Site Description: The subJect property is approxunately 7 3 acres in size The site is flat and
covered with weeds and other vegetation Heavy equipment stored on the site is enclosed in an
$-foot high cyclone fence
Surrounding Conditions: The land lying north of the srte is zoned Urban Residenhal-3 5
(tJR-3 5) and is developed with an elementary school and associated playground. The land 1}nng
south of the site across SR-290 is zoned Heavy Industnal (I-3), and includes undeveloped land,
railroad tracks and nght of way, and the Spokane Industnal Park The land lymg west of the site
is zoned UR-3 5 and includes single-family housing and undeveloped land The land 1}nng east
of the site is zoned I-2, pursuant to a recent rezone of 1 93 acres by the Examiner in File No
ZE-44-96, to allow development of a restaurant, retail sales, self-service storage and other I-2
uses Such land is currently developed with a residence and accessory structures, which will
likely be removed for site development under the I-2 zone
Rezone History of Site: In 1990, in File No ZE-16-90, the Board of County Commissioners
rezoned the current site to the I-2 zone of the Zoning Code, for development of miru-storage
warehouses and recreahonal velucles As support for the rezone, the decision noted the location
of such project along SR-290, the lack of ob1ection from adjoirung landowners, the relatively low
unpact of the proposed storage use, and substantially changed conditions in the area Changed
conditions referenced in the decision included the increase in auto and truck traffic along SR-
290, the increase in train traffic along the railroad line located on the south side of SR-290, and
the proximity of the srte to the expanding Spokane Industnal Park The decision luYUted signage
for such use to one detached advertlsing sign not to exceed 20 feet in beight and 40 square feet in
surface area, consistent with the I-2 zone signage standards at the time The decision fiuther
required, along the north and west property lines of the site, 30 feet of Type I landscaping, a 3-
foot hlgh berm and a sight-obscunng fence The site plan for such project also demonstrated 10
feet of Type II landscaping along the frontage of the srte with SR-290, but no sldewalk
Description of Applicafion: The applicant seeks a change of condihons to delete conditions
of approval found on page 2 of Commissioners Document No 90-1220, the Findmgs ofFact,
Decision, and Conditlons adopted on 10-9-90 in File No ZE-16-90 These condrtlons required
the applicant to develop the subject property in accordance with the site plan presented to the
County Heanng Exanuner Committee on 6-21-90 (dated 4-4-90), and linuhng use of the site to
development of miru-warehouses and RV-storage facilrties The apphcant proposed to develop
the site for a distnbution warehouse and office (7-Up), but did not submit a specific srte plan

III. FINDIiNGS OF FACT & CONCLUSIONS OF LAW
LAND USE ANALYSIS
A Approval cntena
The County Heanng Examiner Ordinance authonzes the Heanng Examiner to grant, deny
or grant with such conditions, modifications and restnctions as the Examiner finds necessary to
make a change of condrtions apphcation compahble with the Spokane County Generahzed
Comprehensive Plan and development regulations See County Resolution No 96-0171,
Attachment "A", paragraphs 7(d) and section 11 Development regulations include, without
limitation, the County Zomng Code, the State Environmental Policy Act (SEPA) and the
County's Local Environmental Ordinance (chapter 11 10 of Spokane County Code)
The County Zoning Code references change of conditions applications, but does not
establish specific cntena for approving such applications Zoning Code 14 504 040 requires that
an application for any significant change to the site development plan approved for a pnor
rezone, or to change the conditions of approval imposed on a pnor rezone, be approved by the
Heanng Body following a public heanng Zoning Code 14 402 120 references change of
condihon applications that pertain to a pnor rezone

