GENERAL INFORMATION Applicant: Karen Aquino, dba Northwest Hair Lines Agent: None Owner: Karen and Louie Aquino Proposal: Establish a beauty shop in the existing, on-site, residential-type building and improve the site tio accommodate the business. Location: In the Spokane Valley on the southwest carner of Carlisle Avenue and Vista Road, in Section 7, Township 25 N., Range 44, E;WM, Spokane County, Washington II. StJMMARY - Approve the zone reclassification, conditioned as set farth below. III. SITE ANALYSIS Comprehensive Plan: Suburban category is inside General Sewer Service Area (GSSA) Boundary, inside Priority Sewer Service Area (PSSA) Boundary, inside Urban Impact Area (LJIA) Boundary. Arterial Road Plan: Vista Road, east of site, is a designated Collector Arterial, requiring a 70 foot right-of-way with a future 35 foot building setback. The . suggested dedication and future right-of-way acquisition reserve is 17.75 feet on Vista Road. With 3 feet of dedication requested, this leaves 14.75 feet of future acquisition reserve plus a 35 foot future building set back. Comrnehensive Pian,/Arterial Road Plan Analvsis: The characteristic features of the Suburban Category of the Comprehensive Plan are that neighborhood commercial uses will be clustered on sites of not more than 4 acres and that few buildings will be multi-story. It further states that commercial uses should be neighborhood serving, such as barber shops, established to serve - the immediate neighborhood and be adjacent to pri.mary or secondary arterials. Purpose and intent of the Neighborhood Business Zone (B-1) clarifies that the zone has the intent of implementing the Suburban Category of the Comprehensive Plan by providing local facilities to serve everyday needs of the surrounding neighborhood. Any B-1 zone in the Suburban Category should not be larger than 5 acres in size with frontage on a collector arterial or higher level arterial being desirable, if not exceeding 6001inear feet Vista Road is a collector arterial. The purpose and intent of the B-1 zone clarifies that these neighborhood business areas should be limited by spacing to at least 1/2 mile apart A review of the zoning in the area indicates there is no other qualifying B-1 ar local business zoning within a half a mrile. 2. Criteria for finding favorably regarding a zone reclassification are as follows: a. The zone reclassifications shall further the objectives and goals of and cany out and conform to the County's Comprehensive Plan and the County's development reguladons. The proposed zone reclassification meets this criteria. b. Almost all of the zroning in the area was established in approximately 1956. • Although the zoning in the area has therefare not changed, the development in the area, particulariy tv the east and the west, has developed to its full potential. Conversion of this dwelling unit to a beauty salon while retaining the residenrial - appearance of the building is consistent with making a transition from a gas station/delicatessen to the residential area immediately to the north. Therefore, although the zoning is not substantially changed, the existing conditions in the area have substantially changed since the ariginal z,oning. c. Since this zone reclassification would not be singling out a smaller area from a large area or district and creating an incompatible land use, and the Comprehensive Plan generally supports this project, a zone reclassification in this instance would not be considered spot zoning. Land Use: Existing on STTE: A beauty parlar in a residence. To the NORTH: A duplex and other, mostly single family detached, residences. To the SOUTH: A gas station and deli. To the EAST: A bingo hall. Ti~ WEST: A(probably) unauthorized, illegal outdoor storage yard and - building as parts of the gas-hydraulic exploration, well drilling business to the south. The factors in support of this point of view are the fact that it fronts on a collector arterial, that the land use immediateiy to the south and east is one in which the hours, activity and lighting are not compatible with a residential life style and the land use immediately to the west, although Agricultural Suburban zoning, appears to be of a questionable level since it is open and covered storage assvciated vvith a drilling and geological exploration finn. This zone reclassification would serve as a buffer between the commercial activity and the residential area to the north. The dwelling unit structure immeidiately to the north is a duplex and this neighborhood business zoning would be a particulariy good buffer to thaz dwelling unit when compared with other possibilities. (14.9°Io) opography: F1at Vegetation: Grass, a few shrubs AgriculSural SummarX: Ded.icat+ed to urban uses Adoining S"=: Cariisle Road to the north of the site is a 34.5 foot County right of way improved with 20 feet of curbless, light paving, tapering westeriy from a curbed 28 foot width at Vista Road. The building setback Is approximately 20 feet at this location and County En,gineer has asked for dedication of 8 feet of right of way on Cazlisle Road. Vista Road to the east of the site is a 40.5 foot County right of way improved with 31 feet of curbed paving, including a gravel sidewalk on the ' site fronting on Vista. The right of way on Vista is unbalanced insofar as there is 23 feet 3 inches of right of way on the east