Enviroilmenial Review: A Deterrruna-tion of Nonsignificance was issued by the Division
of Building and Planning on June 12, 1998.
Site Description: The site is approximatety 1/2 acre in size and is undeveloped. The subject
property slopes slightly from west to east, aiad inctudes some landscaping and a driveway
associated wrfih the adjacent church. Some pine trees'are found on the southeasterLy porfiion of
the property. A 6-foot high cyclone fence is located along the east perimeter of the site. The
subject property is a portion of2 laiger tax parcels.
Surronndi.ng Conditions: Havana Street and Pratt Avenue converge immediatzly south of
the site. Havana Screet is considered a Loca1 Access road under the County Arterial Road Plan,
whi.le Pratt Avenue is in the City of Spokane: The city of Spokane lies immediately west of the
site. The pro,peri.y im.mediatel_y west of the site, at the northwest comer ofPratt and Ravana, is
i.mproved with the.Kingdom Hall of Jehovah's Witnesses church. The church is operated by the
applica.nt. An abandoned surface mine lies immediately east of the site and otJier lots lying along
the east side of Havana Street. A cyclone fence separates the mine from such properties, with the
mi_ne property droppi.ng off steeply a few feet from the fence. The surrounding area otherwise
consists of single-family residences at urban densities, and vacant undeveaoped parcels. A
single-family residence was recently constr_ucted on the lot lying -immediately south of the
subject property, pursuant to aTezone to the LTR 3.5 zone approved by the Rearing Examiner- in
1997, in-Ti1e No. ZE-25-97.
Project Description: The applicanY proposes to xezone the -site to theUR-3.5 zone, for the
purpase of developimg landscaping, parking and drainage facilities for the adjacent church.

III. LAND USE ANALYSIS
FINDINGS OF FACT & CONCLUSIONS OF LAW
A. Annroval criteria
The Hearing Examiner Ordinance authorizes the Hearing Examiner to grant, deny or grant
with such conditions, modifications and restrictions as the Examiner finds necessary to make a
land use application compatible with the Spokane County Generalized Comprehensive Plan and
applicable development regulations. See County Resolution No. 96-0171, Attachment "A",
paragraphs 7(d) and section 11; and RCW 36.70.970. Such regulations include without
limitation the Spokane County Zoning Code, the State Environmental Policy Act (SEPA) and the
County's Local Environmental Ordinance (chapter 11.10 of the Spokane County Code).
In considering a rezone application, Washington case law generally provides that 1) there is
no presumption in favor of the rezone, 2) the applicant for the rezone must prove that conditions
have substantially changed in the area since the last zoning of the property, and 3) the rezone
proposal must bear a substantial relationship to the public health, safety or welfare Parkridge v.
Secrttle, 98 Wn. 2d 454, 462 (1978); and Bjarnson v. Kitsap County, 78 Wn. App. 840 (1995).
The comprehensive plan is considered as a general blueprint for land use regulation, and only
general conformance with a comprehensive plan is required to approve a rezone. See Citizens for
Mount Vernon v. City ofMount Vernon, 133 Wn.2d 861, 873 (1997); and Cathcart v. Snohomish
County, 96 Wn.2d 201, 211-12 (1981). Where a comprehensive plan conflicts with zoning
regulations, the provisions of the zoning code will usually be construed to prevail. See
Weyerhaeziser v. Pierce Coicnty, 124 Wn.2d 26, 43 (1994).

