SITE SIZE: Approximately 25,857 Square Feet (Total All 3 Lots) COMPREHENSIVE PLAN DESIGNATION: URBAN PRIORITY SEWER SERVICE AREA: Yes AQUIFER SENSITIVE AREA: Yes PROJECT LOCATION: Generally located south of Sixth Avenue, approximately 150 feet west of Carnahan Road in Section 23-25-43. II. BACKGROUND ANALYSIS 1) COMPREHENSIVE PLAN: The Urban category is intended to provide for primarily residential uses at various densities. 2) ZONING: North Agricultural, Established, 1949 Agricultural Suburban, Estab. 1956 Residential Manufactured Home, Est. 1969 East Agricultural Suburban, Est. 1958 & 1970 West Agricultural Suburban, Estab. 1958 Agricultural, Established, 1949 South Local Business, Established, 1957 Agricultural, Established, 1949 Agricultural Suburban, Estab. 1978 / r ~ ZONE RECLASSIFICATION N0. ZE-113-84 II. BACKGROUND ANALYSIS (continued) 3) HISTORY OF LAND USE ACTIONS: This immediate area has not been the subject of any land use actions in the recent past. Property to the south was zoned Local Business in 1957 for a grocery and variety store expansion to a food locker. Today's proposal itself was zoned Agricultural Suburban as part of Wilcox Addition, in 1958. The biggest land use action affecting this area, as well as the whole County, was a 1979 amendment to the Spokane County Zoning Ordinance which allowed Manufactured Homes in all Agricultural Zones and double-wide Manufactured Homes in all Agricultural Suburban Zones. The effect was that this present site is allowed only double-wides, while land to the north and west is permitted both single and double-wide Manufactured Homes. 4) LAND USE: Site Vacant North Residential (including standard construction and manufactured housing) and animal keeping. East Residential (including standard construction and manufactured housing) South Food locker, residential, and animal keeping. West Residential (including standard construction and manufactured housing and a greenhouse. S) NEIGHBORHOOD CONSIDER.ATIONS: The area is predominately an older single family neighborhood consisting of standard construction housing and both single and double-wide manufactured homes. The two outstanding non-residential uses are the food locker and a greenhouse. Roads in the area have minimal improvements. Sixth Avenue is narrow and paved without curbs or sidewalks. Improvements to Sixth Avenue are recommended through a RID/CRP. This site is within a drainage basin having stormwater runoff problems and within a Flood Hazard Zone. The County Engineer has recommended special conditions relative to these situations. ~ ~ ~ ~ ~ZONE RECLASSIFICATION N0. ZE-113-84 III. SITE ANALYSIS 1) SITE CHARACTERISTICS AND CONSIDERATIONS: The site is relatively flat without significant vegetation. ' 2) AGRICULTURAL SITriMARY: Urban category of the Comprehensive Plan not intended for agricultural protection. 3) SITE PLAN INFORMATION: SITE SIZE: Approximately 25,857 Square Feet (Total All 3 Lots) Lot 3: Approximately 9,126 Square Feet Lot 4: Approximately 9,126 Square Feet Lot S: Approximately 7,605 Square Feet EXISTING BUILDINGS: 0 PROPOSED BUILDINGS: 3 Residential Structures (1 Per Individual Platted Lot) OTHER SITE PLAN CONSIDERATIONS: Primary purpose for the rezone request is to permit consistency of use between these three parcels and adjoining properties. The Residential Manufactured Home Zone _ would allow the same residential uses as does the Agricultural Zone; single-caide and double-wide manufactured houses as well as standard construction dwellings. IV. CONCLUSION: Approval of the Residential Manufactured Home Zone would be consistent with the Comprehensive Plan and residential uses allowed in the adjoining Agricultural Zones. The keeping of farm animals, however, is not permitted in the Residential Manufactured Home Zone as it is in the Agricultural Zone. r . ~ ZONE RECLASSIFICATION N0. ZE-113-84 V. RECOMMENDED AGENCY CONDITIONS, IF APPROVED: (All Conditions imposed by the Zoning Hearing Examiner Committee shall be binding on the "Applicant", which term shall include the owner or owners of the property, heirs, assigns, and successors.) a) COUNTY PLANNING DEPARTMENT 1. All current standards of the Residential Manufactured Home.Zone, _ as amended, shall be complied with in the development of this site. 2. That the project is subject to Section 4.16A.050, the Aquifer Sensitive Area Overlay Zone of the Spokane County Zoning Ordinance, which sets forth various measures for Aquifer protection; specifically, measures dealing with wastewater disposal, spill protection measures, and stormwater runoff. 3. Any division of land for the purpose of sale, lease or transfer, shall comply with RCW 58-17 and the Spokane County Platting Ordinances prior to issuance of building permits. 