ZONE RECLASSIFICATION NO.: ZE- 4-87 VARIANCE NO.: VE-13-87 SPOKANE COUNTY HEARING EXAMINER COMMITTEE FINDINGS AND ORDER A. INTRODUCTION This matter having come before the Zoning Hearing Examiner Committee on April 2, 1987, and the members of the Committee present being Jim Schurra, Chairman, Ron Odell and Phillip D. Harris. 6. PROPOSAL The sponsors, Neil W. Simpson, Jr, and Dennis E. Dunham, are requesting approval of a zone reclassification, File No. ZE-4-87, Agricultural to Light Industrial (I-2) Zone, for the purpose of converting an existing residence to a- contracto r's office and general industrial uses. Also, a request for a Variance, File No. VE-13-87, to allow an industrial use on property having 50-feet of frontage and 6,250 square feet; whereas, the Zoning Code requires 90-feet of frontage and 15,000 square feet. And, to allow a 2-foot wide landscape strip along the west property line and a 5-foot wide landscape strip along the east property line; whereas, the Zoning Code requires a 20-foot wide landscape strip in both locations. C. FINDINGS OF FACT 1. That the existing land use in the area is residential, industrial, contractor's yard and storage. 2. That the Comprehensive Plan designates this area as appropriate for Industrial development. 3. That the existing zoning of the property described in the application i s Agri cul tu ral . 4. That the provisions of RCW 43.21C (The State Environmental Policy Act) have been complied with, and the Committee concurs with the Determination of Non-Significance. 5. That the proper legal requirements for advertisement of the Agenda Item have been fulfilled. 6. FINDINGS OF FACT (continued) 7. That the applicant has demonstrated that conditions have substantially changed since the original zoning of this area and accordingly, the proposed rezone and variance are justified. 8. That the proposed use is compatible with existing uses in the area. 9. That the owners of adjacent lands expressed neither approval nor disapproval of the proposed use. 10. The Hearing Examiner Committee finds the proposed use to be in harmony with the general purpose and will not be otherwise detrimental to the public health, safety, and welfare. 11. The following are additional findings of fact considered by the Hearing Examiner Committee: a) That due to the character of the area, i.e., changing from residential to industria], the requested variances are justifiable. b) That the proposed zone change to I-2 is consistent with the Comprehensive Plan and the zoning trend for this area. c) That the site's size and frontage are adequate for the proposed use and still provides for screening to the adjacent single family residences. 2 ZONE RECLASSIFICATION NO.: ZE- 4-87 VARIANCE NO.: VE-13-87 D. CONDITIONS OR CONTINGENCIES APPLIED TO THIS APPROVAL (All Conditions imposed by.the Zoning Hearing Examiner Committee shall be binding on the "Applicant", which term shall include the owner or owners of the property, heirs, assigns, and successors.) a) COUNTY PLANNING DEPARTMENT SPECIAL: 1. That the cedar fence and vegetation as shown on the submitted site plan dated April 2, 1987, shall be installed prior to use of the property for industrial purposes or as a contractor's office. STANDARD: 2. Approval by the Zoning Administrator of a specific lighting and signing plan fo r the described prope rty prio r to the release of any building permits. 3. A specific landscape plan, planting schedule and provisions for maintenance acceptable to the Spokane County Zoning Administrator shall be submitted with a performance bond for the project prior to release of building permits. Landscaping shall be installed and maintained such that sight distance at access poi nts i s not obscured or impai red. 4. The applicant shall develop subject property generally in acco rdance within the concept presented to the Hearing Examiner Committee. Va riations when approved by the Zoning Administrator will be permitted, including, but not limited to the following changes: Building location, landscape plans, and general allowable uses of the permitted tone. All variations must conform to regulations set forth in the ZONING CODE FOR SPO KANE COUNTY. The original intent of the development plans shall be maintained. 5. All cu rrent standards of the Light Industrial (I-2) Zone, as amended, shall be complied with in the development of this site. 6. That the present proposal is not detailed enough to determine whether ornot the use of or material s stored on the si te are in compliance with Section 7.06 (Aquifer Sensitive Area Overlay Zone) of the ZONING CODE FOR SPOKANE COUNTY. Accordingly, as a condition of approval, the sponsor/applicant shall be required to file with the Spokane County Audito r, within thirty (30) days of the signing of Findings and Order of the final decision in this matter, a"Notice to the Public" which shall provide in material as follows: 3 'nNE RECLASSIFICATION NO.: ZE- 4-57 VARIANCE NO.: VE-13-87 a) COUNTY PLANNING DEPARTMENT. Applicant shall comply with '208' recommendations concerning stormwate r runoff and provide necessary landscaping for runoff. b) COUNTY ENGINEERING DEPARTMENT Prior To The Issuance Of A Building Permit: STANDARD: l. Access permits for approaches to the County Road System shall be obtained from the Spokane County Engineer. 