The site is generally located noith of and adjacent to Trent Avenue (SIZ-290), approximately 250 feet east of Ellen Raad, i.n the NW'/4 of Sechon 2, Township 25 North, Range 44 EWM, S,pokane County, Washingfion. The site addl=ess is 14523 E. Trent Avenue. 3. The site~ is currentlyreferenced as County Assessor''s tAx parcel no. 45022.5803. The site is legal.ly described as Trentwood O,rchards Replat of Lot 1, Block 1, EXGL-UDZNG,the east SO feet, per glat recorded at Book 14, Page 96 of P1at, records of Spokane County Audiidr, in Spokane Counfiy, Wasliington. 4. Tlae applicant is CLC Associai:es, c/o Jason Langbehn, 707 W. 7ffi Avenue, Suite 200, Spokane, WA. 99204. The 1ega1 owner of the site is Horizon Credit Union, c/o Tom DiLuzio, 14523 E. Trent, Spokane, W'A 99216. 5. The Hearing Exam.iner heard the appli,cation pursuant to fihe- Couvt.y Hearuag Examiner Ordinance (Couniy Resolvtian IrTo. 96-0171) aad the CountyHearing Examiner Rules of Procedure (County IZeso]'uti.on No. 96-0294). 6. The Hea.r-ing Examin.er conducted a public hearing on the proposed rezone-on September 18, 2002. The requirements for notice of public hearing were met. The Hearing- Examiner -ta.kes notice of the Cou.nty Comprehensive Plan (now expired), Gounty C7MA Comprebensive Plan aad Capifial Facilities Plan, Pbase I Development Regulations, County reso,lutions r.ecited in th.is decision, County Zoning Code, County Code, other applicable dev-elopment regulations, and prior land use decisions in the vicinitp., 10. The record includes the documents in the project file at the time of the public heari.ng; the documenfis and testimony submitted at the public hearing, and the items talcen notice of by the 1Iearing Examin er. 11. The subject pronerty is approxunately 1.66 acres in size, relatively flat in fopography and currently ixnproved with a 10,349 square foot building housing the Horizon Credii Union. A 17- foot high monument sip is located ai the enY:rance to the site, in the northwest corner of the site along SR 290. The site is served by publ.ic water and an on-site sewage disposal- system. 12. Tlie rezone application and site plan of record for the proposal were submitted on July 24, 2002. 'I'he site plan_illustra'tes the exisfiing cred.it union buildi.ng: on the site and a proposed pole sign, wluch will-replace the existing nlonument sign i.n the same location. The pole sign has a ni..aximum height oF26 feefi, a maximum widtb of 13.5 feet and an area of 185 square feet. See sign detail plan submitted on 5-1-02. 13. Lffective Tanuar.y 1, 199 L, the zoning of the site was reclassified fram its zon.ing under the -n.ow expixed Count}f Zoning Ordinance-to theUrban Residential-3.5 (UR-15) zone, under the I'rogram to Implement the Spokane County. Zoning Code. 14. Effective Tanuary 15, 2002, the County implementecl a new comprehensive plan ("CrMA Comprehensive=Plan"), Capita.l Facilities Plan, County 1Jrban Growth Area (UGA) boundaries, and Phase T Development Regulations; al.l pursuant to the StateGrowth Management Act (GMA.). The County, also repealed the iuterim development regu.lations previ.ously adopted by the Couaty under the State C'nowth Management Act. See County Resolution No. 2-0037. Minor revisions-were made fo the Phase I Development Regulations on May 7, 2002. See County Resoluti_on No. 2-0470. 15. Tl1e site a.nd neighbori.ng land are designated in the County UGA. The Phase I Development Reguaation,s designate the site, -and, the land .located along and near SR-290 in the -vicinity, in the Mixed YTse czitegory of the GMA Comprehensive Plan. Such r-egulations retained ibc existing zoni_ng of such land, which xs dominated by B-2 and Regional Business (B-3) zoning, and coinrnercial uses. The land Iying directly west of the north half of the site is -zoned UR-22, owned by the owner of the site, a.nd undeveloped. 16. On aJecember 9, 1999, the zoning of .8 acres located approximately one-fourkh (1%4) mile east of the site along SR 290 was reclassified .fzom the B-2 ajzd B.3 zoue to the B-3 Zone, for devcloprnent of a 50-unit self-service storage facility. See decision in File No. ZE-42-97. 17. The Phase 1. Devetopment Regulafions designate the land lying norrher_ly of the siCe .ixi the of the GMA Comprehensive Plan, and refiained the existing Low Densiry Rcsidential cafegory tuban xesidential zoning of the site and neighboring properlies. The land lying immediately HE Fiuduigs, Conclusions and Decision ZE-12-02 Page 2 ✓ ~ north of the site is zoned UR-22 and is developed as a manufactured home park. The other land lying northerly of the site is dominated by single-family homes on various sized lots or parcels. 