This matter coming on for public hearing on February 20, 2002, the Hearing Examiner,
after review of the zone reclassification application and the entire record, and finding good cause
therefore, hereby makes the following findings of fact, conclusions of law and decision:
1. FINDINGS OF FACT
1. The application requests a rezone of 1.18 acres of land from the Uxban Residential-3.5
(UR-3.5) zone to the Regional Business (B-3) zone, for the development of those uses allowed in
the B-3 zone.
2. The site is located south of and adjacent to Sprague Avenue, 1,000 feet west of the
intersection of Sprague Avenue and Conklin Road, in the NW '/4 of Section 24, Township 25
North, Range 44 EWM, Spokane County, Washington.
3. The site is currently referenced as County Assessor's tax parcel no. 45242.0211. The
subject property is legally described in the application.
4. The applicant is Richard D. Taylor, 15212 E. Bella Vista, Veradale, WA 99037. The site
owmer is Richard D. and Lorraine Taylor, at the same address.
5. The Hearing Examiner conducted site visit on February 19, 2002. The Examiner conducted
a public hearing on the proposal on February 20, 2002. The requirements for notice of public
hearing were met.
6. The Hearing Examiner left the record open after the public hearing to give the applicant the
opportunity to withdraw the application, based on concerns expressed by the applicant at the
public hearing regarding the restrictions of the Phase I Development Regulations on the rezone if
approved. The applicant was given ample opportunity and time to request withdxawal of the ~
application, but did not make such request. See letter dated June 4, 2002 from Michael Dem.psey
to Richard Taylor.
7. The Hearing Examiner heard the application pursuant to the County Hearing Examiner
Ordinance (County Resolution No. 96-0171) and the County Hearing Examiner Rules of
Procedure (County Resolution No. 96-0294).

9. The County Division of Planning issued a Determination of Nonsignificance for the project
on December 28, 2001.
10. The Hearing Examiner takes notice of the County Generalized Comprehensive Plan, GMA
Comprehensive Plan and Capital Facilities Plan, Phase I Development Regulations, County
Resolution No. 1-1033, County Resolution No. 2-0037, other applicable development
regulations, and prior land use decisions in the vicinity.
11. The record includes the documents in the project file at the time of the public hearing, the
documents and testimony submitted at tlle public hearing, the items taken notice of by the
Hearing Examiner, and a copy of the Examiner's letter to the applicant dated 6-4-02.
12. Tlle site is approximately 1.18 acre in size and relatively flat in topography. The subject
property is improved with two buildings in the north end of the site, which are respectively used
for an expresso retail service and a 2-car garage.
13. Effective January 1, 1991, the zoning of the site was reclassified from the Agricultural
zone of the now expired County Zoning Ordinance to the Community Business (B-2) zone, under
tlie Program to Implement the Spokane County Zoning Code. The site is also located in the
Aquifer Sensitive Overlay zone and the Public Transit Benefit Area designated by the Zoning
Code.
14. A"counter complete" application for the proposed rezone and fees were submitted on
November 20, 2001. The site plan of record for the proposal submitted on November 20, 2001
illustrates the existing improvements on the site and that the existing garage on the site would be
moved or torn down.
15. The application is subject to the land use processing requirements in County Resolution
No. 1-0700. Such resolution provides that absent statute or ordinance to the contrary, the
regulations in effect on the date a complete application is submitted and fees are paid will be the
standard of review.
16. Effective January 15, 2002, the County implemented a new Comprehensive Plan ("GMA
Comprehensive Plan"), Urban Growth Area (UGA) boundaries and a Capital Facilities Plan, and
Phase I Development Regulations ("Phase I regulations"); all in implementation of the State
Growth Management Act. The County also repealed the interim development regulations and
interim urban growth area (NGA) boundaries previously adopted by the County under the State
Growth Management Act. See County Resolution No. 2-0037.

