FINDINGS OF FACT 1 The apphcation requests a rezone of approximately 5 59 acres of land from the Heavy Industnal (I-3) zone to the Light Industnal (I-2) zone, for a cash-and-carry retail store and warehouse, and other uses allowed in the I-2 zone 2 The site is located at the northwest comer of the intersecnon of Broadway Avenue and Fancher Road, m the NE '/4 of Section 14, Township 25 North, Range 43 EWM, Spokane County, Wash.ington 3 The site is currently referenced as County Assessor's tax parcel no 35141 2108 and 2109 The subject property is legally descnbed on an attachment to the zone reclassification application 4 The apphcant for the proposal is The Campbell Company, c/o Samuel Campbell, 9300 East Sprague Avenue, Suite 201, Spokane, WA 99206 The owner of the site is Nevco, Inc, Harbor Mall, Suite 15, Bellingham, WA 98225 5 The Hearing Examiner heard the application pursuant to the County Hearmg Examiner Ordinance (County Resolution No 96-0171) and the County Heanng Examiner Rules of Procedure (County Resolution No 96-0294) 6 The requirements for nohce of public hearing were met - 7 The Heanng Exanuner conducted a site vlsit on February 12, 2002 8 A public hearing was held on the proposed rezone on February 13, 2002 HE Findings, Conclusions and Decision ZE-24-01 Page 1 ti i 9. The following persons testified at the public hearing: Jim Falk Sam Campbell Division of Planning 9300 East Sprague 1026 West Broadway Suite 201 Spokane, WA 99260 Spokane, WA 99206 10. The County Division of Planning issued a Determination of Nonsignificance for the project on January 25, 2002. 11. The Hearing Examiner takes notice of the County Generalized Comprehensive Plan, County Arterial Road Plan maps, County Zoning Code, GMA Comprehensive Plan and Capital Facilities Plan, Phase I Development Regulations, other applicable development regulations, and prior land use decisions in the vicinity. 12. The record includes the documents in the project file at the time of the public hearing, the documents and testimony submitted at the public hearing, and the items taken notice of by the Hearing Examiner. 1 • 1 13. The site is approximately 5.59 acres in size, relatively flat in topography, and rectangular in shape. The subject property is undeveloped, except for an unpaved parking lot surrounded by cyclone fencing located in the northeast portion. The site is listed by the Washington State Department of Ecology as contaminated on its Confirmed and Suspected Contaminated Site list. The central third (1/3) of the subject property has been cleaned up, but the remainder of the site is still contaminated. 14. The site plan of record dated November 26, 2001 illustrates development of a 21,600 square foot cash-and-carry warehouse-type building in the central portion of the subj ect property. The building would be used to sell groceries and related items. The applicant intends to eventually develop the remainder of the site for speculative I-2 uses. 15. Effective January 1, 1991, the zoning of the site was reclassified from the Industrial zone of the now expired County Zoning Ordinance to the Heavy Industrial (I-3) zone, under the Program to Implement the Spokane County Zoning Code. The site is also located in the Aquifer Sensitive Overlay zone and the Public Transit Benefit Area designated by the Zoning Code. 16. The current rezone application, environmental checklist, site plan of record and application fees were submitted on November 27, 2001. On such date, the application was complete and subject to the land use processing procedures set forth in County Resolution No. 1-0700. 17. Effective January 15, 2002, the County implemented a new Comprehensive Plan ("GMA Comprehensive Plan"), County Urban Growth Area (LTGA) boundaries, and Phase I Development Regulations; all in implementation of the State Growth Management Act. The County also repealed the interim development regulations previously adopted by the County under the State Growth Management Act. See County Resolution No. 2-0037. HE Findings, Conclusions and Decision ZE-24-01 Page 2 ~ 18. The site and the surrounding area are designated in the County UGA. Prior to January 15, 2002, the site and such surrounding land were designated inside the County's interim urban growth area boundaries. 19. The Phase I Development Regulations allow rezone applications that were "counter- complete" before the adoption of such regulations on January 15, 2002, pertain to land located within the UGA and are inconsistent with the GMA Comprehensive Plan to be processed under the comprehensive plan and land use regulations in effect when the application became "counter- complete". If tlle rezone application is approved, the new zoning is effective for a period of one (1) year, and development of the property may proceed under the conditions of the rezone provided a building pennit is submitted within the 1-year period. After the 1-year period, the zoning of the property will "crossover" to the zone designated in the crossover matrix of the Phase I regulations. If a timely building permit is applied for, the conditions of the prior rezone continue to apply; provided, if there is a conflict between the conditions and the development standards of the crossover zone, the more restrictive standard applies. 