This matter has come before the Hearing Examiner Committee on June 22, 1995.
The members of the Comrruttee present are: Verona Southem, Chair, Brenda
Bodenstein and Jane Myers.
PROPOSAL
The sponsors, Sharon Ha1UJi11 Pestrin, request approval of a Zone Reclassification,
ZE-16-95, from Neighborhood Business (B-1) to Urban Residential-3.5 (UR-3.5)
for one single-family residence and those uses allowed in the proposed Urban
Residential-3.5 (UR-3.5) zone.
FINDINGS OF FACT AND CONCLUSIONS
1. The property is generally located west of and adjacent to Carnahan Road,
approximately 120 feet south of Sixth Avenue in the NW 1/4 of Section 23,
Township 25 North, Range 43 EWM, Spokane County, Washington.
2. The Committee adopts the Planning Department Report as a part of this record.
3. The existing land uses in the area include single family residences, truck
parking/storage, greenhouse, pasture and open space.
4. The proposed use is compatible with existing uses in the area.
5. The property is located within the Urban (U) category of the Comprehensive Plan,
the Aquifer Sensitive Area (ASA), and the Priority Sewer Service Area (PSSA).
The Urban (U) category is intended to provide the opportunity for development of a
"city-like" environment which includes various land uses, a variety of housing
rypes and densities, and public facilities and services. The proposal is located in aa
area that is developed and established with a variety of residential densities, ranging
from 6,000 square feet to 2.2 acres in size. The proposed zone reclassification
from Neighborhood Business (B-1) to Urban Residential-3.5 (UR-3.5) is a"down-
zone" in intensity and serves to implement the Goals, Objectives and Decision
Guidelines of the Urban category of the Comprehensive Plan.
6. The proposed zoning does implement and conform to the Comprehensive Plan.
7. The Arterial Road Plan designates Carnahan Road as a Minor Arterial, with a future
right-of-way width of SO feet. In order to implement the Arterial Road Plan, it is
recommended that in addition to the required right-of-way dedication, a strip of
property 15 feet in width along the Camahan Road frontage be set aside in reserve
as a Future Acquisition Area.

8. The existing zoning of the property described in the application is Neighborhood
Business (B-1) established in 1991, previously established as Local Business (LB)
zoning in 1957 and redesignated to Neighborhood Business (B-1) on January 1,
1991 pursuant to the Program to Implement the Spokane County Zoning Code.
The proposal does confonn to the requirements of the proposed zone.
9. The provisions of RCW 43.21 C(The State Environmental Policy Act) have been
complied with and a Determination of Nonsignificance (DNS) was issued. The
Committee, after independent review, hereby adopts the DNS.
10. The legal requirements for public notice have been fulfilled.
11. The owners of adjacent lands expressed neither approval nor disapproval of the
proposed use.
12. The applicant has demonstrated that conditions have substantially changed since the
original zoning of this area and accordingly, the proposed zone reclassification is
justified. Specifically, changed conditions include adoption of the Spokane County
Zoning Code and the Spokane County Comprehensive Plan.
13. The proposed use will not be detrimental to the public health, safety, morals or
welfare especially in light of the conditions recommended by the reviewing
agencies.
14. The Committee additionally finds/concludes:
a. The applicant accepts and agrees with all the recommended conditions of
approval.
CONDITIONS OR CONTINGENCIES APPLIED TO THIS APPROVAL
1. All Conditions imposed by the Hearing Examiner Committee shall be binding on
the "Applicant," which term shall include the owner or owners of the property,
heirs, assigns, and successors-in-interest.
2. The Zone Reclassification applies to the real property described below:

COUNTY, WASHINGTON.
SPOKANE COUNTY PLANNING DEPARTMENT
1. The proposal shall comply with the Urban Residential-3.5 (UR-3.5) zone as
amended.
2. The applicant shall develop subject property generally in accordance within the concept
presented to the Hearing Body. Variations, when approved by the Planning
Director/designee, may be permitted, including, but not limited to building location,
landscape plans and general allowable uses of the permitted zone. All variations must
conform to regulations set forth in the Spokane County Zoning Code, and the original
intent of the development plans shall be maintained.

