ZE-042-87 ~ SPOKANE COUNTY HEARING EXAMINER COMMITTEE FINDINGS AND ORDER A. INTRODUCTION This matter having come before the Zoning Hearing Examiner Committee on October 1, 1981, and the members of the Committee present being Phillip D. Harris, Chairman, and Jim Schurra and Kathy Carstens. B. PROPOSAL The sponsor, The Millway Partnership, is requesting approval of a zone reclassification, File No. ZE-42-87, FREEWAY COMMERCIAL to REGIONAL BUSINESS (B-3) Zone, for the purpose of developing retail/office uses. C. FINUINGS OF FACT 1. That the existing land use in the area is single family residential, apartments motels, Interstate 90 and open area. 2. That the Comprehensive Plan designates this area as appropriate for Major Commercial development. 3. That the existing Zoning of the property described in the application is Freeway Commercial. 4. That the provieions of RCW 43.21C (The State Environmental Policy Act) have been complied with, and the Committee concurs with the Determination of Non-Significance. 5. That the proper legal requirements for advertisement of the Agenda Item have been fulfilled. 6. That the land use in thie area is suitable for the proposed use, or uses within the proposed Zone Classification. 7. That the applicant has demonstrated that conditions have substantially changed since the original zoning of this area and accordingly, the proposed rezone is justified. 8. That the proposed use is compatible with existing uses in the area. 9. That the owners of adjacent lands expressed neither approval nor disapproval of the proposed use. 10. The Hearing Examiner Committee finds the proposed use to be in ha rmony with the general purpose and will not be otherwise detrimental to the public health, safety, and welfare. ~ r C. FINDINGS OF FACT (continued) ZE-42-87 11. The following are additional findings of fact considered by the Hearing Examiner Committee: a) The proposal is consistent with the Major Commercial category of the Comprehensive Plan. The Regional Business (B-3) Zone is specifically intended to implement the Major Commercial category's goals and objectives. b) The proposal would be consistent with the zoning and development trend along Hutchinson Road and Interstate 90 in this location. c) The standards of the Regional Business (B-3) Zone will insure that the development is consistent with other developments in the immediate area. d) The site has direct access to Hutchinson Road, an Interstate 90 frontage road, which serves commercial uses northeast of the site and apartment and/or office uses westerly of the site. Hutchinson Road provides no access to single family uses and therefore additional commercial traffic generated from this site will not affect a residential neighborhood. e) This site is scheduled to cross-over from Freeway Commercial to Regional Business (B-3) 'Lone in 1991. D. CONDITIONS OR CONTINGENCIES APPLIED TO THIS APPROVAL (All Conditions imposed by the Zoning Hearing Examiner Committee shall be binding on the "Applicant", which term shall include the owner or owners of the property, heirs, assigns, and successors.) a) COUNTY PLANNING DEPARTMENT STANDARD: 1. All current standards of the Regional Business (B-3) Zone, as amended, shall be complied with in the development of this site. 2. That the project is subject to Section 7.06, the Aquifer Sensitive Area Overlay Zone of the ZONING CODE FOR SPOKANE COUNfY, which sets forth various measures for Aquifer protection; specifically, measures dealing with wastewater disposal, spill protection measures, and stormwater runoff. 3. That the present proposal is not detailed enough to determine wheCher or not the use of or materials stored on the site are in compliance with Chapter 4.16A (Aquifer Sensitive Area Overlay Zone) of the SPOKANE COUNTY ZONING OEtDINANCE. Accordingly, as a condition of approval, the sponsor/applicant shall be required to file with the Spokane County Auditor, within thirty (30) days of the signing of Findings and Order of the final decision in this matter, a"Notice Co the Public" which shall provide in material as follows: 2 ~ D. The applicant shall submit for approval by the Spokane County Engineer and the Spokane County Health District a detailed combined on-site sewage system plan and surface water disposal plan for the entire pro,ject or any portion thereof, if the development is to be phased. 3. A parking plan and traffic circulation plan shall be submitted and approved by the Spokane County Engineer. The design, location, and arrangement of parking stalls shall be in accordance with standard traffic engineering practices. Paving or surfacing as approved by the County Engineer, will be required for any portion of the pro,ject which is to be occupied or traveled by vehicles. 4. All required improvements shall conform to the current State of Washington Standard Specifications for Road and Bridge Construction, and other applicable County standards and/or adopted resolutions pertaining to Road Standards and Stormwater Management in effect at the date of construction, unless otherwise approved by the County Engineer. 5. Roadway standards, typical roadway sections and drainage plan requirements are found in Spokane Board of County Commissioners' Resolution No. 80-1592 as amended and are applicable to this proposal. 3 ~ ~ D. Sewage dispasal method shall be as authorized by the Directar of Utilities, Spokane County. 3. Water service shall be coordinated through the Directo r of ❑tilities, Spokane County. 4. Subject to specific application approval and issuance of permits by the Health Offieer, the use of an individual on-site sewage system may be authorized. 7. Use of private wells and water systems is prohibiCed. e) COUNTY BUILDING ANU SAFETY DEPARTMENT STANDARD: 1. The site is locaCed in Fire llistrict #1. 2. Fire hydrants shall be located so as to be accessible to fire apparatus and not be obstructed by any structure or vegetation or have the visibility impaired for a distance of fifty feet in the direction of vehicular approach to the hydrant. 3. Specific location of hydrants shall be determined by the fire district. 4. Commercial dumpsters and containers with an individual capacity of 1.5 cubic yards or greater shall not be stored or placed within five feet of combustible walls, openings or combustible roof eave lines. 5. The applicant shall provide verification from the Fire District to the Department of Building and Safety that provisions have been made for adequate fire protection prior to the release of building permits. SPECIAL: 6. Fire apparatus access roads shall be provided and maintained in accordance with the provisions of Section 10.207 of the Uniform Fire Code or as per requirements of the Fire District Chief. 