The members of the Committee present are: Toni Nersesian, Chair, Brenda Bodenstein and Donald Moore. PROPOSAL The sponsor, Joseph O'Connor, requests approval of a Zone Reclassification, ZE-11-95, from Urban Residential-3.5 (UR-3.5) to Urban Residenrial-12 (UR-12) for professional offices and those uses allowed in the Urban Residential-12 (UR-12) zone. FINDINGS OF FACT AND CONCLUSIONS 1. The property is generally located north of and adjacent to Mission Avenue, south of Interstate-90, and approximately 160 feet east of Sargent Road in the SE 1/4 of Section 7, Township 25 North, Range 44 EWM, Spokane County, Washington. 2. The Cornmittee adopts the Planning Department Report as a part of this record. 3. The existing land uses in the area include small and large-lot single-family residences, duplexes, professional office and Interstate 90. 4. The proposed use is compadble with some existing uses in the area. 5. The property is located within the Urban (U) category of the Spokane County Comprehensive Plan and inside the Aquifer Sensitive Area (ASA), Priority Sewer Service Area (PSSA) and General Sewer Service Area (GSSA). The Urban category is intended to provide the opportunity for development of a"citylike" environment which includes various land uses, intensive residential development, and public facilities and services such as water, sanitary and storm sewer lines, and police and fire protection. The land use within this category is intended to be primarily residential, with single- family, two-family, multifamily, and condominium buildings along with neighborhood commercial, light industrial, and public and recreational facilities. The maximum residential net density within the Urban category will range from 1 unit to 17 units per acre. More intensive land uses such as light industrial and neighborhood commercial will be located near the heavily traveled streets, while the least intensive single family residential uses will be isolated from the noise and heavy traffic. Some land uses may require screening or other performance standards to make them more compatible with adjacent and neighboring land uses. Existing residential development should be buffered from new development where adverse effects may develop. Consideration should be given to the mitigation of impacts from new and more intensive sources of light, noise, and vehicular emissions. , ~ The proposed Zone Reclassification to Urban Residential-12 (UR-12) does implement the Goals, Policies, and Decision Guidelines of the Urban category of the Comprehensive Plan, but only in those areas where it does not unnecessanly encroach ugon and adversely impact existing single-family residential areas. 6. The proposed zoning does unplement and conform to the Comprehensive Plan. 7. The site is adjacent to Mission Avenue, which is identified by the Spokane County Arterial Road Plan as a Minor Arterial with a future right-of-way of 80 feet. To implement the Arterial Road Plan County Engineering requires 8 feet along Mission Avenue be set aside in reserve as Future Acquisition Area (FAA). 8. The existing zoning of the property described in the applicarion is Urban Residential-3.5 (UR-3.5) previously established as Agricultural Zone District (A-1) zoning in 1946 and redesignated to Urban Residential-3.5 (UR-3.5) on January 1, 1991 pursuant to the Program to Implement the Spokane County Zoning Code. The proposal does confoml to the requirements of the proposed zone. 9. The provisions of RCW 43.21C ('The State Environmental Policy Act) have been complied with and a Determination of Nonsignificance (DNS) was issued. The Committee, after independent review, hereby adopts the DNS. 10. The legal requirements for public notice have been fulfilled. 11. The owners of adjacent lands expressed disapproval of the proposed use. Concerns expressed were the d.isruption of single family residences and increase in automobile noise and exhaust emissions. 12. The applicant has demonstrated that conditions have substantially changed since the original zoning of this area and accordingly, the proposed zone reclassification is justified. Specifically, changed conditions include the trend toward zones Neighborhood Business (B-2), Community Business (B-2), Regional Business (B-3) and Urban Residential-7 (UR-7). 13. The proposed use will not be detrimental to the public health, safety, morals or welfare especially in light of the conditions recommended by the reviewing agencies. 14. The Committee additionally finds✓concludes: a. The applicant agrees with and accepts all conditions of approval. CONDITIONS OR CONTINGENCIES APPLIED TO THIS APPROVAL 1. All Conditions imposed by the Hearing Examiner Committee shall be binding on the "Applicant," which term shall include the owner or owners of the property, heirs, assigns, and successors-in-interest. 2. The Zone Reclassification applies to the real property described below: HEC Order for ZE- I 1-95 Page 2 r Lot 1 and 2 of Tellefson's Addition, as per plat recorded in Volume 1 of Plats, page 56, records of Spokane County; TOGETHER WTTH Tract 304 of Opportunity, according to plat recorded in Volume "K" of Plats, page 20 in Spokane County, Washington, lying East of said Tellefson's Addition; EXCEPT the East 299.00 feet of said Tract 304; ALSO EXCEPT, a private road access easement described as the South 325 feet of the West 40 feet of the East 319 feet of said Tract 304 of Opportunity. HEARING EXAMINER COMMITTEE 1. The applicant shall develop subject property in general confonnance with the site plan presented to the Hearing Body on Apri120, 1995. All aspects of the concept and proposal shall be binding on the development, including proposed use. Variations, to be approved by the Planning Ilirector/designee, shall only be allowed to meet regulation standards and conditions of approval. Any other modification must be presented to the Hearing Body for review and approval. SPOKANE COUNTY PLANNING DEPARTMENT 1. 