20. The Phase I Development Regulations require any rezone applications submitted after January 15, 2002 to be consistent with the GMA Comprehensive Plan category for the property, ' and with the implementing zone set forth in the Phase I Development regulations for such category. 21. The site is designated in the Heavy Industrial category of the GMA Comprehensive Plan, and within the UGA. Under the Phase I Development Regulations, the crossover zone for the current site is the zoning of the site prior to January 15, 2002 (I-3). The implementing zone for the site, under such regulations, is the I-3 zone. 22. The Examiner must consider the current rezone application under the comprehensive plan and development regulations in effect on November 27, 2001, the date when the application became complete. Th.is includes the old Comprehensive Plan ("Comprehensive Plan"), County Zoning Code, County Road Standards, Critical Areas Ordinance, Stormwater Control Ordinances, interim development regulations for land located inside the County's ILTGA boundaries, and other development regulations in effect on November 27, 2001. 23. The site and surrounding properties are designated in the Industrial category of the Comprehensive Plan. The site and surrounding land is also designated in the Spokane City Fringe Area, Aquifer Sensitive Area, Urban Impact Area and Priority Sewer Service Area designated by the Comprehensive Plan. 24. The land lying directly southeast of the site, at the northwest corner of the intersection of Broadway Avenue and Fancher Road, was rezoned to the B-1 zone in 1993, and is developed with a convenience store/gas pump facility. The other land lying near or adjacent to the site is zoned I-3. 25. The land lying directly north of the site is improved with an office building. The land lying directly west of the site consists of a truck parts sales business and commercial fueling depot. The land,lying east of the site consists of industrial uses. The land lying south of the site across Broadway Avenue consists of an electronics service business and industrial uses. HE Findings, Conclusions and Decision ZE-24-01 Page 3 26. Most of the land located west of the southerly two-thirds (2/3) of the site, west of Howe Road, is zoned I-2. The City of Spokane lies less than one (1) mile northwesterly of the site. Felts Field, a small airport operated by the City of Spokane, is located northwest of the site in the City of Spokane. 27. The County Arterial Road Plan designates Broadway Avenue and Fancher Road in the area as Principal Arterials. The Interstate 90Broadway Avenue overpass is located approximately one (1) mile east of the site. 28. The I-3 zone permits such uses as food products manufacturing/sales and wholesaling, but not retail sales such as those proposed by the applicant. 29. In 1996, the County Zoning Code was amended to pennit certain retail and service uses in the I-2 zone, including but not limited to all uses allowed in the B-3 zone; provided that any B-3 zone uses allowed in the I-2, unless specifically enumerated in the industrial zones matrix, were required to meet all the B-3 zone development standards. See County Resolution No. 96-0787, and Zoning Code 14.629.020 and 14.629.080. 30. The proposal includes both an industrial use (food warehouse) and non-industrial use (retail food sales and other potential non-industrial uses). Decision Guideline 7.2.5 of the Industrial category of the Comprehensive Plan discourages the development of such mixed uses unless they are near other non-industrial categories, and the proposal shows compatibility with existing andlor potential industrial uses through buffering or suitable development covenants. 31. The site is not located near other non-industrial categories; however, the land lying southeast of the site was rezoned to the B-1 zone in 1993 for development of a convenience store/gas pump facility. Further, I-2 zoning and uses are located near the site to the west, and an office use is located directly north of the site. The proximity of the site to the intersection of Fancher and Broadway, where traffic levels are high, its proximity to Interstate 90, and the recent amendments to the I-2 zone, support the proposed retail use of the site. 32. The project would be served by a high level of urban services and facilities; including public sewer and water, and modern utilities. The site is located in the City of Spokane sewer and water service areas. The City is willing to provide sewer and water utility services. There was no opposition to the proposal by neighboring property owners, or public agencies. 