Members present: Mrs. Myers,• Chairperson, Mrs. Tennican and Mr. Skals tad. , Following are the applications in sequence and the action taken by the Conmittee. If not appealed, these decisions will become final on March 25, 1985. Al1 Find- ings and 0 rder for this hearing were signed on March 14, 1985. 1) ZE-59B-81, Change of Conditions in the Freeway Commercial Zone and VE-205-84a Variance from the Setback ReQuirements of the Freewa,y Commercial Zone: Gunning Location: Generally located south of Cataldo Avenue, approximately 150 feet west of Sullivan Road in Section 14-25-44. Pruposal: Addition of 14-Units to an existing Motel Action: Approval. (Vote: 3 - 0) The Zoning Adjustor also approved the requested Variance to allow a 32-foot f rom Cataldo Avenue, whereas Section 4.08A.050-(2) of the Spokane County Zoning Ordinance requires a 50-foot setback. 2) ZE-130-84, Agricultural to Multiple Family Suburban and . Zaning Hearing Examiner Comnittee Actions of March 7, 1985 (continued) 2) ZE-130-84 A ricultural to Multi le Famil Suburban and VE-1-85 Variance Request from the Frontage Requirement continued The Hearing Examiner Committee was concerned with the proposed density of the project and its compatibility with the existing multi-family developments in the imnediate area. The Zoning Adjustor approved the requested Variance to allow an apartment complex on a lot with 30-feet of public road frontage, whereas Section 4,07.060 of the Spokane County Zoning Ordinance requires 90-feet of frontage. (note: The applicant has additional trontage through a private easement.) 3) ZW-132B-78, Change of Conditions in the Mining Zone: Central Pre-Mix Concrete Location: Generally located south of and adjacent to Fort Wright Road, and approximately 1,600 feet easterly of the intersection of Fort Wright Road and Government Way in Section 11-25-42. Action: Withdrawal Accepted. (Vote: 2- 0) The application was withdrawn by the applicant by a letter dated February 14, 1985. 4) ZE-106-84, Agricultural Suburban to Commercial: East Bannen Properties Location: Generally located at the northeast corner of Sprague Avenue and Bannen Road in Section 14-25-44. Proposal: Retail Building Action: Approval. (Vote: 3 - 0) 5) ZE-120-$4, Agricultural to Residential Office and Multiple Family Suburban: Wyatt Location: Generally located east of and adjacent to the intersection of Buckeye Avenue and Pines Road in Section 10-25-44. Proposal: 270-Unit Multi-Family Complex Action: Approval for the Multiple Family Suburban Zone at a density of 9 dwelling units per acre (Site Size - Approximately 14.54 ' Acres). The Residential Office Zone request was denied. (Vote: 3 - 0) The Hearing Examiner Committee felt that the proposal was too dense for the advertised property north of the Freeway, con- sidering the impacts to the Aquifer and the uncertainty as to timing of availability of sewers in the area; therefore, it was felt that the dwelling units allowed should be reduced in number. The Residential Office Zone request wzs denied as future use for offices does not appear practical at this time • until an areawide sewer would be more readily available. - 2 - (continued) . In addi ti on, the Heari ng Exami ner Comni ttee i s concerned that allowing maximum density on this site without existing sewer hook-up may reduce the developer's incentive and the avai 1 abi 1 i ty of bonus densi ty i n the future for projects wi th sewer hook-ups. - It appears that this site is suited for multi-family development but that the issue appears to be that of density. Tennican: - lt is reasonable to understand the applicant's desire to maximize his development potential for this site, but the Heari ng Exami ner Commi ttee must al so consi der the rel ated impacts to a neighborhood; i.e., that of a single access point, i ncreased densi ty and traffic, and the fact of si ngle fami ly character west of Fancher. 2 , ~ [UNt RECLASSIFICATION N0. Also, the timing of sewers i n thi s area i s uncertai n. . ~yers: - That in all probability the proposed site would not develop into a single family residential area because of land costs and the adj acent condominium development. - Density would be more compatible at 35 units rather than the requested 40. _ - The Health District needs to do proper percolation tests for soi 1 sui tabi 1 i ty. - If the application is approved, Fancher should be paved. D. Within the landscape strip, 12 - 15-foot trees planted 25-feet apart shall also be provided. 2. The Zoning Administrator shall approve a specific exterior lighting plan for the approved area prior to installation of ' such lighting. (Such plan shall attempt to confine illumination to the area with full consideration to adjacent properties). A 3. A specific landscape plan, planting schedule and provisions for mai ntenance acceptabl e to the Spokane County Zoni ny Admi ni strator shal 1 be submi tted wi th a performance bond for the project prior to release of building permits. Landscaping shall be installed and maintained such that sight distance at access poi nts i s not obscured or i mpai red. 4. The applicant shall develop subject property generally_in accordance wi thi n the concept presented to the heari ng Exami ner Committee. Variations when approved by the Zoning Administrator will be permitted, including, buit not limited to the following changes: Building location, landscape plans, and general allowable uses of the permitted zone. All variations must conform to regul ati ons set forth i n the Spokane County Zoni ng Ordinance. The original intent of the development plans shall be mai ntai ned. 5. The specific development plan will be submitted for Planning Department review and approval prior to issuance of building permi ts. 6. All current standards of the Multiple Family Suburban Zone, as amended, shall be complied with in the development of this site. 7. That the project i s subject to •Section 4.16A.050, the Aqui fer Sensi ti ve Area Over1 ay Zone of the Spokane County Zoni ng Urdinance, which sets forth various measures for Aquifer protection; specifically, measures dealing with wastewater disposal, spill protection measures, and stormwater runoff. 