This matter coming on for public hearing on June 12, 2002, the Hearing Examiner,
after review of the subject applications and the entire record, and finding good cause
therefore, hereby makes the following findings of fact, conclusions of law and decision:
1. FINDINGS OF FACT
1. The subject applications request a rezone of approximately 1.8 acres of land, from
the Urban Residential-3.5 (UR-3 5) zone to the Community Business (B-2) zone, and a
variance from the Minor Arterial fronta.ge requirements of the B-2 zone, for a self-service
storage facility.
2. The site is generally located north of and adjacent to Empire Way/Avenue,
approximately 250 feet east of Prt Street, in the SE 1/4 of Section 4, Townslup 25 North,
Range 44 EWM, Spokane County, Washington.
3. The site is currently referenced as a portion of County Assessor's tax parcel nos.
45044 0102 and 45044.0103 The site is legally described as Lots 7 and 8, First Addition
to Grandview Acres, as recorded in 1921 in Volume "S" of Plats, Page 6, records of
Spokane County Auditor

9. The County Division of Planning issued a Determination of Nonsignificance for the
proposed rezone on May 24, 2002.
10. The Hearing Examiner takes notice of the County GMA Comprehensive Plan and
Capital Facilities Plan, Phase I Development Regulations, County Six-Year Sewer
Construction Capital Improvement Plan, 2001 County Standards for Road and Sewer
Construction, County official zoning maps, County Zoning Code, County Code, other
applicable development regulations, and pnor land use decisions in the vicuuty
11. The record includes the documents in the project file at the time of the public
hearing, the documents and testimony submitted at the public hearing, and the items
taken notice of by the Hearing Examiner.
12. The subject property is approximately 1.8 acres in size, rectangular in shape and
relatively flat in topography. The west half of the site is improved with two (2) single-
family residences, fronting along Empire Way/Avenue, while the east half is
undeveloped and surrounded by a seven (7)-foot high chain-link fence.
13. The subject rezone and vanance applications, and site plan of record, were
submitted to the County Division of Planning on April 11, 2002. The site plan illustrates
a 37,220 square foot, self-service storage facility, consisting of eight (8) buildings and a
total of 201 storage units The buildings would be single-story, 15 feet high and of inetal
construction. The site plan illustrates a seven (7)-foot high woven wire mesh fence
around the perimeter of the site, along with six (6)-foot high woven wlre fencing with
three (3) strands of barbed wire enclosing a portion of the south half of the site.
14. The site plan lists three (3) parking spaces for a current office and unspecified
parking for a future office, and illustrates three (3) parking spaces in the southeast corner
of the site; but does not show any office uses on the site The existing homes would be
removed for site development Required laisdscaping is illustrated on the site along
Empire Avenue The srte plan illustrates paved, gated accesses in the southeast and
northwest corners of the site Graveled areas are also shown on the subject property
15. Effective January 1, 1991, the zoning of the site was reclassified from the
Agricultural zone of the now expired County Zoning Ordinance to the Urban Residential-
3.5 (UR-3.5) zone, under the Program to Implement the Spokane County Zoning Code
16. Effective January 15, 2002, the County implemented a new comprehensive plan
("GMA Comprehensive Plan"), Capital Facilrties Plan, County Urban Growth Area
(LJGA) boundaries, and Phase I Development Regulations; all pursuant to the State
Growth Management Act (GMA). The County also repealed the interim development

regulations previously adopted by the County under the State Growth Management Act.

