FINDINGS AND ORDER
A. 1NTRODUCTION
This matter having come before the Zoning Hearing Examiner Committee on
December 3. 1987, and the members of the Committee present being Phillip
D. Harris, Chairman, Jim Schuna and Gary N. Anderbeng.
B. PROPOSAL
The sponsor, Terry Wynia, is requesting approval of a zone reclassification,
File No. ZE-49-87; MANUFACTURING to REGIONAL BUSINESS (13-3)
ZONE, for the purpose of developing a motel addition.
C. FINDINGS OF FACT
1. That the existing land use in the area is trucking companies, truck sales
and services, motel, tavern, storage, industrial and open area.
' 2. That the Comprehensive Plan designates this area as appropriate for
INDUSTRIAL development.
3. That the existing zoning of the property described in the application is
Manufacturing.
4. That the provisions of RCW 43.21 C(The State Environmental Policy Act)
have been complied with, and the Committee concurs with the
Determination of Non-Significance.
5. That the proper legal requirements for advertisement of the Agenda Item
have been fulfilled.
6. That the land use in this area is suitable for the proposed use, or uses
within the proposed Zone Ctassification.
7. That the applicant has demonstrated that conditions have substantially
changed since the original zoning of this area and aocordingly, the
proposed rezone is justified.
8. That the proposed use is compatible with existing uses in the area.
9. That the owners of adjacent lands have expressed neither approval nor
disapproval of the proposed use.
10. The Hearing Examiner Committee finds the proposed use to be in
harmony with the general purpose and will not be otherwise detrimental
to the public health, safety, and welfare.

C. FINDINGS OF FACT (continued) ZE-49-87
11. The following are additionai findings of fact considered by the Hearing
Examiner Committee:
a) Specific commercial uses which provide support services to
industrial activities within the Industrial category are appropriate. A
motel which can cater to the needs of trucking traffic in an industrial
area can be considered such a supporting use.
b) The past precedent for this block has been to approve Commercial
zoning for development of a motel complex to serve truck traffic in
the immediate area. This proposed rezone and motel addition is
consistent with that past land use trend.
c) The site development plan indicates planned conformance with the
requirements of the Spokane County Zoning Code. Some
modifications however will be necessary prior to release of specific
building permits; these rnodifications relate to setbacks, landscaping
and tractor/trailer parking needs.
D. CONDITlONS OR CONTINGENCIES APPLIED TO THIS APPROVAL
(All Conditions imposed by the Zoning Hearing Examiner Committee shall
be binding on the "Applicant", which term shall include the owner or owners
of the property, heirs, assigns, and successors.)
a) COUNTY PLANNING DEPARTMENT

1. The applicant shall develop subject property generally in accordance
within the concept presented to the Hearing Examiner Committee.
Variations when approved by the Zoning Administrator will be
permitted, including, but not limited to the following changes: Building
location, landscape plans, and general allowable uses of the
permitted zone. All variations must conform to regulations set forth in
the ZONING CODE FOR SPOKANE COUNTY. The original intent of
the development plans shall be maintained.
2. All current standards of the Regional Business (B-3) Zone, as
amended, shall be complied with in the development of this site.
3. That the present proposal is not detailed enough to determine
whether or not the use of or materials stored on the site are in
compliance with Section 7.06 (Aquifer Sensitive Area Overlay Zone)
of the ZONING CODE FOR SPOKANE COUNTY. Accordingly, as a

