THIS MATTER, being the consideration by the Board of County Commissioners of Spokane County, hereinafter referred to as the "Board", of an appeal of the Spokane Counry Hearing Examiner Committee decision of January 24,1992 denying the Zone
Reclassificadon File No. ZE-49-91 for allowing a garage to be located 6 feet from the rear
property line, hereinafter. referred to as the. "Proposal"; and the Boazd of County .
Commissioners having held a de novo public hearing on Febivary 25, 1992, and having
fuUy considered aIl testimony presented thereat; and further having ind.ividually visited or
being familiar with the site and vicinity in question and having rendered a decision on the -
10 day of March, 1992 approving said proposal with modificadons does hereby enter the
' following: .
FINDINGS OF FACT
1. That the January 23, 1992 Planning Department report was considered as well as
the staff presentation to the Board.
2. That the Januaty 23, 1992 Hearing Examiner Committee Findings and O"rder were
considered. 3. The proposal is generally located adjacent to the east side of Locust Road
approximately 170 feet north of 44th Avenue in Section 32, Township. ~6orth,
Range 44 EWM, Spokane County, Washington. 1~7'
4. The proposal consists of a zone reclassification from Urban Residendal-7 (UR-7) to
Urban Residential-3.5 (UR-3.5) to allow a detached garage to be constivcted within
6 feet of the rear property line.
5. The existing zoning of the site is Urban Residendal-7 (UR-7). The minimum rear yard building setback requirement in the Urban Residential-7 zone is 15 feet
6. The proposed zoning is Urban Residential-3.5 (UR-3.5). The minimum rear yard
setback for a detached garage in the Urban Residendal-3.5 zone is S feet.
7. The applicant has already constructed a 1344 square foot garage 6 feet from the rear
property line. A building pernut for the garage was issued by the Building
Department.
8. An adjacent property owner contacted the Building Department because of concern
over the location of the new gazage.
9. The Building Department nodfied the applicant that the garage does not meet the
rear yard building setback requirement of 15 feet in the Urban Residential•7 zone.
10. The existing land use in this area is single family residential. ,
11. That the subject property and swrounding Ponderosa Heights Addition was zoned
Two Family Residenaal (R-2) prior to 1991 under the old Zoning Ordinance.
There was no rear yard setback requirement for accessory structures in the R-2
zone.

12. That the subject property and surrounding Ponderosa Heights Addition was
reclassified Urban Residential-7 zoae on January 1, 1991, in conjunction with
implementation of the new Zoning Code for Spokane County.
13. That the subject pmperty and surrouading arrea is located in the Suburban Plus (S+)
category of the Comprehensive Plan. The Suburban Plus category is inteaded for
residential development with large lots and open spaces. The Snbnrban Plus
category recommends a residentiaI density mnge firom 1 to S acres per uniL The
existing Urban Residendal-7 zoning allows for a housing density maximum of 7
uniQs per acre. The proposed Urban Residential-3.5 zone allows for a maximum
housing density of 3.5 units per acre. The subject parcel is .28 acnes in area.
14. 'I`he proposal will not have a significant adverse unpact upon the public health,
safety, and general welfare especially in light of the conditions adopted in
conjunction with the approval.
15. The legal requirements for public nodce have been fulfilled.
16. The owners of adjacent properties expressed concerns regarding the proposal. An
ad}oining property owner stated that the locadon of the garage on the subject
property affccted his view. Another property owner recommended a variance rather
than a zone change since a zone change nay a]law la.nd uses to be introduced into
the neighborhood that would not be allowed under existing zoning.
17. There have been changed condiaons in this area to warrant the zone change,
including adopaon of the Comprehensive Plan, implementation of the Zoning Code
and development of the ponderosa Heights Addition with single family residences
although duplexes were allowed by the 1968 zoning decision far the Ponderosa
Heights Addidon.
18. The provisions of RCW 43.21C (The State Environmental Policy Act) have beea .
complied witb and a Determination of NonSignificance was issued. the Board
concurs with the Detennination of NonSignificance.
DECISION
'The Board does hereby approve the zone reclassification request from Urban Residential-7
(UR-7) to Urban Residential-3.5 (t1R-3.5) subject to the Keck's executing a contract
rezone agreement with Spokane County which coatains the following conditions:
1. The Kecks shall comply with the more restrictive of the minimum yards and
setbacks required for the uses, conditional uses and accessory uses in the Urban
Residential-7 (UR-7) zone and the Urban Residential-3.5 (UR-3.5) zone, except
that tbe minimum rear yard setback requirement far accessory bui'ldings of the
Urban Residendal-3.5 zone of 5 feet shall apply to the detached garage constructed
on the property. The Kecks shall not expand said garage.
2. The Kecks shall not use the subject praperty for, or develop, any of the uses,
conditional uses or accessory uses which are permitted in the Urban Residential-3.5
zone but which are not allowed in the Urban Residendal-7 zoae.
3. Landscaping shall be installed to visually screen the garage from the property
abutting the rear property line of the Kecks. The Kecks shall perpetually maintain
such Iandscaping.
4. The Kecks shall abide by all other condidons of approval imposed by the Board of
Counry Comrnissioners on said rezone. .

