ZE-16-01 SPOh:ANE COUNTY HEARING EXAMINER RE: Zone Reclassification from the UR-7 ) FINDINGS OF FACT, Zone to the UR-12 Zone; and ) CONCLUSIONS OF LAW, Variances in the UR-12 Zone; ) AND DECISION Applicant: James Herb ) File No. ZE-16-01 and VE-15 -O 1 ) ) This matter coming on for public hearing on February 6, 2002, the Hearing Examiner, after review of the zone reclassification application, variances application and the entire record, hereby makes the following findings of fact, conclusions of law and decision: 1. FINDINGS OF FACT 1. The subject applications request a rezone of approximately 20,850 square feet of land from the Urban Residential-7 (UR-7) zone to the Urban Residential-12 (CTR-12) zone; and also request related variances from the front yard setback, flanking street yard setback, rear yard setback, minimum frontage, minimum lot size and minirnum lot depth requirements of the UR-12 zone; all for the purpose of allowing two (2) houses and three (3) manufactured homes to remain on the subject property. 2. The site is located at the southeast comer of Fourth Avenue and Girard Street, in the NE 1/4 of Section 24, Township 25 North, Range 43 EWM, Spokane County, Washington. 3. The site is currently referenced as County Assessor's tax parcel nos. 35241.3309 and 35241.3310. The subject property is legally described as Lots 5-9, Block 1, Second Empire Heights Addition, recorded on October 11, 1910 at Book O, Page 20 of Plats, Spokane County Auditor. 4. The applicant for the proposal and the site owner is James Herb, 7109 South Brookshire Court, Spokane, WA 99223. 5. The Hearing Examiner heard the application pursuant to the County Hearing Examiner Ordinance (County Resolution No. 96-0171) and the County Hearing Examiner Rules of Procedure (County Resolution No. 96-0294). 6. The requirements for notice of public hearing were met. 7. The Hearing Examiner conducted a site visit on February 5, 2002. 8. A public hearing was held on the subject applications on February 6, 2002. The Hearing Examiner consolidated the hearing on the rezone application with the hearing on the variances application. On March 7, 2002, the Hearing Examiner reopened the record to consider certain County documents relating to the placement of the existing residences and manufactured homes on the site in 1980-1981. See letter erroneously dated March 7, 2001 from Hearing Examiner to Janzes : Herb and Christina Chenoweth. On March 15, 2002, James Herb and Christina Chenoweth respectfully submitted letters in response to the additional documents. 11. The County Division of Planning issued a Determination of Nonsignificance for the proposed rezone on February 4, 2002. 12. The Hearing Examiner takes notice of the County Generalized Comprehensive Plan, GMA Comprehensive Plan and Capital Facilities Plan, GMA Comprehensive Plan map, Phase I . Development Regulations, County Resolution Nos. 1-1033 and 2-0037, County Arterial Road Plan maps, County official zoning maps, County Zoning Code, County Code, Spokane County Zoning Ordinance (now expired), other applicable development regulations, and prior land use decisions in the vicinity. 13. The record includes the documents in the proj ect file at the time of the public hearing, the documents and testimony submitted at the public hearing, the documents submitted for the record between the public hearing and March 15, 2002, and the items taken notice of by the Hearing Examiner. 14. The site is approximately 20,850 square feet in size and is currently improved with two (2) houses and three (3) single-wide, mobile homes. Such residences range from 540 squaxe feet to 705 square feet in size. The site slopes moderately down from the south to the north, with three topographic bench areas accommodating the homes from north to south. The site is divided from north to south into two (2) tax parcels, each having a length of approximately 138-139 feet from north to south. The westerly tax parcel is approximately 12,400 square feet, and has approximately 90 feet of frontage along both Fourth Avenue and a public alley. The easterly tax parcel is approximately 8,320 square feet in size, and has 60 feet of frontage along both Fourth Avenue and the public alley. HE Findings, Conclusions and Decision ZE-16-01/VE-15-01 Page 2 ~ 15. In 1910, the site was divided into five (5) rectangular lots, each approximately 30 feet wide and 138-139 feet long. Each lot has 30 feet of frontage along both Fourth Avenue and a public alley, at the north and south ends of the property, respectively. 16. The single-family homes aze respectively located in the northwest and southeast corners of the site, and were constructed on the site in the 1930s. At the time, the County did not require building permits for the placement of stnictures. In 1953, a building permit was issued for a two- car garage on the easterly one-third of the site. In 1960, a building permit was issued to allow a trailer for sleeping quarters to be installed on the westerly two-thirds of the site. The garage and trailer do not currently appear to be located on the subject property. 