INTRODUCTION This matter has come before the Hearing Examiner Committee on September 23,
1993. The members of the Committee present are Harry Gibbons, Chairperson,
Frank Yuse and Phil Harris.
PROPOSAL
The sponsor, Dwight Hume, requests approval of a Zone Reclassification from
Heavy Indusmial (I-3) to Neighborhood Business (B-1) for a convenience store and
gas station, File No. ZE-32-93.
FINDINGS OF FACT AND CONCLUSIONS
1. The property is generally located at the northwest corner of the intersecrion of
Broadway Avenue and Fancher Road in the northeast 1/4 of Section 14, Township
25 N., Range 43 EWM.
2. The committee adopts the Planning Department Report as a part of this record.
3. The existing land use(s) in the area include industrial, a~*.:chnical school and service
shops.
4. The proposed use is compatible with existing uses in the area. 5. The Comprehensive Plan designates this site as Industrial. The Industrial category is
intended to provide the opportunity for Industrial development and reserve land for
Industrial purposes.
6. The proposed zoning may not implement and conform to the Comprehensive Plan.
7. The Arterial Road Plan designates Fancher Road and Broadway Avenue as Principal
Arterials, with a reconunended right of way width of 100 feet.
8. The existing zoning of the property described in the application is Heavy Industrial (1-
3), previously established as Manufacturing (M) zoning in 1941 and reclassified to
Heavy Industrial (I-3) on January l, 1991 pursuant to the Program to Implement the
Spokane County Zoning Code.
9. The provisions of RCW 43.21C (The State Environmental Policy Act) have been
complied with and a Determinarion of Nonsignificance was issued. The Committee,
after independent review, hereby adopts the DNS.
10. The.-legal requirements for public noace have been fulfilled.

11. The owners of adjacent lands expressed neither approval nor disagproval of the
proposed use. .
12. The applicant has demonstrated that conditions have substantially changed since the
original zoning of this area and accordingly, the proposed zone reclassification is
justified. 13. The proposed use will not be detrimental to the public health, saf.ety, morals or
welfare especially in light of the condirions recomrnended by the reviewing agencies.
CONDITIONS OR CONTINGENCIES APPLIED TO THIS APPROVAL *
1. All Conditions imposed by the Hearing Examiner CommiCtee shall be binding on the
"Applicant," which term shall include the owner or owners of the property, heirs,
assigns, and successors-in-interest.
2. The following Conditions of Approval apply to the real property described below:
Those portions of Lots 1, 2, 3, 4, 5,201 21, 22, 23, and 24, B lock 6 and of the
vacated alley adjoining said lots, in the Town of Yardley, according to the plat recorded
in Book E, at Page 68, in the NE 1/4 of Section 14, Township 25 North, Range 43
East, W.M., Spokane County, Washington described as follows:
Commencing at the southeast coi-ner of said Lot l; thence N89 48'07"W, along the
south line of said Lot 1, a distance of 40.00 feet to the POINT OF BEGINNING;
thence conrinuing N89 48'07"W, along the south line of said Lots 1,2,3,4, and 5, a
distance of 165.18 feet; thence N00 O l'OS "W, 189.92 feet; thence N89 48' 16"E,
205.24 feet to the east line of said Block b, thence S UO 00'02"E, along said east line
151.33 feet, thence S45 05'55"W, 56.47 feet to the POIN"I' OF BEGINNING;
EXCEPT any portion thereof conveyed by Nevco, Inc., a Washington Corporation, to
Spokane County by Statutory Warranty Deed recorded in Volume 1447 at Page 594,
under Auditor's File Number 9306230215. .
SPOKANE COUNTX PLANNING DEPARTMENT
1. The proposal shall comply with the Neig}iborhood Business (B-1) and Aquifer
Sensitive Area (ASA) Overlay zones as amended. -
2. The applicant shall develop subject property in substantial conformance within the
concept presented to the Hearing Body. Variations, when approved by the
Planning Director/designee, may be permitted, including, but not limited to building
locarion, landscape plans and general allowable uses of the permitted zone. All
variations must conform to regulations set forth in the Spokane County Zoning
Code, and the original intent of the development plans shall be maintained.
3. Approval is required by the Planning Director/designee of a specific lighting and
signing plan for the described property prior to the release of any building permits.
4. A specific land'scape plan, planting schedule and provisions for maintenance
acceptable to the Planning Director/designee shall be submitted with a performance