Section 14.402.020 of the Zoning Code authorizes amendments to the Code based on any
one of six (6) grounds, without differentiating between amendments to the zoning text of the
code and amendments to the official zoning map. The relevant criteria for review of a site
specific rezone are found in Zoning Code 14.402.020 (1), which authorizes the Code to be
amended if it is "...consistent with the Comprehensive Plan and is not detrimental to the public
welfare...", and in Zoning Code 14.402.020 (2), which authorizes a Code amendment where a
..[c]hange in economic, technological, or land use conditions has occurred to warrant
modification of this Code...".
Zoning Code 14.100.104 provides that the Code shall be interpreted to carry out and
implement the purpose and intent of the Comprehensive Plan, and the general plans for physical
development adopted by the Board of County Commissioners. Zoning Code 14.140.106 states
that when the Zoning Code conflicts with the Comprehensive Plan, or other adopted plans and
regulations of the County or other regulatory agencies, the more restrictive provisions shall
govern to the extent legally permissible and the Zoning Code provisions will be met as a
minimum.
The Comprehensive Plan itself indicates that it should be used as a reference source and
guide for making land use decisions. Comprehensive Plan, p. 2. The applicable "decision
guidelines" set forth in the Plan are to be used in determining whether a particular proposal
should be approved, conditioned or denied.
B. The nrovosed rezone, as conditioned, generally conforms with the Comprehensive Plan;
bears a substantial relationshio to and will not be detrimental to the public health. safetv and
welfare: and comolies with the Saokane County Zoning, Code and other applicable develonment
regulations.
The site is designated in the Urban category of the Comprehensive Plan. The Urban
category recommends a residential net density range of 1 to 17 units per acre. The more
intensive uses in the Urban category, such as light industrial and neighborhood commercial, are
expected to be located near or along the heavily traveled streets. The least intensive single-
family residential uses should be isolated from the noise and heavy traffic, while multifamily
structures will usually be a transitional use located between single-family residential and the
more intensive areas. See Comprehensive Plan, Section 1, "Purpose" and "Detailed Definition".
The Urban category includes the following relevant objectives and decision guidelines:
Objective l.l.a Promote fill-in within established development areas and
existing outlying communities where utilities, arterials, schools and
community facilities have already been established.
Decision Guideline 1.1.1 Urban development will be approved in areas
having adequate power supplies, water, sanitary and storm sewers,
streets, and school and fire services, provided that such development
meets the intent of other Objectives and Decision Guidelines of this
section.

-Decision Guideline 1.1.4 A variety of densities and residential uses
should be available to provide a freedom of choice to live in Urban areas
with varying densities, combinations, or mix of uses (see detailed Urban
definitions).
Decision Guideline 1.2.2 The need for recreation and open space created
by residential developments should be met and be in conformance with
ordinances, plans, and policies prior to residential development approval.
Decision Guideline 1.3.3 All Urban development proposals should
require public sanitary and storm sewer systems or interim sewer systems
to protect water quality.
Decision Guideline 1.4.2 Areas with steep slopes, susceptibihty to
landslides, or other hazards should not have Urban land uses unless it is
shown by the developer that such hazard areas can be developed at Urban
densities.
Objective l.S.a New residential or multiple family should be buffered
from existing adjacent land uses where adverse effects may develop.
Decision Guideline 1.5.1 Buffering and/or landscaping will be usecl to
mitigate the differences between proposed developments and existing uses.
Objectzve 1. S. c Encourage paved streets and sidewalks in existing and
future developments where they are appropriate to the nature of the
development.
Objective I.S.e When a neighborhood e,Cperiences pressure for change in
character, such change shall be permitted upon appropriate review.
Objective 1.5.8 When determining whether a proposal will change the
existirig land use character of an area, factors to consider may include:
a) the structure height of the proposal in relation to structure
hetght of nearby structures, and
b) whether new structures will have a positive or negative impact
upon the neighborhood s architectural character.
Decision Guideline 1.61 Before land use proposals are approved they
should:
a) conform to plans, policies and regulatTOns of County water, sewer, storm sewer,
actility and special service districts;
b) conform to Cou»ty transportation plans and policies; and
c) identify and take steps to resolve significant adverse impacts upon existing
utilities, (i.e. water, sanitary and storm sewers, utility, available and firture
energy resources), and traff c systems.
The property is also within the Urban Impact Area (UTA) designated in the Comprehensive
Plan. This is an area where growth, development and higher intensities of land use are
encouraged. Comprehensive Plan, Objective 14.1.a. The tJIA section of the Comprehensive
Plan indicates that traditional urban problems such as incompatible land uses, environmental

