ZE-0003A-98 - RECE VEE) 4- fSPOKANE COUNTY HEARING EXAMINER SEP. 2 7-2001 SPOKAAIE CpUMyENMNEER RE: Change of Conditions to a Prior Zone ) Reclassification, in the Urban ) FINDINGS OF FACT, Residential-3.5 (UR-3.5) Zone; ) CONCLUSIONS OF LAW, Applicant: Greg Ripley ) AND DECISION File No. ZE-3A-98 ) ) This matter coming on for public hearing on August 1, 2001, the Hearing Examiner, after review of the change of conditions application and the entire record, and finding good cause therefore, hereby makes the following findings of fact, conclusions of law and decision: 1. FINDINGS OF FACT 1. The application requests a change of conditions to a prior zone reclassification, in the Urban Residential-3.5 (UR-3.5) zone, to allow modifications to the original site plan of record, and to update the conditions of approval. 2. The site is generally located east of and adjacent to the centerline of vacated Havana Street, northeast of Pratt Avenue, in the SW '/4 of Section 23, Township 25 North, Range 43 EWM, Spokane County, Washington. 3. The site is currently designated as County Assessor's tax parcel no. 35233.9185, and has a mailing address of 4249 East Pratt Avenue. 4. The site owner is Pratt Avenue Congregation of Jehovah's Witnesses, a non-profit corporation, 4249 East Pratt Avenue, Spokane, WA 99202. 5. The applicant for the proposal is Gregory R. Ripley, Sr., 4104 East Pratt Avenue, Spokane, WA 99202. 6. The Hearing Examiner heard the application pursuant to the County Hearing Examiner Ordinance (County Resolurion No. 96-0171) and the County Hearing Examiner Rules of Procedure (County Resolution No. 96-0294). 7. The requirements for public notice have been met. 8. A public hearing was held on the proposed change of conditions on August 1, 2001. 9. The County Division of Planning issued a Detemunation of Nonsignificance for the proposal on July 13, 2001. 11. The Hearing Examiner takes notice of the County Comprehensive Plan, the County Zon.ing Code, other applicable development regulations, and previous land use decisions for the site and in the vicinity. 12. The record includes the documents in File Nos. ZE-3-98 and ZE-3A-98 at the time of the public hearing; the documents submitted at the public hearing; and the items taken notice of by the Examiner. 13. The site is approximately .5 acres in size, and irregular in shape. The subject property slopes slightly from west to east, and includes some landscaping and a driveway associated with a church located west of the site. Some pine trees are found on the southeasterly portion of the property. A 6-foot high cyclone fence is located along the east perimeter of the site. 14. A.64-acre parcel improved with a 2,080 square foot church, on land owned by the owner of the current site, abuts the northerly two-thirds of the current site on the west. The southwest comer of the parcel touches Pratt Avenue. 15. On February 29, 2000, the Hearing Examiner approved a rezone of the current site from the Mining (MZ) zone to the UR-3.5 zone, to provide landscaping, parking and drainage facilities for the adjacent church. See Hearing Examiner decision in File No. ZE-3-98. 16. The change of conditions application proposes significant modifications to the site plan of record for the 2000 rezone decision involving the site, to allow the construction of a new church on the site and the adjacent parcel to the west. The site plan of record dated September 22, 2000 illustrates parking and a future addition to the new church on the current site. The church building on the paxcel to the west would be removed, and parking and drainage for the church installed on such adjacent parcel. 17. Havana Street and Pratt Avenue converge immediately south of the site. Havana Street is considered a Local Access road under the County Arterial Road Plan, while Pratt Avenue is in the City of Spokane. The city of Spokane lies immediately west of the site. The site is located along the east edge of the South Hill area of the City. 18. An abandoned surface mine lies immediately east of the site and other lots lying along the east side of Havana Street. A cyclone fence separates the mine from such properties, with the mining pit dropping off steeply a few feet from the fence. The surrounding area otherwise consists of single-family residences at urban densities, and vacant undeveloped parcels. A single-family residence was recently constructed on the lot lying immediately south of the subject property, pursuant to a rezone to the UR-3.5 zone approved by the Hearing Examiner in 1997, in File No. ZE-25-97. 19. The site is designated in the Urban category of the County Generalized Comprehensive Plan. The subject property also lies inside the Aquifer Sensitive Area, Priority Sewer Service Area and Urban Impact Area designated by the Generalized Comprehensive Plan. HE Findings, Conclusions and Decision ZE-3A-98 Page 2 ~ 20. The site is located inside the interim urban growth area boundaries desigaated by the County pursuant to the State Growth Management Act. 21. The site is located in an area regulated by the Glenrose/Central Park Stormwater Ordinance, adopted by County Resolution No. 99-1046. The project will be required to comply with such regulation. 22. The City of Spokane indicated that it had several concerns with site development, including street, water, sewer and stormwater. The City indicated that these issues could be dealt with at the building permit stage, and did not oppose the proposal. 