This matter has come before the Heanng Examiner Committee on March 18, 1993
The members of the Comrruttee present are Phil Hams, Chairperson, Harry Gibbons
and Jane Myers
PROPOSAL
The sponsor, Mike Schneider, requests approval of a Zone Reclassification, ZE-55-
92, from Light Industnal (1-2) to Regional Business (B-3) zone within the Aquifer
Sensitive Area Overlay zone
FINDINGS OF FACT AND CONCLUSIONS
1 The properry is generally located along the east slde of Uishman-Nbca, approximately
350 feet north of 4th Avenue within the northwest 1/4 0f Section 20, Township 25
N, Range 44 EWM, Spokane County, Washington
2 The comnuttee adopts the 1'lanning Departcnent Report as a part of thls record The
Planning Department has recommended that the proposed rezone be approved subject
to condinons
3 The existing land use(s) in the area are buslness, commercial and industna.l
4 The proposed use rs compatible wlth existing uses in the area
5 The Comprehenslve Plan designates this site as Major Commercial The Major
Commercial category is i.ntended to provide the opportumty for development of
commercial uses
6. The proposed zoning does implement and conform to the Comprehensive Plan
7 The Artenal Road Plan deslgnates Dishman-Mlca as an artenal, wlth a recommended

and kept clean

artenal strip commercial areas will usually be made up of buslnesses or

booth on the site The travel surfaces and parking areas are paved There ls
exishng landsc;aping along Dishman-Mica Road Approximately 220 feet east of
the proposal, on the same paicel, is an exishng vacant building of approximately
30,000 square feet that is not included in this rezone proposal

(RI) zone was designated Light Industnal (I-2) and the Multi-Fanvly Suburban
zone became Urban-Residennal-22, (UR-22) pursuant to the implementation of
the Zomng Code in 1991

significant adverse impacts" would result from the proposal being developed and
issued a Determination of Nonsianificance ("DNS") on December 11, 1992
Thus "DNS" was circulated to 7 other agencies of junsdiction and other
ageneies/departments affected by the future development for review and comment
No comments were received PLu-suant to State Envlronmental Pollcy Act Rules,
WAC 197-11-630, the Planning Department has adopted the Determination of
Nonslanlficance ("DNS") The adopted "DNS" was circulated to 11 other agencies of
