INTRODUCTION
This matter has come before the Hearing Examiner Committee on 3anuary 28, 1993
which was continued from the January 21, 1993 public hearing. The members of the
Committee present are Phil Harris, Chairperson, Bud Skadan and Frank Yuse.
PROPOSAL
The sponsor, Dean Grrafos, requests approval of a, ZE-49-92, Zone Reclassif'ication
from Urban Residential-22 (LTR-22) and Neighborhood Business (B-1) to Urban
Residential-7 (UR-7) within the Aquifer Sensitive Area Overlay zone.
FINDINGS OF FACT AND CONCLUSIONS
1. The property is generally located in the Spokane Valley, 100 feet south of 16th
Avenue and between Oberlin Road and University Road in the NE 1/4 of Section 29,
Township 25 N., Range 44 EWM, Spokane County, Washington.
2. The committee. adopts the Planning Deparnnent Report as a part of this record The
Planning Department has recommended that the proposed plathezone be approved as
conditioned.
3. The existi.ng land use(s) in the area are neighborhood businesses to the north, an
elementary school to the east, single family residences to the west and south.
4. The proposed use is compatible with existing uses in the area.
5. The Comprehensive Plan designates this site as Urban. The Urban category is for tle
purpose of developing a"city-like" environment, including residenrial densiries of 1
to 17 units per acre, or 6.94 units per acre for this proposal.
6. The proposed zoning does implement and conform to the Comprehensive Plan.
7. The Arterial Road Plan designates University Road as a Principal Arterial, with a
recommended right of way width of 100 feet. Appropriate provisions have been
made to implement this plan.
8. The existing zoning of the property described in the application is Neighborhood
Business (B-1) and Urban Residential-22 (tJR-22), previously established as Local
Business (LB) zoning in 1952 and 1977 respectively and reclassified to
Neighborhood Business (B-1) and Urban Residential-22 (UR-22) zoning on January
1, 1991 pursuant to the Program to Implement the Spokane County Zoning Code.
9. The provisions of RCW 43.21C (The State Environmental Policy Act) have been
complied with and a Determination of Nonsignificance was issued. The Committee,
after independent review, hereby adopts the DNS.

10. The legal requirements for public notice have been fulfilled.
11. The owners of adjacent lands expressed approval of the proposed use.
12. The applicant has demonstrated that conditions have substanrially changed since the
original zoning of this area and accordingly, the proposed zone reclassification is
justified. Specifically, changed condirions include the County Engineer's road plan
changing to retain existing street patterns and alignment.
13. The proposed use wi.ll/will not be detrimental to the public health, safety, morals or
welfare especially in light of the conditions recommended by the reviewing agencies.
CONDITIONS OR CONTINGENCIES APPLIED TO THIS APPROVAL
1. All Conditions imposed by the Hearing Examiner Committee shall be binding on the
"Applicant," which terfn shall include the owner or owners of the property, heirs,
assigns, and snccessors-in-interest.
2. The following Conditions of Approval apply to the real property described below:
Lots 3, 6, 7, 8, 9, Block A, except the east 20 feet of Lots 3 and 6, Block A,
Chester Hills Addirion, Spokane County, Washington.
SPOKANE COUNTY PLANNING DEPAR-TMENT
1. All conditions imposed by the Hearing Exam.iner Committee shall be binding on the
"Applicant", which term shall include the owner or owners of the property, heirs,
assigns and successors.
3. The proposal shall comply with the Urban Residential-7 (LTR-7) and Aquifer
Sensitive (ASA) Overlay zones as amended.
4. The applicant shall develop subject property generally in accordanee within the
concept presented to the Hearing Body. Variations, when approved by the
Planning Director/designee, may be permitted, including, but not limited to building
location, landscape plans and general allowable uses of the pemutted zone. All
variations must conform to regularions set forth in the Spokane County Zoning
Code, and the original intent of the development plans shall be rna.intained.
6. A specific landscape plan, planting schedule and provisions for maintenance
acceptable to the Planning Director/designee shall be submitted with a performance
bond for the projeet prior to release of building permits. Landscaping shall be
installed and mainta.ined so that sight distance at access points is not obscured or
impaired.
7. Direct light from any exterior area lighting fixture shall not extend over the property
boundary.

