application and the entire record, hereby makes the following findings of fact, conclusions of law and decision I FINDINGS OF FACT 1 The application requests a change of conditions to a pnor zone reclassification and a pnor change of conditions, in the Urban Residential-22 (UR-22) zone 2 The site is generally located at the northwest corner,9f the intersection of 6u' Avenue and Woodruff Road, in the NW '/4 of Section 20, Townsh.ip 2'4 orth, Range 44 EWM, Spokane CountY, Washington 3 The site is currently designated as County Assessor's taac parcel nos 45202 9069 and 45202 9068 4 The owner of tax parcel no 45202 9068 is Hidden Pines Lunited Partnership, 525 East Mission Avenue, Spokane, WA 99202-1824 The owner of tax parcel no 45202 9069 is Woodruff Heights Limlted Partnership, 525 East Mission Avenue, Spokane, WA 99202-1824 5 The applicant for the proposal is Woodruff Heights Lunited Partnership, 525 East Mission Avenue, Spokane, WA 99202-1824 6 The Hearing Examiner heard the application pursuant to the County Heanng Examiner Ordinance (County Resoluhon No 96-0171) and the County Heanrig Examiner Rules of Procedure (County Resolution No 96-0294) 7 The requirements for Spokane, WA 99202 10 The County Division of Planrung issued a Deternlulation of Nonsigruficance for the proposal on May 25, 2001 11 The Hearing Examiner takes notice of the County Comprehensive Plan, the County Zoning Code, other applicable development regulations, and recent land use decisions in the vicinity 11 The record includes the documents in File Nos ZE-106-72, ZE-59A-72/ZE-106A-72 and ZE-106B-72 at the time of t.he public heanng, the documents submitted at the public heanng, the letter dated 6-15-01 from Fire Distnct No l, the letter dated July 6, 2001 from the Heanng Examiner to Frank Carpenter, and the items taken notice of by the Examiner 12 The site is 3 27 acres in size and is generally flat in topography, except for slopes up to 20% on its northerly portion The property is rectangular in shape, except for a 20-foot wide stnp of land that extends from the northwest corner of the main body of the site west to Farr Road The northerly portion of the site is improved with multi-family dwelling uruts, which are currently occupied The southerly portion of the subject property is improved with multi-family units that are neanng completion, and whlch are currently unoccupied 13 A 50-foot wide nght of way for Woodruff Road abuts the southerly two-tlurds of the site on the east The nght of way connects to Woodruff Road and Sixth Avenue at the southeast corner of the subject property The nght of way is currently un.improved, and is occupied by several pine trees A bluff wrth north-facing slopes up to 20% are found directly north of the nght of way, which features would make it difficult to extend the nght of way further to the north as a public road Woodruff Road extends from the nght of way south to 8" Avenue Sixth Avenue abuts the site on the south 14 In 1977, the site was rezoned to the Mulhple Family Suburban zone, under the now expired County Zoning Ordinance, for the development of no more than 55 garden apartment uruts This was in Plantung File No ZE-106-72 County Engineenng condition # 10 attached to such approval required that the adjoirung nght of way for Woodruff Road be improved to county public road standards 15 In 1977, 7 34 acres of land lying directly west of the site were rezoned to the Multiple Family Suburban zone, under the now expired County Zorung Ordinance, to allow development of no more than 120 apartment uruts Tlus was in Planning File No ZE-59-72 16 Effective January 1, 1991, the zoning of the site, as well as the 7 34 acres involved in File No ZE-59-72, were reclassified to the Urban Residential-22 (LTR-22) zone, pursuant to the Program to Implement the Spokane County Zorung Code Under the terms of the Program to Implement, the conditions of approval attached to the 1972 rezones in File Nos ZE-106-72 and ZE-59-72 continued to apply to the subJect properties See County Resolution No 85-0900 HE Findings, Conclusions and Decision ZE-106B-72 Page 2 / 17 In 1993, a change of conditions was approved for approximately 5 3 acres of land consisting of the site and 1 64 adjacent acres that were part of the rezone site in File No ZE-59- 72 This was in Planning File No ZE-59A-72/ZE-106A-72 The decision approved a revised conceptual site plan for multi-family development of the 5 3 acres under the UR-22 zone, and removed restrictions on building heights and densities imposed by the previous rezones in File Nos ZE-59-72 and ZE-106-72 The decision denied a request to delete County Engineenng condition #10 of the previous rezone in File No ZE-106-72, wluch required that the adjoining nght of way for Woodruff Road be improved to county public road standards 18 The site is designated in the Urban category of the County Generalized Comprehensive Plan The subJect property also lies inside the Aquifer Sensitive Area, Pnonty Sewer Service Area and Urban Impact Area designated by the Generalized Comprehensive Plan 19 The site is located inside the intenm urban growth area boundanes designated by the County pursuant to the State Growth Management Act 20 The County Artenal Road Plan designates 4"' Avenue and Farr Road in the viciruty as a Collector A.rtenal, 8`" Avenue to the south as a Minor Artenal, and Dishman-Mica Road to the west as a Pnricipal Artenal Woodruff Road and 