Members present: Mrs. Carstens, Chairperson; Mrs. Myers and Mr. Odell. Following are the applications in sequence and the action taken by the Committee. If not appealed, these decisions will become final on February 18. 1986. All Find- ings and Order for this hearing were signed on February 6, 1986. 1) ZE-92-85, Residential Office to Corramercial: Narkin Location: Generally located at the southwest corner and northwest corner of lOth and Pines Road in Section 21-25-44. Proposal: Commercial/Office Space (No Site Plan) Action: Approval. (Vote: 3 - 0) 2) ZE-94-85, Multiple Family Suburban to Commercial: Damascus Location: Generally located west of and adjacent to Farr Road, approximately 950 feet south of Sprague avenue in Section 20-25-44. Proposal: Storage Warehouse and Office Building (No Site Plan) Action: Approval. (Yote: 3 - 0) 3) ZW-93-85. INTRODUCTION This matter having come before the Zoning Hearing Examiner Committee on February 6, 1986, and the members of the Committee present being Kathleen M. Carstens, Chairperson, Jane E. Myers and Ron Odell. B. PROPOSAL The sponsor, Nicholas M. Damascus, is requesting approval of a zone reclassification, File No. ZE-94-85. Multiple Family Suburban to Cortrnercial, for the purpose of developing a storage warehouse and office building (No Site Plan). C. FINDINGS OF FACT l. That the existing land use in the area is residential (single family, apartnrents and manufactured horne park Yal l ey Heral d, commerci al , warehousing, roller skating rink and vacant. 2. That.the_Comprehensive Plan designates this area as appropriate for MaJor Comnerci ej devel opment. 3. That the existing zoning of the property described in the application i s Mul i ple Farni 1y Suburban. 4. That the provisions of RCW 43.21C (The State Environmental Policy Act) have been complied with, and the Committee concurs with the Determination of Non-Significance. 5. That the proper legal requirements for advertisement of th? Agenda Item have been fulfilled. 6. That the land in this area is suitable for the proposed use, or uses within the proposed Zone Classification. 7. That the applicant has deiaonstrated that conditions have substantially changed since the original zoning of this area and accordingly, the proposed rezone is justified. 8. That the owners of adjacent lands expressed neither approval nor di sapproval of the proposed use. 10. The Hearing Examiner Committee finds the proposed use to be in harmony with the general purpose and will not be otherwise detrimental to the public health, safety, and welfare. 11. The following are additional findings of fact considered by the Hearing Examiner Committee: a) The proposed zone change will encourage orderly development of the si te and vici ni ty. D. CONDITIONS OR CONTINGENCIES APPLIED TO THIS APPROVAL (All Conditions imposed by the Zoning Hearing Examiner Conmittee shall be binding on the "Applicant:, which term shall include the owner or owners of the property, heirs, assi gns, and successors. ) 1. Amend Planning Condition #13 to read as follows: "That the 5-foot landscape strip along the north and west property ~ lines be planted and maintained in a dense landscape screen which is a minimum of 6-feet in height at installation." 2. Delete Buiading and Safety Department Condition #4•as follows: . ~ 'ODue to the sertsitive storage requirements over the Aquifer, and this site lies within the Waste Water Management area, we feel that some language should address the possible storage of flammable or critical materials within these structures." 2 ZONE RECLASSIFICATION N0. ZE-94-85 D. CONDITIONS OR CONTINGENCIES APPLIED TO THIS APPROVAL (continued) a) COUNTY PLANNING DEPARTMENT 1. Approval by the Zoning Administrator of a specific lighting and signing plan for the described property prior to the release of any building permits. 2. A specific landscape plan, planting schedule and provisions for maintenance acceptable to the Spokane County Zoning Administrator shall be submitted with a performance bond for the project prior to release of building permits. Landscaping shall be installed and maintained such that sight distance at access points is not obscured or impaired. , 3. Di rect 1 i ght from any exteri or area 1 i ghti ng fi xture shal l not extend over the property boundary. 4. The specific development plan will be submitted for Planning Department review and approval prior to issuance of building permi ts. 5. All current standards of the Comnercial Zone, as amended, shall be complied with in the development of this site. : 6. - That. the pro3ect i s sub3ect to Secti on 4.16A.050, the Aqui fer Sensitive Area Overlay Zone of the Spokane County Zoning Ordinance, which sets forth various measures for Aquifer protection; specifically, measures dealing with wastewater , disposal;;-spill protection measures, and stormwater runoff. 