FINDINGS OF FACT AND CONCLUSIONS The Hearing Examiner has reviewed the zone reclassification application and the evidence of record and adopts the following findings of fact and conclusions: A. GENERAL INFORMATION: Applicant: Floyd L. Wakefield Surveyor: Simpson Engineers North 23314 Wagon Road North 909 Argonne Road Colbert, WA 99005 Spokane, WA 99212 Address: East 16712 Sprague Avenue Location: Generaliy located south of and adjacent to Sprague Avenue, approximately 300 feet west of Steen Road in the NE '/a of Section 242 Township 25 North, Range 44 EWM, Spokane County, Washington. Legal DescriPtion: The north 230 feet of the west '/z of the NW '/a of the NE of the NE 1/4 I of Section 24, Township 25 North, Range 44 EWM, EXCEPT the west one acre, and EXCEPT the north 30 feet. Zoning: Neighborhood Business (B-1) Comprehensive Ptan Category: The property is designated in the Major Commercial category of the Spokane County Generalized Comprehensive Plan, and is also within the Priority Sewer Service Area (PSSA). HE Findings, Conclusions and Decision ZE-11-96 Page 1 ~ Environmental Review: A Deternunation of NonSignificance was issued by the Division of Building and Planning on April 1, 1996. Site Description: The site is approximately 53,600 square feet in size, level and has 268 feet of frontage on Sprague Avenue. The site is currently improved with a 7,000 square foot building, used as a U-Haul dealership and office. Surrounding Conditions: Directly south of the site is another parcel owned by the applicant, used for mini-storage and zoned Light Industrial(I-2). The neighborhood is characterized by commercial and retail establishments along both sides of Sprague Avenue. Sprague Avenue is designated as a Principal Arterial and is a major commercial and traffic corridor in the Spokane Valley area of the county. Project Description: The applicant seeks a zone change from Neighborhood Business (B-1) to Regional Business (B-3) to allow the current use of the site and to turn the existing office building into a caretaker's residence, which is allowed as an accessory use in ihe Regional Business (B-3) zone to other uses allowed in such zone. The applicant intends to use the caretaker's residence in conjunction with the U-Haul dealership and the mini-storage facility on the adjacent parcel to the south. B. ZONE RECLASSIFICATION ANALYSIS: To be approved, the zone reclassification application must comply with the requirements of Washington case law and statute for the approval of rezones, and Spokane County Zoning Section 14.402.020 (1)(2). The following findings of fact and conclusions are made: 1. The proposed zone reclassification itenerallv conforms with the Spokane Countv Generalized Comprehensive Plan. The proposal is designated within the Major Commercial category of the Comprehensive Plan. The proposal generally conforms with the goals, objectives and decision guidelines of the Major Commercial category, as outlined in the County Division of Building and Planning staff report. The Regional Business (B-3) zone specifically implements the Major Commercial category. 2. Conditions in the area in which the propertv is located have chan.Red substantiallv since the nronertv was last zoned The current use of the property for a U-Haul dealership and office is more of a regional business use than a local business use under the County Zoning Code. Changes in the area are apparent from visiting the site and observing the development of the area during the 1990s. Sprague Avenue between Sullivan Road and the intersection of Sprague Avenue and Appleway is undergoing intensified commercial activity. This is occurring as Sprague Avenue west of Sullivan Road and Sullivan Road north of Sprague Avenue become saturated with commercial development. Considerable population growth east of Sullivan Road and in the Greenacres area have steadily increased the demand for commercial services along Sprague Avenue east of Sullivan Road. Public sewer has been extended to the area. 3. The nroposed rezone bears a substantial relation and is not detrimental to the public health, safetv and aeneral welfare. The proposal, as conditioned, is in general conformance with the Comprehensive Plan. There was no opposition expressed toward the rezone of the site by adjacent owners, residents of the area or public agencies. The proposal, as conditioned, is compatible with the surrounding area. Adequate infrastructure exists to support the development. County staff recommended approval of the rezone. The proposal provides services to the community. 