bond for the project prior to release of building permits. Landscaping shall be
. installed and maintained so that sight distance at access points is not obscured or
impaired.
5. Direct light from any exterior axea lighting fixture shall not extend over the property
boundary.
6. The Spokane County Planning Department shall prepare and record with the
County Auditor a Title Notice specifying a future land acquisition area for road
right-of-way and utiliries. The reserved future acquisition area Title Notice shall
only be released, in full or in part, by the Planning Department. The notice should
be recorded within the same rime frame as an appeal and shall provide the
following:
a. At least 10 feet of reserved future acquisition area for road right-of-way and
utilities, in addition to the existing and/or newly dedicated right-of-way along
Broadway Avenue.
b. Future building and other setbacks required by the Spokane County Zoning
Code shall be measured from the reserved future acquisition area.
c. No required landscaping, parking, '208' areas, drainfield or allowed signs
should be located within the future acquisition area for road right-of-way and
utilities. If any of the above improvements are made within this area, they
shall be relocated at the applicant's expense when roadway improvements are
made. d. The futur-, acquisition area, until acquired, shall be private properi;;- and may
be used as allowed in the zone, except that any improvements (sucn as
landscaping, parking, surface drainage, drainfield, signs or others) shall be
considered interim uses.
7. The Planning Department shall prepare and record with the Spokane County Auditor a
Title Notice noting that the property in question is subject to a variety of special
conditions imposed as a result of approval of a land use action. This Title Notice shall
serve as public notice of the conditions of approval affecting the property in question.
The Title Notice should be recorded within the same time frame as allowed for an
appeal and shall only be released, in full or in part, by the Planning Department. The
Title Notice shall generally provide as follows:

Prior To Issuance Qf A$uildinLy Pernut Ch Use Of The Propertv As Prouosed:
1. Access permits for approaches to the county road system shall be obtained from the
Spokane County Engineer.
2. The applicant shall subnut for approval by the Spokane County Engineer drainage
and access plans.
3. The applicant shall submit for approval by the Spokane Counry Engineer and the
Spokane County Health District a detailed combined on-site sewage system plan
and surface water disposal plan for the entire project, or portion thereof, if the
development is to be phased.
. 4. A parking plan and traffic circulation plan shall be submitted and approved by the
Spokane County Engineer. The design, location and arrangement of parking stalls
shall be in accordance with standard traffic engineering practices. 1'aving or
surfacing as approved by the County Engineer, will be required for any portion of
the project which is to be oc;cupied or traveled by vehicles.
5. The construcrion of the road improvements stated herein shall be accomplished as .
approved by the Spokane County Engineer.
6. The County Engineer has desi~nated Typical Roadway Section Number One, major
arterial standard for the improvement of Broadway Avenue, which is adjacent to the
proposed dey.elopment. The construction of sidewalk is also required.
7. All required improvements shall conform to the current State. of Washington
Standard Specifications for Road and Bridge Construction and other applicable
County standards and/or adopted resolutions pertaining to Road Standards and
Stormwater Management in effect at the date of construction, unless otherwise .
approved by the County Engineer.
8. Roadway standards, typical roadway sections and drainage plan requirements are
found in Spokane Board of County Commissioners Resolution No. 80-1592 as
amended and are applicable to this proposal.
9. No construction work shall be performed within the existing or proposed public
right-of-way until a permit has been issued by the County Engineer. All work
within the public road right-of-way is subject to inspection and approval by the
County Engineer.
10. All required construction within the existing or proposed public right-of-way is to
be completed prior to the release of a building pernut, or a bond in an amount
estimated by the County Engineer to cover the cost of construcaon of improvements
shall be filed with the County Engineer.
11. The County Arterial Road Plan identifies Broadway Avenue as a Principal Arterial.
The existing right-of-way width of varying feet is not consistent with that specified
in the Plan. In order to implement the Arterial Road Plan, in addition to the
required right-of-way dedicaaon, a strip of property 10 feet in width along the

