ZE-10-91 S SPOItANE COUNTY HEARING EXAMINER COMMITTEE ]FINDIN(TS QF FACT, CONCLUSIONS AND QRDER INTRODUCTION This matter has come before the Hearing Examiner Committee on April 18, 1991. The members of the Committee present are Jane Myers, Chairperson, Frank Yuse and Phil Harris. PROPOSAL The sponsor, Williar.n Sausbury, requests approval of a Zone Reclassification File No. ZE-10-91 from Urban Residential-3.5 (UR-3.5) to Regional Business (B-3). FINDINGS OF FACT AND CONCLUSIONS 1. The property is generally located north of and adjacent to Trent Avenue and approxunately 180 feet west of Vista Road in Section 7, Township 25 North, Range 44 EWM, Spokane County, Washington. - 2. The committee adopts the Planning Department Report as a part of this record. 3. The existing land uses in the area are commercial and single family residences. 4. The Comprehensive Plan designates this site as Urban. The Urban category is for the purpose of crea.ting a"city like" environment including residential, neighborhood commercial, light industrial, public and recreational land uses. The Urban category generally does not support Regional Business (B-3) zoning. 5. Access to the site is from Trent Avenue, a state highway. Carlisle Avenue is located on the north boundary of the site. The existing right of way width for Carlisle Street is 34.5 feet. The County Engineer required dedication of 7.5 feet of land along Carlisle Street for right of way purposes. 6. The existing zoning of the properry described in the application is Urban Residential-3.5 (UR-3.5) previously established on January 1, 1991 according to the program to implement the Spokane Counry Zoning Code. 7. The provisions of RCW 43.21C (The State Environmental Policy Act) have been complied with and a Determinarion of Nonsignificance was issued. 8. The legal requirements for public notice have been fulfilled. 9. The owners of adjacent lands expressed concern over the lack of sunlight reaching their property due to existing buildings on the site and the possible existence of an underground fuel storage tank. 10. The agent for the applicant, Christopher Green, testif'ied that he has no knowledge of an underground storage tan.k on the site. 11. The proposed use is comparible with existing uses in the area. HEC Order for ZE-10-91 Page 2 12. The proposed zoning does not implement and conform to the Comprehensive Plan. 13. The applicant has demonstrated that conditions have substantially changed since the original zoning of this area and accordingly, the proposed zone reclassification is justified. 14. The proposed use will not be detrimental to the public health, safety, morals or welfare. CONDITIONS OR CONTINGENCIES APPLIED TO THIS APPROVAL 1. All Conditions imposed by the Hearing Examiner Committee shall be binding on the "Applicant," which tenn shall include the owner or owners of the property, heirs, assigns, and successors-in-interest. , 2. The following Conditions of Approval apply to the real property described below: Parcel A: The west 120 feet of Tract 213-and the east 30 feet of Tract 212, Orchard Avenue Addition, according to the plat recorded in Volume "M" of Plats, Page 24, Spokane County, Washington. Parcel B: That part of Tract 212, Orchard Avenue Addition, according to plat recorded in Volume "M" of Plats, Page 24, Spokane County, Washington, described as follows: . Beginning at a point on the north line of said Tract, 30 feet west of the northeast _ corner thereof; thence west along the north line of said Tract, 80.75 feet; thence southerly 125 feet along a line which if extended, would intersect the southerly line of said Tract, 115.75 feet from the southeast corner, for the true point of beginning; thence southerly to a point on the south line of said Tract 115.75 feet from the southeast corner of said Tract; thence easterly along the southerly line of said tract 84.4 feet, more or less to a point of intersection with a line drawn para11e1 with and 30 feet west of the east line of said Tract; thence north parallel with and 30 feet west of the east line of said Tract to a point east of the true point of beginning; thence west to the true point of beginning. SPOKANE COUNTY PLANNING DEPARTMENT 1. All current standards of the Regional Business (B-3) zone, as amended, shall be complied with in the development of this site. 2. The applicant shall develop subject property generally in accordance within the concept presented to the Hearing Body. Variations, when approved by the - Planning Director/designee, may be permitted, including, but not limited to building location, landscape plans and general allowable uses of the permitted zone. All variations must conform to regulations set forth in the Zoning Code for