6" Avenue are considered Local Access road 21 The current change of conditions application requests deletion of County Engineenng condrtion #10 imposed by the change of condifiions approved in File Nos ZE-59A-72/ZE-106A- 72 The site plan of record submitted on February 22, 2001 illustrates development of the site under the current change of condrtions The srte plan illustrates a dnveway access to 6u' Avenue and a dnveway access to the adjacent nght of way for Woodruff Road The applicant proposed to pave a pnvate driveway to a width of 25 feet in the adjacent nght of way for access, with parking prohlbited withln the nght of way in order to facilitate emergency access The proposed dnveway is illustrated in a"cla.nfication drawi,ng" dated June 9, 2000 22 The land lying west of the site is improved with multi-family dwellings, under the UR-22 zone 1'he location of housmg unrts on the site plan of record for the current change of conditions is dissunilar to the location of housing ututs illustrated respectively on the site plans of record in File Nos ZE-59-72, ZE-106-72 and ZE-59A-72/ZE-106A-72 Such changes do not appear substantial enough to warrant a separate change of conditions application 23 The land lying east of the site is zoned Urban Residential-3 5(LTR-3 5) and is undeveloped and forested The land lying south of the site across 6' Avenue, and the land lying north of the site, is zoned UR-3 5 and is developed with single-family homes 24 County Engineenng conditions of approval for the proposal authonzed the applicant to locate a paved dnveway with one connection point in the adjacent nght of way, in lieu of improving the nght of way to public road standards The change of condihons does not prevent extension of the subject nght of way to the north as a public road, if found to be necessary in the future HE Findings, Conclusions and Decision ZE-106B-72 Page 3 ~ ~ 25 Fire Distnct 1 conditions of approval for the proposal require the dnveway access to be paved and maintained to a width of 25 feet, with 4"no parking" signs located on erther side of the dnveway spaced approxlmately 50 feet apart, and a sign installed stating that a named towing company will illegally tow vehicles from the parlang lane 26 No opposition to the proposal, as conditioned, was expressed by neighbonng property owners or public agencies The project is compatible with neighbonng land uses 27 The proposal wlll remain subject to the conditions of approval imposed in File No ZE-59A-72/ZE-106A-72, except for the new conditions recommended by public agencies 28 The site and the adjacent 1 64 adjacent acres involved in File No ZE-59A-72/ZE-106A-72 has adequate vehicular access to the County road system, via 6" Avenue, Woodruff Road and Sunderland Road 29 The proposal, as conditioned, will not have a significant impact on the environment or impact neighbonng properties The DNS issued for the project is appropnate 30 The Staff Report adequately analyzes the consistency of the project with the Comprehensive Plan, the development standards of the UR-22 zone, and the change of conditions approved in File No ZE-59A-72/ZE-106A-72 Such analysis is hereby adopted and incorporated by reference as findings of fact herein Based on the above findings of fact, the Hearing Examiner enters the following II CONCLUSIONS OF LAW 1 The proposed change of conditions, as conditioned, generally conforms to the Comprehensive Plan 2 The applicant has established that the changed conditions bears a substantial relationship to, and/or will not be detnmental to, the public health, safety or welfare 3 The procedural requirements of the State Environmental Policy Act and the County's Local Environmental Ordulance have been met 4 The proposal, as conditioned, complies with the UR-22 zone, the County Zoning Code, and other applicable development regulations 5 The proposed rezone meets the cntena established in Section 14 504 040 of the County Zorung Code for a change of conditions application 6 Approval of the land use application is appropnate under the cntena established for the approval of land use applications in Section 11 of the County Heanng Examiner Ordinance, adopted by County Resolution No 96-0171 HE Findings, Conclusions and Decision ZE-106B-72 Page 4 / III. DECISION Based on the Findings of Fact and Conclusions of Law above, the above application for a change of conditions application is hereby approved, subject to the conditions of the vanous public agencies specified below Any changes to pubic agency conditions added or significantly altered by the Examiner are ctalictzed Failure to comply with the conditions of tlus approval may result in revocation of this approval by the Heanng Examiner This approval does not wasve the applicant's obligation to comply with all other requirements of other agencies withjunsdiction over land development SPOKANE COUNTY DIVISION OF PLANNING 1 All condihons unposed by the Heanng Examiner shall be binding on the "Applicant," whlch term shall include the owner, developers and users of the property, and their heirs, assigns and successors 2 The Change in Conditions applies only to the site, which is legally descnbed as "The East 278 feet of the North 547 feet of the South 1,155 feet of the SE '/4 of the NW '/4, and the North 20 feet of the West 382 feet of the East 660 feet of the South 1,155 feet of the SE '/4 of the NW '/4, of Section 20, Townshlp 25N, Range 44 