INTRODUCTION This matter having come before the Zoning Hearing Examiner Committee on June 6, 1985, and the members of the Committee present being F. Lynn Tennican, Chairperson, Kathleen M% Carstens and Ron Odell. 6. PROPOSAL The sponsor, Northwood Properties, Inc., is requesting approval of a zone reclassification, File No. ZE-105-84, Agricultural to Restricted Industrial, for the purpose of developing a Warehouse, Storage and Office Building. C. FINDINGS OF FACT 1. That the existing land use in the area is residential, Argonne Commerci al Center, pasture, and open area. 2. That the Comprehensive Plan designates thls area as appropriate for Industrial development. 3. That the exi sti ng zoni ng of the property descri bed i n the appl icati on i s Agricul tural . 4. That the provisions of RCW 43.21C (The State Environmental Policy Act) have been complied with, and the Comnittee concurs with the Declaration of Non-Significance. 5. That the proper legal requirements for advertisement of the Agenda Item have been fulfilled. 6. That the land in this area is suitable for the proposed use, or uses wi thin the proposed Zone C1 assi fication. 7. That the applicant has demonstrated that conditions have substanti al ly changed since the ori gi nal zoning of thi s area and accordingly, the proposed rezone is 3ustified. 8. That the proposed use is compati bl e wi th exi sti ng uses 1 n the area, if ineasures are implemented for buffering, landscaping and height 1 imitation. ZONE RECLASSIFICATION N0. ZE-105-84 C. FINDINGS OF FACT (continued) 9. That the owners of adjacent lands expressed disapproval of the proposed use. 10. The Hearing Examiner Committee finds the proposed use to be in harmony with the general purpose and will not be otherwise detrimental to the public health, safety, and welfare. 11. The fol 1 owi ng are addi ti onal f i ndi ngs of fact consi dered by the Heari ng Exami ner Commi ttee: a) That previous actions, Such as areawide rezoning of adjacent areas to Restricted Industrial and I-90 construction, set in motion the comnercial and industrial development trend of this area rather than continued residential development. Those acti ons 1 eft some pre-exi sti ng resi denti al devel opment i n thi s area which are now not compatible with the current trend. However, measures imposed on this development should help mitigate some of those compatibility concerns. D. CONDITIONS OR CONTINGENCIES APPLIED TO THIS APPROYAL (All Conditions imposed by the Zoning Hearing Examiner Comnittee shall be binding on the "Applicant", which term shall include the owner or owners of the property, heirs, assigns, and successors.) i The following Conditions were imposed by the Zoning Hearing Examiner Committee: COUNTY PLANNING DEPARTMENT: l. That the maximum 18-foot one-story requirement is clarified further, that building height on this site not exceed that of ~ the present structures within the existing Gunning development to the north which is known as Argonne Cornnercial Center. 2. That no storage of any nature be allowed to the south of any constructed buildings in this proposed rezone site or applicant's adjacent ownership as shown on the submitted site plan. COUNTY ENGINEERING DEPARTMENT: l. Any drainage plan which is developed for the proposed project shall take into consideration the need for and construction of fac i 1 i ties for the contai nment of spi 11 s of cri ti cal materi al s which could result f rom the delivery of those materials to storage facilities which are located on this and/or adjacent parcels. Spill containment facilities shall be constructed per the provisions of the ASA Overlay Zone. 2 • i ZONE RECLASSIFICATION N0. ZE-105-84 D. CONDITIONS OR CONTINGENCIES APPLIED TO THIS APPROVAL (continued) a) COUNTY PLANNING DEPARTMENT 1. Approval by the Zoning Administ-rator of a specific lighting and signing plan for the described property prior to the release of any bui 1 di ng permi ts. 2. A specific landscape plan, planting schedule and provisions for maintenance acceptable to the Spokane County Zoning Administrator shall be submitted with a performance bond for the proj ect pri or to rel ease of bui 1 di ng permi ts. Landscapi ng shal l be installed and maintained such that sight distance at access points is not obscured or impaired. 