II. FINDINGS OF FACT AND CONCLUSIONS
The Hearing Examiner has reviewed the zone reclassification application and the
evidence of record and adopts the following findings of fact and conclusions:
A. GENERAL INFORMATION:

Washington.
Legal Description: That portion of the Northwest quarter of the Southwest quarter of Section 23,
Township 25 N., Range 43 EWM in Spokane County, Washington; described as follows:
BEGI7VNING on the North line of the Plat of Woodland Terrace, as recorded in volume "I" of Plats,

City Fringe Area, Priority Sewer Service Area, the Aquifer Sensitive Area and the Urban Impact
Area designated in the Comprehensive Plan.
Environmental Review: A Determination of Nonsignificance was issued by the Division
of Building and Plaru1ing on May 23, 1997.
Site Description: The site is approximately .31 acres in size and is vacant and undeveloped.
The site topography is relatively flat and vegetation includes native trees, shrubs and weeds. The
applicant's combined ownership slopes moderately uphill toward its east boundary and
moderately downhill to the south. The property is located within the Interim Urban Growth Area
(IUGA) boundary.
Surrounding Conditions: The surrounding area consists of single-family residences at
urban densities surrounding a former surface mine and vacant undeveloped parcels. The surface
mine is located immediately east of the site and other lots lying along the east side of Havana
Street. A cyclone fence separates the mine from such properties, and the mine property drops off
steeply a few feet from the fence. Havana Street terminates at Pratt Avenue to the south, and a
church is located at the southwest corner of the intersection of such streets. The City of Spokane
appears to run west of the centerline of Havana Street in the vicinity of the site.
Project Description: The site plan illustrates a proposed single-family residence on a lot
that is bisected by two zoning classifications. The southerly portion of the lot (approximately
13,844 square feet) is zoned Urban Residential-3.5 (UR-3.5), was created through Certificate of
Exemption CE-424-95(A), and is not part of the rezone proposal. The northerly portion of the lot
(approximately 13,887 square feet) is zoned Mining (MZ) and is the portion of the entire
ownership subject to the proposed zone reclassification. The purpose of the zone reclassification
is to change the portion of the lot zoned Mimng (MZ) to Urban Residential-3.5 (UR-3.5) to allow
construction of a single-family residence and to allow for a subsequent lot line adjustment to
recognize aggregation of the separate parcels. The residence will be served with public sewer
and water by the City of Spokane.

C. ZONE RECLASSIFICATION ANALYSYS:
In considering a rezone application, Washington case law generally provides that (1) there
is no presumption in favor of the rezone, (2) the applicant for the rezone must prove that
conditions have substantially changed in the area since the last zoning of the property, and (3) the
rezone proposal must bear a substantial relationship to the public health, safety or welfare.
Parkridee v. Seattle, 98 Wn. 2d 4542 462 (1978); Biarnson v. Kitsan Countv, 78 Wn. App. 840
(1995). Spokane County Zoning Code Section 14.402 (1)(2) indicates that consistency with the
Comprehensive Plan, detriment to the public welfare and changed circumstances are relevant
criteria to consider when a site-specific rezone is sought.
The proposed rezone must also be consistent with the Spokane County Zoning Code, the
State Environmental Policy Act, the County's Local Environmental Ordinance, and other
applicable land use regulations. Conditions may be imposed to assure the consistency of the
proposal with applicable regulations.
The following findings of fact and conclusions are made:
1. The proposal Renerallv conforms with the Snokane Countv Generalized Comvrehensive Plan.
A county's comprehensive plan provides guidance to the hearing body in making a rezone
decision. Belcher v. Kitsan Countv, 60 Wn. App. 949, 953 (1991). Deviation from a
comprehensive plan does not necessarily render a rezone illegal, only general conformance is
required. Bassani v. Countv Commissioners, 70 Wn. App. 389, 396 (1993).
A. Apalicable volicies
The proposal is designated in the Urban category of the Comprehensive Plan. The Urban
category is intended to provide the opportunity for a"citylike" environment, which includes
various land uses, residential development and a high level of public facilities and urban
services. It is primarily a residential category of single-family, two-family, multi-family, and
condominium buildings along with neighborhood commercial, light industrial, and public and
recreational facilities. The more intensive uses such as light industrial and neighborhood
commercial will be located near the heavily traveled streets, the least intensive single-family
residential uses will be isolated from the noise and heavy traffic, and multifamily structures
will usually be a transitional use located between single-family residential and the more
intensive areas. See Comprehensive Plan, Section 1, "Purpose" and "Detailed Definition".