2. Applicant shall submit for approval by the Spokane County Engineer road, drainage, and access plans. 3. The applicant shall submit for approval by the Spokane County Engineer a detailed combined on-site sewage system plan and surface water disposal plan for the entire project or any po rtion thereof, if the development is to be phased. 4. A parking plan and traffic circulation plan shall be submitted and approved by the Spokane County Engineer. The design, location, and arrangement of parking stalls shall be in accordance with standard traffic engineering practices. Paving or surfacing as approved by the County Engineer, will be required for any portion of the project which is to be occupied or traveled by vehicles. 5. Roadway standards, typical roadway sections and drainage plan requirements are found in Spokane Board of County Commissioners' Resolution No. 80-1592 as amended and are applicable to this proposal. SPECIAL: 6. To construct the road improvements stated herein, the applicant may, with the approval of the County Engineer, join in and be a willing participant in any petition or resolution which purpose is the formation of a Road Improvement District (RID) for said improvement pursuant to RCW 36.88, as amended. Spokane County will not participate in the cost of these improvements. 4 ZONE RECLASSIFICATION NO.: ZE- 4-87 VARIANCE NO.: YE-13-87 b) COUNTY ENGINEERING DEPARTMENT (continued) SPECIAL: - - (continued) 7. As an alternative method of constructing the road improvement stated herein, the applicant may, with the approval of the County Engineer, accomplish the stated road improvements by joining and participating in a County Road Project (CRP) to the extent of the required road improvement. Spokane County will not participate in the cost of these improvements. 8. The County Engineer has designated Typical Roadway Section Number One, Access Street standard for the improvement of Cataldo Avenue which is adjacent to the proposed development. This will require the addition of approximately 10 to 12 feet of asphalt, curb and sidewalk along the f rontage of the development. 9. Applicant shall sign and record Spokane County Notice to the Public #b which specifies the following: The owner(s) or successor(s) in interest agree to authorize the County to place their name(s) on a petition for the formation of a Road Improvement District (RID) by the petition method pursuant to Chapter 36.88 RCW, which petition includes the owner(s) property, and further not to object, by the signing of a ballot, the formation of a RID by the resolution method pursuant to Chapter 36.88 RCW, which resolution includes the owner(s) property. If a RID is formed by either the petition or resolution method, as provided for in Chapter 36.88 RCW, the owner(s) or successor(s) further agree: (1) that the improvements or construction contemplated within the proposed RID is feasible, (2) that the benefits to be derived from the formation of the RID by the property included therein, together with the amount of any County participation, exceeds the cost and expense of formation of the RID, and (3) that the property within the proposed RID is sufficiently develo ped. Provided, further, the owner(s) o r successor(s) shall retain the right, as authorized under RCW 36.88.090, to object to any assessment(s) on the property as a result of the improvements called for in conjunction with the formation of a RID by either petition or resolution method under Chapter 36.88 RCW. c) COUNTY UTILITIES DEPARTMENT STANDARD: l. Pursuant to Board of County Commissioners Resolution No. 80-0418, the use of on-site sewer disposal systems is hereby authorized. This authorization is conditioned on compliance with all rules and regulations of the Spokane County Nealth District and is further conditioned and subject to specific application approval and issuance of permits by the Nealth District. 5 ZONE RECLASSIFICATION NO.: ZE- 4-87 VARIANCE NO.: VE-13-87 c) COUNTY UTILITIES DEPARTMENT (continued) _ ' STANDARD: (continued) • 2. The owner(s) or Successor(s) in interest agree to authorize the County to place their name(s) on a petition for the formation of a ULID by petition method pursuant to RCW 36.94 which the petition includes the Owner(s) property and further not to object by the signing of a protest petition against the formation of a ULID by resolution method pursuant to RCW Chapter 36.94 which includes the Owner(s) property. PROVIDED, this condition shall not prohibit the Owner(s) or Successor(s) from objection to any assessment(s) on the property as a result of improvements called for in conjunction with the formation of a ULID by either petition or resolution method under RCW Chapter 36.94. 3. Any water service for this project shall be provided in accordance with the Coordinated Water System Plan for Spokane County, as amended. d) COUNTY HEALTH DISTRICT STANDARD l. A combined surface water and sewage disposal detailed plan shall be approved by the County Engineer and Spokane County Health District prio r to the issuance of any on-site sewage disposal permit or building permit for this project. 