EWM, Spokane County Washington, Except county nghts of way " The site is currently referenced as County Assessor's tax parcel nos 45202 9068 and 45202 9069 3 The site shall be developed substantially in accordance with the site plan of record submitted on February 22, 2001, subject to compliance with conditions of approval and development regulations Minor vanations may be pernutted admirustratively by the County Division of Planning, in accordance with Section 14 504 040 of the County Zorung Code All other variations must be approved through the submittal of a change of conditions application, for approval by the Hearing Examiner after a public heanng 4 Approval is required by the Planning Director/designee of a specific hghting and signulg plan for the descnbed property pnor to the release of any building permits 5 Direct light from any extenor area lighting fixture shall not extend over the property boundary 6 The improvement of Woodruff Road shall be consistent with Spokane County Dnveway Standards, County Division Building and Code Enforcement Bulletin B-17 The parking of vehicles is prohibited within the nght of way 7 The Division of Planning shall prepare and record with the Spokane County Auditor a Title Nohce, wluch notes that the srte is subject to a vanety of special conditions imposed as a resu0lt of approval of a land use action T'he Trtle Notice shall serve as public notice of the conditions of HE Findings, Conclusions and Decision ZE-106B-72 Page 5 t approval affecting the property in question The Title Notice should be recorded within the same time frame as allowed for an appeal and shall only be released, in full or in part, by the Division of Planning The Title Notice shall generally provide as follows "The parcel of property legally descnbed as `The East 278 feet of 20, Township 25N, Range 44 EWM, Spokane County Washington, Except county nghts of way', is the subject of a land use action by the Spokane County Heanng Examiner on August 16, 2001, in Plaruung File No ZE-106B-72, imposing a vanety of special development conditions File No ZE-106B-72 is available for inspechon and copying in the Spokane County Division of Planxung " 8 The Division of Planning shall file with the Spokane County Auditor, within the same time frame as allowed for an appeal from the Heanng Examiner's decision, including lapsing of the appeal penod, a Title Notice, which shall generally provide as follows "Pnor to the issuance of any building pernut for any building or any use on the property described herein, the applicant shall be responsible for complying with the provisions of the Zoning Code for Spokane County, Section 14 706 (Aquifer Sensitive Area Overlay Zone) The property wluch is the subject of this notice is more particularly descrrbed as follows `The East 278 feet of the North 547 feet of the South 1,155 feet of the SE '/4 of the NW '/4, and the North 20 feet of the West 382 feet of the East 660 feet of the South 1,155 feet of the SE '/4 of the NW '/4, of Sectlon 20, Township 25N, Range 44 EWM, Spokane County Waslungton, Except county nghts of way " SPOKANE COUNTY DIVISION OF BUILDING AND CODE ENFORCEMENT 1 The applicant should contact the Division of Building and Code Enforcement at the eaxliest possible stage in order to be informed of code requirements admirustered/enforced as authonzed by the state Building Code Act Design/development concerns include addressing, fire apparatus access roads, fire hydrant flow, approved water systems, building accessibility, construction type, occupancy classification, existing extenor wall protection and energy code requirements SPOKANE COUNTY DIVISION OF ENGINEERING AND ROADS Pnor to release of a building perrmit or use of properiy as proposed, the following conditions shall be complied with 1 The County Engineer has designated a Local Access Roadway Section for the improvement of Woodruff Road, which is adjacent to the proposed development This will require the addition of approximately 30 feet of asphalt along the frontage of the development Curbing and sidewalk must also be constructed Note In lieu of the above stated road improvements, the County Engineer will allow for the location of a paved dnveway with one connechon point to the multi-family units The applicant shall submit drainage plans for the dnveway to be reviewed and accepted by the County Engineer pnor to construction Spokane County will not maintain the dnveway, HE Findings, Conclusions and Decision ZE-106B-72 Page 6 I therefore, the applicant shall sign and record a"Spokane County Notice to the Public No 4" which allows for the construction and maintenance of a dnveway in the public nght-of-way Any additional access to the Woodruff Road Right-of-Way is prohibited until such time as authonzed by the County Engineer 3 Roadway standards, typical roadway sections and drainage plan requirements are found in Spokane County Resolutton No 99-0265 as amended and are applicable to this proposal 4 The applicant is advised that there may exist utilities either underground or overhead affecting the applicant's property, including property to be dedicated or set aside future acquisition Spokane County will assume no financial obligation for adjustments or relocation regarding these utilities The applicant should contact the applicable utilities regarding responsibility for adjustment or relocation costs and to make arrangements for any necessary work 