The Urban category includes the following relevant objectives and decision guidelines:
Objective l.l.a Promote fill-in within established development areas and
existing outlying communities where utilaties, arterials, schools and
community facilities have already been established.
Decision Guideline 1.1.1 Urban development will be approved in areas
having adeqarate power supplies, water, sanitary and storm sewers,
streets, and school and fcre services, provicled that szcch development
meets the tntent of other Objectives and Decision Gacidelines of this
section.
Deczsion Guideltne 1.1.4 A variety of densities and residential uses
should be available to provide a freedom of choice to live in Urban areas
with varyzng densities, combinations, or mix of uses (see detaaled Urban
definitions).
Decision Guideline 1.2.2 The neecl for recreation and open space created
by residential developments should be met and be in conformance with
ordinances, plans, and policies prior to residential development approval.
Decision Guideline 1.3.3 All Urban development proposccls should
Yequire public sanitary and storm sewer systems or interim sewer systems
to protect water quality.
Decision Guideline 1.4.2 Areas with steep slopes, susceptability to
landslides, or other hazards should not have Urban land uses unless it is
shown by the tleveloper that such hazard areas can be developed at Urban
densities.

from excsting adjacent land uses where aclverse effects may develop.
Decision Guideline 1.5.1 Bufferirtg and/or landscaping wzll be used to

Decision Guideline 1.61 Before land use proposals are approved they
should:
a) conform to plans, policies and regulations of County water, sewer, storm sewer,
utility and special service districts;
b) conform to County transportation plans and policies; and
c) identify and take steps to resolve significant adverse impacts upon existing
utilities, (i.e. water, sanitary and storm sewers, utility, available and future
energy resources), and traffic systems.
The property is also within the Urban Impact Area (UTA) designated in the Comprehensive
Plan. This is an area where growth, development and higher intensities of land use are
encouraged. Comprehensive Plan, Objective 14.1.a. The UTA section of the Comprehensive
Plan indicates that traditional urban problems such as incompatible land uses, environ.mental
pollution and traffic congestion will be managed with greater attention to the general public's
well-being inside the UTA. Comprehensive Plan, Objective 14.1.e. The site is also located
within the County's interim urban growth area established under the State Growth Management
Act, an area where urban densities are encouraged.
The site is also located within the Spokane City Fringe Area designated by the
Comprehensive Plan. The Fringe Area policies indicate that the Comprehensive Plan should
be used as a primary tool for guiding development, and encourages growth and revitalization
of portions of the Fringe Area which have already experienced development.
2. Application of policies to proUOSaI
The applicant proposes to rezone the site to the Urban Residential-3.5 (UR-3.5) zone. The
purpose and intent of the UR-3.5 zone is set forth in Zoning Code 14.616 as follows:
The purpose of the UR-3.5 zorie is to implement the lower density rarige of
the Urban category of the CompYehensive Plan. The intent of the zo»e is
to promote areas of primarily single fafitrly residerttial use in an urbccnized
neighborhood setting, having u high level of public servaces. Lots shall be
seYVed by a public water system and shall require conriection to a public
central sewer system when available. Roadways shall be paved and
curbed and may have sidewalks.
The Staff Report found the proposal to be consistent with the policies of the Urban category
and the Spokane City Fringe Area. No public testimony or written information was offered in
opposition to the proposal. The City of Spokane offered no obj ection to the proposal, and
indicated that public sewer and water area was available in Havana Street 5-20 feet south of the
site. The proposal fits in well with the other new homes constructed along the east side of
Havana Street in the vicinity.
The only public agency expressing concern with the project was County Water Resourees, .
which indicated that when basalt is removed for basements in areas where shallow bedrock and a
high water table are present, the basement becomes a pooling area for groundwater and floods.
County Water Resources requested that a geotechnical analysis be completed if a basement is
proposed. See memo dated 4-16-97 from Brenda Sims/Katherine Miller to John Pederson. The