17. In 1980, the mobile home located in the center portion of the easterly third of the site was installed, and power and a pad were installed for the mobile homes located in the northeast and southwest corners of the site. 18. In December of 1980, the County Building Codes Department commenced an investigation of the placement of the mobile homes on the site as an illegal mobile home park. In March, 1981, the Department found that the installation of the mobile homes complied with County regulations as long as installed as per plot plan...". See notes by Mark Holman. The reference to "plot plan" logically means the "mobile home park plan" required to be submitted to the County Planning Departrnent for mobile home parks in the Residential Mobile Home zone of t11e now expired County Zoning Ordinance, which zoning applied to the site in 1980. See Sections 4.24.110 and 4.05A.040 of July, 1980 version of County Zoning Ordinance. 19. County building permit and zoning files relating to investigation of the 1980 complaint and the mobile home park cannot be located, or were purged by the County along with other files compiled during the 1980s. The County records admitted into the record from 1980-1981 were obtained from the County Division of Planning, which obtained the records from the County Division of Utilities. 20. No building permits could be located for placement of the mobile homes. The record indicates that, more likely that not, such permits were not applied for, though required by County ordinance; but that the lack of said permits was not enforced by the County at the time. 21. The mobile homes located on the site were in compliance with the applicable development standards for a mobile home park in 1980, except that the mobile home in the northeast corner of the site should have been placed 25 feet from Fourth Street, instead of 23 feet, and at least 10 feet from the east property line, instead of one (1) foot. 22. The site plan of record for the proposed zone reclassification, submitted on August 21, 2001, illustrates the existing improvements on the subject property. A site plan for a boundary line adjustment, submitted on the same date for the proposed rezone, proposed variances and a related short plat application, illustrates division of the site into four (4) lots. The lots range from 3,402 square feet to 4,200 square feet in size. Each lot would contain one of the e:cisting residences on the subject property. The overall density of the proposed short plat is approximately 10.4 dwelling units per acre. A private driveway would provide vehicular access to Girard Street for Lots 3 and 4 of the proposed short plat. HE Findings, Conclusions and Decision ZE-16-01/VE-15-01 Page 3 23. The staff report submitted for the variances application, on page 6, indicates the existing variances proposed by the applicant and the applicable development standards of the UR-12 zone. The UR-12 zone respectively imposes a minimum lot area, minimum frontage and minimum depth for single-family dwellings of 4,200 square feet, 50 feet and 80 feet. 24. The site is the subject of a zoning complaint for having more than one dwelling on each of two parcels of property. The complaint originated from the difficulty of extending public sewer to the subject property due to the absence of legal lots or spaces for the existing residences on the site. 25. Effective January 1, 1991, the zoning of the site and surrounding properties was reclassified from the Residential Manufactured Home zone of the now expired County Zoning Ordinance to the Urban Residential-7 (UR-7) zone, under the Program to Implement the Spokane County Zoning Code. The site is also located in the Aquifer Sensitive Overlay zone and the Public Transit Benefit Area designated by the Zoning Code. 26. The current rezone and variances applications, environmental checklist, site plan of record and application fees were submitted on August 17, 2001. At the time, the applications were subject to the land use processing procedures set forth in County Resolution No. 96-0293. 27. Effective September 1, 2001, County Resolution No. 1-0700 replaced Resolution No. 96-0293. Resolution No. 1-0700 provided that land use applications submitted before September 1, 2001 would be processed under Resolution No. 96-0293 until a Determination of Completeness is issued, at which time the application would be further processed under the procedures set forth in Resolution No. 1-0700. 28. County Resolution No. 96-0293 provided for a deternunation of "counter-completeness", as well as a determi.nation of "technical completeness". Such two-tiered completeness process conflicted with local land use procedures specified in chapter 36.70B RCW. County Resolution No. 1-0700 eliminated this ambiguity and provides for one determination of completeness. 29. On Decernber 17, 2001, the County Division of Planning issued a Determination of Completeness for the subject rezone and variances applications, which stated the date of "counter-completeness" (under Resolution No. 96-0293) as August 17, 2001. Upon issuance of the Determination of Completeness, the applications were subject to further processing under Resolution No. 1-0700. 30. The date of "counter-completeness" represents the date when all the requirements for a complete application have been submitted. This date was August 17, 2001 for the subject rezone and variances appiications. 