I NTRQDUCTION This matter having come before the Zoning Hearing Examiner Committee on December 3, 1987, and the members of the Committee present being Phillip D. Harris, Chairman, and Jim Schurra and Gary N. Anderberg. B. PROPO$AL - The sponsor, Ted Gunning, is requesting approval of a zone reclassification, File No. ZE-43-87, AGRICULTURAL to REGIONAL BUSINESS (6-3) Zone for the purpose of developing a total of a 120-unit motel and restaurant (62 of a prior approval with 58 new units planned within this zone change). Also, for a Change of Conditions, File No. ZE-646-83, CHANGE OF CONDITIONS IN A COMMERCIAL ZONE, for the purpose of reviewing a new site development plan regarding an increase in the size of the restaurant and moving the planned 62 unit motel to connect with the zone change as described above. C. f INDINGS OF FACT 1. That the existing land use in the area is single family residences, Interstate 90, Piua Haven, Grey Hound 6us Terminal, vacant and other retail uses. 2. That the Comprehensive Plan designates this area as appropriate for Major Commercial development. 3. That the existing zoning of the property described in the application is Agricultural. 4. That the provisions of RCW 43.21 C(The State Environmental Policy Act) have been complied with, and the Committee concurs with the Determination of Non-Signifcance. 5. That the proper legal requirements for advertisement of the Agenda Item have been fulfilled. 6. That the land use in this area is suitable for the proposed use, or uses within the proposed Zone Classification. 7. That the applicant has demonstrated that conditions have substantially changed since the original zoning of this area and accordingly, the proposed rezone is justified. r r ~ C. CONDITIONS OR CONTINGENGIES ZE-43-87 & ZE-6413-83 a) NEARING EXAMINER COMMITTEE b) This "Title Notice" shall be signed by the applicant to serve as official notice and acknowledgment of said easement. c) That no required landscaping, parking, '208' areas, drainfield or allowed advertising signs shall be allowed within the five (5) foot easement area. If any of the above improvements are made within this area they shall be relocated at the applicant's expense when roadway improvements are made." b) COUNTY PLANNING DEPARTMENT STANDARD: . 1. Approval by the Zoning Administrator of a specific lighting and signing plan for the described property prior to the release of any building permits. 2. A specific landscape plan, planting schedule and provisions for maintenance acceptable to the Spokane County Zoning Administrator shall be submitted with a performance bond for the project prior to release of building permits. Landscaping shall be installed and maintained such that sight distance at access points is not obscured or impaired. 3. The applicant shall develop subject property generally in aocordance within the ooncept presented to the Hearing Examiner Committee. Variations when approved by the Zoning Administrator will be permitted, including, but not limited to the following changes: 6uilding location, landscape plans, and general allowable uses of the permitted zone. All variartions must conform to regulations set forth in the ZONING CODE FOR SPOKANE COUNTY. The original intent of the development plans shall be maintained. 4. The specific development plan will be submitted for Planning Department review and approval prior to issuance of building permits. 5. All current standarcls of the Regional Business (B-3) Zone, as amended, for the legal description of the zone change as described in the application, shall be complied with in the development of this site. 6. That the present proposal is not detailed enough to determine whether or not the use of or materials stored on the site are in compliance with Section 7.06 (Aquifer Sensitive Area Overlay Zone) of the ZONING CODE FOR SPOKANE COUNTY. Accordingly, as a condition of approval, the sponsor/applicant shall be required to file 3 D. (:ONDITIONS OR CONTINGENCIES ZE-43-87 & ZE-6413-83 b} COUNTY PLANNING DEPARTMENT with the Spokane County Auditor, within thirty (30) days of the signing of Findings and Order of the final decision in this matter, a"Notice to the Public" which shall provide in material as follows: PRIOR TO THE ISSUANCE OF ANY BUILDING PERMIT OR CERTIFICATE OF OCCUPANCY FOR ANY BUILDING OR ANY USE ON THE PROPERTY DESCRIBED HEREINAFTER, THE APPLICANT SHALL BE RESPONSIBLE FOR COMPLYING WITH THE PROVISIONS OF THE ZONING CODE FOR SPOKANE COUNTY SECTION 7.06 (AQUIFER SENSITIVE AREA OVERLAY ZONE). THE PROPERTY WHICH IS THE SUBJECT OF THIS NOTICE IS MORE PARTICULARLY DESCRI6ED AS FOLLOWS:....". 7. Applicant shall comply with '208' recommendations concerning stormwater runoff and provide necessary landscaping for runoff. 8. Any division of land for the purpose of sale, lease or transfer, shall comply with RCW 58-17 and the Spokane County Platting Ordinances prior to issuance of building permits. SPECIAL: 9. That all those Conditions of Approval for the existing Commercial Zone, File No. ZE-646-83, except as modified by this change of conditions for a new site plan, shall be complied with. 10. Amend Planning Condition #4 to reduce landscaping along the west property line at the Regional Business (B-3) Zone to 10 feet. 11. That the sign standards as limited by ZE-6413-83 and the Regional Business (6-3) Zone shall be complied with, however, the Zoning Administrator may allow some flexibility as to sign locations. c) COUNTY ENGINEERING DEPARTMENT Prior To The Issuance Of A Buildina Permit Or Use Of The Property As Proposed: 1. Access permits for approaches to the County Road System shall be obtained from the Spokane County Engineer. 