18. The Phase I Development Regulations designate the land lying south of the site across SR- 290 in the Heavy Industrial category, and retained the Heavy Industrial (I-3) zoning of such land. The land lying to the south consists of a railway right of way, undeveloped land and an aluminum rolling plant. SR-290 is a 5-lane state highway in the vicinity. 19. The Staff Report sets forth applicable policies of the Mixed Use category of the GMA Comprehensive Plan. Such policies generally depend on the adoption of a subarea plan that involves input from design professionals, government service providers, business people and community residents. The timing of such subarea planning has not been established. 20. Policy UL.5.2 of the GMA Comprehensive Plan designates an aesthetic corridor along SR- 290, and other major transportation categories in the county, which corridors are intended to provide a positive image of the Spokane Region. Such corridors are to be visible from the roadway and cannot exceed 500 feet on either side of the road. Policy UL.5.3 recommends that specific regulations be adopted for designated aesthetic corridors that provide incentives for aesthetic design, require landscaping buffers adjacent to roadways, limit sign height and size, provide performance standards to adequately screen heavy industrial uses, and use non-glare, energy efficient lighting techniques when possible. 21. Policy UL.5.5 recommends that standards be established for the scale and intensity of commercial signs, which protect views and minimize signage clutter while still allowing adequate business identification. 22. The County recently revised its sign regulations, including signage in the B-2 zone. Restrictive signage was adopted for certain transportation corridors designated as aesthetic corridors. This did not include SR-290. See County Resolution Nos. 2-0188, 2-0315 and 1- 0733. 23. The B-2 zone is an implementing zone for the Mixed Use category under the Phase I Development Regulations. The proposed sign is consistent with newly established signage standards adopted by the County. 24. The Phase I Development Regulations prohibit the approval of new development within the UGA unless the proposal can demonstrate the availability of public water and sewer services through the connection to a fully operational public sewer at the time of occupancy or through location within the County Six-Year Sewer Capital Improvement Program. The site is not located in the 6-year plan area, and is located in the 20-year sewer planning area. See Capital Facilities Plan, Valley Sewer Project Priority Areas map. 25. "New development" for the purpose of the_sewer concurrency provisions of the Phase I Development Regulations includes zone reclassifications. However, new development "not requiring public sewer service" is exempt from sewer concurrency requirements, using the example of a cellular tower. HE Findings, Conclusions and Decision ZE-12-02 Page 3 ~ ~ 26. County Utilities recommended conditions of approval found that the proposal did not need to meet sewer concurrency requirements, since the purpose of the rezone was to increase signage and did not add a new use that would have to be connected to the County's general sewerage system. New uses cannot be added to the site without connecting to public sewer. The Examiner has added a condition requiring connection to public sewer for any changes or new uses that increase sewage flows on the site. 27. The B-2 zone meets the minimum frontage, minimum lot area and other development standards of tlle B-2 zone. The proposal will be served by a high level of public services, as recommended for commercial development in the B-2 zone. Other B-2 zoning, and B-3 zoning, are found near the site along SR-290. 28. Neighboring property owners did not comment on the proposal. The proposal will not adversely impact neighboring properties or the environment. 29. There has not been a substantial change of circumstances in the area since the site was zoned UR-22 in 1991, or since such zoning was retained under the Phase I Development Regulations adopted on January 15, 2002. The site was designated in the Major Commercial category of the Comprehensive Plan prior to adoption of the GMA Comprehensive Plan and Phase I Development Regulations on January 15, 2002. B-2 zoning implemented the Maj or Commercial category of the Comprehensive Plan, as it does the Mixed Use category under the GMA Comprehensive Plan. Based on the above findings of fact, the Hearing Examiner enters the following: II. CONCLUSIONS OF LAW 1. The proposed rezone, as conditioned, conforms to the GMA Comprehensive Plan. 2. The proposal complies with the B-2 zone, other applicable provisions of the County Zoning Code, and other applicable development regulations. 3. The applicant has established that the proposed rezone, as conditioned, bears a substantial relationship, and will not be detrimental, to the public health, safety or welfaxe. 