4. That. the provisions of SEPA's NOTICE OF ACTION pursuant to Chapter 43.21C,080 RCW and the Board of Spokane County Commissioners Resolution #77-1392 be initiated by the project applicant within thirty (30) days of final disposition of this application, and prior to any on-site improvements. b) COUNTY ENGINEERING DEPARTMENT Prior To The Issuance Of A Building-Permit: 1. Access permits for approaches to the County Road System shall be obtained from the Spokane County Engineer. 2. Applicant shall improve Sixth Avenue in a manner consistent with Spokane County TYPICAL roadway section No. 2 minimum paving width Access Standard. 3. The applicant shall submit for approval by the Spokane County Engineer and the Spokane County Health District a detailed combined on-site sewage system plan and surface water disposal plan for the entire project prior to the issuance of any building permit on the property. 4. The word "applicant" shall include the owner or_owners of the property, his heirs, assigns, and successors. 17 , • ~ I, ZONE RECLASSIFICATION N0. ZE-113-84 b) COUNTY ENGINEERING DEPARTMENT (continued) 5. To construct the road improvements stated herein, the applicant may, with the approval of the County Engineer, join in and be a willing participant in any petition or resolution which purpose is the formation of a Road Improvement District (RID) for said improvement pursuant to RCW 36.88, as amended. Spokane County will not participate in the cost of these improvements. 6. As an alternative method of constructing the road improvement stated herein, the applicant may, with the approval of the County Engineer, accomplish the road improvements stated herein by joining and participating in a County Road Project (CRP) to the extent of the required road improvement. Spokane County will not participate in the cost of these improvements. 7. The construction of the road improvements stated herein shall be accomplished as approved by the Spokane County Engineer. 8. Roadway standards, typical roadway sections and drainage plan requirements are found in Spokane Board of County Commissioners'Resolution No. 80-1592 as amended and are applicable to this proposal. 9. This plat or development proposal is located within a drainage basin which has been identified by the Spokane County Engineer's Office as having stormwater runoff problems. Since this plat or development proposal is affected by or is a contributor to stormwater flows, property owners should participate in the planning and implementation of a future basinwide stormwater management system. The following "Condition of Approval" shall be required: That the owner(s) or successor(s) in interest agree to join in any County approved Stormwater Management Program and to pay such rates and charges as may be fixed through public hearings for service or benefit obtained by the planning, design, constructing, maintaining, or operation of stormwater control facilities. • 10. The property within this proposal may be affected by a designated Flood Hazard Zone. Therefore, the provisions of the National Flood Insurance Program are applicable. A permit must be obtained from the County Engineer prior to the placement or construction of any structure on the parcels or prior to any excavation. P~ - o ZONE RECLASSIFICATION N0. ZE-113=84 c) COUNTY UTILITIES DEPARTMENT 1. Pursuant to Board of County Commissioners Resolution No. 80-0418, the use of on-site sewer disposal systems is hereby authorized. This authorization is conditioned on compliance with all rules and regulations of the Spokane County Health District and is further conditioned and subject to specific application approval and issuance of permits by the Health District. 2. The owner(s) or Successor(s) in interest agree to authorize the County to place their name(s) on a petition for the formation of a ULID by petition method pursuant to RCW 36.94 which the petition includes the Owner(s) property and further not to object by the signing of a protest petition against the formation of a ULID by resolution method pursuant to RCW Chapter 36.94 which includes•the Owner(s) property. PROVIDED, this condition shall not prohibit the Owner(s) or Successor(s) from objection to any assessment(s) on the property as a result of improvements called for in conjunction with the formation of a ULID by either petition or resolution method under RCW Chapter 36.94. 3. Any water service for this project shall be provided in accordance with the Coordinated Water System Plan for Spokane County, as amended. 4. Each dwelling unit shall be double-plumbed for connection to future areawide collection systems. d) COUNTY HEALTH DISTRICT 1. Sewage disposal method shall be as authorized by the Director of Utilities, Spokane County. 