2. Applicant shall submit for approval by the Spokane County Engineer road, drai nage, and access plans. 4 D. CQNDITIONS OR CONTINGENCIES ZE-43-87 & ZE-6413-83 c) COUNTY ENGINEERING DEPARTMENT 3. The applicant shall submit for approval by the Spokane County Engineer and the Spokane County Health District a detailed combined on-site sewage system plan and surface water disposal plan for the entire project or any portion thereof, if the development is to be phased. 4. A parking plan and traffic circulation plan shall be submitted and approved by the Spokane County Engineer. The design, location, and arrangement of parking stalls shall be in accordance with standard traffic engineering practices. Paving or surfacing as approved by the County Engineer, will be required for any portion of the project which is to be oocupied or traveled by vehicles. 5. The construction of the road improvements stated herein shall be accomplished as approved by the Spokane County Engineer. 6. The County Engineer has designated Typical Roadway Section Number One, Secondary Arterial standard for the improvement of Mission Avenue which is adjacent to the proposed development. This will require the addition of approximately 12 to 14 feet of asphaft along the frontage of the development. Curbing and sidewalks must also be constructed. 7. All required improvements shall conform to the cuRent State of Washington Standard Specifications for Road and Bridge Construction, and other applicable County standards andlor adopted resolutions pertaining to Road Standards and Stormwater Management in effect at the date of construction, unless otherwise approved by the County Engineer. 8. Roadway standards, typical roadway sections and drainage plan requirements are found in Spokane Board of County Commissioners' Resolution No. 80-1592 as amended and are appticable to this proposal. 9. No construction work is to be pertormed within the existing or proposed public right of way until a permit has been issued by the County Engineer. All work within the public road right of way is subject to inspection and approval by the County Engineer. 10. All required construction within the existing or proposed public right of way is to be completed pdor to the release of a building permit or a bond in the amount estimated by the County Engineer to cover the cost of construction of improvements shall be filed with the County Engineer. 5 ~ D. This authorization is conditioned on compliance with all nales and regulations of the Spokane County Health District and is further conditioned and subject to specific application approval and issuance of pemtits by the Health District. 2. The Owner(s) or Successor(s) in interest agree to authorize the County to place their name(s) on a petition for the formation of a ULID by petition method pursuant to RCW 36.94 which the petition includes the Owner(s) property and further not to object by the signing of a protest petition against the formation of a ULID by resolution method pursuant to RCW Chapter 36.94 which includes the Owner(s) property. PROVIDED, this condition shalt not prohibit the Owner(s) or Successor(s) from objection to any assessment(s) on the property as a result of improvements called for in conjunction with the formation of a ULID by either petition or resolution method under RCW Chapter 36.94. 3. Any water service for this project shall be provided in aocordance with the Coordinated Water System Plan for Spokane County, as amended. 4. Plans and specifications for the dry sewer connection are to be reviewed and approved by the Utilities Department. e) COUNTY HEALTH DISTRICT STANDARD: 1. Water service shall be coordinated through the Director of Utilities, Spokane County. 3. Water service shall be by an existing public water supply when approved by the Regional Engineer (Spokane), State Department of Social and Health Services. 4. Disposal of sewage effluent beneath paved surfaces is currently prohibited. 5. Subject to specific application approval and issuance of permits by the Heatth Officer, the use of an individual on-site sewage system may be authorized. 6. Use of p(vate wells and water systems is prohibited. f) COUNTY BUILDING ANO SAFETY DEPARTMENT 1. The site is located in Fire District #1. 2. Fire hydrants shall bs located so as to be accessible to fire apparatus and not be obstructed by any structure or vegetation or have the visibility impaired for a distance of ffty feet in the direction of vehicular approach. 3. Specific location of hydrants shall be determined by the fire district. 4. Commercial dumpsters and containers with an individual capacity of 1.5 cubic yards or greater shall not be stored or placed within five feet of combustible walls, openings or combustible roof eave lines. 5. The applicant shall provide verification from the fire district to the Department of Building and Safety that provisions have been made for adequate fire protection prior to the release of building permits. g) WATER PURVEYOR 1. Water Purveyor is Modem Electric Water Company, and they will supply the site with adequate water for domestic, fire and irrigation uses. 7 c D. Air pollution regulations require that dust emissions during demolition, excavation and construction projects be controlled. This may require use of water sprays, tarps, spdnklers, or suspension of activity during certain weather conditions. Haul roads should be treated and emissions from the transfer of earthen material must be controlled as well as emissions from all other oonstruction related activities. 