It will be held at the Spokane County Health Building, W. 1101 College Ave., Room 200. At that time, you will be given the opportunity to present your argument as to why the portions of the drainfield in conflict with the garage should not be relocated. Be aware if the District doesn't decide in your favor and you refuse to relocate the drainfield, our next action would be to refer the matter to the County Prosecutor. The District will have to enforce Section 1.04.180 of Spokane County Rules and Regulations for Sewage Disposal Systems and require the relocation of the drainfield that is in conflict with the newly constructed garage. A deadline of May 1, 1987, has been given to you to complete the relocation of the drainfield. Failure to meet the deadline will necessitate an administrative meeting to be conducted. The District has considered your request to not be required to replace the portion of drainfield that is in conflict with your garage, and has decided to deny the request for the following reasons: 1. Section 1.04.180, Table II, of the Spokane County Rules and Regulations for Sewage Disposal Systems, requires a ten foot setback from a drainfield to any building structure. In this instance, a portion of the drainfield is located under the garage. 2. At the time of the building application, the District informed the applicant there was a possible conflict with the garage and that the application could not be approved by the District. 3. The applicant proceeded to build the garage without permits, knowing there was a possible conflict with the drainfield. Because of unfavorable ground conditions at this time, the District will extend the deadline date to relocate portions of the drainfield to May 1, 1987. As you were informed, the last 20 feet of your south east drainfield line is in conflict with your newly constructed garage. Therefore, you need to relocate that portion of your field. Also, there is a drainfield running in front of your garage, where your car crosses over daily. This area needs to be paved, or the drainfield relocated. To repair or replace any portion of a drainfield, a permit needs to be obtained. The replacement permit fee is $45.00. The permit is to be obtained prior to any construction of the system. You must apply for the sewage permit before the District can sign -off your bulding application for the garage. As the garage has already been constructed, your sewage system is considered illegal because it is in violation of the Spokane County Rules and Regulations for Sewage Disposal Systems. Therefore, you need to replace the southeast drainfield line and pave over the drainfield running in front of the garage within 30 days of this letter date. Failure to meet the deadline will necessitate an administrative hearing to be conducted. Please feel free to contact our office at 456-6040, if you have any questions.