1'he proposal shall comply with the Urban Residential-12 (UR-12) zone, as amended. 2. Approval is required by the Planning Director/designee of a specific lighting and signing plan for the described property prior to the release of any build.ing pernuts. 3. A specific landscape plan, planting schedule and provisions for maintenance acceptable to the Planning Director/designee sha11 be submitted with a perfonnance bond for the project prior to release of building pennits. Landscaping shall be installed and maintained so that sight distance at access points is not obscured or impaired. 4. Direct light from any exterior anea lighting fixture shall not extend over the property boundary. 5. The Spokane County Planning Department shall prepare and record with the County Auditor a Tide Notice specifying a future land acquisition anea for road right-of-way and utilities. The reserved future acquisition area Title Notice shall be released, in full or in part, by the Planning Department.l'he notice should be recorded within the same time frame as an appeal and shall provide the following: a. At least 8 feet of reserved future acquisition area for road right-of-way and udlities, in addition to the existing and/or newly dedicated right-of-way along Mission Avenue. NOTE: The County Engineer has required 2 feet of new dedication. b. Futune building and other setbacks required by the Spokane County Zoning Code shall be measured from the reserved future acquisirion area. c. No required landscaping, parking, '208' areas, drainfield or allowed signs should be located within the future acquisition area for road right-of-way and utilities. If HEC Order for ZE-11-95 Page 3 r any of the above improvements are made within this area, they shall be relocated at the applicant's expense when roadway improvements are made. d. The future acquisition area, until acquired, shall be private property and may be used as allowed in the zone, except that any improvements (such a.s landscaping, parldng, surface drainage, drainfield, signs or others) shall be considered interim uses. e. The property owner shall be responsible for relocating such "interim" improvements at the time Spokane County makes roadway unprovements after acquiring said future acquisition area. 6. The applicant shall develop subject property in strict conformance with the site plan presented to the Hearing Body on Apri120, 1995. All aspects of the concept and proposal sha11 be binding on the development, including proposed use. Variations, to be approved by the Planning I?irector/designee, shall only be allowed to meet regulation standards and conditions of approval. Any other modification must be presented to the Hearing Body for review and approval. (Amended by Hearing Examiner Committee Condition No. 1) 7. The Planning Department shall prepare and record with the Spokane County Auditor a Title Notice noting that the property in quesdon is subject to a variety of special cond.itions imposed a.s a result of approval of a land use action. This Tide Norice shall serve as public notice of the conditions of approval affecring the property in question. The Title Notice should be reconied within the same time frame as allowed for an appeal and shall only be released, in full or in part, by the Planning Department. The Title Notice shall generally provide as follows: The parcei of property legally described as [ ] is the subject of a land use action by a Spokane County Hearing Body or Administrative Official on [ imposing a variety of special development conditions. File No. [ ] is available for inspection and copying in the Spokane County Planning Department. SPOKANE COUNTY DIVISION OF ENGINEERING AND ROADS Prior to issuance of a building permit or at the request of the County Engineer in conjunction with a County Road ProjectlRoad Improvement District, whichever comes first: 1. Applicant shall dedicate 2 feet on Mission Avenue for right-of-way. Prior to release of a building pernut or use progerty as proposed: 2. Access permits for approaches to the County Road System shall be obtained from the County Engine,er. 3. Applicant shall submit for approval by the Spokane County Engineer road, drainage and access plans. 4. The applicant shall submit for approval by the Spokane County Engineer and the Spokane County Health District a detailed combined on-site sewage system plan and HEC Order for ZE-11-95 Page 4 surface water disposal plan for the entire project or portion thereof if the development is phased. 5. A parking plan and traffic circulation plan shall be submitted and approved by the Spokane County Engineer. The design, location and arrangement of parking stalls shall be in accordance with standard engineering practices. Paving or surfacing as approved by the County Engineer will be required for any portion of the project which is to be occupied or traveled by vehicles. 6. The construction of the roadway improvements stated herein sha11 be accomplished as approved by the Spokane County Engineer. 7. The County Engineer has designated Typical Roadway Section Number 1 Minor Arterial Standard for the improvement of Mission Avenue which is adjacent to the proposed development. This will require the addition of approxirnately 11-13 feet of asphalt along the frontage of the developmenL Curbing and sidewalk must also be constructed. 