INTRODUCTION
This matter has come before the Heanng Examiner Commttee on March 21, 1996
The members of the Committee present are Brenda Bodenstein, Chair, Donald
Moore and 1V1ichael Schrader.

The sponsor, Cameron Ball, requests approval of a Zone Reclassification ZE-2-96,
from Urban Residential-3 5(UR-3 5) to Urban Residenaal-12 (UR-12) for
developnlent of 11 multiple family residences and those uses allowed in the Urban
Residential-12 (UR-12) zone
FINDINGS OF FACT AND CONCLUSIONS
1 The property is generally located north of and adjacent to 8th Avenue,
approximately 300 feet west of Felts Road in the NE 1/4 of Section 20, Township
25 North, Range 44 EWM, Spokane County, Washington
2 The Committee adopts the Planning Department Report as a part of this record
3 The exisang land uses in the area include single farmly residences, an apartment
complex and a hnuted number of duplexes
4 The proposed use is not compatible with existing uses m the area
5 The Comprehensive Plan designates this site as Urban Residennal net densities in
the Urban category should have an approximate density of one umt per acre to 17
uruts per acre The proposed Urban Residential-12 (UR-12) zone allows a
maacunum density of 12 uruts per acre which is consistent with the density range
suggested by the Urban category The proposal lies within the Pnonty Sewer
Service Area (PSSA) and is served by pubhc faclhties and services Lncluchng water,
samtary stonn sewer lines, pohce and fire protecnon
6 The proposed zoning does not unplement and conform to the Comprehensive Plan
7 The Artenal Road Plan designates Eighth Avenue is as a Mulor Artenal with a
future nght of way width of 80 feet
8 The existing zoiung of the property described m the applicarion is Urban
Residential-3 5(UR-3 5) prevlously established as Agncultural (A) zomng in 1942
and redesignated to Urban Residential-3 5(UR-3 5) on January 1, 1991 pursuant
to the Program to Implement the Spokane County Zoning Code

comphed with and a Determmation of Nonsignificance (DNS) was issued

1. GENERAL INFORMATION

II. SITE INFORMATION
A. Site Size: Approximately 43,200 square feet
Gross Density Approximately 11 dwelling uruts per acre
B. Comprehensive Plan
1. Land Use Plan• The property is located within the Urban category of the
Spokane County Comprehensive Plan. Residential net densities ui the
Urban category should have an approxunate density of one urut per acre to
17 uruts per acre. The proposed Urban Residential-12 (UR-12) zone allows
a maxunum density of 12 units per acre which is consistent with the density
rang suggested by the Urban category. The proposal lies withm the Pnonry
Sewer Sernce Area (PSSA) and is served by pubhc facihtxes and services
including water, sarutary storm sewer luies, police and fire protection
2. Arterial Road Plan Access to the project will be provided by a
dnveway from 8th Avenue. Eighth Avenue is designated as a Minor

Arterial with a future right of way width of 80 feet, The existing nght of
way width is 30 feet. To implement the arterial road plan, County
Engineering has required that a strip of properry 10 feet in width along 8th
Avenue be set aside as a Future Acquisition Area (FAA).
3. County Parks Plan: The Spokane County Parks and Recreation Plan
idenrifies Dishman Hills as the nearest county parks facility Facihties
include picnic and play areas, ball fields, a lodge, rescrooms and fireplaces.
C. Site C6aracteristics: The site is level, undeveloped and has recently been
logged.
D. Neighborhood Characteristics. The neighborhood in the vicinity of the
project is made up of single fanuly residences, an apartment complex and a
hmited number of duplexes.
E. Zoning Analysis: The subject property and adjoining areas to the north,
south, east and a pornon of the west area, are all zoned Urban Residential-3.5
(UR-3.5). A portion of the west boundary of the parcel lies adjacent to Urban
Residential-22 (UR-22) zonuig. Pnor to implementation of the Spokane County
Zorung Code on January 1, 1991, the subject property and adjacent propernes
were zoned Agncultural (A) and Agncultural Suburban (AS)

established as Agncultural in 1942 (ZE-203-42)

South Urban Residential-3.5 (UR-3.5) estabhshed in 1991, previously
established as Agncultural Suburban (AS) in 1965 (ZE-17-65)
EasL Urban Residential-3.5 (UR-3.5) established in 1991, previously
estabhshed as Agncultural in 1942 (ZE-203-42)
West: Urban Residential-3.5 (UR-3.5) estabhshed in 1991, and Urban
Residenaal-22 (UR-22) established in 1991 previously
established as Multiple Family Suburban (MFS) (ZE-191-79)
F. Land Use Analysis: The zone reclassification proposal is bordered by
single family dwelhngs, undeveloped/vacant land and one duplex (LTrban
Residential-3.5 (UR-3.5) zone). A portion of the adjacent west boundary of the
proposal consists of mula-family dwellings (Urban Residential-22 (UR-22)
zone) which was zoned in 1979 as Multiple Family Suburban (1V1FS) and
crossed over dunng the "Program to Implement" the 1991 Zoning Code. The
MFS zomng occurred pnor to implementaaon of the Comprehensive Land Use
Plan (1981). The proposed zone reclassification from Urban Residential-3 5
(UR-3.5) to Urban Residential-12 (UR-12) is, therefore, not consistent with the
surrounding single family uses and zoning executed after unplementation of the
Comprehensive Land Use Plan.