Development Regulations on May 7, 2002 See County Resolution No 2-0470
17. The Phase I Development Regulations designate the site, and neighboring land
lying between the Spokane River and State Route 290 (Trent Avenue), in the Mixed Use
category of the Comprehensive Plan. Such regulations retained the existing zoning of the
site and neighboring properties. The site and neighboring land is designated in the
County UGA, with the nearest UGA border located along the Spokane River to the north
18. The Phase I Development Regulations require all zone reclassification applications
in the Mixed Use category to be consistent with the GMA Comprehensive Plan, and limit
such applications in the Mixed Use category to the Urban Residential-12 (UR-12), Urban
Residential-22 (UR-22), Neighborhood Business (B-1), Community Business (B-2) and
Industrial Park (I-1) zones.
19. The GMA Comprehensive Plan designates Empire Avenue as an Urban Collector
Arterial. Empire Way/Avenue currently consists of a paved, two (2)-lane road without
curb or sidewalk. The site is bordered on the north by a vacant, 40-foot wide railroad
right of way. State Route 290, a 4-lane state highway, lies 700 feet north of the site.
20. 7`he land lying northerly of the site, and the land lying east of the northerly third
(1/3) of the site is zoned Heavy Industrial (I-3) and is developed with industrial uses
This includes 3 5 acres of land lying directly north of the site, which is owned by the
current site owner and developed with a tool sales outlet A gravel pit is located between
such land and the Spokane River. The land lying east of the southerly two-thirds of the
site is zoned I-2 and developed with industrial uses. A tool sales facility is located
directly east of the site A facility for the County Division of Utilities lies approximately
300 feet to the east along Empire Way/Avenue. A now inactive cement plant previously
dominated the area lying between Empire Way/Avenue and the river
21. The land lying west of the site is zoned I-2 The parcel abutting the site to the west
is developed with a metal products use, while the parcel lying directly west of such parcel
is developed with a single-family home. Further to the west, south of Empire
Way/Avenue, the land is zoned UR-3.5 and is improved with single-family homes.
22. The land lying southerly of the site is primarily zoned B-2. The land lying
immediately south of the site is improved with a single-family home The land lying
southwest and southeast of the subject property consists of undeveloped land, residences
and some scattered industrial/commercial uses. This includes a warehouse and oil
recycling use. The homes on the parcels to the south are oriented toward Portland
Avenue, with the rear portion of such residences or separate parcels facing Empire
Way/Avenue. The land lying along the north side of SR-290 in the area is zoned B-3 and
is developed with commercial uses

23. The proposed use is intended to serve the residential uses in the area; particularly
those located west of the site toward the Town of Millwood, and would also provide
some sma11 business storage The rezone application stated that the residences on the site
would be used as offices until being removed. However, at the public hearing, the
applicant's land use consultant testified that offices would not be developed on the site.
24. The residences on the site are currently served by on-site sewage disposal County
Utilities expects to extend public sewer to the area by 2007, and the site can meet the
concurrency requirements for sewer under the GMA Comprehensive Plan. The County
Division of Utilities issued a Concurrency Certificate for the proposal
25. The Staff Report sets forth applicable policies of the Mixed Use category of the
GMA Comprehensive Plan. The proposed use generally does not implement such
policies, however, Policy UL 12.5 recommends that mixed-use areas not be implemented
until after the adoption of a subarea plan that involves design professionals, government
service providers, business people and community residents. The timing of such subarea
planning is unknown
26. The B-2 zone requires frontage along a Minor Arterial The variance application
requests a variance from such frontage standard, to allow the site to front along Empire
Way/Avenue, an Urban Collector Artenal.
27. In 1992, a variance was approved from the storage screening and landscaping
requirements of the B-2 zone, for the industrial property located immediately west of the
site. The variance decision described the residences on the west half of the site as
dilapidated, with one home occupied on a temporary basis; indicated that such portion of
the site was dominated by the illegal storage of equipment, materials and vehicles;
characterized such portion of the site as an unkempt contractor's yard or vehicle parts or
wrecking yard, and found it highly unlikely that the site would ever be developed as a
permanent resldential property See Zoning Adjustor decision dated 9-28-92 in File No
VE-29-92.
28. The existing UR-3 5 zoning of the site is incompatible with adjoining zoning. The
site is generally unsuitable for residential development under the UR-3.5, UR-12 and UR-
22 zones, since it is bordered on three sides by industrial uses. There is no obvious
demand in the area for neighborhood retail uses under the B-1 zone, or for the
development of offices under the B-1, UR-12 or UR-22 zones. The UR-22 zone
recommends frontage along a Minor Arterial or higher classification of public road,
although it does not require frontage along an arterial
29. Some of the uses permitted in the I-1 zone would appear appropriate for the site and
vicinity, including light assembly, wholesaling, warehousing and indoor and outdoor
storage. However, like the UR-22 zone, the I-1 zone recommends frontage along a
Minor Arterial or higher classification, although it does not require frontage along an
arterial.

