INTItODtJCTION
This matter bas come before the Hearing Examiner Committee on June 27, 1991,
1991. The members- of the Cornmittee preseat aze Phil Han-is, Chairperson, Verona
Sourhem and Jane Myers. ,
PItOPOSAL
The sponsor, LDS Church,,requests approval of Rezone No. ZE-21-91; Zone
Reclassification from Urban Residential-3.5 (UR-3.5) to Urban Residential-12 (UR-
12) with a variance request File No. VE-1=1-91 to allow a(private) school on 50 feet
of-frontage wbereas the Zoni.ag Code requires 60 feet of frontage.
FINDINGS OlF FACT A1VD CONCLUSIONS ,
1. The property is generally located along the west side of Herald Street and
approximately 50 feet north of lOth Avenue.in Section 20, Township 25 N., Range
44 EWM, Spokane County, Washington..
2. The committee adopts the Planning Department Report as a part of this rzcord.
3. The existing land use in the area au-e single family residential and a public high school.
4. The Comprehensive Plan designates this site as Urban. The Urban category is for the
purpose of r+esidential development, includirag residential densities of 1 unit per acre
to 17 units per acre.
5. The Arterial Road Plan designates Herald Street as a Collector arterial, with a
recommended right of way width of 70 feet and an existing 60 foot right of way. The
County Engineer has recommended a S foot Future Acquisition Area.
6. The exisring zoning of the property described in the application is Urban Residential-
3.5 (UR-3.5), previously established in 1991.
7. The provisions of_RCW 43.21C ('The State Environmental Policy Act) have beea
complied with and a Deternunation of Nonsignificance was issued.
8. The legal requirements for public notice have been fulfilled.
9. The owners of adjacent lands expressed neither,approval nor disapproval of the
proposeti use.
10. The proposed use is compatible with existing uses in the area.
11. The proposed zoning dces implement and conform to the Comprehensive Plan.

originai zaning af this area and accordingly, the proposed zane xeclassificatian is
justified.

a. The proposed private schaol for religious education will not adaersly impaet the
predaminately single fa,mily neighborhood due to existi.ng activities heid at
University High Schovi.
b. The requested variances are appmpriate to allow the groposed uses Maintaining
the residential character of the site w11I lessen the aeed for buffering far adjacent
uses.
c. 5tudents will walk to class from University High School which reduces the need
for parking.

"Applicant", which term shall include the owner or owners of the property, heirs,
assigns and successors.

6. The proposal shall comply with the Urban Residential-12 (UR-12) zone as
amended.
7. The applicant shall develop subject property in generral conformance with the site
plan and testimony presented to the Hearing B"ody on June 27, 1991. All aspects of
the concept and proposal shall be bindi.ng on the development, including proposed
u5e. Minor exterior alterations and/or variations requireci to ineet reguladons and
conditions of approval shall require approval of the `Plarming Director/designee.
Other modificaaons shall be presented to the Hearing Body for review and
- approval.
8. The Spokane Counry Planning Depamnent shall prepare and r+ecord with the
County Auditor a Tide Notice specifying a futune land acquisition area for road
right of-way and utilities. The reserveci future acquisition area Title Notice shall be
released, ia full or in part, by the Planning Department. The notice shonld be
recorded within the sanle time frame as an appeal and shall_ provide the following:
a. At least S feet of resenred future acquisition area for road rigfit-of-way and
utilities, in addition to the existing rigbt-of-way alon'g Herald Street.
b. Future builciing and other setbacks required by the Spokane County Zoning
Code shall be measured from the reserved futlue acquisidon area.
c. No requireci landscaping, parking, '208' areas, drainf'ield or allowed signs
should be locaied within the future acquisidon area for road right-of--way and
utilities. If -any of the above improvements are made within this area, they
shall be relocated at the applicant's expense when roadway improvements are
made.
d. The future acquisition area, until acquired, shall be private property, and may
be used as allowed in the zone, except that any improvements (such as
landscaping, parlang, surface drainage, drainfield, signs or others) shall be
consideTed interim uses.
9. The Planning Department shall prepare and record with the Spokane County
Aud.itor a Title Notice -nating that the property in question is subject to a vanety of
special conditions imposed as a result of approval of a land use action. This Title
Notice shall serve as public notice of the conditions of approval affecting the
property in quesaon. The Tide Notice should be recorded within the same rime
frame as allowed for an appeal and shall only be released, in full or in part, by 'the
Planning Deparnnent. The T-itle Notice shall generally provide as follows:

Spokane County Engineer. ne design, location and arran.gement uf parking stalls
shall be in amorclance with standaxd traffic eng,ineering practices. Paving or
surfacing as approwed by the County Engineer, will be zequired fvr any gortion af
the project which is to be accupied ar traveleri by vetucles.
5. To construct the roadway improvements stated herein, the applicant may, with the
appmval of the Gaunty Engineer, join in and be wiRing to participate in any
petition ar resolution which purpose is the farmatinn of a Road Xmprnvement
District (R1D) for said imgnovement, pursuant to RCW 36.$8, as amended.