. .~County Health District's memo dated 3-31-97 confirms that the soils on the site are dense dark
basalt deposits, and the presence of basalt soils is readily apparent on the adj acent mining site.
The applicant also confirmed that basement flooding is a problem in the area, due to the presence
of basalt rock near the surface and a high water table. The applicant did not object to adding the
condition of approval recommended by County Water Resources, and the Heanng Examiner has
added such condition to this decision.
The proposal constitutes "fill-in development", within the meaning of the Comprehensive
Plan, and will help renew the area. As conditioned, it complies with County plans, policies and
regulations for water, sewer, utilities, drainage and other necessary infrastructure.
2. Conditions in the area in which the propertv is located have chan@~ed substantiallv since the
propertv was last zoned.
In applying the changed circumstances test, courts have looked at a variety of factors,
including changed public opinion, changes in land use patterns in the area of the rezone proposal,
and changes on the property itself. The Zoning Code references changes in "economic,
technological or land use conditions" as factors that will support a rezone. Spokane County
Zoning Code Section 14.402.020 (2). Washington courts have not required a"strong" showing
of change. The rule is flexible, and each case is to be judged on its own facts. Bassani v. Countv
Commissioners, 70 Wn. App. 389, 394 (1993). Recent cases have held that changed
circumstances are not required for a rezone if the proposed rezone implements policies of a
comprehensive plan. Biarnson, at 846; Save Our Rural Environment v. Snohomish Countv, 99
Wn.2d 363, 370-371 (1983).
As noted, the proposal is consistent with the Comprehensive Plan. Changed circumstances
supporting the rezone include the availability of public sewer and water to the site, growth and
new housing in the area, and abandonment of the adjacent surface mining operation.
3. The nroposed rezone does bear a substantial relationship and is not detrimental to the public
health, safetv and eeneral welfare.
General consistency with a local govern.ment's comprehensive plan is relevant in determining
whether a rezone bears a substantial relationship to the public welfare. Bassani, at 396-98. As
noted, the proposal generally conforms to the Comprehensive Plan. No public opposition was
expressed to the proposal. The proposal is consistent with the single-family uses land uses
located north, south and west of the site. The surface mine to the east is abandoned, and the
proposed single-family home is buffered from the steep pit of the mining property by the depth
of the site, the site topography and a cyclone fence.
4. The nrouosed zone chan2e complies with the nrovisions of the State Environmental Policv
Act and the Countv's Local Environmental Ordinance.
The procedural requirements of chapter 43.21 C RCW (SEPA) and chapter 11.10 of the .
Spokane County Code have been met. The Hearing Examiner concurs with the Determination of
Nonsignificance issued by the Division of Building and Planning, subject to the added condition
recommended by County Water Resources.

5. The nronosal, as conditioned, complies with the Urban Residential-3.5 (UR-3.5) zone, the
Svokane Countv Zonine Code (SCZC), and annlicable land use regulations.
The proposal has been conditioned for compliance with the development standards of the
UR-3.5 zone, and the regulations of the Spokane County Zoning Code. The proposed use of the
site for construction of a single-family residence is prohibited in the Mining Zone, which
necessitated a rezone to the UR-3.5 zone. See Zoning Code 14.636.230. The condition of
approval recommended by County Water Resources is authorized under SEPA, the County's
Local Environmental Ordinance, and drainage authority contained in title 9 of the Spokane
County Code.
III. DECISION
Based on the Findings of Fact and Concliisions above, the above application for a zone
reclassification is hereby approved, subject to the conditions of the various public agencies
specified below. Any new conditions added by the Hearing Examiner are italccized.
Failure to comply with the conditions of this approval may result in revocation of this
approval by the Hearing Examiner. This approval does not waive the applicant's obligation to
comply with all other requirements of other agencies with jurisdiction over land development.
SPOKANE COUNTY DIVISION OF BUILDING AND PLANNING
1. The proposal shall comply with the Urban Residential-3.5 (UR-3.5) zone, as amended.
2. The applicant shall develop the subject property generally in accordance within the concept
presented to the Hearing Body. Variations, when approved by the Division Director/designee,
may be permitted, including, but not limited to building location, landscape plans and general
allowable uses of the permitted zone. All variations must conform to regulations set forth in the
Spokane County Zoning Code, and the original intent of the development plans shall be
maintained.
3. The Division of Building & Planning shall prepare and record with the Spokane County
Auditor a Title Notice noting that the property in question is subject to a vanety of special conditions
imposed as a result of approval of a land use action. This Title Notice shall serve as public notice of
the conditions of approval affecting the property in question. The Title Notice should be recorded
within the same time frame as allowed for an appeal and shall only be released, in full or in part, by
the Division of Building & Planning. The Title Notice shall generally provide as follows:

by a Spokane County Hearing Body or Administrative Official on , imposing a variety of