7. That the present proposal is not detailed enough to determine whether or not the use of or materials stored on the site are in compliance with Chapter 4.16A (Aquifer Sensitive Area Overlay Zone) of the Spokane County Zoning Ordinance. Accordingly, as a condition of approval, the sponsor/applicant shall be required to file with the Spokane County Auditor, within thirty (30) days of the signing of Findings and Order of the final decision in this matter, a"Notice to the Public" which shall provide in material as follows: PRIOR TO THE ISSUANCE OF ANY BUILDING PERMIT OR CERTIFICATE OF OCCUPANCY FOR ANY BUILDING OR ANY USE ON TNE PROPERTY DESCRIBED HEREINAFTER, THE APPLICANT SHALL BE RESPONSI6LE FOR COMPLYIN6 WITH THE PROVISIONS OF SPOKANE COUNTY ZONING ORDINANCE CHAPTER 4.16A (AQUIFER SENSITIVE AREA OVERLAY ZONE). Applicant shall dedicate 10 feet on Farr Road for right-of-way prior to any use of the property. 2. kcess permits for approaches to the County Road System shall be obtained from the Spokane County Engineer. 3. Applicant shall improve Farr Road in a manner consistent with Spokane County TYPICAL roadway section No. 1 minimum paving width Collector Arterial Standard. 4. Applicant shall submit for approval by the Spokane County Engineer road, drainage, and access plans prior to the issuance of a building permit on the property. 4 ZONE RECLASSIFICATION N0. ZE-94-85 b) COUNTY ENGINEERING DEPARTMENT (continued) ' S. The applicant shall submit for approval by the Spokane County Engineer and the Spokane County Health District a detailed combined on-site sewage system plan and surface water disposal plan for the entire project prior to the issuance of any building permit on the property. 6. A parking plan and traffic circulation plan shall be submitted and approved by the Spokane County Engineer prior to the issuance of a building permit on the property. The design, location, and arrangement of parking stalls shall be in accordance with standard traffic engineering practices. Paving or surfacing as approved by the County Engineer, will be required for any portion of the project which is to be occupied or traveled by vehicles. 7. The word "applicant" shall include the owner or owners of the property, his heirs, assigns, and successors. 8. The construction of the road improvements stated herein shall be accomplished as approved by the Spokane County Engineer. 9. Roadway standards, typical roadway sections and drainage plan requirements are found in Spokane Board of County Comnissioners' Resolution No. 80-1592 as amended and are applicable to this proposal. c) COUNTY UTILITIES DEPARTMENT l. Pursuant to Board of County Comnissioners' Resolution No. 80-0418, the use of on-site sewer disposal systems is hereby authorized. This authorization is conditioned on compliance wi th al l rul es and regul ati ons of the Spokane County Heal th District and is further conditioned and subject to specific application approval and issuance of permits by the Health District. 2. The owner(s) or Successor(s) in interest agree to authorize the County to place their name(s) on a petition for the formation of a ULID by petition method pursuant to RCW 36.94 which the petition includes the Owner(s) property and further not to object by the signing of a protest petition against the formation of a ULID by resolution method pursuant to RCW Chapter 36.94 which includes the Owner(s) property. PROVIDED, this condition shall not prohibit the Owner(s) or Successor(s) from objection to any assessment(s) on the property as a result of improvements called for in conjunction with the formation of a ULID by either petition or resolution method under RCW Chapter 36.94. 5 ZONE RECLASSIFICATION N0. ZE-94-85 c) COUNTY UTILITIES DEPARTMENT (continued) 3. Any water service for this project shall be provided in accordance with the Coordinated Water System Plan for Spokane County, as amended. , 4. Each unit shall be double-plumbed for connection to future areawi de col l ecti on systems. 5. Plans and specifications for the double-plumbing are to be reviewed and approved by the Utilities Department prior to septic tank permit application. d) COUNTY HEALTH DISTRICT 1. A combined surface water and sewage disposal detailed plan shall be approved by the Spokane County Engineer and the Spokane County Health District prior to the issuance of any building permit for this project. 2. Sewage disposal method shall be as authoriZed by the Director of Uti 1 i ti es, Spokane County. 3. Subject to specific application approval and issuance of permits by the Health Officer, the use of an on-site sewage disposal system may. be authorized. 4. Water service shall be coordinated through the Director of Uti 1 i ti es, Spokane County. 5. Water ser.vice shall be by an existing public water supply when approved by the Re9ional Engineer (Spokane), State Department of Social and Health Services. 6. Use of private wells and water systems is prohibited. 7. Disposal of sewage effluent beneath paved surfaces is currently prohi bi ted. e) COUNTY BUILDING AND SAFETY DEPARTMENT 1. The site is located in Fire District # 1. 2. Approved numbers or addresses shall be placed on all new and existing buildings in such a position as to be plainly visible and legible from the street or road fronting the property. Said numbers shall contrast with their background. 