31. On January 15, 2002, the County implemented a new Comprehensive Plan ("GMA Comprehensive Plan"), County Urban Growth Area, and Phase I Development Regulations; all in implementation of the State Growth Management Act. The County also repealed the interim development regulations and interim urban growth area (IUGA) boundaries previously adopted by the County under the Growth Management Act. See County Resolution No. 2-0037. HE Findings, Conclusions and Decision ZE-16-01/VE-15-01 Page 4 1 cc 32. The Phase I Development Regulations allow rezone applications which are counter- complete" before the adoption of such regulations on January 15, 2002, perta.in to land located within the Urban Growth Area and which are inconsistent with the GMA Comprehensive Plan to be processed under the comprehensive plan and land use regulations in effect when the application became "counter-complete". If the rezone application is approved, the zoning will be effective for a period of one (1) year, and development may proceed on the property under the conditions of the rezone if a building permit is submitted within the 1-year period. After the 1- year period, the zoning of the rezoned property will "crossover" to the zone designated in the crossover matrix of the Phase I regulations. 33. The site and neighboring properties are designated in the Medium Density category of the GMA Comprehensive Plan, and within the Urban Growth Area. Under the Phase I Development Regulations, the crossover zone for the current site and surrounding properties is the UR-7 zone, the zone that currently applies to the site. 34. The Phase I regulations require that any rezone applications submitted under the GMA Comprehensive Plan and Phase I Development Regulations be consistent with the GMA Comprehensive Plan category for the property atid the implementing zone set forth in the Phase I regulations for such category. The implementing zones for the Medium Density category of the GMA Comprehensive Plan are the UR-7 and UR-12 zones. 35. Neighboring properties are developed for single-family homes on various-sized urban lots zoned UR-7. 36. The County Arterial Road Plan in the Comprehensive Plan designates Fourth Avenue in the vicinity as a Collector Arterial. The Arterial Road Plan in the GMA Comprehensive Plan designates such road as an Urban Collector Arterial. Girard Street is considered a Local Access road under both plans. Park Road, located approximately 500 feet east of the site, is designated as a Principal Arterial in both plans. Sprague Avenue and Appleway Road, which are designated as Principal Arterials under both plans, form a one-way couplet in the area, and comprise a significant transportation and commercial corridor in the South Valley area of the county. 37. The current rezone application must be considered under the comprehensive plan and development regulations in effect on August 17, 2001, the date when the application became "counter-complete". This includes the old Comprehensive Plan ("Comprehensive Plan"), County Zoning Code, County Road Standards, Critical Areas Ordinance, Stormwater Control Ordinances, and other development regulations in effect on such date. 38. As recommended by the Urban category of the Comprehensive Plan and the purpose and intent statement of the UR-12 zone, the proposal will be served by a high level of public services and facilities, including public sewer and water, and modern utilities. 39. The site meets the definition of "fill-in" development in the Urban category, since it is located between and in close proximity to at least two developed geographic areas having densities and land uses conforming to their Comprehensive Plan land use categories designated for such areas, and the development will aid in the cost-effectiveness of utilities and public facilities and services. See Comprehensive Plan, Glossary and Decision Guideline l.l.a. HE Findings, Conclusions and Decision ZE-16-01/VE-15-01 Page 5 ~40. The site is located along an arterial, as recommended for higher density developments in the Urban category of the Comprehensive Plan, and also has convenient access to the major arterial systems to the north and east. 41. Christina Chenoweth and Vivian Chenoweth, who reside near the site, were the only parties of record who objected to the proposal. Such parties own a total of five (5) lots located west of the site and Girard Street, south of Fourth Avenue. Such owners expressed concern regarding how the residences on the site would be connected to and charged for public sewer, the lack of enforcement and absence of County documents for the 1980 zoning violation pertaining to the site, the inadequacy of the proposed lot sizes for the residences on the site, and other concerns. 42. There is no record of any recent complaints received from neighboring property owners regarding the subject property. The owner of a residence located immediately south of the site across the alley expressed support for the proposal; as long as the approval was limited to the existing residences on the site, and provided multi-family dwelling units were not constructed on the subject property. See letter dated 12-31-01 from Wanda Warren. 43. Support for the project was expressed by the person residing in the house located on the westerly two-thirds of the site, who helps manage the residerices on the site, and by a person residing in one of the trailers on the subject property. Both residents have lived on the site for the past approximately 18 years. 44. The applicant has installed attractive landscaping and cyclone fencing on the subject property. See photos submitted by Rick Souza. 45. A motor home without the undercarriage or wheels has been placed along the west side of the residence located at the northeast corner of the site, adjacent to the intersection of Girard Street and Fourth Avenue. The structure is unariractive, appears to encroach on the flanking street yard setback and should be required to comply with applicable setback or other zoning requirements. 