pollution and traffic congestion will be managed with greater attention to the general public's
well-being inside the LTIA. Comprehensive Plan, Objective 14.1.e.
The site is also located within the Spokane City Fringe Area designated by the
Comprehensive Plan. The Fringe Area policies indicate that the Comprehensive Plan should
be used as a primary tool for guiding development, and encourages growth and revitalization
of portions of the Fringe Area which have already experienced development.
The applicant proposes to rezone the site from the Mining (MZ) zone to the Urban
Residential-3.5 (UR-3.5) zone, to allow the property to serve as parking for the adjoining
church operated by the applicant. The Mining (MZ) zone is a holdover from the now
abandoned surface mine use to the east. Such zone does not implement the Urban category.
Zoning Code 14.636.100.
The purpose and intent of the UR-3.5 zone is set forth in Zoning Code 14.616 as follows:
The purpose of the IIR-3.5 zone cs to implement the lower density range of
the Urban category of the Comprehensive Plan. The intent of the zone is
to promote areas of primarily single family residential use in an urbanized
neighborhood setting, having a high level of public services. Lots shall be
served by a public water system and shall require connection to a public
central sewer system when available. Roadways shall be paved and
curbed and may have sidewalks.
The Staff Report found the proposal to be consistent with the policies of the Urban category
and the Spokane City Fringe Area. No public testimony or written information was offered in
opposition to the proposal. The City of Spokane offered no objection to the proposal, and
indicated that the existing water service would be adequate to serve the project. Neither County
Utilities or the Spokane Regional Health District submitted comments for the project, since the
proposed use would put no demand on public sewer. Public sewer is available from the City in
the area if needed. The proposal fits in well with the new homes constructed along the east side
of Havana Street in the vicinity.
The only public agency expressing concern with the project was County Water Resources,
regarding stormwater control. See memorandum dated 4-30-98. However, the site lies outside
the boundaries of the interim official control area recently established by the County.
The proposal constitutes "fill-in development", within the meaning of the Comprehensive
Plan, and will help renew the area. As conditioned, it complies with County plans, policies and
regulations for water, utilities, drainage and other necessary infrastructure. The site is also
located within the County's interim urban growth area established under the State Growth
Management Act, an area where urban densities are encouraged.
The proposal has been conditioned for compliance with the development standards of the
UR-3.5 zone, and the regulations of the Spokane County Zoning Code. The proposed use of the
site as a parking lot for a church is prohibited in the Mining Zone, which necessitated a rezone to
the UR-3.5 zone. See Zoning Code 14.636.230.

The procedural requirements of chapter 43.21C RCW (SEPA) and chapter 11.10 of the
Spokane County Code have been met. The Hearing Examiner concurs with the Determination of
Nonsignificance issued by the Division of Building and Planning.
C. Conditions in the area in which the property is located have changed substantiallv since the
-Dronertv was last zoned.
In applying the changed circumstances test, courts have looked at a variety of factors,
including changed public opinion, changes in land use pattems in the area of the rezone proposal,
and changes on the property itself. The Zoning Code references changes in "economic,
technological or land use conditions" as factors that will support a rezone. Spokane County
Zoning Code Section 14.402.020 (2). Washington courts have not required a"strong" showing
of change. The rule is flexible, and each case is to be judged on its own facts. Bassani v. County
Commissioners, 70 Wn. App. 389, 394 (1993). Recent cases have held that changed
circumstances are not required for a rezone if the proposed rezone implements policies of a
comprehensive plan. Bjarnson, at 846; Save Our Rural Environment v. Snohomish County, 99
Wn.2d 363, 370-371 (1983).
As noted, the proposal is consistent with the Comprehensive Plan. Changed circumstances
supporting the rezone include new housing in the area, abandonment of the adjacent surface
mining operation, the recent rezone to the UR-3.5 zone immediately south of the site, the
availability of public sewer and water in the vicinity, increased population growth in the area,
and designation of the site within the County's IUGA boundaries,
IV. DECISION
Based on the Findings of Fact and Conclusions of Law above, the above application for a
zone reclassification is hereby approved, subject to the conditions of the various public agencies
specified below. Any new conditions added by the Hearing Examiner are italicized.
Failure to comply with the conditions of this approval may result in revocation of this
approval by the Hearing Examiner. This approval does not waive the applicant's obligation to
comply with all other requirements of other agencies with jurisdiction over land development.
SPOKANE COUNTY DIVISION UF CURRENT PLANNING
1. All conditions imposed by the Hearing Examiner shall be binding on the "Applicant",
which term shall include the owner (s) and developer (s) of the site, and their heirs, assigns and
successors.
2. The zone change applies to the following described real property: (as described on the
application submitted 4/13/98).
3. The proposal shall comply with the Urban Residential-3.5 (UR-3.5) zone and other
applicable provisions of the Spokane County Zoning Code, as amended.