4 ' . Pursuant to the provisions of Chapter 43.21C RCW, the SEPA Guidelines (WAC 197-1U) and the Spokane County Enviro rnnental Ordi nance ( SCEO a proposed decl arati on of non-si gni fi cance has been issued at least fifteen (15) days prior to this date; the official file, written comments and/or public testimory contain information regarding assessment of the proposal's likely significant adverse impacts to the physical environment; a fi ndi ng i s hereby made that no probabl e si gni fi cant adverse impacts upon the physical environ ment are anticipated as a resul t of the project; and a fi nal decl arati on of non-significance is hereby to be issued. 12. That the building placement on-site shall be located on the north and east property 1 i nes away from the resi dences on the south and west as far as possible. b) COUNTY ENGINEERING DEPARTMENT Pri or To The Issuance Of A Bui 1 di ng Permi t: l. Access permits for approaches to the County Road System shall be obtained from the Spokane County Engineer. 2. Applicant shall improve Fancher Road in a manner consistent with Spokane County TYPICAL roadway'section No. 1 minimum paving width Access Standard. 3. Roadway improvements along Fancher shall be constructed from the proposed driveway approach (Private Drive access to Fancher) to Eighth Avenue. 4. Applicant shall submit for approval by the Spokane County Engineer road, drainage, and access plans prior to the issuance of a building permit on the property. 5 • ~ . . . ZONE RECLASSIFICATION N0. The applicant shall submit for approval by the Spokane County Engineer and the Spokane County Health District a detailed combined on-site sewage system plan and surface water disposal pl an for the enti re project prior to the i ssuance of any building permit on the property. 6. A parking plan and traffic circulation plan shall be submitted' and approved by the Spokane County Engineer prior to the issuance of a building permit on the property. The design, location, and arrangement of parking stalls shall be in accordance wi th standard traffi c engi neeri ng practi ces. Pavi ng or surfacing as approved by the County Engineer, will be requi red for any porti on of the proj ect whi ch i s to be occupi ed or traveled by vehicles. , 7. The word "applicant" shall include the owner or owners of the property, his heirs, assigns, and successors. . 8. The construction of the road improvements stated herein shall be accomplished as approved by the Spokane County Engineer. 9. Al l requi red improvements sha11 conform to the current State of Washi ngton Standard Speci fi cati ons for Road and Bri dge Construction, and other applicable County standards and/or adopted resolutions pertaining to Road Standards and Stormwater Management in effect at the date of construction, unless otherwi se approved by the County Engi neer. lU. Roadway standards, typical roadway sections and drainage plan requirements are found in Spokane Board of County Commissioners' ftesolution No. 80-1592 as amended and are applicable to this proposal. 11. This plat or development proposal is located within a drainage basi n which has been f denti fied by the Spokane County Engi neer's Office as having stormwater runoff problems. Since this plat or development proposal is affected by or is a contributor to stormwater flows, property owners should participate in the pl anni ng and impl ementati on of a future basi nwi de stormwater management system. Sewage disposal method shall be as authorized by the Uirector of Utilities, Spokane County. 3. Water service shall be by an existing public water supply when approved by the Regional Engineer (Spokane), State Department of Social and Health Services. , 6. Use of private wells and water sy stems is prohibited. 7. Disposal of sewage effluent beneath paved surfaces is currently prohi bi ted. e) CUUNTY BUILDING AND SAFETY DEPARTMENT . 1. The site is located in Fire District # 1. 2. Fire hydrants which meet the fire flow are required to-be installed prior to any construction. These hydrants shall be placed so that no portion of the building exterior is more than 175 feet from the hydrant. The bottom of the lowest outlet of the hydrant shall be no less than 18 inches above grade. Where it is desired to have access control gates in residential developments, the following shall apply: The minimum width of roadway, inside of access gate, shall be twelve (12) feet. There shall be at least two (2) such drive approaches where the gates are located. One may be used for vehicles exiting. Tire flatting spikes shall not be used unless the entrance i s a mi nimum of twenty (20) feet wi de. The gates shall be provided with an appoved method of emergency operation in accordance with the fire department standards. Where each drive approach is less than twenty (20) feet in width and controlled by gates, a secondary means of access shall be provided with a clear, twenty (20) foot unobstructed opening. 