INTRODUCTION
This matter has come before the Hearing Examaner Comrruttee on June 24, 1993
The members of the Comrnittee present are Verona Southern, Chauperson, Frank
Yuse and Harry Gibbons
PROPOSAL
The sponsor, Kenneth Keto, requests approval of ZE-13-93, Zone Reclassificanon
from Urban Residennal-3 5(UR-3 5) to Urban Residential-7 (UR-7) zone wlthin the
Aquifer Sensltive Area (ASA) Overlay Zone for two (2) duplex dwellings or multi-
family uses
FINDZNGS OF FACT AND CONCLUSIONS
1 The property is generally located west of and adjacent to Uruversity Road, approxunately
100 feet north of 8th Avenue within the NE 1/4 of Section 20, Township 25 Norch, Range
44 EWM, Spokane County, Washington
2 The committee adopts the Planning Department Report as a part of this record
3 The existing land uses in the area are single family residences and some duplexes
4 The proposed use is compatible with existing uses in the area
5 The Comprehensive Plan designates this site as Urban The Urban category is for the
purpose of developing a"city-hke" envu-onment, including residential densities of 1
to 17 units per acre, or 5 6 umts per acre for this proposal
6 The proposed zorung does implement and conform to the Comprehensive Plan
7 The Artenal Road Plan designates University Road as a Prulcipal Artenal, with a
xecommended nght of way width of 100 feet
8 The existing zorung of the property descnbed ln the apphcatlon is Urban Resldennal-3 5
(UR-3 5), previously established as Agncultural Suburban zoning ln 1958 and
reclassified to Urba.n Residential-3 5(LTR-3 5) on January 1, 1991 pursuant to the
Program to Implement the Spokane County Zorung Code
9 The provlslons of RCW 43 21C (The State Envuonmental Pohcy Act) have been
comphed with and a Deternunatlon of Nonsignif'icance was issued The Comnuttee,
after independent review, hereby adopts the DNS.

CONDITIONS OR CONTINGENCIES APPLIED TO THIS APPROVAL
1 All Conditions unposed by the Heanng Exan-uner Conmittee shall be binding on the
"Applicant," which term shall mclude the owner or owners of the property, heu-s,
assigns, and successors-in-interest

The South 260 feet of Tract 229 of OPPORT'UNITY, as per plat thereof, recarded in
Volume K of Plats, Page 20, in Spokane County, Washangton, EXCEPT the South
165 feet of the West 132 feet, also EXCEPT the South 150 feet thereof, and also
EXCEPT "BEGINNING at a point on the South llne 22 03 feet Westerly of the
Southeast corner, thence Northerly to a point on the North line 16 63 feet Westerly of

SPOKANE COUNTY PLANNING DEPARTMENT
1 The proposal shall comply with the Urban Residential-7 (UR-7) and Aquifer
Senslnve Area (ASA) Overlay zones as amended
2 The applicant shall develop subject property generally in accordance vvithin the
concept presented to the Heanng Body Vanations, when approved by the
Planning Duector/designee, may be pennitted, includmg, but not luruted to buildhng
locaaon, landscape plans and general allowable uses of the pernutteci zone All
vanahons must conform to regulanons set forth ul the Spokane County Zorung
Code, and the onginal intent of the development plans shall be maintained
3 Duect light from any extenor area hghting fixture shall not extend over the property
boundary
4 The Spokane County Planrung Department shall prepare and record wlth the
County Aud.ltor a Title Notice specifyYng a future land acquisition area for road
nght-of-way and utLhties The reserved future acquisition area Title Nonce shall
only be released, m full or in part, by the Planrung Department. The notice should

Road shall be reserved as future acquisinon area for road right-of-way and
utihties, in addition to the existing and/or newly dedicated nght-of-way along
University Road
b Future building and other setbacks required by the Spokane County Zoning
Code shall be measured from the reserved future acquisition area
c No requu-ed landscaping, parking, '208' areas, drainfield or allowed signs
should be located within the future acquisinon area for road nght-of-way and
utilities If any of the above improvements are made within this area, they
shall be relocated at the appllcant's expense when roadway improvements are
made
d The future acquisition area, unal acquired, shall be pnvate property and may
be used as allowed in the zone, except that any unprovements (such as
landscaping, parking, surface drainage, drainfield, signs or others) shall be
considered intenm uses
5 The Plannmg Department shall prepare and record vvith the Spok,ane County
Auditor a Title Notice notmg that the property in question is subject to a vanery of
special conditions imposed as a result of approval of a land use actxon Thls Title
Notice shall serve as pubhc notice of the conditions of approval affecting the
properry in question The Title Notice should be recorded within the same time
frame as allowed for an appeal and shall only be released, in full or in part, by the
Planning Department The Title Notice shall generally provide as follows