8. The Spokane Counry Planning Deparnnent shall prepare and record with the
County Auditor a Title Notice specifying a future land acquisition area for road
right-of-way and utilities. The reserved future acquisition area Title Notice shall be
released, in full or in part, by the Planning Department. The notice should be
recorderi within the same time frame as an appeal and shall provide the following:
a. At least 15 to 20 feet of reserved future acquisition area for road right-of-way
and utilities, in add.irion to the existing right-of-way along University Road.
NOTE: The County Engineer has not required new dedication with this
proposal.
b. Future building and other setbacks required by the Spokane County Zoning
Code shall be measured from the reserved future acquisition area.
c. No required landscaping, parking, '208' areas, drainfield or allowed signs
should be located within the future acquisition area for road right-of-way and
utilities. If any of the above improvements are made within this area, they
shall be relocated at the applicant's expense when roadway improvements are
made.
d. The future acquisition area, until acquired, shall be private property and may
be used as allowed in the zone, except that any improvements (such as
landscaping, parking, surface drainage, drainfield, signs or others) shall be
considered interim uses.
e. The property owner shall be responsible for relocating such "interim" improvements at the time Spokane County makes roadway improvements
after acquiring said future acquisition area.
9. The Planning Departinent shall prepare and record with the Spokane County
Auditor a Title Notice noting that the property in question is subject to a variety of
special conditions imposed as a result of approval of a land use action. This Title
Notice shall serve as public notice of the conditions of approval affecting the
property in question. The Title Notice should be recorded within the same ti.me
frame as allowed for an appeal and shall only be released, in full or in part, by the
Planning Department. The Title Notice shall generally provide as follows:

10. Prior to approval of road and drainage plans, you are required to coordinate with
the United States Postal Service to determine type and locarion of cenoral mail
delivery facilities which may include applicable easements for developments of
three or more homes.

SPOKANE COUNTY DIVISION OF ENGINEERING AND ROADS

1. Access permits for approaches to the county road system shall be obtained from the
Spokane County Engineer.
2. The applicant shall submit for approval by the Spokane County Engineer road,
drainage and access plans.
3. A parking plan and traffic circularion plan shall be submitted and approved by the
Spokane County Engineer. The design, location and arrangement of parldng stalls
shall be in accordance with standard traffic engineering practices. Paving or
surfacing as approved by the Counry Engineer, will be required for any portion of
the project which is to be occupied or traveled by vehicles.
4. To construct the roadway improvements stated herein, the applicant may, with the
approval of the County Engineer, join in and be willing to participate in any
peririon or resolution which purpose is the formation of a Road Improvement
District (RID) for said improvement, pursuant to RCW 36.88, as amended.
Spokane County will not participate in the cost of these improvements. This is
applicable to Oberlin Road.
5. As an alternative method of constructing the road unprovements stated herein, the
applicant may, with the approval of the County Engineer, accomplish the road
improvements stated herein by joining and participating in a County Road Project
(CRP) to the extent of the required improvement. Spokane County will not
parricipate in the cost of tllese improvements. This is applicable to Oberlin Road.
6. The construction of the road improvements stated herein shall be accomplished as
approved by the Spokane County Engineer.
7. The County Engineer has designated Typical Roadway Section Number Two,
Local Access stand.ard for the unprovement of Oberlin Road, which is adjacent to
the proposed development. This will require the addition of approximately 8-10
feet of asphalt along the frontage of the development. The construcrion of curbing
is also required.
8. All required unprovements shall conform to the current State of Washington
Standazd Specifications for Road and Bridge Construcrion and other applicable
County standards and/or adopted resolutions pertaining to Road Standards and
Stormwater Management in effect at the date of construction, unless otherwise
approved by the County Engineer.
9. Applicant shall construct a paved and delineated approach(es) to meet the existing
pavement on Oberlin and University Roads.
10. Roadway standards, typical roadway sections and drainage plan requirements are
found in Spokane Board of County Commissioners Resolution No. 80-1592 as
amended and are applicable to this proposal.