8. All required improvements shall conform to the current State of Washington Standard Specifications for Road and Bridge construction and other applicable county standards andlor adopted resolutions pertaining to Road Standards and Stormwater Management in effect at the date of construction, unless otherwise approved by the County Engineer. 9. The applicant shall construct a paved and delineated approach(s) to meet the existing pavement on Mission Avenue. 10. Roadway standards, typical roadway sections and drainage plan requirements are found in Spokane Board of County Commissioners resolution 80-1592 as amended and are applicable to this proposal. 11. That the regulations of the National Flood Insurance Program be observed since the proposed development is affected by a flood hazard zone. A development permit shall be obtained from the County Engineer before construction or development begins within any area of the special flood hazani zone (reference Spokane County Ordinance 80-0726). 12. No construction work is to be performed within the e3cisting or proposed right-of-way until a pernut has been issued by the County Engineer. All work within the public road right-of-way is subject to inspection and approval by the County Engineer. 13. All required construction within the existing or proposed public right-of-way is to be completed prior to the release of a building permit or a bond in an amount estimated by the County Engineer to cover the cost of construction or improvements shall be filed with the County Engineer. 14. The County Arterial Road plan identifies Mission Avenue as an 80-foot Minor Arterial. The existing right-of-way width of 60 feet is not consistent with that specified in the Plan. In order to implement the Arterial Road Plan it is recommended that in addition to the required right-of-way dedication, a strip of property 8 feet in width along the Mission Avenue frontage be set aside in reserve. This property may be acquired by Spokane County at the time when Arterial Improvements are made to Mission Avenue. HEC Order for ZE-11-95 Page 5 ~ 15. The applicant should be advised that there may exist utilities either underground or overhead affecting the applicant's property, including property to be dedicated or set- aside future acquisition. Spokane County will assume no financial obligation for adjustments or relocation regarding these utilities. The applicant should check with the applicable utilities and Spokane County Engineer to determine whether the applicant or utiliry is responsible for adjustment or relocation costs and to make arrangements for any necessary work. 16. The applicant is advised that road and drainage plans have been approved for Mission Avenue in conjunction with building pernut #B94041. A bond for $19,300.00 was accepted by Spokane County in lieu of the actual improvements. Approval of plans for construction is granted for two years. Should the improvements not be installed at the end of two years, the County Engineer may require the applicant to resubmit plans to be reviewed under existing standards. 17. The applicant shall demonstrate to the satisfaction of the County Engineer that the appropriate reciprocal ingress/egress and parking easements have been reconied with the Counry Auditor in conjunction with the parlcing and circulation plan and in lieu of private road plans. SPOKANE COUNTY DIVISION OF UTILITIES 1. Any water service for this project shall be provided in accordance with the Coordinated Water System Plan for Spokane County, as amended. 2. Pursuant to the Boazd of County Commissioners Resolution No. 80-0418, the use of on-site sewer disposal systems is hereby authorized. This authorizadon is cond.itioned in compliance with all rules and regulations of the Spokane County Health District and is further conditioned and subject to specific applicarion approval and issuance of permits by the Health District. 3. A covenant agreement shall be signed stating: The Owner(s) or Successor(s) in interest agnee to authorize the County to place their name(s) on a petition for the formation of a ULID by petition method pursuant to RCW 36.94 which the petition includes the Owner(s) property and further not to object by signing of a protest petition against the formation of a ULID by resolution method pursuant to RCW 36.94 which includes the Owner(s) properiy. PROVIDED, this condiaon shall not prohibit the Owner(s) or Successor(s) from objection of any assessment(s) on the properry as a result of imprnvements called for in conjunction with the formation of a ULID by either petition or resolution under RCW 36.94. 4. Each new structure shall be double plumbed for connection to future area-wide collection systems. 5. Applicant shall submit expressly to Spokane Counry Utilities Department "under separate cover", only those plan sheets showing sewer plans and specifications for: Double Plumbing for review and approval by Utilities Deparanent prior to issuance of pennit to connect. HEC Order for ZE-11-95 Page 6 ~ SPOKANE COUNTY HEALTH DISTRICT 1. A combined surface water and sewage disposal plan shall be approved by the Sgokane County Engineer and Spokane County Health District prior to the issuance of any on- site sewage disposal pernut or building pernut for this project. 2. Sewage disposal method shall be as authorized by the Director of Utilities, Spokane County. 3. Water service shall be coordinated through the Director of Utilities, Spokane County. 4. Water service shall be by an existing public water supply when approved by the Regional Engineer (Spokane), State Department of Health. 