FINDINGS AND ORDER
A. INTRODUCTION
This matter having come before the Zoning Hearing Examiner Committee on
August 6, 1981, and the members of the Committee present being Ron Odell,
Chairman, and Gary N. Anderberg and John W. Skadan.
B. PROPOSAL
The sponsor, Robert Bonuccelli, is requesting approval of a zone
reclassification, File No. ZE-23-87 Agricultural to Urban Residential-22
(UR-22) Zone, for the purpose of developing apartments and/or offices.
C. FINDINGS OF FACT
1. That the existing land use in the area is single family residential,
duplexes, apartments, motel, Interstate 90, and open area.
2. That the Comprehensive Plan designates this area as appropriate for
MAJOR COMMERCIAL development.
3. That the existing zoning of the property described in the application
is Agricultural.
4. That the provisions of RCW 43.21C (The State Environmental Policy
Act) have been complied with, and the Committee concurs with the
Determination of Non-Significance.
5. That the proper legal requirements for advertisement of the Agenda
Item have been fulfilled.
6. That the land in this area is suitable for the proposed use, or
uses within the proposed Zone Classification.
l. That the applicant has demonstrated that conditions have
substantially changed since the original zoning of this area and
accordingly, the proposed rezone is justified.
8. That the proposed rezone is compatible with existing uses in the
area; especially in light of all mitigating conditions of approval
attached by the Hearing Examiner Committee.
9. That the owners of adjacent lands expressed disapproval of the
proposed rezone.

C. FINDINGS OP FACT (_continued) ZE-23-87
10. The Hearing Examiner Comrnittee finds the proposed use to be in
harmony with the general purpose and will not be otherwise
detrimental to the public health, safety, and welfare.
11. The following are additional findings of fact considered by the
Hearing Examiner Committee:
a) The Major Commercial category of the Comprehensive Plan would
support the development of this site for office and apartment
uses, especially in light of the Plan's transitional policies.
The Plan urges recognition of the adjoining residential
neighborhood and encourages measures be taken to insure
compatibility.
b) Location of the site, adjacent to apartments, Interstate 90 and
a commercial frontage road (Hutchinson Road), makes the site
more desirable for a higher intensity use. Given the land use
pattern in the area, apartment usage would seem to be the
logical extension of the pattern. Nowever, office uses are also
allowed in the zone and would provide an adequate transition
into the residential neighborhood. In regards to the level of
activity and hours of operation, offices uses are sometimes more
readily accepted adjacent to residential uses than are
apartments. The decision to locate apartments or offices on
this site would be an economic consideration of the applicant.
c) Traffic impacts to the neighborhood, either with office o r
apartment development, would be eliminated with the recommended
traffic circulation conditions. Those conditions will require
the termination of Hutchinson Road into a cul-de-sac, prohibited
access to Sargent Road, construction of a continuous fence along
Sargent Road and additional landscaping along Sargent Road.
d) The landscape standards of the Spokane County Zoning Code and as
recommended should provide adequate buffering to the adjacent
properties whether the site is developed for office or apartment
usage. The additional requirement for a building height
limitation should mitigate visual impacts on adjacent properties
and be consistent with heights established at the adjoining
apartment complex.
e) The Hearing Examiner Committee notes that the site is designated
Major Commercial on the Comprehensive Plan and as such the
planned zoning c rossover to occur in 1991 would place the
property in a Commercial Zone classification; either Community
Business (B-2) or Regional Business (B-3) Zone. Approval of the
rezone as proposed, to the less intense Urban Residential-22
(UR-22) Zone, with conditions of approval to accomplish
transition to the adjacent residential uses and mitigate impacts
to those uses should be more compatible to area.