4. The proposed rezone, as conditioned, meets the criteria established by Washington case law for approving a rezone, and the criteria established in paragraph 14.402.020 (1) of the County Zoning Code for amending the County official zoning map. 5. The procedural requirements of the State Environmental Policy Act and the County's Local Environmental Ordinance have been met. The proposal, as conditioned, will not have a signzficant, probable adverse impact on the environment. 6. Approval of the rezone application, as conditioned, is appropriate under section 11 of the County Hearing Examiner Ordinance, adopted by County Resolution No. 96-0171. HE Findings, Conclusions and Decision ZE-12-02 Page 4 J I III. DECISION . Based on the above Findings of Fact and Conclusions of Law, the subject application for a rezone to the Community Business (B-2) zone, is hereby approved, subj ect to the conditions of approval of the public agencies stated below. Any conditions of such agencies that have been added or significantly revised by the Hearing Examiner are italicized. Failure to comply with the conditions of this approval may result in revocation of this approval by the Hearing Examiner. This approval does not waive the applicant's obligation to comply with all other requirements of other agencies with jurisdiction. SPOKANE COUNTY DIVISION OF PLANNING 1. All cond.itions imposed by the Hearing Examiner shall be binding on the "Applicant," which term shall include the owners and developers of the property, and their heirs, assigns and successors. 2. The zone reclassification applies to the parcel of property legally described as "Trentwood Orchards Replat of Lot 1, Block 1, EXCLUDING the east 50 feet, per plat recorded at Book 14, ' Page 96 of Plat, records of Spokane County Auditor, in Spokane County, Washington". 3. The proposal shall comply with the Community Business (B-2) zone and all other applicable provisions of the Spokane County Zoning Code, as amended. 4. The existing monument sign shall be removed. 5. The site shall be developed in substantial conformance with the site plan of record submitted on July 24, 2002, and the sign detail plan dated August 2, 1999 and submitted on May 1, 2002. The County Division of Planning may approve minor alterations and additions to the site plan of record, pursuant to Section 14.504.040 of the County Zoning Code, as amended, provided that such variations comply with all conditions of approval and regulation standards. All other changes must be submirted to the Hearing Examiner for approval at a public hearing, through a change of conditions application. 6. Any new uses or any changes on the site that generate additional sewage flotivs shall require connection to public sewer. 7. The Division of Planning shall prepare and record with the Spokane County Auditor a Title Notice, noting that the property in question is subject to a variety of special conditions imposed as a result of approval of a land use action. The Title Notice shall serve as public notice of the conditions of approval affecting the property in question. The Title Notice should be recorded within the same time frame as allowed for an appeal and shall only be released, in full or in part, by the Division of Planning. The Title Notice shall generally provide as follows: HE Findings, Conclusions and Decision ZE-12-02 Page 5 ~ "The parcel of property legally described as Trentwood Orchards Replat of Lot l, Block 1, EXCLUDING the east 50 feet, per plat recorded at Book 14, Page 96 of Plat, records of Spokane County Auditor, in Spokane County, Washington, is the subject of a land use action by a Spokane County Hearing Examiner on October 29, 2002, imposing a variety of special development conditions. File No. ZE-12-02 is available for inspection and copying in the Spokane County Division of Planning." SPOKANE COUNTY BUILDING AND CODE ENFORCEMENT 1. The applicant should conta.ct the Division of Building and Code Enforcement at the earliest possible stage in order to be informed of code requirements administeredlenforced as authorized by the State Building Code Act. Design/development concerns include addressing, fire apparatus access roads, fire hydrant flow, approved water systems, building accessibility, construction type, occupancy classification, existing exterior wall protection and energy code requirements. SPOKANE DIVISION OF ENGINEERING AND ROADS Prior to release of a building permit or use of the property as proposed: 1. The Washington State Department of Transportation (WSDOT) must approve any access permits and improvements to State Route 290 (Trent Avenue). 