PROPOSAL
The sponsor,Ralph H R.ice, requests ap,ptoval of a zone reclassification from
Agncultural (A) toRekionalBusuless (B-3) on approxunately 1.75 acres, File No
ZE-34-89, for the purpose of developing retall sales, ofFice, or warehouses.
FINDINGS OF FACT AND CONCLUSIONS
1 The p%perty is generally located in the Spokane Valley at the southwest corner of
Sprague Avenue and Conkhn Road in the .NW 1/4 of Section 24, Townshlp 25 N,
Range 44 EWM, Spokane County, Washu3gton
2 The committee adopts the Plannmg Department Report as a part of ttus record
3. The existing land usas in the area are single fanuly dwellmg, mum-storage facibry,
auto repair, retail sales, vaaant, and undeveloped (south of Mlwaukee nght of way is
a mobile bame park, in final design stage).
4 The Comprehensive Plan desrgnates th7s site as Majar Comxnercial. The 1Viajor
Corinarciat category is for the purpose of development of commercial uses while
providing protecuon to adjacent, less intensive laad uses
5. The exisang zoning of the property descnbed m the apphcatxon is AgnculturaI,
prevzously established in 1942
6. The pzovnsions of RCW 43 21C (The State Environmental Policy Act) have been

CONDITIONS OR CONTINGENCIES APPLIED TO THIS APPROVAL
1. All Condinons unposed by the Heanng Examiner Comrnittee shall be binding on the
"Applicant", which term shall include the owner or owners of the property, heirs,
assigns, and successors-ln-interest.

COUNTY PLANNING DEPARTMENT
1. The Planning Director/designee shall approve a specif'ic extenor hghting plan for the
approved area pnor to installavon of such lighnng (Such plan shall attempt to
confine illumination to the area wnth full consideraaon to adjacent properties).
2. A specific landscape plan, planhng schedule and provisions for mauntenance
acceptable to the Planning Director/designee shall be subrrntted with a performance
bond for the project pnor to release of building pernuts Landscaping shall be
installed and maintained such that slght distance at access points is not obscured or
impaired
3. The applicant shall develop subject property generally in accQrdance wnthm the
concept presented to the Heanng Examiner Committee. Vanaaons, when approved
by the Plammng Du-ector/designee, will be pem-utted, includhng, but not lumted to
the following changes. builcling location, landscape plans, and general allowable
uses of the pernutted zone. All vanations must conform to regulations set forth in
the ZONING CODE FOR SPOKANE COUNTY. The ongmal intent of the
development plans shall be maultained
4 The specific development plan will be subnutted for Planning Department review
and approval pnor to issuance of building pernuts
5. All current standards of the Regional Business (B-3) Zone, as amended, shall be
complied with m the development of thus site
6 The project is subject to Secaon 14.706, the Aquifer Sensitive Area Overlay Zone
of the ZONIlVG CODE FOR SPOKANE COUNTY, which sets forth vanous
measures for Aquifer protection, specifically, measures dealing with wastewater
disposal, spill protection measures, and stormwater runoff
7 The present proposal is not detailed enough to determine whether or not the use of
or matenals stored on the site are in compliance with Section 14 706 (Aquifer
Sensiave Area Overlay Zone) of the ZONING CODE FOR SPOKANE COUNTY
Accordingly, as a condition of approval, the sponsor/applicant shall be requued to
file wnth the Spokane County Auditor, within thirty (30) days of the signing of

NOTICE IS MORE PARTICULARLY DESCRIBED AS FOLLOWS
8. Applicant shall comply with '208' recommendabons concerning stormwater runoff
and provide necessary landscaping for runoff.
9 Any division of land for the purpose of sale, lease or transfer, shall comply with
RCW 58 17 and the Spokane County Platting Ord.inances pnor to issuance of
building pemuts
10. The applicant shall comply with all agency's regulaaons as amended pnor to
issuance of building permits.
11. The Spokane County Plammng Department shall prepare and record with the
Spokane County Auditor a"Title Notice" noting that the property in question is
subject to a vanety of special conditions unposed as a result of approval of a land
use action. This "Title Notice" shall serve as official public notice regarding
condltions of approval affectmg the property in question. The "Title Notice" shall
be recorded within fifteen (15) days of final ciisposiaon of the approved land use
action and shall only be extmgwshed by the Spokane County Planning DepartmenL
The "Title Notice" shall generally provide as follows•
The parcel of property legally described as (legal description and taz parcel
number) is the subject of a land use action, imposing a variety of
special development conditions, by a Spokane County Hearing Body
or Administrative Official on (date) and as maybe amended, altered or
supplemented by official action or as already changed. File No. (Planning
Department File Number) is available for inspection and copying in the
Spokane County Planning Department.
12 Spokane County Planning Department is requu-ed to record wnth the County
Auditor a"Title Nonce," as prepared and signed by the applicant, for a future
acquisiaon area for road nght-of-way and ualities to run with the land, and the
future acquisinon area reservation shall not be removed without pnor approval by
the Spokane County Planning Department Noace shall be recorded pnor to the

