The Hearing Examiner has reviewed the zone reclassification application and the
evidence of record, and hereby adopts the following findings of fiact and conclusions:
A. GENERAL INFORMATION: •

Spokane County, Washington
Legal Description: The northedy 142.71 feet of vacated portion of LaSalle Addition in the
NE 114 of SE 1/4 lying northeasteriy of Hutchinson Road including Lot 2, Block 1, LaSalle
Addition in Section 7, T 25N, R 44, EWM in Spokane County, Washington.
Zoning: Urban Residential-22 (UR-22) and Regional Business (B-3). The property is
also toca#ed within the Aquifer Sensitive Overlay Zone.

Comprehensive Ptan Category: The property is designated as being in the Major
Commercial category of the Spokane County Generalized Comprehensive Plan. The
property is also located within the Interim Urban Growth Area (IUGA), the Public
Transportation Benefit Area (PT6A), and the Prionty Sewer Service Area (PSSA).
Environmental Review: A Determinafion of Nonsignificance was issued by the County
on December 30, 1999.
Site Description: The site is rectangular in shape and reasonably flat. It contains
approximately 35, 460 square feet in area. It has frontage on three streets. It has
approximately 143 feet of frontage on both Hutchinson Road and Argonne Road and
has approximately 248.5 feet of frontage on Knox Avenue. There are curbs and
sidewalks adjacent to those streets. CuRently there are two residences located on the
site that will be removed in order for the proposed restaurant to be developed.
Surrounding Conditions: The surrounding area includes restaurants, retail uses, and
commercial stnp development along Argonne Road To the west of the site the uses are
primarily residential in nature. Zoning to the north and south is B-3, and zoning to the
west is UR-3.5 and UR-22. Knox Avenue and Hutchinson Road are Local Access
Streets in the County's Arterial Road Plan, and Argonne Road is a Principal Arterial.
Project Description: The applicant seeks approval of a zone change in order to develop
a restaurant The site plan shows a proposed Wendy's Restaurant approximately in the
middle of the site, with a 3,300-square-foot footprint. Parking is located around the site,
and there is a dnve-through lane on the south side of the building. The eastem and
western portions of the site are already zoned B-3, but the middle is zoned UR-22. The
applicant seeks to have the entre site zoned B-3, as well as changing the conditions of the
prior zone change approval, in order to allow the dnve-through restaurant to be
constructed. Besides the building on site, parking for 47 vehicles is proposeci.

C. ZONE RECLASSiF1CAT10N ANALYSIS:
1. Aparovai criteria
In considering a rezone application, Washington Case Law generaity pmvides that:
(1) There is no presumption in favor of a rezone, (2) The applicant has the burden of
proving that conditions have substantially changed in the area since the last zoning of
the propetty, and (3) The rezone proposal must bear a substantiai relationship to the
public health, safety, or weifare. Btamson v. Kitsao Counfir, 78 Wn. App. 840 (1995)
citing Parkrid4e v. Seattle, 98 Wn. 2d 454, 462, (1978). Whether an application for
rezoning complies with a aorriprehensive plan is not determinative; oniy °general
conformance" with the comprehensive pian is required. TuQwell v. Kittitas County, 90
Wn. App. 1(1997). Generalty, compliance with the Comprehensive Plan demonstrates
that the proposal has a substantial relationshjp to the public health, safety, or welfare.
Some Washington cases have essentially done away wdh the requirement for
changed circumstances wher+e the proposed rezone closely implemented the policies of
a comprehensive plan. Save Our Rural Environment v. Snohomish County, 99 Wn. 2d.
363o 370-371 (1983). Where a comprehenstve plan conflicts with existing zoning
regulations, the provisions of the zoning code will normally be construed to prevait.
CouQar Mountain Associates v. Kinq Countv, 111 Wn. 2d 742, 755-57 (1988). That
principte applies to existing zoning and not requests for changes in the zoning
classification.
Section 14.402.020 of the County Zoning Code authonzes amendments to the
code based on any one of sfx grounds. Zoning Code Section 14.402.020('( ) authorizes
the amendment if it is consistent with the Comprehensive Plan and is not
detrimental to the public weifare. Section 14.402.020(2) authorizes an amendment
where change in economic, technological, or land use conditions has occurred to
warrant modtflcation of this code.
These are the most retevant criteria for consideration of the current rezone
application. Further, Zaning Code Section 14.100.104 states that the Zoning Code
shall be interpreted to carry out and Impiement the purpose and intent of the
Comprehensive Plan and the General Plans for Physical Development as adopted by
the Board of County Commissianers.