Since a change of conditions applicahon modifies a pnor rezone achon, the cntena for
approving a rezone is generally applicable Section 14 402 020 of the Zoning Code authonzes
amendments to the Code based on any one of six (6) grounds, wlthout differenhatmg between
amendments to the zorung text of the code and amendments to tlle official zorung map Zonung
Code 14 402 020(1) authonzes the Code to be amended if it is " consistent with the
Comprehensive Plan and is not detnmental to the public welfare " Zorung Code
14 402 020(2) authonzes a Code amendment where " [c]hanges in economic, technological, or
land use conditions has occurred to warrant modificahon of th.is Code " These are the most
relevant cntena for consideration of a change of condrtions application
Zoning Code 14 100 104 states that Code provisions shall be interpreted to carry out and
implement the purpose and intent of the Comprehensive Plan, and the general plans for physical
development adopted by the Board of County Commissioners Zomng Code 14 100 106 states
that when the Zorung Code conflicts with the Comprehensive Plan or other adopted plans and
regulations of the County or other regulatory agencies, the more restnctive provlsions shall
govern to the extent legally permissible and the Zorung Code provisions will be met as a
mirumum
The Comprehensive Plan itself indicates that it should be used as a reference source and
guide for making land use decisions See Comprehensive Plan, p 2 The "decision guidelines"
set forth in the respective sections of the Plan are to be used as a guide to deternune whether or
not a particular proposal should be approved, conditioned or denied
In considenng a rezone application, Waslungton case law generally provides that (1) there
is no presumption in favor of the rezone, (2) the applicant for the rezone must prove that
conditions have substantially changed in the area since the last zonmg of the property, and (3) the
rezone proposal must bear a substantial relationslup to the publlc health, safety or welfare
Parkridge v Seattle, 98 Wn 2d 454, 462 (1978), and Bjarnson v Kitsap County, 78 Wn App
840 (1995)
General conformance with a comprehensive plan is usually required before a rezone can be
approved Citizens for Mount Vernon vCity of Mourtt Vernon, 133 Wn 2d 861, 873 (1997),
Cathcart v Snohomish County, 96 Wn 2d 2017 211-12 (1981) Some cases have dispensed with
the changed circumstances requirement where the rezone closely implemented the policies of the
comprehensive plan Bjarnson v Kitsap County, supra , Save Our Rurat Environment v
Snohamish Counry, 99 Wn 2d 363, 370-371 (1983), and Tugwell v Krttitas County, 90 Wn App
15 8, 951 P 2d 272 (1999)
Washington case law indicates that where a comprehensive plan conflicts wrth zoning
regulations, the provisions of the zomng code wlll usually prevail See Weyerhaeuser v Pierce
County, 124 Wn 2d 26, 43 (1994), and Cougar Mt Assocs v Ktng County, 111 Wn 2d 742, 755-
57 (1988), and Nagatani Bros v Commissioners, 108 Wn 2d 477,480 (1987)
A change of conditions is not a rezone, because it does not change the actual zone of the
property However, a change of conditions application may sigruficantly affect conditions of
approval, as well as the permitted uses, location of buildings, landscaping, condrtions of approval
and other features ln a site development plan, approved in conJunction with a pnor rezone The

changed condition applicatlon should be justified by the same changes that supported the onginal
rezone, as modified by any more recent changes in the area
B The vronosed chanize of conditions, as condihoned, generally conforms vnth the Spokane
Countv Generalized Comprehensive Plan, bears a substantial relahonship to and will not be
detnmental to the public health, safetv and eeneral welfare, and complies with tbe Spokane
Countv Zonine Code and other annlicable develonment reeulations
A change of condihons applicahon is required for the proJect, since the appilcant seeks to
change the conditions of the previous rezone and to eliminate the approved site plan from the
previous rezone See Zoning Code 14 504 040
The site and the area is designated in the Urban category of the Comprehensive Plan The
Staff Report found that the proposal generally conformed to the pollcies of the Urban category
The Urban category is mtended to provlde the opportunity for a"citylike" environment,
including a vanety of land uses served by a lugh level of public facihties and sernces It is
pnmanly a residential category of single-fanuly, two-family, multifamily and condomiruum
buildings, along with neighborhood commercial, llght industnal, public and recreabonal
facilities Comprehensive Plan, Section 1
The Urban category states that the more intensive uses such as llght industnal and
neighborhood commercial should be located near the heavily traveled streets, with the less
intensive uses such as residential isolated from the noise and traffic The Urban category
indicates that "major commercial user[s] would not be compatible within areas of the county
designated Urban"
Urban development is recommended in areas having adequate power supplies, water,
sarutary and storm sewers, and school and fire services, provided the other pohcies of the Urban
category are met Comprehensive Plan, Decision Guideline 1 1 1 Sidewalk facilities are
recommended along artenals connecting residential areas with commuruty facilities and/or
commercial areas Decision Gwdeline 15 3 Paved streets, street lights, underground utilrties
and public sewer are strongly encouraged in such category Decision Guidelmes 13 3, 1 5 3,
1 5 4, 1 5 5 The Urban category recommends that land use proposals identify and mitigate
sigiuficant adverse impacts on existing utilities and traffic systems, and conform to applicable
plans, policies and regulations adopted for such facilities Decision Guideline 16 1
The Urban category discourages residential areas in lugh noise areas Objective 1 5 d,
1 5 6 The Urban category recommends that buffenng and/or landscaping be used to mitigate the

