E48 The constructiori of the roadway impzovements statPCl herein shall
be accomplished as approved by the Spokane County Engineer.
E50 The County Engineer has designated Typical Roadway Section
Number Two, Secondary Arterial standard for the improvement of
Bowdish Road which is adjacent to the proposed development. This
will require the addition of approximately 12-14 ft. of asphalt
along the frontage of the development. Curbing and sidewalk must
also be constructed.
E51 All required improvements shall conform to the current State of
Washington Standard Specifications for Road and Bridge
construction and other app].icable county standards and/or
adopted resolutions pertaining pertaining to Road Standards and
Stormwater Management in effect at the date of construction,
unless otherwise approved by the County Engineer.
E54 Access to Bowdish Road shall be prohibited until such time as
specifically authorized by the Spokane County Engineer.
E55 Roadway standards, typical roadway sections and drainage plan
requirements are found in Spokane Board of County Commissioners

The proposed revisions are set forth as follows:
REVISED 9.14.200 Stormwater drainage f acilities--Bonds or
sureties.
Al1 stormwater drainage facilities included in the site
drainage plan approved by the county engineer shall I.-de
installed or covered by bonds or sureties as follows:
(1) For all drainage facilities to be located witrIn Lha
county right-of-way, the sponsor shall post a performance 1bonc
in conformance with Section 9.14.040.
(2) For all drainage facilities to be located outs-ldp
the county right-of-way, the sponsor shall post a perfornance
bond in conformance with Section 9.14.040, and shall also
provide a perpetual maintenance plan f or such f aci 1 i t i e s or i fl r
to final approval. Facilities outside public rights-of-way
requiring further maintenance shall be located within pub?-:1:,
easements.
(3) For all drainage swale systems required tc :e
installed for residential ' lots, the sponsor shall provllde
plans to the county engineering division prepared by a civll
engineer, showing the location and design of the drainayn-
swale system along with an 8 1/2" x 11" plan for each loz:
having a drainage swale. The sponsor shall also install
drywells and rough grade swales, in accordance with the plans,
or post a bond or other security approved by the count-y
engineer therefore.
(4) For all drainage swale systems required to 1)e
installed for residential lots,V the builder shall be
responsible for providing the county division of engineeri-ng
with a site plan drawn on the 8 1/2" x 11" lot plan requiree
under subsection 3 above, showing the location of the drainage
swale system and other proposed site improvements. Tne
builder shall deposit with the county engineering division a
$1000 surety, ip the form of cash, letter of credit or savings
assignment, guaranteeing completion of the fine grad'Lng,
landscaping and installation of sod required for the swale
system within six (6) months of occupancy of the residence
constructed on the lot.

NEW 9.19.205 Failure to Maintain Drainage Facilities
Any person who wilfully damages, alters, remaves or :a:l-5
to maintain or repair stormwater drainage facilities,
including any portion of a drainage swale system, which sG::
person is responsible for maintaining under this chaprA:,
shall be guilty of a misdemeanor ancl shall be subjecc to a
f ine not to exceed two hundred f if ty dollars or impr isorL;.A:: t
in the county jail not exceeding ninety days or both. ~i
addition to, or as an alternative to such penalty, tne
violator may also be subjected to a civil penalty in 1-ne
manner provided by sections 14.406.060 through 14.406.100 o-
the county code.
REVISED 9.14.220 Stormwater drainage facilities ly~;:q
outside rights-of-way Maintenance
and operation by county -
Circumstances
Pursuant to chapter 36.89 RCw, the county may assu:ne
maintenance and operation responsibility of stormwater
drainage facilities which lie outside the county road righr_-
of -way and which are owned by the county or over which
county has right of use for the movement and control of storm
drainage and surface water runoff, including both natural-,,,.
occurring and man-made facilities. The county may assu.ne su:::
responsibility, at its sole discretion and under s,.:--:)
conditions as it deems appropriate, where:
(1) The county and the sponsor have executed
an agreement whereby the owners of properties
served by the f acilities agree to pay service
charges levied by Spokane County for maintenance
and operation of the drainage f acilities; or
(2) The county is authorized under the condit~o-:s
of development approval to provide such services anc le,.--;
service charges for the same; or
(3) The county finds there is a public need :.c
establish a stormwater drainage service area wherein t^,~
county will maintain and operate stormwater drainaye
facilities and levy service charges against
properties served by such facilities.