46. The location of the existing residences on the site for over 20 years, with the apparent or tacit approvaUacquiescence of the County, and the long term residency of two parties of record on the site in reliance thereon, comprise "special circumstances", such that strict application of the Zoning Code creates "practical difficulties" that deprive the property of development options or opportunities enjoyed by other properties in the vicinity and with a similar zone reclassification. "Practical difficulties" may be the result of governmental action, error or oversight that is not unlawful". See Zoning Code 14.404.082 (4)(e). 47. Relaxation of the Zoning Code as proposed will facilitate the extension of public sewer to the residences located on the subj ect property, and removal of existing on-site sewage systems that jeopardize the water quality of the Spokane Aquifer. 48. County Engineering conditions require the owner of the site to participate in a future road improvement district for the improvement of Fourth Avenue and Girard Street, including the addition of pavement, curb and sidewalk. County Planning conditions require the applicant to insta1120 feet of Type III landscaping along the north and west boundaries of the subject HE Findings, Conclusions and Decision ZE-16-01/VE-15-01 Page 6 ~ property. In these respects, as well as preventing dislocation of long-term residents of the site, approval of the proposed variances may serve a broader public or community interest. 49. Approval of the proposed variances would not be substantially based on illegal or nonconforming circumstances on other properties, but would substantially be based on nonconforming circumstances on the subject property. However, it would serve the public interest more to approve the proposed variances than to strictly enforce zoning standards on existing residential uses after the passage of 20 years, where such uses substantially conformed to the County Zoning Ordinance at the time, and such uses were installed or permitted to remain with the apparent or tacit approval of the County. 50. The staff report for the proposed variance proposal indicates that several telephone inquiries have been received from property owners in the vicinity regarding the ability to establish smaller lot sizes to allow the construction of an additional residence on property. Considering the uniqueness of the special circumstances involved, approval of the proposed variances will not establish a precedent that will adversely affect the zoning concept for the area or county as a whole. , 51. The proposed variance proposal will not result in a de facto rezone, since the applicant is requesting a rezone to allow the residential density for the proposed short plat of the site. 52. The variance proposal is not based on upon a lack of economic return, a claim that an existing structure is too small, or the purpose of circumventing density regulations designed to protect groundwater. 53. Separate sewer hookups, connection fees and service charges are required for each residence and proposed short plat lot. See County Division of Utilities conditions of approval, Spokane County Sewer Ordinance, and testimony of James Herb. 54. Approval of the rezone should be conditioned on limiting use of the site to single-family residences and associated accessory uses pernutted by the UR-12 zone. 55. Manufactured homes and manufactured home parks are pernutted in all residential zones of the County Zoning Code, subj ect to certain standards. 56. No public agencies expressed opposition to the project. 57. The proposal has been conditioned for compliance with the development standards of the UR-12 zone and other applicable provisions of the County Zoning Code, and the recommendations of the commenting public agencies. As conditioned, the project will be reasonably compatible with, and not have a significant negative impact on, neighboring land uses. The project, as conditioned, generally conforms to the Comprehensive Plan. 58. No public agencies objected to the Determination of Nonsignificance (DNS) issued for the proposal by the County Division of Plasuning. The proposal will not have more than a moderate effect on the quality of the environment, and the Examiner concurs with issuance of the DNS. The procedural requirements of chapter 43.21 C RCW and chapter 11.10 of the Spokane County Code have been met. HE Findings, Conclusions and Decision ZE-16-01/VE-15-01 Page 7 ~ 59. Changed conditions have occurred in the area since the zorung of the site was reclassified to the UR-7 zone on January 1, 1991, pursuant to the Program to Implement the Spokane County Zoning Code. This includes the availability of public sewer to the subj ect property, development of the Sprague Avenue/Appleway Avenue couplet, adoption of the GMA Comprehensive Plan and Phase I Development Regulations, designation of the site in the Urban Growth Area, and increased population growth in the area. Based on the above findings of fact, the Hearing Examiner enters the following: H. CONCLUSIONS OF LAW 1. The proposed rezone and variances applications, as conditioned, generally conform to the Comprehensive Plan. 2. The proposed rezone will not be detrimental, and bears a substantial relationship, to the ~ public health, safety or welfare. 3. A change in economic, technological, or land use conditions has occurred to warrant the proposed rezone, and a substantial change of circumstances has occurred in the area since the site was last zoned. 