SPOKANE COUNTY DIVISION OF ENGINEERING AND ROADS
Prior to release of a building permit or use of the property as proposed:
1. Access permits for approaches to the County Road System shall be obtained from the
County Engineer.
2. Roadway standards, typical roadway sections and drainage plan requirements are found in
Spokane County Resolution No. 95-0498 as amended and are applicable to this proposal.
3. No construction work is to be performed within the existing or proposed right of way until
a permit has been issued by the County Engineer. All work within the public road right of way is
subj ect to inspection and approval by the County Engineer.
4. The applicant shall sign "Spokane County Notice to the Public Number 4", which will
allow the construction of a driveway in the non-maintained portion of the Havana Street right of
way.
5. The applicant is advised to consult with the City of Spokane Traffic Department for
additional information regarding access and requirements for Havana Street.
SPOKANE REGIONAL HEALTH DISTRICT
1. Sewage disposal method shall be as authorized by the City of Spokane Public Works.
2 Water service shall be coordinated through the City of Spokane Public Works.
3. Water service shall be by an existing public water supply when approved by the Regional
Engineer (Spokane), State Department of Health.
4. A public sewer system will be made available for the project and individual service will be
provided. Use of individual on-site sewage disposal systems shall not be authorized.
5. The use of private wells and water systems is prohibited.
CITY OF SPOKANE-DEPARTMENT OF CONSTRUCTION SERVICES
1. Sanitary sewer is available in Havana Street approximately 20 feet south of the south line
of the subject property.
2. Water is available in Havana Street approximately 5 feet south of the south line of the
subject property.
3. Connection to the above would be allowed subj ect to payment of all required connection
fees and permit fees.

SPOKANE COUNTY DIVISION OF UTILITIES
1. This project lies within the City of Spokane Sewer Service Area. The applicant is required
to notify them of this proposal.
2. Any water service for this proj ect shall be provided in accordance with the Coordinated
Water System Plan for Spokane County, as amended.
SPOKANE COUNTY WATER RESOURCES
1. Due to the presence of shallow basalt bedrock ancl a high water table in the area, which
creates the potential for basement flooding, a geotechnical analysis shall be prepared prior to
issuance of a buildirig permit if a basement is proposed for the single family residence to be
constructed on the site. The analysis needs to indicate the seasonal high water table elevation.
Any proposed basement will need to be above this elevation.

Pursuant to Spokane County Resolution Nos. 96-0171 and 96-0632, the decision of the
Hearing Examiner on an application for a zone reclassification and accompanying SEPA
determination is final and conclusive unless within ten (10) calendar days from the Examiner's
written decision, a party of record aggrieved by such decision files an appeal with the Board of
County Commissioners of Spokane County, Washington. However, RCW 36.70B.110 (9)
indicates that administrative appeals of county land use decisions and SEPA appeals shall be
filed with the legislative body within fourteen (14) calendar days of the date of the decision.

Area (IUGA) boundary The Urban category is pnmanly a residential
designation which is intended for development of a"city-like"
environment which includes various land uses, intensive residential

Urban category should range from 1 to 17 dwelling uruts per acre and

where community facilities have already been established The subject
property adjoins the Crty of Spokane to the west and the specific policies
of Section 30 (Spokane City Fnnge Area) of the Comprehensive Plan are
applicable The proposed zone reclassification is consistent with and
unplements the Goals, Objectives, and Decision Guidelines of the Urban
designation and the City Fnnge Area section of the Spokane County
Comprehensive Plan