5 All other County Engineenng conditions of approval imposed in County Plan.ning File No ZE-59A-72/ZE-106A-72 shall be complied with, except for County Engineenng Condition Nos 10 and 13, which are replaced by the conditions herein SPOKANE REGIONAL HEALTH DISTRICT 1 The sewage disposal method shall be as authonzed by the Director of Utilities, Spokane County 2 Water service shall be coordinated through the Director of Utilities, Spokane County 3 Water service shall be by an existing public water supply when approved by the Regional Engineer (Spokane), State Department of Health 4 A public sewer system will be made available for the project and individual service will be provided Use of individual on-site sewage disposal systems shall not be authonzed 5 The use of pnvate wells and water systems is prohibited SPOKANE COUNTY DIVISION OF UTILITIES 1 A wet (live) sewer connection to the area-wide public sewer system shall be constructed A sewer connection permit is required Commercial developments shall submit histoncal andlor estimated water usage pnor to the issuance of the connection permit in order to establish sewer fees 2 The applicant shall submit expressly to Spokane County Division of Utilities, "under separate cover", only those plan sheets showing sewer plans and specifications for the public sewer connections and facilities for review and approval Commercial and institutional developments shall submit lustoncal and/or estimated water usage as part of the sewer plan submittal HE Findings, Conclusions and Decision ZE-106B-72 Page 7 3 Sewer plans acceptable to the Division of Utilities shall be submitted prior to the issuance of the sewer construction permit 4 Arrangements for payment of applicable sewer charges must be made pnor to issuance of sewer connection permit Sewer charges may include special connection charges and general facilities charges Charges may be substantial depending upon the nature of the development 5 Any water service for this project shall be provided in accordance with the Coordinated Water System Plan for Spokane County, as amended 6 See memorandum dated March 14, 2001 from County Stormwater Utility SPOKANE COUNTY AIR POLLUTION CONTROL AUTHORITY 1 All applicable air pollution regulations must be met SPOKANE VALLEY FIRE DEPARTMENT 1 Fire District 1 will allow the secondary access to this development within the Woodruff Road right of way to be built to the dnveway standard, including maintenance of a paved width of 25 feet 2 Four (4) "No Parking" signs shall be located on either side of the pnvate lane, with each sign placed approximately 50 feet apart A sign shall be placed indicating that a named towing company will tow June 13, 2001 Public Heanng 4 The Change of Condition application requests modification of the original condition of approval to allow the construction of Woodruff Road to County driveway standards The applicant states in the application that Woodruff Road north of 6`h Avenue is currently a dead end street right-of-way Due to topographical constraints, i e an estimated 20% slope at the north terminus of the subject right-of-way, makes extension of Woodruff Road physicaily unlikely and possibly cost prohibitive for the County The right of way ends at a bluff and a road extension of any kind to the north would require going through existing homes The applicant states further that constructing the proposed driveway will aid emergency vehicular access and reduce everyday vehicular traffic access through the Village and Woodruff Apartment complexes At the time that ZE-106-72 was approved, the Division of Engineering and Roads assumed that Woodruff Road would be a thru-street connecting 6th Avenue with 4t' Avenue and the Division determined that it was desirable that any improvement of Woodruff Road would be to Spokane County public road standard The connection to 4th Avenue is now not probable as determined by the Division of Engineering and Roads The original site plan approved by the Board of County Commissioners in November 1977, ZE- 106-72, iliustrated two accesses onto 6t' Avenue, but only one access was provided The applicant would like to provide second access (the subject of this application) to the subject parcels in order to provide safe and convenient access for emergency vehicles and for the future occupants of the multifamily complex the northern tax parcel (45202 9068) of the project site In September of 1993 the owners of the subJect parcels applied for a Change of Conditions, file number ZE-106A-72 One change of condition requested by the applicant was to delete the requirement to improve Woodruff Road to Spokane County Public road standard and dedicate it to the County The Hearing Examiner Committee denied this change of condition in its October 1993 decision based on the recommendations of the Division of Engineenng and Roads The Woodruff Road right-of-way was acquired by the County in August of 1974 Staff Analysis The County Comprehensive Plan The project site and adJoining properties are designated Urban by the Spokane County Comprehensive Plan The area surrounding the subject parcels are classified Urban The Urban category is intended to provide a city-like environment which includes various land use, public facilities and services The Goals, ObJectives and Decision Guidelines identified in Section 1(Urban Category) of the Comprehensive Plan are normally used to determine whether a