COUNTY ENGINEER'S OFFICE
Pnor To The Issuance Of A Building Permit Or Uie Qf The PropgM Aa Propgsed:
1 ApphGant shall dedicate 10 feet on Conkhn Road for nght of way and slope
easements as necessary.
2 AppLcant shall dedzcate 15 feet on Sprague Avenue and a 30 foot rad.ius on Sprague
Avenue and Conklin Road
3 Access permits for approaches to the County Road System shall be obtained from
the Spokane County EngYneer.
4 Apphcant shall subrrut for approval by the Spokane County Engineer road,
dramage, and access plans
5. The applicant shall subrYUt for approval by the Spokane County Engineer and the
Spokane County Health Distnct a detailed combined on-site sewage system plan
and surface water disposal plan for the entire project or any portion thereof, if the
development is to be phased.
6 A parlang plan and traffic circulanon plan shall be subrrutted and approved by the
Spokane County Engineer. The design, locahon, and arrangement of parking stalls
shall be in accordance with standard traffic engineenng practices. Paving or
surfacing as approved by the County Engineer, will be required for any pornon of
the project which is to be occupied or traveled by vetucles.
7 To construct the road improvements stated herein, the apphcant may, with the
approval of the County Engmeer, joln in and be a wnlling participant in any pennon
or resolution which purpose is the formaaon of a Road Improvement Distnct (RID)
for said improvements, pursuant to RCW 36.88, as amended Spokane County
will not participate in the cost of these improvements. This cond.inon apphes to the
improvements which are specified for Sprague Avenue
8 As an alternahve method of constructing the road unprovements stated herein, the
applicant may, wnth the approval of the County Engineer, accomplish the road
improvements stated herein by joining and parUcipanng in a County Road Project
(CRP) to the extent of the required road improvements Spokane County will not
participate in the cost of these improvements This condiaon applies to the
improvements which are specified for Sprague Avenue

9 The construcaon of the road improvements stated herein shall be accomplished as
approved by the Spokane County Engineer
10 The County Engineer has designated Typical Roadway Secnon Number One, Major
(Pnncipal) Artenal Standard for the improvement of Sprague Avenue, which is to
be constructed within the proposed development. This will require the installation
of 8 to 10 feet of asphalt, curb and sidewalk.
11 The County Engineer has designated Typical Roadway Section Number One,
Collector Artenal Standard for the unprovement of Conkhn Road, which is adjacent
to the proposed development. This wnll requue the addition of appnoxunately 10 to
14 feet of asphalt, curb and sldewalk along the frontage of the development
12 All requued unprovements shall conform to the cunent State of Washington
Standard Specifications for Road and Bndge Construcbon, and other applicable
County standards andlor adopted resolutions pertauning to Road Standards and
Stonnwater Management in effect at the date of conswction, unless otherwise
approved by the County Engineer.
13 Access to the abandoned Chicago, Milwaukee and St. Paul Railroad Comdor
(Milwaukee Comdor) is prohibited
14. Roadway standards, typical roadway secdons and drainage plan requuements are
found in Spokane Board of County Commissioners' Resolution No. 80-1592 as
amended and are apphcable to this proposal.
15 This plat or development proposal is located within a dimnage basin wluch has been
identified by the Spokane County Engineer's office as having stormwater runoff
problems. Since this plat or development proposal is affected by or is a contnbutor
to stormwater flows, property owners should parncipate in the planrung and
unplementanon of a future basinwide stormwater management system The
follownng statement shall be placed in the plat dedication: "That the owner(s) or
successor(s) in mterest agree to jom in any County-approved stormwater
management program and to pay such rates and charges as may be fixed through
public heanngs for service or benefit obtained by the plammng, design,
constructing, maultairung or operation of stormwater control facilities."
16 No constniction work is to be performed within the exustuig or proposed public
nght-of-way until a permit has been issued by the County Engineer. All work is
subject to inspection and approval by the County Engineer
17 All requu-ed construction within the existing or proposed public nght of way is to
be completed pnor to the release of a buildmg pemut or a bond in the amount
estimated by the County Engineer to cover the cost of construcaon of improvements
shall be filed with the County Engineer
18 The following statement be placed in the plat dedicauon. "The owner(s) or
successor(s) in interest agree to authonze the County to place their name(s) on a
petition for the formation of a Road Improvement Dismct (RID) by the pebtion
method pursuant to Chapter 36 88 RCW, which petihon includes the owner(s)'
property, and further not to object, by the signing of a ballot, to the formanon of an
RID by the resolunon method pursuant to Chapter 36 88 RCW, which resolution