4. The applicant shall develop the subject property in accordance with the site plan of record
dated June 9, 1987. Minor revisions may be approved administratively by the Director/designee
of Division of Current Planning, pursuant to Section 14.504.040 of the County Zoning Code.
Such revisions must conform to regulation standards and the conditions of approval. All other
modifications must be submitted for the review and approval of the Hearing Examiner, pursuant
to a change of conditions application. The original intent of the development plans sha11 be
maintained.
5. Approval is required by the Director/designee of the Division of Current Planning of a
specific lighting and signing plan for the described property, prior to the release of any building
permit.
6. A specific landscape plan, planting schedule and provisions for maintenance acceptable to
the Director of the Division shall be submitted with a performance bond for the project, or other
suitable guarantee provided before issuance of a building permit. Landscaping shall be installed
and maintained so that sight distance at access points is not obscured or impaired.
7. Direct light from any exterior area lighting fixture shall not extend over the property
boundary.
8. The Division of Current Planning shall prepare and record with the Spokane County Auditor a
Title Notice noting that the property in question is subject to a variety of special conditions imposed
as a result of approval of a land use action. This Title Notice shall serve as public notice of the
conditions of approval affecting the property in question. The Title Notice should be recorded
within the same time frame as allowed for an appeal and shall only be released, in full or in part, by
the Division of Current Planning. The Title Notice shall generally provide as follows:
_ The parcel of property legally described as is the subject of a land use action
by the Hearing Examiner on F'ebruary 29, 2000, imposing a variety of special development
conditions. File No. ZE-3-98is available for inspection and copying in the Spokane County
Division of Current Planning.
9. The applicant is required to apply for a lot line adjustment to recognize the aggregation of
the subject property with the property adjacent to the west. The lot line adjustment must be
approved by both Spokane County and the City of Spokane.
SPOKANE COUNTY DIVISION OF BUILDING AND CODE ENFORCEMENT
1. The applicant shall contact the Division of Building and Code Enforcement at the earliest
possible stage of design/development in order to be informed of Code requirements administered
or enforced by the division, e.g., State Building Code Act regulations such as requirements for
fire hydrant/flow, fire apparatus access roads, street address assignment, barrier free regulations,
energy code regulations, and general coordination with other aspects of project implementation.

SPOKANE COUNTY DIVISION OF ENGINEERING AND ROADS
Prior to release of a building permit or use of the property as proposed:
1. Any required access permits and improvements to Pratt Avenue must be approved by the
City of Spokane.
2. The applicant shall submit for approval by the Spokane County Engineer drainage and
access plans. Because the proposal is located in a joint planning area, the applicant is advised to
consult with the City of Spokane to ensure that the drainage and access plans conform to adopted
City standards.
3. The applicant shall submit for approval by the Spokane County Engineer and the Spokane
Regional Health District a detailed combined on-site sewage system plan and surface water
disposal plan for the entire project or portion thereof if the development is phased.
4. All required improvements shall conform to the current State of Washington Standard
Specifications for Road and Bridge construction and other applicable County standards andlor
adopted resolutions pertaining to Road Standards and Stormwater Management in effect at the
date of construction, unless otherwise approved by the County Engineer.
5. Roadway standards, typical roadway sections and drainage plan requirements are found in
Spokane County Resolution No. 95-0498 as amended and are applicable to this proposal.
SPOKANE REGIONAL HEALTH DISTRICT
1. Should the property be developed, public water and sewer would be required.

Description of the Site:
The site is approximately'/z acre in size and is undeveloped. The site slopes slightly from west to east and
vegetation consists of landscaping. A six foot cyclone fence is located along the eastern boundary of the
site. The surrounding area consists of single family residences at varying densities, a church, and an
abandoned surface mining area.
Backqround:
The applicant has requested a zone reclassification from Mining (MZ) to Urban Residential-3.5 (UR-3.5) for
landscaping, parking and drainage facilities to serve an adjacent church. The adjacent property is located
within the City of Spokane. The application for the zone reclassification was submitted to the Division of
Building and Planning on Apnl 14, 1998. The property is currently undeveloped with the exception of some
landscaping and a driveway serving the adjacent church The subject property is a portion of two larger tax
parcels and the applicant is proposing a subsequent lot line adjustment with the adjacent church property to
recognize the aggregation of the separate parcels. The applicant is aware of the fact that a lot line
adjustment aggregating the subject property with the adjacent property located within the City of Spokane
can be allowed, however, the aggregated property will stilt be subject to two separate taxing districts. The
subject property was zoned Mining (MZ) in 1958 (ZE-44-58), and the site is physically separated from the
abandoned surface mining area by a cliff which forms the eastern boundary of the site.