33. Decision Guideline 30.2.1 of the Spokane City Fringe Area encourages industrial uses in the Fringe Area where such development both utilizes and protects natural and man-made resources, has access to existing transportation facilities, utilizes existing utilities and services, and spreads its impacts and benefits over a wide area. To the extent the proposal develops industrial uses, it will implement Decision Guideline 30.2.1. 34. Decision Guideline 30.2.3 indicates that new retail and business services needed by the expanding populations in the Fringe Area should be provided in part by neighborhood and community shopping centers. Development of the site for retail uses may help implement this policy. HE Findings, Conclusions and Decision ZE-24-01 Page 4 l 35. The Staff Report otherwise adequately discusses the consistency of the proposal with the policies of the Industrial category, City Fringe Area section and Water Quality section of the Comprehensive Plan. The Examiner concurs in and adopts such analysis by reference as findings of fact herein. 36. The proposal can meet the development standards of the B-3 zone or I-2 zone, as applicable. 37. The project has been conditioned for compliance with the development standards of the I-2 zone and other applicable provisions of the County Zoning Code, and the recommendations of the commenting public agencies. As conditioned, the project will be reasonably compatible with, and not have a significant negative impact on, neighboring land uses. 38. No public agencies objected to the Determination of Nonsignificance (DNS) issued for the proposal by the County Division of Planning. The proposal will not have more than a moderate effect on the quality of t,he environment, and the Examiner concurs with issuance of the DNS. 39. Changed conditions have occurred since the zoning of the site was reclassified to the I-3 zone on January 1, 1991, pursuant to the Program to Implement the Spokane County Zoning Code. This includes the availability of public sewer to the subject property, increased commercial development and traffic along Broadway Avenue, the 1996 amendments to the I-2 zone to allow commercial uses, road improvements in the vicinity, the 1993 rezone of the land lying directly southeast of the site to the B-1 zone and development of retail uses on such land, increased residential growth in the area, and reclamation of a portion of the site from a contaminated status. Based on the above findings of fact, the Hearing Examiner enters the following: II. CONCLUSIONS OF LAW 1. The proposed rezone, as conditioned, generally conforms to the Comprehensive Plan. 2. The proposed rezone bears a substantial relationship, and will not be detrimental, to the public health, safety or welfare. 3. A change in econonuc, technological, or land use conditions has occurred to warrant the proposed rezone, and a substantial change of cucumstances has occurred in the area since the site was last zoned. 4. The procedural requirements of the State Environmental Policy Act and the County's Local Environmental Ordinance have been met. The proposal, as conditioned, will not have a significant, probable adverse impact on the environment. 5. The proposed rezone meets the criteria established by Washington case law for approving a rezone, and the criteria established in paragraphs 14.402.020 (1)(2) of the County Zoning Code for amending the County official zoning map. HE Findings, Conclusions and Decision ZE-24-01 Page 5 6. Approval of the land use application is appropriate under section 11 of the County Hearing Examiner Ordinance, adopted by County Resolution No. 96-0171. III. DECISION Based on the above Findings of Fact and Conclusions of Law, the application for a rezone to the Light Industrial (I-2) zone is hereby approved, subj ect to the conditions of approval of the public agencies stated below. Any condirions of such agencies that have been added or significantly revised by the Hearing Examiner are italicized. Failure to comply with the conditions of this approval may result in revocation of this • approval by the Hearing Examiner. This approval does not waive the applicant's obligation to comply with all other requirements of other agencies with jurisdiction. SPOKANE COUNTY DIVISION OF PLA,NNING 1. All conditions imposed by the Hearing Examiner shall be binding on the "Applicant," which term shall include the owners and developers of the property, heirs, assigns and successors. 2. The zone change applies to the property currently referenced as County Assessor's tax parcel nos. 35141.2108 and 35141.2109, and legally described in an attachment to the zone reclassification application in File No. ZE-24-01. 3. The proposal shall comply with the Light Industrial (I-2) zone, the Aquifer Sensitive Overlay zone, and other applicable provisions of the Spokane County Zoning Code, as amended. 4. The central portion of the sate shall be developed an geneYal conformance with the site plan of record dated November 26, 2001. A sate development plan shall be submitted prior to issuance of a building permit, as provided in Section 14.808. 