3. The applicant shall develop subject property generally in accordance within the concept presented to the Hearing Examiner Committee. Variations when approved by the Zoning Administrator will be permitted, including, but not limited to the following changes: Building location, landscape plans, and general allowable uses of the permitted zone. Al1 variations must conform to regulations set forth in the Spokane County Zoning Ordinance. The original intent of the development plans shall be maintained. 4. Di rect 1 i ght from any exteri or area 1 i ghti ng fi xture shal 1 not extend over the property boundary. 5. The specific development plan will be submitted for Planning Department review and approval prior to issuance of building permi ts. 6. All current standards of the Restricted Industrial Zone, as amended, shall be complied with in the development of this site. 3 ZONE RECLASSIFICATION N0. ZE-105-84 a) COUNTY PLANNING DEPARTMENT (continued) 7. That the present proposal is not detailed enough to determine whether or not the use of or materials stored on the site are in compliance with Chapter 4.16A (Aquifer Sensitive Area Overlay Zone) of the Spokane County Zoning Ordinance. Accordingly, as a condition of approval, the sponsor/applicant shall be required to file with the Spokane County Auditor, within thirty (30) days of the signing of Findings and Order of the final decision in this matter, a"Notice to the Public" which shall provide in material as follows: PRIOR TO THE ISSUANCE OF ANY BUILDING PERMIT OR CERTIFICATE OF OCCUPANCY FOR ANY BUILDING OR ANY USE ON THE PROPERTY DESCRIBED HEREINAFTER, THE APPLICANT SHALL BE RESPONSIBLE FOR COMPLYING WITH THE PROVISIONS OF SPOKANE COUNTY ZONING ORDINANCE CHAPTER 4.16A (AQUIFER SENSITIYE AREA OVERLAY ZONE). THE PROPERTY WHICH IS THE SUBJECT OF THIS NOTICE IS MORE PARTICULARLY DESCRIBED AS FOLLOWS:....". 8. Applicant shall comply with '208' recomnendations concerning stormwater runoff and provide necessary landscaping for runoff. 9. Any division of land for the purpose of sale, lease or transfer, shall comply with RCW 58-17 and the Spokane County Platting Ordinances prior to issuance of building permits. 10. That the provisions of SEPA's NOTICE OF ACTION pursuant to Chapter 43.21C.080 RCW and the Board of Spokane County Comni ssi oners Resol uti on #77-1392 be i ni ti ated by the proj ect appl icant wi thi n thi rty (30) days of fi nal di sposi tion of thi s application, and prior to any on-site improvements. 11. That all storage areas, fencing, or gates be located approximately 20-feet from the west property line (Locust Road) on at least the building line of existing structures north of this site. 12. That a landscaped strip/buffer, as approved by the Zoning Administrator, shall be provided along Locust Road between the west property line and proposed 8-foot fence. 13. That a residential-appearing 8-foot sight-obscuring fence be provided along all west and south property lines to provide a buffer for exi sti ng si ngl e fami 1y resi dences. 14. That the existing cyclone fence along the east property line be made sight-obscuring by installation of slats or other materials acceptable to the Zoning Administrator. 4 s ZONE RECLASSIFICATION N0. That tall dense growth landscaping, as approved by the Zoning Administrator, be installed along the west and south sides of the building. 17. That maximum structure height be limited to one story of no more than approximately 18-feet. b) COUNTY ENGINEERING DEPARTMENT Prior To 7he Issuance Of A Building Permit: 1. Access permits for approaches to the County Road System shall be obtai ned from the Spokane County Engi neer. 2. Appltcant shail improve Locust Road in a manner consistent with Spokane County TYPICAL roadway section No. 1 minimum paving width Access Standard. 3. Applicant shall submit for approval by the Spokane County Engineer road, drainage, and access plans prior to the issuance of a building permit on the property. 4 4. The applicant shall submit for approval by the Spokane County Engineer and the Spokane County Heal th Di strict a detai 1 ed combined on-site sewage system plan and surface water disposal pl an for the enti re project pri or to the i ssuance of any building permit on the property. 