2. Subject to specific application approval and issuance of permits by the Health Officer, the use of an individual on-site sewage system may be authorized. . 3. The site is located in Fire District # 1. 2, Approved numbers or addresses shall be placed on all new and existing buildings in such a position as to be plainly visible and legible f rom the street or road f ronting the property. Said numbers shall contrast with their background. 3. A land use permit will be required for each structure. 4. Mains and hydrants shall be installed in accordance with the requirements of the Spokane County Department of Building and Safety. f) WATER PURVEYOR 1. Water Purveyor is Carnhope Water District, and they will supply the site with adequate water for domestic, fire and irrigation uses. g) COUNTY AIR POLLUTION CONTROL AUTHORITY 1. Air pollution regulations require that dust emissions during demolition, excavation and construction projects be controlled. This may require use of water sprays, tarps, sprinklers, or suspension of activity during certain weather conditions. Haul roads should be treatel and emissions from the transfer of earthen material must be controlled as well as emissions from all other construction related activities. 2. Measures must be taken to avoid the deposition of dirt and mud from unpaved surfaces onto paved surfaces. If tracking or spills occur on paved surfaces, measures must be taken immediately to clean these surfaces. 3. A11 travelled surfaces (ingress, egress, parking areas, access roads) must be paved and kept clean. 4. All air pollution regulations must be met. - ep m cri. ZE-113-84 SPOKANE COUNTY HEARING EXAMINER COMMITTEE . FINDINGS AND ORDER , A. INTRODUCTION This matter having come before the Zoning Hearing Examiner Committee on January 3, 1985, and the members of the Committee present being Jane E. Myers, Chairperson, F. Lynn Tennican and Richard L. Skalstad. B. PROPOSAL The sponsor, Victor Hamilton, is requesting approval of a zone reclassification, File No. ZE-113-84, Agricultural Suburban to Residential Manufactured Home, for the purpose of developing Manufactured Homes on Three Individual Lots. C. FINDINGS OF FACT 1. That the existing land use in the area is residential, greenhouse, food locker, and animal keeping. 2. That the Comprehensive Plan designates this area as appropriate for Urban development. 3. That the existing zoning of the property described in the application is Agricultural Suburban. 4. That the provisions of RCW 43.21C (The State Environmental Policy Act) have been complied with, and the Committee concurs with the Declaration of Non-Significance. 5. That the proper legal requirements for advertisement of the Agenda Item have been fulfilled. 6. That the land in this area is suitable for the proposed use, or uses within the proposed Zone Classification. 7. That the applicant has demonstrated that conditions have substantially changed since the original zoning of,this area and accordingly, the proposed rezone is justified. 8. That the proposed use is compatible with existing uses in the area. 1 • 1 ZONE RECLASSIFICATION N0. ZE-113-84 C. FINDINGS OF FACT (continued) 9. That the owners of adjacent lands expressed neither approval nor disapproval of the proposed use. 10. The Hearing Examiner Committee finds the proposed use to be in harmony with the general purpose and will not be otherwise detrimental to the public health, safety, and welfare. 11. The following are additional findings of fact considered by the Hearing Examiner Committee: a) That through testimony at the public hearing, the Hearing Examiner Committee learned of an existing 30-foot easement on the west boundary of Lot S, coupled with a required S-foot setback from the east boundary of said Lot, which would leave only a 30-foot buildable site. Also, there is a possibility that the proposed site lies within a Flood Hazard Zone. However, the soil types in this area appear to be adequate for septic tanks. But then building area minus easements and setbacks results in a minimal amount of land remaining for alternative siting of necessary development. b) That a 65-foot width is the minimum f rontage requirement for a manufactured home lot size within the Residential Manufactured Home Zone. That to be consistent with the Spokane County Zoning Ordinance and the best future land use, the applicant shall work with the Short Plat Administrator to accomplish a minor lot line adjustment for the subject three (3) lots, which would create three (3) lots of 64-foot width for each piece of property; or that Lot 3 remain at its present configuration, but Lots 4 and S be joined under one ownership and a deed restriction be filed of record with the County Auditor. c) That the request for single-wide manufactured