040 of the County Zoning Code, as amended. All variatzons and site development must conform to conditions of approval and the County Zoning Code. 5. The development of Regional Business (B-3) zone uses on the site, which are not specafically listed in the Industrial Zones Matrix as permitted uses, shall comply with the development standards of the B-3 zone; as set forth in Section 14.629.080 of the County Zonang Code, as amended. 6. Approval is required from the Director of the Division of Planning/designee of a specific illumination and signage plan for the described property prior to the release of any building permzt. HE Findings, Conclusions and Decision ZE-24-01 Page 6 i 7. A specific landscape plan, planting schedule and provisions for the maintenance acceptable to the Director of the Division of Planning/designee shall be submitted with a suitable guarantee for the proj ect prior to release of any building permits. The landscape plan shall be consistent with the landscaping requirements of Chapter 14.806 of the County Zoning Code. Landscaping shall be installed and maintained so that sight distance at access points is not obscured or impaired. 8. The Division of Planning shall file with the Spokane County Auditor, within the same time frame as allowed for an appeal from the final disposition, including lapsing of appeal period, a Title Notice, which shall generally provide as follows: "Prior to the issuance of any building permit for any building or any use on the property described herein, the applicant shall be responsible for complying with the provisions of the Zoning Code for Spokane County, Section 14.706 (Aquifer Sensitive Area Overlay Zone). The property which is the subject of this notice is more particularly described as follows: (legal description)." 9. An avigation easement satisfactory to the manager of Felts Field shall be recorded in the Spokane County Auditor's Office prior to issuance of any building permits. This requirement shall not apply if the applicant presents a written determination from the manager of Felts Field stating that an avigation easement is not required. 10. The applicant shall comply with the requirements of the Washington State Department of Ecology for the portions of the site that are still contaminated. 11. Pursuant to the Phase I development regulations adopted by the County, the rezone to the Light Industrial (I-2) zone herein is effective for one (1) year from the date of this decision, building permits for any development under such zone must be applied for withzn the one (1) year peraod, and the zoning of the site will crossover to the Heavy Industrial (I-3) zone at the end of the one (1) year period. 12. The Division of Planning shall prepare and record with the Spokane County Auditor a Title Notice, noting that the property in question is subj ect to a vanety of special conditions imposed as a result of approval of a land use action. This Title Notice shall serve as public notice of the conditions of approval affecting the property in question. The Title Notice should be recorded within the same time frame as allowed for an appeal and shall only be released, in full or in part, by the Division of Planning. The Title Notice shall generally provide as follows: "The parcel of property legally described as (legal description) is the subject of a land use action by the Spokane County Hearing Examiner on March 26, 2002, imposing a variety of special development conditions. File No. ZE-24-01 is available for inspection and copying in the Spokane County Division of Planning." SPOKANE COUNTY BUILDING AND CODE ENFORCEMENT 1. The applicant should contact the Division of Builcling and Code Enforcement at the earliest possible stage in order to be informed of code requirements admin,istered/enforced as authorized HE Findings, Conclusions and Decision ZE-24-01 Page 7 : by the state Building Code Act. Design/development concerns include addressing, fire apparatus access roads, fire hydrant flow, approved water systems, building accessibility, construction type, occupancy classification, existing exterior wall protection and energy code requirements. SPOKANE DIVISION OF ENGINEERING AND ROADS Prior to release of a building permit or use of the property as proposed: 1. Access permits for approaches to the County Road System shall be obtained from the County Engineer. 2. The applicant shall submit for approval by the Spokane County Engineer drainage and access plans. 3. A Professional Engineer (P.E.), licensed in the State of Washington, shall submit road and storm drainage construction plans and a drainage report that conform to the versions of the Spokane County Standards for Road and Sewer Construction, the Guidelines for Stonnwater Management, and all applicable federal, state, and local regulations and laws that are in effect at the tune of the plan submittal or at the time of the development permit application(s). The final road and storm drainage plans and drainage report shall receive the County Engineer's acceptance prior to release of any Grading, Building, or Right-of-Way Permit. 