Access permits for approaches to the County Road System shall be obtained from the Spokane County Engineer. 2. Proposal• A request to rezone an approximate 1.3 acre site from Two-Family Residential (R-2) to Multiple Family Suburban for the purpose of developing four lots into six-plex structures with 24-units total. A request for a Variance from Section 4.07.130-(c) of the Spokane County Zoning Ordinance to allow a 27-foot Front Yard Setback, whereas the Spokane County Zoning Ordinance requires a 30-foot Front Yard Setback. SITE ANALYSIS Comprehensive Plan: MAJOR COMMERCIAL and URBAN Categories - Inside General Sewer Service Area (GSSA) Boundary - Inside Priority Sewer Service Area (PSSA) Boundary - Inside Urban Impact Area (UTA) Boundary The project is within two Comprehensive Plan categories. The line between the Major Comerci al and Urban categori es i s general ly al ong the al ignment of Rockwell Avenue. The Comprehensive Plan Text indicates multiple family developments may be compatible in the Major Commercial category through the use of proper screening and performance standards; but the predominate development will be shopping centers, comercial strips and freeway commercial. The Urban category recommends a residential density range from 1 to 17-units per ac re. The proposed density is 16.86 units per acre. Higher densities are to be located with direct or near direct access to major arterials, be on public transit routes, serve as a transitional use and have urban services available. Adjoining Streets: Rockwell Avenue travels through the site and is a 50-foot County right of way improved with 2 lanes gravel. Best Road to the east of the site is a 40 to 50- foot County right of way improved with 2 lanes paved. Proposed Site Plan. Use: Six-Plex Apartment Building Proposed Buildings: Four (4) Site Coverage: 50 % Maximum Structure Height. 2-1/2 Stories/28 Feet Building Setbacks: PROPOSED REQUIRED - Front Yard 27' 30' Note: The applicant is requesting a Variance to the required Front Yard Setback. Proposed Buffering Techniques: Site plan indicates a 6-foot wooden fence around all four lots in compliance with the Zoning Ordinance. Berming and landscaping are proposed within the side and front yards. The garages are proposed at the rear lot lines. Other Site Plan Considerations: The submitted Environmental Checklist indicates a 50% structure coverage, the Multiple Family Suburban Zone requires 65% of the site remain in open space. note. - The site plan submitted for review by the Zoning Hearing Examiner Committee is general in nature. SITE DEVELOPMENT RECOMMENDATIONS Density: Proposed density of 16.86% is greater than the immediate areaa Multiple Family Suburban zoning is found approximately 700 feet to the east. Design: The Health District advises that there appears to be insufficient space available for on-site sewage disposal systems serving the structures as depicted on the site plan. Landscapin Q/-Bu~fferinq: Due to the proposed 2-1/2 story structures, a aense mix o~ ow-iying and tall growing landscaping is recommended along all property lines. Circulation/Access: Access to the site is via Best to Rockwell Avenue. Stormwater Drainage: Comply with '208' stormwater regulations. Sewage Disposal: This area is designated as a"nitrate hot spot" by the Environmental Protection Agency. A pressurized on-site sewage disposal system is planned by the developer. County Utilities is requiring double-plumbing specifications be approved prior to application for a septic tank permit. Water Supply: Trentwood Irrigation advises adequate mains for fire hydrants shall be required. Fire Protection: Proposed garages need one hour rated burning wall and ~ TO parapet. a Critical Materials/Use Activity: Compliance with Aquifer Sensitive Area Overl ay Zone. IV. SEPA ENVIRONMENTAL REVIEW An Environmental Checklist was submitted by the sponsor and was reviewed by the County Planning Department. The review considered the specifics of the proposal, other available information, County ordinances, other regulations and laws, possible standard Conditions of Approval, the Generalized Comprehensive Plan, and other County policies and guidelines. The Zoning Administrator has determined that "No probable significant adverse impacts" would result f rom the proposal being developed and has issued a Determination of Non-Significance ("ONS"). ~ s r ZONE RECLASSIFICATION N0. SEPA ENVIRONMENTAL REYIEW (continued) The "DNS" was circulated to ten other agencies of jurisdiction and other agencies/departments affected by the future development for review and comnent. The "DNS" comment period ends J uly 2, 1985, and was advertised 