Plan. In order to imglement the Arteraal Raad Plan, in addition to the required
right-of=way dedication, a strip of praperty 15-20 feet in wadth along the XJniversity
Road frvntage shall be set aside in reserve. This property may be acquire.d by
Spokanne County at the time when arterial irnpravements are made ta University
Raad.

property, including property to be dedicated or set aside for future acquisition.
Spokane County assumes no financial obligativn fvr adjustments or relacation
regarding these utilities. Applicant(s) should check with the apgiicable utility
purveyor and the Spokane County Engineer to determine whether applicant(s) or
the -uti.lity is responsible for adjusrment ax relvcation costs and to rnake
arrangerflents fvr any necessary work.
SPOKANE COUNTY DYVISION OF UTILITIES

SPOKANE COUNTY HEAx,'i'H DISTRICT
1. A combined surface water and sevwage disposal detailed plan sha11 be approved by
the Spokane County Engineer and the Spokane County Hea1th District prior to the
issuance of any on-sxte sewage disposal permit or building per~t for this praject.
2. Sewage dispvsal method shal~ ~e as autharized by the Dire.ctor of Utilities, Spokane
County.

County.

5. Disposal of sewage effluent beneath paved surfaces is currently prohibited.
6. A public sewer system will be made available for the project, and individual service
will be provided to each lot prior to sale. Use of individual on-site sewage disposal
systems shall be authorized only on Lots 4& 5 and are subject to specific
applicarion approval and issuance of pemuts by the Health Officer.
7. Use of private wells and water systems is prohibited.
SPOKANE COUNTY DIVISION OF BUILDINGS
1. Fire flows are applicable for this proposal. The minimum fire flow and flow
duration will be based on a representative dwelling size for all floors not including
the basement. The maximum dwelling size needs to be submitted to the Department
of Buildings.
2. An approved water supply capable of supplying the required fire flow protection
shall be provided before any building permits are issued. The water system shall be
installed in accordance with an approved Water System Plan on file with the
Department of Buildings. Certification that the installed system complies with the
requirements of the plan and is operarional shall be submitted to the Department of
Buildings prior to permit issuance.
3. The applicant shall contact the Department of Buildings at the earliest possible stage
of design/development in order to be informed of code requirements -
administered/enforced by the department; e.g., State Building Code Act regulations
such as requirements for exiting, construction type, occupancy classification, fire
hydrant/flow, fire apparatus access roads, accessibility, energy code regulations,
and general coord.inanon with other aspects of project implementation.
SPOKANE COUNTY FIRE PROTECTION DISTRICT NO. 1
1. Access and required fire protection will be verified at the time of building pernut
application.
SPOKANE COUNTY AIR POLLUTION CONTROL AUTHORITY
1. All air pollution regulations must be met. This includes but is not limited to the
following:
2. Air pollution regulations require that dust emissions during demolition, construcrion
and excavation projects be controlled. This may require use of water sprays, tarps,
sprinklers or suspension of activity during certain weather conditions. Haul roads
should be treated, and emissions from the transfer of earthen material must be
controlled, as well as emissions from all other construction-related acrivities.
3. All traveled surfaces (ingress, egress, parking areas, access roads) must be paved
and kept clean.

4. Measures must be taken to avoid the deposition of dirt and mud from unpaved
surfaces onto paved surfaces. If tracking or spills occur on paved surfaces,
measures must be taken immediately to clean these surfaces.
5. All debris that results from this project must be disposed of by means other than open
burning (ie. construction waste, etc.).
6. All solid fuel burning devices (wood stoves, pellet stoves, etc...) must comply with
local, state, and federal rules and regulations.
WASHINGTON STATE DEPARTMENT OF ECOLOGY
1. Stormwater must be handled by drainage swales meeting the "208 stormwater drainage
requirements," as noted in the checklist. Direct discharge is not acceptable.
2. Disposal of construction debris should be done in such a manner that debris cannot
enter the natural stormwater drainage system or cause water quality degradation of state
waters. Proper erosion and sediment control practices rnust be used on the construction
site including re-seeding and revegetation. These practices should be implemented as
soon as land clearing activities begin.

The State Env9ro nmental Po11cy Act (SEPA) chapter 43.21C RCU, requlres all gover m►ental agentles to consider the environmental iiapacts of a proposal
before nwking decisions. An Environmental Tmpact Statement (EIS) must be prepared for all proposali Nith probaDle signlficant adverse lnpacts on
the quality of the environment. The purpose of this checklist is to provide informatton to help you and the agency identtfy lmpacts fron your
proposal (and to reduce or avoid impacts from the proposal. if it can be done) nnd to help the agency decide whether an EIS is requlred.

