners of adjacent lands expressed approval of the proposed use and dhd not
object to the proposed building height
12 The applicant has demonstrated that conditions have substanaally changed since the
ongmal zorung of thls area and accordingly, the proposed zone reclassificaaon is
jusnfied Specifically, changed conditlons include development of an indusmal
park adjacent to the west, and adoption of the Spokane County Comprehensive
Plan
13 The proposed use will not be detnmental to the pubhc health, safery morals or
welfare especially in light of the cond.itions recommended by the reviewnng
agencies
14 The Committee additionally finds
a The proposed zone reclassif'icaaon will not have a detnmental unpact upon the
adjoining properties and the proposed recreational facility will improve the
neighborhood
b That the Spokane County Planning Department, as directed by the Heanng
Examiner Committee should consider amending the Spokane County Zoning
Code so that those uses allowed in the Buslness Mamx are also allowed in the
Industnal Matnx
c The proposed vanances from the maximum bullding height and minimum
frontage requirements of the Regional Business (B 3) zone are appropnate
given the site s proximity to Interstate-90 adJacent industnal development,
compatibility with adjacent land uses and support of the proposal by adjoining
property owners
CONDITIONS OR CONTINGENCIES APPLIED TU THIS APPROVAL
1 All Condhtions imposed by the Heanng Examiner Comrmttee shall be binding on
the Apphcant which term shall lnclude the owner or owners of the property
heus, assigns, and successors-in-interest
2 The following Condltions of Approval apply to the real property descnbed below
A tract of land located in the northeast quarter of Section 13 Township 25 North
Range 43 East of the Willamette Mendlan, Spokane County, Washington being a
pornon of vacated Coleman Road vacated Boone Avenue vacated Cataldo Avenue,
and a pornon of Block 8 of the Fust Addition to East Spokane Addiaon and the vacated
alley in said Block 8 being descnbed as follows
Commencing at the intersection of the centerline of vacated Coleman Road and the
centerline of vacated Boone Avenue the northwest corner of that tract of land shown

on Record of Survey recorded in Book 47 of Surveys Page 57 in the Spokane County
Auditor s Office the True Point of Beginnrng, thence South 89 27 29 East along the
centerline of vacated Boone Avenue a distance of 298 16 feet to the projected westerly
line of Lfly Road the northeast corner of said tract shown on Record of Survey Book
47, Page 57 thence South 00 47'54 East along the westerly line of Lily Road and said
line projected 263 94 feet thence South 57 3818 West along a hne parallel with the
northwesterly nght-of-way of U S Interstate Highway No 90 to an intersection with
the easterly line of vacated Coleman Road, thence South 00 06 30 East along the
easterly line of vacated Coleman Road to a point on a line parallel with and 100 feet
northwesterly of the northwesterly nght of-way of U S Interstate Highway No 90
said point shown on said tract Shown on Record of Survey Book 47, Page 57, thence
South 57 38 18 West along sa.id line parallel with the northwesterly nght of-way of
U S Interstate Fhghway No 90, 35 47 feet to the centerline of vacated Coleman Road,
the southwest corner of sald tract shown on Record of Survey Book 47, Page 57,
thence North 00 06 30' West along the centerline of vacated Coleman Road, 680 34
feet to the True Point of Beginning
SPOKANE COUNTY PLANNING DEPARTMENT
1 Development of the site shall comply with the Regional Business (B-3) zone and
Aquifer Sensitive Area (ASA) Overlay zone as amended The Vanance to exceed
the 35 height lirrut in the Regional Bus1ness (B 3) zone (VE-16 94) and construct a
buildbng to 65 feet is approved The Vanance for inadequate artenal road frontage
(VE-17-94) is approved
2 The applicant shall develop subject property in smct conformance with the site plan
presented to the Heanng Body on June 23, 1994 All aspects of the concept and
proposal shall be binding on the development, including proposed use Vanations
to be approved by the Planning Dlrector/designee shall only be allowed to meet
regulaaon standards and conditions of approval Any other modification must be
presented to the Heanng Body for revlew and approval
3 Approval is required by the Planning Director/designee of a specific lighting and
signing plan for the descnbed property pnor to the release of any building permits
Note The site is restricted to one (1) on-premise advertising display
not to exceed 150 square feet in area Signs shalt not be oriented
towards the residential uses located east and north of the site Written
approval of the WSDOT is required for signs oriented to I-90
4 A specific landscape plan, planting schedule and provisions for maintenance
acceptable to the Planning Director/designee shall be subrrutted with a performance
bond for the project pnor to release of building permits Landscaping shall be
installed and maintained so that sight distance at access points ls not obscured or
impaired
5 Duect light from any extenor area lighhng fixture shall not extend over the property
boundary
6 The Planning Department shall prepare and record wnth the Spokane County
Auditor a Tltle Notice nonng that the property in question is subject to a vanety of
speclal conditions imposed as a result of approval of a land use acnon This Title
Notice shall serve as public notlce of the conditions of approval affecting the
property in quesaon The Title Noace should be recorded within the same time