5, a parking plan and traffic circulation plan shall be submitted ~ and approved by the Spokane County Engineer prior to the issuance of a building permit on the property. The design, location, and arrangement of parking stalls shall be in accordance with standard traffic engineering practices. Paving or surfacing as approved by the County Engineer, will be requi red for any porti on of the pro3 ect whi ch i s to be occupi ed or traveled by vehicles. 6. The word "applicant" shall include the owner or owners of the property, his heirs, assigns, and successors. 7. The construction of the road improvements stated herein shall be accomplished as approved by the Spokane County Engineer. 5 . ZONE RECLASSIFICATION N0. ZE-105-84 b) COUNTY ENGINEERING DEPARTMENT (continued) 8. All required improvements shall conform to the current State of Washington Standard Specifications for Road and Bridge Construction, and other applicable County standards and/or adopted resolutions pertaining to Road Standards and Stormwater Management in effect at the date of construction, unless otherwise approved by the County Engineer. 9. Roadway standards, typical roadway sections and drainage plan requirements are found in Spokane Board of County Comnissioners' Resolution No. 80-1592 as amended and are applicable to this proposal. c) COUNTY UTILITIES DEPARTMENT l. Pursuant to Board of County Commissioners Resolution No. 80-0418, the use of on-site sewer disposal systems is hereby authorized. This authorization is conditioned on compliance with all rules and regulations of the Spokane County Health District and is further conditioned and subject to specific application approval and issuance of permits by the Nealth District. 2. The owner(s) or Successor(s) in interest agree to authorize the County to place their name(s) on a petition for the formation of a ULID by petition method pursuant to RCW 36.94 which the petition includes the Owner(s) property and further not to object by the signing of a protest petition against the formation of a ULID by resolution method pursuant to RCW Chapter 36.94 which includes the Owner(s) property. PROVIDED, this condition shall not prohibit the Owner(s) or Successor(s) from objection to any assessment(s) on the property as a result of i mprovements cal 1 ed for i n con j uncti on wi th the formati on of a ULID by either petition or resolution method under RCW Chapter 36.94. 3. Any water service for this project shall be provided in accordance with the Coordinated Water System Plan for Spokane County, as amended. 4. The unit shall be double-plumbed for connection to future areawide collection systems. 6 . , ZONE RECLASSIFICATION N0. ZE-105-84 d) COUNTY HEALTH DISTRICT 1. A combined surface water and sewage disposal detailed plan shall be approved by the County Engineer and the Health District prior to the issuance of any building permit for this project. 2. Sewage disposal method shall be as authorized by the Director of Utilities, Spokane County. 3. Subject to specific application approval and issua,nce of permi►ts by the Health Officer, the use of an on-site sewage disposal system may be authori zed. - 4, Water service shall be coordinated through the Director of Utilities, Spokane County. 5. Water service shall be by an existing public water supply when approved by the Regional Engineer (Spokane), State Department of Social and Health Services. 6. Use of private wells and water systems is prohibited. 7. Disposal of sewage effluent beneath paved surfaces is currently prohibited. e) COUN7Y BUILOING ANO SAFETY DEPARTMENT 1. The site is located in Fire District # 1. 2. Each building constructed shall be accessible to.fire department apparatus by way of access roadways with all-weather driving surface of not 1 ess than 20 feet of unobstructed wi dth wi th adequate roadway turning radius capable of supporting the imposed loads of fire apparatus and having a minimum of 13 feet, 6 inches of vertical clearances. All roadway grades to be approved by fi re di stri ct. 3. The development shall be provided with at least two (2) points to the public street. The access locations shall be approximately on opposite ends of the development. 4. Approved numbers or addresses shall be placed on all new and existing buildings in such a position as to be plainly visible and 1 egi bl e f rom the street or road f ronti ng the property. Sai d numbers shall contrast with their background. 