4. Because of special circumstances applicable to the property, strict application of the setback, minimum frontage, minimum lot size and minimum depth requirements of the Urban Residential-12 (UR-12) zone creates practical difficulties and deprives the site of rights and privileges enj oyed by other properties in the vicinity and similarly zoned. 5. As conditioned, granting of the variances will neither be detrimental to the public welfare nor inj urious to the property or improvements in the vicinity and the UR-12 zone. 6. The procedural requirements of the State Environmental Policy Act and the County's Local Environmental Ordinance have been met. The proposal, as conditioned, will not have a significant, probable adverse impact on the environment. 7. The proposed rezone meets the criteria established by Washington case law for approving a rezone, and the criteria established in paragraphs 14.402.020 (1)(2) of the County Zoning Code for amending the County official zoning map. 8. The proposed variances meet the criteria established for a variance established in Chapter 14.404 of the County Zoning Code. 9. Approval of the rezone and variances is appropriate under section 11 of the County Hearing Examiner Ordinance, adopted by County Resolution No. 96-0171. HE Findings, Conclusions and Decision- ZE-16-01/VE-15-01 Page 8 / III. DECISION Based on the above Findings of Fact and Conclusions of Law, the application for a rezone to the Urban Residential-12 (LTR-12) zone, and the variances application, are hereby approved, subject to the conditions of approval of the public agencies stated below. Any conditions of such agencies that have been added or significantly revised by the Hearing Examiner are italicized. Failure to comply with the conditions of this approval may result in revocation of this approval by the Hearing Examiner. This approval does not waive the applicant's obligation to comply with all other requirements of other agencies with jurisdiction. SPOKANE COUNTY DIVISION OF PLANNING 1. ` All conditions imposed by the Hearing Examirier shall be binding on the "Applicant," which term shall include the owners and developers of the property, and their heirs, assigns and successors. 2. The zone change and variance approvals apply to Lots 5-9, Block 1, Second Empire Heights Addition, recorded on October 11, 1910 at Book O, Page 20 of Plats, Spokane County Auditor. 3. The proposal shall comply with the Urban Residential-12 (LJR-12) zone, the Aquifer Sensitive Overlay zone, and all applicable provisions of the Spokane County Zoning Code, as amended. 4. The applicant shall develop the subject property substantially in uccordance with the site plan of record for the zone reclassification, and the boundary line adjustment site plan, which were submitted to the County Division of Plunning on August 21, 2001 in File Nos. ZE-16-01, VE-15-01 and SP-1289-01. Variations may be approved administratively by the Director of the Division of Planning/designee, subject to conditions of approval and Section 14.504.040 of the . County Zoning Code as amended. All variations must conform to regulations set forth in the Spokane County Zoning Code, and the original intent of the development plans shall be maintained. 5. The variance approvals are limited to the variances described on page 6 of the February 6, 2002 staff report in File No. VE-15-01. 6. The applicant shall specifically comply with the landscaping standards of Section 14.806.040(2)(a) of the Spokane County Zoning Code as amended. 7. A motor home without wheels and/or undercarriage appears to have been installed permanently in the southwest corner of the site, west of the residence located at 7302 East Fourth Avenue. The motor home may encroach on the flanking street yard setback or be in HE Findings, Conclusions and Decision ZE-16-01/VE-15-01 Page 9 violation of building permit requirements, and shall be removed if such standards are being violated. 8. The Division of Planning shall prepaze and record with the Spokane County Auditor a Title Notice, which notes that the property in question is subject to a variety of special conditions imposed as a result of approval of a land use action. This Title Notice shall serve as public notice of the conditions of approval affecting the property in question. The Title Notice should be recorded within the same time frame as allowed for an appeal and shall only be released, in full or in part, by the Division of Planning. The Title Notice shall generally provide as follows: "The parcel of property legally described as Lots 5-9, Block 1, Second Empire Heights Addition, recorded on October 11, 1910 at Book O, Page 20 of Plats, Spokane County Auditor, is the subject of a land use decision by the Spokane County Hearing Examiner on March 28, 2002, approving a zone reclassification and zoning variances for such property, and imposing a variety of special development conditions. File Nos. ZE-16-01 and VE-15-O1, which contain a copy of such decision, are available for inspection and copying in the Spokane County Division of Planning.,, SPOKANE COUNTY BUILDING AND CODE ENFORCEMENT 1. The applicant should contact the Division of Building and Code Enforcement at the earliest possible stage in order to be informed of code requirements administeredlenforced as authorized by the state Building Code Act. Design/development concems include addressing, fire apparatus access roads, fire hydrant flow, approved water systems, building accessibility, construction type, occupancy classification, existing exterior wall protection and energy code requirements. SPOKANE COUNTY DIVISION OF ENGINEERING AND ROADS Prior to release of a building permit or use of the property as proposed: 1. Approach permits are required prior to any access to the Spokane County Road System. 