(All Conditions imposed by the Zoning Hearing Examiner Committee shall be
binding on the "Applicant", which term shall include the owner or owners
of the property, heirs, assigns, and successors.)
HEARING EXAMINER COMMITTEE
l. That fencing and landscaping called for in Planning Department
Conditions #8 and #9 and in County Engineering Condition #13
shall be installed completely with the first building permit for
this site.
2. That the cul-de-sac required by County Engineers Conditions #11
and #12 be located in the southeast corner of the site.
3. County Engineers Condition #10 is deleted in its entirety.
a) COUNTY PLANNING DEPARTMENT
STANDARD:
1. The specific development plan will be submitted for Planning
Department review and approval prior to issuance of building
permits.
2. Al1 current standards of the Urban Residential-22 (UR-22) Zone,
as amended, shall be complied with in the development of this
site.
3. Applicant shall comply with '208' recommendations concerning
stormwater runoff and provide necessary landscaping for runoff.
4. Any division of land for the purpose of sale, lease or transfer,
shall comply with RCW 58-17 and the Spokane County Platting
Ordinances prior to issuance of building permits.
5. That the proposed rezone, which lacked a site plan, can be
adequately conditioned to insure appropriate development.
Conditions of approval imposed by the Hearing Examiner Committee
are intended to mitigate specific concerns raised at the public
hearing. Therefore, strict compliance with every condition of
approval is required In the development of this site. No
administrative deviations are permitted. Any modification must
be presented to the Hearing Examiner Committee for review and
approval.

a) COUNTY PLANNING DEPARTMENT (continued)
SPECIAL:
6. That the maximum height of any building constructed on the
property shall be 2 112 stories.
7. That access from this site to Sargent Road is prohibited.
8. That a 5 foot tall non-sight-obscuring (cyclone) fence,
extending continuously from the site's north property line to
the site's south property line, along the Sargent Road frontage
be constructed to physically prohibit vehicle and pedestrian
access from Sargent Road to the site. (Note: Construction of a
5 foot tall fence will require approval of an administrative
variance to be applied for by the developer).
9. That a ZO foot wide landscape strip consisting of lyye I
(screen) landscaping be installed along the Sargent Road
frontage.
10. That if the site is developed for any office uses, a 5 foot wide
landscape strip, consisting of Type III (see-through buffer)
landscaping, shall be installed along the east property line.
b) COUNTY ENGINEERING DEPARTMENT
Prior To The Release Of A Building Permit:
STANDARD:
1. Access permits for approaches to the County Road System shall be
obtained from the County Engineer. -
2. Applicant shall submit for approval by the Spokane County
Engineer road, drainage and access plans.
3. The applicant shall submit for approval by the Spokane County
Engineer and the Spokane County Health District a detailed
combined on-site sewage system plan and surface water disposal
plan for the entire project or portion thereof if the
development is phased.
4. A parking plan and traffic circulation plan shall be submitted
and approved by the Spokane County Engineer. The design,
location and arrangement of parking stalls shall be in
accordance with standard engineering practices. Paving or
surfacing as approved by the County Engineer will be required
for any portion of the project which is to be occupied or
traveled by vehicles.

b) COUNTY ENGINEERING DEPARTMENT (continued)
5. The construction of the roadway improvements stated herein shall
be accomplished as approved by the Spokane County Engineer.
6. Al1 required improvements shall conform to the current State of
Washington Standard Specifications for Road and Bridge
construction and other applicable county standards and/or
adopted resolutions pertaining to Road Standards and Stormwater
Management in effect at the date of construction, unless
otherwise approved by the County Engineer.
7. Roadway standards, typical roadway sections and drainage plan
requirements are found in Spokane Board of County Commissioners
resolution 80-1592 as amended and are applicable to this
proposal.
8. No construction work is to be performed within the existing or
proposed right of way until a permit has been issued by the
County Engineer. Al1 work within the public road right of way
is subject to inspection and approval by the County Engineer.
9. All required construction within the existing or proposed public
right of way is to be completed prior to the release of a
building permit or a bond in an amount estimated by the County
Engineer to cover the cost of construction of improvements shall
be filed with the County Engineer.
10. Applicant shall sign and record Spokane County Notice to the
Public #6 which specifies the following:
The owner(s) or successor(s) in interest agree to authorize the
County to place their name(s) on a petition for the formation of
a Road Improvement District (RIO) by the petition method
pursuant to Chapter 36.88 RCW, which petition includes the
owner(s) property, and further not to object, by the signing of
a ballot, the formation of a RID by the resolution method
pursuant to Chapter 36.88 RCW, which resolution includes the
owner(s) property. If a RID is formed by either the petition or
resolution method, as provided for in Chapter 36.88 RCW, the
owner(s) or successor(s) further agree: (1) that the
improvements or construction contemplated within the proposed
RID is feasible, (2) that the benefits to be derived from the
formation of the RID by the property included therein, together
with the amount of any County participation, exceeds the cost
and expense of formation of the RID, and (3) that the property
within the proposed RID is sufficiently developed. Provided,
further, the owner(s) or successor(s) shall retain the right, as
authorized under RCW 36.88.090, to object to any assessment(s)
on the property as a result of the improvements called for in
conjunction with the formation of a RID by either petition or
resolution method under Chapter 36.88 RCW.