proposal in the Urban category shouid be approved, approved with conditions or denied However, the proposal is essentially a road improvement matter and is analyzed for consistency with the Transportation portion of the Comprehensive Plan, Section 21 Therefore, the below analysis is limited to consideration of the proposed Change-of-Condition regarding the Woodruff Road improvement requirement since this is the only issue under consideration Page 247 of the Comprehensive Plan specifies that the primary function of locai access roads is to provide access to adjacent property They should be designed and located to provide convenient access to residential lots and to discourage continuous or unobstructed flows of traffic through the neighborhood The alignment and traffic control measures should encourage a slow, safe speed Parking lanes, separated sidewalks and street plantings are features that help to make the neighborhood a nicer place to live The improvement of Woodruff Road to County driveway standards will enhance convenient access to the subJect residential parcel The short distance and dead end characteristics of the road should discourage high speeds A parking lane will not be provided to enable emergency vehicles sufficient area to access the northern portion of the multifamily development Type III plantings are proposed adjacent to the west boundary of the subject right-of-way between the road and adjacent multifamily structures located on the subject parcels Sidewalks are not proposed to be constructed ZE-1068-72 Staff Report - June 13, 2001 Public Hearing 5 i , j Page 248 of the Comprehensive Plan specifies that parking lanes are generally desirable on roads designed primarily to provide access to adJacent property, such as local access roads and neighborhood collector arterials Seven-foot parking lanes are adequate for local access roads and eight-foot parking lanes for collector arterials No parking lanes are proposed Fire District No 1 recommends that on-street parking be prohibited to enable unimpeded 24 hours a day access to the subject parcels by its emergency vehicles The proposal is inconsistent with this guideline Provision for a parking lane would hinder access to the srjbJect northern parcel by emergency vehicles Page 248 also specifies that sidewalks provide the primary facilities utilized by pedestrians moving about the urbanized areas of the County Sidewalks help eliminate accidents involving pedestrtans who might otherwise be walking, standing, or playing in the street They are of major importance to elderly and handicapped persons because alternative modes of travel may not be available to them for economic reasons, or due to physical barriers All sidewalks should be a minimum of six feet in width and wider in areas where pedestrian traffic is heavy such as commercial centers and high-density residential areas All planting strips should be a minimum of seven feet except on local access roads The proposal does not include sidewalks but does proposed Type ill landscaping The proposai is partially consistent with this guideline Page 249 of the Comprehensive Plan specifies that street lighting should be provided within the urbanized areas of the County in order to provide for vehicular/pedestrian safety and crime prevention The location of street lights should be within road nght-of-way but clear of sidewalks Street lighting is not proposed The proposal is inconsistent with this guideline Page 260 of the Comprehensive Plan sets forth Local Access Road standards as follows Function To provide access to adJacent residential property Right-of-way width 60 feet Building setback At least 25 feet from right-of-way Width between curbs 36-foot minimum Moving lanes 2 Daily volume Variable Access conditions Intersections at grade with direct access to adJacent property Traffic features Alignment designed to encourage slow, safe speed Traffic control measures as warranted to provide adequate sight distance and safety Planning features Should be designed and located to provide convenient access to residential lots and to encourage continuous or unobstructed flow of traffic from neighborhood to neighborhood collector arterials Through traffic from one neighborhood to another should be discouraged by offset access road alignment at intersections ("T' intersections), circie drives, cul- de-sacs, etc Streetscape Planting strip minimum width is six feet The planting strips should be planted and maintained "208" requirements may result in wider planting strips Sidewalks Six foot minimum width sidewalks should be required on at least one side when the local access road serves as a pedestrian route to schools, parks or shopping Street lighting Street lighting should be provided at intersections and other places as necessary for public safety and crime prevention The proposal is consistent with Local Access Road function, building setback moving lanes, access conditions, traffic features, planning features and streetscape critena above The proposal is inconsistent with nght-of-way width, width between curbs, sidewalks and street lighting criteria above The Division of Engineering and Roads in its comments on this project wili allow the road to be improved to County Driveway Standards with conditions This determination implies that the anticipated daily traffic volume can be accommodated by a"driveway standard" road The ZE-106B-72 Staff Report -
