This project was a two story duplex and the framing stage was approximately 75% complete. The only item that needed to be corrected at this time was changing the thickness of stair tread material so that the risers of the stairs would comply with the 3/8" rule as required in Section 3306(c), 1988 Uniform Building Code. JOHNSTON IDAHO & WASHINGTON STATE BARS RECEIVED SEP 19 1990 BUILDING & SAFETY Dear Chief Inspector: Be advised this office representsiAlex Brehm, owner of Chalet Builders who is presently building a -spec duplex in the;City-of . Spokane pursuant to permit number 90-1048. At the time Mr: -:Brehm first took out the permit to build the residence, -a set of plans were submitted for approval of the building department. The plans called for 2x4 construction and Mr. Brehm was not informed this was not pursuant to the building codes of the City of Spokane. He retained the services of a person by the name of Jerry Morrison who advised Alex Brehm he was a former Spokane County Building Inspector who was in the framing business. Based upon Mr. Morrison's representations, a contract was made for the framing of the duplex pursuant to the plans. At no time was Mr. Brehm ever advised by this individual the 2x4 construction was not subject to the applicable building codes of Spokane and the framing was substantially performed pursuant to the plans and specs as called for in the improved plans. A problem arose between Mr. Brehm and Mr. Morrison concerning the work performed and the matter got quite heated. The approved plans were taken from the job site by Mr. Morrison. There is currently litigation between Mr. Morrison and'Mr. Brehm concerning the poor work and contract concerning'the framing and it seems Mr. Morrison has contacted the Spokane County•Building:Department to help out in his cause. At the time of the controversy with Mr. Morrison was the -first time Mr. Brehm was informed the framing which was done was not according°to the Spokane building codes. The plans and specifications were removed from the job site by Mr. rrEiv rn SEP t4 1990 of mun.;.: September 10, 1990 Chief Building Inspector Page 2 Morrison and after demand upon his attorney were returned. Upon the return, it was noted the plans concerning the 2x4 framing had been changed and modified by the building department which were not in the plans at the time Mr. Brehm first obtained his permit. The Building Department has made many unsolicited visits to the job site and have made many objections to the construction site. The only way these particular items would have been noted or these unsolicited inspections of the job site would have been made would be as a result of contact from Mr. Morrison with his past associates. Mr. Brehm feels he is being singled out and harassed by the Building Department. The inspections which are being made are unreasonable and for no other purpose than to put pressure on Mr. Brehm as a result of the disgruntled past subcontractor of Mr. Brehm and friend of the Building Department. DEMAND IS HEREBY MADE by Mr. Brehm this harassment and discrimination cease by the Building Department or Mr. Brehm has advised he will have to bring the appropriate legal action for all parties involved concerning the unwarranted and prejudicial treatment he is receiving from the City. Mr. Brehm would like to meet with the head of the Building Department to discuss the procedures to be followed from this point forward so there is no misunderstanding concerning the requirements and/or needs concerning the construction of this duplex.