5. Disposal of sewage effluent beneath paved surfaces is currently prohibited. 6. Subject to specific application approval and issuance of permits by the Health Officer, the use individual on-site sewage disposal systems may be authorized. 7. Use of private wells and water systems is prohibited. SPOKANE COUNTY FIRE PROTECTION DISTRICT NO. 1 1. Fire apparatus access shall comply with requirements of the Uniform Fire Code. 2. The enrire proposal should be given Mission Avenue addresses. 3. An approved water plan showing fire hydrant placement will be required. WASHINGTON STATE DEPARTMENT OF TRANSPORTATION 1. To accommodate any future widening which may become necessary to I-90, standard setbacks need to be maintained. No variances will be allowed. 2. Any new signs visible from I-90 will need to be reviewed by WSDOT Traffic 4ffice. 3. Drainage from this development will not be allowed onto I-90 right-of-way. All dra.inage must be provided for on site. SPOKANE COUNTY DIVISION OF BUILDINGS 1. The applicant shall contact the Department of Buildings at the earliest possible stage in orcier to be informed of code requirements administered/enforced as authorized by the State Building Code Act. Design/development concerns include: Addressing, fire apparatus access roads, fire hydrantlflow, approved water systems, building accessibility, construction type, occupancy classification, exiting, exterior wall protection, and energy code regulations. (Note: The Department of Buildings reserves the right to confum the actual adciness at the time of building permit.) HEC Order for ZE-11-95 Page 7 f SPOKANE COUNTY AIR POLLUTION CONTROL AUTHORTTY 1. All~ air pollution regulations must he met. 2. Air polludon regulations require that dust emissions during demolirion, construction and excavarion projects be controlled. This may require use of water sprays, tarps, sprinklers or suspension of activity during certain weather conditions. Haul roads should be treated, and emissions from the transfer of earthen material must be controlled, as well as emissions from a11 other construction-related acrivities. 3. SCAPCA strongly recommends that all traveled surfaces (i.e., ingress, egress, parking areas, access roads) be paved and kept clean to minimize dust emissions. 4. Measures must be taken to avoid the deposition of dirt and mud from unpaved surfaces onto paved surfaces. If tracking or spills occur on paved surfaces, measures must be taken immediately to clean these surfaces. 5. SCAPCA Regulation I, Article V, requires that a Notice of Constrvction and Application for Approval be submitted to and approved by our Agency prior to the construction, installation or establishment of air pollution source. This includes any fuel fired equipment rated at greater than 400,040 BTU/hour (boilers, hot water heaters, ovens, etc It also includes paint booths and other sources of air contatninants. 6. SCAPCA Regulation I, Article IV requires registration with this agency. 7. Debris generated as a result of this project must be disposed of by means other than burning, i.e., construction waste, etc. 8. Demolition and renovaaon projects must comply with the requirements of CFR 40, Part 61, Subpart M and SCAPCA Regulation I, Article IX which address asbestos abatement. 'Intent to Demolish' forms are available at the SCA.PCA of~'ice. 9. Failure to meet SCAPCA regulations may result in delays, closure and civil and/or criminal sancdons. Proposal: Zone Reclassificarion from Urban Residential-3.5 (UR-3.5) to Urban Residential-12 (UR-12) for professional offices and those uses allowed in the Urban Residential-12 (UR-12) zone. II. SITE INFORMATION A. Site Size: Approximately 1.56 acres B . Comprehensive Plan 1. Land Use Plan: The property is located within the Urban (U) category of the Spokane County Comprehensive Plan and inside the Aquifer Sensitive Area (ASA), Priority Sewer Service Area (PSSA) and General Sewer Service Area (GSSA). The Urban category is intended to provide the opportunity for development of a"citylike" environment which includes 4/95 HEC Staff Report for ZE-11-95 Page 68 • ♦ various land uses, intensive residendal development, and public faciliries and services such as water, sanitary and storm sewer lines, and police and fire protection. The land use within this category is intended to be primarily residential, with single-family, two-family, multifamily, and condominium buildings along with neighborhood commercial, light industrial, and public and recreational facilities. The maximum residential net density within the Urban category will range from 1 unit to 17 units per acre. More intensive land uses such as light industrial and neighborhood commercial will be located near the heavily traveled smeets, while the least intensive single family residential uses will be isolated from the noise and heavy traff'ic. Some land uses may require screening or other performance standands to make them more compatible with adjacent and neighboring land uses. Existing residential development should be buffered from new development where adverse effects may develop. Consideradon should be given to the mitigation of impacts from new and more intensive sources of light, noise, and vehicular emissions. The proposed Zone Reclassification to Urban Residential-12 (UR-12) does implement the Goals, Policies, and Decision Guidelines of the Urban category of the Comprehensive Plan, but only in those areas where it does not unnecessarily encroach upon and adversely impact existing single- family residential areas. 