b) COUNTY ENGINEERING DEPARTMENT (continued)
SPECIAL:
11. Applicant shall dedicate Spokane County Standard Cul-de-Sac (100
foot diameter) for right of way.
12. The County Engineer has designated Typical Roadway Section
Number One, Access Street standard for the improvement of
Nutchinson Road which is adjacent to the proposed development.
This will require the construction of a Spokane County Standa rd
Cul-de-Sac with curbing and sidewalk along the frontage of the
development.
13. Access to Sargent Road is prohibited. Applicant shall construct
a fence which will prohibit access to Sargent Road by vehicles
and pedestrians.
c) COUNTY UTILITIES DEPARTMENT
STANDARD:
l. Pursuant to the Board of County Commissioners Resolution No.
80-0418, the use of on-site sewer disposal systems is hereby
authorized. This authorization is conditioned on compliance
with all rules and regulations of the Spokane County Nealth
District and is further conditioned and subject to specific
application approval and issuance of permits by the Nealth
Di stri ct.
2. The Owner(s) or Successor(s) in interest agree to authorize the
County to place their name(s) on a petition for the formation of
a ULID by petition method pursuant to RCW 36.94 which the
petition includes the Owner(s) property and further not to
object by the signing of a protest petition against the
formation of a ULIO by resolution method pursuant to RCW Chapter
36.94 which includes the Owner(s) property. PROVIDED, this
condition shall not prohibit the Owner(s) or Successor(s) f rom
objection to any assessment(s) on the property as a result of
improvements called for in conjunction with the formation of a
ULID by either petition or resolution method under RCW Chapter
36.94.
3. Any water service for this project shall be provided in
accordance with the Coordinated Water System Plan for Spokane
County, as amended.
SPECIAL:
4. A dry sewer connection to the future area-wide Sewerage System
is to be constructed. Plans and specifications for the dry
sewer connection are to be reviewed and approved by the
Utilities Department.

d) COUNTY HEALTH DISTRICT
STANDARD:
l. A combined surface water and sewage disposal detailed plan shall
be approved by the Spokane County Engineer and Spokane County
Health District prior to the issuance of any on-site sewage
disposal permit or building permit for this project.
2. Sewage disposal method shall be as authorized by the Director of
Utilities, Spokane County.
3. Water service shall be coordinated through the Director of
Utilities, Spokane County.
4. Water service shall be by an existing public water supply when
approved by the Regional Engineer (Spokane), State Department of
Social and Health Services.
5. Disposal of sewage effluent beneath paved surfaces is currently
prohibited.
6. Subject to specific application approval and issuance of permits
by the Health Officer, the use of an individual on-site sewage
disposal system may be authorized.
7. Use of private wells and water systems is prohibited.
e) COUNTY BUILDING AND SAFETY DEPARTMENT
STANDARD:
1. Project is located within Fire District #1.
2. Fire hydrants shall be located so as to be accessible to fire
apparatus and not be obstructed by any structure or vegetation
or have the visibility impaired for a distance of fifty feet in
the direction of vehicular approach to the hydrant.
3. Specific location of hydrants shall be determined by the fire
district.
4. Commercial dumpsters and containers with an individual capacity
of 1.5 cubic yards or greater shall not be stored or placed
within five feet of combustible walls, openings or combustible
roof eave lines.
5. The applicant shall provide verification from the Fire District
to the Department of 8uilding and Safety that provisions have
been made for adequate fire protection prior to the release of
building permits.