30. Neighbonng property owners, other than the owner of the current site, did not
comment on the proposal. Self-service storage facilities typically do not have adverse
impacts on nearby residences, due to their relatively low traffic generation and limited
business hours. County Engineering certified that the proposal met transportation
concurrency under the GMA Comprehensive Plan. The proposed use will not have a
significant adverse impact on Empire Way/Avenue or other local streets The applicant
will be required to improve Empire Way/Avenue by the addition of asphalt, curb and
sidewalk.
31. Self-service storage facilities can adversely impact aesthetics when located near or
adjacent to single-family homes However, the site is bounded on three (3) sides by
industrial uses, and the residential parcels to the south are generally oriented away from
Empire Avenue.
32. The isolation of the site adjacent to intense industrial uses, as well as the lack of a
subarea plan to implement the Mixed Use category of the GMA Comprehensive Plan,
reduces the development options and opportunities for the site compared to other
properties in the vicinity with similar zorung Strict application of the Minor Arterial
frontage standard of the B-2 zone creates an unreasonable burden in light of the purpose
to be served by the County Zoning Code, and by the UR-3.5 zone.
33. The factors listed under Zoning Code 14 404 082 (2)(b) and (2)(c), and the factors
listed under 14.404 082 (3), are not established
34. Changed circumstances have occurred in the area since the site was zoned UR-3.5
in 1991. This includes designation of the site in the Mixed Use category of the GMA
Comprehensive Plan and in the County UGA, and the transition of the land in the viciruty
from residential to industriaUcommercial uses.
35. Benefits of the project include renewal of the area, improvements to Empire
Avenue and increased property taxes
Based on the above findings of fact, the Hearing Examiner enters the following:
II. CONCLUSIONS OF LAW
1. Because of special circumstances applicable to the property, strict application of the
Minor Arterial frontage requirement of Section 14.626 310 of the County Zoning Code
creates practical difficulties and deprives the property of nghts and privileges enjoyed by
other properties in the vicinity with similar zoning
2. As conditioned, granting of the vanance will neither be detrimental to the public
welfare nor injurious to the property or improvements in the vicinity and the Commuruty
Business (B-2) zone in which the site is now located

3. The proposed rezone and variance, as conditioned, conform to the GMA
Comprehensive Plan and Phase I Development Regulations.
4. The proposal, aside from the requested variance, complies with the B-2 zone and
other applicable development regulations.
5. The applicant has established that the proposed rezone, as conditioned, bears a
substantial relationship, and will not be detrimental, to the public health, safety or
welfare.
6. A change in economic, technological, or land use conditions has occurred to
warrant the proposed rezone, as conditioned. A substantial change of circumstances has
occurred in the area since the site was last zoned.
7. The proposed rezone, as conditioned, meets the criteria established by Washington
case law for approving a rezone, and the criteria established in paragraphs 14 402.020
(1)(2) of the County Zoning Code for amending the County official zoning map
8. The proposed variance meets the criteria for approving a variance listed in Chapter
14.404 of the County Zoning Code
9. The procedural requirements of the State Environmental Policy Act and the
County's Local Environmental Ordinance have been met. The proposal, as conditioned,
will not have a significant, probable adverse impact on the environment.
10. Approval of the rezone and variance applications, as conditioned, is appropriate
under section 11 of the County Hearing Examiner Ordinance, adopted by County
Resolution No. 96-0171
III. DECISION
Based on the above Findings of Fact and Conclusions of Law, the subject
applications for a rezone to the Community Business (B-2) zone, and for a variance from
that portion of the frontage standard of the B-2 zone requiring that lot frontage be along a
Minor Arterial, are hereby approved, subject to the conditions of approval of the public
agencies stated below.
Any conditions of such agencies that have been added or significantly revised by
the Hearing Examiner are italicized.
Failure to comply with the conditions of this approval may result in revocation of
this approval by the Hearing Examiner. This approval does not waive the applicant's
obligation to comply with all other requirements of other agencies with jurisdiction.