15 calendar days before said date in the newspaper, by letter to adjacent property owners within 400 feet of the proposal, and by notice on a sign posted on the proposal site. The Hearing Examiner Comnittee may consider additional environmental related testimony and the "DNS" at the public hearing. V. PLANNING SUMMARY That al though the project i s consistent wi th the Major Commerci al and U rban categories of the Comprehensive Plan, it appears that the density is greater than the nearby surrounding areas. The apartment structures will serve as a suitable transitional use to future commercial uses along T rent; but at the present, these are more than 150-feet to the south. Tall growing landscaping will help reduce the impact to adjacent single family residences of the proposed 2-1/2 story apartment structures. VI. CONDITIONS OF APPROVAL (Al1 Conditions imposed by the Zoning Hearing Examiner Committee shall be binding on the "Applicant", which term shall include the owner or owners of the property, heirs, assigns, and successors.) a) COUNTY PLANNING DEPARTMENT 1. That a dense landscape strip of low lying and tall growing vegetation be provided as a screen around the building for privacy to adjacent uses. 2. That a 6-foot wooden fence be provided on all property lines but not within the front yard setback area. 3. The Zoning Administrator shall approve a specific exterior lighting plan for the approved area prior to installation of such lighting. (Such plan shall attempt to confine illumination to the area with full consideration to adjacent properties). 4. A specific landscape plan, planting schedule and provisions for maintenance acceptable to the Spokane County Zoning Administrator shall be submitted with a performance bond for the project prior to release of building permits. VE-70-85 a) COUNTY PLANNING DEPARTMENT (continued) 5. The applicant shall develop subject property generally in accordance within the concept presented to the Hearing Examiner Committee. Yariations when approved by the Zoning Administrator will be permitted, including, but not limited to the following changes: Building location, landscape plans, and general allowable uses of the permitted zone. All variations must conform to regulations set forth in the Spokane County Zoning Ordinance. The original intent of the development plans shall be maintained. 6. The specific development plan will be submitted for Planning Department review and approval prior to issuance of building permits. 7. Al1 current standards of the Multiple Family Suburban Zone, as amended, shall be complied with in the development of this site. 8. That the project i s subject to Secti on 4.16A.050, the Aqui fer Sensitive Area Overlay Zone of the Spokane County Zoning Ordinance, which sets forth various measures for Aquifer protection; specifically, measures dealing with wastewater disposal, spill protection measures, and stormwater runoff. 9. Any divi si on of 1 and for the purpose of sal e, 1 ease or transfer, shall comply with RCW 58-17 and the Spokane County Platting Ord,ihances prior to issuance of building permits. 10. That the provisions of SEPA's NOTICE OF ACTION pursuant to Chapter 43.21C.080 RCW and the Board of Spokane County Corrrni ssi oners Resol uti on #77-1392 be i ni ti ated by the project applicant within thirty (30) days of final disposition of this application, and prior to any on-site improvements. 11. Pursuant to the provisions of Chapter 43.21C RCW, the SEPA Guidelines (WAC 197-10) and the Spokane County Environmental Ordinance (SCEO), a proposed declaration of non-significance has been lssued at least fifteen (15) days prior to this date, the official file, written comments and/or public testimony contain information regarding assessment of the proposal's likely significant adverse impacts to the physical environment; a finding is hereby made that no probable significant adverse impacts upon the physical environ ment are anticipated as a resul t of the project, and a fi nal decl arati on of non-significance is hereby to be issued. ~ i ZONE RECLASSIFICATION N0. Pursuant to Board of County Commissioners Resolution No. 80-0418, the use of on-site sewer disposal systems is hereby authorized. This authorization is conditioned on compliance with all rules and regulations of the Spokane County Health District and is further conditioned and subject to specific application approval and issuance of permits by the Health Di strict. 