3. The Planning Department shall prepare and record with the Spokane County Auditor a
Title Notice noting that the property in question is subject to a variety of special
conditions imposed as a result of approval of land use action. This Title Notice shall
serve as public notice of the conditions of approval affecting the property in question.
The Tit1e Notice should be recorded within the same time frame as allowed for an
appeal and shall only be released, in full or in part, by the Planning Departxnent. The
Title Notice shall generally provide as follows:
The parcel of property legally described as [ ] is the subject of a
land use action by a Spokane County Hearing Body or Administrative
Of~icial on [ imposing a variety of special development
conditions. File No. [ ] is available for inspection and copying in
the Spokane County Planning Department.
4. The Spokane County Planning Department shall prepare and record with the
County Auditor a Tit1e Notice specifying a future land acquisition area for road
right-of-way and utilities. The reserved future acquisition area Title Notice shall be
released, in full or in part, by the Planning Department. The notice should be
recorded within the same time frame as an appeal and shall provide the following:
a. At least 15 feet of reserved future acquisition area for road right-of-way and
utilities, in addition to the existing andlor newly dedicated right-of-way along
Carnahan Road. NOTE: The County Engineer has required 10 feet of new
dedication.
b. Future building and other setbacks required by the Spokane Counry Zoning
Code shall be measured from the reserved future acquisition area.
c. No required landscaping, parking, '208' areas, drainfield or allowed signs
should be located within the future acquisition area for road right-of-way and
utilities. If any of the above improvements are made within this area, they
shall be relocated at the applicant's expense when roadway improvements are
made.
d. The future acquisition area, until acquired, shall be private property and may
be used as allowed in the zone, except that any improvements (such as
landscaping, parking, surface drainage, drainfield, signs or others) shall be
considered interim uses.
SPOKANE COUNTY DIVISION OF ENGINEERING AND ROADS
Prior to issuance of a building pernut or at the request of the County Engineer in conjunction
with a County Road Project/Road Improvement District, whichever comes first:
1. Applicant shall dedicate 10 feet on Carnahan Road for right-of-way.
Prior to release of a building pernut or use of property as proposed:
2. Access permits for approaches to the County Road System shall be obtained from the
County Engineer.

3. To construct the road improvements stated herein, the applicant may, with the
approval of the County Engineer, join in and be willing to participate in any petition
or resolution which purpose is the formation of a Road Improvement District (RID)
for said improvements pursuant to RCW 36.88, as amended. Spokane County will
not participate in the cost of these improvements. This provision is applicable to
Carnahan Road.
4. As an alternative method of constructing the road improvements stated herein, the
applicant may, with the approval of the Counry Engineer, accomplish the road
improvements stated herein by joining and participating in a County Road Project
(CRP) to the extent of the required road improvements. Spokane County will not
participate in the cost of these improvements. This provision is applicable to
Carnahan Road.
5. The construction of the roadway improvements stated herein shall be accomplished as
approved by the Spokane County Engineer.
6. 1`he County Engineer has designated a Collector Arterial Roadway Section for the
improvement of Carnahan Road, which is adjacent to the proposed development.
This will require the addition of approximately 9-11 feet of asphalt along the
frontage of the development. Curbing must also be constructed.
7. All required improvements shall conform to the current State of Washington
Standard Specifications for Road and Bridge Construction and other applicable
County standards andlor adopted resolutions pertaining to Road Standards and
Stormwater Management in effect at the date of construction, unless otherwise
approved by the County Engineer.
8. Roadway standards, typical roadway sections and drainage plan requirements are
found in Spokane Board of County Commissioners Resolution No. 90-0498 as
amended and are applicable to this proposal.
9. No construction work shall be performed within the existing or proposed public
right-of-way until a permit has been issued by the County Engineer. All work
within the public road right-of-way is subject to inspection and approval by the
County Engineer.
10. Applicant shall sign and record Spokane County Notice to the Public No. 6 which
specifies the following:
The owner(s) or successor(s) in interest agree to authorize the County to place tlleir
name(s) on a petition for the formation of a Road Improvement District (RID) by
the petition method pursuant to Chapter 36.88 RCW, which petition includes the
owner(s) property. If an RID is formed by either the petition or resolution method,
as provided for in Chapter 36.88 RCW, the owner(s) or successor(s) further agree:
(a) that the improvement or construction contemplated within the proposed RID is
feasible;
(b) that the benefits to be derived from the formation of the RID by the property
included therein, together with the amount of any County participation,
exceeds the cost and expense of formation of the RID; and
(c) that the property within the proposed RID is suff'iciently developed.