2. To construct the roadway improvements stated herein, the applicant may, with the approval of the County Engineer, join in and be willing to participate in any petition or resolution which purpose is the formation of a Road Improvement District (RID) for said improvement pursuant to RCW 36.88, as amended. Spokane County will not participate in the cost of these improvements. This provision is applicable to Fourth Avenue and Girard Road. 3. As an alternative method of constructing the road improvements stated herein, the applicant may, with the approval of the County Engineer, accomplish the road improvements stated herein by joining and participating in a County Road Project (CRP) to the extent of the required improvement. Spokane County will not participate in the cost of these improvements. This provision is applicable to Fourth Avenue and Girard Road. 4. The County Engineer has designated a Local Access Roadway Section for the improvement of Fourth Avenue, which is adjacent to the proposed development. This will require the HE Findings, Conclusions and Decision ZE-16-01/VE-15-01 Page 10 1 installation of five (5) feet of asphalt. Curbing and sidewalk must also be constructed. 5. The County Engineer has designated a Local Access Roadway Section for the improvement of Girard Road, which is adjacent to the proposed development. This will require the addition of approximately five (5) feet of asphalt along the frontage of the development. Curbing and sidewalk must also be constructed. 6. All required improvements shall conform to the current State of Washington Standard Specifications for Road and Bridge construction and other applicable County standards andlor adopted resolutions pertaining to Road Standards and Stormwater Management in effect at the date of construction, unless otherwise approved by the County Engineer. 7. Roadway standards, typical roadway sections and drainage plan requirements are found in Spokane County Resolution No. 1-0298 as amended and are applicable to this proposal. 8. No construction work is to be performed within the existing or proposed right of way until a pennit has been issued by the County Engineer. All work within the public road right of way is subj ect to inspection and approval by the County Engineer. 9. The applicant shall sign "Spokane County Notice to the Public Number 6", which specifies the following: "The owner(s) or successor(s) in interest agree that in consideration of Mutual Benefits now or to be hereafter derived, do for themselves, their heirs, grantees, assigns and successor(s) in interest hereby request and authorize Spokane County to include the above described property in a Road Improvement District (RID) and to support the formation of a Road Improvement District for improvement of the road(s) described below by requesting and authorizing Spokane County to place their name(s) on a petition for the formation of a Road Improvement District pursuant to RCW 36.88.050, or by requesting and authorizing Spokane County to cast their ballot in favor of a RID being formed under the resolution method pursuant to RCW 36.88.030, andlor by not filing a protest against the formation of a RID being formed under the alternative resolution method provided for in RCW 36.88.065 and Chapter 35.43 RCW. If an RID is proposed for improvement of the road(s) described below, said owner(s) and successor(s) further agree: (1) that the improvements or construction contemplated within the proposed RID are feasible (2) that the benefits to be derived from the formation of the RID by the property included therein, together with the amount of any County participation, exceeds the cost and expense of formation of the RID, and (3) that the property within the proposed RID is sufficiently developed; provided, they, their heirs, grantees, assigns and successor(s) shall retain the right, as authorized under RCW 36.88.090, to object to any assessment(s) on the property as a result of the improvements called for in conjunction with the formation of a RID by either the petition or resolution method under Chapter 36.88 RCW, and to appeal to the Superior Court the decision of the Board of County Commissioners confirming the final assessment roll; provided further, it is recognized that actual assessments may vary from assessment estimates as long as they do not exceed a figure equal to the increased true and fair value the improvement(s) add(s) to the property. The applicant is advised that there may exist utilities either underground or overhead affecting the applicant's property, including property to be dedicated or set aside future acquisition. Spokane County will assume no financial obligation for adjustments or relocation regarding these utilities. The applicant should contact the applicable utilities regarding the responsibility for adjustment or relocation costs and to make arrangements for any necessary work. 11. The applicant shall grant applicable border easements adjacent to Spokane County Right of Way per Spokane County Standards. 