CONTRACT REZONE AGRSEMENT
THIS AGREEMENT, made and entered into by and between Lewis
Reck and Juanita Keck, husband and wife, residing at 4329 S. Locust
Road, Spokane, WA, 99206, hereinafter referred to as the "Kecks-",
and Spokane County, a palitical subdivision of the State of
Washington, having offices for the transaction of business at W.
1116 Broadway Avenue, Spokane, Washington, 99260, hereinafter
referred to as the "County", jointly referred to as the "Parties".
R E C I T A L S
1. Pursuant to RCW 36.32.120(6), the Board of County
Commissioners of Spokane County has the care of County property and
management of County funds and business.
2. Pursuant to chapter 36.70 RCW and enabling legislation
passed thereunder, the Board has the legal ability to rezone
parcels of property within the unincorporated areas of Spokane
County.
3. Kecka are the owners of a parcel of property fronting on
the east side of Locust Road, approx3mately 170 feet north of 44th
Avenue in the southwest quarter of Section 32, Township 25 North,
Range 44 EWM, Spokane County, Washington, with a residence address
of S. 4329 Locust Road, Spokane, WA. The property is legally
described as 81ock 3, Lot 8, Ponderosa Heights Addition, Spokane
County, Washington.
4. On February 26, 1992, the Board, sitting as a hearing
body, considered an appeal by the Recks of the denial by the
Spokane County Hearing Examiner Committee of his request to rezone
the above property from the Urban Residential - 7 (UR- 7) to the Urban
Residential-3.5 (UR-3.5) classification of the Spokane County
Zoning Cade, for the purpose o€ allowing a detached garage to be
located approximately 6 feet from the rear property line.
5. The garage referenced above has already been cQnstructed.
The Spokane County DepartmenC of Suildings issued a building permit
for the garage without realizing that the structure encroached on
the minimum rear yard setback requirement for an accessory building
in the tTR- 7 zone of 15 feet . The garage would not encroach on the
minimum rear yard building setback requirement for an accessory
building in the UR-3.5 zone, which is 5 feet.
6. Prior to January 1, 1991, the site was zoned under the
former County Zoning Ordinance as Two Family Residential (R-2),
which zone had no minimum rear yard setback requirement for
accessary buildings. The lot size of the property and of adjacent
properties conforms to the standards of the UR-3.5 zone. The UR-
3.5 zone is generally consistent with the County's Comprehensive
Plan category for the property of Suburban Plus.