17. The site and surrounding land are designated in the County's UGA boundaries. Prior to
January 15, 2002, the site and such surrounding land were designated inside the County's ILJGA
boundaries.
18. The Phase I Development Regulations allow rezone applications that were complete before
the adoption of such regulations on January 15, 2002, pertain to land located within the UGA and
are "inconsistent" with the GMA Comprehensive Plan to be processed under the comprehensive
plan and land use regulations in effect when the application became complete. If the rezone
application is approved, the new zoning is effective for a period of one (1) year, and development
of t11e property may proceed under the conditions of the rezone provided a building permit is
submitted within the 1-year period. After the 1-year period, the zoning of the property would
"cross over" to the zone designated in the crossover matrix of the Phase I regulations. If a
building permit is applied for during the 1-year period, the conditions of the prior rezone
continue to apply; provided, if there is a conflict between the conditions and the development
standards of the crossover zone, the more restrictive standard applies.
19. The GMA Comprehensive Plan designates the site, and the land lying north, west, east and
southwest of the site in the Community Center category. The land lying south and southeast of
the site is designated in the Low Density Residential category. Under the Phase I Development
Regulations, the "crossover zone" for land designated in the Community Center category is the
existing zoning of the land.
20. Since the crossover zone (B-2) for the site under the Phase I regulations is different than the
zone (B-3) requested by the applicant, development of the site under the B-3 zone would be
subject to the development standards of the B-3 zone and the conditions of approval imposed by
the Hearing Examiner, as long as a building permit is submitted within one (1) year. After the 1-
year period expires, whether or not a building pernut is timely applied for, the zoning of the site
would "crossover" to the UR-3.5 zone. If a building permit is applied for within the 1-year
period, any conditions of approval imposed under the current rezone to the B-3 zone would
continue to apply to the site upon its crossover to the B-3 zone. See Resolution No. 2-0037,
Phase I regulations.
21. If the current rezone is approved and a building permit is not applied for within the 1-year
period referenced above, the zoning of the site would revert to the B-2 zone and the conditions of
approval of the current rezone would not apply to the subject property. See letter dated March 7,
2002 from Richard Taylor to Jim Falk.
22. The Phase I Development Regulations require any rezone applications submitted under the
GMA Comprehensive Plan and Phase 1 regulations to be consistent with the GMA
Comprehensive Plan category for the property, and with the implementing zone set forth in the
Phase I regulations for such category. The implementing zones for the Community Center
category of the GMA Comprehensive Plan are the UR-22, B-1 and B-2 zones.
23. The land lying north, west and east of the site along Sprague Avenue is zoned B-3 and is
mostly developed with intensive commercial uses. The parcel lying directly west of the site

consists of a vacant retail building, while the parcel lying directly east of the site consists of a
single-story multi-family dwelling. The land lying south and southwest of the site is zoned UR-
22 and is developed with a large apartment complex.
24. The Examiner must consider the cunent rezone application under the comprehensive plan
and development regulations in effect on November 20, 2001, the date when the application was
submitted as complete. This includes the former Comprelaensive Plan ("Comprehensive Plan"),
County Zoning Code, County Road Standards, interim development regulations for land located
inside the County's ICJGA boundaries, and other development regulations in effect on such date.
25. The County Arterial Road Plan in the Comprehensive Plan designates Sprague Avenue and
Sullivan Road in the area as Principal Arterials.
26. Sprague Avenue and Sullivan Roads comprise major traffic and commercial corridors
through the Valley area of Spokane County. The County recently improved Sprague Avenue to a
5-lane arterial section, and installed public sewer in such road, in the vicinity. The Hearing
Exami.ner approved various rezones from the B-2 zone to the B-3 zone along Sprague Avenue,
east of Sullivan Road, over the last six (6) years.
27. The project will be served by a high level of urban services and facilities; including public
sewer and water, and modern utilities.
28. The site is designated in the Major Commercial category of the Comprehensive Plan. The
Staff Report sets forth relevant policies of such category and the Comprehensive Plan, analyzed
the consistency of the proposal with such policies and found the proposal to be consistent with
such policies. The Examiner agxees with such analysis, and adopts and incorporates the same
herein as findings of fact.
29. No opposition was expressed toward the proposal or the Determination of Nonsignificance
(DNS) issued for the proposal by neighboring property owners or public agencies. The proposal,
as conditioned, will not have more than a moderate effect on the quality of the environment, and
the Examiner concurs with issuance of the DNS.
30. The proposal has been conditioned for development in accordance with the requirements of
the B-3 zone and other applicable Zoni.ng Code regulations.
31. Changed conditions have occurred since the zoning of the site was reclassified to the
B-2 zone on January 1, 1991, pursuant to the Program to Implement the Spokane County Zoning
Code. This includes the availability of public sewer in the area, recent road improvements to
Sprague Avenue, recent rezones from the B-2 zone to the B-3 zone along Sprague in the area,
increased commercial development along Sprague Avenue in the area, and increased traffic in the
area.
Based on the above findings of fact, the Hearing Examiner enters the following:

II. CONCLUSIONS OF LAW
1. The proposed rezone, as conditioned, generally conforms to the Comprehensive Plan.
2. The proposed rezone, as conditioned, bears a substantial relationship, and will not be
detrimental, to the public health, safety or welfare.
3. A change in economic, technological, or land use conditions has occurred to warrant the
proposed rezone, as modified and conditioned. A substantial change of circumstances has
occurred in the area since the site was last zoned.
4. The procedural requirements of the State Environmental Policy Act and the County's Local
Environmental Ordinance have been met. The proposal, as conditioned and modified, will not
have a significant, probable adverse impact on the environment.
5. The proposed rezone, as modified and conditioned, meets the criteria established by
Washington case law for approving a rezone, and the criteria established in paragraphs
14.402.020 (1)(2) of the County Zoning Code for amending the County official zoning map.
6. Approval of the land use application is appropriate under section 11 of the County Hearing
Examiner Ordinance, adopted by County Resolution No. 96-0171.
III. DECISION
Based on the above Findings of Fact and Conclusions of Law, the application for a rezone
to the Regional Business (B-3) zone is hereby approved, subject to the conditions of approval of
the public agencies stated below.
Any conditions of such agencies that have been added or significantly revised by the
Hearing Examiner are italicized.
Failure to comply with the conditions of this approval may result in revocation of this
approval by the Hearing Examiner. This approval does not waive the applicant's obligation to
comply with all other requirements of other agencies with jurisdiction.
SPOKANE COUNTY DIVISION OF PLANNING
1. All conditions imposed by the Hearing Examiner shall be binding on the "Applicant,"
which term shall include the owners and developers of the property, and their heirs, assigns and
successors.
2. The zone change applies to the real property currently referenced as County Assessor's
parcel #45242.0211, as legally described in File No. ZE-22-01.