6. Prior to final action approving a site development plan, a
detailed development plan showing locations of buildings and
structures shall be submitted to the Department of Building and
Safety for review and determination of code compliance.
f) WATER PURVEYOR
l. Water Purveyor shall be Modern Electric Water Company, and they
will supply the site with adequate water for domestic, fire and
irrigation uses.
g) COUNTY AIR POLLUTION CONTROL AUTNORITY
All air pollution regulations must be met. This includes but is not
limited to the following:
STANDARD:
l. Air pollution regulations require that dust emissions during
demolition, excavation and construction projects be controlled.
This may require use of water sprays, ta rps, sprinklers, or
suspension of activity during certain weather conditions. Haul
roads should be treated and emissions from the transfer of
earthen material must be controlled as well as emissions from
all other construction related activities.
2. Measures must be taken to avoid the deposition of dirt and mud
from unpaved surfaces onto paved surfaces. If tracking or
spills occur on paved surfaces, measures must be taken
immediately to clean these surfaces.
3. All travelled surfaces (ingress, egress, parking areas, access
roads) must be paved and kept clean.
4. Some objectionable odors will likely result during the
construction phase of the project and from motor vehicles using
the site following completion of the project and from occupants
of the proposed project.
SPECIAL:
5. Any wood combustion units installed must conform to the
requirements of Senate Bill #16 passed by the legislature in
April, 1987.

Proposal:
A request to rezone an approximate 3.87 acre site from Agricultural
to Urban Residential-22 (UR-22) Zone for the purpose of developing
apartments and/or offices. (NO SITE PLAN)
Location:
The site is generally located north of and adjacent to Interstate 90,
west of and adjacent to Hutchinson Road, east of and adjacent to
Sargent Road, and approximately 105 feet south of Michielli Place in
Section 7-25-44. Tax Parcel Number: 07544-0804. Street address:
North 1820 Sargent.
II. SITE ANALYSIS Comprehensive Plan:

The hlajor Comnercial category is primarily intended to provide the opportunity for development of commercial, retail, and office uses.
. Residential use generally is not a high priority in this category.
However, multi-family developments may be compatible in the Major
Comnercial category dependent upon locational considerations, transitional
characteristics, proper screening, and other performance standards.

The proposed site can be considered a transitional parcel from Major
Contiercial to the Urban category which adjoins immediately to the west and
approximately 100 feet to the north. The intent of the transitional
policies is to insure compatibility between conflicting land use
categories through buffering techniques. These may include landscaping,
screening, fencing, orientation of activity, structure height limits, and
change in land use and intensity.

The residential neighborhood to the north-and west of the proposal
has developed to both single family and duplex uses under the
existing Agriculturai and R-2 zoning pattern. 7he 90-unit apartment
complex, consisting of two and three-story buildings, was developed
imnediately east of the current proposal following zoning approval in
1972. Immediately east and northeast of the apartment complex, the
land use becomes commercially oriented and consists of a motel,
off ices and restaurant faci 1 ities. Interstate 90 immedi ately south
of the rezone constitutes a land use barrier.

Adjoining Streets: Hutchinson Road to the east of the site is a 50
foot County right of way improved with two paved
and curbed lanes and sidewalks on the north side.
Sargent Road to the west of the site is an
approximate 40 foot County right of way improved
with two paved and curbed lanes.
Nutchinson Road currently deadends at the rezone's southeast corner
and is basically an Interstate 90 frontage road, serving the
commercial, office, and apartments uses west of Argonne Road.
Sargent Road forms the western boundary of the proposed rezone site
and serves single family and duplex uses to the north and west of the
proposal. Sargent Road extends southerly from Knox Avenue and
deadends at Interstate 90 at approximately the southwest corner of
the rezone proposal. 6oth Hutchinson Road and Sargent Road are
classified as local access roads within the Transportatlon Section of
the Comprehensive Plan.