Provided further that the owner(s) or successor(s) shall retain the right, as
authorized under RCW 36.88.090, to object to any assessment on the property as a
result of the improvements called for in conjunction with the formation of the RID
by either petition or resolution method under Chapter 36.88 RCW.
This provision is applicable to Camahan Road, from which the subject parcel takes
access.
11. The Counry Arterial Road Plan identifies Carnahan Road as an 80 foot Minor
Arterial. The existing right-of-way width of 40 feet is not consistent with that
specified in the Plan. In order to implement the Arterial Road Plan, it is
recommended that in addition to the required right-of-way dedication, a strip of
property 15 feet in width along the Carnahan Road frontage shall be set aside in
reserve. This property may be acquired by Spokane County at the time when
arterial improvements are made to Carnahan Road.
12. The applicant should be advised that there may exist utilities, either underground or
overhead, affecting the applicant's property, including property to be dedicated or
set aside for future acquisition. Spokane County will assume no financial
obligation for adjustments or relocation regarding these utilities. The applicant
should check with the applicable utilities and the Spokane County Engineer to
detennine whether applicant or the utility is responsible for adjustment or relocation
costs and to make arrangernents for any necessary work.
SPOKANE COUNTY DIVISION OF UTILITIES
1. Any water service for this project shall be provided in accordance with the Coordinated
Water System Plan for Spokane County, as amended.
2. Pursuant to the Board of County Commissioners Resolution No. 80-0418, the use of
on-site sewer disposal systems is hereby authorized. This authorization is conditioned
in compliance with all rules and regulations of the Spokane County Health District and
is further conditioned and subject to specific application approval and issuance of
permits by the Health District.
3. A covenant agreement shall be signed stating: The Owner(s) or Successor(s) in interest
agree to authorize the County to place their name(s) on a petition for the formation of a
ULID by petition method pursuant to RCW 36.94 which the petition includes the
Owner(s) property and further not to object by signing of a protest petition against the
formation of a ULID by resolution method pursuant to RCW 36.94 which includes the
Owner(s) property. PROVIDED, this condition shall not prohibit the Owner(s) or
Successor(s) from objection to any assessment(s) on the property as a result of
improvements called for in conjunction with the formation of a ULID by either petition
or resolution under RCW 36.94.
4. A dry sewer connection to the future area-wide Public Sewer System is to be
constructed.

SPOKANE COUNTY HEALTH DISTRICT
1. Sewage disposal method shall be as authorized by the Director of Utilities, Spokane
County.
2. Water service shall be coordinated through the Director of Utilities, Spokane County.
3. Water service shall be by an existing public water supply when approved by the
Regional Engineer (Spokane), State Department of Health.
4. Subject to specific application approval and issuance of permits by the Health Officer,
the use of an individual on-site sewage disposal system may be authorized.
5. Use of private wells and water systems is prohibited.
SPOKANE COUNTY AIR POLLUTION CONTROL AUTHORITY
1. All air pollution regulations must be met.
2. A.ir pollution regulations require that dust emissions during construction and excavation
projects be controlled. This may require the use of water sprays, tarps, sprinklers or
suspension of activity during certain weather conditions. Haul roads should be treated
and emissions from the transfer of earthen material must be controlled as well as
emissions from all other construction related activities.
3. SCAPCA strongly recommends that all traveled surfaces (i.e., ingress, egress, parking
areas, access roads) be paved and kept clean to minimize dust emissions.
4. Measures must be taken to avoid the deposition of dirt and mud from unpaved surfaces
onto paved surfaces. If tracking or spills occur on paved surfaces, measures must be
taken immediately to clean these surfaces.
5. Debris generated as a result of this project must be disposed of by means other than
burning (i.e., construction waste, etc.).
6. All solid fuel burning devices (wood stoves, pellet stoves, etc.) must comply with
local, state, and federal rules and regulations.
SPOKANE COUNTY DIVISION OF BUILDINGS
1. The applicant shall contact the Department of Buildings at the earliest possible stage in
order to be informed of code requuements administered/enforced as authorized by the
State Building Code Act. Design/development concerns include: Addressing, fire
apparatus access roads, fire hydrant/flow, approved water systems, building
accessibility, construction type, occupancy classification, exiting, exterior wall
protection, and energy code regulations. (Note: The Department of Buildings reserves
the right to confirm the actual address at the time of building permit.)