SPOKANE COUNTY DIVISION OF PLANNING
1. All conditions imposed by the Hearing Examiner shall be binding on the
"Applicant", which term shall include the owners and developers of the property, and
their heirs, assigns and successors
2. The zone reclassification applies to Lots 7 and 8, First Addition to Grandview
Acres, as recorded in 1921 in Volume "S" of Plats, Page 6, records of Spokane County
Auditor.
3. The proposal shall comply with the Community Business (B-2) zone, except for the
requirement that the site front along a Minor Arterial. The proposal shall also comply
with the Aquifer Sensitive Overlay zone and all other applicable provisions of the
Spokane County Zoning Code, as amended
4. The site shall be developed in substantial conformance with the site plan of record
submitted on April 11, 2002. The County Division of Planrung may approve minor
alterations and additions to the site plan of record, pursuant to Section 14.504 040 of the
County Zoning Code, as amended, provided that such variations comply wlth all
conditions of approval and regulation standards. All other changes must be submitted to
the Hearing Examiner for approval at a public hearing, through a change of conditions
application.
5. Approval is required from the Director of the Division of Planning/designee of a
specific illumination and signage plan for the described property, prior to the release of
any building permit
6 Direct light from any exterior area lighting fixture shall not extend over the property
boundary.
7. A specific landscape plan, planting schedule and provisions for the maintenance
acceptable to the Director of the Division of Planning/designee shall be submitted with a
performance bond or other suitable guarantee for the project, prior to release of any
building permits. Landscaping shall be installed and maintained so that sight distance at
access points is not obscured or impaired.
8 The Division of Planning shall prepare and record with the Spokane County
Auditor a Title Notice, noting that the property in question is subject to a variety of
special conditions imposed as a result of approval of a land use action. The Title Notice
shall serve as public notice of the conditions of approval affecting the property in
question The Title Notice should be recorded vvithin the same time frame as allowed for
an appeal and shall only be released, in full or in part, by the Division of Planning. The
Title Notice shall generally provide as follows•
"The parcel of property legally described as Lots 7 and 8, Flrst Addition to
Grandview Acres, as recorded in 1921 in Volume "S" of Plats, Page 6, records of

Spokane County Auditor, is the subject of a land use action by a Spokane County
Hearing Examiner on July 16, 2002, approving a rezone and zoning variance, and
imposing a variety of special development conditions. File No. ZE-5-02lVE-7-02 is
available for inspection and copying in the Spokane County Division of Planning "
SPOKANE COUNTY BUILDING AND CODE ENFURCEMENT
1. The applicant should contact the Division of Building and Code Enforcement at the
earliest possible stage in order to be informed of code requirements
administered/enforced as authorized by the state Building Code Act
Designldevelopment concerns include addressing, fire apparatus access roads, fire
hydrant flow, approved water systems, building accessibility, construction type,
occupancy classification, existing exterior wall protection and energy code requirements.
SPOKANE DIVISION OF ENGINEERING AND ROADS
Prior to issuance of a building permit, or at the request of the County Engineer in
conjunction with a County Road Project/Road Improvement District, whichever comes
first:
1. The applicant shall dedicate 2 5 feet of the site adjacent to Empire Avenue/Way for
county right of way purposes
Prior to release of a building permit or use of the property as proposed
2. Access permits for approaches to the County Road System shall be obtained from
the County Engineer.
3. The applicant shall submit road, drainage and access plans to the County Engineer
for approval.
4. A Professional Engineer (P.E.), llcensed in the State of Washington, shall submit
road and storm drainage construction plans and a drainage report that conform to the
versions of the Spokane County Standards for Road and Sewer Construction, the
Guidelines for Stormwater Management, and all applicable federal, state, and local
regulations and laws that are in effect at the time of the plan submittal or at the time of
the development permit application(s). The final road and storm drainage plans and
drainage report shall receive the County Engineer's acceptance, prior to release of any
Grading, Building or Right-of-Way Permits.
5. A parking plan and traffic circulation plan shall be submitted and approved by the
Spokane County Engineer. The design, location and arrangement of parking stalls shall be
in accordance with standard engineenng practices Paving or surfacing, as approved by the
County Engineer, will be required for any portion of the project that is to be occupied or
traveled by vehicles

6. The construction of the roadway improvements stated herein shall be accomplished
as approved by the Spokane County Engineer.
7. The County Engineer has designated a 2-lane Collector Roadway Section for the
improvement of Empire Avenue/Way, which lies adjacent to the proposed development
This will require approximately 8 5 to 10 5 feet of asphalt along the frontage of the
development. Curbing and sidewalk must also be constructed
8. All required improvements shall conform to the current State of Washington
Standard Specifications for Road and Bridge Construction and other applicable County
standards and/or adopted resolutions pertaining to Road Standards and Stormwater
Management in effect at the date of construction, unless otherwise approved by the
County Engineer.
9. Roadway standards, typical roadway sections and drainage plan requirements are
found in Spokane County Resolution No 1-0298, as amended, and are applicable to this
proposal.
10. No construction work is to be performed within the existing or proposed right of
way until the County Engineer has issued a permit therefore. All work within the public
road right of way is subject to inspection and approval by the County Engineer.
11. All required construction within the existing or proposed public right of way is to be
completed prior to the release of a building permit, or a bond in an amount estimated by
the County Engineer to cover the cost of construction or improvements shall be filed with
the County Engineer
12. The applicant is advised that there may exist utilities either underground or overhead
affecting the applicant's property, including property to be dedicated or set aside future
acquisition Spokane County will assume no financial obligation for adjustments or
relocation regarding these utilities The applicant should contact the applicable utilities
regarding responsibility for adjustment or relocation costs and to make arrangements for
any necessary work.
13. The applicant shall grant applicable border easements adjacent to Spokane County
Right of Way per Spokane County Standards
14. The County Engineer will issue a Concurrency Certificate under the County GMA
Comprehensive Plan and Phase I Development Regulations for six (6) PM peak hour trips,
for a 202-unit self-service storage facility
15. The proposed rezone has been reviewed according to the site plan of record Any
modifications to the site plan will require additional review by the County Engineer. At
such time as a revised site plan is submitted for review, the applicant shall submit detailed
traffic information for review by the County Engineer to determine what traffic unpacts, if
any, that the development would have on sunounding infrastructure. Mitigation,

