ZE-44-95 s. w No. 9s 0420 RECElV ED MAY a 6 1996 BEFORE THE BOARD OF COUNTY COMMISSIONE OF SPOKANE COUNTY, WASHINGTON IN THE MATTER OF ZE-44-95, A ZONE ) FINDINGS C) F RECLASSIFICATION FROM RESIDENTIAL-3.5 ) FACT, i (UR3.5) TO URBAN RESIDENTIAL-22 (UR-22) ) DECISION AN1) ) CONDITIONS APPLICANT: BRIAN STONE THIS MATTER, being the consideration by the Board of County Commissioners of Spokane County, hereinafter referred to as the "Board", of an appeal of the Spokane County Hearing Examiner Committee decision of November 17, 1995 denying Zone Reclassification File No. ZE-44-95 for the purpose of developing 62 multiple farnily residences on approximately 2.9 acres of land, hereinafter referred to as the "Proposal"; and the Board of County Commissioners having held a de novo public hearing on January 9, 1996 and having fully considered all testimony presented thereat; and further having individually visited or being familiar with the site and vicinity in question and having rendered an oral decision on the 16th day of January, 1996 and having held a public hearing to reconsider said oral decision on March 26, 1996 and having rendered an oral decision on the 2nd day of April, 1996 approving said proposal with conditions does hereby enter the following: FINDINGS OF FACT 1. The proposal is generally located east of Wilbur Road, east of Nora Avenue (extended) and south of Interstate 90 (I-90), in the SE 1/4 of Section 9, Townshi;25 North, Range 44 EWM, Spokane County, Washington. 2. The proposal consists of a zone reclassification from Urban Residential-3.5 to Urban Residential-22 on approximately 2.9 acres for development of 62 multiple family residences. 3. The proposed density of 62 dwelling units on 2.9 acres (or approximately 22 dwelling units per acre) is generally consistent with the densities for adjacent development and serves to implement the Urban categoi-y of the Comprehensive Plan. 4. The Board finds that the adopted Spokane County Generalized Comprehensi\ . ' Land Use plan designates the area encompassed by the proposal as Urban. Tl, , proposal is generally consistent with existing and adjacent Urban Residential-~' ' zoning. 5. The Hearing Examiner Committee held a public hearing on November 17, 1995 subsequent to which by the Findings of Fact, Conclusion and Decision dated November 17, 1995 they denied the proposal. 6. The applicant filed an appeal on November 22, 1995 and listed the following as a basis for the appeal of the Hearing Examiner Committee (HEC) decision. The HEC decision is unsupported by substantial evidence in the record, is clearly erroneous and arbitrary and capricious. The decision is inconsistent with the Comprehensive Plan and applicable ordinances. Significant findings of fact and conclusions reached by the HEC are in error and contrary to the unrebuttc,_'i , evidence in the record. The HEC decision is therefore contrary to law. Applicant's project meets a11 regulatory criteria and conditions and is in compliance with the Comprehensive Plan. The applicant is being deprived of reasonable and beneficial use of the property. 7. The County Arterial Road Plan designates Union Road and Nora Avenue as Local Access Streets. i ~ i ~ . BOCC FINDINGS ZE-44-95 Page 2 8 The provisions of RCW 43 21 C(The State Environmental Policy Act) have been complied with and a Determination of Nonsignificance was issued The Board concurs with the Determination of Nonsignificance 9 The Board adopts the Divlsion of Building and Planning Report and file of ZE-44-95, as part of this record, as may be modified by this action 10 The existing land uses in this area include single family residences and duplexes 11 The existing zoning of the property described in the application was Urban Residential-3 5 and redesignated in 1991 under the County's Program to Implement the Zoning Code There have been changed conditions since the original zoning of the property in 1942 to warrant the zone reclassification request including increased demand for affordable housing 12 The proposal will not have a sigruficant adverse impact upon the public health, safety, and general welfare especially in light of the conditions adopted in conjunction unth the approval 13 The legal requirements for public notice have been fulfilled 14 The owners of adjacent properties expressed concerns regarding the proposal Those concerns have been addressed in the following manner The project will connect to public sewer and concerns about increased traffic were shown to be insignificantly impacted by the proposal 15 The proposal is consistent with surrounding land uses and past zoning activity wnthin the area, specifically pages 2 and 3 of the Planning Report outlines such consistency 16 The Board finds that the proposal is located within the recorded water service area of the Modern Electric