side of the centerline and only 17 feet 3 inches of right of way on the west side of the centerline, fronting on the subject property. Accordingly, the Engineer's are asking for a ciedication of 3 feet of right of way in order to help alter this inequity. This would allow installation of a proper sidewalk at some point in the future. The front porch of the building would still have a 22 foot setback from the new, adjusted property line. STTE DEVELOPMENT RECOMMENDATIONS Landscaping: A landscaping plan including a planting schedule, consistent with the zoning code requirements should be submitted for review and approval. Installaaon must be assured, Signage: Complywith the standards of Section 14.804.080 3. on the Carlisle frontage. A restrictive sign standard is appropriate due to the location opposite a residential structure. Normal B-1 sign standards on Vista Road frontage are acceptable. Circulation/Access: If it is determined that more parldng is needed, additional parking stalls and a travel lane could be added south of the building with an exit onto Vista. If the work stations are increased to 3 or more, such a concept should be implemented. Sewage Disposal: The business activity should not exceed the capacity of the eacisting unit without upgrading. Fire Protection: The Department of Building and Safety should address this in the Building Permit or Change-in-Use Permit process. V. SEPA ENVIRONMENTAL REVIEW An Environmental Checklist was submitted by the sponsor and was reviewed by the County Planning DepartmenL The review considered the specifics of the proposal, other available uiformadon, County ordinances, other regulations and laws, possible standard Cond.itions of Approval, the Generalized Comprehensive Plan, and other County policies and guidelines. The Zoning Administrator has determined that "No probable significant adverse impacts" would result from the proposal being developed and has issued a Determinarion of Nonsignificancg ("DNS"). The "DNS" was cinulated to five other agencies of jurisdiction and other agencies/departments affected by the future development for review and commenL The 'DNS" comment period ends November 28, 1989, and was advertised 15 calendar days before said date in the newspaper, by letter to adjacent property owners within 400 feet of the proposal, and by notice on a sign posted on the proposal site. The Hearing Examiner may consider add.idonal environmental related tesrimony and the 'DNS" at the public hearing. VI. PLANNING DEPARTMENT SUMMARY - " - Appmve the zone reclassification to B-1 for the reasons stated above under "Zoning." Road right of way dedications and future right of way acquisition reservation need.s to be accomplished.. A traffic and circulation plan should be approved in the event that 3 - or more work stations are installed. Sign standards should be limited to less than B-1 standards on the north side of the site. VII. CONDTTIONS OF APPROVAL i. All Conditions imposed by the Hearing Examiner Committee shall be binding on the "Applicant", which term shall include the owner or owners of t6e property, heirs, assigns, and successors. i i. The zone reclassification encompasses the following real property: North 75' Except the West 120', Block 213, Orchard Avenue Addition, Spokane County, WA; Section 7, ToWnship 25 N., Range 44 EWM. COUNTY PLANNING DEPARTMENT 1. Any sign erected on the north side of the subject property shall comply with Section - 14.804.080 3. of the Zoning Code. The precise parlang and ciinvlation plan shall be reviewed and approved by the ~ Planning Department and the Engineer's Office, recognizing that only two work stations are initially approved. 3. Approval is required by the Planning Director/designee of a specific lighting and signing plan for the described property prior to the release of any building permits. 4. A specific landscape plan, planting schedule and provisions for maintenance acceptable to the Planning I?irector/designee shall be submitted with a performance bond for the project prior to release of building permits. Landscaping shall be installed and maintained such that sight distance at access points is not obscured or impaired. 5. The applicant shall develop subject property generally in accaniance within the concept presented to the Hearing Examiner Committee. Variations, when approved by the Planning Director/designee, will be perniitted, including, but not limited to the following changes: building location, landscape plans, and general allowable uses of the permitted zone. All variations must conform to regulations set forth in the ZONIIVG CODE FOR SPOK:ANE COUNTY. The original intent of the development plans shall be maintained. 6. Direct light from any exterior area lighting fixture shall not extend over the property . boundary. 7. All curnent standards of the B-1 Zone, as amended, shall be complied with in the development of this site, except as otherwise noted in these conditions of approval. 8. The applicant shall comply with all agency's reguiations as amended prior to issuance of Change-in-Use permits. 9. The Spokane County Planning Department shall prepare and recard with the Spokane County Auditor a 'Tide Notice' noting that the property in question is sub'ect tn a varie" of ecial conditionsim sed as a result of approval of a land - - use action. 