3. The proposal shall comply with the Community Business (B-2) zone, the Aquifer Sensitive
Area (ASA) Overlay zone, the Phase I Development Regulations, and other applicable provisions
of the Spokane County Zoning Code, as amended.
4. A detailed site plan shall be submitted prior to issuance of any buzlding permit on the site.
Pursuant to Section I of the Phase I Development Regulations adopted on January 15, 2002,
(County Resolution No. 2-0037), any building perrrcit shall be applied for within one (1) year of
the date of this decision to allow development of the site under the B-3 zone.
5. Approval is required from the Director of the Division of Planning/designee of a specific
signing plan for the described property prior to the release of any building permit.
6. Exterior lighting shall comply with Section 14.810.180 of the County Zoning Code.
Approval is required by the Division of Planning Director/designee of a specific site illumination
plan for the subject property, prior to the release of any building permits for site improvements.
Direct light from any exterior axea lighting fixture shall not extend over the property boundary.
7. Prior to release of any building permits, a specific landscape plan, planting schedule and
provisions for the maintenance acceptable to the Director of the Division of Planning/designee
shall be submitted. Landscaping shall be installed consistent with the requirements of Section
14.804.040 of the County Zoning Code.
8. The Division of Planning shall prepare and record with the Spokane County Auditor a Title
Notice, noting that the property in question is subject to a variety of special conditions imposed
as a result of approval of a land use action. This Title Notice shall serve as public notice of the
conditions of approval affecting the property in question. The Title Notice should be recorded
within the same time frame as allowed for an appeal and shall only be released, in full or in part,
by the Division of Planning. The Title Notice shall generally provide as follows:
"The parcel of property legally described as [insert legal description] is the subject of a
land use decision by the Spokane County Hearing Examiner on September 16, 2002, approving a
zone reclassification and imposing a variety of special development conditions. File No. ZE-22-
01 is available for inspection and copying in the Spokane County Division of Planning."
SPOKANE COUNTY BUILDING AND CODE ENFORCEMENT
1. The applicant should contact the Division of Building and Code Enforcement at the earliest
possible stage in order to be informed of code requirements administered/enforced as authorized
by the state Building Code Act. Design/development concerns include addressing, fire apparatus
access roads, fire hydrant flow, approved water systems, building accessibility, construction type,
occupancy classification, existing exterior wall protection and energy code requirements.

SPOKANE DIVISION OF ENGINEERING AND ROADS
Prior to the issuance of a building permit, or at the request of the County Engineer in
conjunction with a County Road Project/Road Improvement District, whichever comes
first:
1. The applicant shall dedicate 20 feet of land adjacent to the vacated Chicago, Milwaukee, St.
Paul & Pacific Railway Company railroad right of way to Spokane County for right of way
purposes.
Prior to release of a building permit or use of the property as proposed:
2. Access permits for approaches to the County Road System shall be obtained from the
County Engineer.
3. A Professional Engineer (P.E.), licensed in the State of Washington, shall submit road and
stonn drainage construction plans and a drainage report that conform to the versions of the
Spokane County Standards for Road and Sewer Construction, the Guidelines for Stormwater
Management, and all applicable federal, state, and local regulations and laws that are in effect at
the time of the plan submittal or at the time of the development permit application(s). The final
road and storm drainage plans and drainage report shall receive the County Engineer's acceptance
prior to release of any Grading, Building, or Right-of-Way Permit.
4. A parking plan and traffic circulation plan shall be submitted and approved by the Spokane
County Engineer. The design, location and arrangement of parking stalls shall be in accordance
with standard engineering practices. Paving or surfacing as approved by the County Engineer
will be requixed for any portion of the project which is to be occupied or traveled by vehicles.
5. No roadway improvements are required for Sprague Avenue, as County Road Project 2676
built the required road section along the frontage of the site.
6. Access to the vacated Chicago, Milwaukee, St. Paul & Pacific Railway Company railroad
right of way is prohibited until such time as previously authorized by the Spokane County
Engineer.
7. Roadway standards, typical roadway sections and drainage plan requirements are found in
Spokane County Resolution No. 1-0298 as amended and are applicable to this proposal.
8. No construction work is to be perfonned within the existing or proposed right of way until
a permit has been issued by the County Engineer. All work within the public road right of way is
subject to inspection and approval by the County Engineer.
9. The applicant is advised that there may exist utilities either underground or overhead
affecting the applicant's property, includa.ng property to be dedicated or set aside future
acquisition. Spokane County will assume no financial obligation for adjustments or relocation
regarding these utilities. The applicant should contact the applicable utilities regarding
responsibility for adjustment or relocation costs and to make arrangements for any necessary
work.