a) COUNTY PLANNING DEPARTMENT condition of approval, the sponsor/applicant shall be required to file
with the Spokane County Auditor, within thirty (30) days of the signing
of Findings and Order of the final decision in ihis matter, a"Notice to
the Public" which shall provide in material as follows:
PRIOR TO THE ISSUANCE OF ANY 6UILDING PERMIT OR
CERTIFICATE OF OCCUPANCY FOR ANY 6UILDING OR ANY USE
ON THE PROPERTY DESCRIBED HEREINAFTER, THE APPLICANT
SHALL BE RESPONSIBLE FOR COMPLYING WITH THE
PROVISIONS OF THE ZONING CODE FOR SPOKANE COUNTY
SECTION 7.06 (AQUIFER SENSITIVE AREA OVERLAY ZONE). THE
PROPERTY WHICH IS THE SU6JECT OF THIS NOTICE IS MORE
PARTICULARLY DESCRIBED AS FOLLOWS:....".
4. Applicant shall comply with '208' recommendations concerning
stormwater nunoff and provide necessary landscaping for runoff.
5. Any division of land for the purpose of sale, lease or transfer, shall
comply with RCW 58-17 and the Spokane County Platting
Ordinances prior to issuance of building permits.
SPECIAL:
6. That the proposed site development plan reviewed by the Zoning
Hearing Examiner Committee on December 3, 1987, indicates that
the proposed future 20-unit motel addition along the north side of the
property is not in compliance with the required front yard setbacks
from Mallon Avenue. This encroachment into the required front yard
setback area is not authorized. Prior to release of building permits for
the 20-unit addition the specific site development plan shall show
compliance with the required front yard setback standards of the
Spokane County Zoning Code or the proposal shall obtain a variance
from the required setbadc standards through the process specified by
the Spokane County Zoning Code.
7. Development of a motellhotel on this property shall require that one
out of every eight parking spaces required for a motel/hotel use by the
Spokane County Zoning Code be designed, located and reserved for
tractor/trailer parking. Those larger spaces shall be designed at 15
feet wide by 60 feet long and shall have adequate ingress and egress
pursuant to Section 8.02 - Qff-Sireet Parkina and Loading Standards
of the Spokane County Zoning Code. As an alternative to locating the
tractor/trailer parking stalls on this site, the applicant may take
advantage of flexibility of off-site parking standards provided for in
Section 8.02.040(1) of the Spokane County Zoning Code.

b) COUNTY ENGINEERING DEPARTMENT '
Prior To The Issuance Of A Buildina Permit Or Use Of The Property As
Proposed:
STANDARD:
1. Access permits for approaches to the County Road System shall be
obtained from the Spokane County Engineer.
2. Applicant shall submit for approval by the Spokane County Engineer
road, drainage, and aooess plans.
3. The applicant shall submit for approval by the Spokane County
Engineer and the Spokane County Health District a detailed
combined on-site sewage system plan and surface water disposal
plan for the entire project or any portion thereof, if the development is
to be phased.
4. A parking plan and traffic circulation plan shall be submitted and
approved by the Spokane County Engineer. The design, location,
and arrangement of parking stalls shall be in aocordance with
standard traffic engineering practices. Paving or surfacing as
approved by the County Engineer, will be required for any portion of
the project which is to be oa;upied or traveled by vehicles.
5. The construction of the road improvements stated herein shall be
aocomplished as approved*by the Spokane County Engineer.
6. AII required improvements shall conform to the current State of
Washington Standard Specifications for Road and 6ridge
Construction, and other applicable County standards and/or adopted
resolutions pertaining to Road Standards and Stormwater
Management in effect at the date of construction, unless otherwise
approved by the County Engineer.
7. Roadway standards, typical roadway sections and drainage plan
requirements are found in Spokane Board of County Commissioners'
Resolution No. 80-1592 as amended and are applicable to this
proposal.
8. No construction work is to be performed within the existing or
proposed public right of way until a permit has been issued by the
County Engineer. All worc within the public road right of way is
subject to inspection and approval by the County Engineer.

b) COUNTY ENGINEERING DEPARTMENT
9. All required construction within the existing or proposed public right of
way is to be completed prior to the release of a building permit or a
bond in the amount estimated by the County Engineer to cover the
cost of construction of improvements shall be filed with the County
Engineer.
5PECIAL:
10. The County Engineer has designated Typical Roadway Section
Number One, Access Street standard for the improvement of Eastern
Road which is to be constructed within the proposed development.
This will require the installation of asphalt paving, curbing and
sidewalks along the frontage of the proposal.
11. The County Engineer has designated Typical Roadway Section
Number One, Access Street standard for the improvement of Mallon
Avenue which is adjacent to the proposed development. This will
require the addition of asphalt paving, cUrb and sidewalk along the
frontage of the proposal.
c) COUNTY UTILITIES DEPARTMENT
STANDARD:
1. Any water service for this project shall be provided in aocordance with
the Coordinated Water System Plan for Spokane County, as
amended.
SPECIAL:
2. Project is located within the City of Spokane's Future Sewer Service
Area; applicant must see the City of Spokane for recommendations.
d) COUNTY HEALTH DISTRICT

