wifihin the Ponderosa Pine Woodland identified as wildlife habitat in the 1997 Habrtat 1Vlanagem.ent Plan The 1997 Plan prohiblted structures and pavmg within such habitat HE Findings, Conclusions and Decision ZE-37A-96 T'age 2 ! 4 17 A document enhtled "Evaluahon of the Habitat Evaluation and Management Plan" dated March 14, 2001, was submitted by a quallfied consultant retained by the applicant Such document discusses the changes proposed by the current application and their impact on the 1997 Habitat Management Plan The document indicates that such changes will not sigruficantly impact the Ponderosa Pine Woodland, since the unprovements will be constructed in an area that was previously d.isturbed for the former zoo The proposed structures will not be located in the core of the pXne woodland habitat, which 1s the most sensitive part of the habitat The irails loeated closest to core of the pine woodland habitat will be either gravel or bark 18 The Evaluation of the Habitat Evaluation and 1VYanagement Plan dated March 14, 2041 was accepted by the County Division of Planning The Washington State Department of Wildlife submitted comments stating that the cha.nge of conditions would have only a limited impact on the pme woodland habrtat, as long as paving did not occur off the existmg soft pafihs, the proposed structures are constructed on srtes where the former Examiner enters the following 11 CONCLUSIONS OF LAW 1 The proposed change of conditions, as conditioned, generally conforms to the Comprehensive Plan 2 The applicant has established that the proposed change of conditions bears a substantial relationship to, andlor will not be detnmental to, the public health, safety or welfare 3 The procedural requirements of the State Environmental Policy Act and the Gounty's Local Enviranmental Ordinance have been met 4 The proposal, as conditioned, complies with the I-2 zone, the County Zorung Cade, and other apphcable development regulations 5 The proposal meets the cntena established in Section 14 504 040 of the County Zoning Code for a change of conditions application 6 Approval of the Iand use application is appropnate under the cntena established Description of the Site: The subject site is approximately 48 acres in size and is bordered on the east by Mirabeau Parkway. Access to the site is from Discovery Place. The property is the former site of the Walk in the Wild Zoo. The topography of the site ranges from flat to sloping with numerous rock outcroppings, and the site is covered with native vegetation. The northern 2/3 of the subject property is to be developed as a natural area with a series of walking trails. Surrounding uses include the YMCA, Spokane River, Centennial Trail, undeveloped land and commercial uses to the southeast along Indiana Avenue. Backqround: The application was submitted to the Spokane County Division of Planning on March 29, 2001. A Technical Review meeting was held on April 12, 2001. The application was determined to be Technically Complete on May 4, 2001, and the Notice of Application was issued on the same date with a comment period ending on May 25, 2001. The subject property is located within the Interim Urban Growth Area (IUGA) adopted by the Board of County Commissioners on April 7, 1997, Resolution #97-0321. The subject site is part of a proposed conceptual master plan for the development of the Mirabeau Point area. The impacts of the proposed conceptual master plan were addressed through an Environmental Impact Statement (EIS) process and a Final Environmental Impact Statement (FEIS) was issued for the conceptual master plan on June 12, 1998. The Spokane County Critical Areas Maps identify habitat in the form of Urban Natural Open Space located on the subject site. A Habitat Management Plan, dated September 15, 1997, was included as part of the Environmental Impact Statement (EIS) for the Mirabeau Point area. The Habitat Management Plan identifies the rocky woodland located on the north 2/3 of the site as a Ponderosa Pine Woodland which provides habitat to a diverse wildlife population and is highly vulnerable to degradation. The Plan includes specific recommendations for the protection of the Ponderosa Pine Woodland. ZE-37A-96 Staff Report - June 20, 2001 Hearing . 4 of 6 • •i An application for a Zone Reclassification, ZE-37-96, for the south 1/3 of the subject site and adjacent properties to the north, east and south, from the Rural Residential-10 (RR-10) zone to the Light Industrial (I- 2) zone was approved by the Hearing Examiner on August 17, 1999. The north 2/3 of the subject site was not included within the requested Zone Reclassification, however, conditions of approval for ZE-37-96 address this area of the site due to its inclusion within the scope of the Environmental Impact Statement (EIS) for the conceptual master plan for the Mirabeau Point development. The Hearing Examiner's Finding of Fact, Conclusions of Law and Decision for ZE-37-96 includes the following condition of approval: Division of Building and Planning Condition #10 The applicant shall comp/y with and implement fhe recommendations contained in the Mirabeau Poinr Habitaf Evaluafion and Managemenr Plan, with regard to the project site and the off-site portions of the 229- acre Mirabeau Point development. This includes, without limitation, reservation of the central