2. Arterial Road P18n: The site is adjacent to Mission Avenue, which is identified by the Spokane County Arterial Road Plan as a Minor Arterial with a future right-of-way of 80 feet. To implement the Anerial Road Plan County Engineering requires 8 feet along Mission Avenue be set aside in reserve as Future Acquisition Area (FAA). 3. County Parks Plan: The County park closest to the proposal is Balfour Park, which is located approximately 1.3 miles southeast of the proposal. The park is approximately 1.2 acres in size and equipped with picnic tables, drinking fountains, play equipment, volleyball court, and restrooms. C. Site Characteristics: The site slopes gradually from the street down to the north end of the site. D. Neighborhood Characteristics: The area to the north is right-of-way for Interstate-90. To the south and west are single-family residences. To the east and southeast are large office, motel, restaurant, and retail conunercial structures. E . Zoning Analysis: Proposal: Urban Residential-3.5 (UR-3.5) established in 1991, previously designated as Agricultural Zone District (A-1) (84-46). North: Urban Residendal-3.5 (UR-3.5) established in 1991, previously designated as Agricultural Zone District (A-1) (84-46). (Interstate- 90 right-of-way). South: Urban Residential-3.5 (UR-3.5) established in 1991, previously designated as Agricultural Zone District (A-1) (246-47). 4/95 HEC Staff Report for ZE-11-95 Page 69 ~ . East: Community Business (B-2) established in 1991, previously designated as Agricultural Zone District (A-1) (84-46). West: Urban Residenrial-3.5 (UR-3.5) established in 1991, previously designated as Agricultural Zone District (A-1) (84-46). The zoning trend in the area of the proposal remains strongly Urban Residential-3.5 (UR-3.5) at the site and to the south and west. To the east and southeast, the zoning trend is toward Urban Residential-7 (UR-7), with Neighborhood Business (B-1), Community Business (B-2), and Regional Business (B-3) along the Argonne-Mullan comdor. The proposed Urban Residential-12 (UR-12) zone is consistent with the Urban (iJ) category of the Comprehensive Plan, which affords the opportunity for a"cirylike" environment, with a variety of land uses such as intensive residential, offices, and neighborhood cornmercial. F . Land Use Analysis: Site: Single-family residences and duplexes. North: Interstate-90. South: Large-lot single-family residences. East: Professional office, duplex, and single-family residence. West: Small-lot single-family residences Land uses in the area consist of an interstate highway, a professional office, duplexes, and single-fami.ly residences. The proposed zone reclassification to Urban Residential-12 (UR-12) is generally not consistent with existing zoning and land use trends to the south and to the west, but would provide a transirion and it is generally consistent with existing zoning and land use to the east and to the southeast. G. Circulation: The site plan of record indicates that there will be direct access by a private driveway from Mission Avenue. H . Design: 1. Site Plan Data Proposed Site Plan: The site plan of record, as submitted, illustrates two two-story office buildings, along with parking and landscaping. Not illustrated are the existing residential structures on the constituent parcels which comprise the total land area of the proposal. The site plan dces illustrate general compliance with the minimum development standards of the proposed Urban Residential-12 (UR-12) zone. Proposed Buffering/Landscape Techniques: The proposed site plan illustrates 7 feet of Type II landscaping along the Interstate-90 right-of-way, whereas the Zoning Code stipulates 25 feet of Type U. Adjacent to Mission Avenue the site plan illustrates 28 feet of Type III landscaping, which exceeds the 20 foot stand.ard of the Zoning Code. A 6-foot sight-obscuring wall is shown where the property abuts the Urban Residendal-3.5 zone on the west property line, to which the Zoning Code requires 20 feet of Type I landscaping. (Chap. 14.806.040) The site plan shall demonstrate compliance with the standards of the Zoning Code prior to issuance of building pernuts. Other Site Plan Considecations: The site plan submitted for review by the Hearing Examiner Committee is generai in nature. Detailed review to detemii.ne compliance with all Code regulations and conditions of approval is recommended to he administrative and to occur at the Building Permit stage. J. Drainage: Site development shall comply with reguladons of Narional Flood Insurance Program since the parcel is affected by a flovd hazard zone. A development pennit shall be obtained from the County Engineer before construction or development begins within any area of the special flood hazard zone. K. Power Transmission Lines/Other Known Easements: County Engineering advises that there may be utilities either underground or overhead affecting the applicant's property. The applicant should check with the applicable utilities and Spokane County Engineer to deternune whether the applicant or utility is responsible for adjustment or relocation costs and to make arrangements for any necessary work. L. Water Supply: The proposal is served by Modern Electric Water Company. M. Sewage Disposal: An on-site sewer system will serve the proposal. Each structure shall be double-plumbed for connection to future area-wide collection systems. N. School: The proposal is in the West Valley School District #363. 