10. The applicant shall grant applicable border easements adjacent to Spokane County Right of
Way per Spokane County Standards.
11. The proposed zone change was not submitted wit,h a specific site plan or development
proposal. At such time as a site plan is submitted for review, the applicant shall submit detailed
traffic information for review by the County Engineer to detennine what traffic impacts, if any,
that the development would have on surrounding infrastructure. The applicant is advised that
mitigation maybe required for off-site improvements.
SPOKANE COUNTY DIVISION OF UTILITIES
1. Uses on properties within the site shall be required to connect to public sewer and pay
applicable charges according to the County Sewer Ordinance.
2. A sewer connection permit is required. Commercial developments shall submit historical
and/or estimated water usage prior to the issuance of the connection permit in order to establish
sewer fees.
3. The applicant shall submit expressly to Spokane County Division of Utilities "under
separate cover", only those plan sheets showing sewer plans and specifications for the public
sewer connections and facilities for review and approval. Commercial developments shall
submit historical and/or estimated water usage as part of the sewer plan submittal.
4. Sewer plans acceptable to the Division of Utilities shall be submitted prior to the issuance
of the sewer connection permit.
5. Arrangements for payment of applicable sewer charges must be made prior to issuance of a
sewer connection permit. Sewer charges may include special connection charges and general
facilities charges. Charges may be substantial depending on the nature of the development.
6. Any water service for this project shall be provided in accordance with the Coordinated
Water System Plan for Spokane County, as amended.
SPOKANE REGIONAL HEALTH DISTRICT
1. The sewage disposal method shall be as authorized by the Director of Utilities, Spokane
County.
2. Water service shall be coordinated through the Director of Utilities, Spokane County.
3. Water service shall be by an existing public water supply when approved by the Regional
Engineer (Spokane), State Department of Health.

4. A public sewer system will be made available for the project and individual service will be
provided to each tract prior to sale. The use of individual on-site sewage disposal systems shall
not be authorized.
5. The use of private wells and water systems is prohibited.
SPOKANE COUNTY AIR POLLUTION CONTROL AUTHORITY
1. All applicable air pollution control regulations shall be met. See memo dated January 7,
2002 from SCAPCA to the Division of Planning in Planning File No. ZE-22-01.

Pursuant to Spokane County Resolution Nos. 96-0171 and 96-0632, as modified by County
Resolution No. 1-0700, the decision of the Hearing Examiner on an application for a zone
reclassification is final and conclusive unless within fourteen (14) calendar days from the
Examiner's written decision, a party of record aggrieved by such decision files an appeal with the
Board of County Commissioners of Spokane County, Washington.
This decision was mailed by certified mail to the Applicant, and by regular mail to other
parties of record, on September 16, 2002. THE APPEAL CLOSING DATE IS SEPTEMBER
30, 2002.