natural area of the development, provision for avian buffer zones, and dedication of 10-19 acres of park land to Spokane County. The Gming of such dedication of park land shall be determined by the County Parks and Recreation Department, after consultation with the applicants and the Division of Building and Planning. The purpose of the proposed Change of Conditions is to modify this condition of approval in order to amend the recommendations contained within the Mirabeau Point Habitat Evaluation and Management Plan to allow limited structures and paved trail within the interior of the Ponderosa Pine Woodland. The proposed Change of Conditions to ZE-37-96 is not intended to affect any remaining original conditions of approval. An Evaluation of the Mirabeau Point Habitat Evaluation and Management Plan was submitted by the applicant on March 29, 2001. The Evaluation of the original Habitat Management Plan states that the proposed structures; a gazebo, trellis and "Fort Spokane", and 12' wide paved trails will be located in those areas near the entrance of the former Walk in the Wild Zoo, and outside of the core Ponderosa Pine Woodland located near the northwest comer of the site. The Evaluation states that a picnic shelter has already been constructed on the site. The Evaluation of the Habitat Management Plan was accepted by the Division of Planning in consultation with the Washington State Department of Fish and Wildlife. In a letter dated April 16, 2001, the Washington State Department of Fish and Wildlife recommends that with the exception of the proposed structures and limited paving of existing soft trails, all development should continue to follow the guidelines set by the 1997 Habitat Management Plan. Project Description: The proposed Change of Conditions is for the purpose of modifying Division of Building and Planning Condition #10 for ZE-37-96 to allow a limited number of structures, including a gazebo, trellis and "Fort Spokane", and paved trails within the interior of the Ponderosa Pine Woodland located on the site of the Mirabeau Springs Park project, whereas the original recommendations of the Habitat Management Plan prohibited structures and paving within this area. Staff Analysis: Comprehensive Plan: The site is located within the Rural category of the Comprehensive Plan. The Rural category is intended to provide the opportunity for development of agricultural, timber or open environments in a"country like" setting. The land use within this category is intended to be primariiy very large-lot residential with agricultural uses or open areas. Goal 4.2 is intended to encourage a variety or parks and open spaces. Objective 4.4.b recommends the identification of fragile wildlife areas needing protection and to develop methods for such protection. These areas should be conserved and made available for education purposes. Decision guidetines 4.4.2 and 4.4.3 recommend the retention and maintenance of unique environmental areas. The proposed Change of Conditions is generally consistent with Goals, Objective and Decision Guidelines of the Rural category of the Comprehensive Plan. The proposed Mirabeau Springs park project and the proposed Change of Conditions is consistent with the allowable uses and development standards of the Rural Residential-10 (RR-10) zone. The existing zoning of the south 1/3 of the site is Light Industrial (I-2). The proposed Change of Conditions does not affect that portion of the site currently zoned as Light Industrial (I-2). Zoning in the surrounding area of the site consists of Rural Residential-10 (RR-10), Light Industrial (I-2), and Community Business (B-2). Site Plan: The site plan of record for the proposed Change of Conditions illustrates the location of both the proposed and existing trail system and identifies those trails that are intended to be paved. Those trails that are closest to the core Ponderosa Woodland Area located on the northwest area of the site are identified as being either gravel or bark trails. The site plan illustrates the location of the proposed structures, but does not specifically identify the structures. Staff Summarv: As proposed, the requested Change of Conditions to allow structures and paved trails within the interior of the Ponderosa Pine Woodland is generally consistent with the Goals, Objectives and Decision Guidelines of the Rural category of the Comprehensive Plan, the allowable uses and development standards of the Rural Residential-10 (RR-10) zone, and the information included within the accepted Evaluation of the Mirabeau Point Evaluation and Habitat Management Plan. These revisions primarily focus on allowing limited development within the ponderosa pine woocilands on the Mirabeau site. • WDFW believes that paving within the fooipriiit of the existing trail within the ponderosa pine woodland will have a limited impact on the wildlife within that significant plant community type. No paving should occur within this habitat type off the existing soft paths. • Two new facilities (gazebo and Fort Mirabeau) will be constructed within the woodland. This should liave limited impact as long as the majority of these structures are constructed on sites where former Walk-in-the-Wild Zoo exhibits cunently exist. There should be limited disturbancc to existing native vegetation surrounding these two sites.