Spokane - County, and the original intent of the development plans shall be maintained. The Planning Department shall prepare and record with the Spokane County Auditor a Tide Notice noting that the property in question is subject to a variety of special conditions imposed as a result of approval of a land use action. This Title Notice shall serve as public notice of the conditions of approval affecting the property in question. The Tide Notice should be recorded within the same time frame as allowed for an appeal and shall only be released, in full or in part, by the Planning Department. The Title Notice shall generally provide as follows: The par,cel of property legally described as [ ] is the subject of a land use action by a Spokane County Hearing Body or Administrative Official on April 18, 1991, imposing a variety of special development conditions. File No. ZE-10-91 is available for inspection and copying in the Spokane County Planning Department. 4. The Planning Deparnnent shall file with the Spokane County Auditor, within the same time frarrie as allowed for an appeal from the final d.isposition, including lapsing of appeal period, a Title Notice, which shall generally provide as follows: "Prior to the issuance of any build.ing perm.it for any building or any use on the property described herein, the applicant shall be responsible for complyingwith the provisions of the Zoning Code for Spokane County, Section 14.706 (Aquifer Sensitive Area Overlay Zone). The property which is the subject of this notice is more particularly described as follows: 5. A specific landscape plan, planting schedule and provisions for ma.intenance acceptable to the Planning Director/designee shall be submitted with a performance bond for the project prior to release of building permits. Landscaping shall be " installed and maintained so that sight distance at access points,is not obscured or impaired. A type III landscape strip, 5 feet in width, is required along Carlisle Avenue. Type I landscaping is required along the west boundary of the site adjacent to the Urban Residenaal-3.5 zone in accordance with Chapter 14.806.040 of the Spokane County Zoning Code. 6. A specific development plan shall be submitted for Planning Department review and approval prior to issuance of building pemuts. Construction must be judged as proceeding according to the plan or constitute a zoning violation. 7. Approval is required by the Planning Director/designee of a specific lighting and signing plan for the described property prior to the release of any building permits. SPOKANE COUNTY ENGINEER'S OFFICE The applicant shall ded.icate 7.5 feet on Carlisle Street for right of way purposes. Prior To The Issuance Of A Building Permit Or Use Of The Pronertv As Pronosed: 1. Access permits for approaches to the county road system shall be obtained from the Spokane County Engineer. 2. Access pemlits and improvements to Trent Avenue must be approved by the Washington State Department of Transportation (WSDOT). HEC Order for ZE-10-91 - Page 4 3. The applicant shall submit for approval by the Spokane County Engineer road, drainage and access plans. 4. The applicant shall submit for approval by the Spokane County Engineer and the Spokane County Health District a detailed combined on-site sewage system plan and surface water disposal plan for the entire project, or portion thereof, if the development is to be phased. 5. A parking plan and traffic circulation plan shall be subnutted and approved by the Spokane County Engineer. The design, location and arrangement of parking stalls shall be in accordance with standard traffic engineering practices. Paving or surfacing as approved by the County Engineer, will be required for any portion of the project which is to be occupied or traveled by vehicles. 6. To construct the roadway improvements stated herein, the applicant may, with the approval of the County Engineer, join in ahd be willing to participate in any petition or resolurion which purpose is the formation of a Road Improvement District (RTD) for said improvement, pursuant to RCW 36.88, as amended. Spokane County will not participate in the cost of these improvements. This is applicable to Carlisle Street. 7. As an alternative method of constructing the road improvements stated herein, the - applicant may, with the approval of the County Engineer, accomplish the road improvements stated herein by joining and participating in a County Road Project (CRP) to the extent of the required improvement. Spokane County will not participate in the cost of these improvements. This is applicable to Carlisle Street. 8. The construction of the road improvements stated herein shall be accomplished as approved by the Spokane County Engineer. 