PROPOSAL
The sponsor, Redeemer Lutheran Chiuch, requests approval of a Zone
Reclassificanon, File No ZE-46-90, for the purpose of developing 34 apartments
(retirement aparnnents) on approxlmately 2 9 acres
FINDINGS OF FACT AND CONCLUSIONS
1 The property is generally located ui the Spokane Valley east of and adjacent to
Schafer Road and approxumately 350 feet southwest of Dishman Niica Road ui
Section 32, Township 25 N, Range 44 EWM, Spokane County, Washington
2 The comunittee adopts the Plammmg Department Report as a part of tlus record.
3 The exisang land use(s) in the area is pnmanly single family residences A church is
located across Schafer Roa.d from the site
4 The Comprehensive Plan designates tlus site as Urban The Urban category is
intended to provide for development of a city lilce envumnment, including residenual
densities of 1 to 17 wuts per acre This proposal is for 12 uruts per acre
5 The Artenal Road Plan designates Schafer Road as a minor artenal, with a
recommended nght of way width of 80 feet. Exisnng nght of way width is 60 feeL
The Engmeers office has requu-ad that 5 feet of additionai nght of way be dedicated
along Schafer Road and the 5 additional feet be set aside for future nght of way
acquisinon
6 The project is within the Pnonty Sewer Service Area (PSSA) Public Sewer Service
is requu-ed for the project

THIS MATTER, being consldered by the Board of County Commussioners of
Spokane County, hereinafter referred to as the "Board", of an appeal of the Spokane
County Heanng Examiner Committee decision of December 20, 1990, wherein said
comnuttee denied the proposal to de-velop 34 renrement apartments
The Board received an appeal application on December 24, 1990 by Grant Person,
agent for Redeemer Lutheran Church
The Board held a de novo public heanng on January 29, 1991, and having fully
considered all testimony presented, and having ind.ividually acquainted themselves with
the vicinity and the site in quesnon, chd reach a decision on February 12, 1991, to grant
the appeal and approve the proposal subject to certain conditions and in doing so dld enter
the following
FINDINGS OF FACT
1 That the December 20, 1990 PLANNING REPORT was considered as well as
the staff presentanon before the Board
4 2 That the December 20, 1990 Hearing Examiner Committee Findings and Order
were considered
3 That the file of ZE-46-90 was available for consideranon by the Board
4 That the proper legal requirements for advernsing of the heanng before the Board
have been met
5 That the provisions of Chapter 43 21 C RCW (The State Environmental Policy
Act) have been complied wlth and a Determination of Nonslgnificance (DNS) was
issued The Board concurs with the Determination of Nonslgnificance
6 That the proposal is to be located on a 2 9 acre site located in the Spokane Valley
east of and adjacent to Schafer Road and approximately 350 feet southwest of the
intersection of the Dishman Mica Road and Schafer Road in Section 32,
Township 25 North, Range 44 EWM, Spokane County, Washington This is a
unique shaped site created as a result of the realignment of Old Schafer Road
7 That the density of the revised proposal is 12 dwelling units per acre 1'his
density is generally consistent with the Comprehensive Plan The
Comprehensive Plan provides that properties located within the Urban Category
may have densihes from one (1) to seventeen (17) units per acre when located
within the Pnonry Sewer Service Area (PSSA) boundanes
8 The proposal is located adjacent to single family residences on the southwest To
the northwest across Schafer Road from the site, the Redeemer Lutheran Church
ls located To the southeast across Old Schafer Road from the site single family
residences are located Adjacent to the site's northeast boundary the railroad nght
of way is located
9 Owners of property located near the proposal expressed disapproval of the
proposed use due to the following concerns
a The proposed renrement apartments are not companble with the existing
single family residences

b The surrounding roadways are not adequate to accommodate the traffic that
would be generated by the proposal
c The water pressure in the area is not adequate to supply the proposal and
exisnng water uses
10 The Redeemer Lutheran Church onglnally owned the property upon which the
church is located, as well as the rezone proposal site, as one parcel The County
Enguieer's realignment of Schafer Road caused the Church's property to be
bisected This fact, along with the increased traffic on Schafer Road, demonstrate
changed conditions warranting the rezone request
11 Gary Kennelly, Counry Traffic Engineer, testified that Schafer Road was
designed to accommodate 6,000 vehicles per day and that the intersection of
Schafer Road and Dishman Mica Road is in the process of being upgraded This
fact substantiates that the proposal will not cause traffic problems
12 The record indicates that water will be supplied to the proposal by Spokane
County Water Distnct No 3 The Water Distnct has the legal obligation to make
available appropnate water supplies to propernes within its Distnct boundanes
accordingly the proposal makes adequate provisions for water service
13 The zone reclassificanon will not be demmental to the public health, safety,
morals or welfare, especially when conditions as provided for herein after
DECISION
From the foregoing Findings, the Board hereby APPROVES the appeal of
Redeemer Lutheran Church for the zone reclassification of Urban Residenual -3 5
(UR-3 5) to Urban Residential -12 (UR-12) for the property descnbed in the
application ZE-46-90 and provides the following
. CONDITIONS OF APPROVAL
1 No access, to include emergency access, will be allowed from the site to Old
Schafer Road
2 There shall be no storage of recreational vehicles, trailers or boats on the site
3 The applicant shall enter into an agreement, as prepared by the Spokane County
Prosecunng Attorney's Office, which shall limit the use of the site to 34
retirement apartments In the event the present or subsequent owners desire to
change the use from 34 retlrements apartments to apartments or any other use,
whether authonzed or not within the Urban Residential -12 (UR-12) zone, the
owner shall be responslble for malang applicanon to the Planning Department for
a change of condition This applicahon will require a public heanng The
agreement, as prepared by the Spokane County Prosecuting Attorney's Office
vvill be recorded in the Spokane County Auditor's Office and run with the land