2. The QroQosal conforms with the Sookane CountY Generalized Comprehensive Plan,
and will not be detrimental to the Qublic health, safetY and qeneral welfare. It also
complies with the Spokane Countv Zoninq Code and other appiicable development
requlations.
The Staff has analyzed the project's compiiance with the Comprehensive Plan on
page 4 of its Staff Report. Staff has also analyzed the proposal's compliance with the
B-3 zoning regulations. The Staff s finding is that the proposed zone reclassification is
consistent with the Major Commercial Category of the Comprehensive Plan and that the
site can meet the standards of the 6-3 zoning regulations The Hearing Examiner
hereby adopts and incorporates those findings herein.
3. Conditions in the area in which the property is located have chanqed substantiallv
since the orotiertv was iast zoned.
Section 14.402.020(2) of the Spokane County Code states that amendments to the
zoning map may occur when d is found that uChanges in economic, technological, or
land use condifions have occurred to warrant modification " Vanous conditions have
changed in the area since the property was last zoned. There have been many
changes along Argonne Road in the vicinrty of the proposal from residentiat uses to a
range of commercial and office uses as are allowed in the B-3 zone. Numbers of zone
reclassifications to business and commercial have been approved in the vicinity of this
site. Also, Argonne Road has seen increases in traffic and improvements. Finally, the
avaiiability of public services such as sewer, water, and transit service to the site
demonstrate that conditions have changed to the extent that this zone reciassification is
warranted.
111. DECISION
Based on the Findings and Conclusion above, it is the decision of the Hearing
Examiner to approve the proposed zone change subject to the following conditions:
Planning Dept Conditions
1. All conditions imposed by the Hearing Examiner shall be binding on the "Applicant,"
which term shall include the owner or owners of the property, heirs, assigns and
successors
2. The zone change applies to the foltowing real property The northedy 142.71 feet of
vacated portion of LaSalte Addition in NE'/ of SE'/4 lying easterly of Hutchinson Road
including Lot 2, Block 1, LaSalle Addition in Section 7, Township 25 N, Range 44
EWM, in Spokane County, State of Washington
3. The proposal shall comply with the Regional Business (B-3) zone and all applicable
chapters of the Zoning Code, as amended.

4. The appiicant shait develop the subject property generally in accordance with the
concept presented to the Hearing Examiner. Variations, when approved by the Director
ofi the Division of Building and Planningldesignee, may be permitted, including but not
limited to bujlding tocabon, landscape plans and general altowable uses of the
peRnitted zone. All variatrons must conform to regulations set forth in the Spokane
County Zoning Code, and the original intent of the development plans shail be
maintained.
5. Approval is required from the Director of the Division of Building and
Planning/designee of a specifrc iighting and signing plan for the described property prior
to the release of any building permit.
6. Direct light from any exterior area tighting fixture shall not extend over the property
boundary.
7. A specific landscape plan, planfing schedule and provisions for the maintenance
acceptable to the Director of the Division of Building and Planning/designee shall be
submitted with a performance bond or other suitable guarantee for the project prior to
release of any building permits. Landscaping shall be instalted and maintamed so that
sight distance at access points is not obscured or impaired.
8. The Division of Building and Planning shall prepare and record with the Spokane
County Auditor a Title Notice noting that the property in ques#ion is subject tv a variety
of special conditions imposed as a result of approval of a land use action. This Title
Notice shall serve as public notice of the condjtions of approval affecting the property in
question. The Title Notice should be recorded within #he same bme frame as allowed
for an appeal and sfiall only be released, in full or in part, by the Division of Building and
Planning. The Titfe Notice shall generally provide as follows:

land use action by a Spokane Coun,ty Hearing Examiner on January 19,
2000, imposing a variety of special deve/opment conditions. File No. ZE-
15-99 is available forinspection and copying in fhe Spokane County
Division of Building and Planning.
Engineering Department
Prior to release of a buifding permit or use of property as proposed:
1. Access permits for approaches ta the County Road System shall be obtained from
the County Engineef.
2 The applicant shall submit for approval by the Spokane County Engineer, drainage
and access plans.

3. A parking pian and traffic circulation pian shall be submitted and approved by the
Spokane County Engineer. The design, location and arrangement of paricing stalls
shall be in accordance with standard engineering practices. Paving or surfacing as
approved by the County Engineer will be required for any portion of the project which is
to be occupied or travefed by vehicles.
4. All required impravements shall conform to the current State of Washington
Standard Specifications for Road and Bridge construction and other applicable county
standards and/or adopted resolutions pertaining to Road Standards and Stormwater
Management in effect at the date of construction, unless otherwise approved by the
County Engineer.
5. Roadway standards, typical roadway sections and drainage plan requirements are
found in Spokane Board of County Commissioners resolution 99-0265 as amended and
are appficable to this proposal.
6. No construction work is to be perfonned within the existing or proposed right-of-way
until a permit has been issued by the County Engineer. All work within the public road
right-of-way is subject to inspection and approval by the County Engineer.
7. The approach to Argonne Road shall be a right in/right-out only ddveway.
8. Traffic information prepared for this proposal is for direct access to Argonne Road
and Hutchinson Road. Any additional proposed access, or a change ofi use from that of
the site plan of record, will require additional traffic infomnation to be reviewed and
approved by the County Engineer.
9 The applicant shall grant applicable border easements adjacent to Spokane County
Right of Way per Spokane County Standards.
Spokane Regiona! Health District:
1. The sewage disposal method shail be as authorized by the Director of Utilities,
Spokane County.
2. Water service shall be coordinated fhraugh the Director of Utili#ies, Spckane County.
3. Water service shall be by an existing public water supply when approved by the
Regional Engineer (Spokane), State Department of Health Use of private wells and
water systems is prohibited.
4. A public sewer system will be made available for the project Use of an individual
on-site sewage dfsposal system will not be authorized.
Utilities Department
1. A wet (live) sewer connection to the area-wide Public Sewer System is to be
constructed. A sewer connection permit is required. Commercial developments shall

submit historical and/or estimated water usage pnor to the issuance of the connection
permit in order to establish sewer fees.
2. The applicant shall submit expressly to Spokane County Division of Ufilities (under
separate cover," only those plan sheets showing sewer plans and specifications for the
public sewer connections and facilities for review and approval. Commercial
developments shall submit historical andlor estimated water usage as part of the sewer
plan submittal.
3. Sewer plans acceptabte to the Division of Utilities shall be submitted prior to the
issuance of the sewer construction permit.
4. Arrangements for payment of applicable sewer charges must be made prior to
issuance of the sewer constnuction permit. Sewer charges may include special
connection charges and general facilities charges. Charges may be substantial,
depending upon the nafure of the development.
5. Any water service for this project shall be provided in accordance with the
Coordinated Water System Plan for Spokane County, as amended.