- No site plan has been submitted fo r review by the Zoning Hearing
Examiner Committee. Detailed site plan review is recommended to
be administrative at the Building Permit stage with guidance
from the Comprehensive Plan, Ordinance requirements, conditions
of approval, and other County policies and guidelines.
III. SITE DEVELOPMENT RECOMMENDaTIONS
Density: Deveiopment of apartments at the maximum density allowed by
the Urban Residential-22 (UR-22) Zone, that is 22 units per acre, would
. result in 85 dwelling units. This would be comparible to the 90-unit
apartment complex immediately east of this proposal.
Intensity of office development, if that is the chosen option, would be
dependent upon areas needed for parking, setbacks, drainfield, and
landscaping.
Desiqn: Design of the project will ultimately be dependent upon the
type of use developed on the site; apartments, offices, or a combination
of both. However, standards for maximum building height and setbacks
are already established in the Zoning Code no matter what type of use is
developed. The Urban Residential-22 (UR-22) Zone allows for a maximum

Desi2n: (continued) _ building height of fifty (50) feet which would be equivalent to a
five or six story building. Setbac ks around the site would be as
follows:
- Along the Nutchinson Road cul-de-sac, the south property line,
and the west property line (Sargent Road) a 25 foot building
setback is required.
- Along the northerly property lines a 15 foot building setback is
required.
- Along the east property line a 5 foot setback for each story of
the building is required.
The Planning Department recommends a special building height limit of 2
1/2 stories for this site. This would be necessa ry to minimize the
visual impact on the adjoining single family residential neighborhood
and would be consistent with the existing buildings at the adjoining
apartment complex.
Bufferin /Landscapinq: The landscape standards of the Spokane County
Zoning de establishes a minimum level of bufferin and landscaPin

around the site's perimeter. Those standards require:
- 20 feet of Type III (see-through buffer) landscaping in the
front-yard setback area around the future Hutchinson Road cul-de-sac
which will most likely be located in the southeast corner of the property.
- 25 feet of Type II (visual buffer) landscaping to be located along
the south property line adjacent to Interstate 90.
- 20 feet of Type III (see-through buffer) landscaping to be located
along the west property line adjacent to Sargent Road.
- 5 feet of Type III (see-through buffer) ]andscaping for apartments OR
20 feet of Type I(screen) landscaping for offices and either of the
two with a 6 foot tall solid barrier along the northerly property
lines.
- No landscapin9 would be required along the east property line
adjacent to the 90-unit apartment complex.
In order to protect the residential neighborhood to the west and north
of the site and to discourage vehicle and pedestrian access from Sargent
Road, it is recommended that access control measures be required along
Sa rgent Road. The Planning Depa rtment recommends that a 5 foot tall
non-sight-obscuring fence be installed continuously alon9 the site's
west property line common with Sargent Road. Additionally, the required
20 feet of Type III landscaping should be upgraded to a Type I "
landscaping which would form a vegetative screen.
Landscaping should be provided along the east property line if offices -
a re developed.