23. No neighboring property owners or public agencies expressed opposition to the proposal, as conditioned. Tbe project, as conditioned, is compatible with neighboring land uses. 24. The proposal will remain subject to the conditions of approval imposed in File No. ZE-3-98, except for the new conditions recommended by public agencies. 25. The proposal, as conditioned, will not have a significant impact on the environment or impact neighboring properties. 26. The Staff Report adequately analyzes the consistency of the proj ect with the Comprehensive Plan, the development standards of the UR-3.5 zone, and the criteria for approving a change of conditions. Such analysis is hereby adopted and incorporated by reference as findings of fact herein. Based on the above findings of fact, the Hearing Examiner enters the following: U. CONCLUSIONS OF LAW 1. The proposed change of conditions, as conditioned, generally conforms to the Comprehensive Plan. 2. The applicant has established that the proposal bears a substantial relationship to, and/or will not be detrimental to, the public health, safety or welfare. 3. The procedural requirements of the State Environmental Policy Act and the County's Local Environmental Ordinance have been met. 4. The proposal, as conditioned, complies with the UR-3.5 zone, the County Zoning Code, and other applicable development regulations. 5. The proposed change of conditions meets the criteria established in Section 14.504.040 of the County Zoning Code for a change of conditions application. 6. Approval of the land use application is appropriate under the criteria established for the approval of land use applications in Section 11 of the County Hearing Examiner Ordinance, adopted by County Resolution No. 96-0171. DECISION Based on the Findings of Fact and Conclusions of Law above, the above application for a change of conditions application is hereby approved, subject to the conditions of the various public agencies specified below. Any changes to pubic agency conditions added or significantly altered by the Examiner are italicized. Fa.ilure to comply with the conditions of this approval may result in revocation of this approval by the Hearing Examiner. This approval does not waive the applicant's obligation to comply with all other requirements of other agencies with jurisdiction over land development. SPOKANE COUNTY DIVISION OF PLANNING 1. All conditions imposed by the Hearing Examiner shall be binding on the "Applicant", which term shall include the owners, developers and users of the property, and their heirs, assigns and successors. 2. The Change of Conditions applies to the following real property: That portion of the NW '/4 of the SW '/4 of Section 23, T. 25N., R. 43E.W.M., Spokane County, Washington, described as follows: Beginning at the Southwest corner of the NW '/a of the SW '/4 of said Section 23; thence N.00 05'45"W., along the West line of said Section 23, 281.97 feet; thence 5.88 34'40"E., 50.68 feet; thence 5.22 01' 12"E., 155.21 feet; thence S.50 02'09"E., 47.61 feet; thence 5.52 05'45"E., 29.27 feet; thence N.89 34'56"W., 108.12 feet; thence 5.00 05'45"E., 89.49 feet, to the south line of the NW '/4 of the SW '/4 of said Section 23; thence N.89 34'56"W., along South line, 60.00 feet to the Point of Beginning. Except that portion lying within Havana Road. 3. The proposal shall comply with the Urban Residential-3.5 (UR-3.5) zone, the Aquifer Sensitive Overlay zone, and all other applicable provisions of the Spokane County Zoning Code, as amended. 4. The applicant shall develop the subject property substantially in conformance with the site plan of record dated September 22, 2000, subject to the conditions of approval herein and compliance wit,h development regulations. Minor variations may be approved by the Director of the Division of Planning/designee under the criteria specified in Section 14.504.040 of the Spokane County Zoning Code, subject to compliance with regulation standards and conditions of approval. Any other modification must be presented through the submittal of a change of conditions application to the Hearing Examiner for review and approval at a public hearing. 5. Approval is required from the Director of the Division of Planning/designee'of a specific lighting and signing plan for the subject property prior to the release of any building pertnit. 6. Direct light from any exterior area lighting fixture shall not extend over the property boundary. HE Findings, Conclusions and Decision ZE-3A-98 Page 4 ♦ : 7. A specific landscape plan, planting schedule and provisions for the maintenance acceptable to the Director of the Division of Planning/designee shall be submitted with a performance bond or other suitable guarantee for the project prior to release of any building pernuts. Landscaping shall be installed and maintained so that sight distance at access points is not obscured or impaired. 