adjacent to three streets; Argonne Road, Knox Avenue and Hutchinson Road. All three streefis are fuily
improved and have curbs and sidewalks There are two residences located on the subject site that wiil be
removed prior to any development of the site. Sumounding uses inctude restaurants, retaii uses and typicat
commerciai strip development atong Argonne Road corridor, and residential uses located wes# of the site.
Hutchinson Road separates resldences lacated ta the west from the site. The site is located within the
Intenm Urban Growth Area (IUGA) as adopted by the 8oard of County Commissionecs, Resolution #97-
0321.
Backqround:
The current zoning of the subject srte is Urban Residenbal-22 (UR-22) established in 1991, previousiy
classified as IVluftiple Famiiy Suburban (MFS) m 1958 (ZE-90-5$), and Regional Busmess (6-3) estabtished
in 1991, and previously classified as Commercial (C) in 1977 (ZE-101-77C). The applicatian for the
proposed zone rectassificabon was submitted on October 25, 1999 A Technical Review meefing was held

Staff Analysis:
Project Description. The proposed project consisis of a zone reclassification from Urban Residential-22
(UR-22) and Regional Business (B-3) to Regronal 8usiness (B-3) for a drne-thru restaurant The exdsting
Urban Residental-22 (UR•22) zone is located on the interior parcel of the site The remainder of the site is
currently ioned Regionaf Business (8-3).
Comprehensive Plan:
The subjec# property is located within the Major Commercfal category of the Comprehenswe Plan. The
Major Commercial category is intended to pravide the opporturnty for development of commercial uses,
specifically commurnty and regionai shopping cenbers and commercial users, directly related major
throughways The Major Commercial category will be composed of three dtfferent types of commercial
development shopping centers, highway and arterial commerciai strips, and freeway commerc+al Highway
and artenal commercial stnp areas w111 usualty be ttlade up of businesses on mdividual parcels clustered
along a heavily traveled street or highway. Most commercial development vvill occur on generally flat land
and parkmg areas, streets and buddmgs v+nil dommate the site Landscaping, screenmg, signage and
archrtectural treatments wiil help to create sites that are aestheticalty pleasmg The Major Commer+cial
category contains a number of Decision Guidelunes that are applicable to the proposed zone reciassificabon
Decision Guideline 61.3 requires that proposed development provide for iandscapmg, srgnage and
architectural treatments along artenats within the Urban impact Area (UTA). The site plan of record appears
to demonstrate compiiance with the development standards of the proposed Regional Business (B-3) zone
including landscaping, budding setbacks, parlcing and building height
Decision Guidelines 6.1.4, 61.5, and 6 1.6 recommend that commercial developments have access to
major artenal systems, conform to plans for public water and sewer systems, and be reviewed for impacts to
the area transportation systems The proposal is located adjacent to Argonne Road which rs designated as
a Pnncipal Artenat by the Spokane County Arterial Road Plan and is currently served by public water and
sewer. A Vaffic distnbution letter was required and accepted by the Spokane County Division of Engineenng
and Roads The Division of Engineenng and Roads has submitted recommended condkions of approval to
mibgate any impacts that the proposed development may have on the adjacent transportabon sysfiem.
Zoning:
The purpose of the proposed Regional 8usiness (B-3) zone is to provide for the locabon of a wide range of
retail and service acbvibes and to implement tlhe Major Commercial category of the Comprehenswe Plan.
Major commercial uses oRen draw customers from the County at large and other outlymg areas rather than
a more limited populabon It is also the intent of the Regionat Business (8-3) zone to implement
Comprehensive Plan policies that encourage commerctal development along Principal Artenals or highways
and establish regional serving commercral areas General characteristics of these commercial areas will
include paved roads and sidewalks, public sewer and water, and a full Ime of public services The subject
stte is located adjacent to a pnncipal artenal and wnll be served by a full rne of public services
Existing zoning in the area of the sjte consists of a mix of Urban Residental-3.5 (UR-3 5), Urban