. 7. At the February 25, 1992, rezone hearing, some of the
Recks' neighbors indicated they were opposed to the granting of a
rezone, but all the neighbors agreed that the garage should remain
at its present location. The neighbor abutting the rear property
line of the Kecks has indicated that landscaping should be
installed to visually screen the garage from his property.
8. The Board, at a public hearing on March 10, 1992, entered
a decision approving the rezone request, subject to the agreement
by Kecks to execute a contract rezone with the following
stipulations:
a. Kecks shall be allowed to utilize the m.inimum rear yard
building setback requirement for an accessory building in
the IIR- 3. 5 zone of 5 feet, for the sole purpose of
allowing the detached garage recently constructed on the
property. No expansion of the garage will be allowed.
b. Fxcept f or the detached garage, Kecks shal l in the future
comply with the more restrictive of the ntinimum yards and
setbacks required for uses in the Ult-7 zone and the UR-
3.5 zone, and further shall be prohibited from using the
property for, or developing, any of the uses, conditional
uses or accesaory uses which are permitted in the UR- 3. 5
zone but which are not allowed in the UR-7 zone.
c. Landscaping shall be installed to visually screen the
garage from the property abuttiag the rear yard of the •
Kecks. Kecks shall perpetually maintain such
landscaping.
9. The Washington State Supreme Court, in State ex rel. Mvhre v.
Spokane, 70 Wn.2d 207, 422 P.2d 790 (1967), appraved contract
rezones.
NOW, THEREFORB, for and in consideration of Spokane County's
approval of the rezone of the Recks' property as described above,
the Parties mutually agree as follows:
T E R M S
SECTIDN 1: PARTIFS OBLIGATIONS
The Board of County eommissioners of Spokane County, acting
for and on behalf of Spokane County, agree to execute Findings of
Fact and Decision, reflecting their motion of March 10, 1992
approving the rezone request of the Kecks' property, as described
in the above Recitals.
Kecks shall comply with the more restrictive of the minimum
yard.s and setbacks required for uses,conditional uses and accessary
uses in the UR-7 zone and the UR.-3.5 zone, except that the minimum

rear yard setback requirement for acce'ssory buildings of the UR-3.5
zone of 5 feet shall apply to the detached garage constructed on
the property. The Recks shall not expand said garage.
Kecks shall not use the subject property for, or develop, any
of the uses, conditional uses or accessory uses which are pennitted
in the UR-3.5 zone but which are not allowed in the UR-7 zone.
Lanascaping shall be installed to visually screen the garage
from the property abutting the rear property line of the Kecks.
Kecks ehall perpetually maintain such landscaping.
Recks shall abide by all other conditions of approval imposed
by the Board of County Commissioners on said rezone.
SECTION 2: WAIVER
No of f icer, employee, agent or otherwise of the County has the
power, right or authority to waive any of the conditions or
provisions to this agreernent. No waiver of any breach of this
agreement shall be held to be a waiver of any other ar subsequent
breach. All remedies af f orded in this agreement or at law shal l be
taken and construed as cumulative, that is, in addition to every
other remedy provided herein or by law. Failure of the County to
enforce at any time any of the provisions of this agreement or to
require at any time perrormance by Kecks of any provision hereof
shall in no way be construed to be a waiver of such provisions, nor
in any way affect the validity of this agreement or any part
hereof, or the right of the County to enforce each and every such
provision.
SECTION 3: ALL WRITINGS CONTAINED HEREIN
This agreement contains all the teYms and conditions agreed
upon by the partiss. No other understandings, oral or otherwise,
regarding the subjeet matter of this agreement shall be deemed to
exist ar to bind any of the Parties h@reto. Kecks have read and
underatand all of this agreement, and now state that no
representation, promise or agreement not express+ed in this
agreement ha.s been made to induce Kecks to easecute the sazne.
SECTION 4: RFCORDING
The County shall record this agreement in the Spokane County
Auditor's Office. The terms of this agreement shall be binding on
the Kecks, their heirs, successors or assigns. The provisions of
this agreement shall run with the property, as legally deacribed in
the Recitals.