The site is currently zone Light Industnal (I-2) Zoning Code 14 632 100 provides as
follows

The purpose of the I-2 zone is to meet the needs for industnal land
ident f ed in the Industrlal Category of the Comprehensive Plan
Industrial uses in this zone wrll include processing, fabrtcatcon, light
assembly, freight handlzng and similar operations, all of a non-offensive
nature It is the intent of the I-2 zone to allow for these uses by making
them compatible with surrounding uses General characterrstics of
these areas include paved roads and stdewalks, public sewer and water,
a full line of public services including manned fire protectron and publtc
transtt accessibilrty
The Board of County Commissioners recently amended the Industnal Zones Matnx, Zorung
Code Chapter 14 629, to allow several new commercial uses in the industnal zones of the Zorung
Code (County Resolution No 96-0787) In the I-2 zone, this includes certazn designated uses
as well as virtually all uses allowed in the Regional Business (B-3) zone, provided the
development standards of the B-3 zone are met This amendment recogruzed the need for a
broader range of commercial uses in the Industnal category to serve industnal uses m the I-2
zone
The applicant proposed to develop the site for a distnbution warehouse and office Such
proposed uses are allowed in all 3 industnal zones recognized by the County Zonmg Code, and
are no more intensive than the mini-warehouse and RV storage uses previously approved for the
site The I-2 zone does not implement the Urban category, but is implemented by the Industnal
category The land lying south of SR-290 across from the site is designated in the Industnal
category and is zoned Heavy Industnal (I-3) I-2 zone uses, includmg a restaurant, retail sales
and self-service storage, have been authonzed for the site located immediately east of the site,
which was recently rezoned to the I-2 zone The precedent has already been established for I-2
zorung on the site, based on the 1990 rezone of the subject property
The only industnal zone which may be mtended to implement the Urban category is the
Light Industnal (I-1) zone Zorung Code 14 630 100 However, the I-2 zone does contaul
restrictive development standards designed to make I-2 zone uses compatible with adjacent land
uses Further, the previous conditions of approval also require the applicant to insta1130 feet of
Type I(sight-obscunng) Iandscaping, a 3-foot high berm and a sight-obscuring fence along the
north and west boundanes adjacent to the site, where the ad}acent zorung is Urban Residential-
3 5(UR-3 5) and the adjoirung land uses are residenhal, school and undeveloped land This is
more intensive buffenng than required by the I-2 or I-1 zone, although the restnctive setbacks of
the I-1 zone were not imposed
The site is located along a busy state highway, where intensive land uses are considered
more appropnate by the Comprehensive Plan The stte is also served by a high level of public
services This does not include public sewer, but the project is required to be double-plumbed
for connection to the future area-wide sewer The subject property is located inside the County
IUGA regulations The intenm regulations adopted for such area do not restnct the approval of
change of condrtions applicatlons within the IUGA for projects that are not served by public
sewer and which do not lie within the County's 15-year sewer service area, such as the current
project