8. The Division of Planning shall prepare and record with the Spokane County Auditor a Title Notice, noting that the property in question is subject to a variety of special conditions imposed as a result of approval of a land use action. This Title Notice shall serve as public notice of the conditions of approval affecting the property in question. The Title Notice should be recorded within the same time frame as allowed for an appeal and shall only be released, in full or in part, by the Division of Planning. Tbe Title Notice shall generally provide as follows: The parcel of property legally described as [ ] is the subj ect of a land use action by the Spokane County Hearing Examiner on September 27, 2001, approving a change of conditions application and imposing a variety of special development conditions. File No. ZE-3A-98 is available for inspection and copying in the Spokane County Division of Planning. SPOKANE COUNTY DIVISION OF BUILDING AND CODE ENFORCEMENT 1. The applicant shall contact the Division of Building and Code Enforcement at the earliest possible stage in order to be informed of code requirements administered/enforced as authorized by the State Building Code Act. Design/development concerns include addressing, fire apparatus access roads, fire hydrant flow, approved water systems, building accessibility, construction type, occupancy classification, existing exterior wall protection and energy code requirements. SPOKANE COUNTY DIVISION OF ENGINEERING AND ROADS Prior to release of a building permit or use of property as proposed, the following conditions shall be complied with: 1. Any required access permits and improvements to Pratt Avenue must be approved by the City of Spokane. 2. The applicant shall submit drainage and access plans for the review and approval of the Spokane County Engineer. Because this proposal is located in a joint planning area with the City of Spokane under the State Growth Management Act, the applicant is advised to consult with the City of Spokane to ensure that the drainage and access plans conform to adopted city standards. 3. All required improvements shall conform to the current State of Washington Standard Specifications for Road and Bridge Construction and other applicable County standards andlor adopted resolutions pertaining to Road Standards and Stormwater Management in effect at the date of construction, unless otherwise approved by the County Engineer. 4. The proposed change of conditions shall be improved to the standards set forth in Spokane County Resolution No. 1-0298, as amended, which establishes regulations for roads, approaches, drainage and fees in new construction. The applicant is advised that there may exist utilities either underground or overhead affecting the applicant's property, including property to be dedicated or set aside for future acquisition. Spokane County will assume no financial obligation for adjustments or relocation regarding these utilities. The applicant should contact the applicable utilities regarding responsibility for adjustment or relocation costs and to make arrangements for any necessary work. SPOKANE REGIONAL HEALTH DISTRICT 1. The sewage disposal method shall be as authorized by the City of Spokane Public Works. 2. Water service shall be coordinated through the City of Spokane Public Works. 3. Water service shall be by an existing public water supply when approved by the Regional Engineer (Spokane), State Department of Health. 4. A public sewer system shall be made available for the project and individual service provided to the lot. The use of an individual on-site sewage disposal system shall not be authorized. 5. The use of private wells and water systems is prohibited. CITY OF SPOKANE WATER AND HYDROELECTRIC SERVICES 1. An on-site water plan will need to be developed. The water plan must address domestic, irrigation, and fire flows for the project. The fire district has the authority to determine the fire flow requirement. The City's Water Department reserves the right to increase the fire flow. 2. City of Spokane Design Standards shall be utilized both in the development of the water plan and the installation of the water facilities. 3. Pursuant to chapter 36.70C RCW, the date of issuance of the Hearing Examiner's decision is three (3) days after it is mailed. This Decision was mailed by Certified Mail to the Applicant, and by first class mail to other parties of record, on September 27, 2001. The date of issuance of the Hearing Examiner's decision is therefore October l, 2001, counting to the next business day when the last day for mailing falls on a weekend or holiday. Surrounding uses are primarily single family residential, undeveloped land and a former rock quarry. Backaround: The application for the proposed Change of Conditions was submitted on September 25, 2000. A Technical Review meeting was held on October 19, 2000. The application was determined to be Technically Complete on June 13, 2001, and the Notice of Application was circulated at that time with a comment period ending on June 27, 2001. A zone reclassification, ZE-3-98, from Mining (MZ) to Urban Residential-3.5 (UR-3.5) for the development of a parking area for an adjacent church was approved by the Hearing Examiner on February 29, 2000, for the subject site. The requested Change of Conditions applies to the following condition of approval: DIVISION OF PLANNING CONDITION #4: The applicant shall develop the subject property in accordance with the site plan of record dated June 9, 1987. Minor revisions may be approved administratively by the Director/designee of the Division of Current Planning, pursuant to Section 14.504.040 of the Spokane County Zoning Code. Such revisions must conform to regulation standards and the conditions of approval. All other modifications must be submitted for the review and approval of the Hearing Examiner, pursuant to a change of conditions application. The original intent of the development plans shall be maintained. ZE-3A-98 Staff Report - August 1, 2001 Hearing 3 of 5 t' Y The purpose of the requested change