G. Circulation: The property will be accessed from Sth Avenue by a 150 foot
dnveway from 8th Avenue into the site.
H. Design: A specific site plan was subnutted for review by the Hearing
Exanuner Committee. The proposed site plan includes three muln family
buildings mcluding one m-plex and two four-plexes for a total of eleven units.
Each structure will have a buildmg footprint area of 2,400 square feet and a
height of 22 feet. The proposed site plan illustrates general comphance with the
requirements of the Urban Residenaal-12 (UR-12) zone.

Proposed Buffering/Landscaping Techniques Five (5) feet of
Type III landscaping is required adjacent all Urban Residential-3.5 (UR-3 5)
zoning as well as a 6 foot high site-obscuruig fence, solid landscaping or
wall as requued by Secaon 14.620 365-2 of the Zomng Code. The required
landscaping and fencing is correctly indicated on the site plan on the north,
south, east and west boundanes of the property.
Other Site Plan Considerations: The site plan subnutted for review
by the Hearing Examiner Committee is general ul nature. Detailed review to
deterinine compliance vvith all Code regulations and conditions of approval
is recommended to be administrative and to occur at the Btulding Pernut
stage.
I. Density: The proposed density of approximately eleven dwelling units per acre
is consistent with the density range of the Urban category, but may not be
compatible with adjacent densines
J. Drainage: A dramage plan is required.. This plan must be reviewed and

Counry Division of Budding and Planning The review considered the specifics of
the proposal, other available information, County ordinances, other regulations and
laws, possible standard Conditions of Approval, the Generalized Comprehensrve
Plan, and other County policies and guidehnes The Division of Build.ing and
Planning has deterrmned that "No probable signif'icant adverse unpacts" would result
from the proposal being developed and has issued a Deternunanon of
Nonsignificance ("DNS").
The "DNS" was circulated to 15 other agencies of junschction and other
agencies/deparanents affected by the future development for review and comment.
The "DNS" comment penod ends March 19, 1996 and was advertised 15 calendar
days before said date in the newspaper, by letter to adjacent property owners within
400 feet of the proposal, and by notice on a sign posted on the proposal site. The

I V. DIVISION OF BUILDING AND PLANNING SUMMARY AND
RECOMMENDATION
The Urban category encompasses a vanery of land uses and activities as well as a mix
of mula-family and single family uses. However, when mula-family dwelluigs are to
be located adjacent to single fa.nuly aneas, as the proposal uidicates, careful
consideration must be given to the density and design of the multi-family units so as to
ensure the protecaon of the amenities of the single family area. While landscaping and
fencing can be used in the design of the proposal to screen multi-fa.mily from suigle
family dwellings, the proposed Urban Residential-12 (UR-12) zonmg may be
considered too dense for the surrounding (85%) Urban Residential-3.5 (UR-3.5)
zoning. Even though a limited portion of the proposed Urban Residential-12 (UR-12)
zonuig is bordered by Urban Residential-22 (UR-22) zoning on the west boundary, the
Urban Residenhal-22 (UR-22) zorung was established in 1979, prior to unplementation
of the Comprehensive Land Use Plan (1981). Since the remainder of the adjacent
property is zoned exclusively Urban Residential-3.5 (UR-3.5), the Division of
Buflding and Planning recommends DENLAL of the zone reclassif'ication because the
proposed Urban Residential-12 (UR-12) zoning is not consistent wnth adjacent zonuig
and land uses.
V . CONDITIONS OF APPROVAL

impaired.
6. Duect hght from any extenor area lighting fixture shall not extend over the property
boundary.
7. The Division of Building and Plannmg shall prepare and record with the Spokane
County Audhtor a Tide Notice noting that the property ui quesaon is subject to a
vanety of special condhtions imposed as a result of approval of a land use action.
This Tide Notice shall serve as public notice of the conditions of approval affecting
the property in quesaon. The Title Notice should be recorded within the same time
frame as allowed for an appeal and shall only be released, in full or in part, by the
Division of Building and Planrung. The Tide Notice shall generally provide as

sprinklers or suspension of activity dw-ing certain weather conditions. Haul roads
should be treated, and enussions from the transfer of earthen matenal must be
controlled, as well as emissions from all other construcaon-related acavities.