2. The owner(s) or Successor(s) in interest agree to authorize the County to place their name(s) on a petition for the formation of a ULID by petition method pursuant to RCW 36.94 which the petition includes the Owner(s) property and further not to object by the signing of a protest petition against the formation of a ULID by resolution method pursuant to RCW Chapter 36.94 which includes the Owner(s) property. PROVIDED, this ~ condition shall not prohibit the Owner(s) or Successor(s) from objection to any assessment(s) on the property as a result of improvements called for in conjunction with the formation of a ULID by either petition or resolution method under RCW Chapter 36.94. 3. Any water service for thi s project shal l be proi ded i n accordance with the Coordinated Water System Plan for Spokane County, as amended. 4. Each dwelling unit shall be double-plumbed for connection to future areawide collection systems. 5. Plans and specifications for the double plumbing are to be reviewed and approved by the Utilities Department prior to making application for a septic tank permit. d) COUNTY HEALTH DISTRICT 1. A combined surface water and sewage disposal detailed plan shall be approved by the Spokane County Engineer and the Spokane County Health District prior to the issuance of any building permi t for thi s project. 2. Subject to specific application approval and issuance of permits by the Health Officer9 the use of on-site sewage systems may be authorized. 4. Water service shall be coordinated through the Director of Utilities, Spokane County. 5. Water service shall be by an existing public water supply when approved by the Regional Engineer (Spokane), State Department of Social and Health Services. 6. Use of private wells and water systems is prohibited. 7. Disposal of sewage effluent beneath paved surfaces is currently prohi bi ted. 8. Note: There appears to be insufficient space available for on-site sewage disposal systems serving the structures as depicted on the site development plan. e) COUNTY BUILDING AND SAFETY DEPARTMENT l. The site is located in Fire District # 1. 2. Approved numbers or addresses shall be placed on all new and existing buildings in such a position as to be plainly visible and legible from the street or road fronting the property. Said numbers shall contrast with their background. 3. Trash enclosures shall not be located adjacent to combustible construction or underneath windows or nonprotected eaves. 4. Building permits will be required for each structure. 5. Each structure shall be accessible to fire department apparatus by way of access roadways with all-weather driving surface capable of supporting the imposed loads of fire apparatus. The minimum paved roadway width, inside curb face to inside curb face, shall be twenty-four (24) feet with no parking. Parallel parking is permitted on one side with road widths a minimum of thirty (30) feet. Parallel parking is pemitted on both sides with road widths a minimum of thirty-six (36) feet. Signs noting such is required for fire lane. The turning radius of private roadways and drive aisles shall be a minimum of twenty (20) feet inside and a minimum of forty-five (45) feet outside to the curb face. Cul de sacs more than six hundred (600) feet from the center line of the nearest cross street shall have a minimum radius of thirty-seven (37) feet, six (6) inches (75 feet diameter). /o . Fire hydrants which meet the fire flow are required to be installed prior to any construction. These hydrants shall be placed so that no portion of the building exterior is more than 175 feet from the hydrant. The bottom of the 1 owest outl et of the hydrant shall be no less than 18 inches above grade. This wall will be required to be 30" (Parapet) above ga rage roofs. f) WATER PURVEYOR l. Water Purveyor is 7rentwood Irrigation District #3, and they will supply the site with adequate water for domestic, fire and irrigation uses, but indicate that adequate mains need to be provided. g) COUNTY AIR POLLUTION CONTROL AUTHORITY l. Air pollution regulations require that dust emissions during demolition, excavation and construction projects be controlled. This may requi re use of water sprays, tarps, spri nkl ers, or suspension of activity during certain weather conditions. Haul roads should be treated and emissions from the transfer of earthen material must be controlled as well as emissions f rom all other construction related activities. 2. Measures must be taken to avoid the deposition of dirt and mud f rom unpaved surfaces onto paved surfaces. If tracking or spills occur on paved surfaces, measures must be taken immediately to clean these surfaces. 3. All travelled surfaces (ingress, egress, parking areas, access roads) must be paved and kept clean. Rockwell should be paved pri or to or as part of any approval of thi s project. 4.