3. Reclassification of an existing building shall require an application for change of occupancy permit and subsequent inspection for approval. ZONE RECLASSIFICATION N0. ZE-94-85 e) COUNTY BUILDING AND SAFETY DEPARTMENT (continued) 4. Due to the sensitive storage requirements over the Aquifer, and this site lies within the Waste Water Management area, we feel that some language should address the possible storage of flammable or c ritical materialswithin these structures. 5. Trash enclosures shall not be located ad,jacent to combustible construction or underneath windows or nonprotected eaves. 6. 6uilding permits will be required for each structure. 7. A plan for emergency equipment access is required to be submitted prior to any land development. 8. Fire hydrants which meet the fire flow are required to be installed prior to any construction. These hydrants shall be placed so that no portion of the building exterior is more than 175 feet from the hydrant. The bottom of the lowest outlet of the hydrant shall be no less than 18 inches above grade. A water plan showing each fire hydrant (specifying the gallons per minute for each fire hydrant) and meeting the requirements in Chapter 10.04 of the Uniform Fire Code is required prior to construction of the water service. All required fire protection facilities shall be installed and made serviceable prior to and during the time of construction. f) WATER PURVEYOR • 1. Water Purveyor is Modern Electric Water Company, and they will supply the site with adequate water for domestic, fire and i rri gati on uses. g) COUNTY AIR POLLUTION CONTROL AUTHORITY 1. Air pollution regulations require that dust emissions during demolition, excavation and construction projects be controlled. This may require use of water sprays, tarps, sprinklers, or suspension of activity during certain weather conditions. Haul roads should be treated and emissions from the transfer of earthen material must be controlled as well as emissions f rom al l other constructi on rel ated acti vi ti es. 2. Measures must be taken to avoid the deposition of dirt and mud from unpaved surfaces onto paved surfaces. If tracking or spills occur on paved surfaces, measures must be taken immediately to clean these surfaces. 3. All travelled surfaces (ingress, egress, parking areas, access roads) must be paved and kept clean. 7 ZONE RECLASSIFICATION N0. ZE-94-85 g) COUNTY AIR POLLUTION CONTROL AUTHORITY (continued) 4. Some objectionable odors will likely result during the construction phase of the project and from motor vehicles using the site following completion of the project and from occupants of the proposed project. 5. All air pollution regulations must be met. ORDER The Zoning Hearing Examiner Comnittee, pursuant to the aforementioned, finds that the application of Nicholas M. Damascus for a zone reclassification as described in the application should be APPROVED to the COMMERCIAL ZONE. Damascus Proposal: A request to rezone an approximate 43,704 square foot site from Hultiple Family Suburban to Commercial for the purpose of developing a storage warehouse and office building (No Site Plan). Location: The site is generally located west of and ad,jacent to Farr Road, approximately 950 feet south of Sprague Avenue in Section 20-25-44. II. SITE ANALYSIS Comprehensive Plan: MAJOR COMMERCIAL Category - Inside General Sewer Service Area (GSSA) Boundary - Inside Priority Sewer Service Area (PSSA) Boundary - Inside Urban Impact Area (UTA) Boundary This site is adjoined, to the east of Farr Road, by an Urban category; thereby placing the site in a transition area where land use compatibility is a concern. Transitional buffering applications are necessary to provide compatibility. While the area has developed in accordance with the previous zone changes, the 14ultiple Family Suburban zoned areas have remained vacant. Three subsequent zone changes f rom Multiple Fami]y Suburban have occurred, two to Restricted Industrial for mobile fiome repair shops, and one to Commercial which remains undeveloped. Land Use: Existing on SITE: One single family dwelling and open area To the NORTH: Vacant, Valley Herald, commercial _ To the SOUTH: Single family residential, vacant, apartments, manufactured home park To the EAST: Single family residential, open area To the WEST: Mobile home repair shop, warehousing, roller skating rink The area north of 4th Avenue and westerly of the proposal is a mixture of retail and light industrial uses. East of Farr Road are scattered single family dwellings and vacant undeveloped areas. High density manufactured home and apartment developments are iocated south of 4th Avenue. The Valley sewer trunk line lies approximately 300 feet north of the site. SITE ANALYSIS (continued) Site Characteristrics: (continued) Adjoining Streets: Farr Road to the east of the site is a 40-foot County right of way improved with two paved lanes without curbs or sidewalks. The site is predominately flat and occupied by one residential structure. The remainder of the site is vacant. Proposed Buffering