includes the owner(s)' property If an RID is formed by either the petition or
resolution method as provided for in Chapter 36 88 RCW, the owner(s) or
successor(s) further agree
(a) that the unprovement(s) or construction contemplated vvithin the proposed
RID is feasible,
(b) that the benefits to be denved from the formation of the RID by the property
included therein, together with the amount of any County participation,
exceed the cost and expense of formation of the RID, and
(c) that the property within the proposed RID is sufficiently developed.
Provided further that the owner(s) or successor(s) shall retain the nght, as
authonzed under RCW 36 88 090, to object to any assessment(s) on the
property as a result of the improvements called for in conjunction with the
formaaon of an RID by either petiaon or resolution method under Chapter
36.88 RCW.
Special Conditions:
19. The abandoned M11waukee Comdor is designated on the Artenal Road Plan as
Pruicipal Artenal with controlled Access. Any proposed structure shall be set back
in such a manner so as to protect the artenal alignment
20. The apphcant shall set aside a smp of property 22 ft. in wndth along the South
property hne of the subject parcel. This stnp of property will be purchased by
Spokane County for the East-West valley artenal (Milwaukee Comdor)
Acquisition of the property by Spokane County vvill occur in conjunction with the
development of the property.
21. There shall be no access to Conklin Road vvithin 50 ft. of the revised North Lne of
the East-West valley artenal (Milwaukee Comdor).
COUNTY UTILITIES DEPARTMENT
1 The dedication shall state• "The owner(s) or successor(s) in interest agree to
authonze the County to place theu name(s) on a peation for the formaaon of ULID
by petition method pursuant to RCW 36 94, which the pention includes the
owner(s)' property; and further not to object by the sigrung of a protest petition
against the formanon of a ULID by resoluaon method pursuant to RCW Chapter
36 94 which includes the owner(s)' properry PROVIDED this condlnon shall not
prohibit the owner(s) or successor(s) from objecting to any assessment(s) on the
property as a result of improvements called for in conjunction with the formaaon of
a ULID by either petition or resolution method under RCW Chapter 36 94 "
2 Any water service for this project shall be provided in accordance with the
Coordinated Water System Plan for Spokane County, as amended
3 Applicant will make connection to Public Sewer System Sewer connecaon pemtit

COUNTY HEALTH DISTRICT
1 Sewage disposal method shall be as authonzed by the Duector of Uhlities, Spokane
County
2 Water sernce shall be coordinated through the Director of Utihties, Spokane

3 Water service shall be by an exisnng public water supply when approved by the
Regional Enguieer (Spokane), State Department of Health.
4. A pubhc sewer system will be made available for the proJect, and individual service
will be provided to each lot pnor to sale. Use of individual on-site sewage disposal
systems shall not be authonzed
5 Use of pnvate wells and water systems is prohibited.
COUNTY BUILDING AND SAFETY DEPARTMENT
1 The apphcant shall contact the Department of Budding and Safety at the earhest
possible stage of design/development in order to be infonned of Code requumments
administem.d/enforced by the department, e.g , State Building Code Act regulauons
such as requirements for fire hydrantlflow, fire apparatus access roads, street
address assignment, bamer-free regulations, energy caie regulaaons, and general
coordination vsnth other aspects of project unplementation.
2 The issuance of a building pernut by the Department of Buflding and Safety is
required.
3. Requuements of Fue Distnct No. 1 need to be satisfied dunng the building pernut
process.