frame as allowed for an appeal and shall only be released in full or in part, by the
Planning Department The Title Nonce shall generally provide as follows

SPOKANE COUNTY DIVISION OF ENGINEERING AND ROADS
Pnor To Issuance Of A BuildlnLy Permit Or Use Of The Pronertv As Pronosed
1 Access pernuts for approaches to the county road system shall be obtained from the
Spokane County Engineer
2 The applicant shall submit for approval by the Spokane County Engineer and the
Spokane County Health Distnct a detailed combined on site sewage system plan
and surface water disposal plan for the ennre project or pornon thereof, Lf the
development is to be phased
3 A parking plan and traffic circulation plan shall be submitted and approved by the
Spokane County Engineer The design location and arrangement of parking stalls
shall be in accordance with standard traffic engineenng practices Paving or
surfacing as approved by the County Engineer, will be requued for any portion of
the project whlch is to be occupled or traveled by vehicles
4 To construct the roadway improvements stated herein, the apphcant may with the
approval of the County Engineer join in and be wilhng to participate in any
petinon or resolution which purpose is the formation of a Road Improvement
Distnct (RID) for said improvement pursuant to RCW 36 88 as amended
Spokane County will not parncipate in the cost of these improvements This is
applicable to Cataldo Avenue
5 As an alternative method of constructing the road improvements stated herein, the
applicant may with the approval of the County Engineer, accomplish the road
improvements stated herein by joining and parncipating in a County Road Project
(CRP) to the extent of the required improvement Spokane County will not
parncipate in the c,ost of these lmprovements This ls applicable to Cataldo Avenue
6 The construction of the road improvements stated herein shall be accomplished as
approved by the Spokane County Englneer
7 1'he County Engineer has designated Typical Roadway Section Number One Local
Access standard for the improvement of Cataldo Avenue which serves the
proposed development This will require the addinon of varying amounts of
asphalt along the frontage of the development The constructlon of curbing and
sidewalk is also required
9 All requued improvements shall conform to the current State of Washington
Standard Specifications for Road and Bndge Construction and other applicable
County standards and/or adopted resolutions pertalning to Road Standards and

Stormwater Management in effect at the date of construcaon unless otherwise
approved by the County Engineer
10 Applicant shall construct a paved and delineated approach to meet the existing
pavement on Cataldo Avenue
411 Access to Lily Avenue shall be prohibited unal such time as specif'ically authonzed
by the Spokane County Engineer
12 Roadway standards, typical roadway sections and drainage plan requu-ements are
found in Spokane Boaxd of County Comrrussioners Resolunon No 80-1592 as
amended and are apphcable to this proposal
13 No construcaon work shall be performed within the existing or proposed public
nght-of-way until a permit has been issued by the County Engineer All work
within the public road nght-of-way is subject to inspection and approval by the
County Engineer
14 The applicant has proposeti that an emergency vehicle access point be located at the
intersecaon of Boone Avenue and Lily Road The applicant shall provide
documentation to the sahsfaction of the County Engineer that only emergency vehicles,
and not the general public, will use the point of access
The applicant shall also provide to the County Engineer wntten documentation from the
fire distnct approving the proposed method of emergency access The County
Engineer shall also grant approval of the proposed method of access
SPOKANE COUNTY HEALTH DISTRICT
1 A combuled surface water and sewage disposal detailed plan shall be approveti by
the Spokane County Engineer and Spokane County Health Dismct pnor to the
lssuance of any on slte sewage dlsposal pernut or building pernut for this project
2 Sewage disposal method shall be as authonzed by the Duector of Utilitles Spokane
County
3 Water service shall be coordlnated through the Director of Utilities Spokane
County
4 Water service shall be by an exisang public water supply when approved by the
Regional Engineer (Spokane), State Depa.rtment of Health
5 Disposal of sewage effluent beneath paved surfaces is currently prohiblted
6 Subject to specific applicanon approval and issuance of pernuts by the health
officer the use of individual on-slte Sewage disposal systems may be authonzed
7 Use of pnvate wells and water systems ls prohiblted