This evening is the date which the Board of County Commis-
sioners has set to render its decision ori ZE-49-41, a zone
reclassification from UR-7 to UR-3.5, applicant, Lewis Keck.
The application consists of a request to rezone a lot f rom UR-
7 to UR-3.5 to allow a detached garage to be located six feet (61)
from the rear property line. The minimum rear yard setback for
accessory buildinqs in the proposed UR-3.5 zone is five feet (51),
whereas the minimum rear yard setback in the existing UR-7 zone is
f if teen feet (151).
The applicant in this case has already constructed a detached
garage. An adjacent property owner contacted the Building
Department because of the concern over the location of the new
garage. subsequently, the Building Department advised the
applicant that the garage did not meet the rear yard building set
back requirement of f ifteen feet (151) in the UR-7 zone. As a
result of this, the applicant requested a rezone to the UR-3.5
zone, which only requires a five foot (51) rear yard setback.
The file ref lects that the Spokane County Hearing Examiner
Committee denied, without prejudice, the rezone request. The
applicant appealed the denial to the Board of County Commissioners.
At the public hearing, an adjoining property owner contended
that the location of the garage, necessitating the rezone, affected
his view. Another property owner recommended a variance be applied
for instead of a rezone.

of County Commissioners at its public hearing held on February 25,
1992, as well as the public record file, I hereby move that the
appeal f iled by Lewis Keck be granted. In granting the appeal, I
am in effect approving the rezone request, subject to the following
conditions:
(1) Prior to or at the same time the Board of County
Commissioners executes the Findings of Fact and Decision on
,this matter, the Kecks shall enter into a contract rezone for
the proposal. Tbe contract rezone shall provide that the
Kecks shall be authorized to utilize the rear yard building
set back requirement in the UR-3.5 2one for the sole purpose
of allowing the detached garage. No expansion of the garage
will be allowed. The contract rezone shall also provide that
the Kecks shall be prohibited from using the re2oned property
for any of the uses, conditional or accessory, which would be
permitted in the UR-3.5 zone but which are prohibited in the
UR-7 zone. Finally, landscaping shall be installed to
visually screen the qarage from property abutting the rear
yard of the applicant. The applicant shall perpetually
maintain such landscaping.
In making this motion, I specifically find that the rezone,
subject to the condition set forth hereinabove, will not be
detrimental to the public health, safety and welfare of the
surrounding property owners. Moreover, the contract rezone
provisions address those issues raised at the public hearing by the
surrounding property owners, to include aesthetics.
I would request that Planning Department staff prepare
Findings of Fact and Decision ref lecting this motion and other
issues raised at the public hearing for execution by the Soard at
a subsequent public meeting. Such Findings should adopt the
Determination of Nonsignificance issued for this proposal.