The Diviaion of Planning received one (1) response from the public suppotting the proposal.
Description of the Site and Surrounding Area:
The site is approximately 1.18 acres in aize and fronts on the south side of Sprague Avenue, a
four lane arterial. The site is generally flat and has two existing buildings consisdng of an
expresso retail service and a 2 car garage. Sprague Avenue is identiffed as a Principal Arterial
within the Spokane County Arterial Road Plan and typical strip commercial development can be
found along the Sprague Avenue corridor in the vicinity of the proposal. Surrounding uses
include a vacant business building, a tire service outlet, finro auto body repair shops, a self service
storage facil'rty, an auto parts store, a manufactured home sales tot and a large mulafamily
dwelling complex.
ProJect DescriQtion:
The applicant has requested a zone reclassification frorn Community Business (8-2) to Regional
Business (B-3) for those uses allowed in the Regional Business (&3) zone. The appiicatlon for
the zone ireclassification was submitted to the Division of Planning on November 20, 2001. There
is no proposed development or specific site pfan at this time. The cument use of the proper#y is
commetcial, as there is an expresso retait service facility on the site. The subject property was
previously zoned Agricuttural (A) and crossed over to Community Business (B-2) on January 11991 , with implemerrtaton of the Spokane County toning Code.
Staff Anafysis:
Comprehens9ve Plan:
The subject property is designated as Major Commercial and the Major Commeraal category is
intended to provide the opportunity for developmerrt of commercial uses, speciflcalfy oommunity
and negional shopping oenters and commercial uses, directly related to major throughways. The
Major Commerdal category will be composed of three diffenent types of commercial developmerrt:
shopping c;enters, highway and artedal commercial strips, and freeway oommercial. Highway
and arterial commercial strip areas wi11 usually be made up of businesses on individual parcels
clustered along a heavily traveled street or highway. Mast commercial devefopment will occur on
generalty flat land and parking areas, streets and buildings will dominate the sfte. Paved parking,
streets and man-made structures will dominate the ske with few natural featunes to be found.
Landscaping, screening, lighOng, signage and other architeCtural treatment will provide for
aesthetically pleasing developmern. All commercial projects tocating on dhe subject property will
comply with lendscaping, screening, lighting, off street parking and signage requirements of the
Spokane County Zoning Code.
Major commercial areas require a fult line of public servioes and utilities including sanitary and
storm sewers, pubfic water systems. Underground ublfties such as telephone, gas, electricity are
also common in commercial areas. These services are available to the project site except storm
sewers. Surtace drainage will be ar.commodated on-site due to the applic•atlon of surfaoe
drainage requirements set forth in the Spokane County Stormwater Management Guidelirtes.
Comprehensive Plan Goal 6.1 promotes development of commerc.ial land in a manner which is
complimentary and compatible with adjacent land uses and the surrounding ernironment.
4bjective 6.1.a. states that Commercial developrnents should be buffered to protect adjacent
areas. Decision Guideline 6.1.1.c states that the best means of encouraging compatibility
between commercial uses and adjaoent land-use categodes will be acxomplished by considering
provision of landscaping. Objectives 6.1.c states that developers should be required to provtde
sufficient land for off-street parking at commercial sites. Decision Guideline 6.1.6 states that
before approving proposed commercial developments, it should be determined that the proposal

has adequate on-site areas for existing and potentiai parking and storm drainage controfs. The ~
adjoining areas along Sprague Avenue are dominated by commercial uses and the proposed
Reglonal Business (8-3) zone would implement the Major Commercial category and be
compatible with edjacent land uses. Approval of this application with the recommended
conditions will assure that development of the subject site wiil provide for landscaping and
screening, non-giaro iilumination, off-street parking and orrsite stormwater drainage. Provision
for required landscaping, parking, illuminaflon and drainage as required by the Spokane County
Zoning Code will assure the development is compatible with adjacent {and uses.
Section 6(Major Commercial Section) last paragraph of the "Characteristic Features" on Page 89
of the Comprehensive Plan encourages aesthetic and architectural treatment of new development
which eliminate$ or is generally not characterized by signage clutter, provides maintained
landscaping, scneens exterior storage, provides sufficient setbacks and screens parking areas,
should foster improved land use compatibility with adjacent non-commeraal uses and should
support existing and atb~act new viable commercial development. Oecision Guideline 6.1.3
encourages provisiort for aesthetic quality of physical development and land use along rights-of-
way for Arterials, State Highways and Freeways within the Urban Impact Area (UTA) of Spokane
Courrty. These major thoroughfares are encouraged to have an aesthetically pleasing view as
seen by the traveling public and adjacent property owners when they are developed with
cflmmercial uses. This decision guideline suggests that r+egulafion of landscaping, signage,
storage and architectural treatrnent of commeraal development locating along these rights-of-way
is appropriate. Such regulagons exist in the Spokane County Zoning Code except that said code
does not regulate building architecture.
Decision Guidelines 6.1.4, 6.1.5, and 6.1.6 recomrmend that commercial developments have
access to rnajor arterial systems, conform to plans for public water and sewer systems, and be
reviewed for impacts to the area transportation systems. The proposal is located adjacent to
Sprague Avenue which is designated as a Principal Arterial by the Spokane County Arterial Road
Plan. The project site is currently served by public water and sewer. The Division of Engineering
and Roads has submitted r+ecommended condftions of approval to mitigate any impacts that the
proposed development may have on the adjacent transportation system. Water and sewer
purveyors must approve project utility plans prior to issuanoe of a Certificate of Oc.cupancy for any
development locating on the subject site.
Water Quality Goal 10.1 states that no further degradation of the Spokane Valley-Rathdrum
Prairie Aquifer (as defined in the Spokane Aquifer Water Quality Management Plan). Objective
10.1.d states that fill-in development and development with densities which support existing or
proposed sewer systems will be preferred. Objective 10.1.n encourages that development
minimize the amount of pollution caused by stormwater runoff. Decision Guideline 10.1.n states
that where increased stomnwater runoff potential exists due to a proposed developrrient, runoff
managemerrt procedures should be a condition of approval. The recommended conditions of
approval require complianoe to Spokane County Stormwater Management Guidelines. Pollution
of groundwater will be minimized as the project is served by the Spokane County sanitary sewage
collecbon system. Additionally, pollution of the groundwater will be minimized sinoe all
development of the subject site will comply with the Aquifer Sensitive Overlay Zone Requirements
of the Spokane County Zoning Code.
The project is substantially consistent with the policies of the Major Commercial category. The
project site is located in the Interim Urban Growth Area (IUGA) as set forth in County Growth
Management Resolution 97-0321 and the subject application is consistent with the requirements
of said resolution.