homes appears to be consistent with adjacent development, but that the lots be developed with new manufactured housing of materials that resemble conventional housing. It is not necessary that double-wide manufactured homes be placed on the proposed sites. d) That the single family residences along the south border of the subject site and the Local Business Zone are accessed by the 20-foot easement. The front yards of those residences would be seriously infringed upon, if the easement were increased or widened to create additional access along this easement. e) The Hearing Examiner Committee notes that the Local Business use adjacent to the south is now low in intensity but may in fact enlarge in the future. This being the potential for all concerned, the Committee must assume both easements are likely to continue providing access. 2 ZONE RECLASSIFICATION N0. ZE-113-84 C. FINDINGS OF FACT (continued) CONDITIONS ADDED BY THE HEARING EXAMINER COMMITTEE: That a deed restriction be filed of record with the County Auditor which ' states: 1. "That single-wide manufactured housing is allowed on Lots 3, 4, and S of Wilcox Addition, but these are to be NEW units of materials that resemble conventional housing."' 2. "That the applicant work with the Short Plat Administrator to accomplish a"Minor Lot Line Adjustment" for the subject three (3) lots, which would create three (3) lots; Lots 3 and 4 would be reduced to 64-feet in width, with the portions remaining to be joined with Lot 5, all within the Plat known as Wilcox Addition"; or "That Lot 3 of Wilcox Addition may remain at its present configuration, but that Lots 4 and 5 of Wilcox Addition be joined under one ownership to allow one residence and shall not be sold as separate lots. These restrictions shall run with the land and shall not be removed unless approved by Spokane County." D. CONDITIONS OR CONTINGENCIES APPLIED TO THIS APPROVAL (All Conditions imposed by the Zoning Hearing Examiner Committee shall be binding on the "Applicant", which term shall include the owner or owners of the property, heirs, assigns, and successors.) a) COUNTY PLANNING DEPARTMENT 1. All current standards of the Residential Manufactured Home Zone, as amended, shall be complied with in the development of this site. 2. That the project is subject to Section 4.16A.050, the Aquifer Sensitive Area Overlay Zone of the Spokane County Zoning Ordinance, which sets forth various measures for Aquifer protection; specifically, measures dealing with wastewater disposal, spill protection measures, and stormwater runoff. 3. Any division of land for the purpose of sale, lease or transfer, shall comply with RCW 58-17 and the Spokane County Platting Ordinances prior to issuance of building permits. 4. That the provisions of SEPA's NOTICE OF ACTION pursuant to Chapter 43.21C.080 RCW and the Board of Spokane County Commissioners Resolution #77-1392 be initiated by the project applicant within thirty (30) days of final disposition of this application, and prior to any on-site improvements. 3 ZONE RECLASSIFICATION N0. ZE-113-84 b) COUNTY ENGINEERING DEPARTMENT Prior To The Issuance Of A Building Permit: 1. Access permits for approaches to the County Road System shall be obtained from the Spokane County Engineer. 2. Applicant shall improve Sixth Avenue in,a manner consistent with Spokane County TYPICAL roadway section No. 2 minimum paving width Access Standard. 3. The applicant shall submit for approval by the Spokane County Engineer and the Spokane County Health District a detailed combined on-site sewage system plan and surface water disposal plan for the entire project prior to the issuance of any building permit on the property. 4. The word "applicant" shall include the owner or owners of the property, his heirs, assigns, and successors. 5. To construct the road improvements stated herein, the applicant may, with the approval of the County Engineer, join in and be a willing participant in any petition or resolution which purpose is the formation of a Road Improvement District (RID) for said improvement pursuant to RCW 36.88, as amended. Spokane County will not participate in the cost-of-these improvements. 6. As an alternative method of constructing the road improvement stated herein, the applicant may, with the approval of the County Engineer, accomplish the road improvements stated herein by joining,and participating in a County Road Project (CRP) to the extent of the required road improvement. Spokane County will not participate in the cost of these improvements. 7. The construction of the road improvements stated herein shall be accomplished as approved by the Spokane County Engineer. 