Broadway Avenue frontage shall be set aside in reserve. This property may be
acquired by Spokane County at the time when arterial improvements are made to
Broadway Avenue. _
12. There may exist utilities, either underground or overhead, affecting the subject
property, including property to be dedicated or set aside for future acquisition.
Spokane County assumes no financial obligation for adjustments or relocation
regarding these utilities. Applicant(s) should check with the applicable utility
purveyor and the Spokane County Engineer to deternune whether applicant(s) or
the utility is responsible for adjustment or relocation costs and to make
arrangements for any necessary work.
SPOKANE COUNTY DIVISION OF UTILITIES
1. This project lies within the City of Spokane Sewer Service Area. Applicant is required
to notify them of this proposal.
SPOKANE COUNTY HEALTH DISTRICT
1. A combined surface water and sewage disposal detailed plan shall be approved by
the Spokane County Engineer and the Spokane County Health District prior to the
issuance of any on-site sewage disposal pernlit or building permit for this project.
2. Sewage disposal method shall be as authorized by the City of Spokane Public
Works.
3. Water service shall be coordinated through the City of Spokane Puolic Works.
4. Water service shall be by an existing public water.supply when approved by the
Regional Engineer (Spokane), State Department of Health.
5. Disposal of sewage effluent beneath paved surfaces is currently prohibited.
6. Subject to specific application approval and issuance of permits by the health
officer, the use of an individual on-site sewage disposal system may be authorized.
Current regularions do not allow on-site sewage systems in fill material/soil.
7. Use of private wells and water systems is prohibited.
BUILDING AND SAFETY DEPARTMENT CONDITIONS
1. The applicant shall contact the Department of Buildings at the earliest possible stage
of design/development in order to be informed of code requirements
administered/enforced_ as authorized by the State Building Code Act.
Design/development concerns include: ADDRESSING; FIRE A.PPARATUS .
ACCESS ROA.DS; FIRE HYDRANT/FLOW; APPROVED WATER SYSTEMS;
BUILDING ACCESSIBILYTY; CONSTRUCTION TYPE; OCCUPANCY
CLASSIFICAT'ION; EXITING; EXTERIOR WALL PROTECTION; AND
. ENERGY CODE REGULATIONS. (Note: The Division of Buildings reserves the
right to confum the-actual address at the time of building permit.) .

SPOKANE COUNTY AIR POLLUTION CONTROL AUTHORITY
1. All air pollution regulations must be met.
2. Air pollution regulations require that dust emissions during demolirion, construction
. and excavation projects be controlled. This may require use of water sprays, tarps,
sprinklers or suspension of activity during certain weather conditions. Haul roads
should be treated, and emissions from the transfer of earthen material must be
controlled, as well as emissions from all other construction-related activities.
3. All traveled surfaces (ingress, egress, parking areas, access roads) should be paved
and kept clean.
.4. Measures must be taken to avoid the deposirion of dirt and mud from unpaved
surfaces onto paved surfaces. If tracking or spills occur on paved surfaces,
measures must be taken immediately to clean these surfaces.
5. Debris generated as a result of this project must be disposed of by means other than
burning (i.e. construction waste, etc.)
6. Chapter 173-491 WAC requires that gasoline dispensing facilifies with an annual
throughput of 360,000 gallons or greater or new facilities with nominal storage capacity of greater than 10,000 gallons must install Stage I vapor recovery
equipment by December 31, 1993 or upon construction or upgrade to the facility.
SCAPCA is also requiring plumbing for Stage II at new facilities.
7. SCAPCA Regulation I, Article V, requires that a Notice of Cotlstruction and
Applicadon for Approval be subnuttecl to and approved by our agency prior to the
construction, installation or establishment of an air pollution source. A Notice of
Construction application must be filed with and approved by SCAPCA prior to the
_ installation of Stage I and Stage II equipment.
8. SCAPCA Regulation I, Article IV, requires registration with this Agency.
9. Failure to meet SCAPCA regulaaons may result in delays, closure and civil and/or
criminal sanctions.
SPOKANE COUNTY FIRE PROTECTION DISTRICT NO. 1
1. We will require the addition of two fire hydrants located on the Northeast and
Southwest corners of the property with adequate protection from vehicle damage.
Also, Knox Box entry system will be required if the store is not to be open 24 hours.