2. Findings:
a) This project lies over the Spokane-Rathdrum Aquifer.
b) The project is within Critical Water Supply Service Area #3 and within the service area of Spokane
County Water District #3. Water supply wili be a public system.
c) The project is inside the Spokane Couniy Comprehensive Wastewater Management Area, inside fihe
General Sewer Service Area, and inside the Priority Sewer Service Area recomrnended in the '201'
Study. The method af sewage disposal is subject to approval of the Director of Utilities, Spokane
County, pursuant to County Resolution 80.0418 adopted March 24,1980. The topography and soils in
the area are generally suitable for use of individual on-site sewage disposal systems. The lot is not of
the proper dimensions to pennit the use of both an individual well and sewage system.

d) The project lies in a relatively flat area west of Argonne Road and south of Knox Avenue. Local
drainageways are insignificant.
e) Surface soils are classed by the U.S. Soil Conservation Service as Garrison gravelly loam with 0% to
5% slopes. Theq have a septic tank filter field lmutation of slight. There is also possible
contamination of groundwater. This soil would be classified as a Type N.
fl Geologically, the soiis are glaciofluvial deposits. These geological structures generally yield moderate
to very large amounts of water. Data from wells in the area referenced in section 1 f shows they are
from 30' to 196' deep and have static water levels varying from S' to 101' below the surface. The
Spokane County Water District #3 has indicated thafi it can supply domestic use water for the project
upon compledon of agreements with the proponent
3. Required (mandatory) Conditions If Approved:
a) Sewage disposal method shall be as authorized by the D'uector of Utilities, Spokane County.
b) Water service shall be coordinated through the D'uector of Utilities, Spokane County.
c) Water service shall be by an existing public water supply when approved by the Regional Engineer
(Spokane), State Deparcrneni of Health.
d) A public sewer system will be made available for the project and individual service will be provided.
Use of an individual on-site sewage disposal system shall not be authorized.
4. Recommended Condirions of Approval:
a) Use of private wells and water systems is prohibited.

The Spokane County Engineering Department has reviewed the above referenced appiication. The
following "Conditions of Approval" are submitted to the Spokane County Planning Department for
inclusion in the "Findings of Fact, Conclusions and OrderlDecision" shouid the request be approved.

1. Access permits for approaches to the County Road System shall be obtained from the County
Engineer.
2. Applicant shall submrt for approval by the Spokane County Engineer drainage and access
plans.
3. A parking plan and traffic circulation plan shd# be submitted and approved by the Spvkane
County Engineer. The design, location and arrangement of parking stalls shall be in
accordance whh standard engineering practices. Paving or surfacing as approved by the
County Engineer will be required for any portion of the projeci which is to be occupied or

permit has been issued by the County Engineer. All work within the public road right of way is

I have reviewed the site plan and traffic distribution letter from Ann Winkler, dated October 28,
1999 for the above refenenced development Based on my review, I recommend that we allow
this project to continue through the approvai process without further traffic review I have based
my recommendation on the following:
1. The existing LOS, based on counts recorcled m 1998 by Spokane County, is LOS `C'
2. As stated in the distnbution letter, it is likely that a large proportion of the traffic visiting this
proposed development wdl already be on the road network Although more appropriately
described as diverted trips, rather than pass-by, the predominate movements related to the
site woutd be right tums.
3. The access point on Argonne Rd. is a nght-iNright-out only dnveway and should not
mterfere with the operation of the Argonne/Knox intersecbon.
Should the proposed land use or acxess to the site on Knox Ave change from what is shown on
the site plan, I would ask that an updated site plan and distribution letter be prowded

I have been contacted by John Sweitzer to do a trip distribution letter for a
proposed restaurant at the southwest comer of Knox 8 Argonne. This letter will

This proposal is for a 3,300 square foot fast foot restaurant with a drive-thrajgh
window. The site will have two access polnts, one to Hutchinson on the western
~ L site of the site and one to Argonne on the eastem side of the site.