lapsing of appeal penod, a Title Notice, which shall generally provide as follows

property descnbed herein, the applicant shall be responsible for complying with
the provisions of the Zoning Code for Spokane Caunty, Section 14 706 (Aquifer
Sensiuve Area Overlay Zone) The property which is the subject of this nonce is

nght-of-way and ualities The reserved future acquisition area Title Notice shall be
released, in full or in part, by the Planning Department The notice should be
recorded vvithin the same time frame as an appeal and shall provide the following

Schafer Road NOTE The County Engineer has requued five feet of new

b Future building and other setbacks required by the Spokane County Zoning

should be located within the future acquisition area for road nght-of-way and
utiliaes If any of the above improvements are made within this area, they
shall be relocated at the applicant's expense when roadway improvements are
made
d The future acquisition area, until acquired, shall be pnvate property and may
be used as allowe.d in the zone, except that any improvements (such as
landscaping, parking, surface drainage, drainfield, signs or others) shall be
consldered intenm uses
CQIJNTY ENGINEERING CONDITIONS
Pnor To The Issuance Of A Buildine Permit Or Use Of The Propertv As Pronosed
l Applicant shall dedicate 5 feet on Schafer Road for right-of-way

2 Access germits for approaches to the county road system shall be obtained from
the Spokane County Engineer
3 The applicant shall submit for approval by the Spokane County Engineer road,
drainage and access plans
4 The applicant shall submit for approval by the Spokane County Eng-ineer and the
Spokane County Health Dismct a detailed combined on-site sewage system plan
and surface water disposal plan for the entue project, or portlon thereof, if the
development is to be phased
5 A parlang plan and traffic circulaaon plan shall be subrrntted and approved by the
Spokane County Engineer The deslgn, locanon and arrangement of parking
stalls shall be in accordance with standard traffic engineenng practices Paving or
surfacing as approved by the County Engineer, will be required for any portion of
the project which is to be occupied or traveled by vehicles
6 To construct the roadway improvements stated herein, the applicant may, wnth the
approval of the County Engineer, join in and be willing to parncipate in any
peauon or resoluaon which purpose is the formation of a Road Improvement
Ihsmct (RID) for said improvement, pursuant to RCW 36 88, as amended
Spokane County wYll not parcicipate in the cost of these improvements This is
applicable to Schafer Road
7 As an alternative method of constructing the road improvements stated herein, the
applicant may, with the approval of the County Englneer, accomplish the road
unprovements stated hereln by joimng and participating in a County Road Project
(CRP) to the extent of the required improvement Spokane County will not
participate in the cost of these improvements This is applicable to Schafer Road
8 The construction of the road improvements stated herein shall be accomplished as
approved by the Spokane County Engineer
9 The County Engineer has designated Typical Roadway Section Number One,
Secondary Artenal standard for the improvement of Schafer Road, wluch is
adjacent to the proposed development This will require the addition of
approximately 4- 6 feet of asphalt along the frontage of the development The
construcnon of curbing and sidewalk is also required
10 All required improvements shall conform to the current State of Washington
Standard Specificaaons for Road and Bndge Construcaon and other applicable
County standards andlor adopted resolutions pertaining to Road Standards and
Stormwater Management in effect at the date of construction, unless otherwise
approved by the County Engineer
11 Applicant shall construct a paved and delineated approach(es) to meet the existing
pavement on Schafer Road
12 Roadway standards, typical roadway Sections and drainage plan requirements are
found in Spokane Board of County Commissioners Resolution No 80-1592 as
amended and are applicable to this proposdl
13 This subdivision or development proposal is located within a drainage basin
which has been idenhfied by the Spokane County Engineer's office as having
stormwater runoff problems Since this plat or development proposal is affected
by or is a contnbutor to stormwater flows, propercy owners should participate in
the planning and implementaaon of a future basinwide stormwater management
system The follownng statement shall be placed in the plat dedication
"The owner(s) or successor(s) in interest agree to join in any County-approved
stormwater management program and to pay such rates and charges as may be
fixed through public heanngs for service or benefit obtained by the planning,
design, constructing, maintaining or operanon of stormwater control facilities "
14 The regulanons of the National Flood Insurance Program shall be observed since
the proposed plat is affected by a flood hazard zone A development pernut shall
be obtained from the County Engineer before construction or development begins
within any area of the special flood hazard zone (reference Spokane County
Ordinance No 88-0521)