II. SITE INFORMATION
A. Site Size: Approximately 31,000 square feet
B. Comprehensive Plan 1. Land Llse Plan: The proposal is located within the Industrial category of the Comprehensive Plan and within the Priority Sewer Service Area
(PSSA). The Industrial category of the Comprehensive Plan is intended to .
provide the opportunity for industrial development and reserve land for

industrial purposes, with few commercial and residential uses found. The
proposed Neighborhood Business (B-1) zone is intended to implement the
Urban, Suburban and Major Commercial categories of the Comprehensive
Plan. The proposed Neighborhood Business (B-1) zone is not compatible
with the Goa1s, Objectives, and Decision Guidelines of the Industrial
category of the Comprehensive Plan.
2. Arterial Road Plan: The Spokane County Arterial Road Plan designates
Fancher Road and Broadway Avenue as Principal Arterials with future
right-of-way widths of 100 feet. In order to implement the Plan, the
County Engineer is requesting a strip of property 10 feet in width along
Broadway Avenue be set aside as future acquisition area (FAA). The
' County Engineer is not requesting dedication or future acquisition area -
(FAA) along Fancher Road.
C. Site Characteristics: The site is currently vacant and covered with brush,
weeds and cement surfaces in some areas. The site is flat and an approximate six
(6) foot high cyclone fence is adjacent to Broadway Avenue and Fancher Road.
. D. Neighborhood Characteristics: The surrounding area consists of a mixture
of uses including a trade school; sales, services, manufacturing and other
industrial related uses.
E. Zoning Analysis: The existing zoning of the subject property and the
surrounding area is Heavy Industrial (I-3). Prior to implementarion of the
Spokane County Zoning Code on January l, 1991, the site and adjoining
proper~es were zoned Manufacturing (M) under the previous Spokane County
Zoning Ordinance. The area has not been subject to any recent zone
reclassification requests.
The proposed Neighborhood Business (B-1) zone is not consistent with the
Industrial category Goals, Objectives, and Decision Guidelines. If approved, this
proposal may establish a precedent for future requests.for commercial zoning.

F. Land Use Analysis: Phillips Junior College is located north of the site and a
commercial fuel station is located west of the site on the north side of Broadway
Avenue. Uses to the east include a construction office and ASC Machine Tools,
Inc. On the southeast corner of Broadway and Fancher is a vacant restaurant.
Site: The existing land use is vacant. The site was previously the Carny
Pole property.
North: vacant land and Phillips Junior College.
South: supply store, and electronic service center.
East: Acme Construction office and ASC Machine Tools, Inc. West: commercial fuel station and vacant land.
G. Circulation: The site fronts on Broadway Avenue and Fancher Road which
wrll provide direct access to the site. One ingress/egress approach is proposed
from both Broadway Avenue and Fancher Road. All internal circulation and
parking areas will be paved.
H. Design: The proposal is located on a parcel approximately 31,000 square feet in
size. The proposed convenience store is loc;ated in the northwest corner and the
gas pump islands are located withi.n the southeast corner of the parcel. Parking
L spaces are located adjacent the convenience store and along the pump islands. Q