including off-site improvements, may be required
SPOKANE COUNTY DIVISION OF UTILITIES
1. Pursuant to the County Sewer Ordinance, the use of on-site sewage systems may be
authorized. Such authorization is conditioned on compliance with the rules and
regulations of the Spokane Regional Health District and the Phase I Development
Regulations adopted by the County, as amended. Such authorization is further
conditioned on, and subject to, application approval and issuance of permits by the
Health District.
2. Pursuant to the County's Phase I Development Regulations, as amended, each new
building shall be double-plumbed with a dry side sewer for connection to future area-
wide collection systems. Such double-plumbed dry side sewer shall be extended to the
public right of way, or as otherwise required by the Division of Utilities to facilitate
connection to the future public sewer system. Double-plumbing dry side sewer plans
acceptable to the Division of Utilities may be required.
3. Any water service for this project shall be provided in accordance with the
Coordinated Water System Plan for Spokane County, as amended.
SPOKANE REGIONAL HEALTH DISTRICT
1. A combined surface water and sewage disposal detailed plan shall be approved by
the County Engineer and Regional Health District, prior to the issuance of any on-site
sewage disposal permit or building permit
2. Sewage disposal methods shall be as authorized by the Director of Utilities,
Spokane County.
3. Water service shall be coordinated through the Director of Utilities, Spokane
County.
4. Water service shall be by an existing public water supply when approved by the
Regional Engineer (Spokane), State Department of Health.
5. Subject to specific application approval and the issuance of permits by the Health
Officer, the use of individual on-site sewage disposal systems may be authorized
6. The use of pnvate wells and water systems is prohibited.
7. The disposal of effluent beneath paved surfaces is prohibited.

require back-up maneuvers to/from a County road are not acceptable.
8 Utility Condition: Permittee is responsible for arranging for all necessary utility
adjustments, relocations, or improvements as required for completion of the
project, including completion of the required road and drainage improvements

private service, ufiility improvements, and any relocation and adjustment costs

9. Additional Road Information:
A stnp of property 4 feet wide will need to be dedicated as County right-of-way
in order to enclose the above described road improvements whether built or not
at this time A copy of the recorded properfy deed will need to be submitted in
order for the County staff to prepare the Rlght-of-Way Deed for signature by the
Owner(s) The Rrght-of-Way Deed needs to be signed prior to issuance of the
building permit.
A Border Easement will need to be granted to enclose any public sidewalk and
drainage facilities for County rood runoff located outside of the public right-of-
way The Border Easement does not need to be signed until the time of building
occupancy

The subJect site is approximately 1 8 acres in size and is adjacent to Empire Avenue Empire Avenue is
designated as a Collector Arterial by the Spokane County Arterial Road Plan and consists of a paved 2-lane
roadway with no curbs or sidewalks The site is generally flat and includes two existing single family
residences located on the west half of the site The east half of the site is undeveloped and is enclosed with
a 7-foot high chain link fence Surrounding uses include industrial uses to the north, west and east of the
site with single family residences and undeveloped land located south of the site

The proposed land use action consists of a Zone Reciassification from Urban Residential-3 5(UR-3 5) to
Community Business (B-2) for the development of a self-service storage facility, approximately 37,220
square feet in size with 201 units, to be accessed from Empire Avenue There is no proposed office to
serve the self-service storage facility The application also includes a Variance from Section 14 626 310 of
the proposed Community Business (6-2) zone, which requires parcels to have frontage on a Minor Arterial
or higher classification The applicant is requesting to vary from this development standard to allow
frontage on a Collector Arterial based on the minimal traffic impacts that are generated by a self-service
storage facility