5. Trash enclosures shall not be located adjacent to combustible construction or underneath windows or nonprotected eaves. 7 . t ZONE RECLASSIFICATION N0. ZE-105-84 e) COUNTY BUILDING AND SAFETY DEPARTMENT (continued) 6. Building permits will be required for each structure. 7. Fire hydrants which meet the fire flow are required to be installed prior to any construction. These hydrants shall be placed so that no portion of the building exterior is more than 175 feet from the hydrant. The bottom of the lowest outlet of the hydrant shall be no less than 18 inches above grade. A water plan showing each fire hydrant (specifying the gallons per minute for each fire hydrant) and meeting the requirements in Chapter 10.04 of the Uniform Fire Code is required prior to construction of the water serviee. All required fire protection facilities shall be installed and made serviceable prior to and during the time of construction. f) WATER PURVEYOR l. Water Purveyor is Modern Electric Water Company, and they will supply the site with adequate water for domestic, fire and irrigation uses; however, specific arrangements haven't been made. g) COUNTY AIR POLLUTION CONTROL AUTHORITY l. Air pollution regulations require that dust emissions during demolition, excavation and construction projects be controlled. 7his may require use of water sprays, tarps, sprinklers, or suspensi on of acti vi ty duri ng certai n weather condi ti ons. Haul roads should be treated and emissions from the transfer of earthen material must be controlled as well as emissions from all other construction related activities. 2. Measures must be taken to avoid the deposition of dirt and mud from unpaved surfaces onto paved surfaces. If tracking or spills occur on paved surfaces, measures must be taken immediately to clean these surfaces. 3. All travelled surfaces (ingress, egress, parking areas, access roads) must be paved and kept clean. 4. Some objectionable odors will likely result during the constructi on phase of the proj ect and f rom motor vehi cl es usi ng the site following completion of the project and f rom occupants of the proposed project. 5. SCAPCA Regulation I. Article V requires that a Notice of Construction and Application for Approval be submitted to and approved by our Agency prior to the construction, installation or establishment of an air pollution source. 6. All air pollution regulations must be met. 8 ZONE RECLASSIFICATION N0. ZE-105-84 E. ORDER The Hearing Examiner Committee, pursuant to the aforementioned, finds that the application of Northwood Properties, Inc., for a zone reclassification as described in the application should be APPROVED to the RESTRICTED INDUSTRIAL ZONE. SEPA ENVIRONMENTAL REVIEW (c ontinued) An Environmental Chec klist was submitted by the sponsor and was reviewed by the County Planning Department. The review considered the specifics of the proposal, other available information, County ordinanc es, other regulations and laws, possible standard Conditions of Approval, the Generalized Comprehensive Plan, and other County policies and guidelines. The Zoning Administrator has determined that "No probable signific ant adverse impac ts" would result f rom the proposal being developed and has issued a Determination of Non-Si gni fic arce ( "ONS" ) . The "DNS" was c i rcul ated to ni ne other agenc i es of juri sdic ti on and other agenr i es/departments affec ted by the future devel opment for review and c omment. The "DNS" c omment period ends June 5, 1985, and was advertised 15 c alendar days before said date in the newspaper, by 1 etter to adjac ent property owners thi n 400 feet of the proposal, and by notic e on a sign posted on the proposal site. The Hearing Examiner Committee may c onsider additional environmental related testimony and the "DNS" at the public hearing. V. PLANNING SUMMARY The proposed zone c hange is generally c onsistent with the Industrial c ategory of the Comprehensive Plan. In addition, use of the site represents expansion of an exi sti ng i ndustri al /commerci al parlc. Conditions for industrial development have been suggested to include buffering, landsc aping, lighting, and signage c ontrols. VI.