'This 'Iitle Notice" shall serve as~official public notice regarding conditions of appmval affecting the property in question. The "Title Notice" shall be recarded within fifteen (15) days of final disposition of the approved land use acrion and shall only be extinguished by the Spokane County Planning Deparanent. The "Tide Notice" shall generally provide as follows: The parcel of property legally described as (legal description and tax parcel number) is the subject of a land use action, imposing a variety of special development conditions, by a Spokane County Hearing Body or Administrative Official on (date) and as maybe amended, altered or supplemented by official action or as already changed. File No. (Planning Department File Number) is available for inspection and copying in the Spokane County Planning Department. 10. Building and other setbacks required by the Spokane County Zoning Code shall be measured 35 feet from the west edge of the Future Acquisition Area that is reserved for road right-of-way and utilities along Vista Road. c. The following minimum unprovements necessary to support the use within the zone classification as required by the Spokane County Zoning Code standards shall not be located within the Future Acquisition Area. 1. Landscaping 2. Surface drainage 3. Drainfields 4. ParlQng 5. Other d. The Vista Road Future Acquisition Area, until acquired by Spokane County, shall be private property and may be used as allowed in the zone, except any improvements (such as landscaping, parking, surface drainage, drainfields, signs or others) shall be considered "ustenm" uses. 'Ihe property owner shall be responsible for relocating such "interim" improvements at the time Spokane Counry makes roadway improvements after acquiring said Future Acquisition Area. - ' e. This "Title Notice" shall be signed by the applicant to serve as official notice and aclnowledgement of said Future Acquisition Area for road right-of-way and udlities. At such time as an RID is created or any Road Improvement Project is sanctioned by Spokane County, the improvements required (curb, sidewalk, drainage control and paving to existing pavement) will be at the sole expense of the undersigned owner(s), their heirs, grantees and assigns. 6. As an alt,ernative method of constructing the road improvements stated herein, the applicant may, with the approval of the County Engineer, accomplish the road imprflvements stated herein by joining and participating in a County Road Project (CRP) to the extent of the reqiured road improvements. CONCLUSIONS AND ORDER INTRODUCTION Tlus matter having come before the Heanng Examiner Committee on November 30, 1989, and the members of the Committee present being Chauperson Bud Skadan, Phil Hams and Ron Odell PROPOSAL The sponsor, Karen Aquino, dba Northwest Hau Lines, requests approval of a zone reclassificauon from Agncultural Suburban (AS) to Neighborhood Business (B-1), File No. ZE-50-88, for the puipose of establishing a beauty shop in the existing, on- site, residennal-type building FINDINGS OF FACT AND CONCLUSIONS 1 The property is generally located in the Spokane Valley on the southwest corner of Carhsle Avenue and Vista Road, in Secuon 7, Township 25 N., Range 44, EWM, Spokane County, Washington 2 The committee adopts the Planning Department Report as a part of this record 3. The existing land uses in the area are duplex and other single famfly residences,a gas stauon/deh, a bingo hall and an outdoor storage yard with buildhng for a well dnlhng business 4. The Comprehensive Plan de$ignates this site as Suburban The Suburban category is for the purpose of residennal development and hmited businesses providing a neighborhood convenience ~ 5 The Artenal Road Plan designates Vista Road as a Collector Artenal, with a recommended nght of way width of 70 feet 6. The existing zoning of the property descnbed in the application is Agnculh.iral Suburban (AS), previously established in 1956 and within the Aquifer Sensinve Area Overlay Zone 7 The provisions of RCW 43 21C (The State Envuonmental Policy Act) have been comphed with and a Determinanon of Nonsignificance was issued 8. The proper legal reqi.urements for advertisement and notice have been fulfilled 9 Residents of the area expressed approval of the proposed use, but requested that NO PARKING signs be placed on both sides of Carlisle (from Vista westward to the west end of the property) The County Engineer's staff said the Engineer's Office and the Board of County Comrrnssioners handle such matters 10 The proposed use is compatible with exisang uses in the area 11 The proposed zoning does implement and conform to the Comprehensive Plan J 11-89 HEC Order for ZE-50-88 Page 2 12 The apphcant has demonstrated that condinons have substanhally changed since the onginal zoning of this area and accordingly, the proposed zone reclassification is justified. 13 The proposal does not result in spot zoning 14 The proposed use will not be detnmental to the public health, safety, morals or welfare 15 The buildable area remauiing on the site after dedicaaons, future acquisinon areas and future set backs are calculated, provide a very small area for future, new build.ings Future purchasers should be so alerted 16 Both nght of way dedication and future nght of way acquisiaon areas are needed 17. Residences to the north should be afforded more rehef from business signs than provided by the B-1 standards 18.