The subject property is located within the Urban category of the Comprehensive Pian The Urban category
°
is intended to provide the opportunity for a"citylike" environment, which includes various land uses,
residential development and a high level of public facilities and urban services. It is primarily a residential
category of single-family, finro-family, multi-family and condominium buildings along with neighborhood
commercial, light industrial, and public and recreational facilities. Objective 1.1 a promotes fill-in within
established development areas where community facilities have already been established. Decision
Guideline 1.1.1 states that "Urban development will be approved in areas having adequate power supplies,
water, sanitary and storm sewers...n. City of Spokane water and sewer services are available to the site
Decision Guidelines 1.5.1 states that "Buffering and/or landscaping will be used to mitigate the differences
between proposed developments and existing uses".
The site is located within the Urban Impact Area (UTA) as designated by the Comprehensive Plan. The
Urban Impact Area (UTA) is an area where growth, development and higher intensities of land use are
encouraged. The site is also located within the Spokane City Fringe Area. Decision Guideline 30.1.4 states
that urbanization of vacant urban areas should be permitted when consistent with City and County Plan
policies relating to utility services, open space, and alternative living environments.
The proposed zone reclassification is consistent with the Goals, Objectives and Decision Guidelines of the
Urban category, Urban Impact Area (UTA) and Spokane City Fringe Area Sections of the Comprehensive
Plan.
Zoning:
The purpose of the proposed Urban Residential-3.5 (UR-3 5) zone is to implement the lower density range
of the Urban category of the Comprehensive Plan. The intent of the zone is to promote areas of primarily
single-family residential use in an urbanized neighborhood setting, having a high level of public services
Lots shall be served by a public water system and shall require connection to a public central sewer system
when available. Roadways shall be paved and curbed and may have sidewalks. The site is located
adjacent to the City of Spokane and is within an established residential neighborhood. Use of the site to
provide landscaping, parking and drainage facilities for an adjacent church is allowed within the proposed
Urban Residential-3.5 (UR-3.5) zone, provided that the applicant aggregates the subject property with the
adjacent parcel through a lot line adjustment.
Existing zoning in the general area of the proposal consists of Urban Residential-3.5 (UR-3.5), Mining (MZ),
and Single Family Residential (R-1) within the City of Spokane. A zone reclassification from Mining (MZ) to
Urban Residential-3.5 (UR-3.5), for the property south of and adjacent to the proposal, was approved by the
Hearing Examiner in July of 1997 for a single family residence.
The site plan of record illustrates the boundaries of the subject property and the location of the adjacent
church. The application for a lot line adjustment will require approval by Spokane Counry and the City of
Spokane. As stated previously, the properties are subject to finro separate taxing districts and even after the
properties are aggregated, the Spokane County Tax Assessor will identify the subject property by its own
tax parcel number. The Division of Building and Planning recommends that a Title Notice be attached to the
subject property stating that the parcel cannot be sold separately as a buildable parcel
At such time as the church is expanded or remodeled, the applicant will be required to meet both the
Spokane County and City of Spokane landscaping, parking, access and drainage requirements. The site
plan of record is general in nature and detailed review to determine compliance with all development
standards of the proposed Urban Residential-3.5 (UR-3.5) zone and Conditions of Approval is
recommended to be administrative and to occur prior to the issuance of building permits.
As proposed, the zone reclassification from Mining (MZ) to Urban Residential-3.5 (UR-3 5) is consistent with
the purpose and intent of the proposed Urban Residential-3.5 (UR-3.5) zone.

We are concerned that drywells may not be appropriate due to high ground water and shallow
bedrock in the area. The applicant needs to be aware that alternative methods of stormwater
disposal may be needed On site conditions may require the applicant's engineer to provide
drainage facilities that exceed the minimums specified in the Guidelines for Stormwater
Management.

submitted with a performance bond or other suitable guarantee for the project prior to
release of any building pennits. Landscaping shall be installed and maintained so that
sight distance at access points is not obscured or impaired.
