The members of the Committee present are: Frank Yuse, Chair, Verona Southem and Lunell HaughL PROPOSAL The sponsor, Window ProducLs, requests approval of a Change of Condidons, ZE-105A-78 to an existing Light Induscrial (I-2) zone to delete a condition of approval which specifies that use of the subject property shall be limited to warehousing only, and to allow all those uses allowed in the Light Industrial (I-2) zone. FINDINGS OF FACT AND CUNCLUSIONS 1. The property is generally located west of and adjacent to University Road and approximately 300 feet north of Niontgomery Drive in Secdoa 8, Township 25 North, Range 44 EWM, Spokane County, Washingtoa. 2. The Committee adopts the Planning Department Report as a part of this record. 3. The existing Iand uses in the area include warehousing, light manufacturing, offices, single family residences and undeveloped. 4. The proposed use is compatible with existing uses in the area. 5. The Comprehensive Plan designates this site as Industrial. The Industrial category is intended to provide the opportunity for Indusorial development and reserve land far industnal purposes. Decision Guidelines of the Industrial categary suggest that only Light Industrial (I-2) uses should be allowed adjacent to residences and that buffeaing should be required to mitigate negative imgacts on residential development adjacent to indusuW uses. 6. The exisdng zoning dces implement and confonn to the Comprehensive Plan. 7. The Arterial Road Plan designates University Road as a Pniicipal Arterial, with a recommended right of w2►y width of 100 feet. In order to implement the Arterial Road Plan, the County Engineer has requested ded.ication of a 2 foot vvide strip along University Road and that an additional 18 foot wide strip of land should be set aside as a future acquisition ffiea. 8. The existing zoning of the progerty described in the application is Light Industrial (I-2) previously established as Restricted Industrial (Rn tioning in 1978 and . ~ HEC Order for ZE- 1 05A-78 Page 2 . ~ redesignated to Light Industrial (I-2) on Jannary 1,1991 pursuaat to the 1'rogram ta Implement the Spokane County Zoning Code. 9. The provisions of RCW 43.21C (The State Envuonmental Policy Act) have been complied with and a Determination of Nonsignificance (DNS) was issued. The Comaaittee, after independent revitew, hereby adopts the DNS. 10. The legal requirements for pubtic nodce have been fulfilled. 11. The owners of adjacent lands expressed nether approval nor disapproval of the proposed use. 12. The applicant has demonstrated that condidons have substandally changed since the original zoning of tUis area and accordingly, the proposed change of condidons is justified. Specif cally, changed condirions include development of additional light industry in the area. 13. The proposed use will not be detrimental to the public health, safety, morals or welfare especially in hght of the conditions recommended by the reviewing agencies. CONDITIONS OR CONTINGENCIES APPLIED TO THIS APPROVAL 1. All Conditions imposed by the Hearing F,xacniner Committee shall be binding on the "Applicant," which term shall include the owner or owners of the property, heirs, assigns, and successors-in-interest. 2. The following Conditions of Approval apply to the real property described below: The south 160 feet of the north 1/2 of Lots 12 and 13 in Fniitland Addition to Spokane County, Washington, EXCEP'f the south 1609 feet of the west 242 feet of the north 1/2 of Lot 12. TOGETHER WTI'H the west 242 feet of the south 160 feet of the north 1/2 of Tract 12, Fruidand Addition, Spokane County, Washington. 3. All conditions of approval for file no. ZE-105-78 are still applicable to the subject property except as modified by this action. SPOKANE COUNTY PLANNING DEPA1tTMENT 1. The proposal shall comply with the Light Industrial (I-2) zone as amended. 2. 'Ihe applicant shall develop subject property generally in accardance within the concept presented to the Hearing Body. Variations, when approved by the Plannung Director/designee, may be permicted, including, but not limited to building locaaon, landscape pians and general allowable uses of the penrritted zone. All variations mnst coafann to regulations set fortb in the Spokane County Zoning Code, and the original intent of the development plans shall be maintained. . ~ ~ HEC Order for ZE-105A-78 r ' Page 3 . ~ 3. A specific landscape plan, pianting schedule aad provi.sions for mai.atenance acceptable to the Planning Director/designee shall be submitted with a pesformance boAd fQr the project prior to release of building perrmts. Landscaping shall be installed and maintained so that sight d.istance at access points is not obscured or impaired At such time as vehicular access to University Road from the site is appraved by the County Engineer, Type III landscaping, 5 feet wide, will be required along the site's Universiry Road frontage. 4. The Spokane County Planning Department sha11 prrepare and recar+d with the County Auditor a Tide Notice specifying a future land acquisition area for road right-of-way and utilities. The reserved future acquisition area Tide Notice shall be released, in full or in part, by the Planning Department The notice should be rec:orded within the same time frame as an appeal and shall prnvide the following: a. At least 18 feet of reserved future acquisition area for road right-of-way and udlities, in addition to the existing and,/or newly dedicated right-of-way along University Road. NOTE: The County Engineer has required 2 feet of new dedication. b. Futtue building and other setbacks required by the Spokane County Zoning Code shall be measured from the reserved future acrquisition area. c. No required landscaping, parking,'208' areas, drainfield or allowed signs should be located within the future acquisition area for road right of-way and utilides. If any of the above improvements are made within this area, they shall be relocated at the applicant's expense when roadway improvements are made. d. The future acquisition area, until acquired, shall be private property and may be used as allowed in the zone, except that any unprovements (such as landscaping, parking, surface drainage, drainfield, signs or others) shall be considered interim uses. e. The Planning Department shall prepare and recard vsnth the Spokane County Auditor a Tide Notice noting that the property in question is subject to a variety of special conditions imposed as a result of approval of a land use action. This Title Notice shall serve as public notice of the condidons of approval affecting the pmperty in question. The Title Notice should be recorded within the same time frgme as allowed for an appeal and shall only be released, in full or in part, by the Planning Department. Prior to issuance of a building pemoit or at the request of the County Engineer in conjunction with a County Road ProjectJRoad Improvement District, wbichever acdon cames first: 2. Applicant shall dedicate Z feet on University Road for right-of-way purposes. 