Location: Generally located in the Spokane Valley, 100 feet south of 16th
Avenue and between Oberlin Road and University Road in the NE 1./4 of Section
29, Township 25 N., Range 44 EWM, Spokane County, Washington.
Proposal: Zone reclassification of approximately 1.73 acres from Urban
Residential-22 (LTR-22) and Neighborhood Business (B-1) to Urban Residential-7
, (UR-7) within the Aquifer Sensitive Area (ASA) for duplexes and those uses
allowed in the UR-7 Zone.
II. SITE INFORMATION
A. Site Size: 1.73 acres
Gross Density: 5.78 to 6.94 units per acre (Maximum of 12 units on the 5
lots)

B. Comprehensive Plan
1. Land Use Plan: The property is located within the Urban category of the
Comprehensive Plan. This category is intended to provide for development
of a"city like" environment. Since Urban areas will be the most intensely
developed of all the categories, it is primarily a residential category of single
family, two family, multifanuly and condominiums along with
neighborhood commercial, industrial parks, and recreational facilities.
Urban areas will have public water systems, sanitary sewer systems, and
other public facilities typical for intensively developed urban areas. The
more intensive uses will be located along heavily traveled arterials
Objective 1.1 a of the Urban Category discusses fill-in development within
established development areas. Those proposals with existing public
services should be approved provided that such development meets the
intent of other Comprehensive Plan objecrives and guidelines.
Other objecrives of this category include placement of multifamily projects
with direct or near direct access to arterials. Multifamily structures will
usually be a transitional use located between single-family residential and
the more intensive areas. Protection of adjacent single amenities should also
be considered.
2. Arterial Road Plan: The proposal has two lots which have frontage on
Universiry Road, which is designated as a Principal Arterial by the ,
County's Arterial Road Plan with a planned right of way width of 100 feet. ~To implement this plan, the County Engineer will require a strip of property
15 to 20 feet in width for future acquisition area on University Road. No
new right of way dedication was required.
C. Site Characteristics: The site is a flat, vacant field with native grasses,
sagebrush and a few trees. The site consists of 5 previously subdivided lots in
the Chester Hills Addition. The lots create a zig-zag configuration from
northwest to southeast.
D. Neighborhood Characteristics: The proposal is located south and west of a
neighborhood business area on the southwest corner of 16th Avenue and
University Road. These neighborhood business uses include a convenience
, store, insurance office, gasoline station and two undeveloped lots. The other
dominant land use in the area is University Elementary School across University
Road east of the site. To the south and west of the site are single family
residences in Chester Hills Addirion.
E. Zoning Analysis: The proposed UR-7 zone is compatible with the
surrounding zoning because it buffers the UR-3.5 zone and single family
residences to the south and west from the more intensive business uses on the
corner of 16th Avenue and University Road. The UR-7 zone allows less
intensive land uses than the B-1 and UR-22 zones which currently exist on the
site The site is adjacent, or in close proximity to, two Frincipal Arterials (16th
Avenue and University Road) and will be served by public sewer, which
indicates consistency with the goal.s, objectives and decision guidelines o£ the
Comprehensive Plan.

Proposal: Reclassify land established on January 1, 1991as Urban
Residential-22 (UR-22) File No. 168-77C (previously Mulri-
Family Suburban) and Neighborhood Business (B-1)
File No. 228-52 (previously Local Business) to Urban
Residential-7 (UR-7).
North: Neighborhood Business (B-1), File No. 228-52.
South: Urban Residential-3.5 (UR-3.5) zoning established on January 1,
1991, File No. 25-52.
- East: Urban Residential-3.5 (UR-3.5) zoning established on January 1,
1991, File No. 171-55.
West: Urban Residential-3.5 (UR-3.5) zoning established on January 1,
1991, File No. 25-52.
F. Land Use Analysis: The development trend in the area is fill in of vacant lots
with single family residences and neighborhood businesses. The proposal
appears comparible with existing single family residences to the south and west
and businesses to the north. The proposal is for a down zone which will allow
for the transitional use of duplexes or apartments versus businesses or
professional offices currently allowed in the existing zone classi.fication.
Site: The existing land use is a vacant field. The proposed land use is for
duplexes or triplexes. Triplexes woulci be allowed on only two of the
three lots over 15,000 square feet in size. If all three large lots
allowed triplexes, the allowed density of 7 units ger acre would be
exceeded for the site.
North: Neighborhood business uses.
South: Single family residences.
East: University Elementary School and vacant.
West: Single family residences.
G. Circulation: Oberlin Road will provide access to three lots and University Road
will provide access for two lots. The applicant will be required by the County
Engineer to construct paved and delineated approaches to meet the existing
pavement on University Road.
H. Design: The proposed design is for 25 foot high duplexes or triplexes with
wood or vinyl siding on the existing piatted lots. The east 20 feet of Lots 3 and
6, Block A of Chester Hi.11s Addition have been added to Lots 4 and 5, Block A in
a minor lot line adjustnaent action executed prior to this proposal. This leaves
these lots with less than 15,000 square feet of lot area so triplexes are not
permitted on these lots.