SPOKANE COUNTY DIVISION OF UTILITIES
1 Any water service for this project shall be provided in accordance with the
Coordinated Water System Plan for Spokane County, as amended
2 Pursuant to the Board of County Comrrussioners Resolution No 80-0418, the use
of on-site sewer disposal systems is hereby authonzed This authonzation is
cond.iaoned in comphance wrth all rules and regulations of the Spokane County
Health Distnct and is further condhtioned and subject to specific application
approval and issuance of pernuts by the Health Distnct.
3 The owner(s) or successor(s) in interest agree to authonze the County to place theu
name(s) on a petition for the formation of ULID by peanon method pursuant to
RCW 36 94, which petition includes the owner(s)' property, and further not to
object by the sigrung of a protest petition against the formation of a ULID by
resolution method pursuant to RCW Chapter 36 94 which includes the owner(s)'
property PROVIDED, this condlhon shall not prohibit the owner(s) or
successor(s) from objecting to any assessment(s) on the property as a result of
unprovements called for in conjuncnon with the formation of a ULID by either
petition or resolunon under RCW Chapter 36 94
4 Each new urut shall be double-plumbed for connection to future areawide collection
systems
SPOKANE COUNTY AIR POLLUTION CONTROL AUTHORITY
1 All air pollution regulations must be met This includes but is not llmited to the
following
2 Au pollution regulaaons require that dust emissions dunng demolition, construcaon
and excavaaon projects be controlled This may requue use of water sprays, tarps,
spnnklers or suspension of acnvity dunng certain weather conditions Haul roads
should be treated, and enussions from the transfer of earthen matenal must be
controlled as well as enussions from a11 other construction-related activines
3 All traveled surfaces (ingress, egress, parlang areas, access roads) must be paved
and kept clean to rrunirruze dust emissions
4 Measures must be taken to avoid the deposition of dirt and mud from unpaved
surfaces onto paved surfaces If trackuig or spills occur on paved surfaces,
measures must be taken immediately to clean these surfaces
5 Debns generated as a result of this project must be disposed of by means other than
burning (i e, construction waste, etc )
6 SCAPCA Regulation I, Article V requues that a Notice of Construchon and
Application for Approval be subnutted to and approved by our Agency pnor to the
construction, installation or estabhshment of air polluhon source

The Heanng Exanuner Committee pursuant to the above Fmdings of Fact and
Conclusion, APPROVES the application of Doug Lydig for the Zone
Reclassification from Light Industnal (I-2) to Regional Business (B-3) for an
indoor sports arena and those uses permitted in the Regional Business (B-3) zone
with Vanances for bu:ddng height (65' where 35760' is perrmtted) and road
frontage (no artenal road frontage) as descnbed m the application ZE-18-94,
VE-16-94, VE-17-94

Plan category The Urban category is intended to provide the opportunity for
development of a ciry-like envuonment which includes vanous land uses
Intensive residential pubhc facihnes and public sernce are typical of this
category The residential density ranges from 1 unit per acre to 17 uruts per
acre The proposed zone reclassif'icaaon to Regional Business (B-3) is
inconsistent wnth the goals and objecnves of the Urban Category and also the
intent of Chapter 36 70 of the Revised Code of Washington where development
regulations must be consistent wnth the adopted Comprehensive Plan

2 Arterial Road Plan The Spokane County Artenal Road Plan does not
identify artenal roadways adjacent to the slte and the progosed use would be
served by Cataldo Avenue which is designated a Local Access street
C Site Characteristics The site contains an existing metal storage building which
will be removed.
D Neighborhood Characteristics The neighborhoods to the east and north are
residential Uses to the west are indusmal Interstate 90 is located south of the site
E Zoning Analysis The site is currently zoned Light Industnal (I-2) Pnor to the
county-wide zoning redesignanon the site was zoned Restncted Industnal
(ZE-66-77C) under the, now expued Spokane County Zonulg Ordinance
Surroundulg areas are zoned Light Industnal (I-2) and UR-3 5 consistent with
past zomng approvals and the Program to Implement the Spokane County Zoning
Code implemented on January 1, 1991 The proposed zone reclassification is a
sigruficant intrusion on an existing single family neighborhood. There has been
no recent zorung activity in the sunoundulg area The requested zone
classif'ication could be consldered mappropnate due to inconsistency with the
existing area land uses and the guidelines of the Comprehensive Plan
Proposal Light Industnal (I-2) estabhshed in 1991 to Regional Business (B 3)
North Urban Residential-3 5(UR-3 5) estabhshed in 1991
South Light Indusmal (I-2) estabhshed in 1991