9. The County Engineer has designated Typical Roadway Section Number Two, Local Access standard for the improvement of Carlisle Street, which is adjacent to the proposed development. This will require the addition of approximately 9 to 11 feet of asphalt along the frontage of the development. The construction of curbing and sidewalk is also required. 10. All required improvements shall conform to the current State of Washington Standard Specificarions for Road and Bridge Construction and other applicable County standards and/or adopted resolutions pertaining to Road Standards and Storxnwater Management in effect at the date of construction, unless otherwise approved by the County Engineer. 11. Access to Carlisle Street other than emergency access shall be prohibited until such time as specifically authorized by the Spokane County Engineer. 12. Roadway standards, typical roadway sections and drainage plan requirements are found in Spokane Board of County Commissioners Resolution No. 80-1592 as amended and are applicable to this proposal. 13. This subdivision or development proposal is located within a drainage basin which has been identified by the Spokane County Engineer's office as having stormwater H EC Order for ZE-10-91 Page 5 runoff problems. Since this plat or development proposal is affected by or is a contributor to stormwater flows, property owners should participate in the planning and implementation of a future basinwide stormwater management system. The following statement shall be placed in the plat dedication: "The owner(s) or successor(s) in interest agree to join in any County-approved stormwater management progran and to pay such rates and charges as may be fixed through public hearings for service or benefit obtained by the planning, design, constructing, maintaining or operation of stormwater control facilities." 14. No construction work shall be performed within the existing or proposed public right-of-way until a permit has been issued by the County Engineer. All work within the public road right-of-way is subject to inspection and approval by the County Engineer. 15. Applicant shall sign and record Spokane County Notice to the Public No. 6 which specif'ies the following: ' The owner(s) or successor(s) in interest agree to authorize the County to place their name(s) on a petirion for the formation of a Road Improvement District (RID) by the petition method pursuant to Chapter 36.88 RCW, which petition includes the owner(s) properry, and further not to object, by the signing of a ballot, the formation of a RID by the resolurion method pursuant to Chapter 36.88 RCW, which resolurion includes the owner(s) property. If an RID is formed by either the petition or resolution method, as provided for in Chapter 36.88 RCW, the owner(s) or successor(s) further agree: (a) that the improvement or construction contemplated within the proposed RID is feasible; (b) that the benefits to be derived from the fonnation of the RID by the property , included therein, together with the amount of any County participarion, exceeds the cost and expense of formation of the RID; and (c) that the property within the proposed RID is sufficiently developed. Provided further that the owner(s) or successor(s) shall retain the right, as authorized under RCW 36.88.090, to object to any assessment on the property as a result of the unprovements called for in conjunction with the formation of the RID by either petition or resolution method under Chapter 36.88 RCW. This provision is applicable to Carlisle Street. 16. There may exist utilities, either underground or overhead, affecting the subject property, including property to be dedicated or set aside for future acquisition. Spokane County assumes no financial obligation for adjustments or relocation regarding these utilities. Applicant(s) should check with the applicable utility purveyor and the Spokane County Engineer to deternune whether applicant(s) or the utility is responsible for adjustment or relocation costs and to make arrangements for any necessary work. HEC Order for ZE-10-91 Page 6 SPOKANE COUNTY UTILITIES DEPARTMENT 1. Pursuant to the Board of County Commissioners Resolurion No. 80-0418, the use of on-site sewer disposal systems is hereby authorized. This authorization is conditioned on compliance with all rules and regulations of the Spokane County - Health District and is further condirioned and subject to specific application approval and issuance of permits by the Health DistricL 2. The owner(s) or successor(s) in interest agree to authorize the County to place their name(s) on a petition for the formation of ULID by petition method pursuant to RCW 36.94, which petition includes the owner(s)' property; and further not to object by the signing of a protest petition against the formation of a ULID by resolution method pursuant to RCW Chapter 36.94 which includes the owner(s)' property. PROVIDED, this condition shall not prohibit the owner(s) or successor(s) from objecting to any assessment(s) on the property as a result of improvements called for in conjunction with the formation of a ULID by either petition or resolution method under RCW Chapter 36.94. 