8. Roadway standards, typical roadway sections and drainage plan requirements are found in Spokane Board of County Commissioners'Resolution No. 80-1592 as amended and are applicable to this proposal. 4 . . ZONE RECLASSIFICATION N0. ZE-113-84 b) COUNTY ENGINEERING DEPARTMENT (continued) 9. This plat or development proposal is located within a drainage basin which has been identified by the Spokane County Engineer's Office as having stormwater runoff problems. Since this plat or development proposal is affected by or is a contributor to stormwater flows, property owners should participate in the planning and implementation of a future basinwide stormwater management system. The following "Condition of Approval" shall be required: That the owner(s) or successor(s) in interest agree to join in any County approved Stormwater Management Program and to pay such rates and charges as may be fixed through public hearings for service or benefit obtained by the planning, design, constructing, maintaining, or operation of storanwater control facilities. 10. The property within this proposal may be affected by a designated Flood Hazard Zone. Therefore, the provisions of the National Flood Insurance Program are applicable. A permit must be obtained froID"the County Engineer prior to the placement or construction of any structure on the parcels or prior to any excavation. c) COUNTY UTILITIES DEPARTMENT 1. Pursuant to Board of County Commissioners Resolution No. 80-0418, the use of on-site sewer disposal systems is hereby authorized. This authorization is conditioned on compliance with all rules and regulations of the Spokane County Health District and is further conditioned and subject to specific application approval and issuance of permits by the Health District. 2. The owner(s) or Successor(s) in interest agree to authorize the County to place their name(s) on a petition for the formation of a ULID by petition method pursuant to RCW 36.94 which the petition includes the Owner(s) property and further not to object by the signing of a protest petition against the formation of a ULID by resolution method pursuant to RCW Chapter 36.94 which includes the Owner(s) property. PROVIDED, this condition shall not prohibit the Owner(s) or Successor(s) from objection to any assessment(s) on the property as a result of improvements called for in conjunction with the formation of a ULID by either petition or resolution method under RCW Chapter 36.94. 3. Any water service for this project shall be provided in accordance with the Coordinated Water System Plan for Spokane County, as amended. 4. Each dwelling unit shall be double-plumbed for connection to future areawide collection systems. 5 J , J ZONE RECLASSIFICATION N0. ZE-113-84 d) COUNTY HEALTH DISTRICT 1. Sewage disposal method shall be as authorized by the Director of Utilities, Spokane County. 2. Subject to specific application approval and issuance of permits by the Health Officer, the use of an individual on-site sewage system may be suthorized. 3. Water service shall be coordinated through the Director of Utilities, Spokane County. 4. Water service shall be by an existing public water supply when approved by the Regional Engineer (Spokane), State Department of Social and Health Services. 5. Use of private wells and water systems is prohibited. e) COUNTY BUZLDING AND SAFETY DEPARTMENT 1. The site is located in Fire District # 1. 2. Approved numbers or addresses shall be placed on all new and existing buildings in such a position as to be plainly visible and legible f rom the sCreet or road fronting the property. Said numbers shall contrast wfth their background. 3. A land use permit will be required for each structure. 4. Mains and hydrants shall be installed in accordance with the requirements of the Spokane County Department of Building and Safety. f) WATER PURVEYOR 1. Water Purveyor is Carnhope Water District, and they will supply the site with adequate water for domestic, fire and irrigation uses. 6 • ~ ZONE RECLASSIFICATION N0. ZE-113-84 g) COUNTY AIR POLLUTION CONTROL AUTHORITY 1. Air pollution regulations require that dust emissions during demolition, excavation and construction pro3ects be controlled. This may require use of water sprays, tarps, sprinklers, or suspension of activity during certain weather conditions. Haul roads should be treated and emiesions from the transfer of earthen material must be controlled as well as emissions from all other construction related activities. 2. Measures must be taken to avoid the deposition of dirt and mud from unpaved surfaces onto paved surfaces. If tracking or spills occur on paved surfaces, measures must be taken immediately to clean these surfaces. 3. All travelled surfaces (ingress, egress, parking areas, access roads) must be paved and kept clean. 4. All air pollution regulations must be met. E.