The following "Conditions of Approval" for the above referenced zone change
are submitted to the Spokane County Planning Department for inclusion in the
Design Review Meeting scheduled January 10, 1996
E36A Prior to issuance of a building permit or at the request of the County Engineer in
conjunction with a County Road Pro3ect/Road Improvement District, whichever comes
first
E36 Applicant shall dedicate S feet on 8th Avenue for right of way
Prior to release of a building permit or use of property as proposed:
E40 Access permits for approaches to the County Road System shall be obtained from the
County Engineer
43 Applicant shall submit for approval by the Spokane County Engineer road, drainage and
access plans
-94A, The applicant shall submit for approval by the Spokane County Engineer and the Spokane
County Health District a detailed combined on-site sewage system plan and surface water
disposal plan for the entire project or portion thereof if the development is phased
-°-°-E45 A parking plan and traffic circulation plan shall be submitted and approved by the
Spokane County Engineer The design, location and arrangement of parking stalls shall
be in accordance with standard engineering practices Paving or surfacing as approved
by the County Engineer will be required for any porta.on of the project which is to be

E46 To construct the roadway improvements stated herein, the applicant may, with the
approval of the County Engineer, Join in and be willing to participate in any petition
or resolution which purpose is the formation of a Road Improvement District (RID) for
said improvement pursuant to RCW 36 88, as amended Spokane County will not participate
in the cost of these improvements This provision is applicable to 8th Avenue
E47 As an alternative method of constructing the road improvements stated herein, the
applicant may, with the approval of the County Engineer, accomplish the road
improvements stated herein by joining and participating in a County Road Project (CRP)
to the extent of the required improvement Spokane County will not participate in the
cost of these improvements This provision is applicable to 8th Avenue
E48 The construction of the roadway improvements stated herein shall be accomplished as
approved by the Spokane County Engineer
E50 The County Engineer has designated a 5 Lane Minor Arterial Roadway Section for the
improvement of 8th Avenue which is ad3acent to the proposed development This will
require the addition of approximately 16-18 feet of asphalt along the frontage of the
development Curbing and sidewalk must also be constructed
E51 All required improvements shall conform to the current State of Washington Standard
Specifications for Road and Bridge construction and other applicable county standards
and/or adopted resolutions pertaining to Road Standards and Stormwater Management in
effect at the date of construction, unless otherwise approved by the County Engineer
E55 Roadway standards, typical roadway sections and drainage plan requirements are found
in Spokane Board of County Commissioners resolution 95-0498 as amended and are
applicable to this proposal
E58 No construction work is to be performed within the existing or proposed right of way
until a permit has been issued by the County Engineer All work within the public road
right of way is subject to inspection and approval by the County Engineer

The owner(s) or successor(s) in interest agree that in consideration of Mutual Benefits
now or to be hereafter derived, do for themselves, their heirs, grantees, assigns and
successor(s) in interest hereby request and authorize Spokane County to include the
above described property in a Road Improvement District (RID) and to support the
formation of a Road Improvement District for improvement of the road(s) described below
by requesting and authorizing Spokane County to place their name(s) on a petition for
the formation of a Road Improvement District pursuant to RCW 36 88 050, or by
requesting and authorizing Spokane County to cast their ballot in favor of a RID being
formed under the resolution method pursuant to RCW 36 88 030, and/or by not filing a
protest against the formation of a RID being formed under the alternative resolution
method provided for in RCW 36 88 065 and Chapter 35 43 RCW
If a RID is proposed for improvement of the road(s) described below, said owner(s) and
successor (s) further agree• (1) that the improvements or construction contemplated
within the proposed RID are feasible and (2) that the benefits to be derived from the
formation of the RID by the property included therein, together with the amount of any
County participation, exceeds the cost and expense of formation of the RID, and (3)
that the property within the proposed RID is sufficiently developed, provided,
themselves, their heirs, grantees, assigns and successor(s) shall retain the right, as
authorized under RCW 36 88 090, to ob3ect to any assessment(s) on the property as a
result of the improvements called for in con3unction with the formation of a RID by
either the petition or resolution method under Chapter 36 88 RCW and to appeal to the
Superior Court the decision of the Board of County Commissioners confirming the final
assessment roll, provided further, it is recognized that actual assessments may vary
from assessment estimate so long as they do not exceed a figure equal to the increased
true and fair value improvement(s) add(s) to the property
It is further acknowledged and agreed that at such time as a,RID is created or any
County Road Improvement project is authorized by Spokane County, the improvements
required shall be at the sole expense of the owner(s) of property within the RID or
served by the improvements without any monetary participation by Spokane County
The RID waiver contained in this agreement shall expire after ten (10) years from the
date of execution below This provision is applicable to 8th Avenue
E61 The County Arterial Road plan identifies 8th Avenue as a 80 foot Minor Arterial The
existing right of way width of 30 feet is not consistent with that specified in The
Plan In order to implement the Arterial Road Plan it is recommended that in addition
to the required right of way dedication, a strip of property 5 feet in width along the
8th Avenue frontage be set aside in reserve This property may be acquired by Spokane
County at the time when Arterial Improvements are made to 8th Avenue
E90 The applicant should be advised that there may exist utilities either underground or
overhead affecting the applicants property, including property to be dedicated or set
aside future acquisition Spokane County will assume no financial obligation for
adjustments or relocation regarding these utilities The applicant should check with
the applicable utilities and Spokane County Engineer to determine whether the applicant
or utility is responsible for adjustment or relocation costs and to make arrangements
for any necessary work
SPECIAL CONDITION The applicant shall grant applicable border easements adjacent to Spokane
County Right of Way per Spokane County Standards