Water Company and they have indicated they can supply the site with adequate water for domestic, fire and irrigation purposes 17 The proposal is situated with the recorded fire service area of Fire Protection District No 1 and the Fire District indicated they can provide adequate service to the site 19 The Board additionally finds/concludes a That the level of service at affected intersections prior to the project are already at Level of Service E and/or F, and the project would not affect this level of service b That the applicant has agreed to enter into a voluntary mitigation agreement with Waslungton State Department of Transportation to financially participate in intersection improvements DECISION The Board does hereby approve the zone reclassification reyuest from Urban Residential-3 5(UR-3 5) to Urban Residential-22 (UR-22), subject to the following conditions 1 All cooditions amposed by the Board shall be binding on the "Applicant", whicb terms shall include the owoer or owners of the property, heirs, assigns and successors. ii. also notify any potential purchasers who have made an agreement to purchase property withln said plat pwrsuant to the Revised Code of Washington (RCW) 58 17 205, that adequate provistons for school facilities must be made condtttoned on a future agreement between the plattor and school distrlct Voluntary agreements between the owner and school district shall conform to the requirements of RCW administered/enforced as authorized by the State Building Code Act Design/development concerns include Addressing, fire apparatus access roads, fire hydrant/flow, approved water systems, building accessibility, construction type, occupancy classification, exiting, exterior wall protection, and energy code regulations (Note The Division of Building and Planning reserves the right to confirm the actual address at the time of building permit ) SPOKANE COUNTY DIVISION OF ENGINEERING AND ROADS Prior To Issuance Of A BuildinQ Permit Or Use Of The Propertv As Proposed 1 Access permits for approaches to the county road system shall be obtained from the Spokane County Engineer 2 The applicant shall submit for approval by the Spokane County Engineer road, drainage and access plans 3 The applicant shall submit for approval by the Spokane County Engineer and the Spokane County Health District a detailed combined on-site sewage system plan a.nd surface water disposal plan for the entire project, or portion thereof, if the development is to be phased 4 A parking plan and traffic circulation plan shall be submitted and approved by the Spokane County Engineer The design, location and arrangement of parking stalls shall be in accordance with standard traffic engineering practices Paving or surfacing as approved by the County Engineer, will be required for any portion of the project which is to be occupied or traveled by vehicles 5 The construction of the road improvements stated herein shall be accomplished as approved by the Spokane County Engineer 6 The County Engineer has designated Typical Roadway Section Local Access standard for the improvement of Union Road, which is adjacent to the proposed development This will require the addition of approximately 27 feet of asphalt along the frontage of the development and extending south to Mission Avenue Curbing and sidewalk must also be constructed along the frontage only of the parcel 7, All required improvements shall conform to the current State of Washington Standard Specifications for Road and Bridge Construction and other applicable County standards and/or adopted resolutions pertaining to Road Standards and Stormwater Management in effect at the date of construction, unless otherwise approved by the County Engineer 8 Applicant shall construct a paved and delineated approach(es) to meet the existing pavement on Nora Avenue 9 Roadway standards, typical roadway sections and drainage plan requirements are found in Spokane Board of County Commissioners Resolution No 95-0498 as amended and are applicable to this proposal 10 No construction work shall be performed within the existing or proposed public nght-of-way until a permit has been issued by the County Engineer All work witlun the public road right-of-way is subject to inspection and approval by the County Engineer 11 All required construction within the existing or proposed public right-of-way is to be completed prior to the release of a building permit, or a bond in an amount estimated by the County Engineer to cover the cost of construction of improvements shall be filed with the County Engineer 12 There may exist utilities, either underground or overhead, affecting the subject property, including property to be dedicated or set aside for future acquisition Spokane County assumes no financial obligation for adjustments or relocation regarding these