INTRODUCTION This matter having come before the Zoning Hearing Examiner Committee on August 7, 1986, and the members of the Committee present being Phillip D. Harris, Chairman, Ron Odell and,Gary N. Anderberg. B. PROPOSAL The sponsor, Central Park Development, is requesting approval of a zone reclassification, File No. ZE-24-86, Agricultural to Community Business (B-2), for the purpose of continuing the existing Recreation Club and f uture Retail Uses. C. FINDINGS OF FACT 1. That the existing land use in the area is Recreation Club, residential (single family, apartments and manufactured home park), moving/storage company, R-V Park, drive-in theater, and open area. 2. That the Comprehensive Plan designates this area as appropriate f or Urban development. 3. That the existing zoning of the property described in the application is Agricultural. , 4. That the provisions of RCW 43.21C (The State Environmental Policy Act) have been complied with, and the Committee concurs with the Determination of Non-Significance. 5. That the proper legal requirements for advertisement of the Agenda Item have been fulf i 1 led. . 6. That the land in this area is suitable for the proposed use, or uses within the proposed Zone Classification. 7. That the applicant has deinonstrated that conditions have substantially changed since the original zoning of this area and accordingly, the proposed rezone is justified. ti - ZONE RECLASSIFICATION N0. ZE-24-86 C. FINDINGS OF FACT (continued) 8. That the proposed use is compatible with existing uses in the area. 9. That the owners of adjacent lands expressed neither approval nor disapproval of the proposed use. 10. The Ffearing Examiner Committee finds the proposed use to be in harmony with the general purpose and will not be otherwise detriinental to the public health, safety, and welfare. 11. The following are additional findings of fact considered by the . Hearing Examiner Committee: a) That the existing recreational facility has been a good neighbor in the comunity. The required landscaping is necessary to provide a buffer along the north and west property lines. D. CONDITIONS OR CONTINGENCIES APPLIED TO THIS APPROVAL (Al1 Conditions imposed by the Zoning Hearing Examiner Committee shall be binding on the "Applicant", which term shall include the owner or owners of the property, heirs,.assigns, and successors.) l. That the applicant shall provide the required landscaping prior to final approval of the zone change to B-2. The Zoning Administrator shall inspect the property for compliance of this condition. Upon completion of the required landscaping, the Zoning Administrator , shall change the zoning of the property to Community Business (B-2). 2 . ~ ZONE RECLASSIFICATION N0. ZE-24-86 D. CONDITIONS OR CONTINGENCIES APPLIED TO THIS APPROVAL (continued) a) COUNTY PLANNING DEPARTMENT 1. All current standards of the Community Business (B-2) Zone, as amended, shall be complied with in the development of this site. 2. That the project is subject to Section 7.06, the Aquifer Sensitive Area Overlay Zone of the ZONING CODE FOR SPOKANE COUNTY, which sets forth various rneasures for Aquifer protection; specifically, measures dealing with wastewater disposal, spill protection measures, and stormwater runoff. 3. Applicant shall cornply with '208' recommendations concerning stormwater runoff and provide necessary landscaping for runoff. 4. Any division of land for the purpose of sa1e, lease or transfer, shall comply with RCW 58-17 and the Spokane County Platting Ordinances prior to issuance of building permits. 5. That the provisions of SEPA's NOTICE OF ACTION pursuant to Chapter 43.21C.080 RCW and the Board of Spokane County Commissioners Resolution #77-1392 be initiated by the project applicant within thirty (30) days of final disposition of this application, and prior to any on-site improvements, or file appropriate documents to the effect that the NOTICE OF ACTION is waived in accordance with Spokane County Commissioners' Resolution #82-0458 dated May 4, 1982. 6. That within three months of this approval (November 7, 1986)9 the applicant shall install the required B-2 landscaping along 4th Avenue and along Fancher Road for the full length of the , existing improvements. Specifically, this will require compliance with Section 6.26.350, 6.26.365, 8.02.240-(3) and 8.06.040-(2-b) of the Zoning Code of Spokane County. 7. That future expansions to the site will be processed as follows: a) Any expansion of the existing recreation club will be reviewed administratively. b) Any use of the site, other than the recreation club, will be contingent upon its impact to the traffic hazard at 4th , Avenue and Eastern Road. If the situation can be resolved by the applicant and the County Engineer, then review of the proposed use can be administrative by the Zoning Administrator. If the problem can't be mutually resolved, then a public hearing review of the proposed use and site plan will be required. 