4/'95 HEC Staff Report for ZE-11-95 Page 71 x O. Fire Protection: The proposal is within Fire District No. 1. The Fire District and the Division of Buildings Department (Fire Marshall) are required to approve fire protection provisions prior to issuance of building pernuts. P. Wetlands: Spokane County Wetland Inventory Maps do not indicate the presence of wetlands on the site. Q. Cultural Resources: None have been identified. R. Transit: Spokane Transit Authority Route #12 serves Mission Avenue east of Argonne Road and Route #19 serves Argonne and Mullan Roads. III. ENVIRONMENTAL REVIEW: An Environmental Checklist was subnutted by the sponsor and was reviewed by the County Planning Department. The review considered the specifics of the proposal, other available informadon, County ordinances, other regulations and laws, possible standard Conditions of Approval, the Generalized Comprehensive Plan, and other County policies and guidelines. The Planning Department has detennined that "No probable significant adverse impacts" would result from the proposal being developed and has issued a Determination of Nonsignif'icance ("DNS"). The "DNS" was circulated to 13 other agencies of jurisd.iction and other agencies/deparbments affected by the future development for review and comment. The "DNS" comment period ends Apri118, 1995 and was advertised 15 calendar days before said date in the newspaper, by letter to adjacent property owners within 400 feet of the progosal, and by notice on a sign posted on the proposal site. The Hearing Examiner may consider additional envinonmental related testimony at the public hearing. I V. PLANNING DEPARTMENT SUMMARY AND RECOMMENDATION The proposed Zone Reclassification from Urban Residential-3.5 (UR-3.5) to Urban Residential-12 (UR-12) is consistent with the Goals, Objectives and Decision Guidelines of the Urban (i) category of the Spokane County Comprehensive Plan and it is generally compatible with the land use trends in the general area of the proposal. The pnoposal is not compatible with the single-family residenaal land uses to the south and to the west of the proposal. However, the proposal dces implement the development standards of the proposed Urban Residential-12 (UR-12) zone, though that zone is only compatible with land use trends to the east along Mission Avenue and not in the area to the south and to the west of the proposal. Adjustments to the site plan will be necessary to demonstrate compliance with the Zoning Code prior to issuance of building permits. The Planning Department therefore recommends approval, as conditioned. V. CONDITIONS OF APPROVAL i. All conditions imposed by the Hearing Examiner Committee shall be binding on the "Applicant", which terms shall include the owner or owners of the property, heirs, assigns and successors. 4/'95 HIEC Staff Report for ZE-11-95 Page 72 . i i. The zone reclassification applies to the following real property: Lot 1 and 2 of Tellefson's Addition, as per plat recorded in Volume 1 of Plats, page 56, records of Spokane County; TOGETHER WITH Tract 304 of Opportunity, according to plat recorded in Volume "K" of Plats, page 20 in Spokane County, Washington, lying East of said Tellefson's Addition; EXCEPT the East 299.00 feet of said Tract 304; ALSO EXCEPT, a private road access easement described as the South 325 feet of the West 40 feet of the East 319 feet of said Tract 304 of Opportunity. SPOKANE COUNTY PLANNING DEPARTMENT 1. The proposal shall comply with the Urban Residential-12 (UR-12) zone, as amended. 2. Approval is required by the Planning Director/designee of a specific lighting and signing plan for the described property prior to the release of any building permits. - 3. A specific landscape plan, planting schedule and provisions for maintenance acceptable to the Planning Director/designee shall be submitted with a perfonnance bond for the project prior to release of build.ing pernuts. Landscaping shall be installed and maintained so that sight distance at access points is not obscured or unpair+ed. 4. Direct light from any exterior area lighting fixture shall not extend over the property boundary. 5. The Spokane County Planning Deparnnent shall prepare and record with the Counry Aud.itor a Tide Notice specifying a future land acquisition area for road right-of-way and utilities. The reserved future acquisition area Tide Notice shall be released, in full or in part, by the Planning Department. The notice should be recorded within the same time fYame as an appeal and shall provide the following: a. At least 8 feet of reserved future acquisition area for road right-of-way and utilities, in addition to the existing andlor newly dedicated right-of-way along Mission Avenue. NOTE: The County Engineer has required 2 feet of new dedication. b. Future building and other setbacks required by the Spokane County Zoning Code shall be measured from the reserved future acquisidon area. c. No required landscaping, parking, '208' areas, drainfield or allowed signs should be located within the future acquisition area for road right-of-way and utilides. If any of the above improvements are made within this area, they shall be relocated at the applicant's expense when roadway improvements are made. d. The future acquisition area, until acquired, shall be private property and may be used as allowed in the zone, except that any improvements (such as landscaping, parking, surface drainage, drainfield, signs or others) shall be considered interim uses. 4/95 HEC Staff Report for ZE-11-95 Page 73 'w 1 e. The property owner shall be responsible for relocating such "interim" improvements at the time Spokane County makes roadway improvements after acquiring said future acquisition area. 6. The applicant shall develop subject property in strict conformance with the site plan presented to the Hearing Body on Apri120, 1995. All aspects of the concept and proposal shall be binding on the development, including proposed use. Variations, to be approved by the Planning Director/designee, shall only be allowed to meet regulation standards and conditions of approval. Any other modification must be presented to the Hearing Body for review and approval. 