12. The applicant shall execute a Spokane County Notice to Public No. 4 for the purposes of allowing driveway access though the existing alley, which is right-of-way that has not been established for public maintenance. 13. Information submitted with this application indicates that should the proposed zone change and variances be approved, that an application for short plat will be submitted for review. The applicant is advised that additional review will be conducted and additional comments will be submitted at such time a short plat application is circulated for review. SPOKANE REGIONAL HEALTH DISTRICT 1. The sewage disposal method shall be as authorized by the Director of Utilities, Spokane County. 2. Public Comments: Three (3) letters of public comment have been submitted, all in favor of the proposed zone reclassification and associated variance request. Description of the Site: The site consists of two legal lots of record, is approximately 20,850 square feet in size and currently contains 2 houses and 3 manufactured homes. The site is slopes from south to north and has two access points, one from 4'h Avenue and the other from Girard Street. Surrounding uses in the vicinity of the subject property include single family residences. BackQround: The Division of Planning was notified by the Division of Utilities of an alleged violation of the Spokane County Zoning Code and the property owner was subsequently sent a Notice of Violation for having more than one dwelling on a parcel. The Notice of Violation was sent on March 21, 2000 and to a second address for the owner on March 29, 2000. The file was referred to the Spokane County Prosecutors on May 30, 2000. A Final Notice of Violation was issued on February 16, 2001 and again referred to the Prosecutor's Office on March 27, 2001. The owner's designated agent, Rick Souza, attended a pre- conference meeting for a Zone Reclassification, Variance and Short Plat on May 11, 2001. Due to the location of the existing five residences and the area (square footage) of the 2 combined parcels, the applicant was required to apply for a Zone Reclassification to obtain the smaller lot size and frontage requirements, a Variance (numerous, see chart in VE-15-01) for relief from the setback and frontage requirements, and lot line adjustment to isolate one of the existing residences, a Short Plat for the division of the remaining property into 4 residential lots and finally, an administrative exception for lot size on 3 of the Iots to be platted. In order for these processes to flow in an orderly fashion, the Zone Reclassification had to be reviewed first, followed by the Variance request (based upon the lot configuration for the pending Short Plat SP-1289-01) which is also scheduled for public hearing on February 6, 2002, at 10:30 am. The application for the proposal was submitted to the Division of Planning on August 17, 2001. A technical review meeting was held on September 6, 2001, the application was determined to be Complete on December 17, 2001, and Notice of Application was issued the same day, with a 14 day public comment period ending on December 31, 2001. The site is located within the Interim Urban Growth Area (IUGA) as adopted by the Board of County Commissioners Resolution #97-0321. Staff Analvsis: Comprehensive Plan: The subject property is located within the Urban category of the Comprehensive Plan. The Urban category is intended to provide the opportunity for the development of a"citylike" environment with intensive residential uses and public facilities and services. Detailed Definition B states that "Since urban areas will be the most intensely developed of all the categories, it is primarily a residential category of single family two family and multifamily along with neighborhood commercial and light industrial uses. The more intensive land uses will be located near the heavily traveled streets, while the least intensive residential uses will be isolated from the noise and heavy traffic." The site is located at the southeast corner of the intersection of 41 Avenue and Girard Street, which are identified as a Collector Arterial and Local Access Road, respectively, by the Spokane County Arterial Road Plan. ZE-16-01 Staff Report - February 6, 2002 Hearing 4 of 6 y Detailed Definition D states that "Due to the variefy and mix or land uses'and activities found in the Urban category, few land use activities would be inappropriate. Many uses may require screening or other standards to make them compatible with one another." Objective 1.1.a encourages fill-in within established development areas and existing outlying communities where utilities, arterials, schools and community facilities have already been established. The properties surrounding the subject site have been fully developed to the maximum allowed density. Decision Guideline 1.1.1 recommends that urban development will be approved in areas having adequate power supplies, water, sanitary and storm sewers, streets, and school and fire services provided that such development meets the intent of other Objectives and Decision Guidelines of this section. The subject site is located in an area currently serviced by public agencies for water, sewer, schools and fire protection. Decision Guideline 1.1.4 recommends that a variety of densities and residential uses should be available to provide a freedom of choice to live in Urban areas with varying densities, combinations or mix of uses. Objective 1.3.c states that residential platting should be developed with public sewers