Techniques: Recommended is a landscape plan which would be consistent with the specific project proposed. note: - No site plan has been submitted for review by the Zoning Hearing Examiner Committee. Detailed site plan review is recommended to be administrative at the Building Permit stage with guidance from the Comprehensive Plan, Ordinance requirements, conditions - of approval, and other County policies and guidelines. III. SITE DEVELOPMENT RECOMMENDATIONS Bufferinq: Recommend provision of a 5-foot landscape strip consisting of a mix of ~trees, shrubs, and ground cover which is a minimum of 6-feet in height at installation along the north and east property lines. Adjacent Farr Road, a 5-foot landscape strip is recommended and to include a mix of trees and shrubs a minimum of 4-feet in height at installation. It is also recommended that all off-street parking areas (spaces) be located not more than 60-feet from any landscaped area. Si na e: Due to need for transitional buffer, Local Business sign stads are recommended for all development on this site. Circulation/Access: County Engineering is recommending dedication of 10-feet on Farr Road for future right of way. Farr Road and 4th Avenue provide access to multiple family dwellings and manufactured home park to the south, as well as the subject property. Sewa e Dis osal: Interim septic tank and drainfield will be authorized. Doub?e-p um ing is required for connection to future areawide collection systems. Water Supply: Domestic water supply will be provided by Modern Electric Water Company. Critical Materials/Use Activity: Uses on the site will be subject to Aquifer Sensitive Area Overlay Zone standards and will be reviewed for critical materials prior to issuance of a building permit. 0 H ~ ZONE RECLASSIFICATION N0. ZE-94-85 IV. SEPA ENVIRONMENTAL REVIEW An Environmental Checklist was submitted by the sponsor and was reviewed by the County Planning Department. The review considered the specifics of the proposal, other available information, County ordinances, other regulations and laws, possible standard Conditions of Approval, the Generalized Comprehensive Plan, and other County policies and guidelines. The Zoning Administrator has determined that "No probable significant adverse impacts" would result from the proposal being developed and has issued a Determination of Non-Significance ("DNS"). The "DNS" was circulated to eight other agencies of jurisdiction and other agencies/departments affected by the future development for review and comment. The "DNS" comment period ends February 5, 1986, and was advertised 15 calendar days before said date in the newspaper, by letter to ad,jacent property owners within 400 feet of the proposal, and by notice on a sign posted on the proposal site. The Hearing Examiner Committee may consider additional environmental related testimony and the "DNS" at the public hearing. V. PLANNING SUMMARY - This rezone is generally consistent with the Major Commercial category due to its proximity to commercial areas and other Restricted Industrial and Commercial Zones° Conditions of approval requiring transitional buffering techniques consistent with the Comprehensive Plan enhance compatibility with future developments and adjoining residential uses to the east. VI. That the project is subject to Section 4.16A.050, the Aquifer Sensitive Area Overlay Zone of the Spokane County Zoning • Ordinance, which sets forth various measures for Aquifer protection; specifically, measures dealing with wastewater disposal, spill protection measures, and stormwater runoff. 7. That the present proposal is not detailed enough to determine whether or not the use of or materials stored on the site are in , compliance with Chapter 4.16A (Aquifer Sensitive Area Overlay Zone) of the Spokane County Zoning Ordinance. That all off-street parking spaces be located no more than 60-feet from any landscape area. b) COUNTY ENGINEERING DEPARTMENT Prior To The Issuance Of A Building Permit: 1. Applicant shall dedicate 10 feet on Farr Road for right-of-way prior to any use of the property. 2. Access permits for approaches to the County Road System shall be • obtained from the Spokane County Engineer. 3. Applicant shall improve Farr Road in a manner consistent with Spokane County TYPICAL roadway section No. 1 minimum paving width Collector Arterial Standard. 4. Applicant shall submit for approval by the Spokane County Engineer road, drainage, and access plans prior to the issuance of a building permit on the property. 5. The applicant shall submit for approval by the Spokane County Engineer and the Spokane County Health District a detailed combined on-site sewage system plan and surface water disposal plan for the entire project prior to the issuance of any building permit on the property. 6. A parking plan and traffic circulation plan shall be submitted and approved by the Spokane County Engineer prior to the issuance of a building permit on the property. The design, location, and arrangement of parking stalls shall be in accordance with standard traffic engineering practices. Paving or surfacing as approved by the County Engineer, will be required for any portion of the project which is to be occupied or traveled by vehicles. 