CnNCI.I1STnNS AND ORDER INTRODUCTION This matter has come before the Hearing Exarniner Committee on February 20, 1992 1'he members of the Committee present are Harry Gibbons, Chairperson, Frank Yuse and Verona Southern PROPOSAL The sponsor, Gary Hite, requests approval of a Zone Reclassificanon, ZE-1-92, from Light Industnal (I-2) to Reglonal Business (B-3) within the Aquifer Sensiave Area (ASA) Overlay Zone. FINDINGS OF FACT AND CONCLUSIONS 1. The property is generally located east of and adjacent to Dishman IVbca road north of Fourth Avenue in the NW 1/4 of Section 20, Township 25 N., Range 44 EWM, Spokane County, Washington. 2. The committee adopts the Plammng Department Report as a part of this record 3 The exishng land uses in the area are commercial, industnal and residential 4 The Comprehensive Plan designates ttus slte as Major Commercial. The Major Commercial category is for the purpose of intensive commercial development, speclfically communiry and regional shopping centers S The Artenal Road Plan designates Dishman-1Vbca Road as a Pnnciple Artenal, with a recommended nght of way width of 100 feet The County Engineer has requested a S foot dedicanon of addhtionai nght of way Fourth Avenue is designated as a Collector Artenal vvith a proposed nght of way width of 70 feet To implement the Plan, the County Engineer has requested a 5 foot future acquisihon area along Fourth Avenue 6 The exisnng zoning of the property descnbed in the applicaaon is Light Industnal (I-2), previously established in 1991 7 The provisions of RCW 43 21C ('The State Envu-onmental Policy Act) have been complied with and a Deternunanon of Nonsignif'icance was issued 8 The legal requuements for public notice have been fulfilled. 9 The owners of adjacent lands expressed neither approval nor disapproval of the proposed use. 10 The proposed zone reclassificanon is compatible vvith existing commercial uses in the area The site contains an existing, developed comr.iercial shopping center - HEC Qrder for ZE-1 i, Page 2 Yi 11. The proposed zoning dces implement and conform to the Comprehensive Plan. 12. The apphcant has demonstrated that conditions have substanrially changed since the onginal zoning of this area and accorduigly, the proposed zone reclassification is jusafied. 13. The proposed zone reclassificanon will not be detrimental to the pubhc health, safety, morals or welfare. 14. The Committee additionally finds/concludes: a The site was developed as a commercial shopping center under the Restricted Industnal (Rn zone of the Spokane County Zoning Ordinance. The zoning redesignation on January 1, 1991 to Light Indusmal (I-2) under the "Program to Implement" the Spokane County Zoning Code impacted this commercial site. Vanations, when approved by the Plannuig Duector/designee, may be pemutted, includulg, but not limited to build.ing locanon, landscape plans and general allowable uses of the pemutted zone. All vanations must conform to regulations set forth in the Spokane County Zoning Caie, and the original intent of the development plans shall be maintained. , 3. Approval is requued by the Planning Du-ector/designee of a specific hghnng and signing plan for the descnbed property pnor to the release of any building permits. ; 4. A specific landscape plan, planting schedule and provlsions for maintenance acceptable to the Planmng D=tor/designee shall be submitted with a performance bond for the project pnor to release of building pernuts. Landscaping shall be ulstalled and maintained so that sight distance at access points is not obscured or impaired 4 5 Direct light from any extenor area hghting fixture shall not extend over the property boundary 6 The Plammng Department shall prepare and record vvith the Spokane County Auditor a Title Notice noting that the property in question is subject to a variety of special conditions imposed as a result of approval of a land use action. This Title Notice shall serve as pubhc notice of the conditions of approval affectuig the property m quesnon. If any of the above unprovements are made within this area, they shall be relocated at the applicant's expense when roadway improvements are made. d. The Planning Department recognizes the non-conforming elements of the existing site improvements and wnll, as provided in the Zoning Code, implement the Regional Business (B-3) standards for any applicarion for change in use or new building pernuts. In order to implement the Artenal Road Plan, in addition to the requued right-of-way dedicaaon, a stnp of property 5 feet in width along the Fourth Avenue frontage shall be set aside in reserve. This property may be acquued by Spokane County at the time when artenal umprovements are made to Fourth Avenue. 9. There may exist utllihes, either underground or overhead, affecting the subject property, including property to be dechcated or set aside for future acquisition Spokane County assumes no financial obhgation for adjustments or relocahon regarding these utihnes. Applicant(s) should check vvith the applicable utihty purveyor and the Spokane County Engineer to deternune whether applicant(s) or the uulity is responsible for adjustment or relocation costs and to make arrangements for any necessary work. SPOKANE COUNTY HEALTH DISTRICT 1.