3. Prior to release of a buildiag pernut or use of the praperty as proposed: 4. Access pennits for approaches ta the counry road system shall be obtained from the Spokane County Engineer. 5. The applicant shall submit far approval by the Spokane County Engineer road, drainage and access plans. 6. The apglicant shail submit for approval by the Spokane County Engineer aad the Spokane County Health District a detailed combined on-site sewage systecn plan and surface water disposal plan for the entire project, or portion thereof, if the development is to be phased. 7. A parking plan and tiraffic cinculation plan shall be subnutted and approved by the Spokane County Engineer. The design, location and affangement of parldng stalls shall be in accordance with standard traffic engineering practices. Paving or surfacing as approved by the County Engineer, will be required for any portion of the project which is to be occupied or traveled by vehicles. 8. To construct the roadway improvements stated herein, the applicant may, with the appnoval of the County Engineer, join in and be willing to participate in any petidon or resoludon which purpose is the formadon of a Road Improvement District (RID) for said improvement, pursuant to RCW 36.88, as amended. Sgokane County will not parcicipate in the cost of these improvements. This is applicable t+o Umversity Road. 9. As an alcernative method of constructing the road improvements stated herein, the applicant may, wich the approval of the County Engineer, accomplish the road irnprovements scated herein by joining and participaang m a County Road Project (CRP) to the extent of the requred improvement. Spokane Couaty will not participate in the cost of these improvements. This is applicable to University Road. 10. The construcdan of the rQad impmvements stated herein sha11 be accomplished as approved by the Spokane County Engineer. 11. The County Engineer has designated Typical Roadway Section Number Qne, Minor Arterial standand for the improvement of University Road, which is adjacent ta the proposed development This will require the addition of approximately 12 - I4 feet of asphalt along the frontage of the development. This property may be acquired by Spokane County at the time when arterial improvements ar+e made to University Road. 18. There may exist utilities, either underground or overhead, affecting the subject property, including property to be ded.icated or set aside for future acquisition. Spokane County assumes no financial obligation for adJustnents or relocation regardmg these utilities. Applicant(s) should check with the applicable utility punreyor and the Spokane County Engineer to detemtine whether applicant(s) or the utility is responsible for a,djustment or relocation costs and to make anrangements for any necessary work. SPOKANE COUNTY HEALTH DISTRICT 1. A combined surface water and sewage disposal detuled plan shall be approved by the Spokane County Engineer and Spok,ane County Healrh District prior to the issuance of any on-site sewage dbsposal penriit or building pexmit for this project. 2. Sewage disposal method shall be as authorized by the Director of Utilities, Spokane County. 3. Water seTVice shall be coordinated through the I3irector of Utilities, Spokane Couniy. 4. Water service shall be by an existing public water supply when approved by the Regional engineer (Spokane), State Department of Health. 5. I?isposal of sewage efflnent beneath paved surfaces is currently prohibited. 6. Subject to specific application approval and issuance of permits by the health officer, the use of individual on-site sewage disposal systems may be authorized. 7. Use of private wells and water systems is prohibited. SPOKANE COIjNTY DIVISION OF UTILITIES 1. Pursuant to the Board of County Commissioners Resolution No. 80-0418, the use of on-site sewer disposal systems is hereby authorized. This authorizatian is conditioned on compliance with all rules and regulations of the Spokane County Health I?istrict and is further conditioned and subject to specific application approval and issuance of permits by the Health DistricL 2. The owner(s) ar successor(s) in interest agree to authorize the County to place their name(s) on a pedtion for the formarion of ULID by petidon method piusuant to RCW 36.94, which petition i.ncludes the owner(s)' property; and further not to object by the signing of a protest petidon against the fonnation of a ULID by resolution metbod pursuant to RCW Chapter 36.94 which includes the owner(s)' property. Sewa connection permit is required. Plans and specifications are tn be reviewed and approved by the Utiliaes Deparament. SPOKANE COUNTY DIVISION OF BUILDINGS 1. The applicant shall contact the Department of Buildings at the earliest possible stage in order to be infonned of code requirements administeredlenforoed as authorized by the State Building Code Act. Design/development concerns include: Addressing, fire apparatus access roads, fire hydrant/Aow, approved water systems, building accessibility, construction type, occnpancy classificarion, exiting, exterior wall protection, and energy code regulations. Neighborhood Characteristics The area surrounding the subject property is dominated by industnal land uses, prunanly office, warehousing, dismbunon facihties and light assembly. There is a small sulgle farnily housing area located duecdy north of the site. Northeast of the slte is an additional housing area. Otherwise, laud to the south, east and west of the site is occupied by industnal land uses. There is vacant land east, west and north of the subject property which is planned far addiaonal industnal development. E. Zoning Analysis: The site was zoned Restricted Indusmal (RI) in 1978 (ZE-105-78).