1. Sewage disposal method shall be as authorized by the Director of
Utilities, Spokane County.
2. Water service shall be coordinated through the Director of Utilities,
Spokane County.

d) COUNTY HEALTH DISTRICT
3. Water service shall be by an existing public water supply when
approved by the Regional Engineer (Spokane), State Department of
Social and Health Servioes.
4. Subject to specific application approval and issuance of permits by
the Heanh Officer, the use of an individual on-site sewage system
may be authorized.
5. Use of private wells and water systems is prohibited.
SPECIAL:
6. Disposal of sewage effluent beneath paved surfaces is currently
prohibited. Parking or any vehicular traffic over an unpaved drainfield
area is also currently prohibited. The area over the new drainfield is
to be adequately barricaded to prevent vehicular access.
7. If sewage volume exceeds 3,500 gallons per day, then the permitting
of the on-site sewage system will be under the jurisdiction of DSHS.
NOTE: County Commissioner's resolution limits sewage volume to
3,600 gallons per day per acre in this area.
8. Plans for this project should also be submitted to the Transient
Accommodations section of DSHS for their approval.
e) COUNTY BUILDING AND SAFETY DEPARTMENT
STANDARD:
1. The site is located in Fire District #1.

2. The Department of Building and Safety has reviewed this proposal at
a pre-construction conference held on September 21, 1987. The
Department comments are contained in the recorded minutes dated September 22, 1987, which have been distributed to all parties of
record. We have no additional comments.
f) WATER PURVEYOR
1. Water Purveyor is the City of Spokane, and they will supply the site
will adequate water for domestic, fire and irrigation uses.

g) SPOKANE COUNTY AIR POLLUTION CONTROL AUTHORITY
All air pollution reaulations must be met. This includes but is not limited
io the followinQ:
STANDARD:
1. Air pollution regulations require that dust emissions during
demolition, excavation and construction projects be controlled. This
may require use of water sprays, tarps, sprinklers, or suspension of
activity during certain weather conditions. Naul roads should be
treated and emissions from the transfer of earthen material must be
«ontrolled as well as emissions from all other construction related
activities.
2. Measures must be taken to avoid the deposition of dirt and mud from
unpaved surfaces onto paved surfaces. If tracking or spills occur on
paved surfaces, measures must be taken immediately to clean these
surfaces.
3. All travelled surfaces (ingress, egress, parking areas, access roads)
must be paved and kept clean.
4. Some objectionable odors will likely resuit during the construction
phase of the project and from motor vehicles using the site following
completion of the project and from occupants of the proposed project.

finds that the application of Terry Wynia for a zone reclassification as described
in the application should be APPROVED to the REGIONAL BUSINESS (B-3)

1. GENERAL INFORMATION

Progosal:
A request to rezone an approximate 37,285 square foot site from
Manufacturing to Regional 6usiness (B-3) Zone for the purpose of
developing a motei addition.
Location:
The site is generally located at the northeast comer of 8roadway
Avenue and Eastern Street and at the southeast corner of Malion
Avenue and Eastem Streei in Section 13-25-43. Tax Parcel Numbers:
13532-1431; 1432; 1433; 1434; 1435; and 1441.

II. SITE ANALYSIS ZE-49-87 -
The industrial category is primarily a land use designation intended to
protect and reserve land for industrial development to maintain the economic base of Spokane County. Broad general uses that are
appropdate within the industrial category include manufacturing, light
assembly and transportation services. In regards to transportation
services, the Comprehensive Plan recognizes the need to locate
commercially oriented support uses in close proximity to the\
transportation services. Such support senrices may include cafes, truck
service stations, and parts/service stores. Motels, specifically intended
to serve the needs of a nearby transportation service center, may also be
appropriate within the Industrial caiegory as a commercial support use to
industrial uses.