7. The Planning Department shall prepare and record with the Spokane County Auditor a Title Notice noting that the property in question is subject to a variety of special cond.itions imgosed as a result of approval of a land use action. This Tide Notice shall serve as public notice of the conditions of approval affecting the property in question. The Title Norice should be recorded within the same rime frame as allowed for an appeal and shall only be released, in full or in part, by the Planning DepartmenL The Title Nodce shall generally provide as follows: The parcel of property legally described as [ ] is the sub ject of a land use action by a Spokane County Hearing Body or Administrative Official on [ imposing a variety of special development conditions. File No. [ ] is available for inspection and copying in the Spokane County Planning Department. SPOKANE COUNTY DIVISION OF ENGINEERING AND ROADS Prior to issuance of a building pernut or at the request of the County Engineer in conjunction with a County Road Project/Road Improvement District, whichever comes first: 1. Applicant shall dedicate 2 feet on Mission Avenue for right-of-way. Prior to release of a building pernut or use property as proposed: 2. Access permits for approaches to the County Road System shall be obtained from the County Engineer. 3. Applicant shall submit for approval by the Spokane Counry Engineer road, drainage and access plans. 4. The applicant shall submit for approval by the Spokane County Engineer and the Spokane County Health District a detailed combined on-site sewage system plan and surface water disgosal plan for the entire project or portion thereof if the development is phased. 5. A parking plan and traffic circulation plan shall be submitted and approved by the Spokane County Engineer. The design, location and anangement of parking stalls shall be in accordance with standard engineering practices. The construction of the roadway improvements stated herein shall be accomplished as approved by the Spokane County Engineer. 7. The County Engineer has designated Typical Roadway Section Number 1 Minor Arterial Standard for the improvement of Mission Avenue which is adjacent to the proposed development. This will require the addition of approximately 11-13 feet of asphalt along the frontage of the development. Curbing and sidewalk must also be constructed. 8. All requined improvements shall conform to the current State of Washington Standard Specifications for Road and Bridge construction and other applicable county standards andlor adopted resolutions pertaining to Road Standards and Stormwater Management in effect at the date of construcdon, unless otherwise approved by the County Engineer. 9. The applicant shall construct a paved and delineated approach(s) to meet the existing pavement on Mission Avenue. 10. Roadway standards, typical roadway sections and drainage plan requirements are found in Spokane Board of County Commissioners resolution 80-1592 as amended and are applicable to this proposal. 11. That the regulations of the National Flood Insurance Program be observed since the proposed development is affected by a flood hazard zone. A development pernut shall be obtained from the County Engineer before construction or development begins within any area of the special flood hazard zone (reference Spokane County Ordinance 80-0726). 12. No construction work is to be performed within the existing or proposed right-of-way until a pennit has been issued by the County Engineer. All work within the public road right-of-way is subject to inspection and approval by the County Engineer. 13. All required construction within the existing or proposed public right-of-way is to be completed prior to the release of a building pemut or a bond in an amount estimated by the County Engineer to cover the cost of construction or unprovements shall be filed with the Counry Engineer. 14. The County Arterial Road plan identifies Mission Avenue as an 80-foot Minor Arterial. The existing right-of-way width of 60 feet is not consistent with that specified in the Plan. In order to implement the Arterial Road Plan it is recommended that in addition to - the required right-of-way dedicarion, a strip of property 8 feet in width along the Mission Avenue frontage be set aside in reserve. This property may be acquired by Spokane County at the time when Arterial Improvements are made to Mission Avenue. 15. The applicant should be advised that there may exist utilities either underground or overhead affecting the applicant's property, including property to be dedicated or set- aside future acquisition. Spokane County will assume no financial obligation for adjustments or relocation regarding these utilities. The applicant should check with the applicable utilities and Spokane County Engineer to determine whether the applicant or utility is responsible for adjustment or relocation costs and to make amarigements for any necessary work. 16. The applicant is advised that road and dra.inage plans have been approved for Mission Avenue in conjunction with building pernut #B94041. A bond for $19,300.00 was 4/95 HEC Staff Report for ZE-11-95 Page 75 ~ accepted by Spokane County in lieu of the actual improvements. Approval of plans for construction is granted for two years. Should the improvements not be installed at the end of two years, the County Engineer may require the applicant to resubmit plans to be reviewed under existing standards. 