2. The applicant is advised that there may exist utilities either underground or overhead affecting the applicant's property, including property to be dedicated or set aside future acquisition. Spokane County will assume no financial obligation for adjustments or relocation regarding these utilities. The applicant should contact the applicable utilities regarding responsibility for adjustment or relocation costs and to make arrangements for any necessary work. 3. The County Engineer has no obj ection to the proposed zone change for the location of the sign identified in the application. Review of the site plan of record indicates that there are no other changes to the structure or surrounding areas proposed. The applicant is advised that any future revisions to the structure or site will be reviewed for consistency with adopted standards, which include but are not limited to drainage and traffic 4. The Spokane County Engineer has reviewed this project for transportation concurrency and determined that it is exempt under the Phase I-Development Regulations-Section N(B)(2)(c). SPOKANE REGIONAL HEALTH DISTRICT 1. A combined surface water and sewage disposal detailed plan shall be approved by the Spokane County Engineer and Spokane Regional Health District prior to the issuance of any on- site sewage disposal permit or building permit for this project. 2. Sewage disposal methods shall be as authorized by the Director of Utilities, Spokane County. Disposal of effluent beneath pa~ed surfaces i~ currently p-rohibited. 6. Subject to specific applicatian approval and the issua.nce of permits bv the Hea1th Officer, the use of individual on-site sewage disposal systems may be authorized. 7. The use of private wells and -water systems is prohibited. SPUKAM COUNTY DIVIS~~~ OF UTILITIES 1. Mixed-use areas discourage low-intensity, auto- dependent uses and focus on a pedestrian orientation with an emphasis on aesthetics and design. Goals . UL.2 Maintain and enhance the quality of life in Spokane County through urban design standards. Policies UL.2.1 Establish minimum performance standards within the zoning code for nuisances such as noise, vibration, smoke, particulate matter, odors, heat and glare and other aspects as appropriate to ensure compatibility with adjacent land uses and neighborhoods. ZE-12-02 Staff Report - September 18, 2002 Public Hearing 5 : Response: The proposed new signage does not inclyde a videoboard or biliboard and has been evaluated as being in compliance with Section 14.804 (Signage Standards) of the Spokane County Zoning Code. MIXED-USE AREAS Mixed-use areas are intended to enhance travel options, encourage development of commercial uses, higher-density residences, office, recreation and other uses. To be successful, mixed-use areas require detailed professional and community-based planning and quality market research. Neighborhood and subarea planning programs that involve design professionals, government service providers, business people and community residents will be necessary to design successful mixed- use areas. Goal UL.12 Encourage the developrnent of mixed-use areas that foster community identity and are designed to support pedestrian, bicycle, and transit transportation. Policies UL.12.3 The characteristics of a mixed-use area include: a) Housing and employment densities to support frequent transit service; b) Public transit connections to other Centers and Corridors; c) Safe, attractive bus stops and pedestrian and bicycle ways; d) Buildings which front on wide sidewalks with attractive landscaping, benches and frequent transit stops; e) Multi-story buildings oriented to the street rather than parking lots; and - - fl Parking spaces located behind, or to the side of buildings or under/over structures. ResQonse: The sfte is not served by public transit. The existing landscaping is mature and well- maintained with adequate parking provided to the rear and to the west of-the building which contains-10,439 square feet on one floor. UL.12.4 The mix of land use in a mixed-use area includes: - a) A variety of housing styles-apartments, condominiums, row houses, two-family and single-family houses on small lots; b) There could be a full range of retail goods and services-grocery stores serving several neighborhoods, theaters and restaurants, drycleaners, hardware stores and specialty shops; c) A mix of residence types in close proximity to commercial uses and business and government offices; - d) An emphasis on community-serving rather than regional-serving commercial . uses. e) Commercial uses that require large land areas but have low employment density- and are auto-dependent (lumber yards, nurseries, warehouses, auto dealerships, etc.) are prohibited; and f) Residential density within a mixed-use area shall range from 6 units per acre to 30 units per acre. Response: Professional offices are encouraged within this Comprehensive Plan category. UL.12.5 