No public opposition was expressed regardmg project by neighboring property owners or
public agencies No deficiencies with regard to the ability of the project to comply wlth
development regulations have been estabhshed in the record The project has been condihoned for
compliance with the development standards of the I-2 zone and other applicable provisions of the
County Zorung Code, and the recommendahons of the commenting public agencies The Examl.ner
has updated certain conditions to reflect current standards and conditions
No public agencies objected to the DNS issued for the proposal by the County Division of
Building and Plazuung The proposal will not have more than a moderate effect on the quality of
the environment, and the Examuler concurs with issuance of the DNS The procedural
requirements of chapter 43 21 C RCW and chapter 11 10 of the Spokane County Code have been
met

In appl}nng the changed circumstances test, courts have looked at a vanety of factors,
including changed public opuuon, changes m land use pattems in the area of the rezone proposal,
and changes on the property itself The Zomng Code references changes in "econorYUC,
technological or land use conditions" as factors that will support a rezone Spokane County
Zorung Code Section 14 402 020 (2) Washuigton courts have not required a"strong" showing
of change The rule is flexible, and each case is to be judged on its own facts Bassani v County
Commissaoners, 70 Wn App 389, 394 (1993)
As stated previously, recent cases have held that changed circumstances are not required if
the proposed rezone implements policies of a comprehensive plan The project is at least as
consistent with the Urban category as the 1990 rezone proposal previously approved for the site
Changes have occurred in the area since the site was last zoned in 1990, including the
recent rezone of the site 1}nng east of the site to the I-2 zone for vanous commercial or hght
industnal type uses, increased traffic along SR-290, increased population growth in the East
Valley area of the County, and designation of the site inside the County's IUGA boundanes
IV. DECISION
Based on the above Fmdings of Fact and Conclusions of Law, Board of County
Commissioners conditions #1 and #2, on page 2 of Commissioners Document No 90-1220, the
Findings of Fact, Decision, and Condihons adopted on 10-9-90 in File No ZE-16-90, are hereby
deleted as rezone conditions binding slte development The change of conditions application is
hereby approved, subject to the conditions of approval of public agencies stated below Any
conditions of such agencies which have been added or significantly revlsed by the Heanng
Examiner are italicized
Failure to comply with the conditions of this approval may result in revocatlon of this
approval by the Heanng Examiner This approval does not waive the applicant's obligation to
comply with all other requirements of other agencies with junsdiction

SPUKANE COUNTY DIVISION OF CURRENT PLANIVING
1 All conditions imposed by the Heanrig Exammer shall be binding on the "Applicant",
which term shall mclude the owner(s) and developer (s) of the property, and their heirs, assigns
and successors
2 The proposal shall comply with the Light Industnal (I-2) zone and other applicable
provisions of the Spokane County Zorung Code, as amended
3 The project shall be luruted to one detached advertising sign, 20 feet lvgh and 40 square
feet in surface area
4 Thirty (30) feet of Type I landscaping, a 3-foot berm and a sight-obscunng fence shall be
installed along the north and west property lines
5 Approval is required by the Director of the Division of Current Plannmg designee of a
specific lighting and sigrung plan for the descnbed property, pnor to the release of any building
permits
6 Direct light from any extenor area lighting fixture shall not extend over the property
boundary
7 A specific landscape plan, planting schedule and provlsions for maintenance acceptable to
the Director of the Division of Current Planning/designee shall be submrtted with a performance
bond or other suitable guarantee for the project pnor to release of building permits Landscaping
shall be installed and maintained so that sight distance at access pQints is not obscured or
impaired
8 The applicant shall develop the subject property generally in accordance with the concept
presented to the Heanng Examiner at the public heanng Vanations, when approved by the
Planning Director/designee, will be pernutted in accordance with Section 14 504 040 of the
County Zotung Code, as amended All vanations must conform to the conditions of approval,
the County Zorung Code, and other applicable development regulations Any other modification
must be presented to the Hearing Examiner for review and approval as a change of conditions
9 The applicant shall submit a specific development plan to the Division of Current Planrung
for review and approval pnor to the issuance of building pernuts
10 The applicant shall comply with `208' recommendations concerning stormwater runoff and
provide necessar}r landscaping for runoff
11 Any division of land for the purpose of sale, lease or transfer, shall comply with RCW
58 17 and the Spokane County Subdrvision Ordinance pnor to issuance of building permits
12 The Division of Current Planning shall prepare and record with the Spokane County
Auditor a Title Notice noting that the property in question is subject to a vanety of special
conditions imposed as a result of approval of a land use actlon This Title Notice shall serve as