4 The nroposed zone chanee complies with the provisions of the State Environmental Policv Act and the Countv's Local Environmental Ordinance No significant, probable, adverse environmental impacts were identified during the environmental review process or at the hearing of the proposal. The procedural requirements of Chapter 43.21 C RCW and Chapter 11.10 of the County Code have been met. No basis exists to alter or modify the Determination of Nonsignificance issued by the Division of Building and Planning. HE Findings, Conclusions and Decision ZE-11-96 Page 3 5. The nroaosal, as conditioned, complies with the Rep-ional Business (B-3) zone, the Snokane Countv Zoninp- Code, and applicable land use reQulations. - "Mini-storage", a term used by the applicant and County staff to describe storage operations on the applicant's property lying immediately south of the site, is not a designated use in the Zoning Code. However, it appears similar to "self-service storage", which is defined in the Zoning Code. Self-service storage is a permitted use in both the Regional Business (B-3) and the Light Industrial (I-2) zone, while "general-indoors storage" and "general-outdoors storage" are permitted uses only in the Light Industrial (I-2) zone. As long as the caretaker's residence on the site is used as an accessory use to self-service storage, or to other uses permitted in the Regional Business (B-3) zone, it will not violate the Zoning Code. It is also noted that under the Zoning Code, a caretaker's residence must be owned by the owner of the site and occupied by a bona fide employee of the property owner Further, the caretaker's residence is "...limited to the duration of need associated with the custodial, maintenance or overseeing of the owner's property, building and/or use". Zoning Code Section 14.628.220 (1). Some additional language has been added to County Division of Building and Planning Condition No. 9 to more positively state these limitations on the use of the caretaker's residence. As conditioned, the proposal is in compliance with the Zoning Code and other applicable development regulations of Spokane County and other public agencies with jurisdiction over land development. M. DECISION Based on the Findings and Conclusion above, the above rezone application is approved, subject to the following conditions. 1. Compliance with the conditions of the various public agencies specified below. 2. Failure to comply with the conditions of this approval may result in revocation of this approval by the Hearing Examiner. 3. This approval does not waive the applicant's obligation to comply with all other requirements of other agencies with jurisdiction over land development. SPOKANE COUNTY DIVISION OF BUILDING AND PLANNING 1. The proposal shall comply with the Regional Business (B-3) zone, as amended. 2 The applicant shall develop the subject property generally in accordance within the concept presented to the Hearing Examiner. Variations, when approved by the Division of Building and Planning Director/designee, may be permitted, including, but not limited to building location, landscape plans and general allowable uses of the permitted zone, provided they are consistent with the above decision of the Hearing Examiner. All variations must conform to regulations set forth in the Spokane County Zoning Code, and the original intent of the development plans shall be maintained. Approval is required by the Division of Building and Planning Director/designee of a specific lighting and signing plan for the described _property prior to.the release of any building permits. 4. Direct light from any exterior area lighting fixtures shall not extend over the property boundary. 5. A specific landscape plan, planting schedule and provisions for maintenance acceptable to the Division Director/designee shall be submitted with a performance bond for the project prior to release of building permits. Landscaping shall be installed and maintained so that sight distance at access points is not obscured or impaired. 6 The Division of Building and Planning shall prepare and record with the Spokane County Auditor a Title Notice noting that the property in question is subject to a variety of special conditions imposed as a result of approval of a land use action. This Title Notice shall serve as public notice of the conditions of approval affecting the property in question. The Title Notice should be recorded within the same time frame as allowed for an appeal and shall only be released, in full or in part, by the Division of Building and Planning. The Title Notice shall generally provide as follows: The parcel of property legally described as [ ] is the subject of a land use action by a Spokane County Hearing Body on',[ imposing a variety of special development conditions. File No. [ ] is available for inspection and copying in the Spokane County Division of Building and Planning 7. The Spokane County Division of Building and Planning shall prepare and record with the County Auditor a Title Notice specifying a future land acquisitions area for road right of way and utilities. The reserved future acquisition area Title Notice shall be released, in full or in part, by the Division of Building and Planning. The notice should be recorded within the same time frame as an appeal and shall provide