Development of this site into a fast food restaurant requires that a portion of the
sde be zoned 6-3 frorn it's existing zoning of UR-22, to match the balance of the
site.

Infonnation in the Trip Generatlon Nendbook published by the Institute of TransQortaticn
EnQineeriM lists 50% as an average pass-by rate during the PM peak hour for fast food
restaurants. Therefore, new trafflc to/from the site during the PM peak hour is expected to total
onty about 55 vehictes, 29 entering and 26 exffirrg.

The main purpose of this letter is to talk about the expected distrfbutlon of traffic from this sete
onto the sumounding transportabon system. At dhe present time based upon October, 1999
Spokane County Uaffic counts. there are approximately 1.840 northbound vehides on Angonne
at Knox in the PM peak hour. During tw PM peak hour, there are approwmatety 2.600
southbound vehides on Argonne at Knox. Traffic volumes on Knox/Hutchinson are not known,
however, they are expected to be less than 50/o of the traffic volumes on Argonne.
Based upon the type of land use proposed, the exisfing peak hour traffic distribution along 1he
adjaoent stneets and fietd observabons of primary driver characteristics as abserved during site
vissits, the anticipated trip distribution and assignment within the general area was determined.
The traffic to/finom this site is expected to distribute itself onto the transportation system
approximately 40% northbound on Argonne and 60aYo southbound on Argonne. Onty a
negligible amount is anticipated to travei jnto ft neighborhood west og the site, and those are
expectecf to be made up of people who live in that area. Traffic entering/exiting onto
Hutchinson is expected to retum to Argonne. East of the site on Knox traffic from the site will
most likely be made up of "shared" trips, those who are going to this fast food restaurant and
then to another fast food restaurant or store This is also expected to be a negligible amount

the Trip Generatron 14fanual, 6th Fdition published by the Insbtute of
- a_ Transr?ortation EnQineerinq. A substantial pcarbon of the traffic going to and from
`this store is expected to be "pass-by" traffic, alneady on Argonne, which just
- tums into Knox to go to the fast food restaurant and then back onto Argonne.
Information in the Tnp Generation Handbook published by the Institute of
Transoortation Enaoineerinq lists 50% as an average pass-by rate during the PM
, t Tpeak hour for fast food restaurants.
The main purpose of this letter is to talk about the expected distnbution of traffrc
} from this site onto the surrounding transportation system. At the present time
based upon October, 1999 Spokane County traffic counis, there are
approximately 1,840 northbound vehicles on Argonne at Knox in the PM peak
a - hour. During the PM peak hour, there are approximateiy 2,600 southbound
vehicles on Argonne at Knox. Traffic volumes on Knox are not known, however,
they are expected to be less than 50/o of the traffic volumes on Argonne.

Based upon the type of land use proposed, the existing peak hour traffic
' distribu4on along the adjacent streets and field abservations of primary driver
characteristics as observed dunng site visits, the anticipated trip distribution and
r assignment within the general area was determined. The traffic to/from this site
: is expected to distribute itself onto the transportation sysiem approximately 40%

Pla„njng, e4 northbound on Argonne and 60% southbound on Argonne. Only a negligible

PURPOSE OF CRECKLIST
The State Environmental PoUcy Act (SEPA), chapter 43.21C RCW, requues all governmental agencies
to consider the envuonmental impacts of a proposal before makmg decisions. An environmental
impact statement (EIS) must be prepared for aU proposals wrth probable significant adverse unpaca on
the quality of the envirorunent. The purpose of this checklist is to provide information to help you and
the agency identify impact from your proposal (and to reduce or avoid impacts from the proposal, if it
_ can be done) and to help the agency decide wbether an EIS is requued.

Governmental agencies use this checklist to determine whether the environmental impacts or your
proposal are significant, requiring preparation of an EIS. Answer the questions bnefly, with the most