3 ti ZONE RECLASSIFICATION N0. ZE-24-86 b) COUNTY ENGINEERING DEPARTMENT Prior To The Issuance Of A Building Permit: l. Applicant shall dedicate a ZO foot radius on Fancher Road and 4th Avenue prior to any use of the property. 2. Access permits for approaches to the County Road System shall be obtained from the Spokane County Engineer. . 3. The County Engineer has designated Typical Roadway Section 1Vumber One, Access standard for the improvement of 4th Avenue which is adjacent to the proposed development. This will require the addition of sidewalk along the frontage of the development. 4. The County Engineer has designated Typical Roadway Section Number One, Access standard for the improvement of Fancher Road which is adjacent to the proposed development. This will require the addition of approximately 24 to 30 feet of asphalt, curb and sidewalk along the frontage of the development. Applicant may participate in a County Road Improvement District for the construction of these improvements. Should Fancher Road be utilized for access to the development, it will be necessary for the applicant to construct the specified roadway improvement prior to release of a building permit. There shall be no access to Fancher Road until it is constructed to County standards and established as a County road. 5. Applicant shall submit for approval by the Spokane County E.ngineer road, drainage, and access plans prior to the issuance of a building permit on the property. , 6. The.applicant shall submit for approval by the Spokane County Engineer and the Spokane County Nealth District a detailed combined on-site sewage system plan and surface water disposal plan for the entire project prior to the issuance of any building permit on the property. 7. A parking plan and traffic circulation plan shall be submitted and approved by the Spokane County Engineer prior to the issuance of a building permit on the property. The design, location, and arrangement of parking stalls shall be in accordance with standard traffic engineering practices. Paving or surfacing as approved by the County Engineer, will be required for any portion of the project which is to be occupied or traveled by vehicles. 8. The word "applicant" shall include the owner or owners of the property, his heirs, assigns, and successors. 4 r. ZONE RECLASSIFICATION N0. ZE-24-86 b) COUNTY ENGINEERING DEPARTMENT (continued) y. To construct the road improvements stated herein, the applicant _ may, with the approval of the County Engineer, join in and be a willing participant in any petition or resolution which purpose is the formation of a Road Improvement District (RID) for said improvement pursuant to RCW 36.88, as amended. Spokane County will not participate in the cost of these improvements. 10. As an alternative method of constructing the road improvement stated herein, the applicant may, with the approval of the 'County Engineer, accomplish the road improvements stated herein by joining and participating in a County Road Project (CRP) to the extent of the required road improvement. Spokane County will not participate in the cost of these improvements. 11. The construction of the road improvements stated herein shall be accomplished as approved by the Spokane County Engineer. 12. All required improvements shall conform to the current State of Washington Standard Specifications for Road and Bridge Construction, and other applicable County standards and/or adopted resolutions pertaining to Road Standards and Stormwater Management in effect at the date of construction, unless otherwise approved by the County Engineer. 13. Roadway standards, typical roadway sections and drainage plan requirements are found in Spokane Board of County Comrnissioners' Resolution No., 80-1592 as amended and are applicable to this proposal. c) COUNTY UTILITIES DEPARTMENT 1. The Owner(s) or Successor(s) in interest agree to authorize the . County to place their name(s) on a petition for the formation of a ULID by petition method pursuant to RCW 36.94 which the petition includes the Owner(s) property and further not to object by the signing of a protest petition against the formation of a ULID by resolution method pursuant to RCW Chapter 30.94 which includes the Owner(s) property. PROVIDED, this . condition shall not prohibit the Owner(s) or Successor(s) from objection to any assessment(s) on the property as a result of improvements called for in conjunction with the formation of a . ULIO by either petition or resolution method under RCW Chapter 36.94. 