Future site development must meet the landscape requirements of the Urban
Residential-7 (UR-7) zone. Twenty (20) feet of Type III Landscaping is required
along the frontage of University Road and Oberlin Road. A specific landscape
plan will be required prior to the issuance of building permits.
Detailed review to determine compliance with all Zoning Code regulations and
conditions of approval is recommended to be administrative and to occur at the
Building Permit stage.
I. Density: The Zoning Code allows for a density of 7 dwelling units per acre in
the proposed UR-7 zone. This would allow for a total of 12 dwelling units on the
5 existing lots. Only three lots are permitted to have triplexes (Lots 7, 8 and 9,
Block A). For all three to be developed as such, one of the remaining lots (Lots 3
or 6, Block A) would be restricted to a single family residence instead of a duplex
so only 12 total units would result on the S lots.

J. Drainage: A drainage plan is required. This plan must be reviewed and
approved by the County Engineer's Department prior to development.
K. Water Supply: Water service shall be by an existing public water supply
system. The proposal is served by Spokane County Water District #3.
L. Sewage Disposal: The applicant will make connection to the public sewer
system.
M. Schooi: The proposal is in the Central Valley School Disrrict No. 356. No
comments have been received from the district.
N. Fire Protection: The proposal is within Fire District No. 1. The Fire District
and the Division of Buildings Department (Fire Marshall) are required to approve
fire protection provisions prior to finalizing the preliminary plat.
, O. Cultural Resources: None have been identified.
P. Parks and Recreation: In addirion to the University Elementary School
playground, Castle County Park is located one mile south of the site at 32nd
Avenue and University Road.
III. ENVIRONMENTAL REVIEW:
An Environmental Checklist was submitted by the sponsor and was reviewed by the
County Planning Departiment. The review considered the specifics of the proposal,
other available information, County ordinances, other regulations and laws, possible
standard Condirions of Approval, the Generalized Comprehensive Plan, and other
County policies and guidelines. The Planning Department has determined that "No
probable signif'icant adverse impacts" would result from the proposal being developed
and has issued a Determination of NonsiQnificance ("DNS").
The "DNS" was circulated to 12 other agencies of jurisdicdon and other
agencies/deparnnents affected by the future development for review and comment.
The "DNS" comment period ends January 19, 1993 and was advertised 15 calendar