This immediate area, including that area easteriy along Broadway to the
Interstate 90 interchange, is primarity transportation and trucking
oriented. Uses included in the area are truck stops, service stations,
truck sales, repair, service, restaurants, and rtiotels. Most of these
activities are oriented towarci industrial uses in the area or the Interstate
90 transportation corridor.
The Commercial zoning immediately east of and adjacent to this
proposed rezone site was approved for the two phase development of
the existing 35-unit motel; in 1965 and in 1972. In both actions, the
Planning Commission found that the rezones to Commercial, for the specific purpose of developing a motel to serve the needs of the trucking
industry was an appropriate use for this industrial area.

The existing old zones in this area are scheduled to cro'ss-over to the
new Zoning Code in 1991 as foilows: _

Site Characieristics:
Site Size: Approx. 37,285 square feet Existing Buildings: None
Topography: Relatively flat Vegetation: Naturai
Agricultural Summary: The Industrial category of the Comprehensive
Plan is not intended to protect agriculturai land.
Adjoining Streets: Broadway Avenue to the south of the site is a 60 foot
County right of way improved with four paved lanes,
curbing and sidewalks only along the north side.
Eastem Street to the west of the site is a 60 foot
County right of way improved with two gravel lanes.
Matlon Avenue to the north of the site is a 60 foot
County right of way improved with two gravel lanes.
Proposed Site Plan:

Site Plan Considerations: The site plan submitted indicates the existing
and propased improvements for the entire block bounded by Broadway,
Mallon, Eastem and Dyer. The easteriy portion of this block, with the
existing motel, is currently zoned Commercial and is not part of the
proposed rezone. The site ptan indicates immediate construction of an
additional 35 motel units; 12 of the units will be in the existing
- Commercial Zone while the remaining 23 units would be in the proposed
Regional Business (B-3) rezone. A future 20-unit addition is planned for
the Regional Business (B•3) site, most likely after public sewers become
available to ihis area and ihe on-site sewage disposal area can be
abandoned.

Ii. S1TE ANALYSIS ZE-49-87 •
The preliminary location of the future 20-unit addition is not in
conformance with the required front yard setback from Mallon Avenue. If, ' or when, the 20-unit addition is canstructed, it must be in compliance with
the°setback standards of the Spokane County Zoning Code or have been
granted a variance.
The proposed site plan indicates the addition of 35 new parking stalls to
serve the entire motel complex. Additionally, the elimination of the active
and repiacement drainfield areas when public sewers become avaiiable
will allow the deveiopment of an additional 20 parking spaces for the
anticipated future 20-unit addition. All totaled, the overall site plan
indicates an excess of approximately 20 parking spaces over and above
the requirements of the Spokane County Zoning Code.
While the proposed Regional Business (B-3) rezone and motel addition
is generaily anticipated by the applicant as a commercial support use to
the industrial and transportation uses in the area, the site plan does not
indicate any on-site parking areas for large tractor/trailers. All parking
stalls indicated the site plan are dimensioned for automobiles. Currently,
tractor/trailer partcing on the existing motel's paved parking area is
prohibited due to a breakup of the asphaft surface. Those large tnucks
now park on the vacant property which is now proposed for the motel
addition.
The site plan generalfy indicates conformance with the landscape
requirements of the Spokane County Zoning Code. Additional
landscaping may be required within the pat4cing lot area by the Zoning Code: The site plan also indicates planned paving, curbing and
sidewalks along the rezone's boundary common with Eastern Street and
Mallon Avenue.