4. A parking plan and traffic circulation plan shall be submitted and approved by the Spokane County Engineer. The design, location and arrangement of parking stalls shall be in accordance with standard engineering practices. Paving or surfacing as approved by the County Engineer will be required for any portion of the project which is to be occupied or traveled by vehicles. 5. All required improvements shall conform to the current State of Washington Standard Specifications for Road and Bridge construction and other applicable County standards and/or adopted resolutions perta.ining to Road Standards and Stormwater Management in effect at the date of construction, unless otherwise approved by the County Engineer. 6. Roadway standa.rds, typical roadway sections and drainage plan requirements are found in Spokane County Resolution No. 1-0298 as amended and are applicable to this proposal. 7. No construction work is to be perfonned within the existing or proposed right of way until a pennit has been issued by the County Engineer. All work within the public road right of way is subject to inspection and approval by the County Engineer. 8. Frontage improvements are not required for the proposed zone change, since Fancher Road and Broadway Avenue were improved by CRP No. 2398. No future acquisition area is required for the proposed zone change, as the necessary right of way to implement fihe County Arterial Road Plan was acquired in conjunction with CRP No. 2398. . 9. The applicant is advised that there may exist utilities either underground or overhead affecting the applicant's property, including property to be dedicated or set aside future acquisition. Spokane County will assume no financial obligation for adjustments or relocation HE Findings, Conclusions and Decision ZE-24-01 Page 8 ~ i : regarding these utilities. The applicant should contact the applicable utilities regarding responsibility for adjustment or relocation costs and to make arrangements for any necessary work. 10. The site plan for the proposed rezone illustrates a specific development for only a portion of the site. At such time as the additional area is proposed to be developed and a site plan is submitted for review, the County Engineer will conduct fu.rther review to deternune what traffic impacts, if any, that the development would have on surrounding infrastructure. The applicant is advised that mitigation may be required, including off-site improvements. SPOKANE REGIONAL HEALTH DISTRICT 1. The sewage disposal method shall be as authorized by the Director of Utilities, the City of Spokane Public Works. 2. Water service shall be coordinated through the Director of Utilities, Spokane County. 3. Water service shall be by an existing public water supply when approved by the Regional Engineer (Spokane), State Deparhnent of Health. 4. A public sewer system will be made available for the project. The use of individual on-site sewage disposal systems shall not be authorized. 5. The use of private wells and water systems is prohibited. SPOKANE COUNTY DIVISION OF UTILITIES 1. The project lies outside of the County's six-year sewer plan and inside of the Urban Growth Area. Projects that fall within this area are required to connect to a sanitary sewer system. 2. This project lies within the City of Spokane Sewer Service Area. The applicant is required to notify them of this proposal and conform to their requirements. 5. Any water service for this project shall be provided in accordance with the Coordinated Water System Plan for Spokane County, as amended. CITY OF SPOKANE DEVELOPER SERVICES 1. In accordance with the City's Comprehensive Plan and Resolution 01-103, existing City sanitary sewer is located in Broadway and City water mains are located in Broadway and Fancher Road. These systems are available to serve the Xeferenced project. 2. All costs associated with extending and connecting City sanitary sewer and water mains to serve the referenced site will be at the developer's expense. Included in these costs will be City plan review fees, permit fees, con.nection fees and inspection fees. Dempsey, WSBA # 5 NOTICE OF FINAL DECISION AND NOTICE OF RIGHT TO APPEAL Pursuant to Spokane County Resolution Nos. 96-0171 and 96-0632, as modified by County Resolution No. 1-0700, the decision of the Hearing Examiner on an application for a zone reclassification is final and conclusive unless within fourteen (14) calendar days from the Examiner's written decision, a party of record aggrieved by such decision files an appeal with the Board of County Commissioners of Spokane County, Washington. This decision was mailed by certified mail to the Applicant, and by regular mail to other parties of record, on March 26, 2002. THE APPEAL CLOSING DATE IS APRIL 9, 2002. The complete record in this