the following: a. At least 15 feet of reserved future acquisition area for road right of way and utilities, in addition to the existing and/or newly dedicated right of way along Sprague Avenue. NOTE: The County Engineer has required 15 feet of new dedication b. Future building and other setbacks required by the Spokane County Zoning Code shall be measured from the reserved future acquisition area. c. No required landscaping, parking, `208' areas, drainfield or allowed signs should be located within the future acquisition area for road right of way and utilities. If any of the above improvements are made within this area, they shall be relocated at the applicant's expense when roadway improvements are made. d The future acquisition area, until acquired, shall be private property and may be used as allowed in the zone, except that any improvements (such as landscaping, parking, surface drainage, drainfield, signs or others) shall be considered interim uses. The property owner shall be responsible for relocating such "interim" improvements at the time Spokane County makes roadway improvements after acquiring said Future Acquisition Area 8. Use of the caretaker's residence is limited to the duration of need associated with the custodial, maintenance or overseeing of the owner's property, building and use and must be appurtenant to a use allowed in the Regional Business (B-3) zone. When the caretaker's residence ceases to be owned by the owner of the property it resides upon or the caretaker's residence ceases to be occupied by a bona fide employee of the property owner of the related business, such property owner shall obtain a building permit in order to convert the caretaker's residence to non-residential use (such as office or storage uses permitted in the Regional Business (B-3) zone) The caretaker's residence shall not be used as a residential rental property. 9. Future division of the subject property will require compliance with Spokane County Subdivision, Short Plat or Binding Site Plan Ordinance. 10. The applicant shall contact the Division of Building and Planning at the earliest possible stage in order to be informed of code requirements administered/enforced as authorized by the State Building Code Act Design/development concerns include: Addressing, fire apparatus access roads, fire hydrant/flow, approved water systems, building accessibility, construction type, occupancy classification, exiting, exterior wall protection, and energy code regulations (Note: The Division of Building and Planning reserves the right to confirm the actual address at the time of building permit). SPOKANE COUNTY DIVISION OF ENGINEERING Prior to issuance of a building permit or at the request of the County Engineer in conjunction with a County Road Project/Road Improvement District, whichever comes first: 1 Applicant shall dedicate 15 feet on Sprague Avenue for right of way. Prior to release of a building permit or use of the property as proposed: 2 Access permits for approaches to the County Road System shall be obtained from the County Engineer. 3 Applicant shall submit for approval by the Spokane County Engineer drainage and access plans 4. The applicant shall submit for approval by the Spokane County Engineer and the Spokane County Health District a detailed combined on-site sewage system plan and surface water disposal plan for the entire project or portion thereof if the development is phased. 5. _ A parking plan and traffic circulation plan shall be submitted and approved by the Spokane County Engineer. The design, location and arrangement of parking stalls shall be in accordance HE Findings, Conclusions and Decision ZE-11-96 Page 6 r with standard engineering practices. Paving or surfacing as approved by the County Engineer will be required for any portion of the project which is_to be occupied or traveled by vehicles.- 6. To construct the roadway improvements stated herein, the applicant may, with the - approval of the County Engineer, join in and be willing to participate in any petition or resolution which purpose is the formation of a Road Improvement District (RID) for said improvement pursuant to RCW 36.88, as amended. Spokane County will not participate in the cost of these improvements This provision is applicable to Sprague Avenue. 7. As an alternative method of constructing the road improvements stated herein, the applicant may, with the approval of the County Engineer, accomplish the road improvements stated herein by joining and participating in a County Road Project (CRP) to the extent to the required improvement. Spokane County will not participate in the cost of these improvements. This provision is applicable to Sprague Avenue. 