THIS MATTER, Being the consideration by the Board of County Commissioners of
Spokane County, hereinafter referred to as the "Board" of an appeal of the Spokane County
Zoning Heanng Examiner Committee Decision of March 22, 1990, approving the zone
reclassification, ZE-34-$9 from Agncultural (A) to Regional Business (B-3), for the
purpose of developing retail sales, offices, or warehouses, hereinafter referred to as the
"Proposal", and the Board of County Comnussioners having held a public heanrig on May
15, 1990, and having fully considered all testimony presented thereat, and further having
individually visited with the site and vicimty un question, and having rendered a decision on
the 12th day of Sune, 1990, denying said appeal, and, in effect approving the rezone
request, does hereby make the followirig:
FINDINGS OF FACT
1 That the proposal is generally located m the Spokane Valley, at the southwest
corner of Sprague Avenue and Conklin Road, in the NW 1/4 of Secnon 24,
Township 25 North, Range 44 EWM, Spokane County, Washington
2. That the March 22, 1990 Planning Report was considered as well as the staff
presentation at the public heanng.
3 That the March 23, 1990 Heanng Examiner Committee Findings and Order were
considered.
4 That the file for Zone Reclassification ZE-34-89, from Agricultural (A) to Regional
Business (B-3) was available for consideration by the Board.
5 That the Spokane County Hearing Examiner Committee held a public heanng on
March 22, 1990, concerning the proposal, subsequent to which by Findings of
Fact, Decision and Order dated March 23,1990, they approved the proposal.
6 The issue on appeal was not whether the subject property should be rezoned. The
issue was a request by the apphcant that the county reunburse him certain moneys at
the present ume as a result of future nght-of-way acquisitions required (as per the
Spokane County Artenal Road Plan) in conjunction with the rezone approval.
Specifically, the applicant requested reimbursement by the County at the present
time for twenty feet of future nght-of-way acquisinon on Sprague Avenue, and
thuty feet of future nght-of-way acquisinon adjacent to the Mdwaukee railroad
nght-of-way.
7 At the May 15, 1990 public hearing before the Board, the applicant/appellant did
acknowledge that the fifteen foot dedication required (in conjunction with the
proposed rezone) adjacent to Sprague Avenue, and the ten foot dedication requued
(in conjunction with proposed rezone) along Conklin Road, were appropriate given
the increased traffic which the proposal would generate. The applicant also
acknowledged agreement vcnth the County Engineer's offer to chrectly purchase
twenty-two feet of nght-of-way adjacent to the Milwaukee railroad right-of-way for
future road purposes
8. The County Engineer, through Gary Kennaly, advised the Board that the above
referenced future nght-of-way acquisinon areas adjacent to Sprague Avenue and the
Nlilwaukee railroad right-of-way were required as a result of, and to implement the
County's adopted Artenal Road Plan. Mr Kennaly further advised that it was the
intennon of the County, at a future date, when the future nght-of-way acquisitions
are needed, to reimburse the property owner for such nght of way. Mr. Kennaly
also ind.icated that the property owner does have the ability to place certain
improvements within the future nght-of-way acquisition areas, such as
landscaping, off-street parking, surface drainage facilaties, drainfields, signage, or
other uses. '

9 The applicantlappellant although aclrnowledging the adopted Arterial Road Plan,
contended that the property owner could not use the future nght-of-way acquisinon
properties, and his client should be reimbursed today, as opposed to the future, for
the County's condinon requinng the dedication of the future nght-of-way
acquisition areas.
10 The Comprehenslve Plan designates the subject property as Major Commercial.
The Major Commercial category is for the purpose of developing commercial uses
while providing protection to adjacent, less intensive land uses.
11 The existing land uses in the area are a single-family dwelling, rruni-storage facility,
auto repair, retail sales, vacant and undeveloped parcels, and a manufactured home
park in final design phase.
12 That a Declaration of Nonsignificance was issued for this pmject pursuant to the
State Envuonmental Policy Act, on March 2, 1990 This determinaaon was
cuculated to other agencies for comment No agency contested the Deternunation
of Nonslgnificance(DNS) The Board concurs with the DNS issued for this
project.
13 The owners of adjacent propernes expressed neither approval nor disapproval of the
progosed zone reclassification
14. Although recognizing the property owners contention that conditions of approval
requinng dedicauon of nghts of way and dedicaaon of future nght-of-way
acquisition areas may reduce the avallable square footage of the subject property,
the property owner did not indicate that he could not develop the property consistent
with the development plan presented to the Board, even given the conditions of
approval. Further, the Prosecunng Attorney's Office has advised the Board that
nghc-of-way dedicanons, as well as dedication of future nght-of-way acquisition
areas, in conjuncnon with rezone requests, are lawful, especially when related to
promonon of the pubhc health, safety, and general welfare.
15. That the proposal is compatible with exisnng uses in the area as explalned in the
Planning Report.
16 That the applicant has demonstrated changed condiaons since the onglnal zone
change
17 That the proposal is consistent with the surrounding land use classifications as
explained in the Planning Report
18 That access to the site would be via Conklin Road

area of Vera Water and Power Dismct and they are supplying the site with adequate
water for domestic, fire and imgation uses.