INTRODUCTION
This matter has come before the Hearing Examiner Committee oa January 23,
1992. The rriembers of the Committee present are Lunell Haught, Chairperson,
Phil Harris aad Jane Myers.
PItOPOSAL
The sponsor, Lewis Keck, requests approval Qf a ZE-49-91, zone reclassificadon from
Urban Residential-7 (UR-7) to Urban Residential-3.5 (UR-3.5) within the Aquifer
Sensitive 4verlay Zone.
FINDINGS UF FACT AND CONCLUSIONS
1. The property is generally located ad.jacent to the east side of Locust Road
approximately 170 feet north of 44th Avenue in the southwest 1/4 of Section 32,
Township 25 North, Range 44 EWM, Spokane County, Washington.
2. The conunittee adopts the Planning Department Report as a part of this record.
3. The eacisting land use in the area adjacent to the site is single family residential.
4. The Comprehensive Plan designates this site as Suburban Plus. The Suburban Plus
categery is primarily far residential developmenr with large lots and open spaces. The
Suburban Plus category recommends a residenrial density range from 1 to 5 acres per
unit. 'Phe subject parcel is .28 acres in size.
5. The existing zoning of the property described in the application is Urban Residential-7
(UR-7), previously established in 1991. Prior to January 1, 1991 the site and adjacent
properties were zoned Two-Family Residence (R-2).
6. A deeached accessory buitding was constructed on the site six feet from the rear
property line during the Fall of 1991.
7. The existing Urban Residential-? (UR-7) zone requires a rear yazd build.ing setback
of 15 feet from the rear property line.
8. A zone reclassif'icarion to the Urban Residential-3.5 (UR-3.5) zone was requested,
since the minimum rear yard building setback for accessory buildings in the Urban
Residential-3.5 (UR-3.5) zone is five feet. The site as developed meets all
requiremeats of the Urban Residential-3.5 (UR-3.5) zone.
9. The pravisions of RCW 43.2IC (The State Environmental Policy Act) have been
complied with and a Determination of Nonsignificance was issUed.
10. The legal requirements for public notice have been fulfilled.

11. The owners of adjacent land to the east expressed disappraval of the new detached
accessary building due to its height and location and its effect on the view from his
property. Another owner of a nearby residence expressed disapproval of the rezone
based on concerns that new Iand uses may be allowed with Urban Residential-3.5
(UR-3.5) zoning includiag bee keeping, private kennels, conditional accessory units
and home industry.
12. The Planning Department staff re.comraended approval of the rezone stating that the
proposed zoning is compatible with existing development in the area and that the
proposed zoning provides for a lower density than the existing zoning and is
therefore closer to the recammended density of the Compreheasive Plan than the
exisdng zoning.
13. The applicant has demonsmated that conditions have not substantially changed since
the onginal zoning of this area and accor+dingly, the praposed zone reclassification is
not justified.
14. The proposed use will be derrimental to the public health, safety, morals or welfare.
15. The Committee additionally find$/concludes that the proposal may constitute spot
zoning and may result in the introduction of unwanted land uses in the area and that a
variance would be more appropriate.

SUBJECT: ZE 49-91, zone reclassification fr om Urban Residential-7 (tJR 7) to
Urban Residential-3.5 (UR-3.5) within the Aquifer Sensitive Overlay
Zone.
I. GENERAL INFORMATION

Location: Generally located adjacent to the east side of Locust Road
appr~ximat+ely 170 feet north of 44th Avenue in the southwest 1/4 of Secdon 32,
Township 25 N. Range 44 EWM, Spokane County, Washington.
Proposal: Zone change from Urban Residential7 to Urban Residendal-3.5
to allow a detached garage to be located 6 feet from the rear property line. The
minimum rear yard building setback requirement for an acoessory building in the
proposed Urban Resideatial-3.5 zone is 5 feet whereas the minimum rear yard
setback requirement in the existing Urban Residential-7 zone is 15 feeG
The garage in this case has already been constructed. Aa adjacent property owner
contacted the Building Department because of concern over tbe locadon of the new
garage. Subsequendy, the Building Department discovered that the building pennit
(dated October 9,1991) was issued in error since the garage does not meet the rear
ysrd building setback requinement in the Urban Residential7 zone.
II. SITE INFORMATION
A. Site Size: 12,325 square feet
B. Comprehensive Plan
1. Land Use Plan: The property is located within the Suburban Plus
category of the Comprehensive Plan. The Suburban Plus category is