8. The County Engineer has designated a Special Roadway Section for the improvement of Sprague Avenue which is adjacent to the proposed development. This will require the addition of varying amounts of asphalt along the frontage of the development Curbing and sidewalk must also be constructed 9. The applicant shall construct a paved and delineated approach(s) to meet the existing pavement of Sprague Avenue 10. Roadway standards, typical roadway sections and drainage plan requirements are found in Spokane Board of County Commissioners Resolution 95-0498 as amended and are applicable to this proposal. 11. No construction work is to be performed within the existing or proposed right of way until a permit has been issued by the County Engineer. All work within the public road right of way is subject to inspection and approval by the County Engineer. 12. Applicant shall sign and record Spokane County Notice to the Public No. 6 which specifies the following: The owner(s) or successor(s) in interest agree to authorize the County to place their name(s) on a petition for the formation of a Road Improvement District (RID) by the petition method pursuant to Chapter 36.88 RCW, which petition includes the owner(s) property. If a RID is formed by either the petition or resolution method, as provided for in Chapter 36.88 RCW, the owner(s) or successor(s) further agree: (1) that the improvement or construction contemplated within the proposed RID is feasible, (2) that the benefits to be derived from the formation of the RID by the property included therein, together with the amount of any County participation, exceeds the cost and expense of formation of the RID, and (3) that the property within the proposed RID is sufficiently developed Provided, further, the owner(s) or successor(s) shall retain the right, as authorized under RCW 36.88 090, to object to any assessment on the property as a result of the improvements called for in conjunction with the formation of the RID by either petition or resolution method under Chapter 36.88 RCW. This provision is applicable to Sprague Avenue. HE Findings, Conclusions and Decision ZE-11-96 Page 7 ~ 13. The County Arterial Road Plan identifies Sprague Avenue as a 130 foot Principal Arterial. The existing right of way width of 85 feet is not consistent with that specified in the plan. In , order to implement the Arterial Road Plan, it is recommended that in addition to the required right of way dedication, a strip of property 15 feet in width along the Sprague Avenue frontage be set aside in reserve. This property may be acquired by Spokane County at the time when arterial improvements are made to Sprague Avenue. 14. The applicant should be advised that there may exist utilities either underground or overhead affecting the applicants property, including property to be dedicated or set aside as future acquisition. Spokane County will assume no financial obligation for adjustments or relocation regarding these utilities. The applicant should check with the applicable utilities and Spokane County Engineer to determine whether the applicant or utility is responsible for adjustment or relocation costs and to make arrangements for any necessary work. SPOKANE COUNTY HEALTH DISTRICT 1. Sewage disposal method shall be as authorized by the Director of Utilities, Spokane County. 2. Water service shall be coordinated through the Director of Utilities, Spokane County. 3. Water service shall be by an existing public water supply when approved by the Regional Engineer (Spokane), State Department of Health. 4. A public sewer system will be made available for the project. Service will be provided. Use of individual on-site sewage disposal systems shall not be authorized. 5. Use of private wells and water systems is prohibited. SPOKANE COUNTY DIVISION OF UTILITYES 1. Pursuant to the Board of County Commissioners Resolution No. 80-0418, the use of on- site sewer disposal systems is hereby authorized This authorization is conditioned in compliance with all rules and regulations of the Spokane County Health District and is further conditioned and subject to specific application approval and issuance of permits by the Health District. 2. A covenant agreement shall be signed stating: The owner(s) or successor(s) in interest agree to authorize the County to place their name(s) on a petition for the formation of a ULID by petition method pursuant to RCW 36.94 which the petition includes the owner(s) property and further not to object by signing of a protest petition against the formation of a ULID by resolution method pursuant to RCW 36 94 which includes the owner(s) property. Provided, this condition shall not prohibit the owner(s) or successor(s) from objection to any assessment(s) on the property as a result of improvements called for in conjunction with the formation of a ULID by either petition or resolution under RCW 36 94. HE Findings, Conclusions and Decision ZE-11-96 Page 8 . ~ 3. Each new unit shall be double plumbed for connection to future area-wide collection systems. 