Implementation of mixed-use areas should only occur after the adoption of a sub-area plan that involves design professionals, government service providers, business people and community residents. COMPREHENSIVE PLAN SUMMARY: Limited commercial and office zoning are generally consistent with the Goals and Policies of the Mixed Use (MU) category of the Comprehensive Plan. This Comprehensive Plan designation anticipates professional offices, apartments, and commercial development for implementation. CONCURRENCY REVIEW: The proposal is exempted from water and sewer concurrency review under the Phase I-Development Regulations-Section IV (F). The Spokane County Engineer has reviewed this project for transportation concurrency and determined that it is exempt under the Phase I-Development Regulations-Section IV (B) (2) (c). ZONING ANALYSIS: The purpose of the Community Business (B-2) zone is to provide for the location of a wide range of retail and service activities. This zone will implement the Major Commercial category of the Comprehensive Plan. The uses within this zone may often require large areas for customer parking, retail service, some outside activities, display and other commercial activities. The businesses locating within these areas often draw customers from the county at large and other outlying areas rather than from a more limited trade area. Further it is the intent of this section to implement comprehensive plan policies which encourage commercial development along Principal Arterials or highways and establish regional-serving commercial areas. General characteristics of these areas include paved roads and sidewalks, public sewer and water, and a full line of public services including manned fire protection and public transit accessibility. Response: The proposal is generally consistent with the purpose and intent of the Community Business (B-2) zone which is designed to implement the Mixed Use (MU) category of the Comprehensive Plan. The general area includes single family residential development as _ implemented through the UR-22 and commercial uses implemented through the 6-2 and B-3 zones. _ The immediate vicinity also includes Heavy Industrial (I-3) zoning to the south of Trent Avenue. _ Schools are not required to serve tlie proposal, although schools are available for future needs.- SITE PLAN ANALYSIS: The site plan submi#ted with the zone reclassification specifies the location of all existing structures, parking areas, and landscaping. The site plan indicates two existing - accesses to Trent Avenue providing access to drive-through banking lanes and parking areas located to the rear and to the west of the existing structure. CONFORMANCE WITH SIGNAGE STANDARDS: The signage plan submitted with the zone reclassification specifies the location, size and design of the proposed new sign. Section 14.804 of the Spokane County Zoning Code specifies the following standards for freestanding commercial signage in the Community Business (B-2) zone: 14.804.080 Siqn Standards for Business and Industrial (134. B-2, B-3. I-2 and I-3) Zones Any sign, which pertains only to the identification of a permitted use. in the 6-1, B-2, 6-3, I-2 and I-3 zones and is located entirely on the property with the use or business, is permitted, provided that it complies with the following standards. - 1. Wall Signs - Individual and Multiple Businesses Wall signs are permitted on each wall of a building provided the wall sign does not exceed twenty- five percent (25%) of the total area of the wall or a maximum area of 250 square feet, whichever provides the smaller area. uFalse frontsfl and mansard roofs shall not be included when calculating the total area of the wall. This soil would be classified as a Type IV. fl Geologically, the soils are glaciofluvial deposits. These geological structures generally yield moderate to very large amounts of water. Chapter 2(Urban Land Use) states that Mixed Use areas are intended to enhance travel options, encourage development of locally serving commercial uses, medium density apartments and offices along transportation corridors identified on the Land Use Plan map. Consistency with the Comprehensive Plan - The subject site is located entirely within the Mixed Use category of the Comprehensive Plan. Chapter 2(Urban Land Use) states that Mixed Use areas are intended to enhance travel options, encourage development of locally serving commercial uses, medium density apartments and offices along transportation comdors identified on the Land Use Plan map. Mixed-uses areas discourage low-intensity, auto dependent uses and focus on a pedestrian orientation with an emphasis on aesthetics and design. Applicable Goa1s and Policies of the Mixed Use category are described in Goal LTL.12 and policies UL.12.1- UL.12.5.