7. This authoriZation is conditioned on compliance with all rules and regulations of the Spokane County Health ' District and is further conditioned and subject to specific application approval and issuance of permits by the Health District. 2. The owner(s) or Successor(s) in interest agree to authorize the County to place their name(s) on a petition for the formation of a ULID by petition method pursuant to RCW 36.94 which the petition includes the Owner(s) property and further not to object by the signing of a protest petition against the formation of a ULID by resolution method pursuant to RCW Chapter 36.94 which includes the Owner(s) property. PROVIDED, this condition shall not prohibit the Owner(s) or Successor(s) from objection to any assessment(s) on the property as a result of improvements called for in conjunction with the formation of a ULID by either petition or resolution method under RCW Chapter 36.94. . 3. Any water service for this project shall be provided in accordance with the Coordinated Water System Plan for Spokane_ County, as amended. 4. Each unit shall be double-plumbed for connection to future areawide collection systems. 5. ZE-94-85 d) COUNTY HEALTH DISTRICT 1. A combined surface water and sewage disposal detailed plan shall be approved by the Spokane County Engineer and the Spokane County Health District prior to the issuance of any building permi t for thi s'project. 2. Sewage disposal method shall be as authorized by the Director of Utilities, Spokane County. - 3. Subject to specific application approval and issuance of permits by the Health Officer, the use of an on-site sewage disposal system may be authori zed. 4. Water service shall be coordinated through the Director of Utilities, Spokane County. 5. Water service shall be by an existing public water supply when approved by the Regional Engineer (Spokane), State Department of Social and Health Services. 6. Use of private wells and water systems is prohibited. 7. Disposal of sewage effluent beneath paved surfaces is currently prohibited. e) COUNTY BUILDING AND SAFETY DEPARTMENT 1. The site is located in Fire District # 1. 2. Approved numbers or addresses shall be placed on all new and existing buildings in such a position as to be plainly visible and legible from the street or road fronting the property. Said numbers shall contrast with their background. 3. Reclassification of an existing building shall require an application for change of occupancy permit and subsequent inspection for approval. Due to the sensitive storage requirements over tne Aquifer, and this site lies within the Waste Water Management area, we feel that some language should address the possible storage of flammable or critical materialswithin these structures. 5. Trash enclosures shall not be located adjacent to combustible construction or underneath windows or nonprotected eaves. 6. Building permits will be required for each structure. 0 19 ? .S ZONE RECLASSIFICATION N0. ZE-94-85 e) COUNTY BUILDING AND SAFETY DEPARTMENT (continued) 7. A plan for emergency equipment access is required to be submitted prior to any land development. _ 8. Fire hydrants which meet the fire flow are required to be installed prior to any construction. These hy drants shall be placed so that no portion of the building exterior is more than 175 feet f rorn the hy drant. The bottom of the lowest outlet of the hy drant shall be no less than 18 inches above grade. A water plan showing each fire hydrant (specifying the gallons per minute for each fire hydrant) and meeting the requirements in Chapter 10.04 of the Uniform Fire Code is required prior to construction of the water service. All required fire protection facilities shall be installed and made serviceable prior to and during the time of construction. f) WATER PURVEYOR l. Water Purveyor is Modern Electric Water Company, and tney will supply the site with adequate water for domestic, fire and irrigation uses. g) COUNTY AIR POLLUTION CONTROL AUTHORITY 1. Air pollution regulations require that dust emissions during demolition, excavation and construction projects be controlled. This may require use of water sprays, tarps, sprinklers, or suspension of activity during certain weather conditions. Haul roads should be treated and emissions from the transfer of earthen material must be controlled as well as emissions from all other construction related activities. 2. Measures must be taken to avoid the deposition of dirt and mud from unpaved surfaces onto paved surfaces. If tracking or spills occur on paved surfaces, measures must be taken immediately to clean these surfaces. 3. Al1 travelled surfaces (ingress, egress, parking areas, access roads) must be paved and kept clean. 4. Some objectionable odors will likely result during the construction phase of the project and from motor vehicles using the site following completion of the project and from occupants of the proposed project. 5.