- The site plan submitted for review by the Zoning Hearing Examiner
Committee is general in nature. Detailed review to determine
compliance with a{I Ordinance regutations and conditions of approval
is recommended to be administrative and to occur at the Building
Perrnit stage.

appears to be consistent with the standards of the Spokane County Zoning Code. The future 20•unit addition must be in compliance with the front yard

CirculatiQn/Access: Development of this proposal will require improvements
to both Eastern Road and Malion Avenue by the Spokane County Engineer.
Those improvements will inciude paving, curbing and sidewalks along the
frontage of this proposal. Those improvements have been planned for and
indicated on the proposed site plan.
This motel complex has, over the years, been featured as a supporting
commerciai use serving the needs of truckers in this industrial area. In both
previous Commercial rezones, the Planning Commission made that
specific finding of fact and it appeared to be the single most significant
reason for approving a commercial use in an industrial area. in reganis to
this service to the tnucking industry, the originai concept plan submitted for
the commercial rezone in 1965 proposed 7 stails for tractorttrailer parking;
those 7 spaces were in addition to the minimum requirement of 1 parking
space per motel unit. The 7 tractorttrailer parking stalls cuRently do not exist
at the existing motel complex. Given the fact that the cuRent proposal is
generaliy proposed as support service to the trucking industry, adequate
provisions for the parking of tractor/trailers on site should be required. As an
acceptable standard, 1 space out of each 8 spaces required for a rnotel use
by the Spokane County Zoning Code should be developed and reserved as
tractorttrailer parking stalls. Each such stall shall measure 15 feet wide by
60 feet long and have adequate ingress and egress. To be as flexible as
possible, development would be allowed either on-site or off-site as
provided by the Spokane County Zoning Code, Section 8.02.040(1).
SewaaQ Disl2_o_sal: The Spokane County Utilities Depanment has indicated
. that the site is within the City of Spokane's future sewer service area and
that the applicant wil{ be required to meet the requirements of the City of
Spokane. Additionally, the Spokane County Health District notes that the
site is located in the drainage basin north of Interstate 90 and therefore is
subject to sewage volume restrictions of a maximum 3,600 gallons per day
per acre. Location of on-site sewage disposal systems shall not be paved
over and shall be protected from vehicle parking or traffic circulation.
IV. SEPA ENVIRONMENTAL REVIEW
An Environmental Checklist was submitted by the sponsor and was
reviewed by the County Planning Department. The review considered
the specifics of the proposal, other available information, County
ordinances, other regulations and laws, possible standard Conditions of
Approval, the Generalized Comprehensive Plan, and other County
policies and guidelines. The Zoning Administrator has determined that
. "Mo probable significant adverse impacts" would result from the proposal
being deveioped and has issued a Determination of Non-Sianificance
("DNS").

IV. SEPA EN1/IRONMENTAL RE1/IEW (continued) ZE-49•87 The "DNS" was circulated to tenother agencies of jurisdiction _
and other agenciesldepartments affected by the future development for
review and comment. The "ONS" comrnent period ends December 2,
1987, and was advertised 15 calendar days before said date in the
newspaper, by letter to adjacent property owners within 400 feet of the
proposal, and by notice on a sign posted on the proposal site. The
Hearing Examiner Committee may consider additionai environmental
related testimony and the "DNS" at the public hearing.
V. PLANNING SUMMARY
The proposed rezone from Manufacturing to Regionai Business (B-3) Zone
for development of a motel is appropriate and could be approved for the
foilowing reasons:
a) Specific commercial uses which provide support services to industrial
activities within the industrial category are appropriate. A motel which
can cater to the needs of tnucking traffic in an industrial area can be
considered such a supporting use.
b) The past precedent for this biock has been to approve Commercial
zoning for development of a motel complex to serve truck traffic in the
immediate area. This proposed rezone and motel addition is consistent
with that past land use trend. -
c) The site development plan indicates planned conformance with the
requirements of the Spokane County Zoning Code. Some modifications however will be necessary prior to release of specific building permits;
these modifications refate to setbacks, landscaping and tractor/trailer
parking needs.
VI. CONDITIONS OF APPROVAL
(All Conditions imposed by the Zoning Hearing Examiner Committee shall
be binding on the "Applicant", which term shafl include the owner or owners
of the property, heirs, assigns, and successors.)