This evening is the time which the Board has 4 set %t,o,g%Aepder
their decision in conjunction with the appeal hear~ing held on May
15, 1990, on ZE-34-89, Agricultural (A) to Regional Business (B-
3), applicant - Rice.
At the hearing, the Board was advised that the rezone request
is for a parcel of property, comprising 1.75 acres, for the
purpose of developing retail sales, offices or warehouses.
The issue on appeal was not whether the property should be
rezoned. The issue was a request by the applicant that the County
reimburse him certain moneys at the present time as a result of
f uture right-of -way acquisitions required in conj unction,.wi~,.t-h*the
rezone approval. In particular, the applicant requested reimbur-
sement by the County at the present time for twenty feet (201) of
future right-of-way acquisition on Sprague Avenue, and thirty feet
(30') of future right-of-way acquisition adjacent to the Milwaukee
right-of-way.
At the publi.c hearing, the applicant/appellant acknowledged
that the fifteen (151) dedication required in con3unction with the
rezone adjacent to Sprague Avenue, and the ten foot (10')
dedication along Conklin Road in conjunction with the rezone, were
appropriate as a result of the increased traffic which the rezone
would generate. The applicant also acknowledged a,greement~w,ith
the County Engineer's offer to purchase twenty-twor feet (22') of
right-of-way adjacent to the Milwaukee right-of-way for future
road purposes.
The County Engineer, through Gary Kennaly, advised the Board
of County Commissioners that the 20' future right-of-way acquisi-
tion along Sprague Avenue, and the 30' future acquisition ad3acent
to the Milwaukee right-of-way were required as a result of the
County's adopted arterial road plan. Mr. Kennaly further advised
that it was the intention of the County, at some future date, when
the future right-of-way acquisitions were needed, to reimburse the
property owner for such properties. Mr. Kennaly alsa indi~ tied
that the property owner had the ability to put certain improve-
ments within the future right-of-way acquisition properties, such
as landscaping, parking, surface drainage, drain fields, signs or
other uses.
The applicantlappellant, although acknowledging the arterial
road plan, indicated that the property owner could not use the
future rlght-of-way acquisition properties, and his client should
be reimbursed today, as opposed to the future, for the County's
condition requiring the dedication of the future right-of-way
acquisition.
Although I certainly sympathize with the pro,perty O-Wlffler~ s
observation that the conditions of appraval requiring dedication
of rights-of way, and dedication of future right-of-way ac-
quisitions, may reduce the square footage of his property, the
property owner did not indicate that he could not place the
proposed development presented to the Board on his property, even
given the conditions of approval. Moreover, the Prosecuting
Attorney's Office has advised that the dedication of right-of-way,
as well as the dedication of future right-of-way acquisition
properties, in conjunction with rezone requests, is lawful,

especially when related to public health, safety and welfare
concerns.
Based upon the record before the Board, and advice of the Spokane County Prosecuting Attorney's Off ice, I her,eby mo~ve"~7hat
the appeal filed by Mr. Rice in conjunction with ZE-34-89, be
denied. In denying the appeal, I am basically approving the
rezone as requested, and also adopting all conditions of approval,
including Conditions No. 12 and 13, as well as Engineer's
Condition No. 22, relating to future acquisition areas, as well as
setbacks along Sprague Avenue and the Milwaukee right-of-way.
I would request the Planning Department staff prepare
Findings of Fact and Decision reflecting this motion, to be
presented to the Board at a subsequent public meeting.

19. The abandoned Milwaukee Comdor is designated on the Arterial Road Plan as
Principal Arterial wich controlled Access. Any proposed structune shall be set back
in such a manncr so as to protect the arterial alignment.
20. The applicant shall set aside a stiip of property 22 ft. in width along the South
property line of the subject parcel. This strip of property will be purchased by
Spokane County for the East-West valley arterial (Milwaukee Corridor).
Acquisition of thc property by Spokane County will occur in conjuncdon with the
devclopment of the pmperty.
21. There shall bc no access to Conklin Road within SO fL of the revised North line of
the East-West valley arterial (Milwaukee Corridor).
COUNTY UTILTTIES DEPARTMENT
1. The dedication shall state: "The owner(s) or successor(s) in interest agree to
authorizc the County to place their name(s) on a peation for the formarion of ULID
by pctition method pursuant to RCW 36.94, which the perition includes thc
owner(s)' property; and furcher not to object by the signing of a protest petition
against the foimation of a ULID by resolution methai pursuant to RCW Chapter
36.94 which includes the owner(s)' property. PROVIDED this condition shall not
prohibit the owner(s) or successor(s) from objecting to any assessment(s) on the