The purpose of the proposed Regional Business (B-3) zone is to provide for the locaton of a wide
range of r+etail and service activfties and to implement the Major Commercial category of the
Comprehensive Pian. Major commercial uses often dirauv customers from the County at large and
other outlying areas rather than a more limited population. It is also the intent of the Regiond
Business (B-3) zone to irmplement Comprehensive Pian policies that encourage commercial
development along Principai Arteria{s or highways and establish regional seroing commeraal
areae. General characteristics of these commercial areas will include paved roads and sidewalks,
public sewer and water, and a full line of public services. The subject slte is located adjacent to a
Principal Arterial and will be served by public sewer and water, solid waste disposal, power and
telephone, public transit service, police and fire protec#ion services. Existing =oning tn the area of
the site consists of a mix of Regional Business (8-3), Community Business (13-2), Urban
Reaidential-22 (UR-22), and Light Industrial (I-2) Zones. The subject site is bounded on three
sides by an existing Regional 6usiness (B-3) Zone and ihe B-3 Zone is the predominate zoning
found north and south along Sprague Avenue in the vicinity of the subject site. The proposed
zone reclassification from Community Business (B-2) to Regionai Businese (B-3) is consistent
with the purpose and intent of the Regional Business (B-3) zone.
Site Plan:
The applicant is not proposing any development at this time and will likely develop or market the
property fvr those uses allowed in the Regional Business (B-3) zone. The site pian submitted
neflects what currently exists on the subject property. Site development wiil be required to
comply with all applicable Spokane County development regulations to indude but not be limited
to Spokane County Zoning Code, Environmental Or+dinance, the Spokane County Standards for
Road Construcdon, the Spokane County Guidelines for Stormwater Management and
Sedimentation Control, the Spokane Regional Heatth District Sewage Disposal and Water Suppty
fegulaflons, the Uniform Building Code and Uniform Fire Code and including compliance with
rezone conditions of approval. More specrticatly, Zoning Code regulations applFcable to site
devetopmertt including but not limited to signage, landscaping and screening, off street parking
and on-site iilumination. These and other appticable Spokane County and Washington State
development regula~tions will be used for project impact mitigation as needed.