8 • ' a . . A land use permit will be required for each structure. f) WATER PURVEYOR 1. Water Purveyor is Spokane Suburban Water Company, and they wi11 supply the site with adequate water for domestic, fire and irrigation uses; however, satisfactory arrangements to serve this proposal have not been made. 9 • a . ZONE RECLASSIFICATION N0. ZE-130-84 VARIANCE N0. VE- 1-85 g) COUNTY AIR POLLUTIUN CONTROL AUTHORITY l. Air pollution regulations require that dust emissions during - demolition, excavation and construction projects be controlled. Thi s may requi re use of water sprays, tarps, spri nkl ers, or . suspensi on of acti vi ty duri ng certai n weather condi ti ons. Naul roads shoul d be treated and emi ssi ons from the transfer of ' earthen material must be controlled as well as emissions from ' al l other constructi on rel ated acti vi ti es. 2. Measures must be taken to avoid the deposition of dirt and mud from unpaved surfaces onto paved surfaces. If tracki ng or spills occur on paved surfaces, measu res must be taken imnediately to clean these surfaces. 3. Al l travel led surfaces (i ngress, egress, parki ng areas, access roads) must be paved and kept clean. 4. It has been determined that fireplaces and wood stoves are a significant source of suspended particulates. The small particlet (L lO(nicrons) are respirable and can have an adverse effect upon the health of the public. We strongly urge that if wood stoves/fireplaces are used, that burning be done as efficiently as possible. All wood should be seasoned and stored in a dry place. During periods of poor ventilation or elevated air pollution levels, we request that use of wood stoves and fireplaces be discontinued. 5. Some obj ectionable odors will likely result during the constructi on phase of the proj ect and f rom motor vehi cl es usi ng the si te fol l owi ng compl eti on of the proj ect and from occupants of the proposed project. - 6. All air pollution regulations must be met. 7. Additio nal Comments: We request denial of the proposed project unless Woodlawn Drive from 8th Avenue to Fancher and Fancher from 8th Avenue to Woodlawn Drive are paved. lU r . That the appellant among other items raised concerns, at the public hearing before the Board, about the height of structures, sewerage concerns and si dewal k requi rement. The approval of this proposal as condi ti oned herei n, adequately addresses these concerns. 15. That with regards tothe requested Yariance before the Zoning Adjustor, the Board has no jurisdiction in that matter and makes no findings as to the meri ts of the request. 16. That the proper 1 egal requi rements for adverti si n9 of the hearing before the Board of County Commissioners of Spokane County have been met. 17. That on the llth day of J une, 1985, the Board of County Cortmissioners of Spokane County at a regular meeting did APPROYE in part and DENY i n part the proposal sub3 ect to certai n condi ti ons. DECISION From the foregoing Findings, a review of the Planning Department Staff Report dated March 7, 1985, and the Staff presentation of File No. ZE-130-84, the 8oard hereby in APPROYING in part and DENYING in part, the proposal does make the fol l owi ng conditions: , CONDITIONS 1. The Comprehensive Plan Text Decision Guidelines suggest that hlultiple Family Suburban projects be located with near direct access to a major arterial, near public transit routes, improve or maintain the character of an area, and serve as a transitional use located between single family residential and the more intensive uses. The project can also be considered as being a fill-in-development. South 14ultiple Family Suburban, Estab, 1971 3) hISTURY OF LAND USE ACTIONS: The more recent zone changes in the area have been to Residential hlanufactured home in 1974 and Multiple Family Suburban in 1971 for the Central Park condominium development. The Planning Commission in approving the Central Park Condo proj ect for 272 units, they limited the structure height to one story along 8th Avenue, Eastern and Fancher Roads. The interior uni ts coul d be 2 stori es, wi th the uni ts al ong the north boundary limited to 3 stories. Sight screening and landscaping around parking lots were required, and vacation or new dedications were also required with controlled access points to County Roads. The Planning Commission found the proj ect to be in reasonable proximity to shopping and other community services, that tne property was on the edge of a residential neighbohood and that the proposal, subject to required conditions, provided the best alternative for residential development. The Planning Commission felt that the area woul d not be readi ly devel oped for qual i ty si ngl e fami 1y resi dences, and felt that the site, if developed in mobile homes, would have a greater impact on the surrounding properties. A portion of the easement i s. uti lli zed by an access dri veway to the si te. The Staff cannot address the issue of usability of this easement for forty apartment dwellers or the extent of pading,:landscaping or other uses that may occur wi,thin the easement area. These issues are left to be resolved between the affected parties,. Should the easement not be utilized for the above purposes, it appears a redesign of the dri veway can be accompl i shed wi thi n the 30-foot ownershi p of the applicant. The Countjr Engineer has required road improvements along Fancher to Eighth Avenue. IV. CUNCLUSION: The project can be consistent with the Comprehensive Plan Uecision Guidelines for high density development, if compliance with the recommended conditions is provided. The rezone to Multiple Family Suburban is consistent with past ione changes in the area, although more dense; and Fancher Road bei ng a publ i c street, has 'been condi ti oned by the. County Engineer to accommodate the project traffic volumes.