The parcel of property legally described [ J of Section 1, Township 25
North, Range 44 EWM, in Spokane County, Washington, is the subject of a land use action
by the Spokane County Hearing Examiner on February 23, 2000 imposing a variety of
special development conditions. File No. ZE-16A-90 is available for inspection and copying
in the Spokane Division of Current Planning.
13 The Division of Current Planning sha11 file wlth the Spokane County Auditor, within the
same time frame as allowed for an appeal from the final disposition, including lapsing of appeal
penod, a Title Notice, wluch shall generally provide as follows
"Pnor to the issuance of any building pernut for any bwlding or any use on the property
descnbed herein, the applicant shall be responsible for complying with the provisions of the
Zomng Code for Spokane County, Section 14 706 (Aquifer Sensitive Area Overlay Zone) The
property whlch is the subject of this notice is more particularly descnbed as follows [
DIVISION OF BUILDING AND CODE ENFORCEMENT
1 The applicant shall contact the Drvision of Bwlding at the earliest possible stage of
design/development in order to be mformed of Code requirements adrrurustered or enforced by
the division, e g, State Building Code Act regulations such as requuements for fue hydrant/flow,
fire apparatus access roads, street address assignment, bamer free regulahons, energy code
regulations, and general coordination with other aspects of project implementation
2 The issuance of building permits is required
3 Reqwrements of Fire Distnct 1 need to be satisfied duruig the building pernut process
4 Applicant should contact the Building Department regarding area separation walls and fire
requirements
SPOKANE COUNTY DIVISION OF ENGINEERING
Prior to release of a building permit or use of property as proposed:
1 Access permits and improvements to State Highway 290 (Trent Avenue) must be approved
by the Washington State Department of Transportation (W S D O T)
2 The applicant shall submit for approval by the Spokane County Engineer and the Spokane
Regional Health Distnct a detailed combined on-site sewage system plan and surface water
disposal plan for the entue project, or portion thereof if the development is phased
3 A parking plan and traffic circulation plan shall be submitted and must be approved by the
Spokane County Engineer The design, location and arrangement of parking stalls shall be in
accordance with standard traffic engineenng practices Paving or surfacing, as approved by the

County Engineer, will be required for any portion of the project which is to be occupied or
traveled by vehicles
4 All requlred improvements shall conform to the current State of Waslungton Standard
Specifications for Road and Bndge Construction and other appllcable County standards and/or
adopted resolutions pertairung to Road Standards and Stormwater Management in effect at the
date of constructlon, unless otherwise approved by the County Engineer '
5 Roadway standards, typical roadway sections and drainage plan requuements are found
in Spokane County Resoluhon No 95-0498 as amended and are applicable to this proposal
SPOKANE REGIONAL HEALTH DISTRICT
1 A combined surface water and sewage disposal detailed plan shall be approved by the
Spokane County Engineer and Spokane Regional Health Distnct pnor to the issuance of any on-
site sewage disposal permit or building permit for this project
2 The sewage disposal method shall be as authonzed by the Director of Utilities for Spokane
County
3 Water service shall be coordinated through the Director of Utilrties for Spokane County
4 Water servxce shall be by an existing public water supply when approved by the Regional
Engineer (Spokane), State Department of Health
5 The disposal of sewage effluent beneath paved surfaces is currently prohibited
6 Subject to specific application approval and issuance of permits by the Health Officer, the
use of an individual on-srte sewage disposal system may be authonzed Note A maxunum
density of 3,600 gallons of wastewater per acre of gross land area shall be allowed
7 The use of pnvate wells and water systems is prohibited
SPOKANE COUNTY DIVISION OF UTILITIES
1 Pursuant to the Spokane County Sewer Code, the use of on-site sewer disposal systems is
hereby authonzed This authonzation is conditioned on compliance with all rules and
regulations of the Spokane County Health Distnct and is further conditioned and subject to
specific application approval and the issuance of permits by the Health Distnct
2 A covenant agreement shall be signed by the owner of the site stating The Owner(s) or