2. Findings:
a) This project lies over the Spokanne-Rathdrum.
b) The project is within Critical Water Supply Service Area #3 and within the service area of
Consolidated Irrigation District. Water supply will be a public system.
c} The project is inside the Spokane Couaty Comprehensive Wastewater Maaagement Area, inside the
General Sewer Service Area, and inside the Priority Sevver Service Area recommended in the '201'
Study. The method of sewage disposal is subject to approval of the Director of Utilities, Spokane
County, pursuant to County Resolution 80.0418 adopted March 24, 1980. The topography and soils in
the area are generally suitable for use of individual on-site sewage disposal systems. The lot is not of
the proper dimensions to permit the use of both an individual well and sewage system.
d) The project lies in a relatively flat area east of Sullivan Road and south of Sprague Avenue. Local
draina$eways are insignificant

e) Surface soils ere ciassei by the U.S. Soil Conservation Service as Gazrison gravelly loam with 0% to
5% slopes. They have a septic tank filter field limitation of slight. There is also possible contamination
of groundwater. This soil would be classified as a Type N.
fl Geologically, the soils are glaciofluvial deposits. These geologiGal structures generaUy yield moderate
to very large amouats of water. Data from wells in the area referenced in section 1 g shows they are
from 81' to 240' deep and have static water levels varying from 55' to 115' below the surfface. The
Consolidated Irrigation District has indicated that it can supply domestic use water for the project
upon completion of agreements with the proponent.

a) Sewage disposal method shall be as authorized by the Director of Utilities, Spokane Couuty.
b) Water service shall be coordi.nated through the Director of Utilities, Spokane County.

4. A parking pian and trafflc circulation plan shall be submitted and approved by the Spokane
County Engineer. The design, locagon and aRangement of parking stalls shall be in
accordance with standand engineedng practices. Paving or surfacing as approved by the County
Engineer will be required for any portion of the project which is to be occupied or traveled by
vehicies.
5. No roadway improvements are required for Sprague Avenue because County Road Project
2676 built the required road section along the frontage of this parcel.
6. Access to the Oid Chicago, Miiwaukee, St. Paul & Pacific Railway Company's Raiiroad right of
way shall be prohibited until such time as specifically authodzed by the Spokane County
Engineer.
7. Roadway standards, typical roadway sections and drainage pian requirements are found in
Spokane Boani of County Commissioners resolution 1-0298 as amended and are applicable to
this proposal.
8. No construction work is to be performed within the existing or proposed right of way until a
permft has been issued by the County Engirteer. All work within the public road right of way is
subject to inspection and approval by the County Engineer.

the applicant's property, including property to be dedicated or set aside future acquisibon.
Spokane County will assume no financial obligation for adjustments or relocation reganding

County Engineer. The design, location and arrangement of parking stalis shall be in
accordance with standard engineering practices. Paving or surfacing as approved by the County
Engineer will be required for any portion of the project which is to be occupied or traveled by
vehiclss.

l. Reimburse Spokane County for project review and inspection fees as specified in Chapter 9.14 ot'
ihe Spokane County Code. The fees will be based on actual salary costs incurred bv Spokane
County for project reviews and / or inspections plus a ten percent administrative charge, and will
be billed monthly as accrued. Any billing amounts due, including any expenses incurred in [lie
collection of an overdue account, rnust be paid prior to [he County's acceptance of the project for
tiling. If a project is approved and/or filed with a balance still owing, the unpaid halance shall he
paid within 30 days of the invoice date.
2. The undersigned agrees that these fees are due and payable upon receipt of the hiiling as specitieii

Dear N'Ir. Taylor:
On February 20, 2002, I held a public hearing on the above proposal. At the end of
hearing, I stated that I would approve the proposed rezone, subject to the restrictions of
the Phase I Development Regulations adopted by the County on January 15, 2002. Such
regulations would require that any application for a building permit under the new B-3
zone on the property be applied for within one (1) year after the date of my written
decision. After the one (1)-year period, the zoning of the site would revert back to the B-
2 zone. If you do not develop the property, the conditions of approval for the current
rezone would not remain binding on the property when it reverts back to the B-2 zone
after one (1) year.
After the hearing, you requested a 60-day extension to give you time to decide on
whether yau still wanted the rezone approved, and because you were leavi.ng the area for
a few months. More than 60 days have elapsed, and I have heard nothing from you.
I cannot wait any longer before issuing a decision. If I do not hear from you by June 13,
2002, I will enter a final written decision approving the rezone to the B-3 zone.