15 No construction work shall be performed within the existing or proposed public
nght-of-way until a pennit has been issued by the County Engineer All work
wnthin the public road nght-of-way is subject to inspection and approval by the
County Engineer
16 All requued construction within the existing or proposed pubhc nght-of-way is to
be completed pnor to the release of a build.ing permit, or a bond in an amount
estimated by the County Engineer to cover the cost of construcaon of
unprovements shall be filed wlth the Counry Engineer
17 Apphcant shall sign and record Spokane County Notice to the Public No 6 which
specifies the following
The owner(s) or successor(s) in interest agree to authonze the County to place
theu name(s) on a pehnon for the formation of a Road Improvement Dismct
(RID) by the peanon method pursuant to Chapter 36 88 RCW, which pention
includes the owner(s) property, and further not to object, by the signing of a
ballot, the formaaon of a RID by the resolution method pursuant to Chapter 36 88
RCW, which resolunon includes the owner(s) propercy If an RID is formed by
either the petinon or resolunon method, as provided for in Chapter 36 88 RCW,
the owner(s) or successor(s) further agree
(a) that the improvement or construction contemplated within the proposed RID is
feasible,
(b) that the benefits to be derlved from the formation of the RID by the property
included therein, together with the amount of any County participanon, exceeds
the cost and expense of formanon of the RID, and
(c) that the property within the proposed RID is sufficiently developed
Provlded further that the owner(s) or successor(s) shall retain the nght, as
authonzed under RCW 36 88 090, to object to any assessment on the property
° as a result of the improvements called for in conjunction with the formation of the
RID by either petinon or resolution method under Chapter 36 88 RCW

existing nght-of-way wndth of 60 feet is not consistent with that specified in the
Plan In order to implement the Artenal Road Plan, in adciiaon to the requued
nght-of-way dedication, a smp of property S feet in width along the Schafer Road
frontage shall be set aslde in reserve This property may be acquired by Spokane
County at the time when artenal improvements are made to Schafer Road

concept Should these apartments be constructed for an occupancy other than for

change are submitted to the Spokane County Hearing Examiner Committee
for inclusion in the "Planning Report" and "Findings and Order" of
the public hearing scheduled December 20, 1990
Prior to the release of a building permit or use of the property as
proposed
E36 Applicant shall dedicate 5 feet on Schafer Road for right of
way
E40 Access permits for approaches to the County Road System shall be
obtained from the County Engineer
E43 Applicant shall submit for approval by the Spokane County
Engineer road, drainage and access plans
E44 The applicant shall submit for approval by the Spokane County
Engineer and the Spokane County Health District a detailed
combined on-site sewage system plan and surface water disposal
plan for the entire project or portion thereof if the
development is phased
E45 A parking plan and traffic circulation plan shall be submitted
and approved by the Spokane County Engineer The design,
location and arrangement of parking stalls shall be in

Density The proposed density is 117 dwelling units per acre which is wrthin the

Buffering The proposed type III landscaping along all property boundanes meets
the requuements of the zoning code The proposed landscaping wdl help to buffer
the adjacent smgle family residences from the parlang areas on the site
Circulation/Access Pnmary access to the site will be from the dnveways on the

County policies and guideluies The Plannmg Department has deternuned that "No
probable significant adverse unpacts" would result from the proposal being developed
and has issued a Determinjdon of NonWnlficance, ("DNS")
The "DNS" was cuculated to eight other agencies of junsdiction and other
agenciesJdepartments affected by the future development for review and comment
The "DNS" comment penod ends December 18, 1990 and was advertised 15 calendar
days before said date in the newspaper, by letter to adjacent property owners wnthin
400 feet of the proposal, and by noace on a sign posted on the proposal site The

from Old Schafer Road The site is unusual in that it features two front lot hnes
This fact does restnct the usable area of the site sigruficantly when both front yard
requirements are apphed
Since Old Schafer Road is a dead end smeet wnth very light traffic granting the setback
vanance will have relattvely little unpact on the public and adjacent propemes The
Planning Department recommends approval of the rezone and vanance as
condinoned

also contain special services such as medical
services, dining facilities and some limited
supporting retail facilities.
Only five studies conducted in the San Fran-
cisco Bay Area contained trip generation for
these communities. The average weekday ve-
hicle trip generation rate measured entering
and leaving the communities was 3.3 vehicle

You must ansrer each Question accurately and carefully, to the best of your knowledge. In most cases, you should De able to answer the questions
from your own observations or project plans without the need to hfre experts. If you really do not knoa the answer, or if a question does not apply