4. Any water service for this project shall be provided in accordance with the Coordinated Water System Plan for Spokane County, as amended. ~ SPOKANE COUNTY AIR POLLUTION CONTROL AUTHORITY 1. All air pollution regulations must be met. 2. Air pollution regulations require that dust emissions during demolition, construction and excavation projects be controlled. This may require the use of water sprays, tarps, sprinklers or suspension of activity during certain weather conditions Haul roads should be treated and emissions from the transfer of earthen material must be controlled as well as emissions from all other construction related activities. 3. SCAPCA strongly recommends that all traveled surfaces (i.e., ingress, egress, parking areas, access roads) be paved and kept clean to minimize dust emissions. 4. Measures must be taken to avoid the deposition of dirt and mud from unpaved surfaces onto paved surfaces. If tracking or spills occur on paved surfaces, measures must be taken immediately to clean these surfaces. 5. SCAPCA Regulation I, Article V, requires that a Notice of Construction and Application for Approval be submitted to and approved by our Agency prior to the construction, installation or establishment of an air pollution source. This includes any fuel fired equipment rated at greater than 400,000 BTU/hour (boilers, hot water heaters, ovens, etc. It also includes paint booths, and other sources of air contaminants. 6 SCA.PCA Regulation I, Article IV may require registration with this agency. 7. SCAPCA Regulation I, Article VI, and SCAPCA Regulation II, Article IV, address emission standards. All emission standards must be met. 8 Debris generated as a result of this project must be disposed of by means other than burning (i.e., vegetative material, construction waste, etc...). 9. Demolition and renovation projects must comply with the requirements of CFR 40, Part 61, Subpart M and SCAPCA Regulation I, Article IX, which address asbestos abatement issues. Intent to Demolish forms are available at the SCAPCA office. 10. SITE INFORMATION A. Site Size: Approximately 53,600 square feet B. Comprehensive Plan 1. The Comprehensive Plan category of the subject property is Major Commercial. The subject property is within the Priority Sewer Service Area (PSSA). The Maj or Commercial (C) category is intended to provide the opportunity for development of commercial uses, specifically community and regional shopping centers and commercial uses, directly related to major throughways. Regional Business (B-3) zoning is intended to implement the Major Commercial category of the Comprehensive Plan. Arterial Road Plan: The subject property is located on Sprague Avenue which is identified by the Spokane County Arterial Road Plan as a Principal Arterial with a future Right of Way (ROV) width of 130 feet. In order to implement tlie Arterial Road Plan, the applicant is required to dedicate 15 feet of property along Sprague Avenue and reserve an additional 15 feet property as a Future Acquisition Area (FAA). 3. County Parks Plan: Terrace View Park is located approximately 2 miles southwest of the subj ect property. C. Site Characteristics: The site is level and is already developed with an approximately 7,000 square foot building close to Sprague Avenue. South of the building is a gravel lot. D. Neighborhood Characteristics: The neighborhood is characterized by commercial and retail establishments along both sides of Sprague Avenue. South of the subject parcel is another parcel owned by the applicant and occupied by a mini storage facility. E. Zoning Analysis: Regional Business (B-3) zones exist north of the subject property across Sprague Avenue and west of the site. These zones were established in 1991 based on the Program to Implement the Zoning Code. This property may be acquired by Spokane County at the time when arterial improvements are made to Sprague Avenue. 15. Spokane County assumes no financial obligation for adjustments or relocation regarding these utilities. All air pollution regulations must be met. 2. Air pollution regulations require that dust emissions during demolition, construction and excavation projects be controlled. This may require use of water sprays, tarps, sprinklers or suspension of activity during certain weather conditions. E36A Prior to issuance of a building permit or at the request of the County Engineer in conjunction with a County Road Project/Road Improvement District, whichever comes first: E36 Applicant shall dedicate 15 feet on 3jpracrue Avenue for right of way. Prior to release of a building permit or use of property as proposed: E40 Access permits for approaches to the County Road System shall be obtained from the County Engineer. E43 Applicant shall submit for approval by the Spokane County Engineer drainage and access plans. E44 The applicant shall submit for approval by the Spokane County Engineer and the Spokane County Health District a detailed combined on-site sewage system plan and surface water disposal plan for the entire project or portion thereof if the development is phased. .