Proposed Buffering/Landscaping Techniques: The proposed site
plan illustrates landscaping along all propercy lines. Width of plandngs
range from 5 feet to 30 feet. Type III landscaping is proposed along
Fancher Road and Broadway Avenue and Type IV is proposed along the
north and west property lines. The proposed landscaping exceeds the
minimum required by the Zoning Code for the proposed use.
Other Site Plan Considerations: The site plan proposed generally
conforms to the development standards of the Neighborhood Business
(B-1-) zone.
The site plan submitted for review by the Hearing Examiner Committee is
general in nature. Detailed review to deternune compliance with all Code
regulations and conditions of approval is recommended to be administrative
and to occur at the Building Permit stage.
I. Drainage: A drainage plan is required. This plan must be reviewed and
approved by the Spokane County Engineer prior to development.
L. Power Transmission Lines/Other Known Easements: The site plan
illustrates two (2) access easements to the parcel located north and west of the
site.
M. Water Supply: The proposal is within the City Of Spokane water service area.
Provisions for water service will be required prior to the issuance of building
permits.
N. Sewage Disposal: An individual on-site sewage disposal system will be
utilized for sewage disposal as authorized by the Spokane County Health District.
0. School: The proposal is in the Spokane School Distr.ict No. 81. No cominents
were received from the school district. .
P. Fire Protection: The proposal is within Fire District No. 1. The Fire District
and the Division of Buildings Department (Fire Marshall) are required to approve fire protection provisions prior to the issuance of building pernuts.
Q. Wetlands: Spokane County Wedand Inventory Maps do not indicate the
presence of wetlands on the site.
R. Cultural Resources: None have been identified.
S. Transit: The proposal is located within the Public Transit Benefit Area (PTBA)
boundary. Two (2) routes, #15;Crosstown and #17;East Spokane provide
service adjacent the site. _

III. ENVIRONMENTAL REVIEW: An Environmental Checklist was submitted by the sponsor and was reviewed by
the County Planning Department. The review considered the specifics of the
proposal, other available infornlation, County ordinances, other regulaaons and
laws, possible standard Conditions of Approval, the Generalized Comprehensive
Plan, and other Counry policies and guidelines. The Planning Department has
determined that "No probable significant adverse impacts" would result from the
proposal being developed and has issued a Deternunation of NonsiEnificance
("DNS
The "DNS" was circulated to 13 other agencies of jurisdiction and other
agencies/departments affected by the future development for review and comment. .
The "DNS" comment period ends September 21, 1993 and was advertised 15
- calendar days before said date in the newspaper, by letter to adjacent property
owners within 400 feet of the proposal, and by notice on a sign posted on the
proposal site. The Hearing Examiner may consider additional envixonmental related
testimony at the public hearing.
IV. PLANNING DEPARTMENT SUMMARY AND RECOMMENDATION
The proposed Neighborhood Business (B-1) zone is not consistent with the Goals,
Objectives, and Decision Guidelines of the Industrial category of the Comprehensive
Plan. If approved, a precedent may be established for future requests to commercial
zones in an area intended for existing and future industrial uses. The Planning _
Department therefore must'recommer•ici denial.