The Owner shall also nonfy any potential purchasers who have made an agreement to
purchase said property that pursuant to the Revlsed Code of Washuigton
(58 17 205), adequate provlsions for school facilities must be made condhtioned on a
future agreement between the "applicant" and school chstnct
Voluntary agreements between the Owner and School Distnct shall confo1m to the

1 Access pemuts for approaches to the county road system shall be obtalned from the
Spokane County Englneer
2 The apphcant shall subrrnt for approval by the Spokane County Engineer, draulage
and access plans
3 A parlang plan and waffic clrculanon plan shall be subrrutted and approved by the
Spokane County Engineer The design, location and arrangement of parking stalls
shall be in accordance with standard traffic engineerulg pracaces Paving or
surfacing as approved by the County Engineer, will be required for any pornon of
the project which is to be occupied or traveled by vehicles
4 The construction of the road unprovements stated herein shall be accomplished as
approved by the Spokane County Engineer
5 All requu-ed unprovements shall conform to the current State of Washington
Standard Specificanons for Road and Bndge Construction and other apphcable
County standards and/or adopted resolutions pertaining to Road Standards and
Stormwater Management in effect at the date of construction, unless otherwise
approved by the County Engineer
6 Applicant shall construct a paved and dehneated approach(s) to meet the existing
pavement on University Road
7 Roadway standards, typical roadway sections and drainage plan requirements are
found ui Spokane Board of County Comnussioners Resolunon No 80-1592 as
amended and are apphcable to this proposal
8 No construcnon work shall be performed within the existing or proposed public
nght-of-way untfl a pernut has been issued by the County Engineer All work

9 The County Artenal Road Plan identifies University Road as a Pnncipal Artenal
The existing nght-of-way width from 46 63 feet to 52 03 feet is not consistent wlth
that specified in the Plan In order to implement the Artenal Road Plan, it is
recommended that, a stnp of property to equa150 feet form centerline in width
along the University Road frontage be set aside in reserve This property may be
acquired by Spokane County at the time when artenal unprovements are made to
University Road
10 There may exist util.ities, either underground or overhead, affecting the subject
property, including property to be dedhcated or set aside for future acquisltion
Spokane County assumes no financial obhgation for adjustrnents or relocation
regard.ing these utilines Apphcant(s) should check vvith the applicable ub.hty
purveyor and the Spokane County Engineer to deternune whether applicant(s) or

controlled, as well as emissions from all other construction-related activlnes
3 All traveled surfaces (ingress, egress, parlang areas, access roads) must be paved
and kept clean

burning ( construction waste, etc )
6 All solid fuel burning devices (wood stoves, pellet stoves, etc ) must comply with
iocal, state, and federal rules and regulations
SPOKANE COUNTY FIRE DISTRICT NO. 1
1 We need to venfy the d.istance of this proposal to existing fire hydrants on the West
side of University One new fire hydrant may be requued pnor to construction
2 We neeci to venfy if there is adequate room to turn around a fire truck at the duplex
on the west

the County Planning Department The review considered the specifics of the
proposal, other available informanon, County ordinances, other regulations and
laws, possible standard Condltions of Approval, the Generalized Comprehensive
Plan, and other Counry pohcies and guidellnes The Planmng Department has
determined that "No probable significant adverse unpacts" would result from the
proposal being developed and has issued a Determinaaon of Nonsienlficance
("DNS
The "DNS" was circulated to 12 other agencies of junsdiction and other
agencies/departments affected by the future development for review and comment
The "DNS" comment penod ends June 22, 1993 and was advertised 15 calendar
days before said date in the newspaper, by letter to adjacent property owners within
400 feet of the proposal, and by notice on a sign posted on the proposal site The