days before said date in the newspaper, by letter to adjacent property owners within
400 feet of the proposal, and by notice on a sign posted on the proposal site. 1'he
Hearing Examiner may consider additional environmental related testimony at the
. public hearing.
I V. PLANNING DEPARTMENT SUMMARY AND RECOMMENDATION
The proposal is consistent with the proposed zoning, existing Comprehensive Plan
category, Arterial Road plan and adjacent land uses. Based upon the above analysis
and other departmental reviews, the Planning Department recommends approval of the
zone reclassification from Urban Residential-22 (UR-22) to Urban Residential-7 (UR-
7) as conditioned.
V . CONDITIONS OF APPROVAL
i. All conditions imposed by the Hearing Examiner Committee shall
be binding on the "Applicant", which terms shall include the
owner or owners of the property, heirs, assigns and successors.
i i. The zone reclassification applies to the following reai property:
Lots 3, 6, 7, 8, 9, Block A, except the east 20 feet of Lots 3 and 6, Block A,
Chester Hills Addition, Spokane County, Washington.
SPOKANE COUNTY PLANNING DEPARTMENT
1. All conditions imposed by the Hearing Examiner Committee shall be bind.ing on the
"Applicant", which term shall include the owner or owners of the property, heirs,
assigns and successors.
3. The proposal shall comply with the Urban Residential-7 (UR-7) and Aquifer
Sensitive (ASA) Overlay zones as amended.
4. The applicant shall develop subject property generally in accordance within the
concept presented to the Hearing Body. Variations, when approved by the
P1annulg Director/designee, may be permitted, including, but not limited to building
locarion, landscape plans and general allowable uses of the permitted zone. All
variations must conform to regulations set forth in the Spokane County Zoning
Code, and the original intent of the development plans shall be maintained.
6. A specific landscape plan, planting schedule and provisions for maintenance
acceptable to the Planning Director/designee shall be submitted with a performance
bond for the project prior to release of building permits. Landscaping shall be
installed and maintained so that sight distance at access points is not obscured or

8. The Spokane County Planning Department shall prepare and record with the
County Auditor a Tide Notice specifying a future land acquisition area for road
right-of-way and utilities. The reserved future acquisition area Title Notice shall be
released, in full or in part, by the Planning Department. The notice should be
recorded within the sa.me time frame as an appeal and shall provide the following:
a. At least 15 to 20 feet of reserved future acquisirion area for road right-of-way
and utilities, in a.dd.ition to the existing right-of-way along University Road.
NOTE: The County Engineer has not required new dedication with this
proposal.
b. Future building and other setbacks required by the Spokane County Zoning
Code shall be measured from the reserved future acquisition area.
c. No required landscaping, parking, '208' areas, drainfield or allowed signs
should be located within the future acquisition area for road right-of-way and
utilities. If any of the above improvements are made within this area, they
shall be relocated at the applicant's expense when roadway improvements are
made.
d. The future acquisition area, until acquired, shall be private property and may
be used as allowed in the zone, except that any improvements (such as
landscaping, parking, surface drainage, drainfield, signs or others) shall be
considered interim uses.
e. The property owner shall be responsiblP fnr relocating such "interim"
improvements at the time Spokane County makes roadway improvements
after acquiring said future acquisirion area.
9. The Planning Department shall prepare and record with the Spokane County
Auditor a Title Notice noting that the property in question is subject to a variety of
special conditions imposed as a result of approval of a land use action. This Title
Notice shall serve as public notice of the conditions of approval affecting the
property in question. The Title Notice should be recorded within the same time
frame as allowed for an appeal and shall only be released, in full or in part, by the
Planning Department. The Title Notice shall generally provide as follows:
The parcel of property legally described as [ ] is the subject
of a land use action by a Spokane County Hearing Body or
Administrative Official on [ imposing a variety of ,
special development conditions. File No. [ ] is available for
inspection and copying in the Spokane County Planning Department.
10. Prior to approval of road and drainage plans, you are required to coordinate with

delivery facilities which may include applicable easements for developments of

SPOKANE COUNTY DIVISION OF ENGINEERING AND ROADS
Prior To Issuance Of A Building,aermit C?r t15e Of The Provertv As ProggleiL
1. Access permits for approaches to the county road system shall be obtained from the
Spokane County Engineer.
2. The applicant shall submit for approval by the Spokane County Engineer road,
drainage and access plans.
3. A parking plan and traffic circulation plan shall be submitted and approved by the
Spokane County Engineer. The design, location and arrangement of parking stalls
shall be in accordance with standard traffic engineering practices. Paving or
surfacing as approved by the County Engineer, will be required for any portion of
the project which is to be occupied or traveled by vehicles.
4. The construction of the road improvements stated herein shall be accomplished as
approved by the Spokane County Engineer.
5. All required improvements shall conform to the current State of Washington
Standard Specifications for Road and Bridge Construcrion and other applicable
County standards and/or adopted resolutions pertaining to Road Standards and
Stormwater Management in effect at the date of construction, unless otherwise
approved by the County Engineer.
6. Applicant shall cbnstruct a paved and delineated approach(es) to meet the existing
pavement on University Road.
7. Roadway standazds, typical roadway secrions and drainage plan requirements are
found in Spokane Board of County Commissioners Resolution No. 80-1592 as
amended and are applicable to this proposal.
8. No construction work shall be performed within the existing or proposed public
right-of-way until a perrnit has been issued by the County Engineer. All work
within the public road right-of-way is subject to inspection and approval by the
County Engineer.
9. The County Arterial Road Plan identifies University Road as a Principal Arterial.
The existing right-of-way width of 70 feet is not consistent with that specified in the
Plan. In order to implement the Arterial Road Plan, in addition to the required
right-of-way deducation, a strip of property 15-20 feet in width along the University Road frontage shall be set aside in reserve. This property may be acquired by
Spokane County at the time when arterial improvements are made to University
Road.
10. There may exist utilities, either underground or overhead, affecting the subject
property, including property to be dedicated or set aside for future acquisition.
Spokane County assumes no financial obligation for adjustments or relocation
regarding these utilities. Applicant(s) should check with the applicable utility
purveyor and the Spokane County Engineer to determine whether applicant(s) or
the utility is responsible for adjustrnent or relocation costs and to make
ancangements for any necessary work.