matter, including this decision, is on file during the appeal period with the Office of the Hearing Examiner, Third Floor, Public Works Building, 1026 West Broadway Avenue, Spokane, Washington, 99260-0245, (509) 477-7490. The file may be inspected during normal working hours, listed as Monday - Friday of each week, except holidays, between the hours of 8:30 a.m. and 5:00 p.m. Copies of the documents in the record will be made available at the cost set by Spokane County. Pursuant to RCW 36.70B.130, affected property owners may request a change in valuation for property tax purposes notwithstanding any program of revaluation. The site is approximately 5.59 acres in size and is flat. The site is currently vacant except that a northeastem portlon of the site is being utilized as an unpaved, cyclone fenced parking lot serving nearby businesses. There is virtually no vegetation on the property except grasses. The Washington State Department of Ecology lists the subject property as a contaminated site on the Confirmed and Suspected Contaminated sites list The central third of the site has been adequately cleaned up and the remaining two thirds of the site is still oontaminated. Industrial businesses are located east, west and south of the site. A service business is located north of the proposal. Backqround: The cuRent zoning of the subject property is Heavy Industrial (I-3). The applicant is requesting a Zone Reclassifrcation to Light Industrial (I-2) on approximately 5.59 acres. The subject property was established pursuant to Certiflcate of Exemption, CE-367-97. The application for the proposed Zone Reclassification was submitted on November 27, 2002 and a technical review meeting was held on January 10, 2002. Notice of Application was mailed on January 7, 2002 and a Determination of Nonsignificance (DNS) was issued for the proposal on January 25, 2002. The Industrial Category is intended to provide the opportunity for industrial,development and reserve land for industrial'purposes. The purpose of this section is to guide development relafed to the man.ufacturing, processing,, warehousing, transporting and refining of goods. The Industrial category virill be composed of a.variety of industrial, mining ;and transportation uses and few commercial and r"esidentiat uses will be found. These sites will idealty have site landscaping and fencing to improve their,overall appearance. Small-scale activities related to'industrial uses such~as cafes, service stations, and parts and service stores inrill be characteristic of the Industrial category. Public water systems, sanitary sewer systems,.storm sewer systems and other underground utility systems such as elecfical, -telephone,, gas, and cable.services should be-available. Streets should tie curbed,. paved and have high load-bearing capacifies. The Light Industrial (I-2) Zone is one,of the zone classifications which implements the Industrial Category of the Comprehens,ive: Plan. The subject property,is served by,public sewer and water services, and electrical, telephone and gas services are available. Additional services available to the, site are solid waste pickup/processing, fire and police protection and Spokane Transit Authority (STA) service (STA Route 94 serves the area). Two Pirincipal' Arter,ials, Broadway.Avenue and Fancher Road provide high, load-bearing access capacity to the subject site. The following is a review'of the proposal's ~ consistency with applicable Objectivves and Decision Guidelines of the Comprehensive Plan. Decision Guideline 7.1.2(b) recommends that b,uffering between proposed.and.existing development.should be required if it is determined that the proposal without buffering under circumstances, definedin 7.2.4 may impact existing development. The proposal is adjacent to Broadway_Avenue and Fancher Road, both designated Ptincipal Arterials by the. Spokane County Arterial Road Plan. Section' 14.806.040(2)(b) of the Spokane County Zoning Code, requires,5 feet of Type III landscaping adjacent to, all highways'and arterials: Decision. Guideline 7.1.3(a) recommends ttiat large or medium scale industrial -sites -sho'uld' be directly .accessible to highways, fieeways, and arteirial roadways arid sfiould not overload or congest such routes: The project. site `is adjacent to and accessible from finro Principal Arterials, Broadway Avenue and Fancher Road, both of which will be 'able to safely accommodate traffic generated uses permitted 'in ttie I-2 Zorie, assuming complianceMith Spokane County road standards. - Decision Guideline 7.1.4 states that before industrial proposals can be approved, they must conform to County water, sewer, and utility plans,, confonn to County transportation plans, and provide the necessary buffering. The subject site is served fby City of Spokane water and~ sewer services and said services are capable,of ineeting the needs of the uses permitted: in,.the,l=2 Zone. The proposal, as condifioned, is consistent with the,County Arterial Road Plan-and the utility purveyor's plans and requirements. Decision Guideline 7.2.1 &T2.2 suggest that compatibility between industrial category and other adjacent land use categories be maintained through` buffering and 'the change of land use intensity. The subject site is entirely surrounded by Heavy Industrial (1=3) zoriing and therefore landscaped bu ,ffering is not required on the north, west and south bound, aries of the proposal. However, Secbon 14.606.040(2),(b) ~of the'Spokane County Zoning Code requires. 