of conditions is to allow modifications to the original site plan of record to allow the construction of a church on the subject site that will replace the existing church Iocated to the west. Required parking and drainage areas will be located on the site of the existing church. The subject property has been aggregated through a lot line adjustment with the property on which the existing church is located and approved by the Spokane County Division of Planning and the City of Spokane Planning Services (see CE-456-98), however, the property will continue to be identified by separate tax parcel numbers since each parcel is located within a separate taxing district. Staff Analvsis: Comprehensive Plan: The subject property is located within the Urban category of the Comprehensive Plan. The Urban category is intended to provide the opportunity for the development of a"citylike" environment, which includes various land uses, residential development and a high level of public facilities and urban services. It is primarily a residential category of single-family, two-family, multi-family and condominium buildings along with neighborhood commercial, light industrial, and public and recreational facilities. Objective 1.1 a promotes fill-in within established development areas where community facilities have already been established. Decision Guideline 1.1.1 states that "Urban development will be approved in areas having adequate power supplies, water, sanitary and storm sewers... City of Spokane water and sewer services are available to the site. Decision Guidelines 1.5.1 states that "Buffering and/or landscaping will be used to mitigate the differences between proposed developments and existing uses". A 10' wide strip of Type I landscaping will be provided along the south property line in order to buffer existing residential uses located south of the site. Objectives 1.5.e recommends that when a neighborhood experiences pressure for a change in character, such change shall be permitted upon appropriate review. Decision Guideline 1.5.8 recommends that when determining whether a proposal will change the character of an existing neighborhood, both the height and design of the proposed structure be considered. The site is also located within the Spokane City Fringe Area. The Fringe Area policies indicate that the Comprehensive Plan should be used as a primary tool for guiding development, and encourage growth and revitalization of portions of the Fringe Area that have already experienced development. Decision Guideline 30.1.4 states that urbanization of vacant urban areas should be permitted when consistent with City and County Plan policies relating to utility services, open space, and alternative living environments. The proposed zone reclassification is consistent with the Goals, Objectives and Decision Guidelines of the Urban category and Spokane City Fringe Area Sections of the Comprehensive Plan. Zoning: The existing zoning of the site is Urban Residential-3.5 (UR-3.5) established in 2000 (ZE-3-98), and previously classified as Mining (MZ) in 1958 (ZE-44-58). The purpose of the Urban Residential-3.5 (UR-3.5) zone is to implement the lower density range of the Urban category of the Comprehensive Plan. The intent is to promote areas of primarily single-family residential use in an urbanized neighborhood setting, having a high level of public services. Lots shall be served by a public water system and shall require connection to a public sewer system when available. Roadways shall be paved and curbed and may have sidewalks. The site is located adjacent to the City of Spokane and is within an established residential neighborhood. The proposed church is an allowed use within the existing Urban Residential-3.5 (UR-3.5) zone. Site Plan: The site plan of record illustrates a proposed church, approximately 3696 square feet in size, a future 1764 square foot addition, parking and drainage areas, and landscaping along the south side yard property line. Access to the site is from Pratt Avenue. The site plan illustrates that the northwest corner of the proposed building will be located on the adjacent parcel and within the City of Spokane. The subject site and adjacent parcel have been aggregated through an approved Certificate of Exemption (CE-456-98). We have the following comments and concems. • The proposal straddles the City Limits line. Who administers this project? • Which Zoning holds preference? This proposal lies in an area of Joint Planning. • This proposal straddles two parcels. This causes a problem for the Assessor with different tax rates within the same parcel. Aggregation of the parcels would be necessary in order to construct. • The right-of-way is irregular here and vacations and dedications should be accomplished at this time. Traf#ic Engineering would recommend annexation to the City of Spokane. Appropriate investigation to settle on the exact outline of the portion proposed for annexation should begin as soon as practical. Annexation solves who administers the project, creates a single appropriate taxing area, utilizes a single set of Zoning and Design Standards, and incorporates this parcel already using City water, sewer, and transportation facilities. It is the appropriate solution to the multi jurisdictional hurdles. We will be looking for standard driveways, curbing, sidewalks, parking and accessible stalls, appropriate signage, etc. (The site plan attached to the Staff Report is not definitive enough.)