III. SITE DEVELOPMENT RECOMMENDATIONS (continued) .
• Circulation/Access: The Spokane County Engineer is recommending that
Hutchinson Road not be extended through the property to connect with
roads in the residential neighborhood. The Engineer's requirernent will
necessitate the applicant dedicating and improving a cul-de-sac with
curbing and sidewalk on the property. Additionally, together with the
Planning Department, they are recommending that any access to the site
be prohibited from Sargent Road. The termination of Hutchinson Road
into a cul-de-sac and prohibited access to Sargent Road should
,effectively protect the adjacent single family neighborhood from any
traffic or circulation impacts generated by development of this property.
Sewage Disposal: Both the Utilities Oepartment and the Health District
will authorize the use of individual on-site sewage disposal systems
subject to specific application and approval. Use of such systems will
be dependent upon the applicant agreeing to participate in a future ULID
and constructing a dry sewer line for eventual connection to the
area-wide sewage system.
I V. SEPA ENV I RONI4ENTAL REV I EW
An Environmental Checklist was submitted by the sponsor and was
reviewed by the County Planning Department. The review considered
the specifics of the proposal, other available information, County
- ordinances, other regulation"s and laws, possible standard Conditions
of Approval, the Generalized Comprehensive Plan, and other County
policies and guidelines. The Zoning Administrator has determined
_ that "Vo probable significant adverse impacts" would result from the
proposal being developed and has issued a Determination of
Non-Significance ("DNS").
The "DNS" was circulated to eleven other agencies of jurisdiction and
other agencies/departments affected by the future development for
review and comment. The "DAS" comment period ends August 5, 1987,
and was advertised 15 calendar days before said date in the
newspaper, by letter to adjacent property owners within 400 feet of
the proposal, and by notice on a sign posted on the proposal site.
7he Hearing Examiner Committee may consider additional environmental
related testimony and the "DNS" at the public hearing.
V. PLANNING SUMMARY
Approval of the requested rezone to Urban Residential-22 (UR-22) Zone -
is appropriate for the following reasons:
a. The Major Commercial category of the Comprehensive Plan
would support the development of this site for office and
apartment uses, especially in light of the Plan's
transitional policies. 7he Plan urges recognition of the
adjoining residential neighborhood and encourages measures
be ta ken to i nsure compati bi l i ty.
b.. Location of the site, adjacent to apartments, Interstate 90
and a commercial frontage road (Hutchinson Road), makes the
site more desirable for a higher intensity use. Given the
land use pattern in the area, apartment usage would seem to
be the logical extension of the pattern. However, office
uses are also allowed in the zone and would provide an
adequate transition into the residential neighborhood. In
regards to the level of activity and hours of operation,
office uses are sometimes more readily accepted adjacent to
residentiai uses than are apartments. The decision to
locate apartments or offices on this site would be an
economic consideration of the applicant.
c. Traffic impacts to'the neighborhood, either with office or -
apartment development, would be eliminated with the
recommended traffic circulation conditions. Those
conditions will require the termination of Hutchinson Road -
• into a cul-de-sac, prohibited access to Sargent Road,
construction of a continuous fence along Sargent Road and
additional landscaping along Sargent Road.
d. The landscape standards of the Spokane County Zoning Code
and as recommended should provide adequate buffering to the
adjacent properties whether the site is developed for
office or apartment usage. The additional requirement for
a building height limitation shouid mitigate visual impacts
on adjacent properties and be consistent with heights
. established at the adjoining apartment complex.

YI. CONDITIONS OF APPROVAL

binding on the "Applicant", which term shall include the owner or owners
of the property, heirs, assigns, and successors.)

STANDARD:
l. The specific development plan will be submitted for Planning
Department review and approval prior to issuance of building
permits.
2. All current standards of the Urban Residential-22 (UR-22) Zone,
as amended, shall be complied with in the development of this
si te.
3. Applicant shall comply with '208' recommendations concerning
stormwater runoff and provide necessary landscaping for runoff.
4. Any division of land for the purpose of sale, lease or transfer,
shall comply with RCW 58-17 and the Spokane County Platting
Ordinances prior to issuance of building permits.
5. 7hat the proposed rezone, which lacked a site plan, can be
adequately conditioned to insure appropriate development.
Conditions of approval imposed by the Hearing Examiner Committee
- are intended to mitigate specific concerns rafsed at the public

STANDARD:
1. Access permits for approaches to the County Road System shall be
obtained from the County Engineer.