5feet of Type III landscaping -adjacent to Broadway Avenue and Fancher Road. Decision Guideline 7.3.3 recommends that industrial proposals should be approved that aid in the location of compatitile industry equally throughout industrial areas and minimize commubng distance to residential tE-2401, Staff Repflrt - February 13, 2002 Public Hearing Page 5 areas. The proposal is located in the highfy% urbanized west central portion of the Spokane Valley and is ~ wlthin a few miles of large residental areas north, east and south of the proposal. Objective 18.1.2(a) states that development should provide for treatment of impervious surface runoff. Decision Guideline 18.1.2.3 recommends that development site plans use standards similar to aquifer protection regulabons. The proposal as condiboned requires stormwater runoff and treatment be consistent with the Spokane County Stormwater Management Guidelines. Any grass perculabon, detentioNretention ponds and/or c:ontainment devices shall be approved by the County Engineer/designee prior to issuance of a building permit for the subject site. Decision Guideline 18.1.4.7 and 16.1.4.9 state that new development should maintain the existing development theme by way of landscaping, signage, and building styles. The site plan proposes a structure that has essentially the same overall scale of development as neighboring industrial and commercial structures. Installation of signage consistent with the requirements of the Spokane County Zoning Code will assure signage is essentially the same as the scope and scale of signage associated with neighboring industrial and commercial uses. Objective 18.1.5(a) states that all development should provide adequate right-of-way and roadway improvements therein to accommodate short and long-term projected traffic. The proposal, as conditioned, will assure adequate roadway improvements. The County Engineer states that Broadway Avenue and Fancher Road have adequate road right-of-way to serve the proposal. Decision Guideline 18.1.6.14 recommends that driveways not be tocated within 200 feet of an arterial intersection when accessing a principal or rninor arterial, within 100 feet of an arterial intersection when accessing a collector arterial, or within 50 feet of a local access intersection. The proposal as conditioned will be consistent with this guideline and shall be address at such time as detaited site plans are submitted for review. Decision Guideline 18.1.9.22 recommends that all site plans be reviewed for needed improvements to inifiate, expand, and maintain public Vansportation service and facili6es. This guideline shall be addressed at such time as detailed site plans are submitted for review. Decision Gufdeline 18.1.9.23 recommends that development site plans provide parking at the rear or side of the development in order to provide convenient transportation facilities. The proposat provides for parlcing entirely in the front of the warehouse and appears to be inconsistent with this Decision Guideline. Objective 16.1.11(a) recommends that the developer coordinate between water, sewer, and utility providers to assure the slze and location of the facilities will accommodate future growth. The subject site is located within the City of Spokane service area for water and sewer services. Water Quality Goal 10.1 states that there be no further degradation of the Spokane Valley-Rathdrum Prairie Aquifer (as defined in the Spokane Aquifer Water Quality Management Plan). Objective 10.1.d states that fill-in devefopment and development with densities which support existing or proposed sewer systems will be prefeRed. Objective 10.1.n encourages that development minimize the amount of pollution caused by stormwater runoff. Decision Guideline 10.1.n states that where increased stormwater nmoff potential exists due to a proposed development, runoff management procedures should be a condition of approval. The recommended conditions of approval require compliance to Spokane County Stormwater Management Guidelines. Pollution of groundwater will be minimized as the project is served by the City of Spokane sanitary sewage collection system. Additionally, all development and operations shall comply with the Aquifer Sensitive Area (ASA) Overlay Zone requirements in the Spokane County Zoning Code, and Washington State Hazardous Materials handling and disposal requirements. The subject parcel is also located in the Spokane City Fringe Area as specified in