where it can be established that alternatives would be a threat to the water source. Although not part of this action, the applicant has indicated a desire to short plat the property to establish the existing residences on separate, legal lots. Decision Guidelines 1.3.3 and 1.6.1 recommend the provision of sanitary and storm sewer for developments to protect water quality when the provision is consistent with County plans, policies and regulations. The subject property is will be served by a public sewer system. Decision Guideline 1.5.2 recommends that landscaping be required to provide a healthful and pleasing residential environment. The applicant will be required to comply with the landscaping standards set forth in Section 14.806.040(2)(a) of the Spokane County Zoning Code. Decision Guideline 1.5.5 recommends that paved streets and street lights should be required in Urban density developments. Objective 1.5.e recommends that when a neighborhood experiences pressure for a change of character, such change shall be permitted upon appropriate review. The proposed use is located with direct access to an arterial and within close proximity to a larger transportation network, Park Road and Sprague Avenue. Zoning: The purpose and intent of the proposed Urban Residential-12 (UR-12) zone is to set standards for the orderly development of residential property in a manner that provides a desirable living environment that is compatible with surrounding land uses and assures the protection of property values. It is intended that this zone be used to add to the variety of housing types and densities, and as an implementation tool for the Urban category of the Comprehensive Plan. The Urban Residential-12 (UR-12) zone is intended primarily for multiple-family dwellings and is frequently used to provide a transition between low density residential zones and intensive business zones. Existing zoning in the area of the site consists mostly of Urban Residential-7 (UR-7) with Urban Residential- 22 located one block west of the site and east of the site along Park Road. Site Plan: The site plan of record reflects what currently exists on the subject site. The applicant is proposing to short plat the property to establish legal lots of record for the five existing residences, if this request is approved. The applicant is also requesting, as a separate, but associated action, numerous variances needed to meet the development standards of the Urban Residential-12 (UR-12) zone. The existing residences on the site vary in size from 540 square feet to 705 square feet. The subject site is currently landscaped, however, due to the Zone Reclassification request, the applicant will be required to install additional landscaping along the Girard Street and 41hAvenue Frontage to meet the standards set forth in Section 14.806.040(2)(a), 20 feet of Type III landscaping. The sight slopes from south to north (less than 30%) and is tiered for the location of the residences and to allow adequate off-street parking for each. No recent changes have occurred in the area, however, the proposed Zone Reclassification will only increase the density for residential use. Staff Summary: The proposed Zone Reclassification is generally consistent with the Goals, Objectives Decision Guidelines of the Urban category and can implement the purpose and intent of the proposed Urban Residential-12 (UR- 12) zone. Water supply will be a public system. c) The project is inside the Spokane County Comprehensive Wastewater Management Area, inside the General Sewer Service Area, and inside the Priority Sewer Service Area recommended in the '201' Study. The method of sewage disposal is subject to approval of the Director of Utilities, Spokane County, pursuant to County Resolution 80.0418 adopted March 24, 1980. The topography and soils in , the area are generally suitable for use of individual on-site sewage disposal systems. The lot is not of the proper dimensions to permit the use of both an individual well and sewage system. d) The project lies in a relatively flat area east of Girrard Street and south of 4" Avenue. Loca1 drainageways are insignificant. e) Surface soils are classed by the U.S. Soil Conservation Service as Garrison gravelly loam with 0% to 5% slopes. They have a septic tank filter field limitation of slight. There is also possible contamination of groundwater. This soil would be classified as a Type IV. fl Geologically, the soils are glaciofluvial deposits. These geological structures generally yield moderate to very large amounts of water. Data from wells in the area referenced in section 1 f shows they are from 38' to 440' deep and have static water levels varying from 25' to 280' below the surface. The East Spokane Water District #1 has indicated that it can supply domestic use water for the project. 3. Required (mandatory) Conditions If Approved: a) Sewage disposal method shall be as authorized by the Director of Utilities, Spokane County. b) Water service shall be coordinated through the Director of Utilities, Spokane County. c) Water service shall be by an existing public water supply when approved by the Regional Engineer (Spokane), State Department of Health. d) A public sewer system will be made available for the project. Spokane County will assume no financial obligation for adjustments or relocation regarding these utilities. The applicant shall grant applicable border easements adjacent to Spokane County Right of Way per Spokane County Standards. 12.