that is bisected by two zorung classifications The southerly portion of the lot
(approximately 13,844 square feet) is zoned Urban Residential-3 5(UR-3 5),
and is not subject to the proposed zone reclassification and was created through
Certificate of Exemption CE-424-95(A) The northerly portion of the lot
(approximately 13,887 square feet) is zoned 1Vhrung (MZ) and is the portion of
the entire ownership subject to the proposed zone reclassification The purpose
of the zone reclassification is to change the pomon of the lot zoned Mining
(MZ) to Urban Residential-3 5(UR-3 5) to allow construction of a single family
residence and to allow for a subsequent lot line adjustment to recognize
aggregation of the separate parcels
The site plan illustrates general conformance with the development standards of
the proposed Urban Residential-3 5(UR-3 5) zone Detailed review to
determine compllance with all Zorung Code regulations and conditions of
approval is recommended to be admirustrative and to occur pnor to issuance of
a building pernut
H. Circulation: Access to the site is provided by Havana Street and individual
access points to Havana Street are subject to review and approval by the City of
Spokane Havana Street is currently improved with two paved lanes without
curb or sidewalk

County Division of Engineerulg prior to building permits being issued

An Environmental Checklist was submitted by the sponsor and was reviewed by the
Spokane County Division of Building and Planning The review considered the
specifics of the proposal, other available information, County ordinances, other
regulations and laws, possible standard Conditions of Approval, the Generalized
Comprehensive Plan, and other County policies and guidelines The Spokane County
Division of Building and Planrung has determined that "No probable sigruficant
adverse impacts" would result from the proposal being developed and has issued a
Determination of Nonsignificance ("DNS")
The "DNS" was circulated to 15 other agencies ofjunsdiction and other
agencies/departments affected by the future development for review and comment
The "DNS" comment period ends June 16, 1997 and was advertised 15 calendar
days before said date in the newspaper, by letter to adjacent property owners within
400 feet of the proposal, and by notice on a sign posted on the proposal site The
Hearing Examiner may consider additional environmental related testimony at the
public heanng
IV. SPOKANE COUiNTY DIVISION OF BUILDING AND PLANNING
SUMMARY AND RECOMMENDATION
The zone reclassification is consistent wlth and unplements the Goals, Objectives,
and Decision Guidelines of the Urban category of the Spokane County
Comprehensive Plan and is consistent with adjacent land uses The Division of
Building & Planrung recommends approval, as conditloned

Air pollution regulations require that dust emissions during demolition, construction and
excavation projects be controlied This may require the use of water sprays, tarps,
sprinklers or suspension of activity during certain weather conditions Haul roads should
be treated and emissions from the transfer of earthen materiai must be controlied as well
as emissions from all ottier construction related activities
Measures must be takeri to avoid the deposition of dirt and mud from unpaved surFaces
onto paved surfaces li, tracking or spiils occur on paved surfaces, measures must be
taken immediately to clean these surfaces
Debris generafed as airesuit of this project must be disposed of by means other than
burning (i e constructiori waste, vegetative waste etc )
All solid fuel burning devices (fireplaces wood stoves, pe(let stoves, etc ) must comply
with local, state, and federal rules and regulations Fireplace emission standards go into
effect January 1, 1997 New fireplaces must be tes#ed and labeled in accordance with

Will a basement be a part of this building? If so, we are concerned that basement flooding
could occur due to the soil conditions and shallow water table in the area We recommend a
geotechnical analysis be completed if a basement is proposed The analysis needs to indicate
the seasonal high water table elevation Any proposed basement will need to be above this
elevation
Our experience has been that when basalt is removed for basements in areas where shallow
bedrock and a high water table are present, the basement becomes a pooling area for the
groundwater

The Spokane County Division of Building & Pla.nning accepted the above -referenced
zone reclassnfication as a"counter-complete" application on March 20, 1997 Acceptance
of the zone reclassification application and designating said application as "counter
complete" vests the application fo review with respect to current regulations and for
review to determine technically complete stafius The County now has 28 calendar days
to circulate application to affected agencies for their review Additional information may
be requested by affected agencies allowing the County to determine if the application is
teclmically complete If additional information is requested, the 28 day time periocl will

Will a basement be a part of this building? If so, we are concerned that basement flooding
could occur due to the soil conditions and shallow water table in the area We recommend a
geotechnical analysis be completed if a basement is proposed The analysis needs to indicate
the seasonal high water table elevation Any proposed basement will need to be above this
elevation
Our experience has been that when basalt is removed for basements in areas where shallow
bedrock and a high water table are present, the basement becomes a pooling area for the
groundwater