6. As an aIternative methvd of consmacting the rvad impravements stated herein, the
agplica.nt may, with the approval af the County Engineer, accamplish the raad
imgmvements stated herein by joining and parficipating in a Cauncy Road Project
(CF..F) tv the extent of the reqnired impravement. Spokane Counry wiil not
garticipate in the cost of these impravernents. This is agplicable ta Herald Street.
7. The constructian of the raad improvements stated herein shall be accomplish+ed as
approved by the Spokane Covnty Engineer.
8. The GQUnty Engineer has designated Typical Raadway Sectian Number Two,
collector Arteial stand,ard fvr the improvement of Herald Avenue, which is adjacent
to the proposad development. This will require the additian of apprvximately 14-12
feet of aspbalt along the frontage af the development. The construetion of curbi.ng
and sidewalk is also xequired.

9. All required 'unprovements shall conform to the curnent State of Washington
Standard Specifications for Road and Bridge Construction and other applicable
County standards and/or adopted resolutions pertaining to Road Standards and
Stormwater Management in effect at the date of cons-truction, unless otherrwise
approved by the County Engineer. 10. Applicant shall construct a paved and delineated approach(es) to meet the existing
pavement on Herald Avenue.
11. Roadway standards, typical roadway sections and drainage plan requirements are
found ia Spokane Board of County Commissioners Resoludon.No. 80-1592 as
amended and are applicable to this propvsal.
12. This subdivision or development proposal is located within a drainage basin which
has been identified by the Spokane County Engineer`s office as having stormwater
runoff problems. Since this glat or development proposal is affected by or is a
contributor to stormwater flows, property owners,should participate in the planning
and implementation of a future basinwide stormwater management system.
The owner(s) or successor(s) in interest agnee to join in any County-approved
stonnwater management program and to pay sucti rates and charges as may be fixed
through public hearings for service or benefit obtained by the planning, design,
constructing, ma.intaining ar operation of stonnwater control facilities.
13. No construction work shall be performed within the existing or proposed public
right-of-way until a petmit has been issued by the County Engineer. All work
within the public road right-of-way is subject to inspection and approval by the
County Engineer.
14. Applicant shall sign and record Spokane County Notice to the Public No. 6 which
specifies the following:
The owner(s) or,successor(s) in interest agree to authorize the County to place their
name(s) on a petition for the fonnation of a Road Improvement District (RID) by
the petition method pursuant to Chapter 36.88 RCW, which petition includes the
awaer(s) property, and further not to object, by the signing of a ballot, the
fornaadon of a RID by the resolution method- pursuant to'Chapter 36.88 RCW,
which resolution includes the owner(s) property. If an RID is formed by eiiher the
pedtion or resolution methocl, as provided for in Chapter 36.88 RCW, the awnei(s)
or successor(s) furcher agree:
(a) that the improvement or construction contemplated within the proposed RID is
feasible;
(b) that the benefits to be derived firom the-formation of tlie RID by the property
included therein, together with the amount of any County participation,
exceeds the cost and expense of'formation of the RID; and
(c) that the property withi.n the proposed RID is sufficiendy developed.
Provided further_that the owner(s) or successor(s) shall retain the right, as
authorized under RCW 36.88.090, to object to any assessment on,the property as a

result of the improvements called for in conjunction with the fonnation of the RID
by either petition or resolution method under Chapter 36.88 RCW.
This requirement applies to Herald Stre.et, from which the subject parcel takes
access.
15. The County Arterial Road Plan identifies Herald Aveaue as a Collector arterial. The
existing right-of-way width of 60 feet is not consistent with, that specifi'ed in the
Plan. In order to implement the Arterial Road Plan, in addition to the required
right-of-way dedication, a strip of property 5 feain width along the Herald Avenue
frontage shall be set aside in reserve. This property may be acquired by Spokane
County at the,time when arterial improvements are made to Herald Avenue.
16. There may exist utilities, either underground or overhead, affecting the subject
property, includi.ng property to be dedicated or set aside for future acquisition.
Spokane County assumes no financial obligation for adjustrnents or relocation
regarding these utilities. Applicant(s) should check with the applicable utility
_purveyor and the Spokane County Engineer to detennine whether applicant(s) or
the utility is,responsible for adjustment or relocation costs and to make
an angements for any necessary work. i