2. Measures must be taken to avoid the deposition of dirt and mud from unpaved surfaces onto paved surtaces. If tracking or spills occur on paved surfaces, measures must be taken immediately to clean these surfaces. 3. All travelled surfaces (ingress, egress, parking areas, access roads) must be paved and kept clean. 4. Some objectionable odors will likely result during the construction phase of the project and from motor vehicles using the site following completion of the project and from occupants of the proposed project. 8 . . The Circulation Element: The Transportation Seciion -21 of the Spokane County Comprehensive Plan Text includes the Arterial Road Plan Map adopted by the 6oard of County Commissioners in September 1986. The Argonne-Mullan Corridor has developed into aesthetically pleasing retail and office complexes with generous tandscaping strips along roads and next to buildings. Site Gharacteristics: Site Size: Approximately 3.25 acres Existing 6uildings: Two single family residences Topography: Relatively flat Vegetation: Natural grasses Agricutturat Summary: Major Commercial category of the ° Comprehensive Plan is not intended for agricultural protection. Adjoining Streets: Mission Avenue to the south of the site is a 60 foot . County right of way improved with two paved lanes . and curbing. Argonne Road to the east of the site is a 60 foot County right of way improved with four paved lanes, curbing and sidewalks. The County Engineer is requiring 12 to 14 feet of additional asphaK, sidewalks and curbs along the frontage of the development. SITE ANALYSIS ZE-43-87 & ZE-64B-83 ProQOSed Site Plan: NOTE: To accomplish the 70 foot right of way for Mission Avenue, an administrative variance may be requested along the north property line at some future date by the sponsor. Parking: To be determined at the building permit stage. Proposed Buffering Techniques: Compliance with the Regional Business (B-3) landscaping standards has been designed into the site plan. Some administrative discretion will be allowed as 41.4% of the site is shown landscaped and the standards indicate that 15% landscaping of the site should not be exceeded. The landscaping will be placed to most benefit the community. The 41.4% figure is somewhat misleading as it includes the drainfield area which may be seeded but not necessarily planted in trees and shrubs. Other Site Plan Considerations: The project will be developed in phases; 84 motel units first with the remaining 36 units and the restaurant being built as needed. n o t S: - The site plan submitted for review by the Zoning Hearing Examiner Committee is general in nature. Detailed review to determine compliance with all Ordinance regulations and conditions of approval is recommended to be administrative and to occur at the Building , Permit stage. III. SEPA ENVIRONMENTAL REVIEW An Environmental Checkiist was submitted by the sponsor and was reviewed by the County Planning Department. The review considered the speafics of the proposal, other available information, County orciinances, other regulations and laws, possible standard Conditions of Approval, the Generalized Comprehensive Plan, and other County policies and guidelines. The Zoning Administrator has detennined that "No probable significant adverse impacis" would result from the proposal being developed and has issued a Determination of No= nificance ("DNS"). The "DNS" was arculated to ten other agencies of jurisdiction and other agencies/departments affected by the future development for review and c;ommerrt. The "ONS" comment period ends December 2, 1987, and was advertised 15 calendar days before said date in the newspaper, by letter to adjacent property owners within 400 feet of the proposal, and by notice on a ' sign posted on the proposal site. The Hearing Examiner may consider additional environmental related testimony and the "DNS" at the public _ hearing. V. P A_NNING SUMMARY Development of this site-for commercial uses is supported by the Comprehensive Plan, past land use actions, and planned and existing uses in the area. INTRODUCTION This matter having come before the Zoning Hearing Examiner Committee on November 5, 1987, and the members of the Coimnittee present being Phillip D. Harris, Chairman, and Jiro Schurra and Ron Odell. B. PROPOSAI The sponsor, Ted Gunning, is requesting approval of a zone reclassification, File No. ZE-43-87. AGRICULTURAL to REGIONAL BUSINESS (0-3) Zone, for the purpose of deve]oping a motel/restaurant. Also, a change of conditions, File No. ZE-648-83, CNANGE OF CONDITIONS IN A CUtdMERGIAI ZONE, for the purpose of reviewing a new site development plan for an existing Commercial Zone. C. FINOINGS OF FACT 1. The following are additional findings of fact considered by the Hearing Examiner Comnittee: a1 That the applicant and/or his representative has not provided adequate legai notice advertising this proposal for public hearing, i.e., the required sfgn did not contain the correct information (date, time and project description). D. CONDITIONS OR CONTINGENCIES APPLIED TO THIS APPROVAL (All Conditions imposed by the Zoning Hearing facamfner Comnittee shall be binding on the "Applicantu, which term shall include the owner or owners of the property, heirs, assigns, and successors.) a) NEARING EXAMINER COMMITTEE 1. That the applicant and/or his representative remove the existing legal notice sign for at least ten (10) days and be replaced with the correct information at a new location on site at least 15 days prior to the December 3, 1987, public hearing. 2.