SPOKANE COUNTY PLANNING DEPARTMENT
1. The proposal shall comply with the Neighborhood Business (B-1) and Aquifer
Sensitive Area (ASA) Overlay zones as amended.
2. The applicant sha11 develop subject property in substantial conformance within the
concept presented to the Hearing Body. Variations, when approved by the
Planning Director/designee, may be permitted, including, but not limited to building
location, landscape plans and general allowable uses of the pernutted zone. A11
variations must conform to regulations set forth in the Spokane County Zoning
Code, and the original intent of the development plans shall be maintained.
3. Approval is required by the Planning Director/designee of a specific lighting and
signing plan for the described property prior to the release of any building permits.
4. A specific landscape plan, planting schedule and provisions for maintenance
acceptable to the Planning Director/designee shall be submitted with a performance
bond for the project prior to release of building pernzits. Landscaping shall be
installed and maintained so that sight distance at access points is not obscured or
impaired.
5. Direct light from any exterior area lighting fixture shall not extend over the property
boundary. 6. The Spokane County Planning Department shall prepare and record with the
County Auditor a Title Notice specifying a future land acquisition area for road right-of-way and utilities. The reserved future acquisition area Title Notice shall
only be released, in full or in part, by the Planning Department. The notice should
be recorded within the same rime frame as an appeal and shall provide the
following: .
a. At least 10 feet of reserved future acquisition area for road right-of-way and
utilities, in addition to the existing andJor newly dedicated right-of-way along
Broadway Avenue. b. Future building and other setbacks required by the Spokane County Zoning
Code shall be measured from the reserved future acquisition area.
c. No required landscaping, parking, '208' areas, drainfield or allowed signs
should be located within the future acquisition area for road right-of-way and
utilities. If any of the above improvements are made within this area, they
shall be relocated at the applicant's expense when roadway improvements are
made.
d. The future acquisirion area, unril acquired, shall be private property and may
be used as allowed in the zone, except that any improvements (such as
landscaping, parking, surface drainage, drainfield, signs or others) shall be
considered interim uses..

7. The Planning Department shall prepare and record with the Spokane County Auditor a
Title Notice noting that the property in question is subject to a variety of special
conditions imposed as a result of approval of a land use action. This Title Notice shall

serve as public notice of the conditions of approval affecting the property in question. .
The Title Notice should be recorded within the same rime frame as allowed for an appeal and shall only be released, in full or in part, by the Planning Department. The
. Title Notice shall generally provide as follows:

SPOKANE COUNTY DIVISION OF ENGINEERING AND ROADS Prior To Issuance Of A Buildine Permit Or Use Of The Propertv As Prooosed:
1. Access permits for approaches to the county road system shall be obtained from the
Spokane County Engineer.
2. 1'he applicant shall submit for approval by the Spokane County Engineer drainage
and access plans.
3. The applicant shall submit for approval by the Spokane County Engineer and the
Spokane County Health Disti-ict a detailed combined on-site sewage system plan
and surface water disposal plan for the entire project, or pomon thereof, if the development is to be phased.
4. A parking plan and traffic circulation plan shall be submitted and approved by the
Spokane County Engineer. The design, locarion and arrangement of parking stalls
shall be in accordance with standard traffic engineering practices. Paving or
surfacing as approved by the County Engineer, will be required for any portion of
the project which is to be occupied or traveled by vehicles.
5. The construction of the road improvements stated herein shall be accomplished as
approved by the Spokane County Engineer.
6. The County Engineer has designated Typical Roadway Secrion Number One, major
arterial standard for the improvement of Broadway Avenue,
which is adjacent to the proposed development. The construction of sidewalk is
also required. ,
7.- All required improvements shall conform to the current State of Washington
Standard Specifications for Road and Bridge Construction and other applicable
County standards and/or adopted resolutions pertaining to Road Standards and Stormwater Management in effect at the date of construction, unless otherwise
approved by the County Engineer.