The application for the proposal was submitted to the Division of Planning on April 11, 2002 A Technical
Review meeting was held on April 25, 2002 The Determination of Completeness was issued on April 22,
2003, and the Notice of Application was issued on April 23, 2002, with a 14-day public comment period
ending on May 6, 2002
The existing zoning of the site is Urban Residential-3 5(UR-3 5) established in 1991, and previously
classified as Agricultural in 1942 (ZE-24-42) The adoption of the Phase I Development Regulations to
Implement the Comprehenswe Plan by the Board of County Commissioners on January 15, 2002,
Resolution #2-0037, did not affect the existing zoning of the subJect site
Section IV, Concurrency, of the Phase I Development Regulations requires applications for Zone
Reclassifications within the Urban Growth Area (UGA) to be evaluated for both transportation, and water
and sewer concurrency The Spokane County Division of Engineering and Roads issued a Certificate of
Transportation Concurrency for the proposal on Apnl 24, 2002 The Spokane County Division of Utilities
and Irvin Water District No 6 have both signed Certificates of Concurrency stating that public water is
available to serve the site and that the subJect parcel is within the Spokane County Sewer six-year Capital
Improvement Program
Staff Analvsis
Comprehensive Plan
The subject property is located within the Mixed-use Category of the Urban Land Use Chapter, Chapter 2, of
the Spokane County Comprehensive Plan Mixed-use areas are intended to consist of "centers" and
"corridors" distributed throughout the urban area to provide for retail sales, services, government and
business offices, recreation facilities, higher-density residences and other high-intensity uses to serve the
needs of surrounding residential areas Mixed-use areas are intended to enhance travel options, encourage
development of localiy serving commercial uses, medium-density apartments and offices along
transportation corridors identified on the Land Use Plan Map Mixed-use areas discourage low-intensity,
auto-dependent uses and focus on a pedestrian orientation with an emphasis on aesthetics and design
Neighborhood and subarea planning programs that involve design professionals, government service
providers, business people and community residents will be necessary to design successful mixed-use
areas
Policies UL 12 2, UL 12 3 and UL 12 4 state that Mixed-use areas will include a variety of high density
housing and employment to support transit service, a fuli range of retail goods and services with a with an
emphasis on community-serving rather than regional serving commercial uses, and will prohibit commercial
uses that require large land areas with low employment densities such as warehouses, auto dealerships,
etc Policy UL 12 5 states that implementation of Mixed-use areas should only occur after the adoption of a
subarea plan that involves design professionals, government service providers, business people and
community residents
As stated above, the policies of the Mixed-use Category of the Urban Land Use Chapter do not generally
support uses similar to a self-service storage facility, however, Policy UL 12 5 states that Mixed-use areas

1 should not be implemented prior to the adoptianlf4stibarea plan ►Section II, Zone Reclassification
Applications, of the Phase I Development Regulations states that applications for amendments to the
Spokane County Zoning Map initiated under Section 14 402 100(1) of the Spokane County Zoning Code
shall be limited to reclassifications that are consistent with the Comprehensive Plan category and
associated implementing zone as provided in the table attached to the Regulations The table identifies the
implementing zones for the Mixed-use Category to include Urban Residential-12 (UR-12), Urban
Residential-22 (UR-22), Neighborhood Business (B-1), Industrial Park (I-1) and the proposed Community
Business (B-2) zone
The Mixed-use Category of the Urban Land Use Chapter of the Comprehensive Plan does not specifically
address variance requests as provided for in Chapter 14 404 of the Spokane County Zoning Code
Goals CF 3, CF 6 and CF 7 Capital Facilities, Chapter 7, are to ensure that public facilities and services
support proposed development at established Levels of Service and is consistent with public water and
sewer system planning The application for the proposed zone reclassification is consistent with
transportation concurrency requirements, has the availability of public water and is located within the six-
year Sewer Improvement Program Policy CF 8 1 requires stormwater management systems for new
development within the Urban Growth Area (UGA) The Site Plan of Record identifies proposed stormwater
management areas