3. Any water service for this project shall be provided in accordance with the Coord.inated Water System Plan for Spokane County, as amended. 4. Each new dwelling unit shall be double-plumbed for connection to future areawide collection systems. SPOKANE COUNTY HEALTH DISTRICT 1. Sewage disposal method shall be as authorized by the Director of Utilities, Spokane County. 2. Water service shall be coordinated through the Director of Utilities, Spokane County. 3. Water service shall be by an existing public water supply when approved by the Regional Engineer (Spokane), State Department of Health. 4. Disposal of sewage effluent beneath paved surfaces is currently prohibited. 5. Subject to specific application approval and issuance of pernuts by the health officer, the use of (an) individual on-site sewage disposal system(s) may be authorized. Note: The current on-site sewage disposal system is sized for six employees. A new on-site system will be required for the residence. SPOKANE COUNTY ALR POLLUTION CONTROL AUTHORITY 1. Air pollurion regulations require that dust emissions during demolition, construction and excavation projects be controlled. This may require use of water sprays, tarps, sprinklers or suspension of activity during certain weather conditions. Haul roads should be treated, and emissions from the transfer of earthen material must be controlled, as well as emissions from all other construction-related activiries. HEC Order for ZE-10-91 Page 7 2. Measures must be taken to avoid the deposition of dirt and mud from unpaved surfaces onto paved surfaces. If tracki.ng or spills occur on paved surfaces, measures must be taken immediately to clean these surfaces. 3. SCAPCA Regulation I, Article V, requires that a Notice of Construction and Application for Approval be submitted to and approved by our agency prior to the construction, installation or establishment of an air pollution source. 4. SCAPCA Regulation I, Article VI, and SCAPCA Regulation II, Article IV, address emission standards. All emission standards must be met. ~ HEC Order for ZE-10-91 Page 8 SRDER . Spokane County Zoning Code Chapter 14.508.060 nonconforming buildings and structures provides that nonconforming buildings may be alteretl or extended as long as the alteration does not increase the buildings nonconfornuty. - F. Landscaping: A landscape strip consisting of Type III landscaping (see through buffer), 5 feet in width is required along the entire Carlisle Street right of way except for the' driveway. . G. Stormwater Drainage: The site plan shows 4 existing drywells for stormwater disposal. Z"he Engi.neers office has required that a detailed surface - watez disposal plan be submitted prior to any development. , H. Sewage Disposal: A septic system exists on the site for sewage disposal which is sized for up to 6 employees. A new on-site septic system must be installed for the proposed residence. The new dwelling unit must be double plumbed for future connection to an area wide collection system. I. Water Supply: Orchard Avenue I.rrigation District currently supplies water to the site. J. Fire Protection: Spokane County Fire Protection District No. 1 provides the protection for the site. Note: ' The site plan submitted for review by the Hearing Examiner Committee is , general in nature. SEPA 'ENVIRONMENTAL REVIEW An Environmental Checklist was submitted by the sponsor and was reviewed by the County Planning Department. The review considered the specifics of the proposal, other available information, County ordinances, other regulations and laws, possible standard Condirions of Approval, the Generalized Comprehensive Plan, and other . County policies and guidelines. The Planning Department has determined that "No probable significant adverse impacts" would result from the proposal being developed and has issued a Determinarion of Nonsignificance.