The members of the Comnuttee present are Verona Southern, Chair, Brenda
Bodenstein and Jane Myers
PROPOSAL
The sponsors, Douglas and Colleen Barry, request approval of a Change of
Conditions to an existing Urban Residential-22 (UR-22) zone, File No
ZE-116-81, to delete specific conditions of approval which require improvements
to Nora Avenue Specifically, Conditions No 1 and No 6 of the Spokane County
Engineenng Department wluch requue the applicant to construct cement concrete
curb and sidewallc and pave to the existing pavement adjacent to the properry on
Nora Avenue
FINI)INGS OF FACT AND COIVCLUSIONS
1 The property is generally located south of and adjacent to Nora Avenue,
approximately 800 feet west of Mamer Road in the SE 1/4 of Section 10, Townslup
25 North, Range 44 EWM, Spokane County, Waslungton
2 The Commrttee adopts the Planrung Department Report as a part of this record
3 The existing land uses in the area include single fanuly residences and professional
off'ice
4 The proposed use is compatible with existing uses in the area
5 The property is located withn the Urban category of the Comprehensive Plan and
witrun the Prionty Sewer Service Area (PSSA)
6 The proposed change of cond.itions does implement and conform to the
Comprehensive Plan
7 The existuig zorung of the property descnbed in the apphcation is Urban
Residential-22 (UR-22) previously estabhshed as Residential Off'ice (RO) zotung in
1981 and redesignated to Urban Residential-22 (UR-22) on January 1, 1991
pursuant to the Program to Implement the Spokane County Zoning Code
8 The provisions of RCW 43 21C (The State Envuonmental Policy Act) have been
complied with and a Deternunation of Nonsigruficance (DNS) was issued The
Committee, after independent review, hereby adopts the DNS

A INTRODUCTION
This matter having come before the Examiner Committee on December 10, 1981,
and the members of the Committee present being Jane Myers, Acting Chair-
person, Kathleen Carstens and Jerry Williams
B. PROPOSAL
The sponsor, James E Ayers, M D, is requesting approval of a zone reciassifi-
cation, File No ZE-116-81, Agricultural to Residentiai Office, with no proposed
development at this time.
C. FINDINGS OF FACT
1. That the existing land use in the area is residential, I-90, and vacant.
2. That the Comprehensive Pian designates this area as appropriate for Urban
development.
3. That the existing zoning of the property described in the application is
Agricultural
4. That the provisions of RCW 43 21C (The State Environmental Policy Act)
have been complied with, and the Committee concurs with the Declaration of
Non-Significance
5. That the proper legal requirements for advertisement of the Agenda Item
have been fulfilled.
6. That the land in this area is suitable for the proposed use, or uses within
the proposed Zone Classification.
7 That the applicant has demonstrated that conditions have substantially
changed since the original zoning of this area and accordingly, the pro-
posed rezone is justified.

a) COUNTY PLANN I NG DEPARTMENT
1. Approvai by the Zoning Administrator of a specific lighting and sign-
ing plan for the described property prior to the release of any build-
ing permits
2. A specific landscape plan, planting schedule and provisions for- main-
tenance acceptabie to the Spokane County Zoning Administrator shall
be submitted with a performance bond for the project prior to release
of building permits
3. Dtrect Iight from any exterior area lighting fixture shail not extend
over the property boundary
4. All current standards of the Residential Office Zone, as amended, shall
be complied with in the development of this site
5. Applicant shall comply with 1208' recommendations concerning storm-
water runoff and provide necessary iandscaping for runoff
6 That the provisions of SEPA's NOTICE OF ACTION pursuant to
Chapter 43 21C.080 RCW and the Board of Spokane County Commis-
sioners Resolution #77-1392 be initiated by the project applicant within
thirty (30) days of final disposition of this application, and prior to
any on-site improvements
7. The applicant shall compiy with RCW 58-17 as amended, and the
Spokane County Platting Ordinances prior to issuance of building
permits.
8. That prior to buiiding permit release on the southerly portion of
this site, annexation procedures to Consolidated I rrigation
District must be completed
' 9 Pursuant to the provisions of Chapter 43 21C RCW, the SEPA
Guidelines (WAC 197-10) and the Spokane County Environmental
Ordinance (SCEO), a proposed declaration of non-significance
has been issued at least fifteen (15) days prior to this date, the
official file, written comments and/or public testimony contain
information regarding assessment of the proposal's adverse
impacts to the physical environment, a finding is hereby made
that no potentiaily significant adverse impacts upon the physical
environment are anticipated as a result of the project, and a
final declaration of non-significance is hereby to be issued.
10. That, pursuant to WAC 197-10-040 (2)(a) and (20), WAC
197-10-155 and SCEO 11 00 055, the rezone is an action subject
to SEPA, but insufficient detail concerning the proposal is avail-
able to permit meaningful environmental analysis at the rezone
level, consequently a detailed site plan, subject to full com-
pliance with Chapter 43 21C RCW, shall be submitted for con-

more, it is hereby stipulated that, because of project details not
now available, the Zoning Administrator may require additional

b) COUNTY ENGI NEER I NG DEPARTMENT
1. Applicant shall construct cement concrete curb and sidewaik and pave
to the existing pavement adjacent to the property on Nora Avenue.
2. Applicant shail submit for approval by the Spokane County Engineer
road, drainage, and access plans prior to the issuance of a building
permit on the property
3 The applicant shall submit for approval by the Spokane County
Engineer and the Spokane County Health District a detailed combined
on-site sewage system plan and surface water disposal plan for the
entire project prior to the issuance of any building permit on the
property.
4. A parking plan and traffic circulation plan shall be submitted and
approved by the Spokane County Engineer prior to the issuance of a
building permit on the property The design, location, and arrange-
ment of parking stalls shall be in accordance with standard traffic
engineering practices Paving or surfacing as approved by the
County Engineer, will be required for any portion of the project which
is to be occupied or traveled by vehicles
5. The word "applicant" shall include the owner or owners of the
property, his heirs, assigns, and successors
• 6 The construction of the road improvements stated herein shall be
accomplished as approved by the Spokane County Engineer
7. All required improvements shall conform to the current State of
Washington Standard Specifications for Road and Bridge
Construction, and other applicable county standards and/or
adopted resolutions pertaining to Road Standards and Stormwater
Management in effect at the date of construction, unless other-
wise approved by the County Engineer

1. Pursuant to Board of County Commissioners Resolution No 80-0418,
the use of on-site sewer disposal systems is hereby authoriZed. This
authorization is conditioned on compliance with all rules and regulations

After reviewing the above development which is located proximate to SR-27, the ~
Washington State Department of Transportation (WSDOT) has the following comments
concerning this proposal:
1. Due to the fact that this development is limited to a model home which will be usec{
as a sales office for such homes, WSDOT anticpates the traffic that this
development will generate will be quite limited. Due to this minor trip generatiori
of this Since this is a significant addition to the existing buildings, the applicant will
need to obtain a valid WSDOT road approach to serve this new addition. This road
approach must be obtained prior to the release of any building permits for thi s ,
property. For more information or to apply for a road approach please contact '
Leonard McDonnell in our Maintenance Department at 625-5144.