THIS MATTER, Being the consideration by the Board of County Commissioncrs
of Spokane County, hereinafter referred to as the "Board" of an appeal of the
Spokane County Zoning Hearing Examiner CommittEe Decision of June 22, 1990,
denying the zone reclassification, ZE-016-90 from Agricultural (A) to Light
Industrial (I-2), for the purpose of developing mini warehouses and RV
storage facilities, hereinafter referred to as the "Proposal", and the Board of
County Commissioners having held a public hearing on July 24, 1990, and
having fully considered all testimony presented thcrcat, and further having
individually visited with the site and vicinity in question, and having
rendered a decision on the 7th day of August, 1990, approving said appcal, docs

FINDINGS OF FACT
1 That the proposal is generally located north of and adjacent to Trent Road,
approximately 250 feet west of Flora Road in the Spokane Valley, in thc NE
1/4 of Seetion 1, Township 25 North, Range 44 EWM, Spokane County,
Washington
2 That the June 21, 1990 Planning Report, the staff presentation, and all
other testimony was considered at the public hearing
3 That the June 22, 1990 Hearing Examiner Committce Findings and Ordcr
were considered
4 That the file for Zone Reclassification ZE-016-90, from Agricultural (A) to
Light Industrial (I-2) was available for considEration by the Board
S That the Spokane County Hearing Examincr Committee held a public
hearing on June 21, 1990, concerning the proposal, subsequent to which by
Findings of Fact, Decision and Order datcd June 22, 1990, the proposal was
denied
6 The adopted Spokane County generalizcd Comprchensive Plan designates
the subject property as Urban The project is consistent with the
characteristic features of the Urban category which is intended for the
purpose of developing a"citylike" environmcnt which includes various
land uses, intensive residential development, and more intensive
neighborhood commercial, light industrial, and public and recreational
facilities More intcnsive land uses such as light industrial and
neighborhood commercial are to be located near heavily travelcd strccts
7 That the existing land uscs in the area of thc proposal include s,ngle
family residential, Skyview Elementary School, railroad right of way and
Spokane Valley Industrial Park
8 That a Determination of Nonsignificance (DNS) was issued for this project
pursuant to the State Environmental Policy Act on June 1, 1990 This
determination was circulated to eight other agcncics for comment No
agency contested the DNS The Board concurs with the DNS issued for this
project
9 The owners of adjacent properties expressed approval of the proposed zone
reclassification
10 The proposed land use is the most compatible and at the same time least
intrusivc upon the surrounding area
11 The applicant has demonstrated changed conditions in the area since the
subject property was originally rcLoncd Changed condilions includc
increase in auto and truck traffic on Trent Avenue, increase in number of

AGRICULTLTRAL TO LIGHT INDUSTRIAL
APPLICANT: CARROL KNUTSEN
After considering all public testimony and exhibits submitted
to the Board of County Commissioners at public hearing held on
July 24, 1990, on the appeal by Mr. Knutsen of the Hearing
Examiner Committee's denial of a rezone from Agricultural to Light
Industrial, I hereby move that the appeal be granted.
In granting the appeal, I am limiting approval to the
construction and operation of mini-warehouses and recreational
vehicle storage facilities only.
Use of the sub3ect property for mini-warehouses and RV
storage facilities is an allowable use in the I-2 Zone and is
consistent with the characteristic features found in the Urban
Category of the Comprehensive Plan. Changed conditions since the
subject site was originally zoned include increases in heavy
truck traffic on Trent, the number of trains on the BN mainline,
and the proximity of the sub3ect site to the Spokane Industrial
Park which is increasing in size. The benefit of the rezone to
the public welfare is evidenced in part by the favora.ble testimony
of surrounding landowners. The proposed use is most compatible
and at the same time least intrusive upon the surrounding area.
I would request that the Planning Department prepare Findings
of Fact and a Decision ref lecting this motion as well as including
the conditions of approval recommended by the various County
departments, to be presented to the Board at a subsequent public
meeting.