("DNS The "DNS" was circulated to 9 other agencies of jurisdiction and other agencies/departments affected by the future development for review and comment. The "DNS" comment period ends April 16, 1991 and was advertised 15 calendar days before said date in the newspaper, by letter to adjacent property owners within 400 feet of the proposal, and by notice on a sign posted on the proposal site. The Hearing Examiner may consider additional environmental related testimony at the public hearing. V . PLANNING DEPARTMENT SUMMARY The proposal is located in the Urban Category of the Comprehensive category which generally supports neighborhood business but not regional business. The site fronts or a principal arterial and most of the site is currently zoned Regional B-usiness (B-3). The current use of the site is for office and warehouse. Business zoning and land uses are located to the east and west of the proposal. - Since the only change proposal is the addition of a second story residence and _ remalel of an existing warehouse structure, the Planning Department recommends approval of the proposal. Granting the rezone will provide consistent zoning for the entire site and will allow remodel of the structures used for business use that are currently located in the Urban Residential-3.5 (UR-3.5). SPOKANE COUNTY PLANNING DEPARTMENT • 1. All current standards of the Regional Business (B-3) zone, as amended, shall be complied with in the development of this site. 2. The applicant shall develop subject property generally in accordance within the concept presented to the Hearing Body. Variarions, when approved by the . Planning Director/designee, may be permitted, including, but not limited to building location, landscape plans and general allowable uses of the permitted zone. All variations must conform to regulations set forth in the Zoning Code for Spokane , County, and the original intent of the development plans shall be maintained. _ 3. The Planning Department shall prepare and record with the Spokane County Auditor a Title Notice noting that the property in question is subject to a variery of special condirions imposed as a result of approval of a land use action. This Title - Norice shall serve as public notice of the conditions of approval affecting the " properry in question. The Title Notice should be recorded within the same time frame as allowed for an appeal and shall only be released, in full or in part, by the Planning Department. SPOKANE COUNTY ENGINEER'S OFFICE The applicant shall dedicate 7.5 feet on Carlisle Street for right of way purposes. Prior To The Issuance Of A BuildinEr Permit Or Use Of The Propertv As PropQsed: 1. Access permits for approaches to the county road system shall be obtained from the Spokane County Engineer. 2. Access pernuts and improvements to Trent Avenue must be approved by the Washington State Department of Transportation (WSDOT). 3. The applicant shall submit for approval by the Spokane County Engineer road, drainage and access plans. , 4. The applicant shall submit for approval by the Spokane County Engineer and the - Spokane County Health District a detailed combined on-site sewage system plan . and surface water disposal plan for the entire project, or portion thereof, if the development is to be phased. 5. A parking plan and traffic circulation plan shall be submitted and approved by the Spokane County Engineer. The design, location and arrangement of parking stalls shall be in accordance with standard traffic engineering practices. Paving or surfacing as approved by the County Engineer, will be required for any portion of the project which is to be occupied or traveled by vehicles. 6. To construct the roadway improvements stated herein, the applicant may, with the approval of the County Engineer, join in and be willing to participate in any petition or resolution which purpose is the formation of a Road Improvement . District (RID) for said improvement, pursuant to RCW 36.88, as amended. Spokane County will not participate in the cost of these improvements. This is applicable to Carlisle Street. 7. As an alternative method of constructing the road improvements stated herein, the applicant may, with the approval of the County Engineer, accomplish the road improvements stated herein by joining and participating in a County Road Project • (CRP) to the extent of the required improvement. The construction of the road improvements stated herein shall be accomplished as approved by the Spokane County Engineer. 9. The County Engineer has designated Typical Roadway Secrion Number Two, Local Access standard for the improvement of Carlisle Street, which is adjacent to the proposeri developnient. This will require the addition of approximately [ 1 feet of asphalt along the frontage of the development. The construction of curbing . and sidewallc is also required. : 10. All required improvements shall conform to the current State of Washington Standard Specifications for Road and Bridge Construction and other applicable County standards and/or adopted resolutions pertaining to Road Standards and Stormwater Management in effect at the date of construction, unless otherwise approved by the County Engineer. 