For those drainage facilities operated and maintaineci :,y
the county under Section 9.14.200, service charges shall c-3
applicable for each property served or benefitted therebI-,
according to the schedule of charges listed in the written
agreement or as established or revised by resolution of the
board of county commissioners after notice and hearing.
Pursuant to RCW Chapter 36.89.092, delinquent charges shall
bear interest at the rate of twelve percent per annw-n,
compu:tec3 on a m,onthly basis from the date of delinquency as
said date is fixed by resolution.
Pursuant to RCW 36.89.090, the county shall have a lie►~►
zor delinquent service charges, including interest thereon,
against any property against which they were levied for

Location: Generally located in the Spokane Valley at the southwest corner of the
intersection of 24th Avenue and Bowdish Road in Section 28, Township 25 N.,
Range 44 EWM, Spokane County, Washington.
Proposal: Two duplexes, two existing single family houses will be demolished.
II. SITE ANALYSYS
A. Comprehensive Plan: The proposal is located in the Urban category of the
Comprehensive Plan. The Urban category provides for residential densities from 1 to
17 dwelling units per acre. _
The Comprehensive Plan does not provide specific location criteria for duplexes in
the Urban category. However, the Urban category objecrive l.lb states that higher
density developments such as multifamily should be located with direct or near direct
access to the major arterial system.
The proposal is located at the intersection of 24th Avenue, a Collector Arterial and
Bowdish Road, a Minor Arterial.
The proposal is in conformance with the objectives and decision guidelines of the
Urban category.
B. Arterial Road Plan: The proposal fronts on 24th Avenue and Bowdish Road.
Twenty Fourth Avenue is designated as a Collector Arterial with a future right of way
width of 70 feet. Bowdish Road is designated as a Minor A.rterial with a future right
of way width of 80 feet.

AcceM The site is located at the southwest corner of the intersection of Bowdish
Road and 24th Avenue. The County Engineer has prohibited vehicular access to
Bowdish Road. Access will be provided on 24th Avenue.
III. PROPOSED SITE PI,AN
The site plan submitted with the application shows two duplexes located on 4 platted
lots. Each of the 4 lots is 51 feet wide and 130 feet deep. In order to accommodate
the proposed duplex design and meet the flanking street and side yard setback
requirements, a minor lot line adjustment will be necessary. Issuance of a Certi.ficate

af Exemption by the Planning Department will be necessary to accomplish the lot line -
adjustment.

A. Parking: Each housing unit will be provided with a one car garage or.carport. The
driveway to each unit will provide add:tional off-sa-eet parlci.ng. The Zoning Code
requires one and one-half off-street parlcing spaces per,multiple family dwelling unit.
Parking spaces may be stacked in driveways. '
B. Site Coverage: Following construction of the duplexes, buildings will cover
approximately 20 % of the site.
C. Stormwater Disposal: This development is located within a dra.inage basin which
has been identified by the County Eng-ineer as having stormwater runoff problems.
Future owners will be required to participate in planning and implementation of a
future basin wide stormwater management system.
D. .Sewage Disposal: The project will be connected to public sewer.
E. Water Supply: Water service will be provided by Model Trrigation District No.
18.
F. Fire Protection: Fire protection will be provided by Spokane County Fire District
No. 1.
G. Schools: The project is located in Central Valley School District No. 356.
Note:
The site plan submitted for review by the Hearing Examiner Comrnittee is general in
nature. Detailed review to deternune compliance with all Ordinance regulations ~and
conditions of approval is recommended to be administrative and to occur at the
B uilding Permit stage. '
I V. SEPA ENVIRONMENTAL REVIEW
An Eiivironmenta]. Checklist was submitted by the sponsor and was reviewed by the
Counry Planning Department. The review considered the specifics of the proposal,
other available information, County ordinances, other regulations and laws, possible
standard Condirions of Approval, -the Generalized Comprehensive Plan, and other
County policies and guidelines. The Planning Department has deternuned that "No
probable significant adverse impacts" would result from the proposal being developed
and has issued a Determination of Nonsienificance ("DNS").
The "DNS" was circulated to 9 other agencies of jurisdiction and other
agencies/departments affected by the future development for review and comment.
The "DNS" comment period ends Augvst 20, 1991 and was advertised 15 calendar
days before said date in the newspaper, by letter to adjacent property owners within
400 feet of the proposal, and by notice on a sign posted on the proposal site. The
Heari.ng Examiner may consider additional environmental related testimony at the
public hearing.