7. Prior to final action approving a site development plan, a detailed development plan showing locations of buildings and structures shall be submitted to the Department of Building and Safety for review and determination of code compliance. 8. Hydrant locations and flow rate are to be verified by sponsor and verification provided to the Spokane County Department of Building and Safety prior to finalization of the permiC. 5 A ~ D. CONDITIONS OR CONTINGENCIES APPLIED TO THIS APPROVAL ZE-42-87 e) COUNTY BUILDING AND SAFETY DEPARTMENT (continued) 9. Exterior walls of any existing or proposed buildings shall have fire resistance and opening protection from the property line as set forth in the Uniform Building Code. f) WATER PURVEYOR 1. Water Purveyor is Modern Electric Water Company, and they can supply the site with adequate water for domestic, fire and irrigation uses when arrangements are made with the district. g) COUNTY AIR POLLUTION CANTROL AUTHORITY STANDARD: 1. Air pollution regulations require that dust emissions during ` demolition, excavation and construction projects be controlled. This may require use of water sprays, tarps, sprinklers, or suspension of activity during certain weather conditions. Haul roads should be treated and emissions from the transfer of earthen material must be controlled as well as emissions from all other construction related activities. 2. Measures must be taken to avoid the deposition of dirt and mud f rom unpaved surfaces onto paved surfaces. If tracking or spills occur on paved surfaces, measures must be taken immediately to clean these surfaces. 3. All travelled surfaces (ingress, egress, parking areas, access roads) must be paved and kept clean. 4. Some objectionable odora will likely reault during the construction phase of the project and from motor vehicles using the site following completion of the project and f rom occupants of the proposed project. 6 . ~ ORDER ZE-42-87 The Zoning Hearing Examiner Committee, pursuant to the aforementioned, finds that the application of The Millway PaXtnership for a zone reclassification as described in the application should be A.PPROVED to the REGIONAL BUSINESS (B-3) Zone. Hutchinson Road is basically a freeway frontage road serving coininercial and apartment uses along its north side. With recent approval of a Urban Residential-22 (UR-22) Zone (File ZE-23-87), westerly of the current proposal, Nutchinson Road will tenninate in a cul-de-sac on that Urban Residential-22 (UR-22) property. note: - No site plan has been subrnitted for review by the Zoning Hearing Exaiii i ner Coiiuni ttee. III. SITE DEVELOPtIENT RECOMMENDATIONS • Design: The proposed rezone to Regional Business (B-3) is not necessari ly a significant change from the existing Freeway Cornnercial . zoning. The Regional Business (B-3) Zone will offer a wider variety of com3ercial uses for the site; uses that are not just lirnited to the , traveling public. And, the Regional Business (B-3) Zone provides for standards that are inore flexible than those of the existing Freeway Coinnercial Zone, while at the sarne time offering adequate coinpatibility measures for adjacent land uses. Landsca in : The landscape standards of the new Spokane County Zoning Code wiequire some plantings and screening along Hutchinson Road and along the site's west property line. The extent of those standards will be dependent upon building location, parking lot placement, and access paints. Signaqe: The signage standards of the new Spokane County Zoning Code provides for adequate identification of uses while also discouraging sign competition within heavily developed comnercial areas. SEPA ENVIRONIIENTAL REVIEW ZE-42-87 • An Envirornnental Checkl ist was submitted by the sponsor and was reviewed by the County Planning Departinent. The review considered the spec if i cs of the proposa 1, other ava i 1'ab 1 e i nforriiat i on, County ordinances, other regulations and laws, possible standard Conditions of Approval, the Generalized Coiaprehensive Plan, and other County policies and guidelines. The Zoning Adrninistrator has deterinined that "No probable significant adverse iinpacts" would result from the proposal being developed and has issued a Deterr:iination of Non-Significance ("DNS"). . The "DNS" was circulated to nine other agencies of jurisdiction and other agencies/departinents affected by the future development for review and cormiient. The "DNS" coiranent period ends Septeinber 30, 1987, and was advertised 15 calendar days before said date in the newspaper, by letter to adjacent property owners within 400 feet of the proposal, and by notice on a sign posted on the proposal site. Paving or surfacing as approved by the County Engineer, will be required for any portion of the project which is to be occupied or traveled by vehicles. . 4. All required improvements shall conform to the current State of ~ Washington Standard Specifications for Road and Bridge Construction, and other applicable County standards and/or adopted resolutions pertaining to Road Standards and Stormwater Management in effect at the date of construction, unless otherwise approved by the County Engineer. 5. Any water service for this project shall be provided in accordance with the Coordinated Water Systern Plan for Spokane County, as aiaended. 4. A coinbined surface water and sewage disposal detailed plan shall be approved by the County Engineer and the Nealth District prior to the issuance of any building permit for this project. 2. Sewage disposal method shall be as authorized by the Director of Utilities, Spokane County. 3. Water service shall be coordinated through the Director of Utilities, Spokane County. 4. Water service shall be by an existing public water supply when approved by the Regional Engineer (Spokane), State Departrnent of Social and Health Services. 5. Disposal of sewage effluent beneath paved surf aces is currently prohibited. 6. Subject to specific application approval and issuance of perrnits by the Health Officer, the use of an individual on-site sewage system inay be authorized. Fire hydrants shall be located so as to be accessible to fire apparatus and not be obstructed by any structure or vegetation or have the visibility impaired for a distance of fifty feet in the direction of vehicular approach to the hydrant. 3.