A SPOKANE COUNTY DIVISION OF UTILITIES
1. Applicant shall make connection to public sewer system. Sewer connection permit
is required. Plans and specifications are to be reviewed and approved by the
Utilities Department.
SPOKANE COUNTY HEALTH DISTRICT
1. A combined surface water and sewage disposal detailed plan shall be approved by
the Spokane County Engineer and the Spokane County Health District prior to the
issuance of any on-site sewage disposal pernut or build.ing permit for this project.
2. Sewage disposal method shall be as authorized by the Director of Utilities, Spokane
County.
3. Water service shall be coordinated through the Director of Utilities, Spokane
County.
4. Water service shall be by an existing public water supply when approved by the
Regional Engineer (Spokane), State Department of Health.
5. Disposal of sewage effluent beneath paved surfaces is currently prohibited.
6. A public sewer system will be made available for the project, and individual service
will be provided to each lot prior to sa1e. Use of individual on-site sewage disposal
systems shall be authorized only on Lots 4& 5 and are subject to specific
application approval and issuance of permits by the Health Officer.
7. Use of private wells and water systems is prohibited.
SPOKANE COUNTY DIVISXON OF BUILDINGS
1. Fire flows are applicable for this proposal. The minimum fire flow and flow
duration will be based on a representative dwelling size for all floors not includ.ing
the basement. The maximum dwelling size needs to be submitted to the Department
. of Buildings.
2. An approved water supply capable of supplying the required fire flow protection
shall be provided before any building permits are issued. The water system shall be
installed in accordance with an approved Water System Plan on file with the
Department of Buildings. Certification that the installed system complies with the
requirements of the plan and is operational shall be submitted to the Department of
Buildings prior to permit issuance.
3. The applicant shall contact the Department of Buildings at the earliest possible stage
of design/development in order to be informed of code requirements
administered/enforced by the deparnnent; e.g., State Building Code Act regulations
such as requirements for exiting, construction type, occupancy classification, fire

hydrantlflow, fire apparatus access roads, accessibility, energy code regularions,
and general coordination with other aspects of project implementation.
SPOKANE COUNTY FIRE PROTECTION DISTRICT NO. 1

SPOKANE COUNTY AIR POLLUTION CONTROL AUTHORITY
1. All air pollution regulations must be met. This includes but is not linnited to the
following:
2. Air pollution regularions require that dust emissions during demolition, construction
and excavation projects be controlled. This may require use of water sprays, tarps,
sprinklers or suspension of activity during certain weather conditions. Haul roads
should be treated, and emissions from the transfer of earthen material must be
controlled, as well as emissions from all other construction-related acrivities.
3. All traveled surfaces (ingress, egress, parking areas, access roads) must be paved
and kept clean.
4. Measures must be taken to avoid the deposition of dirt and mud from unpaved
surfaces onto paved surfaces. If tracking or spills occur on paved surfaces,
measures must be taken immediately to clean these surfaces.
5. All debris that results from this project must be disposed of by means other than open
burning (ie. construction waste, etc.).
6. All solid fuel burning devices (wood stoves, pellet stoves, etc...)must comply with
local, state, and federal rules and regulations.