F Variance Analysis The apphcant is aslang for a relaxanon of Zoning Code
standards for height ( Chapter 14 628 335) and artenal road frontage (Chapter
14 628 315 ) under the Regional Business (B-3) zone Structure height within
the Regional Business (B-3) zone is hnuted to 60 feet unless within 150 feet of a
residential zone, structure height is hnuted to 35 feet Sixty-five feet is the
proposed height of the "inflatable" structure
The proposed Regional Business (B-3) zone requues frontage on a Pnnciple
Artenal or higher roadway classificanon Pn.mary access to the site would be
provided by two Local Access streets, Cataldo Avenue from the south, wnth a

Response The apphcant has not demonstrated that there are special
circumstances, particular to this site, which would create practical difficulties for
industnal development under the current Light Industnal (I-2) zone It appears that
gra.nting either vanance would be a detnment to the general neighborhood due to the
unposition of a structure with an unposing height, visible from both the adjacent
residential neighborhood and I-90 The use would also create commercial traffic
vvithm a prunanly industnal area. The cumulative unpacts of multiple vanances
would allow a use which is incompatible
In addiaon to the pnmary considerations listed above the noted Code section hsts
several secondary considerations for granting a vanance
2a Strict applicanon of the Zontng Code standard(s) creates an unreasonable
burden in light of the purpose to be served by this Code
2b Relaxanon of the Zorung code standard wtll allow a more envtronmentally
sensinve, energy conserving design or result in the adapttve reuse of an
htstortc property or
2c A broader publtc or commuruty need or lnterest will be served by grannng
the variance as opposed to denying the applicanon
Response Smct applicaaon of the Zoning Code would allow industnal
development for a pazcel zoned Light Industnal (I-2) and adjacent to an existing
industnal area The Zorung Code has mherent safeguards whlch would protect
residential neighborhoods from the noise, odor, and glare of intrusive industnal uses
In some respects, the proposed use would provide for community recreanonal needs
however, multiple vanances and a zone reclassification for intensive commercial uses
adjacent to residennal development are incompatible
G Land Use Analysis Industnal uses are located to the west and north Residennal
uses have been established to the northeast and east There may be certain cases
where intensive commercial uses may be pemutted within estabhshed neighborhoods
and should meet the mumum development standazds of the proposed zone The

and gwdehnes The Plannmg Department has deternuned that "No probable sigruficant
adverse impacts" would result from the proposal being developed and has issued a

IV PLANNING DEPARTMENT SUMMARY AND RECOMMENDATION
Zone reclassifications should be based on consistency with the underlying Comprehensive
Plan Category and should not conflict with the Goals and Objectives of the Comprehensive

Plan When a site specif'ic zorung request is affected by adjacent Categones the
Comprehensive Plan gives the Heanng Body flexibihty to approve land use regulanons
based on the "Transition Pohcy" whereby fnnge areas located between two Comprehensive
Plan categones may allow development complyuig with either category if approved by the
Heanrig Body The site is located adjacent to an area designated as Indusmal by the
Spokane County Comprehensive Plan and the existing Light Industnal (I-2) zone
classification meets the uitent of the Transition Pohcy whereas the proposed Regional
Busmess (B-3) zone could create an inappropnate mtrusion on both industnal and
residennal uses Addhnonally, it is apparent that the need for two vanances from the
proposed zone standards for height and artenal frontage demonstrate an inherent
incompatibility The Plammng Department recommends that the zone reclassffication and
both vanances be derued

Prior to release of a building permit or use of property as proposed
E40 Access permits for approaches to the County Road System shall be
obtained from the County Engineer
E44 The applicant shall submit for approval by the Spokane County Engineer
and the Spokane County Health District a detailed combined on-site
sewage system plan and surface water disposal plan for the entire
project or portion thereof if the development is phased
E45 A parking plan and traffic circulation plan shall be submitted and