ORDER
The Hearing Examiner Committee, pursuant to the above Findings of Fact and
Conclusion, APPROVES the application of Sharon HalUJill Pestrin for the Zone
Reclassification from Neighborhood Business (B-1) to Urban Residential-3.5 (UR-3.5)
for one single-family residence and those uses allowed in the proposed Urban
Residential-3.5 (UR-3.5) zone as described in the application ZE-16-95.

The following "Conditions of Approval" for the above referenced zone change
application are submitted to the Spokane County Hearing Examiner Committee
for inclusion in the "Planning Report" and "Findings and Order" of the public
hearing scheduled June 22, 1995.
E36A Prior to issuance of a building permit or at the request of the County

participating in a County Road Project (CRP) to the extent of the
required improvement. Spokane County wi11 not participate in the cost of
these improvements. This provision is applicable to Carnahan Road.
E48 The construction of the roadway improvements stated herein shall be
accomplished as approved by the Spokane County Engineer.
E50 The County Engineer has designated Typical Roadway Section Number
2.Local Access Standard for the improvement of Carnahan Road which is
adjacent to the proposed development. This will require the addition of
approximately 9-11 feet of asphalt along the frontage of the
development. Curbing must also be constructed.
E51 All required improvements shall conform to the current State of
Washington Standard Specifications for Road and Bridge construction and
other applicable county standards and/or adopted resolutions pertaining
pertaining to Road Standards and Stormwater Management in effect at the
date of construction, unless otherwise approved by the County Engineer.
E55 Roadway standards, typical roadway sections and drainage plan
requirements are found in Spokane Board of County Commissioners
resolution 80-1592 as amended and are applicable to this proposal.
E58 No construction work is to be performed within the existing or proposed
right of way until a permit has been issued by the County Engineer. All
work within the public road right of way is subject to inspection and
approval by the County Engineer.
E60 Applicant shall sign and record Spokane County Notice to the Public No.
6 which specifies the following:
The owner(s) or successor(s) in interest agree to authorize the County
to place their name(s) on a petition for the formation of a Road
Improvement District (RID) by the petition method pursuant to Chapter
36.88 RCW, which petition includes the owner(s) property. If a RID is
formed by either the petition or resolution method, as provided for

the improvements called for in conjunction with the formation of the
RID by either petition or resolution method under Chapter 36.88 RCW.
This nrovision is anolicable to Carnahan Road from which the sublect
zaarcel takes accesa.
E61 The County Arterial Road plan identifies Carnahan Road as an 80 foot
Minor Arterial. The existing right of way width of 40 feet is not
consistent with that specified in The Plan. In order to implement the
Arterial Road Plan it is recommended that in addition to the required
right of way dedication, a strip of property 15 teet, in width along the
Carnahan Road frontage be set aside in reserve. This property may be
acquired by Spokane County at the time when Arterial Improvements are
made to Carnahan Road,.
E90 The applicant should be advised that there may exist utilities
either underground or overhead affecting the applicants
property, including property to be dedicated or set aside future
acqui"sition. Spokane County will assume no financial obligation
for adjustments or relocation regarding these utilities. The
applicant should check with the applicable utilities and Spokane
County Engineer to determine whether the applicant or utility is
responsible for adjustment or relocation costs and to make
arrangements for any necessary work.