utilities Applicant(s) should check with the applicable utility purveyor and the Spokane County Engineer to determine whether applicant(s) or the utility is signed stating The name(s) on a petition for the formation of a ULID by petition method pursuant to RC W 36 94 which the petition includes the Owner(s) property and further not to object by signing of a protest petition against the formation of a ULID by resolution method pursuant to RCW 36 94 which includes the Owner(s) property Provided, this condition sha11 not prohibit the Owner(s) or Successor(s) from objection to any assessment(s) on the property as a result of improvements called for in the conjunction with the formation of a ULID by either petition or resolution under RCW 36 94 2 A wet (live) sewer connection to the areawide Public Sewer System is to be constructed Sewer connection permit is required This shall be an interim connection to the North Pines Sewer District It is doubtful that there is capacity in the pump station at Pines and Mission Connection will be made further south 3 Applicant is required to sign a Sewer Connection Agreement prior to issuance of permit to connect 4 Applicant shall submit expressly to Spokane County Utilities Department "under separate cover" only those plan sheets showrng sewer plans and specifications for Public Sewer and Private Sewer connections for review and approval by the Utilities Department Prior to issuance of permit to connect 5 Security shall be deposited with the Utilities Department for construction of Public Sewer connections 6 Arrangements for payments of additional sewer charges must be made for prior to issuance of sewer connection permrt 7 Any water service for this project shall be provided in accordance with the Coordinated Water System Plan for Spokane County, as amended SPOI{AIVE COUNTY HEALTH DISTRICT 1 Sewage disposal method shall be as authorized by the Director of Utilities, Spokane County 2 Water service shall be coordinated through the Director of Utilities, Spokane, County 3 Water service shall be by an existing public water supply when approved by the Regional Engineer (Spokane), State Department of Health 4 A public sewer system will be made available for the project 5 Use or pnvate wells and water systems is prohibited SPOKANE COUNTY AIR POLLUTION CON'I"I20L AUTHORITY 1 All air pollution regulations must be met 2 Air pollution regulations requ.ire that dust emissions during demolition, construction and excavation projects be controlled This may require use of water sprays, tarps, spnnklers or suspension of activity during certain weather conditions Haul roads should be treated, and emissions from the transfer of earthen matenal must be controlled, as well as emissions from all other construction-related activities 3 SCAPCA strongly recommends that all traveled surfaces (i e, ingress, egress, parking areas, access roads) be paved and kept clean to minimize dust emissions 4 Measures must be taken to avoid the deposition of dirt and mud from unpaved surfaces onto paved surfaces If tracking or spills occur on paved surfaces, measures must be sewage flows are determined by the number of bedrooms/unit One- bedroom apartments are designed on the basis of 200 gallons/unit/day If 62 one- bedroom units are planned, design flows would be 12,400 gallons per day A mix of one-, two-, and three-bedroom units could amount to flows exceeding 14,500 gallons per minute and fall withui Ecology jurisdiction Area sewage loading requirements for 2 9 acres are limited to a maximum of 4,560 gallons per minute Dedicating the adjacent 2 7 acres would allow 4,240 addition gallons per minute and restrict future use This design may not be acceptable WASHINGTON STAT'E DEPAR'TiVIENT OF Z'RANSPORT'ATION 1 Based on the remaining 78 apartments and mitigation totaling $8,892 00, the pro- rata share shall be $114 00 per living unit Payment of this fee The existing land uses in the area include single family residences and duplexes at densities significantly lower than that proposed. 4. The proposed use is not compatible with existing uses in the area. - 5. The property is located within the Urban (U) category of the Spokane County Comprehensive Plan and inside both the Aquifer Sensitive Area (ASA) and the Priority Sewer Service Area (PSSA). The Urban category is intended to provide the opportunity for development of a"citylike" environment which includes variou ~ land uses, intensive residential development, and public facilities and services such as water, sanitary and storm sewer lines, and police and fire protection. The lan-:i use within this category is intended to be primarily residential, with single-famil . two-family, multifamily, and condominium buildings along with neighborhood commercial, light industrial, and public and recreational facilities.