8. Roadway standards, typical roadway sections and drainage plan requirements are
found in Spokane Board of County Commissioners Resolution No. 80-1592 as
amended and are applicable to this proposal.
9. No constnuction work shall be performed within the existing or proposed public
right-of-way until a permit has been issued by the County Engineer. All work
within the public road right-of-way is subject to inspection and approval by the
County Engineer. .
10. All required construction within the existing or proposed public right-of-way is to
be completed prior to the release of a building pernut, or a bond in an amount
estimated by the County Engineer to cover the cost of construction of improvements
shall be filed with the County Engineer.
11. The County Arterial Road Plan idenrifies Broadway Avenue as a Principal Arterial.
The existing right-of way width of varying feet is not consistent with that specified
in the Plan. In order to implement the Arterial Road Plan, in addition to the
required right-of-way dedication, a strip of property 10 feet in width along the
Broadway Avenue frontage shall be set aside in reserve. This property may be
acquired by Spokane County at the time when arterial improvements are made to
Broadway Avenue.
12. There may exist utilities, either underground or overhead, affecang the subject
property, including property to be dedicated or set aside for future acquisition.
Spokane County assumes no financial obligaaon for adjustments or relocation
regarding these utilities. Applicant(s) should check with the applicable utility
purveyor and the Spokane County Engineer to deternune whether applicant(s) or
the utility is responsible for adjustment or relocation costs andto make
arrangements for any necessary work.
SPOKANE COUNTY DIVISION OF UTILITIES 1. This project lies within the City of Spokane Sewer Service Area. Applicant is required
to notify them of this proposal.
SPOKANE COUNTY HEALTH DISTRICT
1. A cornbined surface water and sewage d.isposal detailed plan shall be approved by
the Spokane County Engineer and the Spokane County Health District prior to the
issuance of any on-site sewage disposal permit or building pernut for this project.
2. Sewage disposal method shall be as authorized by the City of Spokane Public
Works.
3. Water service shall be coordinated through the City of Spokane Public Works.
4. Water service shall be by an existing public water supply when approved by the
Regional Engineer (Spokane), State Department of Health.
5. Disposal of sewage effluent beneath paved surfaces is currently prohibited.

6. Subject to specific application approval and issuance of permits by the health
officer, the use of an individual on-site sewage disposal system may be authorized.
Current regulations do not allow on-site sewage systems in fill material/soil.
7. Use of private wells and water systems is prohibited.
BUILDING AND SAFETY DEPARTMENT CnNDITIONS
1. The applicant shall contact the Department of Buildings at the earliest possible stage
' of designldevelopment in order to be informed of code requirements
administeredJenforced as authorized by the State Building Code Act.
Design/development concerns include: FYRE APPARATUS ACCESS ROADS;
FIRE HYDRANT/FLOW; APPROVED WATER SYSTEMS; BUILDING
ACCESSIBILITY; CONSTRUCTION TYPE; OCCUPANCY
_ CLASSIFICATION; EXITING; EXTERIOR WALL PROTECTION; AND
ENERGY CODE REGULATIONS. (Note: The Division of Buildings reserves the
right to confirm the actual address at the time of building permit.)
SPOKANE COUNTY AIR PQLLUTION CONTROL AUTHORITY
1. All air pollution regulations must be met.
2. Air pollution regulations require that dust emissions during demolition, construction
and excavation projects be controlled. This may require use of water sprays, tarps,
. sprinklers or suspension of activity during certain weather conditions. Haul roads
should be treated, and emissions from the transfer of earthen material must be ~
controlled, as well as emissions from all other construction-related activities. 3. All traveled surfaces (ingress, egress, parking areas, access roads) should be paved
and kept clean.
4. Measures must be taken to avoid the deposition of dirt and mud from unpaved
surfaces onto paved surfaces. If tracking or spills occur on paved surfaces,
measures must be taken immediately to clean these surfaces.
5. Debris generated as a result of this project must be disposed of by means other than
burning (i.e. construction waste, etc.)
6. Chapter 173-491 WAC requires chat gasoline dispensing facilides with an annual
throughput of 360,000 gallons or greater or new facilities with nominal storage
capaciry of greater than 10,000 gallons must install Stage I vapor recovery
equipment by December 31, 1993 or upon construction or upgrade to the facility.
SCAPCA is also requiring plumbing for Stage II at new facilities.
7. SCAPCA Regulation I, Article V, requires that a Notice of Constrtiiction and
Application for Approval be submitted to and approved by our agency prior to the
. construction, installation or establishment of an air pollution source. A Notice of
Construction application must be filed with and approved by SCAPCA prior to the
installarion of Stage I and Stage II equipment.
8. SCAPCA Regulation I, Article N, requires registration with this Agency.