The purpose of the proposed Community Business (B-2) zone is to provide for the establishment of
commerciai centers which will meet the needs of the a community for a wide range of retail and service
uses, and to implement the MaJor Commercial category of the Comprehensive Pian The Community
Business (B-2) zone is intended to primarily accommodate community shopping facilities grouped at one
location and served by arterials where they can serve a trade area of several neighborhoods The proposed
Community Business (B-2) ione generally implements the existing Mixed-use Category of the
Comprehensive Plan, based on Section II of the Phase I Development Regulations General characteristics
include paved roads and sidewalks, public sewer and water, and a full line of public services
The site is currently served by public water and is within a Spokane County six-year Sewer Improvement
Program
The purpose and intent statement (Section 14 626 100) of the proposed Community Business (B-2) zone
states that any B-2 zoned area shouid have frontage on a Minor Arterial or higher ciassification and Section
14 626 310 requires frontage on a street or road of the Minor Artenai classification or a higher classification
as a developrnent standard for the Community Business (B-2) zone The site is located north of and
adjacent to Empire Avenue, which is designated as a Collector Arterial by the Spokane County Arterial
Road Plan The proposed land use action includes a Variance from the Minor Arterial frontage
requirements of Section 14 626 310, and a discussion of the proposal's consistency with the Variance

The Spokane County Division of Engineenng and Roads has reviewed the above referenced application The
following "Conditions of Approval" are submitted to the Spokane County Division of Planning for inclusion in the
"Findings of Fact, Conclusions and Order/Decision" should the request be approved
Prior to issuance of a building permit or at the request of the County Engineer in conjunction with a
County Road Project/Road Improvement District, whichever comes first:
1. Applicant shall dedicate 2.5 feet on Empire Avenue/Way for right of way
Prior to release of a building permit or use of property as proposed:
2 Access permits for approaches to the County Road System shall be obtained from the County Engineer
3. Applicant shall submit for approval by the Spokane County Engineer road, drainage and access plans
4 A Professional Engineer (P E.), licensed in the State of Washington, shall submit road and storm
drainage construction plans and a drainage report that conform to the versions of the Spokane County
Standards for Road and Sewer Construction, the Guidelines for Stormwater Management, and all
applicable federal, state, and local regulations and laws that are in effect at the time of the plan submittal
or at the time of the development permit application(s). The final road and storrn drainage plans and
drainage report shall receive the County Engineer's acceptance prior to release of any Grading, Building,
or Right-of-Way Permit
5. A parking plan and traffic circulation plan shall be submitted and approved by the Spokane Coun'ty
Engineer. The design, location and arrangement of parking stalls shall be in accordance with standard
engineering practices Paving or surfacing as approved by the County Engineer will be required for any
portion of the project which is to be occupied or traveled by vehicles.
6. The construction of the roadway improvements stated herein shall be accomplished as approved by the
Spokane County Engineer.

7. The County Engineer has designated a 2-Lane Collector Roadway Section for the improvement of
Empire Avenue/Way which is adjacent to the proposed develvpment. This will require the addition of
approximately 8.5 to 10 5 feet of asphalt along the frontage of the development Curbing and sidewalk
must also be constructed
8 All required improvements shall conform to the current State of Washington Standard Specifications for
Road and Bridge construction and other appiicabie county standards and/or adopted resolutions
pertaining to Road Standards and Stormwater Management in effect at the date of construction, unless
othenivise approved by the County Engineer
9. Roadway standards, typical roadway sections and drainage plan requirements are found in Spokane
Board of County Commissioners resolution 1-0298 as amended and are applicable to this proposal
10 No construction work is to be performed within- the existing or proposed right of way until a permit has
been issued by the County Engineer All work within the public road nght of way is subject to inspection
and approval by the County Engineer
11 All required construction within the existing or proposed public right of way is to be completed prior to the
release of a building permit or a bond in an amount estimated by the County Engineer to cover the cost
of construction or improvements shall be filed with the County Engineer
12 GThe applicant is advised that there may exist utilities either underground or overhead effecting the
applicant's property, including property to be dedicated or set aside future acquisition Spokane County

plan is submitted for review, the applicant shall submit detailed traffic information for review by the
County Engineer to determine what traffic impacts, if any, that the development would have on

The Spokane County Division of Engineering and Roads has reviewed the above referenced application. The
following "Conditions of Approval" are submitted to the Spokane County Division of Planning for inclusion in the
"Findings of Fact, Conclusions and Order/Decision" should the request be approved.
Prior to issuance of a building permit or at the request of the County Engineer in conjunction with a
County Road Project/Road Improvement District, whichever comes first:
1. Applicant shall dedicate 2.5 feet on Empire Avenue/Way for right of way.
Prior to release of a building permit or use of property as proposed:

applicable federal, state, and local regulations and laws that are in effect at the time of the plan submittal
or at the time of the development permit application(s). The final road and storm drainage plans and
drainage report shall receive the County Engineer's acceptance prior to release of any Grading, Building,
or Right-of-Way Permit.
5. A parking plan and traffic circulation plan shall be submitted and approved by the Spokane County
Engineer. The design, location and arrangement of parking stalls shall be in accordance with standard
• engineering practices. Paving or surfacing as approved by the County Engineer will be required for any
portion of the project which is to be occupied or traveled by vehicles.
6. The construction of the roadway improvements stated herein shall be accomplished as approved by the
Spokane County Engineer.