2. Any water service for this project shall be provided in accordance with the Coordinated Water System Plan for Spokane County, as arnended. 3. That with issusance of a building permit for further addition to the site, the entire complex shall be required to make connection to the Valley Sewer system. Sewer Connection agreement and permit required. 5 ~ ZONE KECLASSIFICATION N0. ZE-24-86 d) COUNTY HEALTN UISTKICT 1. Sewage disposal method shall be as authorized by the Director of _ Utilities, Spokane County. 2. A public sewer system will be made available for the entire project property prior to any expansion on the subject property. Use of individual on-site sewage disposal systems shall not be authorized. 3. Water service shall be coordinated through the Director of Utilities, Spokane County. 4. Water service shall be by an exist'ing public water supply when approved by the Regional Engineer (Spokane), State Department of Social and Health Services. 5. Use of private wells and water systems is prohibited. e) COUNTY BUILDING AND SAFETY DEPARTMENT l. The site is located in Fire District # l. 'L. Recominend approval with the condition that detailed plans be submitted for review for compliance with all applicable codes administered by the Departrnent of Bui lding and Safety. f) WATER PURVEYOR l. Water Purveyor is Spokane Suburban Water, and they are supplying the site with adequate water for domestic, fire and irrigation uses. g) COUNTY AIR POLLUTION CONTROL AUTNORITY All air pollution regulations must be met. This includes but is not limited to the following: l. Air pollution regulations require that dust emissions during demolition, excavation and construction projects be controlled. This may require use of water sprays, tarps, sprinklers, or suspension of activity during certain weather conditions. Haul roads should be treated and emissions from the transfer of earthen material must be controlled as well as emissions f rom all other construction related activities. 2. Measures must be taken to avoid the deposition of dirt and mud from unpaved surfaces onto paved surf aces. If tracking or spills occur on paved surfaces, measures must be taken immediately to clean these surfaces. ~ . . ZONE kECLASSIFICATION N0. ZE-24-86 g) COUNTY AIR POLLUTION CONTROL AUTHORITY (continued) 3. Al1 travelled surfaces (ingress, egress, parking areas, access _ roads) must be paved and kept clean. 4. Some objectionable odors will likely result during the construction phase of the project and from motor vehicles using the site following completion of the project and from occupants of the proposed project. GENERAL INFORMATION Afflicant: CENTRAL PARK DEYELOPMENT Aqent: Donald Foss Owners: Foss and Oahlen Proposal: A request to retone an approximate 6.54 acre site from Agricultural to Community Business (B-2) for the purpose of continuing the existing Recreation Cluo and future Retail uses. Location: fEe site is generally located at the southeast corner of Fourth Avenue and Fancher Road in Section 24-25-43. II. SITE ANALYSIS Comerehensive Plan: URBAN ~ategory - Inside General Sewer Service Area (GSSA) Boundary - Inside Priority Sewer Service Area (PSSA) Boundary - Inside Urban Impact Area (UTA) Boundary The Uruan category recognizes that, based on locational criteria, certa,:-l service or retail uses would be appropriate. SITE ANALYSIS (continued) Zonin Klisting on SITE: Agricultural (established 1955) and within: Aquifer Sensitive Area Overlay Zone To the NORTH: Camrnercial (established 1963 and 1983) To the SOUTH: Multiple Family Suburban (est. 1971 and 1984) To the EAST: Multiple Family Suburban (established 1948, 1971, and 1978) To the WEST: Residential Manufactured Home (established 1969 and 1974) Land Use: Existing on SITE: Recreation Club and Open Area To the NORTH: Moving/Storage Company, R-Y Park, and Drive-In Theater To the SOUTH: Open Area and Apartments To the EAST: Apartments To the WEST: Manufactured Home Park and Residential The established land use/zoning pattern indicates that commercial services are generally north of 4th Avenue and west of Eastern Road, while residential is predominately south of 4th Avenue. The lone exception is the existing recreation club on the proposed rezone site. This facility was approved in 1971 as a Conditional Use Permit (CUE-135-71 with the scope of the project 1 imi ted by condi tions of approval. The R-V Park north of 4th Avenue has developed and maintained an attractive landscape buffer which screens out Interstate 90, 4th Avenue, and adjacent uses. The moving/storage operation, while not containing significant amounts of landscaping, has a well kept appearance. The drive-in theater maintains a security fence along 4th Avenue and Eastern Road. The area doesn't appear as a highly intensive commercial neighborhood. Fancher Road to the