11. Access to Carlisle Street other than emergency access shall be prohibited until such time as specifically authorized by the Spokane County Engineer. 12. Roadway standards, typical roadway sections and drainage plan requirements are found in Spokane Board of County Commissioners Resolution No. 80-1592 as amended and are applicable to this proposal. . 13. This subdivision or development proposal is located within a drainage basin which has been identified-by the Spokane County Engineer's office as having stormwater _ runoff problems. Since this plat or development proposal is affected by or is a contributor to stormwater flows, property owners should participate in the planning and implementarion of a future basinwide stormwater management system. The - following statement shall be placed in the plat dedication: . , "The owner(s) or successor(s) in interest agree to join in any County-approved stormwater management program and to pay such rates and charges as may be fixed through public hearings for service or benefit obtained by the planning, design, constructing, maintaining or operation of stormwater control facilities." 14. If an RID is formed by either the petition or resolution method, as provided for in Chapter 36.88 RCW, the owner(s) or successor(s) further agree: . 4/91 HEC Staff Report for ZE-10-91 Page 95 t s (a) that the improvement or construction contemplated within the proposed RID is feasible; (b) that the benefits to be derived from the formation of the RID by the property included therein, together with the amount of any County participation, exceeds the cost and expense of formation of the RID; and (c) that the property within the proposed RID is sufficiently developed. Provided further that the owner(s) or successor(s) shall retain the right, as authorized under RCW 36.88.090, to object to any assessment on the property as a . result of the improvements called for in conjunction with the formation of the RID by either petirion or resolution method under Chapter 36.88 RCW. This provision is applicable to Carlisle Street. 16. There may exist utilities, either underground or overhead, affecting the subject property, including property to be dedicated or set aside for future acquisirion. Spokane Counry assumes no financial obligation for adjustments or relocation regarding these utilities. Applicant(s) should check with the applicable utility purveyor and the Spokane Counry Engineer to deternine whether applicant(s) or the utility is responsible for adjustment or relocation costs and to make arrangements for any_necessary work. SPOKANE COUNTY UTILITIES DEPARTMENT 1. Pursuant to the Board of County Commissioners Resolution No. 80-0418, the use of on-site sewer disposal systems is hereby authorized. This authorization is ' conditioned on compliance with all rules and regulations of the Spokane County . Health District and is further condirioned and subject to specific application approval and issuance of permits by the Health District. 2. The owner(s) or successor(s) in interest agree to authorize the County to place their name(s) on a petition for the fonnation of ULID by petition method pursuant to RCW 36.94, which petition includes the owner(s)' property; and further not to object by the signing of a protest petition against the formation of a ULID by resolurion method pursuant to RCW Chapter 36.94 which includes the owner(s)' property. Subject to specific application approval and issuance of permits by the health officer, the use of (an) individual on-site sewage disposal system(s) may be authorized. Note: The current on-site sewage disposal system is sized for six employees. A new on-site system will be required for the residence. SPOKANE COUNTY AIR POLLUTION CONTROL AUTHORITY 1. Air pollution regulations require that dust emissions during demolition, construction and excavarion projects be controlled. This may require use of water sprays, tarps, sprinklers or suspension of activity during certain weather conditions. Haul roads should be treated, and emissions from the transfer of earthen material must be controlled, as well as emissions from all other construcrion-related activities. . . 2. Measures must be taken to avoid the deposition of dirt and mud from unpaved surfaces onto paved surfaces. If tracking or spills occur on paved surfaces, ' measures must be taken immediately to clean these surfaces. 3. SCAPCA Regulation I, Article V, requires that a Notice of Construction and Application for Approval be submitted to and approved by our agency prior to the construction, installation or establishment of an ai.r pollution source. _ 4.