intended tio provide the opportunity for the development of resideatial areas
with l,arge yards and open spaces. The vecemmeaded residential density of
this category ranges fiom 1 acre per dwelling to 5 acres per dwelling urut.
the proposed Urban Residentia13.5 (UR 3.5) would allow 1/2 the density
that the existing Urban Residendal-7 (UR 7) zone prESendy allows. The
proposed Urbaa Residential-3.5 (UR-3.5) zone is closer to the
recommended density of the Comprehensive Plan than the existing Urban
Residential-? (tJR 7) zone.
The site is located inside the priority sewer senrice area (PS SA).
2. Arterial Road Ptan: The subject property is accessed from Locust
Road, a Iocal access street. C. Site Characteristics: The site's topography is essendally flat. The site is
devedoped with a single family resideace. A detached acoessory building,1344
square feet ia area, is located on the rear of the loL The accessory building is
located 6 feet from the rear or east property line and 5 feet from the north/side
property line.
D. Neighborhood Characteristics: Trie site is located in the Ponderosa Heights
Subdivision. The average lot size in the 27 Iot subdivision is approximately
12,000 square feet. Outside of the Ponderosa Heights Subdivision most of the
surrounding residendal lots are apprommately 1 acre in area. Thene aze also some
larger tracts in the immediate vicinity encompassing up to 40 acres, which are
used for agriculnum and as range land.
E. Zoning Analysis: Prior to January 1, 1991, the site was z,aned Two Family
Residential (R-2) under the old Zoning Ordinance. On January 1,1991 the site
was redesignated Urban Residendal7 (UR 7) when the new Zoning Code was
fully implemented wbich is a best fit to the old Two Family Residential (R-2)
zone.
The UR-7 zone is similaz to the R-2 zane in that the gernutted uses in each zone
are sinailar. However, the building setbaclc requirements the UR 7 zone are
different than ihose in the R 2 zone. In the subject case, the variation ia rear yarrd
setback requirements between the existing UR-7 zone, the previous R 2 zone and
proposed UR-3.5 zone has become an issne. The rear yard setback for each of
these zones is shown below:

I. Drainage: The site is locatod in an anea thnt has been identified as having
stormwater nunoff problems. The County Enginoer has required that the applicaat
participate in the planning and implementation of a stormwater management
systena for the area.
J. Water Supply: The proposall iS within the Spokane Connty Waier District No. 3.
K. Sewage Disposal: The site is located inside the prioriEy sewer service area
(PSSA.). A septic tanlc and diainfiield is used to dispose of sewage. Cannectioa
to the public sewer w71 be required when it beconaes available.
L. School: The proposal is in the Central Valley School District No. 356
M. Fire Protection: The proposal is within Fire District No. 1.
III. ENVIRONMENTAL REVIE'OV:
An Environnaental Checklist was sobmitted by the sponsor aad was reviewed by the
County Planning DeparemenL The review considered the specifics of the proposal,
other available infornaedon, County ordinances, other regulations and laws, possible
sta.adard Conditions of Approval, the Generalized Comprehensive Plan, and ot6er
County policies and guidelines. The Planning Deparmaent has detenmined that "No
probable signif cant a,dverse impacts" would resule from the proposal being developed
and has issued a I?etenminadon of N n i ificance ("DNS").
The "DNS" was circulated m 9 other agencies of jurisdiction and other
agencies/departments affected by the future development for review and comment

days before said date in the newspager, by letter to adjacent property owners within
400 feet of the proposal, and by notice oa a sign posted on the proposal site. The

IV. PLANrIING DEPARTMENT SI;IMMARY AND RECOMMENDATION
Although the site and surrounding Ponderosa Heights Addition was originally zoned
Two Fainily Residence (R-2), development consists entirely of single family
residences. The lot size of the site and adjacent properties conforms to the standards of
the Urban Residential-3.5 (UR-3.5) Zone.
The Comprehensive Plan category for the site is Suburban Plus. This category dces
not supptm residential densities that arce allowed in the existing Urban Residential-7
(UR-7) Zone. Most of the parcels in the surrounding ar+ea outside the Ponderosa
Heights Addition are 1 acre ar greater in sitie.
Due to the facts noted above, the Planning Department rocommends that this application
be approved subject to the condition.s of approval.