V. PL,ANNING DEPARTMENT SUMMAR'Y
The proposal is located in the Urban category of the Comprehensive Plan. The
project is in conformance with the Urban category especially since_it is located
. adjacent to Minor and Collector Arterial streets.
The project is cunrently provided with the full range of urban services and should be
compatible with surrounding residential development.
1'he Planning Department recommends that the project be approved subject to the
conditions of approval.
V I. CONDI'TIONS OF APPROVAL
i. All Conditions imposed by the Hearing Examiner Committee shall
be binding on the "Applicant," which term shaIl include the owner
or owners of the property, heirs, assigns, and successors.
ii. The Zone Reclassification applies to the following real property:
Lots 1, 2, 3, and 4 Block, 25 Kokomo Townsite.
SPOKANE COUNTY PLANNING DEPARTMENT
1. The proposal shall comply with the Urban Residential-7 (UR-7) zone as amended.
2. Certificates of Exemption to allow minor lot line adjustments will be required prior
to issuance of building permits for the project Note: The lot line adjustment is
necessary between lots 2 and 3 to meet flanking street and side yard setback
requirements.
3. The applicant shall develop subject property generally in accordance within the
concept presented to the Hearing Body. Variations, when approved by the .
Planning Director/designee, may be permitted, including, but not limited to building
location, landscape plans and general allowable uses of the pernutted zone. All
variations must conform to regulations set forth in the Zoning Code for Spokane
County, and the original intent of the development plans shall be maintained.
4. The Planning Department shall prepare and record with the Spokane County
Auditor a Title Notice noting that the property in question is subject to a variety of
special conclitions imposed as a result of approval of a land use action. This Title
Notice shall serve as public notice of the condhtions of approval affecting the
property in question. The Title Notice should be recorded within the same time
frame as allowed for an appeal and shall only be released, in full or in part, by the
Planning Department. The Title Notice shall generally provide as follows:

utilities. If any of the above improvements are made within this area, they
shall be relocated at the applicant's expense when roadway improvements are
made.
d. The future acquisition area, until acquired, shall be private property and may
be used as allowed in the zone, except that any improvements (such as
landscaping, parking, surface drainage, drainfield, signs or others) shall be
considered interim uses..

5. The construction of the road unprovements stated herein shall be accomplished as
approved by the Spokane County Engineer. :
6. The County Engineer has designated Typical Roadway Section Number Two,
Secondary Asterial standard for the improvement of Bowdish Road, which is
adjacent to the proposed development. This will require the adclition of
approximately 12-14 feet of asphalt along the frontage of the development The .
construction of curbing and sidewallc is also required.
7. All required improvements shall conform to the cwrrent State of Washington
Standard Specifications for Road and Bridge Construction and other applicable
County standards and/or adopted resolutions pertaining to Road Standards and
Stormwater Management in effect at the date of construcrion, unless otherwise
approved by the County Engineer. . ,
8. Access to Bowd.ish Road shall be prohibited until such time as specifically
authorized by the Spokane County Engineer.
9. Roadway standards, typical roadway secrions and drainage plan requirements are
found in Spokane Board of County-Commissioners Resolution No. 80-1592 as
amended and are applicable to this proposal.
10. This subdivision or development proposal is located within a drainage basin which
has been idenrif'ied by the Spokane County Engineer's office as having stormwater
runoff problems. Since this plator development proposal is affected by or is a
contributor to stormwater flows, property owners should participate in the planning
and implementation of a future basinwide stormwater management system. The

2. Requirements of Fire District No. 1 need to be satisfied during the building pernut

3. Fire hydrants shall be located at roadway intersections wherever possible and the
maximum average distance between them shall be no further than 900 feet and these
hydrants shall be placed so no portion of the structures are i.n excess of 450 feet
from a hydrant. -
SPOKANE COUNTX AIR POLLUTION CONTROL AUTHORITY
1. All a.ir pollution regulations must be met. This includes but is not limited to the
following:
2. Air pollution regulations require that dust emissions during demolition, construction
and excavation projects be controlled. This may require use of water sprays, tarps,
sprinklers or suspension of activity during certain weather cond.itions. Haul roads
should be treated, and emissions from the arransfer of earthen material must be
controlled, as well as emissions from all other construction-related activities.
3. Measures must be taken to avoid the deposition of dirt and mud from unpaved
surfaces onto paved surfaces. If tracking or spills occur on paved surfaces,
measures must be taken immediately to clean these surfaces.
4. Debris generated as a result of this project must be disposed of by means other than
burning.
5. Demolition and renovation projects must comply wich the requirements of CFR 40,
Part 61, Subpart M. Intent to Demolish and Renovate forrns are available at the
S CAPCA office.
6. Solid fuel heating device(s) shall meet provisions of SCA.PCA Regulation I, Article