2. Applicant shall submit for approval by the Spokane County
Engineer road, drainage, and access plans.
3. The applicant shall submit for approval by the Spokane County
Engineer and the Spokane County Health District a detailed
combined on-site sewage system plan and surface water disposal
plan for the entire project or portion thereof, if the
development is phased.
4. A parking plan and traffic circulation plan shall be submitted
and approved by the Spokane County Engineer. The design,
location, and arrangement of parking stalls shall be in
accordance with standard traffic engineering practices. Paving
or surfacing as approved by the County Engineer, will be
required for any portioin of the project which is to be occupied -
or traveled by vehicles.
5. The construction of the roadway improvements stated herein shall -
• be accomplished as approved by the Spokane County Engineer.
6. All required improvements shall conform to the current State of
Washington Standard Specifications for Road and Bridge
Construction, and other applicable County standards and/or
adopted resolutions pertaining to Road Standards and Stormwater
Management in effect at the date of construction, unless
otherwise approved by the County Engineer.
7. Roadway standards, typical roadway sections and drainage plan
requirements a re found in Spokane Board of County Commissioners'
Resolution No. 80-1592 as amended and are applicable to this
proposal.
8. No construction work is to be performed within the existing or
proposed right of way until a permit has been issued by the
County Engineer. All work within the public road right of way

with all rules and regulations of the Spokane County Health
District and is further conditioned and subject to specific
application approval and issuance of permits by the Health
Oistrict.
2. The Owner(s) or Successor(s) in interest agree to authorize the
County to place their name(s) on a petition for the formation of
a ULID by petition method pursuant to RCW 36.94 which the
petition includes the Owner(s) property and further not to
object by the signing of a protest petition against the
formation of a ULID by resolution method pursuant to RCW Chapter
36.94 which includes the Owner(s) property. PROYIDED, this
condition shall not prohibit the Owner(s) or Successor(s) from
objection to any assessment(s) on the property as a result of
improvements called for in conjunction with the formation of a
ULIO by either petition or resolution method under RCW Chapter
36.94. -
3. Any water service for this project shall be provided in
accordance with the Coordinated Wate r System Plan for Spokane -
• County, as amended.
4. A dry sewer connection to the future area-wide Sewerage System
is to be constructed. Plans and specifications for the dry
sewer connection are to be reviewed and approved by the
Utilities Depa rtment.
d) COUNTY HEALTH DISTRICT
STANDARO: _
1. A combined surface water and sewage disposal detailed plan shall
be approved by the Spokane County Engineer and Spokane County
Health District prior to the issuance of any on-site sewage
disposal permit or building permit for this project.
2. Sewage disposal method shall be as authoriied by the Director of
Utilities, Spokane County.
3. Water service shall be coordinated through the Director of
Utilities, Spokane County.
4. Water service shall be by an existing public water supply when approved by the Regional Engineer (Spokane), State Department of
Social and Health Services.

or have the visibility impaired for a distance of fifty feet in
the direction of vehicular approach to the hydrant.

- 4. Comnercial dumpsters and containers with an individual capacity
' of 1.5 cubic yards or greater shall not be stored or placed

to the Department of Building and Safety that provisions have
been made for adequate fire protection prior to the release of
building permits.
6. Prior to final action approving a site development plan, a
detailed development plan showing locations of buildings and

Safety for review and determination of code compliance.
f) WATER PURYEYOR
l. Water Purveyor is Modern Electric Water Company, and they will
supply the site with adequate water for domestic, fire and
irrigation uses.

g) COUNTY AIR POLLUTION CONTROL AUTNORITY
All air pollution regulations must be met. This includes but is not
1 imited to the fol lowing:
STANDARD:
l. Air pollution regulations require that dust emissions during
demolition, excavation and construction projects be controlled.
This may require use of water sprays, tarps, sprinklers, or
suspension of activity during certain weather conditions. Haul
roads should be treated and emissions from the transfer of earthen material must be controlled as well as emissions from
all other construction related activities. .
2. Measures must be taken to avoid the deposition of dirt and mud
from unpaved surfaces onto paved surfaces. If tracking or
spills occur on paved surfaces, measures must be taken
imnediately to clean these surfaces.
3. All travelled surfaces (ingress, egress, parking areas, access
roads) must be paved and kept clean.
4. Some objectionable odors will likely result during the construction phase of the project and from motor vehicles using
the site following completion of the project and from occupants
of the proposed project. -

5. Any wood combustion units installed must conform to the _
requirements of Senate Bill #16 passed by the legislature in