7. The County Engineer has designated a 2-Lane Collector Roadway Section for the improvement of
Empire Avenue/Way which is adjacent to the proposed development. This will require the addition of
approximately 8.5 to 10.5 feet of asphalt along the frontage of the development. Curbing and sidewalk
must also be constructed.
8. All required improvements shall conform to the current State of Washington Standard Specifications for
Road and Bridge construction and other applicable county standards and/or adopted resolutions
pertaining to Road Standards and Stormwater Management in effect at the date of construction, unless
otherwise approved by the County Engineer.
9. Roadway standards, typical roadway sections and drainage plan requirements are found in Spokane
Board of County Commissioners resolution 1-0298 as amended and are applicable to this proposal.
10. No construction work is to be performed within the existing or proposed right of way until a permit has
been issued by the County Engineer. All work within the public road right of way is subject to inspection
and approval by the County Engineer.
11. All required construction within the existing or proposed public right of way is to be completed prior to the
release of a building permit or a bond in an amount estimated by the County Engineer to cover the cost
of construction or improvements shall be filed with the County Engineer.
12. "The applicant is advised that there may exist utilities either underground or overhead effecting the
applicant's property, including property to be dedicated or set aside future acquisition. Spokane County
will assume no financial obligation for adjustments or relocation regarding these utilities." "The applicant
should contact the applicable utilities regarding responsibility for adjustment or relocation costs and to
make arrangements for any necessary work."
13. The applicant shall grant applicable border easements adjacent to Spokane County Right of Way per
Spokane County Standards.
14. If the requested zone change is approved, the Spokane County Engineer will issue a Concurrency
Certificate under the Spokane County Comprehensive Plan for six (6) PM peak hour trips for a 202 unit
mini-storage operation.
15. This proposed zone change has been reviewed according to the site plan of record. Any modifications to
this site plan of record shall require additional review by the County Engineer. At such time a revised site
plan is submitted for review, the applicant shall submit detailed traffic information for review by the
County Engineer to determine what traffic impacts, if any, that the development would have on
surrounding infrastructure. The applicant is advised that mitigation maybe required for off-site
improvements.

Spokane County Resolution No. 1-0700. All interested persons may testify at the public hearing, and
may submit written comments and documents before or at the hearing. The Hearing Examiner may limit
the time given to speakers. A speaker representing each side of the issue is encouraged. Any appeal of
the Hearing Examiner's decision will be based on the record established before the Hearing Examiner,
pursuant to County Resolution Nos. 96-0171. Environmental appeals will follow the same procedural
route as the underlying action. All hearings will be conducted in facilities that are accessible to persons
with physical disabilities.

PURPOSE OF CHECKLIST
The State Environmental Policy Act (SEPA), chapter 43.21 C RCW, requires all governmental agencies
to consider the environmental impacu of a proposal before making decisions. An environmental
impact statement (EIS) must be prepared for all proposals with probable significant adverse impacts on
the quality of the environment. The purpose of this checklist is to provide information to help you
and the agency identify impact from your proposal (and to reduce or avoid impacts from the proposal,
if it can be done) and to help the agency decide whether an EIS is required.
INSTRUCTIONS FOR APPLICANTS
This environmental checklist asks you to describe some basic information about your proposal.
Governmental agencies use this checklist to determine whether the environmental impacts or your
proposal are significant, requiring preparauon of an EIS. Answer the questions briefly, with the most
precise information known, or give the best description you can.
You must answer each question accurately and carefully, to the best of your knowledge. In most
cases, you should be able to answer the questions from your own observations or project plans
without the need to hire experes. If you really do not know the answer, or if a question does not
apply to your proposal, write "do not know" or "does not apply". Complete answers to the questions
now may avoid unnecessary delays later.
Some questions ask about governmental regulations, such as zoning, shoreline, and landmark
designations. Answer these question if you can. If you have problems, the governmenral agencies can
assist you.
The checklist questions apply to a11 parts of your proposal, even if you plan to do them over a period
of time or on different parcels of land. Attach any additional information that will help describe your
proposal or its environmental effects. The agency to which you submit this checklist may ask you to