17. The applicant shall demonstrate to the satisfaction of the Counry Engineer that the appropriate reciprocal ingress/egress and parking easements have been recorded with the County Auditor in conjunction with the parking and circularion plan and in lieu of private road plans. SPOKANE COUNTY DIVISION OF UTILITIES 1. Any water service for this project shall be provided in accordance with the Coordinated Water System Plan for Spokane County, as amended. 2. Pursuant to the Board of County Commissioners Resolution No. 80-0418, the use of on-site sewer d.isposal systems is hereby authorized. This authorization is condirioned in compliance with a11 rules and regulations of the Spokane County Health District and is furiher conditioned and subject to specific application approval and issuance of pernuts by the Health District. 3. A covenant agreement shall be signed stating: The Owner(s) or Successor(s) in interest agree to authorize the County to place their name(s) on a petition for the formadon of a ULID by petition method pursuant to RCW 36.94 which the petition includes the Owner(s) property and further not to object by signing of a protest petidon against the formation of a ULID by resolution methai pursuant to RCW 36.94 which includes the Owner(s) property. PROVIDED, this condition shall not prohibit the Owner(s) or Successor(s) from objecrion of any assessment(s) on the property as a result of improvements called for in conjunction with the formation of a ULID by either petition or resolution under RCW 36.94. 4. Each new structure shall be double plumbed for connection to future area-wide collection systems. 5. Applicant shall submit expressly to Spokane County Utilities Department "under separate cover", only those plan sheets showing sewer plans and specifications for: Double Plumbing for review and approval by Utilities Deparnnent prior to issuance of peITYllt t0 COMCCi. SPOKANE COUNTY HEALTH DISTRICT 1. A combined surface water and sewage disposal plan shall be approved by the Spokane County Engineer and Spokane County Health District prior to the issuance of any on- site sewage disposal pernut or building permit for this project. 2. Sewage disposal method shall be as authorized by the Director of Utilities, Spokane County. 3. Water service shall be by an existing public water supply when approved by the Regional Engineer (Spokane), State Department of Health. 5. Disposal of sewage effluent beneath paved surfaces is cunendy prohibited. 6. Subject to specific application approval and issuance of pernuts by the Health Officer, the use individual on-site sewage disposal systems may be authorized. 7. Use of private wells and water systems is prohibited. SPOKANE COUNTY FIRE PROTECTION DISTRICT NO. 1 1. Fire apparatus access shall comply with requirements of the Uniform Fire Code. 2. The entire proposal should be given Mission Avenue addresses. 3. An approved water plan showing fire hydrant placement will be required. WASHINGTON STATE DEPARTMENT OF TRANSPORTATION 1. To accommodate any future widening which may become necessary to I-90, standard setbacks need to be maintained. No variances will be allowed. 2. Any new signs visible from I-90 will need to be reviewed by WSDOT Traffic Office. 3. Drainage from this development will not be allowed onto I-90 right-of-way. All cirainage must be provided for on site. SPOKANE COUNTY DIVISION OF BUILDINGS 1. The applicant shall contact the Department of Buildings at the earliest possible stage in order to be informed of code requirements administeredJenforced as authorized by the State Building Code Act. Design/development concerns include: Addressing, fire apparatus access roads, fire hydrant/flow, approved water systems, building accessibility, construcdon type, occupancy classificarion, exiting, exterior wall protection, and energy code regulations. (Note: The Department of Buildings reserves the right to confirm the actual address at the time of build,ing permit.) SPOKANE COUNTY AIR POLLUTION CONTROL AUTHORITY 1. All air pollution regulations must be met. 2. Air polludon regulations require that dust etnissions during demolirion, construction and excavation projects be controlled. This may require use of water sprays, tarps, sprinklers or suspension of activity during certain weather conditions. SCAPCA strongly recommends that all traveled surfaces (i.e., ingress, egress, parlcing areas, access roads) be paved and kept clean to minimize dust emissions. 4. Measures must be taken to avoid the deposition of dirt and mud from unpaved surfaces onto paved surfaces. If tracking or spills occur on paved surfaces, measures must be taken immediately to clean these surfaces. 5. SCAPCA Regulation I, Article, V requires that a Notice of Construction and Application for Approval be submitted to and approved by our Agency prior to the construction, installadon or establishment of air pollution source. This includes any fuel fired equipment rated at greater than 400,000 BTU/hour (boilers, hot water heaters, ovens, etc It also includes paint booths, and other sources of air contaminants. 6. SC'APCA Regulation I, Article IV requires registrarion with this agency. 7. Debris generated as a result of this project must be disposed of by means other than burning i.e., construction waste, etc.). 8. Demolition and renovation projects must comply with the requirements of CFR 40, Part 61, Subpart M and SCAPCA Regulation I, Article IX which address asbestos abatement. Intent to Demolish forms are available at the SCAPCA office. 9.