1. Sewerage faciliaes are not affected by this pmposal; therefore, no recommendation.
SPQKANE COUNTY HEAI:TH DISTRICT
1. Sewage disposal method shall be as authorized by the Director of Utilities, Spokane
County.
2. Water service shall be coondinated through the Director of Utilities, Spokane
County.
3. Wacer senrice shall be by an existing public water supply when approved by the
Regional Engineer (Spokane), State Department of Health.
4. Disposal of sewage effluent beneath paved surfaces is currendy prohibited.
5. Subject to specific application approval and issuance of permits by the health
officer, the use of (an) individual on-site sewage disposal system(s) may be
authorized. Note: The existing on-site sewage disposal system can be utilized to
serve the seminary based on the number of students and staff stated in the
application for zoning reclassification.
SPOKANE CUUNTY BUILDING AND SAFETY DEPAItT1VIEN'I'
1. The applicant shall contact the Departiment of Building and Safety at the earliest
possible stage of design/development in order to, be informed of code requirements
administered/enforced by the department, e.g., StateBuild.ing Code Act

regulations, such as requirements for fire hydrant/flow, fire apparatus access roads,
street address- assignment, barrier-free r+egulations, energy code reguladons and
general coordinarion with other aspects of praject implementation.
2. Requirements of Fire District No. 1 need to be satisfied during the building penaiit
process.
SPOKANE COUNTY AIR POLLUTION CON'TItOL AUTHORTTY
11. All air pollution regulations must be met. This includes but is not limited to the
following:
2. Air pollution regulations nequire that dust emissions during demolition, construction
and excavadon projects be controlled. Thismay, require use of water sprays, tarps,
sprinklers or suspension of acrivity during certain weather conditions. Haul roads
should be treated, and emissions from the transfer of earthen material must be
controlled, as well as emissions from all other construction-related activiries.
3. Measures must be taken to avoid the deposition of dirt and mud from unpaved
surfaces onto paved surfaces. If tracking or spills occur on paved surfaces,
meascres must be taken invned.iately to clean these surfaces.
4. All travelled surfaces (ingress, egress, parking areas, access roads), must be paved
and kept clean.
5. Debris generated as a result of this project must be d.isposed of by means other than
burning.
6. Demolition and renovation projects must comply with the requirements of CFR 40,
Part 61, Subpart M. Intent to Demolish and Renovate forms are available at the
SCAPCA office.

1 Application was previously made for a variance to the minimum 4 1/2 acre lot size
for a high school use in an Agriculture-Suburban Zone (AS) Under the previous
AS classification prior the crossover to UR-3 5, high school was a permrtted use.
The variance appiication was withdrawn by the applicant prior to the September
261 1990 hearing for Church reasons not related to the variance application

facing an existing high school There is existing multi-family zoning in the
immediate area, and although not expected to be developed as such, the UR-12

specific purpose of operating a small private junior high/high school. This facility
will operate in conjunction with the existing University High School directiy across
the street as part of a"release-time" program which allows students to take
religious training at this location during selected class periods at University High

The existing house on the site wiil undergo minor alternations to comply with
building codes and to accommodate a single classroom, instructors office, and
workroom Classroom capacity will be approximately 10 to 12 students, and finro
or three classes per school day will be conducted One part-time instructor and
one part time staff assistant wiil use the facility None of the activity normally
associated wrth a large full service high school is intended to take place at the site
school bus traffic, student automobile traffic, outside activity, or large assemblies

1 Application was previousiy made for a variance to the minimum 4 1/2 acre lot size
for a high school use in an Agricufture-Suburban Zone (AS) Under the previous
AS classification prior the crossover to UR-3 5, high school was a permitted use
The variance application was withdrawn by the applicant prior to the September
26, 1990 hearing for Church reasons not related to the variance application
2 The proposed zone classification is consistent with the Comprehensive Plan the
site is situated at the edge of a neighborhood and fronts on a collector arterial
facing an existing high school There is existing multi-family zoning in the
immediate area, and although not expected to be developed as such, the UR-12
zoning would be consistent with what may eventually become a more intensely
used area along the coilector arterial
3 This application is to reclassify the site in question from UR-3 5 to UR-12 for the
specific purpose of operating a small private junior high/high school This facility
will operate in conjunction with the existing University High School directly across
the street as part of a"release-time" program which allows students to take
religious training at this location during selected class periods at University High
School
The existing house on the site witl undergo minor aiternations to comply with
buiiding codes and to accommodate a single classroom, instructors office, and
workroom, Ciassroom capacity will be approximately 10 to 12 students, and two
or three classes per school day will be conducted One part-time instructor and
one part time staff assistant will use the facility None of the activity normaily
associated with a large full service high school is intended to take place at the site
school bus traffic, student automobile traffic, outside activity, or large assemblies