History:
This site was considered for a zone change to the Resmcted Industnal in November
1982 The Hearing Exarniner Corrunittee denied the Restncted Industnal request but
approved Local Busmess Zonmg The applicant appealed the Local Business Zone
approval to the Board of County Commissioners Legal council advised the Board
that approval to Local Business was invahd for a vanety of reasons but pnmanly
because legal notaces dhd not advernse for Local Business Zorung and the uses
permitted in the Local Busuiess Zone were substantially different from those allowed
in the Restncted Industnal Zone The Board of County Comnussioners, after public
testunony, denied the restncted Industnal Zone finduig that industnal zoning along
the north side of Trent Road was not justified at that ame and the intent of the
Comprehensive Plan was to dLscourage stnp development along Trent Avenue m this
area. Industnal zomng was not compatible at that tune vvith existing uses in the area,
espemally the residenaal uses to the north The proposed industnal zoning would

was added to the proposal which basically resulted in a new zoning proposal, File
No. ZE-14-82 The conditions of approval recognized the sensinvity of the
residential character for this area by requmng sigtuf'icant landscapmg, berrrung and
site plan onentaaon to buffer unpacts. The decision stated that this approval was not
to be considered as a precedent for future proposals.

I V. SEPA ENVIRONMENTAL REVIEW
An Environmental Checklist was subnutted by the sponsor and was reviewed by the
County Planning Deparanent. The review considered the specifics of the proposal,
other available information, County ordinances, other regulations and laws, possible
standard Condiaons of Approval, the Generahzed Comprehensive Plan, and other
County golicies and guidelmes The Planning Department has deternuned that "No
probable significant adverse unpacts" would result from the proposal being developed
and has issued aDeterminanon of Nonsigmficance ("DNS")
The "DNS" was cuculated to eight other agencies of junsdiction and other agencies/ -
departments affected by the future development for review and comment The
"DNS" comment penod ends June 19, 1990 and was advernsed 15 calendar days
before said date in the newspaper, by letter to adjacent property owners within 400
feet of the proposal, and by nonce on a sign posted on the proposal site The Heanng
Examiner may consider addiaonal envuonmental related tesamony at the public
heanmg.
V . PLANNING DEPARTMENT SUMMARY
The Planrung Department recommends denial of the proposal based on the analyses ,
set forth in this report which summanzed are• conflicts with adjacent land uses,
incompaubility Wnth the Comprehensive Plan's guidelines for future growth, and the
aming issue that approval of this zone change will set a precedent for future uses to
be sirrular in nature to industnal zones And lasdy, that the Urban category does not
encourage stnp development along this pomon of Trent Road.
V I. CONDITIONS OF APPROVAL
i. All Conditions imposed by the Hearing Examiner Committee shall
be binding on the "Applicant," which term shall include the owner
or owners of the property, heirs, assigns, and successors.

COUNTY UTILTTIES DEPARTMENT

of on-site sewer disposal systems is hereby authonzed. This authonzation is
conditioned on compliance with all rules and regulaaons of the Spokane County
Health Distnct and is further condiuoned and subject to specific applicaaon
approval and issuance of permits by the Health I?istncL

COUNTY BUILDING AND SAFETY DEPARTMENT
1. The apphcant shall contact the Deparnnent of Building and Safety at the earhest
possible stage of design/development in order to be informed of Code requirements
admimstered/enforced by the department, e g, State Bwlding Code Act regulanons
such as requuements for fire hydrant/flow, fire apparatus access roads, street
address assignment, bamer-free regulations, energy code regulaaons, and general
coordination with other aspects of project unplementation.