Section 30 of the Comprehensive Plan. Section 30 provides specific policies for developing a planning process applicabte to the Fringe Area and includes specific guidance regarding the planning issues that should be addressed for the subject area. The City of Spokane was requested to evaluate this proposal for consistency with City Planning policies. The City responded, stating that the City has no comment. The purpose of Decision Guidelines therein is to provide means to determine whether or not a particular proposal within the Fringe ZE-24-01 Staff Report - February 13, 2002 Public Nearing Page 6 Ar,ea should be approved, condidoned, or, denied. The fiDllowing Spokane City Fringe Area Goal, Objectives 'and Decision Guidelines apply to the proposal. Fringe Area Goai 30.1 provides for a planning process which adequately protects existing and future living environments. Objective 30.1.a provides for present residents of the Spokane Fringe Area -a quality life`by using the Comprehensive Plan as a primary tool for guiding developmenL The above analysis to determine theproposal's consistency with the Compr,ehensive Plan Decision satisfles this Objective. Decision Guideline 30.1.2 recommends that land use plans should be established and adhered to for a reasonable periodof time to provide stability and eliminate need to reconstruct utility systems. The adoptlon of the Comprehensive Plan in 1981 together withlhe requirement,that development be consistent with said plan adeq'uatety,addresses this Dec'ision Guideline. Decision Guideline,30.1.4 specifles that urbanization and development of vacant urban areas and rehabilitation of exlsting older areas should be permitted when consistent with City; and .County Plan policies relating to utility services, open spa"ce, and altemative living environments. The proposal is an urban "in-fll"development utllizing cuRently available water, sewer and transportation capacity and' is therefore consistent with this Decision Guideline: Decision Guideline 30.1.6 ,specifles that new growth proposals within the Fringe Area should consider impacts upon the environmentand existing available resour,ce. The interagency review process-to included recommended conddions of approval adequately addresses this Decfsion Guideline. The proposats oonditions of approval and compliance witti all Spokane County Development regulations will assure environmental impacts are mitigated. : M . 7 t.s The proposal, as conditioned, is sdbstantially consistent~with the policies of the Industnal category of the Comprehensive Plan. The project sife is also located in the'Interim Urban Growth Area (IUGA) and the subject application is consistent with the requirements of Spokane County Growth Management Resolution 97-0321. Zoning: The purpose of the proposed Light Industrial (I-2) zone'is, to meet the, needs for industrial land identrfied in the Industrial, category of the Comprehensive Plan. Industrial 'uses will include processing; light assembly, freight handling and similar operations,,.all of a non-offensive nature. It is the intent of the Light Industrial'(I-2) zone to allow for these uses by making them compadblewith surrounding uses: General characterisdcs of,these areas include-paved roads and sidewalks, a full line of public services including manned fire protection and public transit accessibility. The proposed zone reclassiflcation implements the purpose and intent of the Llght Industrial (62) zone based on the availability of adequate power, telephone, police and fire protection services and in consideration of existing adjacent industrial zoning,and land uses, existing direct access -to two Principal Arterials, and based on the site's close proximity to Interstate 90 access ramps which are approximately one mile east of the subject~property: The proposed zone reclassification is generally consistent with the purpose and intent of the Light Industtrial (I-2) zone. Even though, the applicant submitted a site plan proposing a cash and carry retail warehouse facility,, the application is asking for zone,reclassification that allows fior the development of any use permitted1n the I-2 Zone. Therefore, this analysis does not address consistency of the warehouse proposal with the specific standards of the I-2 Zone. However, it, is noted that the warehouse proposal as condiOoned is generalty consistent'with requirements of the ,Light Industrial (I-2), Zone. Changed Conditions: Section 14.402.020(2) of the-Spokane County Zoning Code states that amendments to the zoning map may occur when it is found that "changes in economic,, technological, or land use conditions has occurred to warrant modifications.°' Conditions have not changed in the area of the proposal. Tliis section contemplates that the service infrastructure enhancement has occurred in the vicinity supporting more-intensive uses, and further, that a trend in the development of more intensive land uses has begun, justifying addidonal zone reclassifications.