2. Sewage disposal method shall be as authorized by the Director of Utilities, Spokane County. , 3. Water service shall be coordinated through the Director of Utilities, Spokane County. 4. Disposal of sewage effluent beneath paved surfaces is currently prohibited. 5. Use of private wells and water systems is prohibitive. SPECIAL: 6. Subject to specific application approval and issuance of permits by the Health Office r, the use of an individual on-site sewage disposal system may be authorized. note: The sponsor shall provide evidence that the existing on-site system was property installed and sized large enough to accommodate the proposed project. 6 ZONE RECLASSIFICATION NO.: ZE- 4-81 VARIANCE NO.: VE-13-87 e) COUNTY BUILDING AND SAFETY,DEPARTMENT STANDARD: - - l. The site is located in Fire District # 1. 2. No change shall be made in the character of occupancies or use of any building which would place the building in a different division of the same group of occupancy or in a different group of occupancies, without first obtaining a change in use permit from the Departmnent of Building and Safety. 3. The Department of Building and Safety will require the applicant to identify critical materials and submit design requirements for the containment prior to the issuance of a building permit. 4. Commercial dumpsters and containers with an individual capacity of 1.5 cubic yards or greater shall not be stored or placed within five feet of combustible walls, openings or combustible roof eave lines. 5. The applicant shall provide written verification from the Fire District to the Department of Building and Safety that provisions have been made for adequate fire protection prior to the release of building permits. SPECIAL 6. Site contains existing buildings and structures which are subject to code requirements involving either demolition permits or change i n use permi ts. f) WATER PURVEYOR 1. Water Purveyor is City of Spokane, and they will supply the site with adequate water for domestic, fire and irrigation uses. g) COUNTY AIR POLLUTION CONTROL AUTHORITY Al1 air pollution regulations must be met. This includes but is not limited to the following: STANDARD: 1. Air pollution regulations require that dust emissions during demolition, excavation and construction projects be controlled. This may require use of water sprays, tarps, sprinklers, or suspension of activity during certain weather conditions. Haul roads should be treated and emissions from the transfer of earthen material must be controlled as well as emissions from all other construction related activities. '7 , w . Measures must be taken to avoid the deposition of dirt and mud from unpaved surfaces onto paved surfaces. If tracking or spills occur on paved surfaces, measures must be taken immediately to clean these surfaces. 3. SCAPCA Regulation I. Article V requires that a Notice of Construction and Application for Approval be submitted to and approved by our Agency prior to the construction, installation or establishment of an air pollution source. SPECIAL: 4. All travelled surfaces (ingress, egress, parking areas, access roads) must be paved and kept clean. Storage areas must be dust free or treated with a dust palliative. E. ORDER The Zoning Hearing Examiner Committee, pursuant to the aforementioned, finds that the application of Neil W. Simpson, Jr, and Dennis E. Dunham for a tone reclassification as described in the application should be APPROVED to the LIGHT INDUSTRIAL (I-2) ZONE. Also, the request for a variance for lot frontage, lot area and landscape width requirements as described in the application should be APPROVED. Variance Considerations: As described earlier, the applicant is requesting a Variance to allow a contractor's yard on property smaller and with less frontage than required by the I-2 Zone. REYIEW An Environmental Checklist was subrnitted by the sponsor and was reviewed by the County Plann.ing Department. The review considered the specifics of the proposal, other-available information, County ordinances, other regulations and laws, possible standard Conditions of Approval, the Generalized Comprehensive Plan, and other County policies and guidelines. The Zoning Administrator has determined that "No probable significant adverse impacts" would result from the proposal being developed and has issued a Determination of Non-Significance ("DNS"). The "DNS" was circulated to nine other agencies of jurisdiction and other agencies/departments affected by the future development for review and comment. The "DNS" comment period ends April 1, 1987, and was advertised 15 calendar days before said date in the newspaper, by letter to adjacent property owners within 400 feet of the proposal, and by notice on a sign posted on the pro posal site. The Hearing Examiner Committee may consider additional environmental related testimony and the "DNS" at the public hearing. V. PLANNING SUMMARY The proposed zone change to I-2 is consistent with the Comprehensive Plan and the Zoning trend for this area.