west of the site is a 60-foot County right of way improved with only gravel. . j ZONE RECLASSIFICATION N0. ZE-24-86 II. SITE ANALYSIS (continued) Site Characteristics (continued) Traffic to or from the.site by way of Sprague Avenue to the northeast of the property must go through the extremely awkward road intersection at 4th and Eastern. Sight distance due to topograpny and road curves is limited. The addition of more traffic, generated by retail use of this site, may increase traffic concerns. The Spokane Valley Sewer Interceptor line is located within the 4th Avenue right of way; and a sewer lateral line, which serves a new apartment complex at 6th and Fancher, is located within the Fancher Road right of way adjacent to the west. Use: Continued Recreation Club and possible future Retail. Proposed Buildings: Recreation Building and Outdoor Tennis Courts The site plan submitted by the sponsor simply indicates the existing improvements to the property without detailing any future expansions. III. SITE DEYELOPMENT RECOMMENDATIONS Buffering: Future additions to the site will be required to comply with buf~ering techniques of the B-2 Zone. This will generally require only five feet of landscaping adjacent to the south and east property lines. Landscaping: The Zoning Code will require between 5-feet and 8-feet of Type I to III landscaping adj acent to 4th Avenue and Fancher Road. Since the recreation club is already in place, and it has only minimum landscaping now, it is recommended.that more landscaping be added now. Required would be compliance with the B-2 landscape standards along 4th Avenue and along Fancher Road the full length of existing improvements. Circulation/Access: Dedication of a 20-foot radius at 4th and Fancher wiii ne required with future improvements by the owner to Fancher Road. Improvements can be delayed to a CRP or RID. Because of the potential problems at the intersection of 4th and Eastern that could be increased by use of this site, the Planning Department makes tne following recommendations for future additions to this site. 1) Expansion of the existing recreation facilities should be reviewed and approved administratively. It is felt that traffic volume for the recreation club is not, and would not with an expansion, be that high. 2) If any other use of the site is proposed and the problems at the intersection can be resolved or adequately addressed by the applicant and County Engineer's, then approval should be administrative. If there are concerns about the added hazards or the problem can't be resolved, then a public hearing review of the proposal would be necessary. 47 rt ZONE RECLASSIFICATION N0. ZE-24-86 III: SITE DEVELOPMENT RECOMMENDATIONS (continued) Sewage Disposal: Since sewers are available adjacent to the site, the owner is required to hook-up the entire complex with any future expansion or when required by the Health District and Utilities Department. New on-site disposal will not be allowed. IV. SEPA ENVIRONMENTAL REVIEW An Environmental Checklist was submitted by the sponsor and was reviewed by the County Planning Department. The review considered the specifics of the proposal, other available information, County ordinances, other regulations and laws, possible standard Conditions of Approval, the Generali2ed Comprehensive Plan, and other County policies and guidelines. The Zoning Administrator has determined that "No probable significant adverse impacts" would result from the proposal being developed and has issued a Determination of Non-Significance ("DNS"). The "DNS" was circulated to ten other agencies of jurisdiction and other agencies/departments affected by the future development for review and comment. The "DNS" comment period ends August o, 1986, and was advertised 15 calendar days before said date in the newspaper, by letter to adjacent property owners within 400 feet of the proposal, and by notice on a sign posted on the proposal site. The Hearing Examiner Committee may consider additional environmental -related testimony and the "DNS" at the public hearing. V. PLANNING SUMMARY The request can be approved, provided some immediate mitigating conditions dealing with landscaping are added and subject to conditions for future site plan review. Approval can be based on: 1) The Comprehensive Plan's Urban category supports non-residential uses in areas adjacent to arterials and other non-residential uses. 2) Topography of the site is such that residential uses to the south and east sit on a bench above this site. Residential uses to the west can be buffered immediately by landscaping and the established orientation of activity away from the site's west property line. 3) Continued expansion as a recreation facility should not add greatly to the traffic situation.