the property to the south
Backqround
Division of Building and Planrnng staff held a buildmg permit pre-application conference with the applicant, at
which time the applrcant was informed that a change of conditions was required in order for the properly to
be used for any use other than minNwarehouses and RV storage faciliUes An applicabon for a change of
conditions was submitted on September 16, 1997
The property was onginally zoned Agncuitural (A) under the, now expired, Spokane County Zoning
Ordinance This site was considered for a rezone from Agncultural (A) to Restncted Industrial (RI) m 1982
The Heanng Exarniner Committee denied the request and instead approved Local Busmess (LB) zoning for
the property On appeal to the Board of County Commissioners, the Board denied the Local Business (LB)
zone because the county's legal counsel advised the Board that it was unlawful to approve a zone
ciassification that was not requested in the application or mcluded in the legal notice The Board considered
and denied the request to the Restncted Industnal (RI) zone
A subsequent zone reclassification request from Agncultural (A) to Light Industnal (I-2) was made in 1990
(File No ZE-16-90) The request was derned by the Heanng Exammer Committee, but was overtumed and
approved on appeal to the Board of County Commissioners The Board imposed addiUonal conditions in the
rezone approvai such that the applicant develop the property m compliance v+nth the site plan presented to
the Hearing Examiner Committee on June 21, 1990, and that use of the property be limited to mmi-
warehouses and RV storage facilities It is these two condiUons that the appiicant is requesbng to have
deleted The applicant now mtends to use the property for a distnbution warehouse and office
Staff AnalVsis.
The proposal is located within the Urban Comprehensive Plan category The Urban category is mtended to
provide the opportunity for a°ciry-like" environment, inciudmg a vanety of land uses served by a high levei of
public facilities and services It is pnmanly a residential category of single-family, two-famdy, multi-family,
and condomirnum buildings, along wah neighborhood commercral, light industrial, public and recreational
facilities The Urban category states that the more intensive uses such as light rndustnal and neighborhood
commercial should be located near the heavily traveled streets, with the less intensive uses such as
residenUai, isolated from the noise and traffic The Urban category mdicates that buffenng, screening or
other performance standards may be required to make potenUally conflrcbng land uses compabble
The proposed change of conditions is generally consistent with the Urban category The proposed light
industnai uses are located adjacent to a heavily traveled street State Route 290 Additionai buffenng and
landscaping wili be installed to help mitigate impacts to adJacent land uses per the Board of County
Commissioner's decision and conditions of approvai dated October 9, 1990 Thirty feet of Type I
landscaping, a three (3) foot high berm, and a sight obscuring fence are required along the site's north and
west property lines As conditioned, adequate buffering and screernng will be provided
Detailed review for compiiance with parking, setbacks, lightmg, buildmg height and other development
standards wiil occur dunng the building permit process

in review of the requested change of conditions for the proposed 7-UP
warehouseJdistn'butioo facibty at Trent and Flora, the Washington State Department of
TransportaUon (WSDOT) has the following comments
1 Based on projected traffic counts provided by the appLcant, left turn channehzahon
on Trent Avenue at the proposed access to Trent will be requved This
channeLzation wlll need to be designed and constructed to the appropnate WSDOT
specifications by the appLcant pnor to the occupancy of the budding An alternative
to tlvs would be if access easements can be secured from the adjacent property
owner to allow access directly to Flora, then left turn restnctions can be unposed on
the duect access to Trent With left turn restrictions in place, the above mentioned
left turn lane would not be needed
2 Pnor to the issuance of building pernuts for this srte the applicant shall apply for and
obtain vaLd WSDOT road approach pernuts for all duect access to Trent Tlus site
vnll be Lnuted to one direct access on this property, plus the one shared approach to
ihe McPhee property to the east, provided easements can be obtained
3 Drasnage facthties and any signs adjacent to Trent Avenue will need to be reviewed
by WSDOT