improvements at the time Spokane County makes roadway improvements after ~

COUNTY ENGINEER'S OFFICE
Priar To Thc Issuancc Of A Building Pennit Or Use Of "Ihe ProveM As Pro2gsed:
1. Applicant shall dedicate 10 fcet on Conklin Road for right of way and slopc
easements as necessary.
2. Applicant shall dedicate 15 feet on Sprague Avenue and a 30 foot radius on Sprague
Avenue and Conklin Road.
3. Acccss pernuts for approaches to the County Road System shall be obtained from
the Spokane County Engineer.
4. Applicant shall submit for approval by the Spokane County Engineer road,
drainage, and access plans.
5. The applicant shall submit for approval by the Spokane County Engineer and the
Spokane County Health District a detailed combineri on-site sewage system plan
and surface water disposal plan for the entire project or any portion thereof, if the
development is to be phased
6. A parldng plan and traffic circulation plan shall be submitted and approved by the
Spokane County Engineer. The design, location, and airangement of parlang stalls
shall be in acconda.nce with standard traffic engineering practices. Paving or
surfacing as approved by the County Engineer, will be required for any portion of
the project which is to be occupied or traveled by vehicles.
7. To construct the road improvements stated herein, the applicant may, with the
approval of the County Enginecr, join in and be a willing participant in any peation
or resolution which purpose is the formation of a Road Improvement District (RID)
for said improvements, ptirsuant to RCW 36.88, as amended. Spokane County
will not participate in the cost of these improvements. This condition applies to the
improvements which are specified for Sprague Avenue.
8. As an alternaave method of constructing the road improvements stated herein, the
applicant may, with the approval of the County Engineer, accomplish the road
improvements stated herein by joining and participating in a County Road Project
(CRP) to the extent of the required road improvements. Spokane County will not
participate in the cost of these improvcments. This condiaon applies to the
improvements which are specified for Sprague Avenue.

9. The conswction of the road improvements stated herein shall be accomplished as
approved by the Spokane County Engineer.
10. The County Engineer has designated Typical Roadway Seceon Number One, Major
(Principal) Arterial Standard for the improvement of Sprague Avenue, which is to
be constructed within the proposed development. This will require the installation
of 8 to 10 feet of asphalt, curb and sidewalk.
11. The County Engineer has designated Typical Roadway Secrion Number One,
Collector Arterial Standard for the improvement of Conklin Road, which is adjacent
„ to the proposed development. This will require the addition of approximately 10 to
14 feet of asphalt, curb and sidewalk along the frontage of the development.
12. All required 'unprovements shall conform to the current State of Washington . Standard Specifications for Road and Bridge Construction, and other applicable
County standards andlor adopted resolutions pertaining to Road Standards and
Stornzwater Management in effect at the date of construction, unless otherwise
approved by the County Engineer.
13. Access to the abandoned Chicago, Milwaukee and St Paul Railroad Corridor
(Milwaukee Corridor) is prohibited.
14. Roadway standards, typical roadway sections and drainage plan requirements are
found in Spokane Board of County Commissioners' Resolution No. 80-1592 as
amended and are applicable to this proposal.
15. This plat or development proposal is located within a drainage basin which has been
identif'ied by the Spokane County Engineer's office as having stormwater runoff
problems. Since this plat or development proposal is affected by or is a contributor
to stormwater flows, property owners should participate in the planning and
implementation of a future basinwide stormwater management system. The
following statement shall be placed in the plat dedication: "That the owner(s) or
successor(s) in interest agree to join in any County-approved stormwater management program and to pay such rates and charges as may be fixed through
public hearings for service or benefit obtained by the planning, design,
constructing, maintaining or operation of stormwater control faciliues." 16. No construction work is to be performed within the existing or proposed public
right-of-way until a permit has been issued by the County Engineer. All work is
subject to inspection and approval by the County Engineer.
17. All required construction within the existing or proposed public right of way is to
be completed prior to the release of a building pennit or a bond in the amount
estimated by the County Engineer to cover the cost of construction of improvements
shall be filed with the Counry Engineer. •
